FODEP asks President Lungu to intervene in matters raised by Nchito

The Foundation for Democratic Process (FODEP) says President Edgar Lungu should quickly intervene in the matter in which the suspended Director of Public Prosecution (DPP), Mutembo Nchito, has questioned the morality of the former chief justices, Ernest Sakala and Matthews Ngulube respectively to sit on a tribunal aimed at probing his alleged misconduct.

FODEP Executive Director MacDonald Chipenzi says the issues being raised by the accused on the duo border on their integrity, as such, unless the duo proves beyond reasonable doubt to the contrary, the tribunal is likely to hit glitches which will stall its progress.

Mr. Chipenzi notes that if care is not taken, the Justice Anniel Silungwe Tribunal may end up like the Judge Lovemore Chikopa Tribunal and the tribunal members likely to suffer public ridicule and embarrassment going by the unfolding events around this tribunal.

He says Zambians are tired of hearing of such tribunals and Commissions of inquiry whose findings have either been ridiculed or not acted upon by the executive after raking the national treasury.

He adds that before Zambians are availed with the findings of the Commission of Inquiry on Energy crisis that hit the country recently, the government has instead choked the citizens with another tribunal to probe the DPP.

The FODEP Executive Director feels that the rescheduling of the tribunal sittings last week demonstrates the point that the tribunal was constituted in haste and for political expedience and unlikely to meet the intended objective.

Mr. Chipenzi says President Lungu has three options to make on this tribunal by either suspending the sittings of the tribunal indefinitely until proper charges are crafted and brought before the accused; remove the two concerned justices, Sakala and Ngulube or disband the tribunal altogether for the sake of progress and before public resources are wasted on an exercise likely to yield no tangible results.

He says for the sake of transparency and accountability, government should disclose how much the two exercises, commission of inquiry on energy and the tribunal on Mutembo Nchito would cost the national treasury.

    • I always wonder what some people are really after. It is indisputable that Mutembo Nchito’s character and behaviour since his appointment as the DPP has failed to live up to the expectations of everyone except the Post Newspaper and Wynter Kabimba. Why then would anyone come to suggest that the proposed tribunal should be halted?
      Mutembo is a Lawyer and will use every letter, word and trick in the legal journals to frustrate the tribunal. That does not make him right and or the tribunal a waste of public resources.
      The proper process and legal provisions have to be followed and in that lies the strength of the protection of the DPP’s office. Not easy to remove but equally never to use the office to protect criminals and criminality.

    • Nchito by levelling allegations on two judges has proved that he had grudge against them and was the cause of creating bad blood. Nchito cannot cry and FODEP cannot support him on that front. What morality Nchito had when he hunted out Mukelabai Mukelabai? What morality he showed telling lies to the Parliament select committee? What morality did he show when entering a Nolle against his financier? What morality did he show when joining as a defence lawyer in criminal case initiated by ex president? what morality he has shown expropriating rental and other income on consficated properties under Task Force? Let the tribunal go ahead and findings made. Let tribunal hear witnesses and let the world know the truth. Name and Shame all, including those from the ruling party that benefitted from

    • Nchito was not the judge in the RB case, he was just the prosecutor. It is the judge who is supposed to be neutral. Nchito is not asking Newton Nguni or Changala to recuse themselves, he is asking the judges who have issues with him because it will be them who will be making the final judgement

ECL is smart and ECL you have done remarkably well in 3 months and against a backdrop of hatred from the Opposition Parties and the relentless hallucinated attacks from the Post Newspaper. They are by default building you up for an easy victory come 2016.

    • Agreed, what goes around comes around. When Mutembo was requested to hand over the prosecution of Rupiah Banda because he was likely to be unfair as he was connected positively to the person that had been sued by Rupiah Banda, he vehemently refused. Well, those that deny justice to others do not deserve it themselves.

    in any case, nchito deserve what he is getting. if anything, he deserves worse.

    • Remember Armsterdam’s “Useful *****s”? Seems to me Chipenzi is one such “Useful *****”, albeit inadvertently, I hope. Perhaps this is one of those occasions when “Silence is Golden”? Macdonald Chipenzi would do well to keep quiet, and the rest of us will not begin to doubt his intelligence, or otherwise! Mutumbo Nchito will use all tricks in the book to delay the tribunal’s proceedings, in the hope that a user-friendly government will assume power in 2016, and discontinue the investigation into his abuse of authority! Anyone, except Chipenzi of course, can see that! Chipenzi /(Chibvuto), please spare us your unsolicited uneducated stance on this matter!   6. Chipenzi sounds like a blunt double-bladed knife. Not long ago he was advocating for the resignation of the DPP to facilitate investigations. Now he is wondering why the DPP has been removed and he would like to recommend judges for the tribunal. It is a given fact that the DPP is involved in the k38bn belonging to taxpayers. It is also a fact that Nchito has been a disgrace to the office of the DPP.
    To Mr Chipenzi, it’s alright to have a dog biting a goat. And when that goat bites the dog? Which way, now, Mr Chipenzi?

    • Chipenzi is ok…..Mutembo is not above the law and he is also not below the law……Give him a fair hearing…..why not.

Did Mutembo know about conflict of intressed when he was prosecuting RB (though legally right but morally wrong) did he know about conflict of intrest when he took over the case of his partner in Crime Mmembe?did he know about conflict of intrest when he entered a Nolle for himself? Has he forgoten what he did to former DPP Mukelebai Mukelebai who died under suspicious circumestances in exile in south africa? Let this F.u.c.k.e.n fat I.DI.O.T reap what he sowed!   8. “Muana Tembo” your spot on, this so called Directors in “FIMOFIMO” are misleading Zambians.
    All those who were condemning Nchito at time of his appointment due to various cases, have now changed and seeing the later as a saint. They are forgetting that this guy has a debit, just recently he was fighting to prosecute RB on behalf of his friend Meembe.

Most of you who blog on tumfweko will know me as i have been very successful in convincing many followers to join the winning team UPND. I am now hoping to do the same here. I know i will face alot of criticism as i did on tumfweko but i can assure you that i will not leave any stone unturned. i can already see a cretin called senior citizen seems to be a lost cause. A party can live only by growing, intolerance of ideas brings it’s death,….an organization that depends upon reproduction only for votes, son taking of the father, is not a political party, but a regional tribe, not citizens brought together by thought and conscience, but a northern tribe held together by blood and prejudice.

    Forward with the case. Raised issues immaterial and completely irrelevant to the Tribunal Case points.

  14. Two wrongs do not make it right. It is not like in maths where you multiply two negative numbers and the answer will be positive. If Mutembo Nchito did not want to recuse himself from the case involving the thief Rupiah Banda it does not give the two discredited retired judges to sit on the tribunal that involve a person who was prosecuting them for various offences or one offence I do not care. The problem in PF everything is eye for an eye, problems are never resolved professionally just like the way the Kwacha is getting mad. Simple things are looked at in a complicated way. The chaps have ransacked state coffers in three years and are borrowing heavily because of stealing money. Kabimba, Miles Sampa, nchito brothers and Chikwanda have money stacked in foreign countries, South america

    In other words you are simpy saying Mutembo should never face a tribunal made up human beings. shame!

  18. If all these allegations against Mutembo are true, did the police investigate them, I am behind in this issue. if yes then its criminal cases. if not then its political nonses.

    RB failed to have Mutembo caged and now he is using EL. be careful EL you may just be digging your gravel.

    Concetrate on improving lives of people who voted for you. How many companies and individuals have borrowed money and failed to pay back, is it mutembo alone.
    Simple civic lessons for all

    These banks including DBZ has assessors for loans, did they not assess the loan application.
    We Zambians worst a lot of time and resources on useless things. what is the problem, politics, hatred, greedy and power at play.

The problem with cadres ,they are always subjectively in their thinking.Issues raised by Nchito are very objective and genuine that must be supported by any right thinking person because that’s the core of our constitution.If the situation of raping our constitution will continue ,i see EL and the group will be answerable one day.They will dance PELETE ask RB or George Mpombo.

    There is nothing honorable about Mutembo. Yes loan was assessed but based on false information he supplied. This is why Judge Mutuna ruled that they got the loan through fraudulent means. Mutembo knew that he did not have capacity to payback but manipulated loan application process and documentation. This is same as obtaining money by false pretense which is fraud. So how can we have a DPP with a fraud record. Be sincere. It is not EL in the dock but Mutembo. This is a court trial but tribunal investigating allegations. It is the nature of the cartel that the police have been ruled out to investigate the matter. Chipenzi is being insincere

  21. Iwe Mcdonald Chimpanzi, whay was your comment when Mutembo was issuing nolles to his friends and creditors? when he was pretending to prosecute mmembe in the RB contempt what did you say? In the latter casemutembo said that it was within his powers as DPP regardless of fairness or being compromised you said nothing, well the tribunal is also within its powers to proceed regardless of what mutembo perceives as unfairness. What is good for the goose is also good for the gander.
    We do not care what that scoundrel mmembe writed in his Past news, what did he say when his friend and business partner was tsking over his contempt case? Look you fo..ol mmembe that was barely six months ago

  22. Useless tribunal

    It does not make sense to constitute a tribunal and then start looking for terms of reference. EL the failure got a lot of filthy support from RB so his dirty hands are tied.Where did RB get the money when prior to bein President, he was just languishing at his dis functional farm recieving handouts from his children?

    All the people who moved the tribunal are in league with the crooked RB whose son cannot even come to Zambia. The whole matter has been handled in a very childish manner

    EL attend to the many challenges Zambia is facing instead of wasting peoples time.

  23. Looking at some of the comments above, I can see that those who have failed to refute Mutembo’s logic have resorted to insults. Let us be objective and answer the issues raised. Someone raised the issue of Mutuna having found Mutembo guilty for the DBZ loan!o Well, unless yu live on the moon, you will know that it was RB who used Mutuna to fix them. Judge Wood was arm twisted out of the case so that Mutuna could fix them. that is why the Supreme Court castigated Mutuna and threw out that case. Selective amnesia?
    By the way, why are you so afraid of an open tribunal? Is it you or Mutembo who has skeletons to hide?
