Human Rights Commission condemns attacks on Tayali

The Human Rights Commission has condemned the harassment of Economic and Equity Party President Chilufya Tayali, by some suspected United Party for National Development sympathizers at the Lusaka Magistrates Court Premises where he had gone for a Court Session yesterday.

The Commission has however commended the Zambia Police Service for their alertness and quick protection of Mr. Tayali from further punishment by guaranteeing him his right to personal security.

Mr. Tayali who was appearing in the Lusaka magistrates court to answer to a complaint of defamation against UPND Leader Hakainde Hichilema to which he pleaded not guilty was beaten by youths alleged to be from the United Party for National Development.

As the people were waiting for Mr. Hichilema to arrive at the court, irate youths pounced on Mr. Tayali who was then rescued by Police Officers who took him to holding cells at the Court.

But the Human Rights Commission says the harassment and roughing up of Mr. Tayali within the court premises, which resulted in tearing up of his jacket, was deeply regrettable and must be condemned as an act of lawlessness that should not be allowed in a democratic country such as Zambia.

“Mr. Tayali had been sued by the UPND President, Mr. Hakainde Hichilema, for alleged criminal defamation and he had lawfully gone to answer to the charges as directed by the court. It was therefore regrettable that he was almost physically manhandled and his clothes torn before the Police rescued him”. Commission spokesperson Mwelwa Muleya said in a statement.

Mr. Muleya said after speaking to some of the eye witnesses, including some UPND sympathisers and Mr. Tayali himself as a victim, the Commission is of the view that the perpetrators of violence against Mr. Tayali exhibited some level of intolerance and lacked self-restraint as expected in a multi-party democracy.

He has since called on all those who may be aggrieved by the alleged utterances and actions of Mr. Tayali to refrain from taking the law into their own hands but exercise patience and allow the law to take its own course.

“Suing the EEP President was one of the civilized forms of redressing grievances in a democracy. To this effect, it is important to allow justice to take its course uninterrupted by any form of human rights violation such as physical, psychological or verbal abuse of either parties and/or their agents or witnesses”, Mr. Muleya added.

He said Mr. Tayali, like any other individual, has the right to equal protection and benefit of the law through the courts of the law adding that the Commission is against any form of breach of law and order such as violence because it has potential to undermine a conducive environment for protection of human rights and freedoms.

    • Condemn the UNELECTABLE and not the foot soldiers. It is behind the unrests in Zambia by being cantankerous. Like a little mule.

    • Tayali is like a village dog which rushes to every home where it hears a sound of someone cleaning a pot. It knows food remnats will be thrown at it for free. Human rights commission it’s good you are doing your job but you must be fair and equally condemn other rights which are being violated such as the brutal force with which the police acted at Unza which lead to the death of a student. And the right to freedom of assembly, the right to protest etc which are being curtailed by the same police force.

    Anyway P.F the paymasters of this maggOt Tayali, via morally bankrupt Antonio Mwanza, will replace that “Cheap Kapenta Suit”.

    It always seeks attention, however if a fly hovers over your food, you don’t take court action, & the same should be for this useless little Oaf.
    In fact not to worry too much,. Antonio Mwanza, via his P.F paymasters, will replace that Cheap Kapenta suit.

  10. I don’t think that anything will come out of the case. The objective of suing was likely to lure the Tayali boy to court so that he can be clobbered so that he stops embarrassing the supreme leader. What defamation????

This is a result that enmanates from low levels of education and low human development index, what we have are just highly emotional illiterate souls whose job is to serve as loose cannons for disgrantled politicians. There is absolutely no need for such an attack. What is the story telling us? the police got the victim and protected him? How about the perpetrator(s)? arrested or what? This is a perfect example where police must use their constitutional power to arrest people and not those just assembling for political reasons.
