Book Review: Do you like to Wear Used or Second hand Underwear?

Introduction

Do you like to wear used or second hand underwear? My answer is that the very thought of my private parts residing in an intimate apparel which had previously housed some other man’s parts, would make my manhood shrink in revulsion.

I would not wear it even if the Ministry of Health had certified the used underwear had been washed in boiling water for 24 hours. Wearing such a used garment would most likely threaten my matrimonial stability as my manhood would go on strike and refuse to fulfill its conjugal obligations. Whatever your answer is, I never knew that there are some men in Zambia, Africa, and probably elsewhere who welcome wearing used or salaula underwear. You may be wondering what wearing used or second hand underwear has to do with the book about anthology of law.

I would not have contemplated let alone been regaled by these thoughts had I completely succumbed to my initial erroneous judgment of the book by its title. Quickly looking at the title amidst the contemporary tidal wave of internet explosion of thousands if not millions of books and other commercial junk that is competing for my attention, I didn’t think the book was for me.

This is because Professor Mwenda is an eminent legal scholar who has a stellar career in the legal profession. He read law at Oxford University as a Rhodes Scholar and has published more than 25 books in the legal field. When I saw an email of the published just hot off of the press, Kenneth Mwenda’s Anthology in Law and the Social Sciences, I assumed if I read the book I would yawn through legalese. When I read the book, I was pleasantry surprised.

Structure of the Book

Kenneth Mwenda’s Anthology in Law and the Social Sciences is one thousand one hundred and eleven pages long of short easy to read articles meant for the non-legal ordinary reader like you and I. The volume is divided into three parts A, B, and C with a total of 88 chapters. Although he calls most of the 88 short articles “chapters”, let that not intimidate you as I was able to read many of the first 25 “chapters” or articles in between watching a boring blow out American “National Basketball Association” (NBA) basketball playoff game in which the San Antonio Spurs trounced the Oklahoma City Thunder 124-92.

The format of the articles is that Prof. Mwenda raises a subject of very high public interest such as “should you wear used underwear”? He includes interesting anecdotes in the stories. Then he skillfully infuses and injects a legal perspective or public law into it. In this way the articles both entertain and educate you, they expose the reader to topics they never thought or knew about, and how the topic may relate to both national and international law.

For example, although I would not want to wear used or second hand underwear, I am not sure I want to stop other people who might make the choice. After all, the famous saying is that “One man’s meat is another man’s poison”. But Zambian law does not think so. “In Zambia, the Inspection and Acceptance Criteria for used Textiles Products (ZS 559:2004) criminalizes the selling or buying of second-hand underwear.” (p. 24) According to the article, other countries such as Zimbabwe and Ghana have passed similar laws prohibiting the sale of second-hand underwear for hygiene reasons.

I would not have known this was even an issue if I had not read Kenneth Mwenda’s Anthology in Law and the Social Sciences. I am assuming some men like myself might have strong views against wearing used underwear. What about women? Would they wear used underwear? Would they wear a second-hand bra?

As I read article after article, Kenneth Mwenda’s Anthology in Law and the Social Sciences did not disappoint me. The first few that I have read include: “Legalizing marijuana: to smoke or not to smoke?” “Working for a lousy boss”, “Does international law permit the searching of a diplomat?” “Can A Christian divorce and remarry?” “Falling in Love with Africa”, “Growing up and moving out of your parent’s home.”

Are You a Patriotic Zambian?

Part B contains many unedited extracts from the media which covers 93 pages of the book. One media story that attracted my interest was “Chileka Man Conceals Ex-Wife’s Private Parts Again” of August 27, 2009.

In Malawi a man used magical powers to conceal his ex-wife’s private parts such that when she wanted to physically consume their love with her new lover, her private parts disappeared to both lovers’ frustration. Of course the Malawian courts got involved. Another article I found interesting was: “Did Kaunda Lead Zambia illegally?”

Part C of the book from Chapter 88 starting at page 915 contains: “Public intellectualism and philosophical inquiry through metaphors and muses”. This segment of the book has well over forty of these metaphors and muses. But Kenneth Mwenda’s Anthology in Law and the Social Sciences had one article that made me shed tears and made me proud of my patriotism as a Zambian was the piece: “A nation that stood tall above others and gave its best to the liberation of Southern Africa from colonial rule and apartheid”. Among us educated Africans being educated and “objective” often means always mercilessly contemptuously tearing apart your own country’s heritage and leaders. This piece spoke volumes about being very proud and positive about our own country both the past and present.

If you are a Zambian you should inscribe this quote in your heart and all the public spaces in Zambia. We don’t beat our chests about it. But we have been and are a great nation.

Mumbi Phiri says Some Senior UPND Members to Defect to PF today

PRESIDENT Lungu is today expected in Chilanga to receive some senior United Party for National Development officials defecting to the Patriotic Front (PF).

PF deputy secretary-general Mumbi Phiri said in an interview yesterday that President Lungu is expected to receive notable UPND officials who will join the ruling party ahead of the August 11 general elections.

And President Lungu yesterday gave Kitwe soccer fans a surprise memorable weekend after paying for their entry to watch a Super Division Week 10 derby between Nkana and Power Dynamos at Nkana Stadium.

The President, who watched the match, urged Zambians to support the local league to supplement the efforts the Football Association of Zambia is making to accelerate the development of the sport.

Lungu said supporting the local league could help clubs to increase their revenue from gate takings to effectively meet their financial obligations.
He expressed happiness at the quality of football both teams displayed in an exciting match that ended 1-1.

“We need to support our local football for it to reach greater heights. I am here to support our local football and I am impressed with the standard of play,” President Lungu said

Meanwhile, President Lungu’s special assistant for press and public relations, Amos Chanda, has dismissed reports alleging that Minister of Chiefs and Traditional Affairs Joseph Katema was yesterday attacked at Woodlands Shopping Mall by some opposition political cadres for using a Government vehicle.

The minister also said in an interview yesterday that he does not use a Government vehicle over the weekend and was not attacked.

Your Seed Determines Your Harvest

Have you ever looked at a large, old tree and wondered how long it has been there? It’s amazing to think that at one point, that gigantic tree was merely a tiny seed. In the same way, our words and actions are seeds. We will always reap a harvest on what we sow.

Think about the types of seeds you have been sowing. Are you sowing encouragement, hope, blessing, love? Then that’s what you’ll reap in the future. But if you’ve been sowing criticism, judgment and anger, you’re probably already reaping a bad harvest. It’s time to start changing your seed.

Today, I encourage you to pray and ask God to help you uproot any negative seeds you may have planted in the past and begin sowing good seeds for your future. As you stay obedient to the Word of God, you’ll see those seeds grow. You’ll rise up higher and enjoy the harvest of blessing God has promised you.

UPND says ZNBC has rejected the Party Adverts, Plans to sue the Public Broadcaster

The opposition UPND has threatened to take legal action against ZNBC for allegedly denying it chance to place political adverts.

UPND spokesperson Charles Kakoma has disclosed in a statement to the media that ZNBC has rejected two of his party’s paid for TV campaign adverts which were to start airing on Monday next week.

Mr. Kakoma said that his party thinks that such censorship is unwarranted and undermines key principles of democracy and freedoms of Zambians, stating that that what ZNBC has done is in fact a clear abrogation of the electoral code of conduct.

Mr. Kakoma said that the UPND is thus consulting with the Electoral Commission of Zambia (ECZ) and will take legal action if necessary to ensure that its adverts are aired by ZNBC.

ZNBC Rejection of UPND TV Ads

ZNBC have rejected two of our paid campaign television advertisements that were to start airing on Monday 16th May, which is the official date for the beginning of campaigns.

This is clearly against the electoral code of conduct and exactly the sort of reason why Zambians wanted cabinet to be dissolved to stop politicians interfering with the operations at these public media institutions and other government agencies in order to advantage themselves in the upcoming elections.

It is not the first time the public broadcaster have done such a thing to the UPND, as they did the same last year when they rejected a paid for non-political advert of UPND President Hakainde Hichilema wishing Zambians a Happy Christmas and Prosperous New Year.

This censorship is unwarranted and undermines key principles of our democracy and our freedoms as Zambians.

So far we have not had any fair coverage on ZNBC and other public media houses funded by taxpayers’ money, and our space for freedoms of assembly, association, and expression has been heavily limited throughout the year.

On the other hand, our competitors in the PF Government have had a free ride on ZNBC making all sorts of accusations, spreading hate speech and derogatory language against us without giving us right to reply.

With denial of our paid for content on ZNBC, it’s clear they will not cover our campaign programmes except on rare occasions.

We have run campaigns under many regimes since the formation of the UPND, and it’s the first time we are ever experiencing such repressive and heavy-handed behaviour that only further highlights the need for Zambians to liberate themselves in August.

We are consulting the Electoral Commission of Zambia and will take legal action if necessary to ensure that our adverts are aired by ZNBC, which claims to be a public broadcaster and is funded by the taxpayer.

Power hold Nkana in Kitwe derby

Nkana fought back from a goal down to draw 1-1 against Power Dynamos in Saturday’s key low Kitwe derby at Nkana Stadium in Wusakile.

Winger Kennedy Mudenda scored for Power with creative midfielder Jacob Ngulube equalising for Nkana.

Power took a 1-0 lead into the half time break after Mudenda had pounced on loose ball before unleashing a powerful shot that penetrated through the Nkana back-line five minutes earlier.

Ngulube levelled on 62 minutes when he turned in a Shadrick Musonda cross from the left wing.

However, Nkana were unlucky to have been denied a wining goal by the cross bar after 74 minutes.

Power were the first ones to create a serious scoring opportunity that saw strike Patson Daka’s 12 minute goal bound shot blocked by Joseph Musonda from the box.

This draw pushes Nkana to 20 points from 8 games played.

Musokotwane counsels the incoming President

Former Finance Minister Situmbeko Musokotwane has observed the need for government to calm the business community after the August 11th general elections.

Dr. Musokotwane is advising whoever will become republican President in August to come out strongly and make an assurance that stability will be sustained in government policy.

In an interview Dr. Musokotwane who served as Cabinet Minister under the MMD government has suggested that the business community both in Zambia and abroad should be assured that the policy inconsistencies that have been witnessed in the last five years will not happen again.

Dr. Musokotwane states that this will also entail that whenever government announces any policy change, going forward, it should be a decision that has been thought through carefully.

He says this is with the view of not giving an impression that government is experimenting.

Dr. Musokotwane says he also expect whoever will become the republican president after this year’s general elections to focus on stabilizing the mining sector.

He says this is besides making the Country’s Agriculture sector competitive to the extent of producing for exports.

President Edgar Lungu has said that he will not respond to all those tabloids and individuals insulting him. Responding Copperbelt minister Mwenya Musenge who had urged the President to deal with some media houses insulting him, the president said that all those insulting him are bitter because the people of ZAMBIA elected him as President.

The President told scores of people who had gathered to welcome him at Simon Mwansa Kapwepwe international airport this morning that the battle at hand is not for him but God.

Mr Musenge told the president that it was unZambian for the Media and people to print hate speech and insults on the President. President Lungu said that they are so many Countries that are still struggling to recover from pain and anguish as a result of hate speech, urging all party members and the nation at large to remain prayerful and peaceful even when provoked beyond measure.

President Lungu further added that he was once legal counsel for a named tabloid but he is not not bothered by their hate speech because God will deal with them.

The president appealed to Copperbelt residents to remain loyal to the ruling PF and deliver the much needed development.

PF copperbelt Chairman Steven Kainga said the PF is ready for the August 11 polls and will get a resounding victory.

The President is on the Copperbelt to officiate at the Baptist Church conference on Sunday afternoon and later watch a football match in Kitwe between Nkana and power dynamos football clubs. The President’s plane touched down at 11:20hrs.

Meanwhile, President Lungu is among hundreds of Baptist Union of Zambia Pastors and elders who have gathered for the leader’s conference at Fiwale mission in Masaiti.

And former Masaiti Member of Parliament Michael Katambo has urged residents to vote for President Lungu in the August 11 polls.

Mr Katambo says President Lungu and the PF Government have done a lot for people of Masaiti to deserve another mandate.

He said the PF have built schools, roads, schools and other infrastructure to better the lives of people in the area.

Mr Katambo was speaking at the Masaiti Fiwale mission Baptist union of Zambia conference for pastors and leaders conference.

He said there’s need for residents in the area to give President Lungu a resounding vote because he is a humble leader with the interests of Zambians at heart.

And in his prayer Reverend Adamson Shamfuti asked God to prevail over the Country’s polls.

Reverend Shamfuti said Zambians must remain peaceful to secure the country’s sovereignty and national development.

The president is accompanied by PF deputy secretary general Mumbi Phiri, his assistant for press Amos Chanda and several other government officials.

Nkana will beat Power – Mweemba

Nkana goalkeeper Charles Mweemba is confident his side will triumph over Power Dynamos in Saturday’s big Kitwe local derby in Wusakile.

Nkana and Power clash in a round ten match of the 2016 FAZ Super Division at 15h00.

“We are pretty sure that we will collect maximum points in tomorrow’s(Saturday) game. The morale in the camp is high,” Mweemba said.

“We are going to approach the game with a very serious altitude as you know Power are our rivals,” he said.

This will be the first instalment of the Kitwe derby in this year’s campaign.

“We have to make sure that we work together. We are taking each and every game seriously. We are going to win the game,” Mweemba added.

Last season, Power beat Nkana 2-1 in the return match after the Wusakile club had won the first round encounter 1-0 at home.

This game is live on SuperSport -kicking off at 15h00.

TBZ to buy less Tobacco from farmers this year

THE TOBACCO of Zambia Board (TBZ) has projected that there will be 1,000 metric tonnes reduction of tobacco to be bought from the farmers during the 2016 tobacco floors in Eastern Province.

TBZ Chief Executive Officer Samson Muyembe disclosed in Chipata yesterday the merchants were expected to buy 6,000 tones compared to 7,000 tones which was bought by the merchants during the last season giving a reduction of 1,000 tones.

Mr Muyembe said this was necessitated due to the dry spell which had hit some parts of the farming community in the province as well as the pulling out from the markets by the two merchants during the 2015 season.

He explained that the pulling out of Alliance One International and Zambia Leaf from the market affected the production of tobacco in the province.

Mr Muyembe explained that some farmers in Zemba area of Chadiza and Lundazi District were affected with the decision by the two companies to pull out from the market.

“We are expecting a reduction of 1,000 metric tones of tobacco during this year’s floors. The merchants are expected to buy 6,000 metric tones while for last year, we had 7,000 metric tones which were purchased by the merchants,” he said.

Mr Muyembe said the merchants that were currently the tobacco from the farmers includes Tombwe Processing Plant Limited, Japan Tobacco International (JTI), Hillside, Sun Bridge, Ross Tobacco Investments and Pemba Leaf respectively.

He said he was hopeful that during this year’s tobacco season would be success.

Government to upgrade sanitation system in Choma

GOVERNMENT will soon embark on a project to upgrade the current water and sanitation system in Choma to cope with the growing demand.

Southern Province permanent secretary Sibanze Simuchoba said this yesterday during the commissioning of the Southern Water and Sewerage Company (SWASCO) K2.7 million water supply project funded by the Devolution Trust Fund (DTF) in Chandamali Township in Choma.

Mr Simuchoba said the government was committed to deliver development to the people of Southern province.

“I know that a much bigger project funded by my government is coming to Choma to upgrade the current water and sanitation system to cope with the growing demand especially that Choma is now a provincial capital,” he said.

He said Chandamali Township had inadequate water supply and unreliable water systems which forced residents to travel longer distances to fetch water.

Following the completion of the water project a total of 29.654 kilometres of water network was laid and a total of 1,900 households were connected and being metered.

SWASCO managing Director Charles Shandaile said the project was executed over a period of 13 months from November 2014 and December 2015.

“This yet another water supply project that SWASCO has successfully completed and now being commissioned,” Mr Shindaile said.

He paid tribute to DTF for the provision of the funds amounting to K2,742, 174 million for the water supply project in Chandamali.

The project was funded to improve the water supply in the per-urban area as well as promote health and hygiene by providing adequate and clean water to the urban poor in Chandamali which has an estimated population of about 11,000.

A representative from DTF Victor Muyeba said water and sanitation supply plays a significant role in the national development.

Mr Muyeba paid tribute to government for fulfilling the pledged commitments to the DTF thereby the financing of the projects.

“We are thankful to the government for the support to the DTF and the sector,” he said.

Chandamali Community representative Godrick Simukonde thanked the government for prioritising infrastructure development in the country.

Mr Simukonde said following the completion of water project the community would be able to access adequate water supply and manage the water bills.

He appealed to his fellow residents to guard the water supply facility network against all forms of vandalism and illegal water connections.

Husband tells court how he discovered that his wife was impregnated by another man

A promiscuous Zingalume woman landed in the local court after her husband discovered that she was pregnant by another man.

This is in a case which Godfrey Mwale, 29, of Matero township sued Esther Chasaya, 26 for divorce. The couple has two children together. Bride price was not paid.

Godfrey told the court that he lost sanity and admitted to the Senior Local Court Magistrate Lewis Mumba that his wife severely deprived him of sex despite the fact they were sharing the same bed and blankets.

The plaintiff added that Chasaya, his wife of five years marriage, was promiscuous and was pregnant for another man. He described his wife as a cantankerous housewife who had miserably distorts his name and managed to ruin their matrimonial home.

“My wife your honour is adulterous and dishonest; she has been cheating on me ever since we got married in Livingstone sometimes in 2010 and now I have no doubt that she is carrying another man’s baby. I can visibly see her stomach growing bigger day by day,” he said.

Further, Mwale revealed that his estranged wife was also in the habit of threatening to take his life. “My wife your honour had on several occasion hired people to stub me with a knife,” he remarked.

“I am afraid now because my wife may succeed in taking my life one day and I don’t want to die now, I still have responsibilities especially looking after my children,” he said.

He alleged that his wife on several occasions packed his belongings and went to her parents without his permission whenever they have misunderstanding.

With tears coming down, Mwale pleaded with the court to dissolve their marriage as his love for Chasaya had grown cold adding that elders are now tired talking about the fate of their marriage every day.

In her defense, Chasaya denied all the allegations levied against her, including carrying a baby for another man.

“I am not pregnant your honour for any man; it’s just that I’m putting in some weight these days. The problem with my husband is that he is always suspicious,” she said.

She also said that she was not promiscuous adding that she has maintained her marital vows towards Mwale.

And when asked why she was organising people to kill her husband, Chasaya laughed at the assertions and described them as false adding that she was not raised to be a murderer.

Chasaya told the court that she was also fed up of living in a relationship with a man who did not care about the well-being of his children and conceded with her husband’s plea for the court to dissolve their marriage.

Passing judgment, Senior Local Court Magistrate Lewis Mumba dismissed claim for divorce because bride price was not paid. “The two of you were just cohabiting,” he said.

United Party for National Development (UPND) president Hakainde Hichilema has challenged President Edgar Lungu to pinpoint successes he has scored during his one and half years he has been in office.

Speaking when he welcomed former MMD members of Parliament who have officially joined the UPND in Lusaka yesterday, Mr Hichilema said that president Lungu has not done anything since he was elected apart from inflicting abject poverty on Zambians.

And Mr. Hichilema has warned that the Electoral Commission of Zambia will be responsible for whatever will happen in the country if it insists I printing ballot papers in Dubai.
And Mr Hichilema has demanded that President Lungu pays students at the University of Zambia all their meal allowances in the next five days.

And former First Lady Maureen Mwanawasa has warned the Electoral Commission of Zambia not to manipulate this year’s election because Zambians are watching.

Securing Our Future

To our men and women in uniform, and other security agencies, we have heard your cries and messages through various forums.

We are fully aware of your plight both in the conditions under which you operate and the numerous challenges you face, including having been promised various incentives that have not been honoured or even withdrawn altogether.

We are equally aware of the many youths that were enlisted for engagements in several units but have remained in the streets because resources have been diverted into luxurious expenditures at the expense of priority issues affecting our people, including in this case both job creation and security.

Our message to you is to please remain loyal and disciplined citizens of this republic as you have always been.

In the coming weeks you will be under the spotlight, as we journey through this critical period in history when our people will decide the destiny of our great nation.

Yours is a call to duty that must be above partisan politics and centre on being ready to protect all citizens regardless of their political affiliation. Remember, regardless of the views we hold we all go to the same shops to buy the same expensive items and experience the same load shedding.

Most importantly, we must keep reminding ourselves that we are one people and must remain so no matter what schemes, rumours and hateful messages are used to try and divide and distract us from the important issues.

Going forward, and as a departure from the usual way of doing things, we are aware that in your private lives you can equally be productive if given support to engage in meaningful business ventures such as farming activities, the small-scale mining industry, tourism and value-addition industries. We believe in the power of such programmes to empower our people and their families so they can secure their future and reap the benefits of hard work.

ZANASU think tank Chairperson Gershom Phiri says those who have been reported to have endorsed the opposition leader have done so in their personal capacities.

Mr Phiri says the association has received reports that some people who are not members of the organization have endorsed the opposition leader.

He said that ZANASU is a non partisan organisation which can only work with the government of the day for the benefit of the public and its bonafide members.

And Mr Phiri has commended President Edgar Lungu for implementing some of the requests his organisation made regarding empowerment of the hearing impaired.

He said it is gratifying to note that more than 50 thousand kwacha was disbursed to the hearing impaired.
