A 27-YEAR-OLD male hair-dresser who had been posing as a woman now faces 15 years in prison after a Mongu magistrate’s court convicted him of sodomy.
The court has committed Hatch Bril of Mongu’s St John’s area to the High Court for sentencing.
Bril, who appeared uneasy during the one hour and 14 minutes judgment, was sued by a 19-year-old taxi driver whom he allegedly permitted to have carnal knowledge with against the order of nature.
The incident occurred on September 24, 2015 around 02:00 hours.
The court heard that Bril deceived the teenager in what was love at first sight in a bar as he was dressed and appeared like a woman on the material day.
Magistrate Derrick Mate Chingumbe said he had no doubt that Bril committed the offence because the evidence given by the teenager to court was overwhelming.
He said the complainant had proved that Bril had allowed him to have carnal knowledge of him, contrary to the convict’s defence that he was forced into the act.
The parked courtroom further heard that the teenager told the court that Bril asked him to turn off the lights before the two engaged in the act.
This was after he proposed love to ‘her’ after a drink-up at a night club.
Mr Chingumbe said the medical report compiled at Lewanika General Hospital indicated that the incident was against the order of nature as Bril had a tear around his anal area.
“Cases such as this one require one to prove whether the accused person did actually permit the other to have carnal knowledge of him, or indeed, if the act was against the order of nature.
“Well, after looking at the evidence on record from the six witnesses that the prosecutors presented, I have concluded that Bril did actually permit the taxi driver to have carnal knowledge of him. In fact, he was made to
believe that he was actually going to sleep with a woman and a woman only because of the way he [Bril] was dressed, and he had long hair,” Mr Chingumbe said.
He granted Bril the right to appeal to the High Court.
The minimum sentence for sodomy is 15 years.

Mr Lungu counselled the miners to avoid being cheated by some power-hungry opposition leaders discrediting Government over the challenges the mining sector is facing.
He said the challenges besetting the mining sector are a result of a drastic fall in copper prices on the international market.
He called on the labour movement in the mining sector to provide the required leadership of championing the interests of the workers and protect them from any form of abuse at their respective companies.
President Lungu was speaking during his familiarisation tour of Konkola Copper Mines’ (KCM) Konkola Deep Mining Project shaft number four.
“I am here to see how you are working and assure you that we will not abandon Zambian mineworkers because of the fall in copper prices. We will make hard decisions going forward, but we’ll not neglect miners. We need to benefit from our minerals. We’re still depending on copper for the growth of our economy.
“We don’t expect mine owners to fire people when prices of copper go down. Minerals should not only benefit foreigners but benefit Zambians as well,” President Lungu said.
He was accompanied by First Lady Esther and State House staff led by his special assistant for press and public relations, Amos Chanda.
The President called for sacrifice from mine owners and workers during these hard times in order to sustain jobs and operations of all the mines.
He said problems in the mining sector should not be politicised and that he would not allow mining firms to hold Government to ransom through retrogressive job cuts and closure of mines.
“We can’t change the price of copper, so mining companies will not be allowed to hold us to ransom by firing workers,” Mr Lungu said.
He said government would remain open to dialogue on matters that could make the sector viable.
Minister of Information and Broadcasting Services Chishimba Kambwili, who was part of President Lungu’s entourage, urged KCM and all mining companies to respect Zambian workers and always avoid throwing them onto the streets whenever the sector encounters temporary setbacks.
“It is not good to throw workers on the street. Business of copper has ups and downs. It is unfair to lay off employees who have contributed to mining companies when the sector is faced with temporary setbacks,” Mr Kambwili said.
KCM chief executive officer Steven Din said his mining company is in Zambia to stay and that it has a 50-year long-term plan which guarantees job security to its workers.
He lauded President Lungu for his visit to KCM and promised to work closely with unions in the sector on matters that could help in making the sector viable.
Minister of Mines and Minerals Development Christopher Yaluma, Copperbelt Minister Mwenya Musenge, Patriotic Front (PF) deputy secretary general Mumbi Phiri and Chililabombwe member of Parliament Esther Banda were among those who accompanied the President on the tour.

LECTURERS and academic staff at the Copperbelt University (CBU) have called off their work boycott.
Copperbelt University Academics Union (CBUAU) president Mwiya Songolo said in a statement released in Kitwe yesterday that the lecturers have decided to resume work for the sake of the institution.
Minister of Higher Education Michael Kaingu on Monday threatened to facilitate the sacking of all the lecturers and academic staff if they did not call off their work boycott by yesterday.
Mr Songolo said: “We have decided to take this decision simply because of the fear of God, who has entrusted us with the responsibility to be stewards for over 10,000 souls who are lovely students.
“It is important for the nation to know that the fear of man has not caused us to rescind our decision but the fear of God,” Mr Songolo said.

FORMER Zambia Congress of Trade Unions (ZCTU) secretary-general Roy Mwaba and two Rainbow Party senior provincial leaders have joined the Patriotic Front (PF), citing good leadership qualities being demonstrated by President Lungu and his administration.
And PF secretary-general Davies Chama has urged party members to embrace new-comers and work extra hard in mobilising the ruling party ahead of the 2016 general elections.
Speaking in Lusaka yesterday after joining the ruling party, Mr Mwaba said he has joined the PF because of its unsurpassed socio-economic programmes that have started uplifting the welfare of people in the country.
“After serious reflections on the political developments taking place in the country, I have finally decided not to sit on the fence and be a spectator but to join the PF party so that I can contribute to the development efforts being made by the PF government.
“I must also emphasise that ever since President Lungu took over leadership of the party, the PF has demonstrated maturity and dynamism by welcoming new-comers who have been joining the party in the past few years,” Mr Mwaba said.
He said after carefully scrutinising the manifestoes of various political parties, he decided to tug along with the PF because the party stands for ideals meant to improve the socio-economic status of Zambians.
Mr Mwaba also said the decision to join the PF is one made in the interest of nation-building and sacrifice to the country.
“The current challenges we are going through as a country demand a clique of leaders who are dedicated and committed to finding solutions under this very trying moment and the PF leadership has ably demonstrated this spirit and needs the support of everyone,” he said.
Rainbow Party Lusaka Province chairperson Mulenga Mwiche and vice-chairperson Stanslus Mambo have also joined the PF.
They said they have joined the ruling party because of President Lungu’s message of love, unity and reconciliation.
“President Lungu is a unifying President we have ever had in Zambia. He has been preaching love, unity and reconciliation and this is what we want as Zambians,” Mr Mwiche said.
Receiving the new members, Mr Chama urged the PF membership to welcome new-comers.
Mr Chama said politics is about numbers and that he is ready to work with both old and new members.
He also said the PF will win the 2016 general elections because of the projects that are currently being initiated and implemented by Government.
Copperbelt Police Commissioner Joyce Kasosa has said ddispelled report by FDD that their President Edith Nawakwi was arrested by the Police in Kitwe. In an Interview with ZNBC, Ms Kasosa said that her officers cautioned the FDD President because she was operating outside the law.
Ms Kasosa said that Ms Nawakwi was holding political meetings in Mulenga compound without authority, adding that as a former lawmaker, Ms Nawakwi knows that the law requires that she notifies the Police before holding political activities.
Yesterday, FDD reported that Police in Kitwe arrested Forum for Democracy and Development (FDD) President Edith Nawakwi for unlawful assembly.
FDD Spokesperson Antonio Mwanza told Qfm News that Ms. Nawakwi was picked up by the police in full riot gear around 12 hours in Mulenga compound in Wusakile constituency where she was meeting one of the FDD chairladies.
Mr Antonia said that Ms Nwakwi was taken to Wusakile Police station where she was detained for almost an hour and later taken to Kitwe Central Police Station.
Mr Mwanza said that Police recorded a warn and caution statement and later released her.
Finance Bank Footprint across Zambia
ATLAS Mara, the parent company of retail bank BancABC says it has inched closer to taking over Zambia’s six largest bank as the group continues with its acquisitive strategy to grow its earnings and expand its foothold in the region.
Atlas Mara, an investment company co-owned by former Barclays Plc chief executive Bob Diamond, last year acquired ABC Holdings — which owns BancABC which has its presence in Botswana, Mozambique, Tanzania, Zambia and Zimbabwe.
Earlier this month, the group said it was looking to expand into seven more countries in sub-Saharan Africa through acquisitions.
Announcing its financial results for the nine months to September where it posted an after tax profit of US$7,1 million, the group said negotiations to acquire total control of Finance Bank of Zambia were at an advanced stage.
The group said the financial performance of the Southern region year-to-date was supported by, among other factors, asset recoveries emanating from continued management efforts, particularly the increased focus on non-performing loans and the establishment of new collections activities.
“The potential transaction is subject to the parties entering into definitive documentation and the subsequent satisfaction of selected conditions precedent (including requisite regulatory approvals). The Company expects that definitive documentation will be signed shortly,” the company said in a statement accompanying the financials.
“Subject to agreeing definitive documentation and the subsequent satisfaction of relevant conditions precedent, Atlas Mara anticipates that it would acquire FBZ for approximately US$60 million in cash and 2.6 million Atlas Mara shares (this may increase to US$61 million and up to 5.7 million Atlas Mara shares, subject to a number of conditions, including the Zambian Kwacha/U.S.
Dollar exchange rate at closing and the meeting of specific future profitability targets). Subject to signing definitive documentation, Atlas Mara would expect the transaction to close in Q1 2016.”
The group said once completed, the transaction, which would include the merger of FBZ with Atlas Mara’s Zambian subsidiary, African Banking Corporation Zambia Limited, would result in the creation of Zambia’s largest bank by branch network and fifth largest bank by assets with combined assets of approximately US$418 million.
“The enlarged group would be well-positioned to contribute meaningfully to the development of financial services in Zambia and the potential combination would be consistent with Atlas Mara’s over-arching strategic objective of being a “scale” player in its countries of operation,” the company said.- Zimbabwe Independent

Miners who were sent on forced leave by Luanshya Copper Mines in Luanshya this morning took to the streets in Roan Township blocking the Roan -Mpatamato road in a near riotous protest.
The miners are rejecting the K900 monthly salary effected this month.
And Luanshya District Commissioner Harold Mbaulu expressed disappointment at the action saying protesting was a sign of disrespect and lack of confidence in President Edgar Lungu who was in the province to address the issue among other challenges.
The irate miners, who gathered outside the Mine Workers Union of Zambia Roan Branch office, took to the streets after a failed attempt by District Commissioner Mbaulu to resolve the matter.
The miners demanded to meet the union representatives who were not in their offices.
The miners placed big logs across the road as they started throwing stones to oncoming vehicles, prompting police officers in riot gear to swing into action.
The miners were demanding for among other things to have their full salaries restored, know the date the LMC Baluba shaft would open and resume work, maintaining of their full pension and also to have direct audience with President Lungu and not through their unions when he visits the district on Tuesday next week.
They complained that this was not the first time the mine in Luanshya had gone on care and maintenance as this has happened on three occasions and all the time they got their full salaries, but wondered what was special this time around.
They complained that their salaries were negative as the banks were deducting the loans owed to them and that they were also faced with legal litigations as they were failing to pay back to other institutions and people they owed.
But Mr. Mbaulu assured the miners of government intervention into their requests saying President Lungu was on their side and that was why he was going to visit the district on Tuesday to resolve the mine issues once and for all.
He begged the miners to remain calm, noting that their grievances were genuine and that government was doing everything possible to safeguard their interests.
He implored the miners and other Luanshya residents to show solidarity to the President by remaining peaceful and present their petitions through a right channel to ensure that President Lungu attended to their plight.
Mr Mbaulu further urged the miners not to politicise the issue by refusing to dialogue and persisting to take a violent course as this will spoil their opportunity to be heard and have their grievances addressed.
About 1,640 employees at LMC Luanshya copper mines two months ago were sent on forced leave following Baluba mine being put on care and maintenance.
The action has seen miners getting a minimum of K900 salary from the initial K2800 for the least paid workers.
Last month, Chief Government Spokesperson Chishimba Kambwili assured the miners that government had engaged LMC on the matter and that they were going to continue receiving their full salaries despite being sent on forced leave.

Vice-President, Inonge Wina, is today expected in London, United Kingdom where she is leading a Zambian delegation to an Investment Forum organised by the Developing Markets Associates (DMA).
Mrs Wina will be accompanied by the Minister of Commerce Trade and Industry, Margaret Mwanakatwe, the Minister of Energy and Water Development, Dora Siliya, Director General, Zambia Development Agency, other government officials and the private sector.
The trade and investment forum will be held on the 4th of November, 2015 in central London.

The Chipata High Court has sentenced two Chipata men aged 23 and 21 to 17 years imprisonment each for defiling a 14-year-old girl.
Kelvin Banda, 23, and Michael Mwale, 21, were charged with one count each, for defiling the girl in April this year.
Banda and Mwale defiled the girl in a bush.
The victim was Banda’s girlfriend.
Banda grabbed the girl in a bush and forcibly removed her underwear, but she managed to run.
He managed to capture the girl with the help of Mwale.
The two then took turns in defiling her.
They claimed to have had carnal knowledge of the girl because they believed she was aged above 16.
However, the under-five card produced before the court showed that the girl was 14 years old.
Lusaka-based High Court judge William Mweemba on Friday found the two guilty and sentenced them to 17 years imprisonment each with hard labour with effect from April 14, 2015.
In the same court, Mr Justice Mweemba also sentenced a Chipata man to seven years imprisonment with hard labour for stealing a motor vehicle.
“The convict is a second offender who is serving another sentence of theft of motor vehicle. These sentences will run one after another,” he said.
And a 16-year-old girl who was charged with one count of burglary and theft has been ordered to go to a school for juveniles for three years to reform.
This was after Chipata welfare department recommended that the juvenile, who broke into the house of Aliness Ngulube and stole K500 cash and an MTN phone all valued at K600, should not be jailed.
On July 13, 2015, the girl, while acting together with another girl, broke into the house at night and stole cash and a mobile phone.
Mr Justice Mweemba said he was satisfied with the recommendation from the welfare department and ordered that the girl be sent to a reformatory for three years to enable her to reform and earn a life skill.

THE United Party for National Development (UPND) is being provocative, unreasonable and uncouth in their continued attacks and slander of President Edgar Lungu and Zambians will teach them a lesson in the 2016 general elections, Mandevu Patriotic Front (PF) member of Parliament Jean Kapata has charged.
Ms Kapata said it was shocking that while President Lungu and the PF had continued preaching peace, unity, harmony and reconciliation, the UPND had continued with their politics of bitterness, malice and slander.
She said President Lungu was too decent a leader to engage in hegemonic politics recalling that the Head of State was on record that he did not want his hands to be soiled with political blood.
Ms Kapata who is Tourism and Arts Minister said President Lungu had on countless times preached civil politics and that assertions that the Head of State would kill to win the 2016 general elections were extremely provocative.
She told the Daily Nation that President Lungu won the January presidential election at a time when the opposition political parties and some members of the ruling party had ganged against the Head of State in a bid to remove the ruling party from power.
On Wednesday, UPND special advisor to the president Douglas Syakalima claimed that if President Lungu was ready to spend money to win the general elections next year, then he was equally ready to kill to retain the presidency.
“The UPND has always been provocative in their politics but we understand because they are bitter after their leader failed to win the presidency for the ampteeth time. The UPND started campaigning long before president Sata died and when a presidential election was announced, they were beaming with glee to the prospects of dislodging the PF from government. What they did not know that God had destined President Lungu…and let them know that the President is too decent a leader to engage in less than civil politics,” Ms Kapata said.
She said the UPND celebrated when there was a presidential election following the death of president Michael Sata because their desire was to have the PF be the only political party in the history of the country to have governed the country for only three years.
Ms Kapata said during the transition, the PF was deeply divided and was at its weakest point but God through Zambians had destined President Lungu to take over from late president Sata.
She stated that the UPND had failed to defeat the PF at the time the ruling party was going through internal turbulences and it was going to be extremely difficult for the opposition political party to be a threat to the PF victory next year.
“The UPND is particularly popular on social media and especially on one online publication and they are being misled that they can win an election. The situation on the ground is very different because not so many Zambians have time for social media. In Mandevu Constituency, how many people can find time to be on social media? We are going to campaign aggressively now that we are solidly in control. So let them continue campaigning on social media and we are going to be on the ground meeting and interacting with real people,” Ms Kapata said.

Armed police officers in Kitwe have picked up FDD leader Edith Nawakwi in Mulenga compound where she was addressing party leaders.
The police officers in full riot gear arrived who had earlier trailed the opposition leader arrived in two land cruiser vehicles shortly after Ms. Nawakwi had finished her meeting and blocked as she headed out of the compound.
At this point Nawakwi obliged and was later taken at Wusakile police station for interrogations.
But a police source said the instructions came from above.
“We are told by the bosses that she should leave Kitwe now. We are just following instructions. It seems they are not happy with the stories coming out of papers and radio stations of Nawakwi been here. The boss (President Lungu) is here and it seem this has not gone well. So for us we are just following orders my brother! But we think she should just be allowed. The boss (President Lungu) should just concentrate on addressing real issues. We are just making her popular, why should Nawakwi’s presence here put pressure on the boss,” said a police source.
