A 47-YEAR-OLD man of Kasama has been arrested for being in possession of obscene materials on his laptop.
Daniel Thomet, who was allegedly purporting to be a tourist, was found in possession of obscene materials on his laptop carrying his image while having carnal knowledge of a girl who is yet to be identified by the police.
Police acting spokesperson Rae Hamoonga said the incident happened between June 2013 at an unknown date and time and September 11, 2013 at 19:00 hours in Chishipula area in Kasama.
“The suspect has since been charged with being in possession of obscene materials and will appear in court soon,” Mr Hamoonga said.
Meanwhile, Police in Mufulira has launched a manhunt for three unknown people that gang raped a 43-year- old woman and left her unconscious.
The victim was allegedly gang raped by the three men who had joined her during a drinking spree and later attacked her after leaving the drinking place.
Copperbelt acting Police Chief Joyce Kasosa confirmed the incident which happened last weekend.
Ms Kasosa explained that the woman went for a drink and was approached by three men who started drinking with her.
The woman left the drinking place after 23:00 hours and it was believed that she was followed by the same men she was drinking with who hit her on the head and later took turns in raping her.
Ms Kasosa said the victim who sustained a deep cut on the head was found unconscious by passerby who reported the matter to the police.
The victim is currently admitted at Ronald Ross Hospital.
Opposition MMD leader Nevers Mumba arrives at the magistrate’s court complex in Lusaka
MMD leader Nevers Mumba has unreservedly apologized for alleged assaulting the integrity of the judiciary.
Mumba has submitted to the court that his statements were not in any way intended to ridicule or bring the much-revered Supreme Court into dispute but were merely fair comments on matters of public interest.
This is in a matter where Petauke central constituency losing candidate Leonard Banda has sued Mumba for contempt of court.
This was after Mumba attacked the judiciary through the media over its decision to nullify Dora Siliya’s seat.
But Dr Mumba who admitted to having issued the statements complained of said he was apologizing and withdrawing the statements if in its ordinary sense they amounted to contempt of court.
“Should the statements in their ordinary sense insinuate or indeed amount to contempt, I unreservedly apologies and withdraw to the extent of the contempt” Mumba submitted in his three paged statement to the court.
Mumba however told the court that the language he used in the issuance of the statements was mild as he had used words like “may” and posing questions for debate.
He said that he recalled making the statements complained of but the same were issued for and on behalf of the MMD party as a party that was injured by the numerous nullifications.
Mumba said that because of the same, MMD was grieving as a party in the face of taunts from the ruling party which included a statement from Justice Minister Wynter Kabimba that the ruling party would “engage’ the court in relation to the same.
He further said that following the announcement by Mr Kabimba, a press statement was issued purportedly for and on behalf of the Supreme Court affecting the MMD in relation to its candidate Siliya.
Mumba said that the statements generated public discussions that were in public domain and became matters of public interest.
“The statements complained of were intended to be fair comments on matter of public interest. Necessary caution was taken in the issuance of the statements in that the same were posed as questions for public debate. Further I used the word “may” in most of my statements” Mumba said.
Mumba said that the statements were not conclusive of any fact in issue but speculative on a matter of public interest that was enjoying diverse comments from the general public.
The panel of five Supreme Court judges namely acting deputy chief justice Florence Mumba, Mervin Mwanamwambwa, Hildah Chibomba , Gregory Phiri and Munyinda Wanki have since wondered whether it would be necessary for the court to proceed in hearing the alleged contempt of court in an event that Mumba had apologized.
Meanwhile, trial in the same matter failed to takeoff because Mumba’s lawyer Ireen Kunda was unwell.
Donald Kasote from George Kunda and company who applied for an adjournment on behalf of Ms Kunda told the court that Ms Kunda had been advised by medical experts to be on bed rest for five days because her blood pressure was high.
Ms Justice Mwanamwambwa who adjourned the case to November 13, 2013 ordered Mr Kasote to study the case in case Ms Kunda would not have recovered by then and that he should concentrate on Mumba’s issue of apologizing to the court.
THE Bank of Zambia (BoZ) has welcomed the public service wage and recruitment freeze in 2014 and 2015 as this will help to contain inflationary pressures in the country.
BoZ governor Michael Gondwe said the risks to inflation in 2014 may include the continued sluggish growth of the global economy which may reduce demand and consequently the price of copper.
Dr Gondwe said this on Monday when he appeared before the expanded parliamentary committee on estimates to make comments on the 2014 national budget.
“The inflationary pressures would also result in a reduction in foreign exchange earnings and consequently lead to a depreciation of the exchange rate.
“Therefore, the measure that the Government has undertaken to come up with a public service wage free and the civil service recruitment freeze is welcome as this will assist in addressing inflationary pressures,” he said.
Dr Gondwe said he is also happy that the budget has focused on key growth sectors of the economy.
He said the key sectors which include agriculture, tourism, manufacturing, energy and construction will help to consolidate economic growth, accelerate job creation and promote social justice for all Zambians.
Dr Gondwe said it is also gratifying to note that in the 2014 budget, domestic borrowing will be limited to about 2.5 percent of the Gross Domestic Products (GDP).
He said this will enable the government to raise about K3, 501.8 million from the domestic market in 2014 with foreign financing estimated at about K7, 015 million. Dr Gondwe also said Zambia’s total public debt of the GDP is well within the 60 percent threshold which is considered sustainable by international standards.
THE Lusaka high court has ruled that William Harrington has the right to be heard through a tribunal over his allegations against Tourism and Arts minister Sylvia Masebo in the matter she is alleged to have interfered and abused her authority regarding the operations at Zambia Wildlife Authority (ZAWA).
Judge Dominic Sichinga said yesterday in his judgment said that the parliamentarian and ministerial code of conduct required that acting chief justice Lombe Chibesakunda was under the law required to appoint a tribunal to probe the allegations against Ms Masebo.
This is in a matter in which former Tourism Minister William Harrington had sought judicial review over Ms Justice Chibesakunda’s decision to refuse to appoint a tribunal to probe Ms Masebo on grounds that he had not supplied her with sufficient facts and particulars on the alleged breaches that Ms Masebo had committed.
But Mr Justice Sichinga said in his more than an hour judgment said that the decision by the acting chief justice to refuse to appoint a tribunal could be said to be flawed because Mr Harrington had the right to be heard under section 13 (1) and (3) of the Act.

He said he was satisfied that there was an illegality on the acting chief justice decision not to appoint a tribunal to investigate allegations levelled against Ms Masebo.
Mr Justice Sichinga said that the decision by Ms Justice Chibesakunda to refuse to appoint a tribunal effectively denied the applicant an opinion to be heard in the allegations he had submitted against the minister.
“In this case, the duty imposed on the chief justice in terms of section 13 (1) is to act in one particular manner and that is to appoint a tribunal. The decision to refuse to appoint can thus be said to be flawed,” he said.
He said that Mr Harrington had demonstrated the illegality and procedural impropriety allegations in the decision of Ms Justice Chibesakunda.
Mr Justice Sichinga further said that the statement by Ms Justice Chibesakunda to refuse to set up a tribunal on the grounds that Ms Masebo’s reputation would be irreparably damaged politically was a mere moral concern because the law stated otherwise.
He said all what the acting chief justice was supposed to do was to inform the President and the speaker of the national assembly about the request by Mr Harrington to have Ms Masebo probed of which she rightly did when she informed the President about the same through a letter.
He could however not grant a request by Mr Harrington to have Ms justice Chibesakunda’s decision to refuse to set up a tribunal to be quashed saying there was nothing for him to quash.
“However I have earlier in my judgment rendered the said decision to be a nullity. This means that infact there is nothing to quash and therefore I decline to grant the relief,” Mr Justice Sichinga said.
MINISTER of Home Affairs Edgar Lungu has rejected an appeal by Dan Pule against the decision of the Registrar of Societies not to register Dr Pule’s United People’s Jubilee Party.
Mr Lungu said yesterday that he concurred with the Registrar of Societies’ decision to reject an application to register Dr Pule’s party because its name was going to be associated with the country’s independence Jubilee celebrations next year.
“I rejected the appeal by Dr Pule because the name United People’s Jubilee Party would end up being associated with Jubilee celebrations next year,” he said.
Mr Lungu said he received Dr Pule’s appeal last week in which he wanted to counter the decision of the Registrar of Societies.
The minister said he advised Dr Pule to come up with a different name for his new political party.
Dr Pule has done so but is for now not stating what the new name is.
And Dr Pule told the Zambia National Broadcasting Corporation yesterday that he has changed the name for his party because he does not want to be seen to be fighting against Government.
On Saturday, Deputy Minister of Home Affairs Stephen Kampyongo cautioned Dr Pule against involving himself in illegal activities by going ahead to unveil his political party despite the application for its registration having been rejected by the Registrar of Societies.
Christopher Katongo has helped Henan Jianye to promotion back to the Chinese super League.
10-man Henan beat 11th placed Tianjin Sonjiang 2-1 on October 26 to secure a quick return to the top flight following their demotion at the end of the 2012 season.

The Zambia Police has warned pupils finishing the Grade 12 to desist from bad behaviour.
Police Public Relations Officer Munganga Chanda said in a statement that police will be on guard to ensure that peace and order is maintained during this period.
“Wednesday 30th October 2013, marks the end of year examinations for the Grade 12s. From past experiences, the Zambia Police service has observed that when pupils complete writing their final grade twelve exams, they get very excited and involve themselves in illicit activities such as beer drinking, use of drugs, casual sex and interruption of traffic,” Mrs Chanda said.
She added, “We would like to caution those planning to involve themselves in unruly behaviors out of excitement of completing their grade twelve that we will be on the look-out for them. We will not tolerate a situation where innocent citizens suffer at the hands of these unruly school leavers just because they have completed their secondary school.”
Mrs Chanda also appealed to parents and school authorities to warn their children and pupils respectively against being involved in bad behavior.
“As Zambia Police, we would like to discourage the hosting of leavers balls since this is where most of these vices are exhibited from. We will be on high alert to ensure that there is peace and order during this period and all those who will be found wanting will be dealt with accordingly.”

The United Party for National Development (UPND) has charged that President Michael Sata is a danger to press freedom and democracy.
In a statement released to Qfm, UPND Vice President Dr Cannicius Banda says in revoking the national broadcasting licenses that government recently issued to Radio Phoenix and Qfm, the President is keeping citizens uninformed which is greatest danger to the integrity of the nation and not media freedom.
Dr. Banda says keeping citizens uninformed using instruments of state power run counter to the very functions and purpose of the office of the president.
Dr. Banda adds that not issuing licenses based on the decisions of the previous administrations illustrates the case of basing decisions on flawed precedents.
He adds that UPND leader Hakainde Hichilema is at liberty to communicate using whatever medium is available to him as any other citizen.
Alliance for Democracy and Development (ADD) president Charles Milupi
Alliance for Democracy and Development (ADD) Leader Charles Milupi says he does not see the country having a people driven constitution in the absence of a legal framework.
Mr. Milupi says a legal framework in the constitution making process would have given the Zambian people ultimate control of the process including adoption of the constitution through a referendum.
He says it is unfortunate that Justice Minister has indicated that there is no budget for the referendum two years after the constitution review process was commenced.
Mr. Milupi says this is a clear indication that the PF is not being sincere in the constitution making process.
Government has disclosed that the Road Development Agency Board will be appointed by the end of November this year.
Transport, Communications, Works and Supply Minister Mukanga told parliament in a ministerial statement that the relevant ministries and institutions have submitted names of nominees for the board.
Mr. Mukanga informed the house that the names of the nominees are currently under scrutiny.
“The names suggested are currently undergoing normal security screening and once that is done, I will be able to unveil the names,” Mr Mukanga said.
He explained that there have been delays in appointing the board of directors because government institutions handed over the names late.
The Road Development Agency has been operating without a board of directors for about two years with PF Presidential Campaign Manager Willie Nsanda as Board Chairman.
Opposition leader Hakainde Hichilema recently wrote to President Sata questioning the lack of a board at RDA.
Mr Hichilema argued that the agency is currently spending a lot of public funds and operating without a board raises governance concerns.

TP Mazembe coach Patrice Carteron has welcomed the arrival of Zambia
defender Chongo Kabaso at the Lubumbashi club.
Kabaso, 21, joined Mazembe from FAZ Super League club Konkola Mine

The Zambia Police Service has advised owners of vehicles that are impounded and then cleared after investigations to immediately collect their motor vehicles from police premises around the country.
Inspector General of Police Stellah Libongani has warned that the delay would force the state to auction the vehicles because they make police premises very untidy.
Ms. Libongani told ZANIS in an interview in Lusaka that police stations were not garages hence no private vehicle should be kept there for a long time.
She observed that some impounded vehicles have remained parked at police premises despite being cleared by traffic officers.
She has since directed all Officers In-Charge to ensure that unclaimed vehicles found at police stations were duly auctioned through the courts in accordance with the provisions of the law.
The Inspector General of Police further explained that the police usually notifies car owners to pick their vehicles but regretted that some were rather adamant to comply with the law.
Ms. Libongani could however not state how long vehicles should stay at police premises after being cleared of investigations.
Movement for Multiparty Democracy (MMD) president Dr. Nevers Mumba has denied sanctioning a statement undersigned with his named which referred to first republican president Dr Kenneth Kaunda as a Senile retiree after he condemned the opposition for criticizing President Michael Sata.
According to the English Dictionary, if old people become senile, they become confused, can no longer remember things, and are unable to look after themselves.
Dr. Mumba told Qfm News in an interview that someone in the former ruling party issued the said statement which he did not have a look at.
Dr Mumba said he has since written to the former president Dr Kaunda to clarify the matter.
He said the words attributed to him in the statement do not form part of his language and has never used such words to any person.
Dr. Mumba said he has great respect for the first republican president to use such language towards him
He said the MMD’s only concern is the stance Dr. Kaunda has taken in by getting involved in active politics.
He further added that it is unfair to accuse him of calling the first republican president a senile retiree.
Dr. Mumba said Dr. Kaunda should be a shining example of a great leader who fought for the struggle of the country from colonialism by embracing every opposition leader to drive the country forward.
