Bus fares hike illegal – RTSA

2

a-minibus-driver

The Road Transport and Safety Agency (RTSA) has declared the decision to increase local bus fares by bus operators as illegal and void.

RATSA Principal Publicity officer Mercy Mwila in a statement released to QFM News says while the Agency appreciates requests from two operators; Capital Buses and representatives of a group of luxury buses to vary their current Road Service Licences (RSL) for adjustment of bus fares by 6th May 2013, such a stipulated and concrete date for the desired increase can only be communicated after discussions have been held and concluded by all concerned stakeholders including the Ministry of Transport, Communications, Works and Supply.

Ms Mwila says Bus operators are aware of this regulation, which stipulates the conditions under which Road Service Licences are granted.

She points out that Subsection 12 (d) of Section 108 of the Road Traffic Act No. of 2002 underscores that “a person applying for a road service license, and a holder of such a licence applying for its variation, shall submit to the Director %u2013 the rate of fares of the proposed services”.

She says the regulation therefore entails that bus operators are under obligation to request the Director for variation of the current Road Service Licences or the terms and conditions under which licenses were granted.

Ms Mwila adds that the Agency has also received to vary the Road Service Licenses in a bid to increase bus fares from the intercity bus operators in which they are requesting to increase the fares by KR30.

She has since appealed passengers not to hesitate to call the Agency on 983 toll free line should they be charged be new fares before an agreement has been reached.

Meanwhile, the Agency expressed deep concern over some operators’ conduct, which have been revealed through the Joint National Road Traffic Enforcement Programme, where they have continued to operate without RSLs.

Ms Mwila says in some cases, these operators have continued to disrespect passenger safety including overloading, abandoning passengers and the vehicles, leaving the Agency with no option but incur expenses of towing the vehicles to safer venues.

She has warned all operators that it is against the Road Traffic Act No. 11 of 2002 to operate outside the Act and any operator found will be dealt with severely in a bid to safe-guard the lives of passengers and other road users.

Sources within the MMD say Richard Taima resigned as MMD Solwezi East Member of Parliament to join the PF due to billion he owes the Citizens Economic Empowerment Commission (CEEC) in unpaid loans.

The sources have told QFM News that Mr Taima’s wants to seek protection from the ruling Patriotic Front over the money he owes the CEEC which has embarked on an exercise to repossess property of people who have failed to liquidate their loans.

The sources further reveal that the CEEC has already started confiscating property belonging to Mr.Taima for failing to pay back the loan he got.

They have also disclosed that a lodge in Solwezi belonging to the parliamentarian has since been repossessed by the CEEC.

The sources say this predicament has left Mr Taima with no option but to join the ruling PF with the hope that President Michael Sata will prevail over the CEEC on his behalf.

They sources have also stated that Mr.Taima is also afraid of losing the petition in which his election as Solwezi East MP has been challenged.

But when contacted by QFM News, Mr. Taima said even if he owed the CEEC huge sums of money, that is not the reason why he has decided to ditch the MMD for the PF.

He was at the time of his resignation serving s Commerce, Trade and Industry deputy Minister in the PF government.

Police were wrong to detain and caution Elias Chipimo Jr -Edgar Lungu

GOVERNMENT is disappointed with the action of Copperbelt police officers who warned and cautioned National Restoration Party president Elias Chipimo on suspicion that he was addressing an illegal assembly.

Minister of Home Affairs Edgar Lungu said in an interview in Lusaka yesterday that the detention and recording of a warn-and-caution statement from Mr Chipimo by police in Kitwe on Thursday “is a very sad chapter in the history of the Patriotic Front (PF) Government”.

“This is very sad… Elias Chipimo is an opposition leader who has the freedom to criticise and advise on behalf of his party without being harassed by the police,” Mr Lungu said.

The audibly upset minister said police are supposed to protect opposition leaders and anyone else with a divergent view as long as such people are responsible in their actions.

“We will immediately constitute an inquiry to find out under whose instructions police officers were acting because it is certainly not Government policy to harass people,” he said.

Mr Lungu said if police had any suspicion that something illegal was going on at Mr Chipimo’s gathering, they would have investigated the matter instead of rushing into warning and cautioning the opposition leader.

[pullquote]“We will immediately constitute an inquiry to find out under whose instructions police officers were acting because it is certainly not Government policy to harass people,” he said.[/pullquote]

He said Zambia is internationally known for its respect for the rule of law and human rights and will not allow a “few bad elements in the police service” to tarnish the country’s image locally and internationally.

“We inherited a system with a lot of bad eggs, not only in the police service but in many other Government departments. But let this be a warning that we will weed them out to clean up the system because the PF Government is a just government,” Mr Lungu said.

On Thursday, police recorded a warn-and-caution statement from Mr Chipimo for alleged unlawful assembly.

Mr Chipimo, who was holding a workshop at Provident Guest House, was picked up by police officers in riot gear and taken to Kitwe Central Police Station.

The opposition leader was only released around 13:00 hours after being detained for over three hours.

Meanwhile, Mr Chipimo has demanded that Government compensates his party KR30,000 (K30 million) following his arrest and disruption of the workshop he was conducting for NAREP officials.

[pullquote]He said Zambia is internationally known for its respect for the rule of law and human rights and will not allow a “few bad elements in the police service” to tarnish the country’s image locally and internationally.[/pullquote]

Mr Chipimo has also demanded an explanation from the Minister of Home Affairs about why Police in full riot gear stormed the venue of the workshop.
“We spent in excess of KR30, 000 on booking the venue, paying for transport costs, fuel and other incidentals. We cannot recover that money now,” he said.

He said the party wants categorical answers from the state on how they will operate as a political party since they are being barred from meeting their own members.

Mr Chipimo, who is a lawyer, has threatened legal action depending on how the party’s demands are treated by Government.
“Depending on how government responds to our questions regarding the manner in which our meeting was disrupted, we will take legal action,” Mr Chipimo said.

He further said if police continue to disrupt NAREP’s internal party meetings throughout the country, the party will take legal action.

Mr Chipimo said while the police were interrogating him, he received overwhelming solidarity from international human rights watch groups.
“Our conclusion is that the action by police in Kitwe was a deliberate desire by an overzealous government official trying to intimidate us,” he said.

He said NAREP has been practising mature politics and does not expect the police on the Copperbelt to behave in the manner they did.

ECZ not responsible for the 15% voter turnout in Kapiri Mposhi By-Elections

1

The Electoral Commission of Zambia (ECZ) Public Relations Manager Crispin Akufuna says the Commission is concerned with the accusation made by Central Province Minister, Philip Kosamu, on MUVI Television and Zambia National Broadcasting Television (ZNBC).

Last week on Thursday Mr Kosamu said the Commission did not do enough voter education to sensitise voters in Kapiri Mposhi resulting in low voter turnout of about 15.06 per cent of registered voters.

Mr Akufuna said voter registration is a mammoth task which requires not only ECZ but also political parties that need to win the elections.

He also stated that it is important for political parties to conduct research to ascertain causes of voter apathy during elections which cannot only be attributed to inadequate voter education.

This is according to the press statement made available to ZANIS yesterday by ECZ Public Relations Manager Crispin Akufuna.

Mr Akufuna also explained that the Commission carried out vigorous voter education before the April 23 Kapiri Mposhi by elections.

Mr Akufuna has since called on all stake holders to compliment the Commission’s efforts in sensitising voters to cast their votes during elections.

THE Supreme Court has set May 9 this year as the date for judgment in a matter in which the Lusaka High Court halted proceedings of a tribunal appointed by President Michael Sata to investigate the alleged misconduct of Supreme Court judge and two High Court Judges.

This is in a case in which Supreme Court judge, Phillip Musonda, two High Court judges Nigel Mutuna and Charles Kajimanga have dragged the Attorney General to Court asking it to quash Mr Sata’s decision to constitute a tribunal to conduct investigations of their alleged misbehaviour or incompetence.

But in her ruling High Court judge Fulgence Chisanga granted the trio leave to seek judicial review in the matter which operated as a stay of Mr Sata’s decision to appoint a tribunal and suspend the judges and any adverse measures against the applicants.

The State having been not satisfied decided to appeal in the Supreme Court against Ms Chisanga’s ruling which operated as a stay to stop proceedings of a tribunal to investigate them on allegations leveled against them.

According to a notice of judgment issued yesterday by the master of the Supreme Court, Dories Nambela stated that the appeal would be heard and determined by the Supreme Court sitting on Thursday next week.

“ Take notice that the above mentioned appeal will be heard and determined by the Supreme Court sitting in Lusaka on Thursday next week at 14:30 hours, for any reason if any part would be ready to attend file notices in advance,” she said.

Mr. Sata issued the directives yesterday during the laying of a foundation stone for the construction of Chalimbana University in Chongwe district.

“Education minister ensure secondary schools are opened in all the chiefdoms of Chieftainess Nkomesha Mukamambo II,” he directed.

The Head of State said it was important that more schools are built so that children can have easy access to quality education.

He has since admonished the people of Chongwe to look after Chalimbana university infrastructure jealously when it is constructed.

He said the construction of the university was a project of Chongwe residents hence the need for them to look after it.

And Chieftainess Nkomesha Mukamambo II said the people of Chongwe district will support the PF government in all its projects.

She praised President Sata for initiating the construction of the university adding that the land has been lying idle for a long time.

Meanwhile, Chieftainess Nkomesha Mukamambo II has appealed to government to consider utilizing the land she gave the state to construct a police camp in Chongwe.

She lamented that nothing has been done on the piece of land she released to government for constructing of police housing units and an office block when the MMD was still in power.

The traditional leader revealed to President Sata that police officers in Chongwe have no houses, a situation that has forced them to rent houses elsewhere.

The Chieftainess further disclosed that the police was also renting an office from the Chongwe district council which the officers were using for their day to day work.
Meanwhile, Education, Science, Vocational Training and Early Education Minister John Phiri said the PF government was delivering according to the campaign promises it made to the electorate.

He stated that during the 2011 pre-election campaigns, Mr. Sata promised the people f Chongwe that PF will turn Chalimbana College into a university once elected into office, a promise the party has since honoured.

And Lusaka Province Minister Freedom Sikazwe said the construction of the university has excited the people of Chongwe.

He reiterated that the people of Chongwe have been crying for Chalimbana College to be upgraded into a university for a long time now.

Mr Sikazwe said the university will help to absolve pupils who are not taken by other higher learning institutions.

President Michael Sata today launched the 61 kilometres multi million Kwacha rebased Chalimbana-Lwimba-Katoba road project in Chongwe district of Lusaka province.

The project is part of the link Zambia 8,000.

The road will link Chongwe district via Kafue to Chirundu and Luanga districts respectively.

Speaking during the launch which was at the junction of Chongwe and Chalimbana road, President Sata said investors can only be wooed to do business in Zambia if the road network is improved.

President Sata said the launch of the Chalimbana-Lwimba-Katoba road project was important for attracting investment to Chongwe district.

Mr. Sata recalled that in the past, road development projects were associated with election campaigns.

He however noted that his government would develop the country’s road network even when there was no looming election.

And President Sata has said many people have suffered complications as result of dusty emanating from gravel roads.

He has since directed the Road Development Agency (RDA) to ensure that roads in Chongwe district were tarred.

He said Lusaka province should start developing eastwards so as to open up Chongwe to development.

Meanwhile, President Sata has advised Chieftainess Nkomesha Mukamambo II to write to government any problems affecting the chiefdom.

He said his administration will be ready to respond to the problems raised in writing and addressed to the government.

In a related development, Mr. Sata implored ministers to frequently visit Chongwe district in a bid to establish themselves.

And speaking earlier at the same function, Chieftainess Nkomesha Mukamambo II thanked President Sata for hearing the cries of the people of Chongwe concerning the upgrading of the Chalimbana-Lwimba-Katoba road.

The chieftainess disclosed that the people of Chongwe have for a long time been crying to have the Chalimbana-Lwimba-Katoba road upgraded and tarred.

She said she almost lost her chieftaincy for calling on government to upgrade the named road.

The traditional leader said she suffered for asking on behalf of the people to have the road developed as many institutions of education are along the same road.

Chieftainess Nkomesha Mukamambo II said she has been calling for the tarring of the road for a long time now and she was grateful that her dream has come to a reality.

The chieftainess has since appealed to President Sata to continue hearing to the cries of many Zambians yearning for development in other parts of the country.

Meanwhile, Lusaka Province Minister Freedom Sikazwe said the tarring of the Chalimbana-Lwimba-Katoba road will help enhance agriculture in the area.

He said farmers will have easy access to the market due to the improved road network.

Mr. Sikazwe said previous administrations paid a deaf ear to the cries of the people of Chongwe concerning the tarrying of the road.

He said the MMD government used the Chalimbana-Lwimba-Katoba road as a campaign tool.
