2011 elections to be held under new constitution – Kunda

Vice President Goerge Kunda says the 2011 presidential elections will be held under a new republican constitution.

Mr. Kunda has appealed to the National Constitutional Conference (NCC) to expedite the constitution process so that the presidential elections are held in a peaceful, free and affair atmosphere.

The Vice President said this at Solwezi Airport on his arrival from Zambezi district where he had gone to officiate at this year’s Likumbi Lya-mize traditional ceremony for the Luvale speaking people.

He said that the NCC should not make unnecessary delays in coming up with a new constitution before the 2011 polls saying the exercise is costly on the part of government as it is draining the national coffers.

“I appeal to the NCC members and secretariat to conclude the deliberations of the NCC before 2011 when Zambia goes to the polls because this exercise is costly. As government we want to serve resources being spent in this constitution ( making ) process,” Mr. Kunda said.

And Mr. Kunda has appealed to the Zambian people not to be cheated by the formation of the UPND/PF Pact calling it a failure and destined to collapse.

The Veep said the people at the grass roots do not know and understand the pact. it and that the Pact does not exist.

He said the ruling MMD is not threatened by the UPND/PF pact even if the co-pact leaders are going around the country telling lies and always criticizing government’s good fiscal policies that are bearing fruit..

Mr. Kunda accused the Pact’s leadership of being selfish saying they cannot develop the country.

The Vice President advised UPND leader Hakainde Hichilema to start politics at grassroots opposed to being an opposition president.

He cited that he himself served at Mansa Municipal Council and rose in different government portfolios under his appointment as Second in Command, Veep.

The Vice President is in Solwezi to officiate at the 2009 North-western province MMD card renewal exercise.

He is accompanied by his wife, Florence, cabinet Ministers, Peter Daka, (Lands) Sara Sayifwanda (Gender), Michael Kaingu (Community Development and Social Services), Elijah Muchima (Information Deputy Minister), senior government official and MMD Deputy National Secretary Jeff Kaande, other senior MMD party officials.

Provincial Minister Joseph Mulyata, Commerce Deputy Minister Richard Taima, Agriculture Deputy Minister Daniel Kalenga, NWP Deputy PS Nkolola Hazemba, Defense chiefs, senior government officials, MMD party officials and patriotic Zambians were at hand to recieve the Mr Kunda.

President Rupiah Banda has said that government fired former Task Force on Corruption Chairman Max Nkole because he defied government advise over former president Chiluba’s acquittal.

President Banda said Mr. Nkole’s failure to heed advise from the Director of Public Prosecution (DPP) Chalwe Mchenga following Dr. Chiluba’s acquittal amounted to indiscipline.

The President said this in Matsapha, Swaziland when he addressed the Zambian community living in that country.

He said Mr. Nkole went ahead to appeal against the former president Chiluba’s acquittal in Ndola High Court, ignoring advise from the DPP to allow his office study the judgment first before taking such a move.

Mr. Banda said the DPP had all the constitutional powers to prosecute all criminal cases without interference from anyone.
He said Mr. Nkole should have followed the advise from the DPP before appealing against the acquittal of Mr. Chiluba.

Mr. Banda disclosed that Mr. Nkole’s behaviour also made it difficult for him to renew his contract which expired in November last year.

Mr. Nkole’s contract as Task Force on Corruption ended on November 16, 2008.[quote]

“Mr. Nkole defied advise given to him by the DPP and decided to deal with the matter in his own way,” The President said.

Mr. Nkole’s appeal against the former president’s acquittal in the Ndola High Court has since been withdrawn by the DPP.

The president told Zambians community in Swaziland that the country was politically stable although it had faced some economic problems brought about by the global financial crisis.

Mr. Banda said he was happy that things did not become worse because there was fear of massive job losses due to closure of companies especially in the mining sector.

He said only one mine had problems and was put on care and maintenance but government has since sorted out the problem with over 1000 people who had lost their jobs re-employed.

President Banda hoped that the National Constitution Conference (NCC)would conclude its business soon and give the country a better constitution than the current one.

He said due to a strong appeal from Zambians in diapora, the NCC has agreed that Zambians should be allowed to have dual citizenship.

Mr. Banda said the current constitution did not allow Zambians to have dual citizenship but the NCC felt that the constitution should be changed to allow that.

The President said there were several reasons why Zambians seek citizenship from other countries.
He said if Zambians who sought citizenship from other countries still wanted to remain Zambians, they should not be denied that opportunity.

And the Association of Zambian Nationals in Swaziland (AZANAS) has appealed to government to speed up the processing of new passports for Zambians living abroad.

AZANAS President Dickson Mukunda said only few Zambians in living in Swaziland had so far acquired new passports.

Rev. Mukunda said the rest were still waiting for the passport one year after submitting the forms to the Zambian Mission in Mozambique.
The AZANAS president also appealed to the President Banda to extend the deadline for the renewal of passports.

President Banda said he would ensure that the Passport Office speed up the issuance of passports to Zambians living abroad.

Those who attended the meeting included Finance and National Planning Minister Situmbeko Musokotwane, Zambia’s Ambassador to Mozambique Agness Ngoma and government officials from both countries.

Former President Frederick Chiluba has refuted media reports suggesting that he celebrated the death of his predecessor, Levy Mwanawasa.

He said some sections of the media misunderstood him when he observed that whenever there is a change of leadership the country’s environment also changes.

The former Head of State said this at a thanksgiving service dubbed ‘Thanksgiving Service for the Acquittal of the Former Republican President’ organised by the clergy from various Pentecostal churches in Lusaka yesterday.

He said no-one should rejoice over another person’s death because all human beings are destined to die at a certain time.

“I did not rejoice over the death of President Mwanawasa. I meant to say that change of leadership in the country changes the environment but I was misunderstood by our colleagues from the press. No one should celebrate the death of another human being because everyone will die,” Dr Chiluba said

And Dr Chiluba has described his acquittal by the Lusaka magistrates court as God’s act and that President Banda did not in any way influence the court’s decision to acquit him on six counts of corruption charges involving US$500,000.

“President Banda had nothing to do with this acquittal. This acquittal is purely by the grace of God nothing else,” Dr Chiluba said.

He reiterated that Zambians must continue to uphold his declaration of the country as a Christian nation when he was President.

Dr Chiluba said that now that he has been acquitted he will concentrate and spend more time preaching the word of God.

He said that the eight years he spent facing corruption charges in court have helped to bring him closer to God because he met a lot of people who spent time praying with him.[quote]

“I am a great friend of all the Christian denominations in the country. The past eight years has brought me closer to God. Had it not been for the false accusations, I would not have been closer to God,” he said.

He thanked his wife Regina for having endured the times he had been sick and going to court.

Dr Chiluba has also hailed his spokesperson Emmanuel Mwamba, Dr Justine Kangwa, lawyers John Sangwa and Robert Simeza and all support staff for not deserting him when he faced the corruption charges.

Liberty Christian Centre bishop, Eddie Mulenga, said the declaration of Zambia as a Christian nation has been further strengthened by Dr Chiluba’s acquittal.

Bishop Mulenga said Dr Chiluba’s acquittal is an indication that God has delivered the former Head of State because of his honest leadership when he was Republican President.

He commended the media in the country for their consistency in informing the nation about Dr Chiluba’s court proceedings.

Dunamis Church apostle, Dan Pule, said Dr Chiluba’s acquittal is a victory for all Christians.

The Necessity

The second part of Migration and Christian Living article was to share the principles that have been helpful in maintaining fervency in our faith, but after the responses to part one, it is necessary to address some concerns. The question that arises concerning our faith and attending Church while away from Zambia is; Is it necessary?

Attending Church is not the ultimate goal for our lives and Church can be a waste of time if we don’t do first things first. Most of the Zambians that we know have attended Church since they were young. Church has been a part of the Zambian life for decades and as a result it has become a tradition that most of us do without thinking about why we do it. For most, if asked why go to Church? Answer: “we have always gone to Church.” or Why not? Others say Christianity is a “white man’s religion.”

Many Africans who have migrated to developed countries have been disappointed with Church. Even though there are genuine churches, some are like businesses. Not many nationals are interested in attending and somehow feel disappointed that the people who introduced us to it are not interested today. They feel cheated.

Firstly, lets look at the statement that some of us used to believe and confessed often; ‘Christianity is a white man’s religion.’ Wait a minute, Christianity has its roots in the Jewish nation and as far as we know, Jews are not white, so this notion is incorrect. The white man brought it to Africa, some in obedience to what the Lord Jesus told His Jewish followers in Matthew 28: 18-20 and others as a tool to accomplish selfish motives. We shouldn’t throw the genuine because we encountered the fake. The fact that the white people introduced Christianity to us and now on the average are not interested in it does not make it wrong. It is like a lot of Zambians who were introduced to traveling to places like Dubai, Hong Kong, etc for business, some of the ones who started it no longer go for some reason or another, but for some who were introduced to it, it has worked out to be profitable and still travel. The thing is not about the one who introduced it but is it real to you?

Why attend Church?’ Hebrews 10:25 encourages us ‘not to forsake the assembling of ourselves together … ’ The main reason is for fellowship and teaching. Church life must begin with having a personal relationship with Jesus Christ (Revelation 3:20, Ephesians 3:17-19) and that’s what will make us guard our faith jealously and Church will be meaningful.

Police clobber miners in Kitwe

a-policeman-dragPolice in Kitwe battered former Mopani and Konkola Copper Mines Employees for allegedly holding an unlawful demonstration over the decision by Barclays Bank to hold their retrenchment packages.

The battered former miners who were part of the group that had earlier on Friday morning gathered at Barclays Bank to demonstrate over the banks decision to hold their terminal benefits have since been arrested and charged with conduct likely to cause a breach of peace.

Copperbelt police Acting Commanding Officer Daniel Kasonde confirmed the incident to ZANIS but said the former Miners had no permit to hold a peaceful demonstration hence the decision by Police to arrest them.

The former Miners who were retrenched amid the global economic crisis and falling Copper Prices early his year had obtained loans from the Bank while they were still in employment hence he decision by Barclays to withhold their terminal benefits.

One of the affected miners Lawrence Mwamba said it was unfortunate that police resort to battering the miners who were just demonstrating over a just cause.

He said the affected Miners had lost all their retrenchment packages and that it was unfortunate that people who were just peaceful could be injured and battered in such a manner.

Mr. Mwaba said when they were obtaining loans Barclays Bank did not indicate in the memorandum of understanding that they would grab their terminal benefits in an event that they lost their jobs.

And Barclays Bank Corporate Affairs Manager Webster Malido said the bank was committed to working and find an amicable solution with the affected Miners.

Mr.Malido in a statement obtained by ZANIS indicated that the Bank has shown willingness to discuss and iron out the problems with the affected customers.

Chipata Farmers stuck with their maize produce

Scores of peasant farmers in Chikando area in Chipata district in Eastern province are stuck with maize because Food Reserve Agency can no longer buy the crop.

A check by ZANIS at Chikando satellite depot in Chikando ward in Luangeni constituency found that most farmers were stunk with their produce.

One farmer talked to said that FRA was only purchasing 20 x 50kg bags from each farmer.

Mr. Fackson Mtonga said that each farmer in the area had produced more 1000 bags of maize adding that it was unfair for FRA to only purchase 20 bags out of 1000.

Mr. Mtonga said that unscrupulous businessmen have also invaded the area and whre buying a 50kg bag of maize at K40 000.

FRA at Chikando satellite depot was given a target to purchase 4690 x 50kg of maize.

And area Member of Parliament Angela Cifire has assured the farmer in the area that FRA would purchase their maize as government has allocated more funds to the Agency to buy more maize.

Ms. Cifire told farmers that all their produce would be purchased because government would soon release fund to FRA.

She advised farmers in her not to panic selling their produce t unscrupulous businessmen who were exploiting the market price.

Ms Cifire who is also Youth, Sport and Child Development Deputy Minister is in the area to monitor some developmental project in her constituency.

Zambia Open Rnd-2 Wrap-Up

Only two Zambia’s made the cut for the final round of this years Zambia Open that ends tomorrow at Ndola Golf Club.

Madalisto Muthiya and Patrick Mwendapole were the only ones from 17 local entries to make the cut for final third round of this years event on the 88-year-old Ndola course.

Muthiya finished level after dropping a shot from 1-Under on  Friday to 1-Over on Saturday in 41st place while Mwendapole finished at 1-Under to qualify with a two day total of 1-Over 147.

Meanwhile, South African Neil Schietekat who led from day-one remained firmly on course for his first-ever Zambia Open title after carding a  2-day total of 11-Under 135.

Schietekat finished round 2 at 3-Under, failing to replicate his 1st round 1 score of 65 after a triple bogey on the 7th hole on Saturday.

And another South African Anton Haig lit-up the tournament with a hole-in-one on the 3rd.

Meanwhile, defending champion Tyrone Ferreira rebounded after a poor day-1 on Friday from level to 6-Under 67 today.

2006 and 2007 champion Steve Basson almost qualified after finishing level together with Muthiya.

Zanaco Draw..Again

Zanaco recorded their second successive draw today this time away to Green Buffaloes.

The game ended 1-1 at Nkoloma Stadium in Lusaka to see Zanaco move up one point from 47 to 48 points on the table, 8 more than 2nd placed Zesco United.

Buffaloes were on target through Linker Mwikisa while Zanaco’s striker and the league top scorer Patrick Kabamba got one for the leaders to score his 20th goal of the season.

Elsewhere, Power Dynamos beat Kabwe Warriors 1-0 thanks to a 55th minute goal from Kennedy Mudenda.

Choma Eagles were the biggest winners on the day after a 2-1 home win over Chambishi thanks to goals from Aubrey Zulu and Diamond Chigwegwe.

Vanacious Mapande scored Chambishi’s lone goal.

Forest Rangers, like Power, also won 1-0 at home where they beat Red Arrows, Mala Besa there the scorer for the hosts.

Kaiser Kalambo’s  Konkola Blades also won by a lone goal and they defeated Nakambala Leopards courtesy of a Mulenga Mwape goal in the 75th minute.

And in Ndola, there was another 1-0 score line in the game between hosts Zamtel and away side Roan United.

Zamtel were the winners in that match after Francis Kamfwa  scored to hand his side the 3 points.

President Rupiah Banda has commended the Kingdom of

Swaziland for its relentless efforts aimed at addressing security concerns in the SADC region.

The President was speaking yesterday during a State Banquet hosted in his honour by King Mswati III, at Lozitha Royal Palace.

The Kingdom of Swaziland is the current chair of SADC’s organ of political, Defence and Peace in the region.[quote]

Mr Banda said the process so far made in Magadascar negotiations had been possible due to the role Swaziland had played in the early days of the crisis.

“In the same vein, I wish to applaud SADC’s efforts through its special envoy former President Joachim Chissano of Mozambique for trying to restore peace in Madagascar. We look forward to a successful mediation in the interest of our sub-region,” President Banda said.

The president said there was need for urgent revival of the Zambia-Swaziland Joint Permanent Commission (JPC) of Cooperation because the two countries shared a historical bond friendship and affinity.

He said the common desire of the two countries for economic growth and sustainable development gave them impetus to explore new areas of economic, social and political cooperation which would be beneficial to both countries.

Mr. Banda said Zambia and Swaziland enjoyed common membership to international organisations such as the African Union, the Commonwealth and the United Nations.

At these fora, the two countries shared common positions like the Africa’s common stance on the reform of the United Nations as embodied in the Eluwlini Consensus.

President Banda said in addition, Zambia and Swaziland shared same aspirations as they both envisage an African Continent free from debt, disease, poverty, economic stagnation, oppression and conflict.

He said the two countries should show the same resolve which characterized efforts in support of the liberation struggle in Southern Africa.

The President re-affirmed government’s commitment to cooperate and increasing of interaction with the people and government of Swaziland.

And King Mswati said he was pleased that SADC had continued to uphold dialogue whenever conflicts arose because this approach had continued to pay dividends in the region.

The King said the negotiations aimed at ending the political crisis in Madagascar were encouraging because all parties had been willing to put aside their political interests in the interest of their country.

He said the Swazi nation has continued to protect and preserve its cultural heritage which had become their symbol of identity and unity over time.

“These cultural ceremonies have been passed on from generation to generation and they make us unique,” King Mswati said.

The King said the Reed Dance traditional ceremony which President Banda was invited to witness had been unifying the people of Swaziland as a nation for a long time.

He said the ceremony brought chastity pride and nationalism to the young girls in the country.

The Clash between MMD and PF Cadres

I wish to comment on the recent clash between Movement for Multi-party Democracy (MMD) and Patriotic Front (PF) cadres outside Lusaka magistrate court complex during the trial of Post news editor Chansa Kabwela yesterday.

The scuffle left one PF cadre with a deep cut on the forehead.

Joseph Chama was allegedly hit with a screw driver during the physical confrontation.

He was immediately rushed to the University Teaching Hospital for treatment.

What is really the source of such savage and uncivilized behavior among political cadres in our beloved country?

We need to learn to engage in politics without physically assaulting others. We need to remember that we are Zambians first in spite of the different political parties we belong to.There are 73 different tribes to which we belong, or the different languages we speak. And we also have the same dreams as members of the larger Zambian family!

As we seek to improve the livelihoods of each and every Zambian, we should put our political alignments, tribal identities, religious convictions, and professional affiliations aside and work together as a nation. We need to strive to create a society in which political, ethnic, cultural, racial, and religious diversity is appreciated, tolerated and celebrated.

We should not allow politics to create divisions amongst us to the extent of battering each other during campaigns and whenever we have differences in opinion over national issues. We should avoid acting savagely toward one another. And we need to pray for one another, and for our beloved country. After all, we are one and the same people – we are members of the Zambian family!

EVANGELICAL Fellowship of Zambia (EFZ) has said Director of Public Prosecutions (DPP) Chalwe Mchenga acted within the law to withdraw the notice of appeal filed by the Taskforce against the acquittal of second Republican president Frederick Chiluba.

EFZ Executive Director Bishop Paul Mususu said in an interview yesterday that the DPP acted within the powers conferred on him by the Constitution.

Bishop Mususu advised political leaders and Zambians in general to exercise caution when commenting on Dr Chiluba’s acquittal, saying there was need to avoid statements that would divide the country.

He said Zambians should realise that the powers to prosecute were only vested in the DPP and that the people should not think desired results in the fight against corruption could only be achieved once Dr Chiluba was jailed.

The bishop advised political leaders to take a lead in uniting the nation by sticking to what was required of the law when making statements over Dr Chiluba’s issue.

He said there was need for Zambians to avoid only hanging on to Dr Chiluba’s case but also realise that the country needed to move forward if it was to develop.

And Lusaka lawyer, Kelvin Hang’andu has petitioned the High Court to dismiss Director of Public Prosecutions (DPP) Chalwe Mchenga’s withdrawal of the notice of appeal filed by Taskforce prosecutor, Mutembo Nchito against the acquittal of former president Frederick Chiluba.

Mr Hang’andu said in a petition filed in the Lusaka High Court registry yesterday that although the DPP had the authority to stop the appeal against Dr Chiluba’s acquittal, he should have consulted the attorney general before doing so.

“The DPP willfully neglected to obtain the requisite directions from the attorney general as prescribed by Article 56(7) of the Constitution before acting as such,” Mr Hang’andu said.

Attorney General Mumba Malila said in an interview yesterday he had not seen the petition and would only comment after studying the document.

Mr Hang’andu said in the petition that because the DPP did not seek the attorney general’s advice, his action amounted to abuse of or unlawful use of public office.[quote]

He said by withdrawing the notice of appeal filed by the Taskforce on Corruption, the DPP stifled the constitutional right and freedom granted to parties to a criminal trial, of equal protection of the law as enshrined by Article 11 (a) of the Constitution.

Mr Hang’andu wants the court to order that the notice of intention to appeal in the case against Dr Chiluba was validly entered and must proceed by the High Court in a regular manner.

On Thursday, Mr Mchenga said the State will not challenge the acquittal of former President Frederick Chiluba because the appeal is unlikely to be successful.

Mr Mchenga said that evidence before court shows that the Zamtrop account from which Dr Chiluba was alleged to have stolen about $500,000 received money from sources other than the Government.

“An appeal should only be made when there is a likelihood of it succeeding. Appealing because of concerns of members of the public without regard to the likelihood of success is actually an abuse of the judicial process,” Mr Mchenga said.

Mr Mchenga said there was evidence before court that money in excess of US$8.5 million was paid into the Zamtrop account from other sources and Dr Chiluba made a statement that some money had been placed into the account on his behalf.

Chinese company refuses to pay for injured employee in Sinazongwe

The Chinese Coal Mine management in Sinazongwe district has refused to provide a K10 million required for an operation of their employer injured in a mine accident and compensation for a miner whose arm has been amputated.

Dallas Bbulukwa, brother to the paralysed miner who was admitted to the University Teaching Hospital (UTH) and later referred to the Italian Orthopedics Hospital,has been told to pay K10 million for the operation.

He named his brother as Shadrick Shandima of Vwavwa village in Chief Sinazongwe area who recently sustained a deep cut on his right foot, a dislocated ankle, and general body pains at the Chinese Coal mine at shaft one.

Mr. Bbulikwa said the Chinese management has told him that they would rather treat him themselves rather than take him to the Zambian hospitals because they allegedly have no proper medication.

He said the Chinese Directors want his brother who is supposed to undergo three operations on his right foot to be treated at their mine where there were no facilities.

Mr. Bbulukwa noted that the Chinese directors were trying to run away from paying the medical fees when his brother was paralysed as a result of the mine accident.

Sinzo Muzyamuna the other miner whose arm has been amputated after he was injured in a mine accident last month said the Chinese directors at shaft three have refused to compensate him.

Mr.Muzyamuna said doctors from Choma have declared him to be discharged on medical ground.

He said the Chinese Directors only offered to be pay him a K240, 000 for a period of one year six months which he has rejected.

Muzyamuna appealed to government to assist him to get his compensation that befits the nature of damage done to his body.

Govt urged to revise employment Act

Global Labour Consultant and Rights Services Director Agrippa Tembo has urged government to revise minimum wages and conditions of Employment Act, cap 276 enforced since May 2006.

Mr. Tembo said the act stipulates that no worker shall be paid less than K 268, 800 as basic salary, adding that it was his
organisation’s suggestion to add lunch allowances of not less than K70, 000, K80, 000 for transport and K50, 000 as tools allowance among other allowances.

He said that there is need for labour law subjects to be introduced in secondary schools so as to equip school leavers with knowledge about labour laws and their rights.

He has further asked government to include a provision for death benefits in the minimum wages, resignation benefits, and 14 days paid paternity leave for men to help their wives.

Mr. Tembo said and the provision for casual employee should be repealed as it encourages employers to put workers on rolling contracts.
