Doctor testifies in Findley rape case

The Ndola Magistrate Courts this morning heard that findings of the medical examinations carried out on the juvenile alleged to have been raped by MMD Copperbelt Provincial Chairman Terence Findley, were inconsistent.

Appearing before Ndola Principal Resident Magistrate Chilombo Phiri, Dr Adolphus Obi, the Acting head of Obstetrics and Gynaecology department at Ndola Central Hospital, said findings on tests carried out on the juvenile were not conclusive.

During cross-examination in the continued hearing of the case, Dr Obi who did not personally examine the juvenile explained that the victim had no bruises and no injuries on her.

“From the findings it is very inconclusive for the charge of rape because there were no bruises and no form of injuries were found,” he said.

But the Doctor confirmed that the victim had scars on her left hand and buttocks.

The defence team is lead by Eric Silwamba, Paulman Chungu and Lawrence Matibini.

Meanwhile, the Ndola Magistrate Court grounds had a heavy presence of police officers in uniform and plain clothes as MMD cadres chanting party slogans had come to show solidarity to their party chairman.

Police in London recover 79,000 pounds of ‘plundered Zambian money’

Police in London have recovered 79, 000 British pounds in an account of an Ethiopian national believed to be plundered resources for the Zambia government.

Task Force on Corrption was informed by Swindon police about a money transfer transaction made into the account of the Ethiopian national in suspicious circumstances.

Task Force on Corruption spokesperson Victor Makayi who confirmed the development in a statement today said the British police have since obtained a court order freezing the suspects (Ethiopian national) bank account and took him for questioning.

According to Mr. Makayi, the suspect told the police that thge money was not his, but that he had allowed the Canadian Bank Note Company (CBNC) to transfer into his account monies which they claimed was owing to Mr. Faustin Kabwe.

Mr. Kabwe was engaged by CBNC as their Zambian representative through a consultancy agreement with the Bank of Zambia in 1999.

The Task Force on Corruption believes that the transaction was an attempt by Mr. Kabwe to hide the moeny from the effect of the World Wide Freezing court order which is enforceable on him.

The freezing order does not allow Mr. Kabwe to receive monies without disclosure to the London court.

Mr. Makayi said following instructions from the Task Force on Corruption, the lawyers in London contacted Barclays Bank Swindon and served upon them the original world freezing order thereby putting them on notice of Mr. Kabwe’s status.

He said the Bank has since confirmed to the lawyers that the monies will remain frozen pursuant to the post judgement freezing order and that they will comply with any court order the lawyers will obtain.

Recently, the lawyers in London engaged by the Task Force, have obtained from the account holders (Ethiopian man) solicitors, a signed declaration, confirming that he has no interest in the funds in his account.

Furthermore, a letter has been obtained from the Canadian Bank Note Company, confirming that the funds they paid the account holders account, were payable by them to Mr. Kabwe in respect of commission due to him and that they have no interest in the money.

Mr. Kabwe has made an appeal an application in London for leave to appeal against the London judgement and the last indication on timing from Court of Appeal was that all applications would be reviewed by a single Lord Justice of Appeal during the course of this month.

Therefore, as matters currently stand, the monies are frozen by the bank, pursuant to the post judgement freezing order and the evidence the Task Force has supplied to them of Mr. Kabwe’s ownership of the funds.

If Mr. Kabwe’s application for leave of appeal is dismissed the Task Force will seek through its lawyers, an order paying the funds to the Attorney General of Zambia in accordance with the judgement.

Man, 38, commits suicide in Mwinilunga

Mwinilunga, November 21, ZANIS – A thirty eight year old male of Kabanda township has committed suicide in Mwinilunga district in an unexplained circumstances.

Noah Sandu was found hanging to a mango tree in the early hours of yesterday by passers by by.

A police officer who sought anonymity disclosed that the body of the late Mr Sandu was found hanging to the tree around 05:00 hours.

“We found the body of Mr Sandu hanging in a mango tree after we got a tip off from the public. That is when we rushed to the scene to retrieve the body from the mango tree” said the Police officer.

The body of the late Mr. Nsandu is lying in Mwinilunga hospital mortuary awaiting burial.

The cause of suicide has not yet been established and investigations have since been instituted.

Former African heads of states AIDS meeting opens in Livingstone

The workshop for former African leaders called to discuss the challenges posed by the HIV and AIDS pandemic to the socio-economic development of the continent opened in Livingstone today.

The former heads of states in attendance at the three-day workshop taking place at the Zambezi Sun hotels include Tanzania’s second president Ali Hassan Mwinyi, his successor Benjamin Mkapa, Bakili Muluzi of Malawi and Pierre Buyoya of Burundi.

Others distinguished officials are former African union secretary general and prime minister of Tanzania Salim Ahmed Salim and executive secretary of the Africa Forum Dr John Tesha.

United Nations development programme resident coordinator Aeneas Chuma and senior Zambian government officials are also in attendance.

Opening the workshop, President Mwanawasa said Zambia has made great strides to prevent the further spread of the pandemic and mitigate its socio-economic impact.

In a speech read on his behalf by defence minister George Mpombo, Dr Mwanawasa said the country has adopted a multisectoral approach to prevent infection, treat, and care and support the infected and the affected.

He told the leaders that Zambia is greatly honoured that its president Dr Kenneth Kaunda is among those in the fore front fighting the pandemic.

Dr Mwanawasa said the Zambian response to the pandemic has involved formulation of policies and guidelines citing the national HIV/AIDS/STI/TB policy and the policy on providing free antiretroviral drugs in public health institutions.

And in a vote of thanks, African Forum executive secretary said the solution to the AIDS pandemic does not lie with the donor community but within Africa.

Dr John Tesha said there is now need for more action than rhetoric.

During the three days workshop the former leaders will also engage in dialogue with children who have been impacted by HIV and AIDS while they are also expected to visit various places where they would be confronted with brutal facts of the pandemic and reflect on the issue together.

Stakeholders requests ERB to reject ZESCO’s proposed electricity tariffs

Various individuals and industrial electricity consumers have asked the Energy Regulation Board (ERB) to reject the proposed electricity tariff increase by the Zambia Electricity Supply Corporation ( ZESCO).

ZESCO has proposed electricity tariff increment of between 40-45% for domestic users and 70-75% for the industrial sector.

Zambia National Farmers Union (ZNFU) first vice president, Jervis Zimba said at a public hearing on the ZESCO tariff review in Lusaka today that the proposed increment for the industrial sector is too high as it will have a direct impact on production costs and prices of items in the basket of goods that are monitored for inflationary trends.

Mr Zimba noted that if the cost structure of the Zambian producers becomes unfavourable, this will adversely affect food balance and will undermine the country’s position as the potential food basket of the region.

He observed that there is need to ensure that the cost of power to productive sectors of the economy remains as low as possible in order to derive full benefits from Zambia’s natural comparative advantage in agriculture.

Mr Zimba said that the proposed tariffs should be reversed with 40-45% being for the most productive sectors and 70-75% for non productive sectors.

Mr Zimba charged that the final increase in ZESCO tariffs that will be agreed upon should translate into improved funding for maintenance works at the local level so that the supply of electricity can become more reliable than the current situation.

He appealed to ZESCO to also publicise information on how much the mining sector are contributing in their current electricity tariffs.

Mr Zimba said electricity consumers need the assurance of ZESCO that the mining sector is paying its fair share of the costs of expansion.

And the Zambia Association of Chambers of Commerce and Industry (ZACCI) Executive Director, Justine Chisulo said the proposed tariff increment by ZESCO was too high and too sudden.

Mr Chisulo said that in as much as it supports tariff adjustments, the proposed electricity increments by the power company was unjustified as the cost of doing business will skyrocket.

He advised that ZESCO should among other things try to recover over K300 billion it is owed by various Government agencies adding that even salaries and gratuity it gives to its contract employees should be reduced for the company to manage its operational costs.

Speaking earlier, ERB Chairperson Sikota Wina said that it is the Board’s objective to ensure that quality energy services are provided at reasonable prices.

Mr Wina noted that since its inception it has dealt with more than 10 tariff reviews for ZESCO.

He noted that this year’s review has been most comprehensive adding that it attracted 60 submissions and more stakeholders than before.

Mr Wina further noted that the review has come at a wake of a looming power deficit both in Zambia and in the entire Southern African Region.

The Zambia national soccer team this afternoon takes on Tanzania in a friendly match at the National Stadium here in Dar es Salaam.

The match will to be played on an artificial turf at the old national stadium that stands dwarfed next to the brand-new Chinese-built 60,000 seat arena.

It is the first of two pre-Africa Cup build-up match lined up for Patrick Phiri’s team.

The other confirmed match is against Tunisia to be played on January 6 away in Tunis.

For today’s friendly, Patrick Phiri will have three foreign based players available for the match here in Dar es Salaam.

They include the Angolan based duo of strikers Dube Phiri and debutant Nephias Banda former of City of Lusaka and Power Dynamos.

Veteran defender Clive Hachilensa of Finland club Mariehamn is the third foreign-based player in the team.

Phiri will have no regular’s goalkeeper available for this match and has Roan United’s Mufwaya Makasa and Mike Poto of Green Buffaloes to battle for a place in-between the sticks this afternoon.

Cadres petition MMD secretariet to expel Findlay

Ndola, Nov 20, 2007, Zanis – The MMD in Ndola has petitioned the MMD Secretariat to expel their provincial chairman Mr. Terence Findlay from the party.

A group of party women and youths staged a peaceful demonstration at the provincial minister’s office today where they requested the party president to expel their provincial chairman for ill conduct.

Copperbelt provincial minister Mr. Mwansa Mbulakulima endorsed their action and called on the secretariat to take action against Mr. Findlay alleging that his actions amounted to extreme indiscipline, insubordination and insolence.

He said he could not understand why Mr. Findlay chose the press to air his concerns when by virtue of being a provincial chairman, he was a member the party national executive committee.

The provincial minister added that findlay’s conduct should be dealt with firmly because it could create indiscipline in the party.

He said there was need to foster discipline in the party structures if the MMD was to win the 2011 elections.

He said national leaders in the party needed to exhibit tolerance and humility at all times.

He assured the party cadres that the petition which they presented to him would reach the National Secretariat today without further delays so that appropriate action against Mr. Findlay is taken.

And District Youth Chairman Mr. Richard Mofya said Mr. Findlay was a sympathiser of the past regime and should not be allowed to bring the new deal administration into disrepute.

He said Mr. Findlay’s conduct had disgraced the party and attracted shame on the party leaders.

He said Mr. Findlay has failed to cope with the high levels of integrity that President Mwanawasa has been insisting on in public office.

He appealed to Dr. Mwanawasa to expel Mr. Findlay from the party.

Govt signing of MoU with mining explorations firm irks chief Mushima

Chief Mushima of Mufumbwe district the recently announced signing of a memorandum of understanding between government and ZAMKOR to carry out mineral explorations in his chiefdom was done without the consultation of the local people.

Chief Mushima said in a statement today that he was shocked to hear Local government and Housing Deputy Minister Ben Tetamashimba’s announcing that government signed an MOU with ZAMKOR to carry out mineral explorations in Lwamakambi, in Mufuambwe district without his knowledge.

He described the announcement by Mr. Tetamashimba as an insult to his chiefdom and a disgrace to his royal establishment.

He claimed that Mr. Tetamashimba, who is also Solwezi Central member of parliament had not consulted him over the mineral explorations in his chiefdom.

He said that he was not against promoting economic development in Zambia and North Western province in particular, but that such important investments should be made in consultation with the local people.

Efforts to get a comment from Mr. Tetamashimba failed by press time.

Sinazongwe Council opens up new roads and streets for development

Sinazongwe District Council Secretary has disclosed that the council has started opening up roads and streets in line with its land development programme following the completion of the surveying of the entire district. 

Oliver Muuka said in Sinazongwe that the Council has hired the bull dozer for Zongwe Farming a local company to open up the roads and streets. 

He said work was progressing well though government did not allocate the entire amount that the council had budgeted for to complete the work under the land development programme.Out the K800,000,000 that the council had budget for Mr. Muuka said government released K500,000,000 and the shortfall of K300,000,000 would make the local authority fail to meet its target.“The shortfall of K300, 000,000 was meant for opening up of the roads and streets but at the moment we will do with what have, and it will attract people to acquire plots and the money from it will be a revolving fund for further developments,” Mr. Muuka said. 

The Council secretary pointed out that there has been a good response from people wanting to acquire plots following the completion of the surveying of the district. 

He said more than 60 people had applied for plots in September adding that the opening up of the roads and streets would attract more people to acquire plots. 

This year the Council received K500, 000,000 from government under the land development programme which has enabled them to survey Maamba Township, Sinazeze, Sinazongwe, and the opening of the new Siansowa Township.                                           ZANIS 

Sunday Nkonde dropped

PRESIDENT Mwanawasa has with immediate effect terminated the services of Solicitor-General, Sunday Nkonde.

State House Chief Analyst for Press and Public Relations, David Kombe, announced the development in a statement in Lusaka last evening.

In a letter to Mr Nkonde, Dr Mwanawasa thanked him for the services he rendered to the nation and wished him the best in his future endeavours.

“I wish to inform you that I have pursuant to Article 55(3) of the Constitution of Zambia removed you from office, as Solicitor General with immediate effect,” Dr Mwanawasa said.

FRA owes farmers in Petauke K8.9 billion

Petauke District Commisioner David Tembo says the food Reserve Agency (FRA) owes Petauke district farmers K8.9 billion.

Mr. Tembo disclosed this to ZANIS in an interview at his office today.

And two farmers found at the DC’s office to seek clarification on when the FRA will release the money, said they were disappointed at the manner in which the FRA handled the issue, accusing the FRA of corruption.

One of the farmers of Muliluzye corporative in chief Mumbi’s area, Saulosi Zulu, said he sold 29 bags of maize to FRA in July this year but up to now he has not been given the money.

Some of the farmers had sold as much as 500 bags of maize each in the same month but they have since not been paid.

They said such a poor system of payment hindered farmers from accessing farming inputs that was likely to cause serious hunger in the next harvest season.

When asked on the payments, the district commissioner said it was not clear as to when these farmers will get their money from the FRA.

But sources at the FRA said farmers will get their payments after the agency has sold part of the maize purchased from the farmers.

Mr. Tembo said farmers needed to exercise patience as government was doing everything possible to settle the payments.

The curtain looks set to come down on one of the longest and most controversial coaching reigns this decade on the Zambian football scene.

Celebrated as a rampaging winger, Peter Kaumba faces an unceremonious exit as Zambia Under-23 coach after six years in charge following his team’s emphatic 4-1 away defeat against Cote d’Ivoire in an Olympic qualifier played in Abidjan on Sunday.

The Ivorian’s win meant the West African nation qualified for next Summers Olympic Games football tournament for the first time ever on an unassailable 12 points with a game in hand.

“That (My future as Under-23) is up to the appointing authority and I’m sure that issue will be discussed,” Kaumba said from Abidjan on Sunday after the defeat when asked whether he still had a role to play in team 2011 when Zambia is expected to host the All-Africa Games.

To most Kaumba is aloof, arrogant and unmovable and as rigid as his much-loved 3-5-1 system.

He isn’t also the easiest of coaches to interview and is very famous for his cut and paste comments.

However, his comments in the build-up to the Olympic qualifier in the local press did not go unnoticed and with Sundays score line, it was now a serious case of whose laughing now.

Kaumba is sure to ride the criticism as he endured three difficult and vitriolic seasons as coach at Kitwe United from 2003 to 2006 where he was unmoved all throughout his reign at Garden Park-win or lose.

Many have attacked him for not heeding to popular cry to draft in playmaker Rainford Kalaba and Clifford Mulenga to the team to counter a potential Cote d’Ivoire coup de grace with the drafting in of Chelsea’s striker Solomon Kalou.

Kalou scored one and was influential against Kaumba’s men in the coach’s forgettable return to the land he enjoyed brief success as a player in the mid-80’s at Africasports.

Despite his shortcomings, Kaumba has enjoyed a good run with the Under-23 taking them past the last eight of the two All-Africa games tournament.

Kaumba has also overseen the development of senior national team mainstays Kennedy Mweene, Billy Mwanza, Collins Mbesuma, Jacob Mulenga and Christopher Katongo-all gradutes of his class of 2003.

And on both All-Africa Games occasions, a podium finish eluded him and had to settle for fourth place.

The Olympics, however, is a whole different story.

Kaumba could be excused for his failure in qualifiers for the 2004 Greece finals when Ghana beat them in the race with Kalusha Bwalya taking charge for the decider played in Accra.

In Abidjan this time around Kaumba was left to his own devise and it will be interesting to see how one of the most emotionless figures on the Zambian bench will recover from this episode.

Zambia under 23 beat Malaw 6 – 1

1.JPG1.JPGThe under 23 Zambia National Soccer Team yesterday won the Malawi Premier League 6 goals to 1.

The match which started at around 15:30 and ended at 17:25 hours at David Kaunda
Stadium in Chipata saw Zambia’s Timothy Mbewe scoring the first goal 7 minutes after
the game started while the second one was coverted 20 minutes later by Reuben Tembo.

Speaking just after the game, Assistant Zambian National Soccer Team Coach Wesley
Mondo, said the aim of the game was not to win but to equip the team adequately as
they prepare for the Olympic games that will take place on the 22 of August 2007.

Mr Mondo said the team will tomorrow have another game with the Eastern Province
selected side and this will give them an opportunity to scout for good players from
Eastern Province.

Mr. Mondo said the Malawian team posed a good challenge to the Zambian Team and has since called for such friendly matches in future.

Meanwhile Burger World Co-Director Charles Kumwenda, who is one of the sponsors of
the game, revealed that more than K20 million will spent for the games,
accommodation of the players, food and advertising.

He has appealed to government and the people of Zambia to support such games if they
want to expect good results from the football team.

Mr. Kumwenda said Eastern Province has a lot of talented footballers and believed
that tomorrows game will help in exposing the local players.

The team which arrived in Chipata on 12th August is expected to leave for Lusaka on
17th August 2007.

UPND Siavonga ex-councilor shoots man, 37, for stealing goat

A 37-year-old man is battling for his life in Siavonga district hospital after being shot and wounded by another man for allegedly
stealing a goat.

The man identified as, Jankalo Mwanja, of Mutandalima village was allegedly shot in
the chest by opposition United Party for National Development, UPND, former
councilor for Simamba Ward, Friday Mungazi, for stealing a goat, which he later
slaughtered.

Police sources in the district confirmed the shooting incident and arrest of Mangazi
to help with investigations in the matter.

A check by ZANIS at the hospital found Mwanja undergoing treatment and placed on a
24 hour state security.

The police sources however, disclosed that Mwanja has also been charged with stock
theft and will appear in court soon after being discharged from hospital.

And Mungazi has admitted having shot Mwanja on Saturday night using a shot gun after
concerned villagers alerted him that Mwanja, in the company of another unknown man
had stolen the goat, which was being slaughtered in the nearby bush.

” I was informed by villagers that they saw my goat killed and hanged on a tree in
the bush. I went to the scene around 14: 00 hours armed with a shot gun but did not
find anyone. I then decided to wait until 20:00 hours when I heard two men talking
and coming towards the place where they left the carcass,” he said.

Mungazi said he then rushed to the scene and found the duo packing carcasses of the
goat adding that Mwanja and his accomplice immediately upon seeing him decided to
escape.

He further narrated, he was forced to open fire in the air in an effort to scare
them but to no avail hence his move to shoot Mwanja in the chest in a bid to
apprehend him.
