Constitutional Court JudgesThe Constitutional Court has reserved ruling on whether or not its final decision in a matter can be reopened without seeking its permission in writing.
This is in a matter the Law Association of Zambia (LAZ), as the third petitioner, filed a preliminary issue to discontinue a motion by PF Secretary General, Davies Mwila asking the Court to set aside or reverse its own decision that Ministers who remained in office after the dissolution of parliament should pay back the money they received.
In its preliminary issue, and relying on the skeleton arguments filed in Court, LAZ has argued that the respondents who are Mr. Mwila and the 64 others did not seek permission of the Constitutional Court when they filed a notice of motion and an affidavit asking the Court to reopen its final decision.
And when the matter came up, lawyer representing LAZ Jeffrey Chimankata argued that Order 1, rule 2 of the Constitutional Court does not provide for the reopening of the Court’s final decisions without prior permission in writing.
Mr. Chimankata contends that it is therefore mandatory that if the Court is to reopen its final decision in unique cases, the mover of the motion will have to first put it in writing.
In response counsel representing the respondents Chewe Bwalya argued that there are no requirements for moving a motion to cause the reopening of the final decision of the Constitutional Court.
Mr. Bwalya urged the Court to dismiss LAZ’s preliminary issue as the Court has jurisdiction to give direction where there is no precedence in practice and procedure.
Another lawyer representing the respondents Milingo Lungu urged the Court to evoke Article 118 of the Republican Constitution.
In reply, Mr. Chimankata contended that there is no rule that allows the Constitutional Court to derogate from its own rule.
Mr. Chimankata has insisted that the Court has its own mandate to follow.
Constitutional Court president Hilda Chibomba has since adjourned the matter to a date to be communicated to the parties.
Vice President Inonge WinaVice-President Inonge Wina has called for stronger trade and diplomatic relations with Turkey because of the country’s potential to contribute to Zambia’s development aspirations.
Mrs Wina said Turkey remains a strategic country to Zambia’s development agenda because of the high-levels of development that the country has recorded in recent years.
“We have noticed that development in Turkey is much higher than in many developed countries, this is a very strategic country and Zambia needs to forge stronger trade and diplomatic relations,” Mrs Wina said.
The Vice-President said this when Zambia’s Ambassador designate to the Republic of Turkey, Mr Joseph Chilengi and Zambia Honorary Consul in Istanbul, Dr Bulent Goktuna, paid a courtesy call on her in Istanbul today.
Mrs Wina transited through Istanbul on her way to attend the African Union (AU) Heads of State and Government summit in the Islamic Republic of Mauritania.
“This is a country that is enjoying development from almost three worlds it borders, its geographical position gives it a status that is much more enriched by the civilisations around. Turkey is between Europe, Asia and to some extent, the Middle East,” Mrs Wina said.
She added that President Edgar Lungu’s administration was pursuing a fore?gn pol?cy anchored on econom?c diplomacy to attract the much needed Foreign D?rect Investment (FDI) to create jobs for the c?t?zens.
Mrs Wina urged diplomats to step up promotion of the country as a tour?sm and ?nvestment destination of choice and to facilitate bus?ness partnersh?ps between foreign companies and local firms.
“We have been mining copper for so many years but I think there is a gap somewhere, we need to get into the value addition of copper for the country to benefit from that resource,” Mrs Wina said.
She also congratulated Turkey for holding successful Presidential and parliamentary elections in which incumbent President Recep Tayyip Erdogan emerged victorious to become Turkey’s first executive President under the new constitution.
“We believe that President Erdogan is a strong leader who has maintained the unity of the country,” Mrs Wina said
She said to cement the existing warm relations between the two countries there was need for increased high-level reciprocal visits.
The Vice-President thanked the Government of the Republic of Turkey for the warm reception accorded to her, which demonstrated the existing strong relations between the two countries.
And Mr Chilengi thanked the Vice-President for the visit and expressed hope that she would visit Turkey in the near future to complement efforts to strengthen relations between the two countries.
He said the Mission was working hard to promote Zambia as an investment and tourism destination of choice in line with the country’s foreign policy.
Vice-President, Inonge Wina will represent His Excellency, Mr Edgar Lungu, President of the Republic of Zambia, at the summit to be held in Nouakchott from June 25 to July 3, 2018, under the theme “Winning the Fight against Corruption: A Sustainable Path to Africa’s Transformation”.
Mr Fresher Siwale and Mr Mike Mulongoti when they went to file a complaint to the Office of the Public Protector about President Lungu’s identify recently.I have never accused President Edgar Lungu of being a foreigner. All I wanted was approval of his nationality through the Public Protector says, Peoples Party president Mike Mulongoti.
Mr Mulongoti said there was nothing strange for him to ask the Office of the Public Protector to verify President Lungu’s nationality as previous Presidents had been asked to do so.
He said he only wrote to the Public Protector to ascertain if President Lungu was indeed Zambian and it was New Labour Party president Fresher Siwale who accused President Lungu of being a foreigner.
He said he had formally written to the Public Protector and nowhere in the letter did he accuse President Lungu of being a foreigner.
Mr Mulongoti told the Daily Nation in an interview that President Lungu and his supporters were the ones who had dragged the matter and blowing it out of proportion by not responding to the letter he wrote to the Public Protector.
“What I did is just to write to the Public Protector, so that President Lungu Should provide his NRC to the institution for verification and it should have ended there but he has not yet done so, there is no need for us to know Mr Lungu’s relatives,” he said.
Mr Mulongoti said it was immaterial that the President visited his relatives recently as that was not the issue at hand.
“All we are asking from Mr Lungu as a public officer is “tizibane” formally by going to the public protector, he himself asked the same questions to Dr Chiluba when he was practicing as a lawyer,” he said.

Mr. Malanji says President Edgar Lungu abhors Corruption and that it is for the reason that he has constantly asked ACC to conclude investigations on the cases.
Mr. Malanji says it is also for this reason that Government is strengthening structures to fight the scourge.
Mr. Malanji says corruption is a cancer that needs to be fought tooth and nail.
Meanwhile, Zambia will not fail to pay its debt, Finance Minister Margaret Mwanakatwe said on Thursday, after concerns emerged about Zambia’s debt levels.
Mrs Mwanakatwe also told parliament that Zambia, one of the largest copper producers in Africa, would keep reviewing its mining tax regime to ensure it is in line with “what the country wants”.
FAZ Division One Zone Two leaders Mufulira Wanderers need one point from Saturday’s top of the table clash against Konkola Blades to qualify for the 2018 Barclays Cup.
Mighty, who returned to the top after midweek games, host second placed Konkola at Shinde Stadium with the aim of avoiding losing to remain top as the Division One season reaches the middle.
Wanderers have 31 points, two ahead of second placed Konkola, after 14 matches played.

Green Buffaloes visit Nakambala Leopards seeking to cut the gap with leaders and defending FAZ Super Division champions Zesco United to one point.
Second placed Buffaloes have 44 points behind Zesco who only play on Sunday when they visit Forest Rangers in an Ndola derby.
But Buffaloes visit a Nakambala side that has lost just twice this season at their Mazabuka fortress.
Nakambala have so far collected five wins and two draws in their nine home games this season in Zambia’s Sugar Capital.
But 15th placed Nakambala need to finally find some consistent form after collecting just two wins in their last 13 games in which they have also record a mere three draws.
Meanwhile, down the road in Choma, third placed Zanaco visit Green Eagles and will be hoping for a third straight win to help consolidate their position.
Zanaco have 38 points although victory will obviously not change their top three status but instead keep them in close contact with the top two sides.

The Industrial Development Corporation (IDC) has effected a shareholder’s loan to Times Printpak Zambia, towards payment of the three months’ salary arrears for unionised staff.
By close of business on Thursday, Times Printpak had started the process of uploading salary transfers into staff accounts.
IDC Group Chief Executive Office Mr Mateyo Kaluba, said that all transfers would be made on or by 30th June 2018.
He further thanked staff for remaining calm during the process.
“The plan is it to finish all transfers by or before 30th June 2018. I want to thank the staff at Times Printpak for remaining calm during this period as we continue to look for a long-term solution to sustain the company.
On 15th May 2018, the IDC announced that staff at Times Printpak Zambia would be paid three months’ salary arrears after resources were made available for IDC at the end of June through a shareholder’s loan to Times Printpak.
The resources are meant to alleviate pressure on the arrears.
This is according to a statement issued by IDC Public Relations Manager Namakau Mukelabai.
President Edgar Lungu has disclosed that Acting Auditor General, Mr Ron Mwambwa had disclosed to him that he would be resigning to pursue his career interests in the Republic of Liberia.
President Lungu said that he couldn’t resist the resignation as Mr. Mwambwa would be Zambia’s flag bearer in that country.
In a statement issued by Special Assistant for Press and Public Relations Amos Chanda, President Lungu bemoaned the growing culture by some sections of Zambians who have resorted to politicizing everything.
“I had a meeting with the Auditor General prior to his resignation. He told me he was going to Liberia where he would set up an Auditing system.for that country. I thought that was good for him to go to Liberia because he would be a flag bearer for Zambia. It is really sad and unfortunate that there is a growing culture among Zambians, some Zambians to politicise everything on baseless grounds to gain political mileage. Where are We going as a country with this culture?” the President said.
United Part for National Development (UPND) leader Hakainde Hichilema , barely 48 hours after calling on his members to reiterate when provoked, has called for peaceful campaigns ahead of the mayoral and local government by-elections slated for next month.
Mr. Hichilema’s change of stance follows Republican President Edgar Lungu’s growing concern over calls for violence by the opposition despite government’s call for peace during the forthcoming by- elections.
President Lungu said it is retrogressive for the UPND to advise its supporters to revenge when attacked by their political rivals.
The President’s concern follows a video which has gone viral on social-media in which Mr Hichilema is captured urging his supporters to defend themselves when attacked purportedly by PF cadres.
However, Mr Hichilema has now changed his stance by explaining that violence has no space in the modern politics and should be condemned by all well-meaning Zambians.
“We are calling for peace in our nation, violence has no space in the modern politics and should be condemned by all well-meaning Zambians,” he said.
Speaking to journalists yesterday in an interview after taking part in the American National Day celebrations, the UPND leader suggested that all political stakeholders should agree to put in place a peaceful environment to allow for free and fair by-elections in the country.
“All political parties, Electoral Commission of Zambia and the general citizenry should stand up and say no to violence as it puts the lives of ordinary citizens at risk,” he said.
The UPND leader went on further to propose the suspension of the scheduled elections in the country until political players and all stakeholders in the political arena agree to the creation of a peaceful environment to protect and preserve the lives of citizens.
Mr. Hichilema told Journalists that the events and violence that characterized the recent Chilanga by-election require that no elections are held until stakeholders agree to programs and activities that will not lead to violence and not put the lives of the citizens at risk.
The UPND leader recalled that the violence that was witnessed in Chilanga during the recent Parliamentary by-elections should not be given room to reoccur.
Mr. Hichilema said that the Chilanga by-election was not an election but a war that left a lot of people injured in the process, and that this should not be tolerated or repeated at any point in the country.
Mr Hichilema said that it was not too late to call off any scheduled elections whose process has already begun until programs that will create a peaceful environment are put in place and agreed upon by all stakeholders.
Mr. Hichilema stated that no election is worth the lives of people and therefore there is no need to go ahead with elections in dangerous environments that might put the lives of the innocent citizens at risk
Zambia will hold mayoral by-elections in Lusaka and other local government by-elections on 26th July 2018.
Meanwhile, the Electoral Commission of Zambia (ECZ) has warned that it will not hesitate to disqualify any political party that abrogates the Electoral Act from contesting the July 26th by-elections.
ECZ Spokesperson, Margaret Chimanse has said that the commission will not be lenient in enforcing the provisions of the Electoral Act.
Ms. Chimanse told QTV news by telephone that the Commission has a mandate to apply the electoral law firmly in an election.
Ms. Chimanse explained that it was the reason why sometimes the commission engages political parties privately on the laid down rules and regulations for participating in national elections.
Ms. Chimanse said that the role of the ECZ is to act as referee by creating an electoral environment where all participating political parties have an opportunity to win an election.

Vice-President Wina says Government has put stringent measures to fight graft, among them, the establishment of integrity committees in all government institutions.
Mrs Wina says corruption undermines the fabric of society and will not be allowed to take root in Zambia.
“Fighting corruption is not the job of government alone, this is because corruption takes place in both the public and private sector, therefore Zambians must take an active role in fighting corruption”, Mrs Wina said.
The Vice-President also called on stakeholders in the country to desist from sensationalizing and politicizing corruption issues, and giving the public a perception that government is not committed to the fight.
“In fact most of the online issues you hear about corruption in Zambia, this leader or that one is corrupt are often sensationalized and politicized,” Mrs Wina said.
The Vice President said she cannot deny that there are corrupt elements in both government and the Private sector, and encouraged the law enforcement wings to heed President Lungu’s directive to be proactive in investigating and prosecuting cases.
And Mrs Wina observed that the Financial Intelligence Center (FIC) is an important institution government is using to fight corruption in government ministries.
She however regretted that the FIC broke government procedure in disseminating the 2017 trends report to the public before availing it to relevant authorities that are obligated to investigate and prosecute financial crimes.
Mrs Wina also said Zambia supports the African Union Agenda of fighting corruption as a means of attaining sustainable growth.
The Vice-President added that Zambia will, during this AU summit, look forward to seeing concrete agreed positions by African leaders on how to fight corruption.
She was speaking when she made a stop over in Addis Ababa before proceeding to Mauritania for the 31st AU Heads of States and Government Summit.

The ruling patriotic Front has described as misinformation being orchestrated in some sections of the media on reports that their Mayor candidate had promised to deliver free wifi to the resident of Lusaka within 100 days.
In a media statement made available to the media, PF said that what their candidate promised was to start the process for the free WiFi project within 100 days and that he did not say the project would be completed within 100 days as insinuated

Lusaka, Zambia, 28th June 2018 – Patriotic Front salutes the media houses which attended the maiden appearance of its Mayoral candidate Hon Miles Bwalya Sampa when he featured on the PF Interactive Forum on 27th June 2018 where he laid bare his vision which is anchored in the grand Party manifesto for 2016-2021.
For the purpose of clarity, we will address also the misinformation being orchestrated in some sections of the media. This is with regard to some of the pronouncements made by the PF Mayoral candidate, Hon Miles Sampa, as part of his vision for Lusaka.
Hon Sampa said he would ensure that Lusaka City Council starts the process for the free WiFi project within 100 days. He did not say the project would be completed within 100 days as insinuated
In addressing the need for the council to generate income for improved delivery of services, Hon Sampa said he would ensure the rates reflect the economic value as opposed to rates which do not make business sense for the Council. He made a strong case for stakeholder engagement in order to arrive at a win-win situation.
His statement did not mention what is being falsely implied by the said media houses, which is that in 100 days he would hike rates for medium businesses and malls to increase revenue for the council.
Lastly, Hon Sampa was at a barbershop/salon where he met with many other customers and members of the public, among them was former UPND Parliamentary Candidate for Chilanga Constituency Cde Charmaine Musonda.
In the spirit of good faith and mature democratic practice, he exchanged greetings and took pictures together with other members of the Campaign team.
This is as it should be with evolved political contests. We are pleased that while we may belong to different political parties, we are not enemies and must continue being cordial with each other.
This is the unity we would like to see among all our members and all Zambians in all sections of society as we move towards the heroes and unity holiday. We can disagree without becoming personally disagreeable.

Botswana’s President Mokgweetsi Eric Masisi says Zambia and Botswana have the potential to grow trade between the two countries.
Mr. Masisi said this can be attributed to the number of success stories and steady growth of trade that has been recorded among the two peoples.
The Botswana Head of State noted that the two countries have the ability to attract exhibitors from all over the world stating that he is optimistic that Zambia will continue recording more success in her business trade environment.
President Masisi was speaking when he officiated at this year’s 54th International Trade Fair in Ndola held under the theme-Private sector, key to industrialization.
Mr. Masisi thanked his Zambian counterpart for considering him to grace the important occasion which he said demonstrates the strong bond that Zambia has shared with Botswana over the past years.
And President Masisi has encouraged Zambians to take advantage of the favorable economic front in the country to grow their trade base.
And Mr. Masisi has further invited his counterpart to attend that country’s business expo which will be held from October 30 to November 2, 2018.
And President Edgar Lungu said the increased exhibitors from outside the country during the International Trade Fair every year signifies the strengthened bilateral ties and confidence that Zambia continues to share with her neighbours.
The Head of State noted that both Zambia and Botswana have a duty to build on the friendship that the two peoples have continued to share.
He added that it is important for the two countries to reflect on the strides that they shared during the independence struggle.
President Masisi was accompanied by his wife Jane Masisi and senior government officials from Botswana.
