Mwamba advises HH to stop tarnishing Zambia’s image
Zambia’s High Commissioner to South Africa Emmanuel Mwamba has urged opposition United Party for National Development ( UPND ) leader Hakainde Hichilema to positively use his time in South Africa instead of spreading falsehood and consequently tarnishing the image of Zambia.
Mr. Mwamba says the recent claims by the UPND Leader Hakainde Hichilema that Zambia was facing a break down in the rule of law are all lies and based on total fabrications.
He explains that Mr. Hichilema’s recent release from prison together with his co-accused was a demonstration of Zambia’s entrenched rule of law and a tested democracy.
He adds that the recent acquittals of UPND’s Vice President Geoffrey Bwalya Mwamba and the other UPND senior member Obvious Mwaliteta also demonstrate that the independence of the judiciary.
Reacting to Mr. Hichilema’s statements that Zambia’s 2016 general elections remain disputed, Mr. Mwamba clarified that President Edger Lungu won the 2016 elections with clear margin of over one hundred thousand votes representing a percentage of 50.35 contrary to Mr. Hichilema’s claim.
He added that the election of President Edger Lungu in 2016 was pronounced and determined as credible by reputable local and international observers thereby making Mr. Hichilema’s claims unfounded.
Mr. Mwamba has further refuted Mr. Hichilema’s claim that there was no media freedom in Zambia.
“There is a diversified and independent media with over 85 radio stations and 15 television stations including 10 newspaper firms operating freely in Zambia,” he explained.
He added that the suspension of two radio stations Komboni Radio and Itezhi-Tezhi FM and Muvi TV could not be used to justify claims as the named stations were suspended and found liable for using and promoting hate speech.
The Zambian Envoy has also described Mr. Hichilema’s claims that the Zambian Parliament was raided by Police as a fabrication stating that no such incident has ever happened in Zambia.
Mr. Mwamba explained that Zambian nationals who travel abroad are expected to honour their solemn duty and responsibility to the country and not speak ill of the country.
He urged Mr. Hichilema to help promote peace, unity and contribute towards Zambia’s development.
The UPND President is currently in South Africa where he is reported having held a joint press conference with South Africa’s opposition Democratic Alliance leader, Mmusi Maimane in Cape Town.
Mr. Hichilema is reported having stated that there was break down of the rule of law in Zambia, no media freedom in Zambia, the Zambian parliament was raided by police and the President Edger Lungu’s election remains disputed.

Government selling rural prime land to foreign nationals in the name of farming blocks.
In an interview in Lusaka yesterday, Mr. Chanda alleged that Agriculture Minister Dora Siliya recently handed over three hundred and forty thousand hectares of land to the Chinese to form farming blocks and another two thousand hectares of land is yet to be flogged to foreigners who will employ Zambians.
Mr. Chanda has raised suspicion over the sale of land to foreigners through Agriculture Minister Dora Siliya instead of the appropriate Ministry of Lands headed by Ms. Jean Kapata.
“Government that through Ministry of Agriculture is selling rural prime land to foreign nationals in the name of farming blocks” Banda said
The straight-talking United Peaceful and Prosperous Zambia (UPPZ) leader has since cautioned foreigners who have acquired land from the Patriotic Front (PF) Government of repossession for the benefit of Zambians once his party forms government in 2021.
And when contacted by Pan African Radio News at Press time, Minister of Lands Jean Kapata declined to comment as she was in a meeting.

Police intercepts six trucks laden with the prohibited Mukula logs.
Police in Senanga district of Western province have intercepted six trucks laden with the prohibited mukula logs.
In an interview, Senanga district Commissioner Vivian Mubukwanu said the trucks bearing Zambian registration number plates were intercepted by police at Senanga round-about enroute to Namibia from Kasempa district of North Western province.
Mr Mubukwanu said that upon being intercepted by the vigil police officers on Monday around 18:00 hours this week, the drivers of the trucks abandoned the trucks for fear of being arrested.
He said the six trucks are laden with undisclosed number of mukula logs as the contraband is parked in containers.
The DC said the stance of government is to ensure that the country’s natural resources in protected from being exploited.
He said at the moment his office has handed over the report to the task force in Lusaka mandated to handle the illegal harvesting of mukula trees in the country.
Mr Mubukwanu said police officers are manning the trucks for fear of being damaged by unknown people and that the marooned trucks will only be cleared once the task force carries its thorough report on the impounded trucks in the district.
The senior government official said some of the company owner’s contraband has so been contacted to appear before Senanga police station in order to clear the marooned trucks in the district.
Mr Mubukwanu has appealed to business companies in the country intending to deal in mukula logging to follow the stipulated procedures of the land to avoid being in conflict with the laws.
And Senanga Central Member of Parliament Mubukwanu Mulowa has called on government to stiffen laws in order to stop the rampant harvesting of the country’s natural resources.
Mr Mulowa said people in the country are sitting on the abundance of natural resources but the citizens are benefitting less resulting in alarming levels of poverty especially in rural areas.
The law maker said the illegal cutting of timber in Senanga district by unscrupulous dealers is unbelievable and that the situation should be brought to book by the relevant authorities.
Mr Mulowa said the security wings should not relent in impounding all trucks especially with containers in order to bring the smuggling of the country’s natural resources to manageable levels.
Green Party Skeptical Mopani will honour All its Obligations Within the Agreed Six-Weeks Time-Frame

We as the Green Party are skeptical that Mopani Copper Mines (MCM) will pay the outstanding US$15 million which the company owes Copperbelt Energy Corporation (CEC) within the agreed timeframe of six weeks, including payments at new ZESCO cost-reflective tariffs which all other mining companies are paying.
We are also unconvinced that with the agreed timeframe, Mopani will provide to Zambia Revenue Authority (ZRA), and other relevant stakeholders, all the relevant documentation to resolve the VAT impasse and also facilitate a credible forensic audit to disprove strong allegations that suggest the mining company has defrauded the Zambian government in excess of $10 billion through transfer pricing and in-house hedging.
Mopani is believed to have hedged copper sales at $3,000 dollars using its parent company Glencore. Through this scheme, the Zambian government loses on all revenue when copper price on the world market exceeds the hedged amount. For example, now that the copper price is approximately $7,000, this means the Zambian Government gets zero from the $4,000 revenue which is in excess of the hedged amount.
We are also doubtful that Mopani will pay dividends which the company has failed to pay in the last 17 years of operations at Nkana and Mufulira mines. Should Mopani provide all the documentation, we believe the forensic audit will establish that Mopani owes ZCCM-IH and Government dividends running in millions of dollars from 2000 up to date.
We are also skeptical that Mopani will provide financial cover to secure its more than $80 million in environmental liabilities which since 2008, the mining company has failed to cover through bank guarantees.
Finally, we are distrustful that Mopani will restore the all the 300 contracts for Zambian suppliers and contractors which were cancelled last week, as well as retaining all the 4,700 miners the mining company planned to retrench. We will nonetheless keep our fingers crossed and monitor the situation closely.
Furthermore, we urge our colleagues in the PF Government to refrain from the tendency of going to the mines each time there is an issue to be sorted out. This culture belittles the status government and promotes state capture corruption. We instead implore our colleagues in Government to develop an arms-length culture whereby the President and his ministers merely summon management of the mining companies to respective government offices… not for government leaders patronizing corporate offices.

It’s not right for investors to take advantage of Zambians – President Lungu
President Lungu says he was greatly concerned when he heard that Mopani was threatening to fire 4700 workers saying this was the reason why he then decided to meet with Glencore ( the Mopani mine investor ) on the matter for only five minutes, today.
He said that he was saddened , during his meeting with Glencore on why Mopani was refusing to pay the new electricity tariffs, to hear claimed that they ( the investors ) have not realized profits despite being in mining for 17 years.
Addressing miners in Mufulira District today, the Head of State wondered how possible it is that an investor can keep pumping money into a company for 17 years without making profits and yet not giving up.
Mr. Lungu disclosed that he had in fact received information that there is cobalt and gold in the copper that is exported, and wondered why the mining companies in the country only declare copper but hide the gold and cobalt.
“I didn’t want to talk to the C.E.O because of his arrogance, so I decided to talk to his boss, because he’s not the owner of the company,Glencore are the owners, and they are the ones I called,” Mr. Lungu disclosed.
“So I called Glencore ,they came and we had a meeting, I just asked them, ‘do you still want to be in our country or you want a divorce?.”
The head of state said it was at that point that Glencore claimed not to be making profit.
The President said he then advised Glencore that if they do not want to reach an amicable agreement with Copperbelt Energy Corporation (CEC), it is better they leave the country and another investor takes over.
President Lungu says it is for this reason that he will embark on mine reforms, that will ensure that part of the wealth realized from mining remains in Zambia. Zambians had been exploited for too long without knowing and this must come to an end, he said.
President Lungu said this when he addressed miners in Mufulira District , today , that operations at Mopani Copper Mines would continue as normal.
“I have come to assure you that this matter is now in the past. We expect the mine to start operating normally.”
The President added that contractors and suppliers would also continue working normally.
He told the miners that he will soon constitute a taskforce of ministers, the Zambia Revenue Authority ( ZRA ) and other stakeholders which will look into reasons why an investor can continue claiming to make no profit while investing in mining for 17 years or more.
President Lungu says it is for this reason that he has decided to form a special taskforce to look into the operations of the mines within the country.
The task force will investigate these issues and find out how the mining companies are operating within the country, he said.
Mahrez to miss Zambia game?
Algeria star striker Riyad Mahrez will miss Saturday’s crucial 2018 FIFA World Cup Group B qualifier against Zambia to be played in Lusaka.
According to the Algerian Football Federation (FAF), Mahrez has been allowed to leave the Algeria squad to “formalise” his move from Premier League side Leicester City.
“Mahrez was authorised by the national coach Lucas Alcaraz and the Algerian Football Federation to make an express trip to Europe to formalise on Thursday his transfer to his new club,” said the statement from FAF.
“The national team will fly without him on Thursday morning to Lusaka to face Zambia on Saturday.”
According to BBC Sport, the 26-year-old has been the subject of three bids from Italian club Roma since expressing his desire to leave the 2015-16 Premier League champions
MAAMBA Mine Collieries to rehabilitate roads in Maamba Township at a cost of K20 million

MAAMBA Mine Collieries Limited in Sinazongwe District has launched the rehabilitation of roads in Maamba Township under its co-operate social responsibility at the total cost of twenty million Kwacha.
Speaking during the ground breaking of the road works in Maamba Township yesterday, Maamba Collieries Limited Chief Executive Officer Rear Shankur said rehabilitation works on the roads in Maamba Township will be completed within the period of six months and this was purely under the company’s cooperate social responsibility.
Mr.Shankur said that the works shall be undertaken by the mining company itself because engaging a contractor turned out to be expensive for them.
He said that the company had already acquired equipment to be used for the rehabilitation works which will continue to be used for maintaining the same roads after being rehabilitated.
Mr.Shankur called on Government and other relevant authorities to help ensure that the local community that would be affected by this development are relocated to alternative areas in order to avoid any further inconviniences that may result from rehabilitation works of the roads in the township.
He said that there was need to make the roads strong by putting up shoulders on either sides but observed that some members of the community had built structures much closer to the roads which may pose a challenge to the works if not addressed.
Mr.Shankur said that MCL placed the community around the mining area as a priority hence taking up such a huge task despite financial challenges caused by non payments for the power generated and supplied from the thermal power station.
Meanwhile Sinazongwe Constituency law maker Gift Sialubalo has applauded MCL for implementing its cooperate social responsibility for the benefit of the people in the area.
Mr.Sialubalo said at the same function that it was not easy for the mining company to plough back to the community in such a way because the cost of doing business was very high.
He said that the company was among the few in Sinazongwe District to plough back to the community within a short period of time after taking over running of the mine.
Mr.Sialubalo also called on MCL to consider using local labour force for certain jobs apart from experts in order to help the unemployed youths in Sinazongwe District.
He further called on the Government to consider expediting the process of redesigning and rehabilitating the Batoka Maamba road since MCL had already set the pace by rehabilitating roads in Maamba Township.
Mr.Sialubalo said that Batoka Maamba road was an economically important road not only to Sinazongwe District alone but the Country at large.
He challenged other companies that existed in Sinazongwe District to emulate MCL by also implementing thier cooperate social responsibility as a way of ploughing back to the community.
And Sinazongwe Town Council Secretary Everty Ngandu said at the same function that the rehabilitation of roads in Maamba Township was another milestone in development caused by MCL besides donating a tipper truck and back hoe loader both Valued at k1.2million two days ago for purposes of gabbage collection to keep the environment clean.
Mr.Ngandu said that Governments’ vision of 2030, the seventh National Development Plan (SNDP) and decentralization policy called for improved infrastructure development and therefore the roads rehabilitation works in Maamba Township were timely as they fit well in the Government policies.
He said that Government was there to create a conducive environment for the private sector to participate in the Country’s economic development.
Mr.Ngandu said that the Council and Government at large treasured the gestures shown by MCL because it was a positive contribution towards sustainable development of the nation.
He said that the rehabilitation of the roads in the township shall not only add beauty to it but improve the quality of life of the people and attract more investment for development.
MISA, IBA welcome govt’s plan to table Access to Information bill in parliament
The Media Institute of Southern Africa (MISA) has commended government’s pronouncement that the much anticipated Access to Information (A.T.I) Bill will be presented to parliament next month.
ZANIS reports that MISA Zambia Vice Chairperson Elizabeth Chanda says the pronouncement is more than welcome as the law is long overdue.
Mrs. Chanda says the ATI bill needs to be tabled in parliament as it benefit every citizen in the country when it is becomes law.
“As stakeholders, we have had time to look at the law and its implications. By now, we all know that the law is not meant to only benefit the media. Yes, the media will talk more about it because for them, information is their major resource.
“Maybe in terms of usage, Journalists will use the law more than any other ordinary citizen. However, it does not take away the fact that each and every citizen will benefit from this law,” she stated.
Mrs. Chanda, who is also a Media Law Lecturer at the University of Zambia, said Zambia has grown as a country and as a democratic state, the issues surrounding the Access to Information Bill are clearly understood.
“It is high time we moved in a certain direction. As MISA, we want to see specific results,” she added.
And Independent Broadcasting Authority (I.B.A) Director General Josephine Mapoma says the pronouncement by government to table the A.T.I bill before parliament is a welcome move.
Ms. Mapoma echoed Ms. Chanda’s sentiments that the law is not only meant to benefit journalists as is misconstrued.
She said the law will allow every single citizen to access information on an individual basis.
Minister of Justice Given Lubinda recently said the Access to Information Bill will be presented to parliament when it begins its sitting next month.
Wise Up or We Take Over, Youths Warn Politicians
Speaking when he featured on Joy FM live interactive program, the Platform, Prince Ndoyi who featured together with fellow MMD youth Gerald Chiluba and Gilbert Liswaniso from the UPND said that there is a youth movement which is slowly forming to push for a youth inclusiveness in the running of the country.
He said youths are slowly realising that they are being used like tools box which is only remembered when there is a break down and put out of site once the tools have been used.
He said youths are the majority hence the coming together of youths from differentpolitical parties should be a wake up call to politicians that things are changing and that youths will no longer accept to be used during elections and excluded in governance.
He warned that the 2021 elections would be different from the past elections because it will not be about political parties but the marginalised who include youths and women.
And on the proposed increase in the years describing a child Mr Ndoyi said the move sounds like a ploy to run away from responsibilities.
He said if the years are increased then the number of youths will reduce there by the number that should be mandated for employment would have decreased.
Further Mr Ndoyi called on young to support each other and stop competing with muscles but instead compete with ideas which would uplift their lives and contribute to the country’s economy and development.
He urged youths to join hands and fight the high poverty levels among them and ensure that they push political leaders for their inclusion in running the affairs of the country.
And Gilbert Liswaniso who is the Youth Spokesperson for the UPND noted the need for more on consultation on the proposed increase in the age describing a child.
He said there are people who are less than 21 who are living by themselves due to circumstances beyond their control and should be given opportunities to have a better life by government by creating jobs and that if the age is increased then these people would not have equal opportunities getting employed as they would be considered as children.
Meanwhile Mr Liswaniso has described the educated citizenry in the country as a let down to the nation.
He said most people who have gone to school some even at the expense of the tax payer have excluded themselves from the governance of the country and that they fail to even speak for themselves because they think politics should be left to people they consider uneducated.
He said the running of the country should be a responsibility all regardless of how educated someone might be, because when things are bad in the country everyone is affected.
Meanwhile Gerald Chiluba who is MMD Die Hard Youths Coordinator said through CYLA youths will be brought together and fight for a common agenda.
He said youths can not continue to fight the battles of others when they have so much on their plates.
He said for a long time youths have been perceived to be irresponsible people who can only be used during elections but that will come to an end because by coming together young people will say no to number of vices.
He said young people are going to rebrand themselves and ensure that they earn the respect they deserve so that even when they demand for something they would be seen to be responsible people capable of being leaders.
Namwala Marketeers empathizes with their colleagues at Kapalala market in Ndola District
Namwala Market Association Chairperson Oliver Kayombo says his association is saddened by the gutting of the Kapalala market in Masala area of Ndola District on the Copperbelt province.
Mr. Kayombo says as a market association they are very saddened by their colleagues loss of property worth millions of kwacha due to an inferno which yesterday gutted the market in Ndola.
He has however appealed to various stakeholders including government to help the victims with capital so that they continue looking after their families as most of them depend on the market to sustain their lives.
The Namwala Market Association Chairperson has also appealed to marketeers to form market security groups to help police to intensify patrols to avoid such calamities at market places which have recently rocked the country.
The market in Ndola’s Kabushi constituency was yesterday gutted destroying merchandise belonging to hundreds of marketeers.
The development has left many in a state of shock as over 3 000 stands have been destroyed and the cause of fire is not yet established.
The suspect Luckson Ngabala of Kabushi township was today sentenced to two years imprisonment with hard labour for causing the fire that swept the Kapalala at Masala market in Ndola yesterday.
National Assembly launches 2017-2021 Communication Strategy

Acting Clerk of the National Assembly Cecilia Mbewe says the National Assembly of Zambia has since 2011 developed communication strategies that help to disseminate information about the activities of the institution.
Ms. Mbewe said this at the official launch of the communication strategy in Lusaka today.
The Acting Clerk revealed that the 2017-2021 National Assembly of Zambia Communication Strategy has identified important strategies of taking Parliament closer to the people by enhancing its engagement and interaction with various stakeholders.
These strategies assist the National Assembly in creating public awareness of the activities of the Institution thereby increasing people’s effective participation in National governance processes, she stated.
The Acting Clerk of the National Assembly further noted that the implementation of the Communication Strategy will require forging effective partnerships with media institutions across the country.
She said the media are strategic partners in disseminating information on the work of the National Assembly of Zambia effectively.
The media provides an important accountability mechanism as it raises important issues that would otherwise never be debated or addressed publicly, she said.
Speaking at the same event, Acting Deputy Clerk-Procedure of the National Assembly of Zambia Cecilia Sikatele disclosed that the 2017-2021 Communication Strategy is aimed at enhancing the visibility of the National Assembly to the public and enabling public participation in the work of the Assembly.
Ms. Sikatele explained that the National Assembly recognizes enhanced partnerships with the media as one of the key enablers in rolling out of the Communication Strategy.

To start with, allow me to greet you all on bhealf of my fellow Zambians back home, I want to say thank you for inviting us to come and share with you our country’s current standing.
Thanks giving.
My brothers and sisters, we are here to reaffirm our commitment towards the upholding of democracy in our respective countries, and Africa at large.
However, before I go in detail, please allow me to thank the following people who stood firm and demanded for our release when we were arrested and detained on
Treason trumped charge:
1. To the people of this great nation, I say thank you for standing up for me.
2. To my brother mr mmusi maimane, I say thank you for standing up for democracy in my country, and please allow me to apologize on behalf of the 16 million Zambians over what happened to you on our soil as you wanted to attend my court trial and visit me in prison.
3. To the South african unions, (numsa) I say thank you, because you stood up for my country when your fellow unions were supressed or indeed feared for their lives and could not talk when injustices begun in my country.
4. To the church, I say may god, the almighty richly bless you as you have always shown leadership even when others may call you names, you still speak for the oppressed and please continue just like you did when I was brutally detained.
5. I want to say thank you to former nigerian president, president olusegun obasanjo for his statesmanship and please allow me to thank the international community which stood up and are still doing so for democracy in Zambia and world over, as you maybe aware that to a large extent our regional bodies turned a blind eye on the atrocious, and all that comes with dictatorship, especially in the southern african region but also Africa as a whole.
6. Commonwealth secretary general, the right honourable Baroness Patricia Scotland, I say thank you too.
Ladies and gentlemen, the list of those to thank is endless but I want once more thank people in my country who have been suffocated by those who do not value human rights, good governance and justice for all.
Facts regarding our arrest
Ladies and gentlemen, allow me to quickly run you through how we were brutally arrested on the 10th of april 2017 as the police brutally tortured us on the very day from 21:00 hours to about 04:00 hours Zambian time.
1. Over 200 police brutally attacked us, and vandalised our residence and tortured us for no reason but later arrested us for treason, a trumped up charge which we did not commit.
2. I was put in solitary confinement for 8 days,
3. I was put in a police cell full of feacal matter.
4. I was moved from prison to prison.
5. I was made to answer the call of nature using a bucket.
However, ladies and gentlemen, we are here to tell you that despite all this brutality and inhuman treatment that those in authority made us go through, we harbour no hate, we are not bitter and we forgive them and we will use their brutality on us to make Zambia a safe home for all including neighbouring countries.
And this drives me to the next point;
Current state of affairs in our country, Zambia ladies and gentlemen, it is no longer arguable that our country Zambia is undergoing very difficult times, where citizens cannot fully stand to talk and say this is the Zambia we want.
1. Suffice to say that, as Hakainde Hichilema, I remain indebted to the people of my country, our country does not need guns or mighty men with guns but its need leadership, leadership that will realise that god hates injustices.
2. Breakdown in the rule of law; there is an absolute breakdown in the rule of law in my country which need urgent attention by all well meaning bodies.
3. Elections; I was arrested because of disputing election results through the courts of law, therefore Zambia needs an independent electoral commission if democracy is to be resuscitated.
4.JUDICIARY; Zambia needs an independent judiciary that will opetate freely unlike a situation where in the morning the constitutional court rules that a presidential petition will be heard the following day but when that day comes, they say no, time has lapsed.
5. Freedoms: ladies and gentlemen, I am glad that my brothers and sisters here in South Africa can go about and wear clothes branded by their political parties of choice unlike in our country, people from our party are daily being maimed for wearing our regalia and this is why we call on the people of South Africa to join in the struggle for democracy in Zambia, remember how Zambia joined hands with South Africa during the struggle, where has that humanism gone to?
6. Freedoms: the media in our country is not safe, there is no press freedom in my country, journalists are getting arrested even on flimsy charges such as terrorism, private newspapers, radio and television have been getting closed; Post Newspaper, Komboni Radio, Itezhi Tezhi and Muvi Television. And is urinating into a journalist’s mouth press freedom? Well, that is not a surprise to us as cadres from the ruling party have done that in Zambia.
7. Freedoms: there is no freedom of assembly, association, speech and this is why we are saying that neighbouring countries must not watch these injustices go on, because what affects Zambia, affects all and
Therefore we must all stop this.
Ladies and gentlemen, as Hakainde Hichilema, I will remain committed to ensuring that Zambia stops anyone practising dictatorship, I believe that power belongs to the people and that Zambia is not an highland and therefore I again call on other countries that believe in humanism, fundamental human rights and democracy to join in restoring democracy in Zambia.
Yes, we are ready to talk with anyone and we mean anyone with bold stance that yes, Zambia needs institutional reforms such as those of the police among others.
I want the best for Zambia and I want the best for Africa, after all, we all want the best for the world, so Let us all work towards that.
May god bless our two sisterly countries, may god bless Africa and may god bless the whole globe.

Lusaka woman accused of running over her husband and killing him acquitted

A Lusaka woman who was accused of killing her husband last October by driving over him with her car has been acquitted by the Lusaka High Court on lack of evidence.
Details of the case were that Jacqueline, a Health Care Administrator was accused of killing her husband Kofi Milumbe in October last year by running him over with a car after a domestic dispute on October 28, 2016.
High Court Judge Charles Chanda said the prosecution failed to establish prema-facie case against the accused as the case was full of speculation.
Jacqueline was accused of killing her husband Kofi Milumbe by running over him on October 28, 2016.
Judge Chanda said Jacqueline did not run over her husband but that he was run over by another speeding vehicle on the road.
Judge Chanda found that all the prosecution’s witnesses exonerated the accused and did not implicate her in any way.
“Based on the evidence before court and relying on the findings of the pathologist, I find that the deceased died as a result of the road traffic accident,” said Judge Chanda.
Jacqueline’s lawyer Abyudi Shonga had asked the court to acquit her because the prosecution had not established a prima facie case against her.
