President Edgar Lungu and Vice- President Inonge Wina sworn in

chagwa-swornPresident Edgar Lungu and Vice- President Inonge Wina have taken oath of office at a fully packed Lusaka’s National Heroes Stadium and have given their collective vision for the nation for the next five years.

In his 43 minutes inaugural speech this morning, President Lungu has assured the nation that he will leave the nation better than he found it.

The Head of State has also disclosed that he will appoint a commission of inquiry to investigate post-election violence experienced in certain parts of the country.

President Lungu has thanked the people of Zambia for exhibiting maturity after the elections by remaining peaceful even to extents of provocation.

He says even though there were some pockets of hostility in certain parts of the country after the elections, Zambians generally conducted themselves in a peaceful manner.

He has warned public workers not to engage in any corrupt activities saying they will face the wrath of the law without protection.

He has also assured that there is no time for him to settle scores saying he has a lot on his table in terms of development.

President Lungu has appealed to all Zambian citizens that he needs their full support during his five year term of office.

Speaking at the same event, Zimbabwean President Robert Mugabe, who represented visiting Presidents, says according to the election observers, Zambia’s elections were held in a free and fair environment.

Mr. Mugabe has also advised against using violence just to be in office saying Zambia has been known as a beacon of peace for many years.

He has also encouraged the nation to avoid tribalism but rather remain as one people.

The inauguration of President Lungu and Ms Wina was witnessed by some foreign heads of states which include Zimbabwean President Robert Mugabe, Uganda’s Yoweri Museveni, Botswana’s Ian Khama.

Tanzania President John Magufuli was represented by his Vice President, Paul Dlamini, the Deputy Prime Minister of Swaziland, Namibian Vice-President, Nicky Iyambo, Malawi’s Vice President, Saulos Chilima and Kenyan Deputy President, William Ruto.

Others who have attended are African Union Commissioner for Economic Affairs, Dr. Anthony Mothae Maruping, Common Market for Eastern and Southern Africa (COMESA) Secretary-General Sindiso Ngwenya and African Economic, Social and Cultural Council (ECOSOCC) Chairman, Joseph Chilengi.

Dr. Stergomena Lawrence, who is Southern African Development Community (SADC) Executive Secretary as well as Vice Chairman of the Chinese People’s Pacific and Consultative Conference and International Conference of the Great Lakes Region (ICGLR) representatives were also in attendance.

Why I disagree with Prof. Ndulo and Hansungule On HH and ConCourt Decision

Soon after the Electoral Commission of Zambia announced its final results in favor of Lungu, Prof. Ndulo warned that Zambia was becoming a failed state. On September 12, Lusaka Times published a detailed article from Professor Ndulo, addressed to the three Constitutional Court (ConCourt) Judges who reversed their decision on HH’s petition. Prof. Ndulo argument is summarized in the first two paragraphs:

“There can be no denying that Zambia’s Judicial system, especially the Constitutional Court, is in a crisis. It has failed to play its constitutional role. I would agree with Professor Hansugule’s assessment that the Zambian Constitutional Court displays unbelievable mediocrity and is an embarrassment to Africa and the rest of the world. In this article I argue that the September 5 decision of Justices Sitali, Mulonda and Mulenga to overturn a decision of the full bench was illegal, irregular and unprofessional and has no legal effect.”

Prof. Ndulo’s article followed Prof. Hansugule’s piece which condemned the ConCourt’s decision. The article further claimed that his once “friend” Lungu stole the election from his “younger brother” HH—and Lungu “knows it”. Lungu, he argued, “has unilaterally barred the CC from hearing the petitioner in line with well-articulated principles insisting on an independent judiciary.” There is nothing new to Prof. Hansugule claims—HH, UPND and the Zambian Watchdog have repeated these claims.
I have respect for the two Professors and I believe they are among the cream of Zambian intellectuals. However, I am surprised that they ignored the first U-turn of the ConCourt, when it reversed its decision to dismiss the petition on Friday 2, 2016. HH was excited that the ConCourt had reversed its official decision, and would hear his petition on Monday. But when the same Court reversed its reversed decision, he cried foul.

Sadly, the two learned scholars did not address the Friday September 2, 2016 ConCourt U-turn—which is equally shocking. In legal terms, the Court needed to cite the section of the Constitution under which its decision to reverse its initial ruling was based—which in fact does not exist. Since the precedent of reversing decisions was set on Friday when HH complained, it should not surprise us that the ConCourt did it again on Monday September 5, 2016.

In addition, the two scholars failed to discuss some bigger problems with the Constitution—14 days and the finality of the ConCourt decisions. I fully agree with Prof. Ndulo—we face a constitutional crisis. This crisis, however, is not due to Lungu’s victory or the ConCurt’s decision, but the national Constitution. All well-meaning Zambians need to accept that the current Constitution needs straightening if it is to stand the test of time. I realize that those who participated in the drafting of the Constitution simply cut and paste various sections from other nations’ Constitutions and legal documents without thinking through the legal implications of the same. It is for this reason that HH must be applauded—he allowed us to see the holes in our Constitution. To cite Constitution, while ignoring those which justify the Court’s decision is nothing but mere partisan politicking.

It is saddening that scholarly analysis of the issue is blinded by partisan politics as opposed to independent legal analysis. In my article published before the Supreme Court’s ruling on HH’s attempts to halt the inauguration of Lungu, I argued that the Zambian Constitution does not allow appeals related to presidential petitions: “Clause 101: 7, and 103: 4 state that the ConCourt’s decision “is final.” These clauses are further stamped by Article 128: (4) “A decision of the Constitutional Court is not appealable to the Supreme Court.” Thus due to the un-appealable clause, HH, GBM, the UPND and its allies can make as much noise as possible—but the case is constitutionally closed!” Supreme Court Justice Nigel Mutuna agreed with my reading of the Constitution when he dismissed HH’s case with the words, “decisions made by the Constitutional Court cannot be reversed by the Supreme Court.”

Finally, we do not have the legal framework for addressing the Presidential petition and neither do we have any case in our short history to employ as an example. We may refer to other courts in other parts of the world as General Miyanda did, but those nations’ legal structures are equally different. Since the ConCourt itself is a new legal entity in the nation, we need to address how it relates to the bigger legal system in the nation—we need to work together to resolve this crisis.

In The Kitchen With Kanta : Rice and Chicken

I’ve just got back from Spain and I had such an amazing time, it was everything I needed and more.  Spain is a beautiful country, most of the food that I enjoyed during my time there was; fresh tropical fruits, fresh fish, chicken, salads and veggies. It felt so good to know that I was putting such good, fresh food into my body.  I never thought I would feel such a difference between over processed food and fresh food. It gave me a whole new perspective and inspired me to actively eat good and fresh food as much as possible.  Now don’t get me wrong I love a treat every now and then; and I don’t believe in restricting oneself too much, but it was refreshing to enjoy such fresh food.

However since my return I have been craving Rice and Chicken.  Some of you might not think that this is the healthiest meal in the world but, as the saying goes “there is more than one way to skin a cat”; and likewise there are many different ways to cook the same meal.  For example, instead of frying the chicken you can oven bake it, or grill it; you can cook it with or without the skin.  You can add an assortment of veggies or beans to this dish, and you can even have brown rice instead of white rice.  This is one of the many reasons why I love rice and chicken.  So without further ado – here is your recipe of the week delicious Rice and Chicken.

Preparation and Cooking: 1 hour

Serves: 4-8 people

Ingredients

  • Olive oil
  • 8 pieces of chicken, legs and thighs (either skinless and boneless or with the skin left on)
  • 1 red onion, chopped
  • 2 red or orange peppers, halved, deseeded and sliced
  • 1 garlic clove, crushed and chopped
  • 200g long grain rice (or brown rice)
  • 400g can of chopped tomatoes
  • 300ml chicken stock
  • 2 tsps Paprika
  • Salt
  • Pepper

Method

Cook your rice according to the instructions on the packet

Preheat the oven to 200C/fan 180C/gas 6.  Marinate your chicken with the paprika, salt and pepper to taste, drizzle some olive oil over it, place it an oven tray and cook it for about 20-30 minutes, or until cooked through.

In a medium frying pan, heat 2 tbsps of olive oil, add the onion and peppers, and cook for 3 minutes or until lightly golden. Tip in the garlic and fry for one minute. Add your canned tomatoes and chicken stock, and cook until thickened.

 Serving

Plate up your steaming rice, followed by your chicken and pour your gravy over the top. Enjoy this simple yet delicious meal.

ZAMBIAN BREWERIES URGES RESPONSIBLE DRINKING

Zambian Breweries has signed an agreement with the Lusaka Province Liquor Traders Association (LPLTA) in its latest move to encourage responsible alcohol consumption.
The memorandum of understanding, which was witnessed by Lusaka City Council, was signed today (September 12) between Zambian Breweries Director of Corporate Affairs Ezekiel Sekele and Liquor Traders Association president David Nseluka.
The two organisations are collaborating in an effort to enhance the knowledge, attitudes, and values of the alcohol industry by educating the public and retail traders in developing responsible behavior in relation to the sale and consumption of alcohol and in combating illegal trading and underage drinking.
According to the terms of the agreement, which will run from August 31, 2016 to September 1, 2017, SABMiller Zambia will provide the Liquor Association with technical expertise, capacity building initiatives, and financial support.
Speaking after the signing ceremony, which was held at Lusaka’s Southern Sun Hotel, Mr Sekele said: “We want to support Government and community efforts in curbing irresponsible sale and consumption of alcoholic beverage and curb underage drinking.  Our country has a youthful population and of which 50% is composed of less than 18 years old and with slightly over 80% of the total population being below the age of 34 years. We therefore encourage and support the establishment and enforcement of clear standards aimed at enhancing compliance for the legal sale and distribution of beer retail in the on- and off-trade.”
“Collaborating with key organisations such as the Lusaka Province Liquor Traders Association helps us achieve this objective more effectively,” he added.
Mr Nseluka said: “The members of the Lusaka Province Liquor Traders Association are at the sharp end of the alcohol business in our capital city. It is our members who are in direct contact with the consumers and we therefore occupy an important role in the fight against alcohol abuse such as under-age drinking, drinking in pregnancy and so on. The signing of the MOU will also help us to meet part of our costs as we work with the Lusaka City Council in educating the traders and the public about the laws and rules of the alcohol trade.”
In promoting responsible alcohol consumption among consumers, SABMiller Zambia has also partnered with the Road Traffic and Safety Agency and the National Road Safety Foundation, in the enforcement of existing legislation on drinking and driving.

President Lungu warns prisoners not to abuse presidential pardon

President Edgar Lungu has cautioned prisoners against abusing the presidential pardon once released from prison.

President Lungu has observed that inmates who are released on presidential pardon have in the recent past abused their chances and ended up finding themselves back in prisons.

ZANIS reports that the President said powers to forgive prisoners should not be taken for granted because his intention to pardon some prisoners is being exercised in good faith in order to give people who had gone against the law a second chance.

The head of state cautioned inmates against embarrassing him for pardoning them saying it was embarrassing to see some inmates who were pardoned back in the correctional facilities.

He said prisoners are incarcerated in order to reform so that they can return to society as better and resourceful citizens and not as condemned citizens.

He said as a Christian he feels duty bound to forgive law breakers after they realise their mistake so that they can start over in society.

He said every citizen can make a mistake but pointed out that breaking the law with impunity does not pay as the law breakers will be caged.

He said his government started the prisons reforms in 2011 so that prison facilities can transform into correctional facilities where inmates will be rehabilitated into better citizens.

The President has since hinted that during his 5 year term, there will be total transformation of prisons into correctional facilities that will make inmates change into better citizens after serving their prison sentence.

The President was speaking when he donated computers, cookers and fridges to Lusaka Central Prison in Lusaka.

The President donated 50 computers, 6 electrical pots, 4 deep fridges, 4 upright fridges, 4 stoves and chitenge materials for women inmates.

Kamwala remand prison will also benefit 2 out of the 6 donated electrical pots, a fridge and a scale for the clinic which is within Kamwala correctional facility.

And Zambia Correctional Service Commissioner General Percy Chato has described President Lungu as the champion of prison reforms in Zambia.

Mr. Chato noted that for the reforms to be effective in prisons there should a champion to affect them saying President Lungu has since his ascendency to power been driving the reforms.

The Commissioner General commended the President for the donations and pledged the commitment of the correctional service in ensuring that government’s effort to transform the prisons service is supported and actualized.

The head of state recently visited Lusaka Central and Kamwala Remand correctional facilities and pledged to donate equipment which he has since honoured yesterday.

Livingstone City Council steps up clearing garbage in communities

LIVINGSTONE City Council(LCC) has made headway in clearing garbage in most communities of Livingstone town, Livingstone City Council Public Relations Manager Emmanuel Sikanyika has said.

Mr Sikanyika said the solid waste department under the council was working round the clock in ensuring that the tourist capital maintained its status as a cleanest city in the country.

In an interview yesterday Mr Sikanyika said that the operations of the local authority had been boosted with the acquisition of three tipper trucks, tractor and a tractor back haul loader.

“You know that garbage is an ongoing problem because people generate it every day, so we have to ensure that we are collecting garbage every day and I can boast that we have a very hard working solid management team and we believe that we are on top of things. If you have been to Maramba, actually there is an area where garbage had mounted for over five years and people thought it was surmountable but we have moved in there and we have swept the whole area clean.

“The council has been boosted with the acquisition of more trucks, now we have three dependable tipper trucks, a tractor, tractor back haul loader, all these equipment are making it easier for us to carry out our work as a local authority in order to clear out all the garbage, ”Mr Sikanyika said.

He warned members of the public against dumping garbage in areas that were not designated by the local authority.

“We want to take this opportunity to also warn members of the public to stop dumping garbage anyhow, there are designated areas where garbage should be disposed off so that it is easier for our people to carry out their works,” he said.

Mr Sikanyika disclosed that the council had engaged six companies to help collect garbage in selected townships of Livingstone at a small fee.

“We have a franchise arrangement ,were we have contracted about six companies that are collecting garbage on our behalf in different zones across Livingstone and people must be able to pay the people collecting garbage so that the service is effective. The issue of collecting garbage is everyone’s issue and it’s just fair enough for people to contribute a little towards the service at a fee that is minimal,” he said.

Meanwhile the local authority warned traditional healers with a tendency of putting advertising posters in the central business district of Livingstone to desist from the practice or risk being penalised.

Red Cross deploys 50 First Aid staff for inauguration ceremony

The Zambia Red Cross Society has deployed Fifty (50) first aid workers for tomorrow’s inauguration ceremony of President – elect Edgar Lungu and Vice President – elect Inonge Wina at Heroes Stadium.

Zambia Red Cross Society Secretary General Abraham Gwevarghese confirmed to ZANIS in a telephone interview yesterday, that 50 first Aid staff have been lined up for tomorrow’s inauguration ceremony to handle any case of eventuality.

Mr. Gwevarghese said that all arrangements have been completed and that everything is in place and ready for tomorrow’s inauguration ceremony.

He further disclosed that the Red Cross is working together with the Ministry of Health, and that the first aiders will be use the clinic at the Heroes Stadium to treat any serious cases of serious issues.

Meanwhile Mr. Gwevarghese has appealed to the general public to accept the Red Cross officials and allow them to do their work as an independent body, for they are not attached to any political party.

Government introduces keeping girls in school programme

Government has introduced a five year project that aims at improving the living standards of women and keeping the girl children in school to ensure that they are educated.

The Girls Education and Women Empowerment Livelihood (GEWEL) project, which is funded by the World Bank, will be implemented at a total cost of US$65 million.

To this effect, officials from the Ministry of Community Development and Social Welfare have embarked on a robust sensitization programme to educate provincial heads and district stakeholders on the implementation modalities of the project.

Team leader, Ireen Munga revealed that the Keeping Girls in School’ (KGS) project was earmarked to commence in January 2017.

Ms. Munga said over US$25 million will be spent on this project.

She said 14,000 girls from Chama and Mafinga districts in Muchinga Province will benefit from the KGS project.

She further revealed that the supporting women livelihood (SWL) project will be implemented at a cost US$36 million and is targeting 75,000 women in Shiwang’andu, Mafinga and Chama districts.

Ms. Munga, who is also Chief Social Welfare Officer in the Ministry of Community Development and Social Welfare, said the project’s main objective was to increase access to livelihood support for extremely poor women and also enhance access to secondary education for girls in extremely poor households.

She said the GEWEL project will be implemented by two departments.

She explained that the component of supporting women livelihood will be undertaken by the department of Community Development while the responsibility of keeping girls in school has been entrusted to the department of Social Welfare in collaboration with the Ministry of General Education.

And Muchinga Province Permanent Secretary (PS) Bright Nundwe has welcomed the programme saying it was a good project that will change the lives of women and girls in communities.

Mr. Nundwe said this when the team paid a courtesy on him at his office today.

He said there was need for the school where the 14,000 girls will be enrolled to provide counseling and guidance.

He also called for discipline and prudence among the beneficiaries of the GEWEL project and urged them to ensure that this opportunity is carefully utilized.

Mr. Nundwe has since commended government for supporting the project and making sure that the project was implemented.

Several PF supporters braved the morning darkness and started heading to the Heroes Stadium in Lusaka, the venue for the inauguration ceremony of Zambia’s sixth President Edgar Lungu and Vice President Inonge Wina.

Some of the people started arriving as early as 05:30 for a ceremony which is expected to start at 08 Hours.

President Lungu is expected to deliver his inauguration speech at around 10:00 Hours.

Several dignitaries including four Heads of States are expected to grace the event.

There will also be a state luncheon at State House which will be held around 12: 00 Hours.

BRANDING Constitutional Court Judges thugs and criminals by Hakainde Hichilema is the gravest assault on the Judiciary and the UPND leader should know that his conduct towards the Zambian courts is injudicious and not acceptable, Brebner Changala has charged.

And Mr Changala has said Zambian Judges should be protected from political hooligans whom he said were on the loose and on rampage of violating the sanctity of the country’s judicial system.

Mr Changala has demanded that sanctions should be taken against Mr Hichilema for his disrespect and insolence against the Judiciary which is one of the critical institutions of governance in the country.

Mr Changala, who is civil rights activist, said Mr Hichilema should be made to account for his insults against the Judges because such kind of conduct had the potential to destroy the Judiciary without which the governance of the country would be threatened.

He said Mr Hichilema was not the first neither was he the last to have lost elections and that his bitterness over the electoral defeat he suffered at the hands of President Edgar Lungu should not be extended to the Judges who presided over his failed petition to nullify the re-election of the Head of State.

Mr Changala stated that Mr Hichilema’s assault on the Judiciary which was a critical part of the governance system, and demeaning Judges to the level of reducing them to criminals should never be condoned and the UPND leader should, therefore, be condemned in the strongest terms for his unbecoming behaviour.

Mr Changala explained that Zambians had made the right decision to reject Mr Hichilema because the UPND leader was going to destroy the Judiciary had he taken over the leadership of the country.

“Destroying the Judiciary is killing the umpire of justice. Zambians must strongly condemn Mr Hichilema for insulting the Constitutional Court Judges. Zambia is bigger than individual political parties and Mr Hichilema. I am asking that there should be sanctions against the UPND leader so that we can preserve our three arms of government. Mr Hichilema must be reminded that as a man aspiring to take over the leadership of the country, he will not be able to govern if he is going to inherit a nation with a destroyed judicial system,” Mr Changala said.

Mr Changala said the phenomenon of wanting to win an election and get State power at all costs had completely blinded Mr Hichilema who he said had been of the belief that he had won the general elections and had powers to abuse institutions of governance.

He said the UPND leader had no proof whatsoever that the Constitutional Court Judges had been paid by President Lungu to lapse his petition neither did he have evidence that the Judges were nothing but a bunch of criminals.

“Ironically, Mr Hichilema is still going to the courts and will be appearing before the same Judges he has branded thugs and criminals. What sense is he making out of his attacks? How does he insist to continue appearing before the same Judges he is abusing with impunity?” Mr Changala wondered.

ZNWL’S EXPECTATIONS FROM PRESIDENT- ELECT, EDGAR CHAGWA LUNGU AND THE NEW GOVERNMENT

The Zambia National Women’s Lobby (ZNWL) congratulates President- elect Mr. Edgar Chagwa Lungu on his re-election as Zambia’s 7th Republican President.

ZNWL further congratulates Vice-President Elect Ms. Inonge Wina and all other candidates that participated in the just ended elections at Presidential, Parliamentary and Local Government level. We especially applaud the women who have emerged victorious at Parliamentary and local government level.

As an organization that seeks to enhance the participation of women in decision making at all levels, the following are the expectations we have of President Lungu and his new government:

1. IMPLEMENTATION OF THE GENDER EQUITY AND EQUALITY ACT

We expect increased efforts to actualize the provisions of the Gender Equity and Equality Act through Gender Commission which should result in enhanced mainstreaming of gender in all sectors. This is important because apart from being in the majority, women are directly affected by the social and economic challenges experienced in this country, thus their inclusion in priority setting, planning, decision making and implementation, is critical.

2. AFFIRMATIVE ACTION IN THE APPOINTMENT OF CABINET MINISTERS AND SENIOR CIVIL SERVANTS

We expect that President Lungu will appoint a significant number of women into his cabinet. The Patriotic Front has 13 female Members of Parliament; it is therefore our hope that a considerable number of female Members of Parliament will be appointed in the next Cabinet. We further implore President Lungu to consider appointing women into key and influential government positions. The track record of women that have held influential positions in Zambia is quite good which points to the fact that women are effective leaders.
We therefore call upon the President to consider women, even as he nominates Members of Parliament from various sectors in the country.

3. PRIORITIZATION OF SECTORS THAT HAVE DIRECT BEARING ON THE LIVES OF WOMEN.

We expect the new government to work towards enhancing the status of women by investing in women’s health and focusing on improving sectors in which women are the majority such as the agriculture sector. We further expect increased emphasis on girl child education and an invigorated fight against child marriages.

4. IMPLEMENTATION OF THE IMF AUSTERITY MEASURES

As government prepares to enforce austerity measures in line with the International Monetary Fund aid package, we implore the government to ensure that sectors that directly affect women such as the health, agriculture and social welfare are spared to avoid the increase in the disease burden and escalation of the household poverty.

In conclusion, we reiterate our resolve to ensure that women actively participate in decision making processes at all levels in Zambia. We believe that this can be achieved if a multi-faceted approach is taken and all stakeholders are willing to apply the principles of gender equity in all sectors.
