This afternoon Mr. Hichilema addressed a press briefing at Moba Hotel in Kitwe. He covered a number of issues from violence to the recent ruling by the Constitutional Court that PF ministers have continued in office illegally and must now pay back all the money they owe to the Zambian people.

Following attempts by the PF to cancel the UPND’s final rallies and further attacks on supporters, including the UPND youth team travelling by bus in Mtendere yesterday, Mr. Hichilema put the question to Lungu ‘What are you afraid off to be behaving like this?’. He called for institutions, such as ZICTA and the Zambia Police, to resist being abused and misused by Lungu so as to deny citizens their rights.

Mr. Hichilema called for calm saying: “I want to say thank you to all UPND members who have behaved calmly in the face of provocation during the campaign period and I want to ask you to continue on like this.”

He explained the significance of the Constitutional Court ruling of Monday 8th August as evidence that Lungu has benefitted from state resources during the campaign. He said, however, while the campaign period had not been free and fair President Lungu should make sure he doesn’t interfere with the election itself, or he will find himself being ruled against in the courts.

Not only has the Constitutional Court now ruled against Lungu, but in the last 24 hours the High Court has ruled in the UPND’s favour on PF attempts to have the rally in Kitwe’s Freedom Park cancelled, as well as the ongoing matter with ZNBC on the airing of the UPND’s documentary entitled ‘Hakainde Hichilema – The Man, The Vision, The Plan’. Mr. Hichilema explained that this in combination with the UPND’s plan to protect the vote and commitment by our supporters to turnout in great numbers on Thursday will take the party to a conclusive first round victory.

Former DPP Mutembo Nchito
President Edgar Lungu has removed suspended Director of Public Prosecution (DPP) Mr. Mutembo Nchito from office following the Tribunal’s recommendation that he vacates office for misconduct.

According to a statement released to the media by his Press Aide Amos Chanda, President Lungu has since appointed acting DPP Mrs. Lilian Siyuni into the job subject to ratification by Parliament. The President has made the appointment in exercise of powers vested in him by Article 180 of the Constitution of Zambia.

In a letter dated 9th August, 2016 to Mrs. Siyuni, the President wished her God’s speed in the discharge of her duties.

“I hereby appoint you as Director of Public Prosecutions. Your appointment is subject to ratification by Parliament.”

The President’s decision follows the Report by the Tribunal which was appointed on 10th March, 2015 pursuant to Article 58(2) and (3) of the Republican Constitution. The Tribunal was appointed to investigate allegations of misconduct by Mr. Nchito.

The Tribunal led by former Chief Justice Mr. Justice Annel Silungwe on Sunday, 7th August, 2016 submitted the Report to His Excellency the President, after completing its inquiry into the matter.

The Tribunal recommended that the two proven Terms of Reference No. 2 and No. 4 sufficiently constituted misconduct in reference to Article 58(2) and (3) of the Constitution of the Republic of Zambia.

The Tribunal concluded that the Term of Reference No. 2, alleging misconduct or misbehavior by the DPP whereby on 20th February, 2015, the DPP purportedly took over prosecution of a matter before Senior Resident Magistrate, Lameck Mwale where the DPP was personally an accused person and proceeded to enter a nolle prosequi in his own case thereby defeating the ends justice, has been proved.

The Tribunal also concluded that the Term of Reference No.4 that the DPP’s act of intentional disrespect to judicial proceedings has been proved.

8 UPND CADRES WERE ASSAULTED BY PF CADRES IN MTENDERE COMPOUND, SAYS POLICE IG

EIGHT members of the United Party for National Development (UPND) have been assaulted in clashes between their party and the Patriotic Front (PF) cadres.

Inspector General of Police Kakoma Kanganja has confirmed in a statement today that the eight were injured during a political violence between the two political parties at Zambeef in Mtendere compound yesterday.

Kanganja says the incident happened when the PF cadres were waiting for their parliamentary candidate Nkandu Luo while the UPND cadres were passing through dropping their political fliers.

The IG has named the eight injured UPND supporters as Austin Simweene aged 21 of Bauleni compound, Peter Mukupa of Mtendere East, Kebby Muchala Lungwe aged 29 also of Mtendere East, Thomas Phiri of Bauleni compound, and David Mweemba Malama of Bauleni compound.

Others are Tyson Zulu of Kalikiliki, Mildred Kailu aged 46 of Kalingalinga, and Obert Hankamba aged 37 of Mtendere compound.

“During the same confusion, two Samsung phones valued at K7 000, K18 000 cash and a laptop valued at K5 000 all property of Kosamu Tembo are reported to have been stolen,” Kanganja says.

“A public address system valued at K15 000 belonging to Panot Ngandu of Mtendere compound was also stolen.”

He says medical report forms were issued to those who were injured and that dockets will be opened as soon as complainants take back the said documents.

“We have instituted investigations in the matter and whoever will be found wanting will be dealt with accordingly irrespective of their political affiliation,” says Kanganja.

President Lungu tells EU observer mission he does not run ZNBC

President Lungu
President Lungu
President Edgar Lungu has said he is not in charge of the Zambia National Broadcasting Services (ZNBC) despite being the Head of State.

President Lungu reiterated that his role is to provide free, fair and credible elections so that people elect for themselves the leader they want.

The Head of State said this in Lusaka today when the European Union Observer Mission paid a courtesy call on him.

President Lungu said he does not control or direct the coverage of stories by ZNBC and neither does he control the content, of the public broadcaster as the institution is independent of its operations.

President Lungu said many times he has been accused that he influences the content of the National Broadcaster when in fact not.

He said ZNBC is run by the Independent Board of Directors, and execute their duties diligently without interference from government.

President Lungu said he has not stopped the opposition rallies and he has not restricted them access to the media in the country.

He said ZNBC also has its own editorial content and ethical standards which cannot be challenged by the government.

President Lungu said all the Rallies that are aired on ZNBC are fully paid for by the PF and are not aired for free as perceived by the general public and some opposition political parties.

The Head of State said the EU Observer Missions always gives one sided stories, which are not balanced and aimed at tarnishing the image of the country.

Meanwhile President Lungu has maintained that police have the discretion not to allow political parties to hold rallies, if the Head of State is in a certain area.

President Lungu said the police have always maintained that having two or more political parties in an area compromises security, which results in some rallies being postponed.

He said the opposition is complaining about postponement of their rallies because they fear that they are losing the elections.

The Head of State said he has a duty to maintain order because, peace, order and democracy need to co-exist in an election period.

President Edgar Lungu says conceding defeat in elections in most African countries is still a huge challenge.

President Lungu noted that most opposition political parties in Africa and Zambia in particular refuse to accept election results

The Head of State said for instance that the opposition UPND has already declared itself winners ahead of the August 11 polls and will not accept anything to the contrary.

President Lungu said this in Lusaka today when a group of four Election observer teams paid a courtesy call on him at State House.

The missions comprised of former president of Nigeria Goodluck Jonathan under the African Union Elections Observation Mission (AUEOM) , Cassam Uteen, former President of Mauritius, under the Electoral Institute for Sustainable Democracy in Africa (EISA) Observer Mission, Ibrahim Gambani ,Special Envoy of the President of Nigeria and Cecile Kyenge ,chief observer for the European Union Observer Mission.

President Lungu advised all political parties in the country to know that there is life beyond being in State House.

The Head of State wondered why some political parties have gone further to state that they will not accept the Presidential results if they are not in their favour.

President Lungu said in a few hours , Zambians will choose their candidate and as Head of State he has ensured that there is a levelled playing field.

He said he is committed to giving Zambians a free, fair and credible election, which will enable citizens chose their leaders freely.

The Head of State said he has confidence in the election observers that have been sent in the country, as it will also show the world how democratic Zambia is.

The President said he is happy that most of the election monitoring teams comprise former government officials who know how it feels to being in State House.

Meanwhile African Union Elections Observation Mission Leader Goodluck Jonathan said Zambia is known worldwide as a haven of Peace.

Mr. Jonathan said very few countries can match Zambia’s record of peaceful elections and expressed optimism that the record will be maintained.

He has since appealed to President Lungu to remain magnanimous and accept everyone in the country regardless of which party they belong to.

Mr. Jonathan said his team is in the country not to look for faults but to ensure that the elections are held in a peaceful manner.

And former President of Mauritius Cassam Uteen, who is leading the Electoral Institute for Sustainable Democracy in Africa (EISA), thanked President Lungu for welcoming the election observers.

Mr. Uteen said Zambia is generally a peaceful country and he would love that peace is maintained before during and after elections.

He said leaders must provide the necessary support to all political parties and the electoral body to ensure smooth elections

Meanwhile , President Lungu is scheduled to address three major rallies today in Ndola rural, said his spokesman Amos Chanda in an official timetable released to the media.

Today, Tuesday 9th August, President Lungu will hold rallies in the following areas in Ndola rural in Masaiti at 15:00 hrs, Mpongwe at 15: 45 hrs and Lufwanyama at 16: 30 hrs.

President Lungu will then move to Kitwe where he will have a radio program that shall be streamed live to other radio stations across the country and beyond the borders to those that have internet radio.

During the radio programme, the head of state is expected to discuss some of his governments major development achievements such as the heavy multi-billion dollar investment in the energy sector, agriculture development etc.

The programme, because of its huge magnitude is also expected to be monitored by the state broadcaster, Zambia National Broadcasting Corporation (ZNBC) television and radio.

Local and foreign media are free to tune into this important programme that will commence at 7 am and end at 8 am.

President Lungu is expected back in Lusaka where he will close his country wide marathon tour with a Mega Rally at Woodlands stadium.

According to the statement, Woodlands stadium area bears a nostalgic feeling for the President of Zambia. It is at Woodlands Stadium Open Grounds where the party held its final rally. It is also the place President Lungu made a passionate call to be elected.

And the President has continued to urge Zambians, especially members of political parties to maintain peace and unity before and after elections.

Ignoring the Prize: Can HH or Lungu win the Elections with 50+1 ?

polling assistants verifying the details of a voter at omelo mumba basic school in Katete district yesterday

The issue of 50+1remains veiled as Zambia votes. It is telling that the Electoral Commission of Zambia and politicians have not educated the public on this matter. Regardless of votes won, the requirement of 50+1 is the winning mark. What happens if no candidate gets 50+1 votes? How about the time involved before declaring the winner? These are critical questions to the 2016 presidential elections.

Unless numbers lie, Lungu and HH are unlikely to win the August 9 elections. In the January 20, 2015, Edgar Lungu got 48.33 (807,925), while HH got 46.67 (780,168). In the 2011 elections, the PF got 42 %, MMD 35 %, while UPND got 18 %. The 2008 election followed this pattern: MMD won by 40%, PF by 38 %, while UPND dropped to 19.7 %. In 2006, MMD won that election with 43 %, followed by PF at 29 % and lastly by UPND with 25 % of the vote.

The above numbers show why both HH and Lungu are not likely to win this election. Theoretically, one can argue that the absence of the MMD in 2016 elections suggest that a candidate can win 50+1. But as the 2015 elections showed, both parties are beneficiaries of MMD votes. Hence, love them or hate them, smaller parties will be the spoilers—they will make it very hard to hit 50+1.

Can Lungu hit the home-run without a re-run? To his credit, President Lungu started campaigning the moment he took power. Aside from widening PF-reach in rural areas through the implementation of the “Social Cash Transfer,” he killed the MMD—winning over Eastern province; thus restricting HH’s reach in Eastern Province. In this regard, PF and not HH will win a big chunk of former MMD votes in Eastern province. Nonetheless, President Lungu is unlikely to hit 50+1. At the hype of his popularity, President Sata could not hit 50%. President Lungu is not Sata – thus expecting 50+1 is ignoring the above figures.

But can HH make history this time around? Some people think the August 9 elections are settled. To use former first lady, Mrs. Maureen Mwanawasa’s words, “HH’s time to rule Zambia has come”. The numbers of former PF MPs campaigning for him such as Guy Scott, Silvia Masebo and Miles Sampa among many others and his support from Nevers Mumba’s MMD (though Mumba brings no vote to HH) add to this excitement. HH’s popularity in Southern province is intact, while the Copperbelt and Lusaka provinces have always been accommodating to UPND. Without polling, HH’s popularity in these areas will only be known after all votes are counted. Nevertheless, the question is not whether there is the HH tsunami in Zambia, but whether this tsunami will translate into 50+1 votes. Given the tribal nature of Zambian politics, and the number of opposition parties, HH’s chances of forming the next government without a re-run are very slim.

What this means is that unlike in previous elections when a simple plurality declared one a winner, in 2016, one can only win by 50 +1. Zambia will surely go for the re-run between PF and UPND—something new to our political process. Should we have a re-run, smaller parties will determine the next president. It is therefore imperative that the public and all political cadres are educated about this requirement to avoid violence on the streets. Currently the Electoral Commission seems to ignore this sensitive reality.

UPND refuses to be intimidated by violent PF cadres

The UPND has refused to be intimidated by PF. After a horde of PF cadres attacked a UPND double decker bus in Munali yesterday afternoon, hurling rocks that caused injury and stealing UPND materials, a UPND team swept up the broken glass and checked on fellow supporters before continuing on to the University of Zambia.

UPND president Hakainde Hichilema said the Zambian youth are hungry for change. They want universities that stay open, they want a government that doesn’t withhold meal allowances while ministers are busy feeding themselves, and most of all they want jobs and business opportunities.

Mr.Hichilema said UPND is ready to deliver its 10 Point Plan by cutting waste and fighting corruption. He said UPND is ready to support and empower business professionals, entrepreneurs and civil society leaders of tomorrow.

President Lungu urges observers verify the information they gather with all concerned parties

27

President Lungu
President Lungu
President Edgar Lungu has implored election observers in the country to stop transmitting falsehood about the electoral process to their institutions.

President Lungu says observers should instead verify the information they gather with all concerned parties.

The President says it is disturbing that some observers are transmitting lies told by the opposition UPND.

President Lungu says he has on several occasion pledged to deliver a free, transparent, and fair election and that his position will not change.

The President says the opposition UPND has just failed to sell their message to the electorates hence the desperate attempts to mislead the International community.

President Lungu has since challenged the observer missions to interrogate information they obtain from political players and other stakeholders with relevant authorities.

The President also encouraged election Overseers to find out why UPND is saying they will not accept defeat after this Thursday’s poll.

President Lungu said this at State House today when he held meetings with four observer missions.

And African Union head of mission Goodluck Jonathan says his team is impressed and satisfied with the process so far.

Mr. Jonathan who is also former Nigerian President said he is hopeful that Zambia will maintain its good reputation of holding free and fair election.

He has however urged all Presidential candidates to accept the outcome of the elections.

Meanwhile former Mauritius President, Cassam Uttem says Zambia should remain the beacon of peace in Africa after the polls.

Mr. Uttem who is heading the delegation of the Electoral Institute for Sustainable Democracy in Africa -EISA- observer mission said his team is equally satisfied with the process.

President Lungu also held talks with European and Commonwealth observer mission delegates

Vote wisely – JCTR urges Electorates

7

jctrWith only a few days remaining before Zambians go to cast their vote on 11th August 2016 to elect a new set of Leaders and Vote alongside the Referendum, JCTR Livingstone has urged the electorates to vote wisely on 11th August, 2016 general elections and vote on issues that will enhance the quality of living of every Zambian especially the poor.

JCTR Livingstone Outreach Regional Officer Gorge Makaha says it is imperative that the casting of votes is based on issues relating to availability and accessibility of adequate nutrition and quality social services to the majority Zambians.

Mr Makaha said from the standpoint of the electorate, election time is meant to critically analyse party manifestoes and right candidates who will contribute towards changing the harsh living conditions that our people find themselves in and such candidates should be “servant of the people” who attend to the needs of those who elect them.

He said If the process of elections is to be meaningful to Zambian households they must be seen to be creating positive changes in as far as improving the household’s ability to access basic needs is concerned.

“JCTR’s belief is that the duty of the electorates should go beyond the actual voting to actively participate in all forms of governance processes after the elections. Specifically, electorates must make government accountable and measure its’ success by evaluating their performance on the basis of the promises made during the campaigns.

“The future of our country over the next five years now lies in the BALLOT BOX”. We hope it is a future that will guarantee prosperity for all. Only creditable, honesty and humble leaders can ensure that hope for prosperity is equitably shared amongst the 14 million plus inhabitants that live within our borders,”he said.

And according to JCTR the basic needs basket in Livingstone slowed down in July by almost K 7.14“At the end of July 2016, the BNB for livingstone for family of five showed a reduction of K3, 852.83 from K3, 852.83 recorded in June 2016.

“The average cost is too high for most households to adequately meet essential household needs” said Mr. Makaha

ZNBC a Disgrace to the Nation

ZNBC DG Richard Mwanza with Airtel Zambia CEO Peter Correia as the Mr Mwanza takes his time to tour Airtel Head Office: Network Center on Wednesday , July 13th 2016

The Zambia National Broadcasting Corporation (ZNBC) which prides itself in being a public broadcaster is a disgrace and is doing this nation a disservice. I make this observation in light of its partisan and unpatriotic reporting in the last few months.

It is not debatable that in the last few months, when you switch to ZNBC news, the headlines have been obvious: President Edgar Chagwa Lungu, Inonge Wina, Esther Lungu, Chishimba Kambwili, usually in that order. In short ZNBC has virtually transformed itself into a PF propaganda wing.

But what happened last night is a scandal. The Constitutional Court passed a landmark judgment to the effect that cabinet ministers, deputy ministers and provincial ministers should vacate their offices forthwith and pay back salaries and allowances they have been drawing. Muvi TV gave this item prominence and it came out as the first headline during its 1830 hours prime time news.

Sadly our “Dead NBC” chose to ignore this historic landmark judgment during its 1900 hours news. They chose to give prominence to PF campaigns as usual. Interestingly, during the 2200 hours news, the headline was that “President Lungu accepts Constitutional Court Judgment”, again trying to give prominence to Lungu’s response rather than the actual judgment. We know that the majority of viewers watch the 1900 hours news more than the 2200 hours news. Therefore, this was deliberate and intended to deny the majority of Zambians critical information.

This is unacceptable for a media house that is supposed to serve public interest and uses taxpayers’ money to function. ZNBC under Richard Mwanza is the worst we have seen in the history of this country, and if he has any iota of conscience remaining in him he should step down.

I call upon all well-meaning Zambians to come together and compel ZNBC to begin to serve the interests of the public. As for the judgment, let us ensure that no former minster stays in office today and that they do not get away with the repayments.

Ignore UPND on the referendum-Nakacinda

7
Raphael Nakacinda
Raphael Nakacinda

MMD’s other national secretary has called on people to ignore calls by the UPND for people not to vote in the referendum and ensure that they turn up in numbers.

Speaking when he featured on Zambezi FM in Livingstone Raphael Nakacinda said the calls by the UPND for people to boycott voting referendum was unreasonable because the referendum was not in any way connected to any party but ensuring that some rights are granted constitutionally.

Mr Nakacinda said the UPND have resorted in calling for a boycott in the referendum because the PF had taken away what they wanted to use as a campaign tool.

He said the cries by the UPND are sour grapes because they are the same party who advocated for the enactment of the new constitution and that the PF have done that they have chosen to U-turn from their own advocacy.

“What the UPND is doing is just sour grapes because these are the same people who calling for the new constitution to be enacted. They wanted to use the constitution as a campaign tool but now that it has been given to the Zambian people they don’t have anything use in their campaign messages.

“The referendum is not for the PF but for Zambians and anyone who tells people not to vote in a referendum does not mean well. Mr Hichilema and his party should be advocating for the improvement of lives of many children because that’s what it entails to vote in a referendum.

“The are many rights that will be granted to mothers and children such as the right to education which will ensure that all Zambian children can go to school without being chased for any reason,” he said.

Nevers Mumba takes a swipe at President Lungu, RB should not be in active Politics

52

Nevers Mumba
Nevers Mumba
MMD President Dr. Nevers Mumba has expressed alarm at the shocking levels of ignorance and inexperience being exhibited by President Lungu on important constitutional matters that hinge on poor governance and disregard for rule of law.

Commenting on the Constitutional Court ruling that Ministers’ continued stay in their positions beyond the desolution of Parliament on 16th May, 2016 was illegal and were now required to re-imburse all monies received in allowances and salaries since that date. Dr. Mumba wondered how President Lungu could have made such a blunder even on Deputy Ministers when the position was now not in the Amended Constitution and that the entire case only proved the theft and lack of regard for public resources by the PF Government.

Dr Mumba further said those that had accused President Lungu of being unfit to occupy the highest office in the land had been vindicated since it appeared that the country had been on ‘auto pilot’ since January 2015 and perhaps explained certain questionable political and governance decisions made by Mr. Lungu, which had led to the current pitiful state of affairs in the country. He said it was now clear that President Lungu and his advisers were all simply incompetent to run government.

Dr. Mumba further said it was extremely disturbing that a lawyer of President Lungu’s stature could superintend over a government so fraught with lawlessness and recklessness plunder of national resources never experienced before in this country. He said right now the country was grappling with trying to understand how a lawyer president could allow a former president, who was actively involved in politics, continue to draw hefty pension benefits in defiant violation of the Benefits of Former President’s Act Chapter 15 of the Laws of Zambia, which stipulates that any former President who engages in active politics immediately forfeits claim to the benefits. But it now appeared that Mr. Banda had met his match in President Lungu in defying the rule of law and violation of the Constitution of the land.

“It is gratifying that the Law Asociation of Zambia has won this case to bring sanity to the nation. We now appeal to the Association to petition President Lungu on the unfortunate case of former President Rupiah Banda being allowed in active politics while drawing his benefits in clear violation of the law. We also request LAZ to censure and question the Attorney General, the Minister of Finance, the DPP, the Secretary to the Cabinet and the Secretary to the Treasury to answer to the taxpayers on how this case has been handled which was another case of obvious abuse of office and authority on the President’s part.

“This is not based on anything personal against Mr. Banda, but must be addressed for the sake of precedence and posterity,” he said.

According to Dr Mumba , Mr. Banda was recently awarded K5 Billion (un-rebased) which was the purported value of a house he is entitled to as a former president. Last week Mr. Banda joined President Lungu on the campaign trail in Eastern Province to campaign for Mr. Lungu and the Patrotic Front, in violation of both the Principal and the Amended Benefits of Former Presidents Act.

Al Ahly in confidence setback ahead of Zesco clash

Al Ahly suffered a confidence setback on Monday evening ahead of their home game against Zesco United after losing to Zamalek in the Egypt Cup final.

Zamalek beat Al Ahly 3-1 in Cairo into retain their title in a match Zambia striker Emmanuel Mayuka was an unused substitute.

The defeat came five days before Al Ahly host Zesco in this Friday’s penultimate 2016 CAF Champions League Group A match in Suez.

However, Zesco have not been in action since July 27 when they returned from Cote d’Ivoire where they drew 1-1 with ASEC Mimosa in a Group A fixture.

And Al Ahly, who picked up their first Group A win on July 27 after beating leaders Wydad Casablanca 1-0 away in Morocco, are seeking their second straight victory when they hosts Zesco.

15 years later, Igesund’s long wait for Zambia job ends

23

An interesting fact is that Gordon Igesund finally gets the Zambia job 15 years after he was first linked to the post.

The South African is set to be appointed Zambia coach in what will be his first foreign stint after a decorated career at club level in his homeland.

Igesund was first linked to the Zambia job in 2001.

The ex-Bafana-Bafana coach was courted for the job as gap-coach to oversee Zambia’s 2002 Africa Cup outing in Mali following CAF’s suspension of Dutchman Jan Brouwer.

Browuer was suspended by CAF after pushing a match official in Zambia’s 1-0 away win over Madagascar that earned Chipolopolo a dramatic last day passage to Mali after earlier losing 2-1 at home to their Indian Ocean rivals.

The interim position, though, went to Roald Poulsen at the Mali tournament where Zambia exited with its now customary one point in the preliminary round.

Igesund has some insights into Zambian football with two club wins and two national team defeats.

He led Manning Rangers to a 4-0 aggregate win over Power Dynamos in the pre-group stage of the 1998 CAF Champions League whose highlight was a convincing 2-0 victory in Kitwe.

Manning Rangers went to to finish second in Group B behind eventual 1998 African champions ASEC in the old format that went a straight finals after the league phase.

With the national team, Igesund lost 1-0 at home to Zambia in the 2012 Mandela Challenge in Johannesburg.

A year later, Zambia beat Bafana 5-3 on penalties in the 2013 Cosafa Cup semifinals in Ndola after a 0-0 full-time result en route to Chipolopolo lifting the title at home.
