Nevers Mumba led MMD Faction says Supreme Court has ruled in their favour

MMD National Chairperson Winnie Zaloumis has announced that the Supreme Court of Zambia this morning reconfirmed Dr. Nevers Mumba as President of the MMD.

She said the Court ruled that the court order which the Felix Mutati faction relied upon and misinterpreted as giving them consent to proceed with three actions namely, the holding of the controversial convention held in Kabwe on 20 -22 May, taking over the offices and assets of the party and changing names of party office holders at the Registrar of Societies has been overturned and quashed.

Ms Zaloumis has further said today’s judgement effectively reconfirms the status quo of Dr.Nevers Mumba as President of the MMD with all the other legitimate office holders. Felix Mutati therefore maintains his expelled status until the courts makes another order. Rafael Nakacinda remains suspended from engaging in any party activities.

And yesterday,the Felix Mutati-led MMD lost a petition against the nomination of three parliamentary candidates because the matter was wrongly filed before the Constitutional Court.

Constitution Court Justice Mugeli Mulenga said the matter was wrongly before the Constitution Court, despite the petitioner having been clearly and timely advised to take the case before the High Court.

This was in a matter in which Raphael Nakachinda in his capacity as MDD national secretary petitioned the adoption and nomination of Elizabeth Chitika as a parliamentary candidate for Kawambwa Constituency under the MMD in the forthcoming August 11, 2016 general elections.

Ms Justice Mulenga said Mr Nakachinda had the time and opportunity to file the matter before the High Court, which chance he had lost out on procedural technicalities.

“I note in this case that the petitioner was not ignorant of the appropriate forum as acknowledged in the affidavit of verification and exhibited letter from the Electoral Commission of Zambia clearly and timely advised him to petition the High Court within seven days after the close of nominations.

“The petitioner thus has himself to blame. In light of these facts, the provisions of Article 118 (2) of the Constitution on not having undue regard to procedural technicalities cannot assist the petitioner in his willful conduct,” Ms Justice Mulenga said.

Mr Nakachinda had earlier requested if the matter could be transferred to the High Court, but Ms Justice Mulenga argued that he was advised and so was fully aware of the consequences of his action.

He had also applied for the consolidation of two other matters of similar nature in which two other candidates also filed in nominations under the defunct Nevers Mumba-led MMD.

“He (Nakachinda) urged the court to consider article 118(2) (e) that justice shall be administered without undue regard to technicalities and that if the matter is dismissed, they cannot go to the High Court as they would be time bound,” she said.

The MMD national secretary complained to ECZ and later sought the intervention of the court claiming that Ms Chitika and two others had filed their nominations fraudulently and sought that the Constitutional Court should strike off the nominations as invalid.

UPND Kabwata aspiring candidate Mulenga Sata yesterday rubbished reports suggesting that he was a missing candidate in Kabwata, as he has allegedly not been seen conducting meetings in the constituency.

Mr Sata has accused the Patriotic Front (PF) of being behind the spread of the false rumors that he had gone into oblivion and was not campaigning.

In an interview with the Daily Nation yesterday, Mr Sata said he was the candidate with more posters in Kabwata constituency than any other aspirant.

“If you compare the posters that I have with others in Kabwata constituency you will see that I am around campaigning unless if those who are saying I am not campaigning need different types of campaigns, which I don’t know of,” he said.

Mr Sata said it was impossible for him to be in each and every part of Kabwata constituency for people to see that he was campaigning.

“I want to win the Kabwata constituency seat; that is why I am campaigning on the ground but please remember that I cannot be everywhere at the same time,” he said.

Mr Sata said he had a strong and hardworking campaign committee who were on the ground campaigning for him.

“We have been having door-to-door campaigns, meetings with women and youth groups in the constituency, and tomorrow I will be meeting a group of pastors,” he said.

Mr Sata said time for rallies would soon come and the people of Kabwata would be able to see him.

“I have been meeting different groups of women, men and the youth. Tomorrow I will be meeting a group of pastors, so I don’t understand why people are saying that I am missing in my constituency,” he said.

Mr Sata wondered what kind of campaigns people were expecting him to be engaged in.

Recruitment of Grade 11s to man polls in Chadiza by ECZ raise suspicion

With only 17 days to go before Zambians vote in the general elections and the referendum, the Electoral Commission of Zambia (ECZ) is leaving no stone unturned in trying to deliver a credible electoral process.

The commission has since trained poll staff that would be charged with the duty of carrying out the very important national duty.

In chadiza district 528 people have been picked and trained as poll staff for the forthcoming general elections and referendum.

Out of the 528 only 470 will be recruited to conduct the voting exercise.

However, the selection of poll staff in Chadiza district has been received with mixed feelings as grade 11s and school leavers without proper qualification have been picked to conduct the national duty.

A list that was made by a team of experts comprising the District Education Officer (DEBS), the Zambia Police, and the returning officer was repealed and replaced with a list that was done by trainers, a situation that has brought concerns in the area.

A number of residents that were dropped and left out of the list have continued to storm ZANIS offices in Chadiza to express their feelings over the electoral commission recruitment criteria.

District Training Officer, Kabange Masenga, has acknowledged the recruitment of a wide range of people including school leavers.

Mr Masenga said a number of school leavers have been recruited including other people that were already in employment.

And District Electoral Officer, Kennedy Kazanda, has refuted reports that trainers had recruited relatives and girlfriends.

Mr Kazanda challenged those coming up with such allegations to come out in the open and point out which trainer had recruited a girlfriend or any relative.

He also refuted reports that the electoral examination has been leaked, adding that the examination papers were intact as they were brought in from the electoral commission.

He said whoever was making such allegations should come up with a copy of the leaked paper as evidence because to him all was just a mare speculation.

The allegations come out when some participants were being hand-picked out of the training to go and collect their electoral certificates with others being threatened to be thrown out of the examinations.

PRESIDENT Edgar Lungu described as total falsehood claims by Geoffrey Bwalya Mwamba (GBM) that he was pivotal in the formation and founding of the Patriotic Front (PF) led by late President Michael Sata.

According to a statement issued to Daily Nation by Patriotic Front information committee member Sunday Chanda, President Lungu cautioned the people of Northern Province not to fall for Mr Mwamba’s claim that he was popular and could deliver development in Northern Province.

“Uyu ale mi bepa ati ewa chitile fund party,” President Lungu said, “ale mibepa. The people that were at the formation of the party are people like Mr Samuel Mukupa, Mr Chishimba Kambwili not uyu…he is a liar and carries no clout.”

“Do not be cheated by Mwamba and his self-perceived importance and claims that he helped fund PF…he is nothing but a liar who was not even there at the formation of the party.”
President Lungu said in 2001 Mr Mwamba was still “stewing” in hate for having been convincingly whacked by Agriculture minister Given Lubinda when he first contested the Kabwata parliamentary seat, despite having heavily funded the lost campaign.

He said the PF later on, through President Sata, took pity on Mr Mwamba and campaigned for him to run in Kasama where he, for the first time, became a Member of Parliament due to the popularity of President Sata.

President Lungu, who in the past has questioned UPND leader Hakainde Hichilema’s judgment to appoint Mr Mwamba as a running due to his documented history of violence against his wife Chama, sister-in-law and workers also took time to root for his running mate Ms Inonge Wina.

“I am confident that if anything happened to me, Ms Wina would be a great President because she is not very different from me,” President Lungu said, “batila ichikwanka bachimwena kuma mpalanya (meaning you can tell a person by the company he or she keeps.”

And Kasama Central aspiring candidate Kelvin Sampa said women voters must think twice before voting for Mwamba because “a vote for Mr Mwamba is effectively endorsing violence.

Mr Mwamba’s history of violence, beating up his wife including his wife’s sister is a well-documented fact. It is something I would not endorse if I were a Zambian woman.”

President Lungu wound up his Mungwi rally by promising more development for the area in return for the Northern Province continued unwavering support.
“It is an undeniable fact that your support ought to be rewarded,” he said.

President Lungu later held another rally at Kasama’s Gold Club that got filled to capacity after scares that the Independence Square would not hold the heavy crowd without possible casualties.

First Lady Esther Lungu, who accompanied the President, told the ecstatic crowd that her husband would appoint skilled people with disabilities to his Government once re-elected.

MAZ disappointed with members found guilty of underweight packaging as consumers call for punishment

mealie meal2The Millers Association of Zambia has expressed disappointment with its members who have been found wanting due to under packaging.

Association Chairperson Andrew Chintala said it is unfortunate that some of its members have been found guilty of the offence of underweight packaging and selling underweight mealie meal.

Mr Chintala further said his Association will launch investigations on the matter to establish the cause of such behaviour by its members.

Seven out of 10 inspected milling companies in Lusaka, Ndola, Luanshya, and Choma were found guilty by the Zambia Weights and Measures Agency of the offence contrary to the provisions of the Weights and Measures Amendment Act number 12 of 2003.

And some consumers have called on the relevant authorities to institute necessary punishment to the millers found guilt of underweight packaging.

Samson Ngoma of Lusaka said the behavior by the milling companies can only be described as day light robbery of consumers.

He said it was unfair to hard working Zambians to be robbed by millers in such a manner and that stringent monitoring measures should be put in place to ensure that aligning millers are kept in check.

Another consumer also from Lusaka Gerald Mwansa suggested that millers fund guilt should be black listed by the FRA as punishment of their crooked behavior.

He said Zambians cannot be subsidizing the commodity for companies which in turn use dubious means to reap them of the little they earn.

He said there are a lot of poor Zambians who struggle to make money and that selling them underweight bags of the staple food adds to their challenges hence a befitting punishment would be to deny the millers found wanting access to the FRA maize.

James Ngoma earned his stage name from his debut album Chamanyazi, which was released in 1994 while he was doing his secondary education at Kabulonga Boys Secondary School of Lusaka. His debut album became an instant hit on the Zambian music market, receiving massive airplay both on Television and Radio stations in the country, and had instant coverage on most of the print media.

James Chamanyazi, a contemporary Kalindula/Traditional Pop & Jazz artist has been in the music industry since 1994, when he was a teenager.  He is one of the pioneers of rejuvenating the Zambian music industry, which was at the verge of extinction at the time; and in the fore front of Zambian Arts administration, from a tender age under the tutelage of the late Webster Malama, where he served in many different portfolios in ZAM. He has managed and inspired a lot of fellow musicians/Artists both at home and abroad. He has managed to be consistently active since his early years in the music industry and made it a very successful two decades in the industry.

Since 1997, James Chamanyazi and other artists, while working under Muvi studios formed a band called The Muvi Posse Band whose sole aim was to bring back the popularity of Zambian music in the country (which was hugely dominated by foreign music). After its successes, such as winning the first KORA AWRD by a Zambian artist in 1999, also winning the M-net most talked about artist and several Ngoma awards then the Muvi studios management stopped sponsoring the band. The pulling out of Muvi Studios led to some of the top musicians leaving the band, thus leaving Chamanyazi to manage the band singlehandedly.

Chamanyazi and the Muvi Posse band are one of the very few contemporary live bands that performs authentic Zambian music in a multi-dimensional, traditional and multi-directional way . The Muvi Posse Band performs and explores various elements of African music such as Kalindula, Chitelele, Shonongo, manchacha, chingande, chimtali, Siomboka, Rhumba, Chimurenga, Kanindo, Kizomba, Hip hop, Reggae, Rock, Jazz, Kwaito and free form. Since inception, the band has sought opportunities for a wider, free expression of live band music. The Band’s musical inspirations include some of Zambia’s singing sensations like Late Alick Nkhata, Late P.K Chishala, Late Paul Ngozi, Late Mike Nyoni, Violet Kafula, Late Joyce Nyirongo, the WITCH band and the Musi-o-tunya band. The Muvi Posse Band finds performing and touring an opportunity to engage in dialogue with different people of the world and the mixture of cultures that contributes to the betterment of the earth. Other successes Chamanyazi and the band have achieved include the Best Kalindula album of the year award 2014 at the Zambian Music Awards (Mosi Awards); the most conscious HIV and AIDS Artist 2008 and 2009 and best band of the year 2010 and 2011, (all of which were Ngoma Awards).

From 2003 to date, Chamanyazi has been managing this band and helping other budding, upcoming and less privileged artists at his garage studios, through music lessons, recording studio and live band performances, as well as live band equipment assistance. He has also been in the fore front of bringing professional Arts management to the Zambian music industry as has sat on the Zambia Association of Musicians (ZAM) board and has served as the General Secretary. He has also been on the Zambian Music Copyright Protection Society (ZAMCOPS) Board as a committee member.

 

Chamanyazi has been involved in several community awareness campaigns with the Government and Non-Governmental Organizations such as the fight against HIV and AIDS, Environmental protection awareness, Climate Change awareness, Malnutrition awareness campaign, Safe Motherhood awareness, Children’s rights awareness, voters’ education awareness, cervical cancer awareness, human rights awareness, Make Fair Trade and early childhood education awareness campaigns among others.

President Edgar Lungu’s daughter Tasila has refuted reports that she challenged UPND leader Hakainde Hichilema to a live TV debate.

In a statement, Tasila who aspiring for a ward seat in Chawama under the PF ticket said it has come to her attention that statements have been issued and circulated on and off line directly attributed to her ostensibly challenging Mr Hichilema to a debate.

“I would like to set the record straight here and now by categorically refuting any authorship of the statement (s), either officially or unofficially. Please treat the statements as a hoax,” Tasila said.

“I nevertheless thank you very much, especially the people of Chawama, where I am contesting a seat as a Councillor, and also thank you for the unwavering support you have continued to give President Edgar Chagwa Lungu as he takes his development campaign across the country ahead of the 11th August polls. God bless you all.

THE Jesuit Centre for Theological Reflection (JCTR) has urged Zambians to give a yes vote to the referendum on 11 August.

JCTR director Leonard Chiti said the issue of the referendum was not a partisan but national issue that needed concerted efforts from all stakeholders regardless of one’s religious or political affiliation.

Fr Chiti said politicians had an opportunity of telling the people the truth regarding the referendum instead of them giving conflicting information on the exercise.
Fr Chiti was speaking during a stakeholder’s workshop on the referendum and elections at Livingstone Lodge in Livingstone yesterday.

He said the referendum exercise has an opportunity of building a platform for a better Zambia if it succeeded.

“My appeal is that this is not a partisan issue, but a national issue that is very progressive and for the better future of the generation to come. We started advocating for a new constitution sometime back and some of the politicians who are against the referendum now, were part of the exercise but now we are surprised that they have changed their stance.

“Some of the rights that are being proposed in the bill of rights are very cardinal to the development of the nation but it is sad that here in Southern Province some politicians are telling people to ignore the referendum and to our surprise, they are not explaining why people should ignore it,”Fr Chiti said.

He called on stakeholders to go flat out and sensitise people to vote yes in the referendum.

The JCTR director also appealed to political parties to engage in issue based before the 11 August general elections.

“Politicians should realise that people want to hear their agenda for the country and not personal attacks. Am happy with what I have seen in Livingstone, campaigns are peaceful and political parties are able to co-exist, all districts need to emulate the atmosphere in Livingstone,” he said.

HH Promises to revive all dormant industries in Livingstone once elected

UNITED Party for National Development (UPND) President Hakainde Hichilema has promised to revive all dormant industries in Livingstone once voted into power on 11 August.
Mr Hichilema said Livingstone needed to reclaim its position as a Tourism, Textile and Timber industries town in order to create more employment opportunities for the local people.

Addressing a rally at Villa Grounds in Livingstone on Monday, the UPND leader promised to complete the construction of the bus terminus and the market which he claimed the Patriotic Front (PF) Government had abandoned.

Mr Hichilema who was accompanied by UDF leader Miles Sampa bragged that he was the only leader in Zambia who was able fix the economy because he was an economist who understood the running of national affairs for a developing nation like Zambia.

“Once elected into office on 11 August, I promise to bring back all industries including the Livingstone motor assembly plant, I promise to give loans to all Marketeers and Taxi drivers so that they become their own boss instead of working for someone.

“There is too much hunger in our homes, very few people are educated and that is why as UPND we still insist on free education and reducing the cost of basic commodities, ”Mr Hichilema said.

He said once voted into power, the UPND will only give contracts for transportation of maize to Zambian companies only.

“No foreign company will be awarded contracts to transport maize across the country because we want to empower local transporters and so if there is a company from South Africa,Congo,Zimbabwe or Malawai that is transporting our maize, your days are numbered,” he said.

Mr Hichilema also strongly advised his supporters to reject the referendum alleging that it was meant to help rig the elections for the Patriotic Front.

Meanwhile UPND cardres ran amok after their rally and started beating up PF sympathisers, pulling down PF posters and chitenges in full view of the UPND leader when his motorcade made its way into the central business district of Livingstone town.

Last batch of ballot papers transported to Dubai Airport

Team Zambia has today completed its mission at the Al Ghurair Printing and Publishing Company in Dubai after seeing off the last consignment of ballot papers from the plant to the airport for delivery to Zambia on Thursday this week.

The team reiterated its satisfaction at the work done and the cooperation that existed among different political parties, the Electoral Commission of Zambia (ECZ) and other stakeholders during the printing and packaging process.

Himba Malambo of the People’s Alliance for Change (PAC) said it was pleasing that the ballot paper printing exercise has been accomplished without any dissatisfaction among stakeholders.

Ms. Malambo, who spoke on behalf of other political parties, said all stakeholders were happy with the whole process.

And Bishop Shemmy Makelele from the Evangelical Fellowship of Zambia (EFZ), who represented the church in Zambia in Dubai, urged Zambians to remain peaceful and united as they await the arrival of ballot papers and the subsequent casting of votes on August 11, 2016.

Meanwhile, the Islamic Supreme Council of Zambia (ISCZ) has said Zambians should trust the team in Dubai on the information they have given regarding the printing and packaging process of ballot papers.

ISCZ Secretary General Sheikh Shaban Abdulamajeed Phiri, who represented other faith based organisations, said it was encouraging that all stakeholders have expressed satisfaction with the whole process in Dubai.

And the leader of team Zambia Emily Sikazwe said the Electoral Commission of Zambia (ECZ) was happy with the work which stakeholders have done during the whole process.

Dr. Sikazwe, who is one of the Commissioners at ECZ, said the unity and the work which stakeholders have done in Dubai was a demonstration that Zambia was ready to strengthen her democratic process.

She said there was transparency and credibility during the team’s stay in Dubai.

The last batch to be transported to the airport in Dubai comprised 189 pallets containing ballot papers for the mayoral/councillor, local government and national assembly elections.

Each of the three levels of elections has 63 pallets of ballot papers.

Yesterday, 155 pallets containing ballot papers for presidential election and the referendum, posters and NRC verification forms were transported to the airport in readiness for delivery to Zambia.

All pallets will have an allowance of 24 hours to allow for cooling in the airport warehouse before being transported to Zambia on Thursday, July 28, 2016.

Police have apprehended ten suspects in connection with the offence of Malicious Damage to property.

Police Deputy Spokesman Rae Hamoonga said it is believed that on Sunday around 15:00 hours in old Kanyama compound, ten suspected UPND cadres whilst on a campaign trail damaged five front screens and sliding glasses of five minibuses that were stationed at Mutandabantu Bus Station without any lawful justification.

Mr Hamoonga said among the suspects who were apprehended, Orian Shantobolo was found in possession of a catapult and a bottle containing sand and petrol.

“Following the arrest, an identification Parade was conducted yesterday 25th July, 2016 between 15:00 and 16:00 hours. Five out of ten suspects were positively identified by the owners of the buses and will be charged for Malicious Damage to property.”

He said the four Chitabola Lipoba aged 30, Chikumbi Lastone aged 32, John Dausi aged 26, Namasiku Namangolwa aged 26 while the fifth suspect identified as Orian Shantobolo aged 30 will also be charged for Malicious Damage to Property and being found in possession of offensive weapons.

Mr Hamoonga said the value of the damaged property has not yet been ascertained and that suspects are in Police custody and will appear in court soon.

George Lwnadamina has asked his charges for an efficient display in Abidjan on Wednesday as Zesco United seek their first away Group A win with a Champions League semifinals berth just around the bend.

Zesco visit ASEC Mimosa in looking for their first group stage win after losing 2-0 away to Wydad Casablanca on June 30 in Morocco.

The Zambian champions have half the job done with a 3-1 home win over the Cote d’Ivoire giants on July 16 in Ndola.

“ASEC are beatable at home but I expect them to fight hard for a win,” Lwandamina said.

Victory will lift second placed Zesco to 9 points that they need to seal their semifinal place with two matches to spare.

Zesco are one point behind leaders Wydad and are three points ahead of ASEC who are number three.

Record 8-time champions Al Ahly of Egypt are bottom with one point from three games.

Green Eagles sign Boniface Sunzu

FAZ Super Division side Green Eagles have signed former Konkola Blades defender Boniface Sunzu on a permanent deal.

Sunzu moves from his parent club Konkola to Eagles less than a month After being released by Napsa Stars.

His contract is indefinite after agreeing to be engaged as a Zambia National Service officer as well.

Sunzu, the younger brother to Chipolopolo star Stoppila, is one of the four players Eagles have captured in the mid-season transfer window.

Eagles have also signed striker Greenwell Witika from Ndola United, winger Lazarous Phiri from Lumwana Radiants and Nakambala Leopards’ Tindi Mwape.

Club chairman Lieutenant Col Jim Kafumukache hopes the four players will help struggling Eagles to survive relegation.

“The bottom is not our portion,” he said.

Eagles are 14th on the 18-team table with 18 points from 19 games played.

Gladys Lengwe to ref at Rio Olympics

Kitwe based FIFA referee Gladys Lengwe is elated after being selected to officiate at the forthcoming Olympic Games in Rio, Brazil.

Lengwe is leaving for Brazil on Wednesday where she will part of a panel of referees to handle football matches at the Rio games.

The ref said she was surprised to be selected for the Olympics.

“I am very happy and very excited. I didn’t expect this but I thank God that I was invited,” Lengwe said.

“My selection opens the window for other referees in Zambia both women and men to work hard and realise they can achieve great things,” she said.

Lengwe has vast experience gained from the 2014 Youth Olympics in China and the FIFA Under-17 Women’s World Cup hosted by Costa Rica in the same year.

She also appeared at last year’s FIFA Women’s World Cup in Canada.

“Expect me to perform to the best of my ability. I want to go all the way and officiate in the final,” Lengwe said
