The Road Transport and Safety Agency (RTSA) has recorded a total number of 325 cases of drink driving during the festive season countrywide.

RTSA Public Relations Manager, Mukela Mangolwa said Copperbelt Province recorded the highest number of drink driving with one hundred and one (101) cases, followed by Southern Province with 69 cases, sixty (60) cases in Central Province, fifty-nine (59) in Lusaka Province, , Sixteen (16) Western Province, fourteen (14) Eastern Province and 6 cases in Muchinga Province.

Mr. Mangolwa said out of the 69 cases reported in Southern Province, the Livingstone Subordinate Court has since charged and fined 10 motorists K2000 each for the offence of drink driving and the other 18 motorists will appear in court on Monday, 4th January 2016. The rest (41) were charged on the spot at check-points.

Meanwhile the Lusaka Fast Track court has also this festive season fined and convicted 14 motorists for drink driving who were found above the legal limit which is 0.38mg/l and 13 will appear in court on Monday.

Section 156 of the Road Traffic Act No. 11 of 2002 of the Laws of Zambia states that any person who, when in charge of a motor vehicle is on a road, but not driving the vehicle, is under the influence of intoxicating liquor or narcotic drugs to such an extent as to be incapable of having proper control of such vehicle, commits an offence and is liable, upon conviction, to a fine not exceeding one thousand five hundred penalty units, and in the case of a second or subsequent conviction, to fine not exceeding not ten thousand penalty units or to imprisonment for a period not exceeding two years.

In view of this, the Road Transport and Safety Agency (RTSA) is appealing to members of the public to refrain from drink driving as anyone who will be found wanting will be charged according to the Law.

The opposition Movement for Multiparty Democracy (MMD) has advised people who wish to contest as Councilors and Members of Parliament to submit application letters accompanied by Grade 12 certificates.

MMD Spokesperson Raphael Nakacinda has said that this is in view of the requirement in Clause 162 of the amended constitution.

Mr Nakacinda has said that the former ruling party is not worried with the new constitution requirement pertaining to elective offices.

According to the constitution amendment bill passed by Parliament last year, which will be assented by President Edgar Lungu tomorrow, no candidate without a Grade 12 certificate will be allowed to contest, the Presidency, Vice Presidency, Parliament and Council Elections.

Rainbow Party leader Wynter Kabimba should be the last politician to start talking about issues affecting Western Province, says Barotse Freedom Movement secretary Chazele Mulasikwanda.

And Charles Ngalama, a Lozi loyalist, said no one should be allowed to entertain politicians coming with the promise of restoring the Barotseland Agreement of 1964 because it was the same Mr Kabimba and his group that had brought havoc in Western Province.

Mr Mulasikwanda wondered why Mr Kabimba was talking about issues against the Patriotic Front when he was the one who had brought confusion in Western Province after he and other PF allegedly cheated people to vote for them to have their request honoured.

“No one in Western Province will listen to Mr Kabimba and he should go back and stop wasting people’s time, the people are currently going through serious hardships, and yet he still comes to talk about the Barotseland agreement,” he said.

Mr Mulasikwanda advised the people of Barotseland to observe peace and stop being misled by politicians who were bound to confuse them.

And Mr Ngalama said policians should not take the people of Western Province for for granted and attempt to use the Barotseland Agreement to win votes.

MMD promises to scrap The Public Order Act

The Police officers involved in the infamous Lundazi Teargassing incident on 18th of December 2015 used the Public Order Act which is an archaic piece of legislation from 1953, whose sole purpose was to harass and intimidate opposition voices. The Patriotic Front have greatly abused the Public Order Act by forcing political parties to obtain so-called Police permits to hold rallies. This is completely wrong.

In 1995, there was a landmark Supreme Court ruling in the case of “Christine Mulundika and Seven Others Versus The People”. The Supreme court noted that the Public Order Act is a hangover from colonial times and was abandoned by the British themselves who wrote it. So why do we still have it in our books?

The Supreme Court ruled that it is not necessary for anyone to get a police permit for a public gathering as it was inconsistent with Freedom of Speech and Movement which are guaranteed in the Zambian Constitution. The provision requiring police permits was declared null and void and struck down 20 years ago but it is still being misused because of ignorance. Let me quote from the judgment.

“… we hold that subsection 4 of section 5 the Public Order Act, CAP 104, contravenes Articles 20 and 21 of the constitution and is null and void, and therefore invalid for unconstitutionality. It follows also that the invalidity and the constitutional guarantee of the rights of assembly and expression preclude the prosecution of persons and the criminalization of gatherings in contravention of the subsection pronounced against. Accordingly, a prosecution based on paragraph (a) of section 7 which depends on subsection 4 of section 5 would itself be inconsistent with the constitutional guarantees and equally invalid.”

Fellow Zambians, the court advised political parties to inform the Police of impending public meetings which those of us in the opposition adhere to but the PF themselves never follow. Moreover, a private meeting with our party structures requires no notice to the Police because we are a private club. It would be absurd for the Police to require notice for every private meeting we hold because this would entail that even the Lions Club or Rotary Club or churches would also require police notification.

Unfortunately, the PF has taken advantage of its position in power to force us in the opposition to apply for police permits which they then reject for flimsy reasons. We demand that the PF stop using the Police to enforce a non-existent law.

Once elected, we shall abolish the Public Order Act within my first year in office. It has no place in a modern society. There are enough provisions in other parts of the law which deal with public disorder or damage to property. The Public Order Act does not add any value to Zambian politics.

I am not leaving UPND and preparing to rejoin PF -GBM

Opposition UPND Vice President Geoffrey Mwamba has refuted rumours circulating that he has quit the UPND as he prepares to rejoin the PF.

In a statement, Mr Mwamba who is commonly known as GBM said the rumours are baseless.

He said he has no desire to return to the PF adding that the ruling party has allegedly failed the Zambian people.

Below is Mr Mwamba’s statement.

I Would not normally respond to rumours but I am forced to depart from this norm because remaining silent may be construed as consent.

In the past few days the rumour mill has generated a story that I have or will resign from the UPND as I have intentions of going back to the Patriotic Front.

Let me categorically state and this is official that no iota of me desires to return to the PF, a party that has in a short lifespan sent the Zambian people into extreme abject poverty never seen in this country’s existence.

As a sane person how would I leave a progressive party such as the UPND that has the programs and strategies that would emancipate us from the lack of direction and plans of the PF.

The PF has failed the Zambian people, and in desperation they have now began to use methods that they intend to confuse the Zambians by running a propaganda and malicious campaign on unsubstantiated issues and hope that some of us will look like we have no morals and are job seekers.

I entered politics to serve the people and not for my benefit and I joined and accepted the position of Vice President Administration of this great party and will remain so until the party decides otherwise.

My position is that nothing will make me leave UPND ,and for PF? What a fallacy. Not a party that has no focus and no love for the people they are supposed to serve. A sinking titanic indeed.

Hear it from me, I have not and do not intend to resign from the UPND and will work tirelessly to ensure that the party forms government come August 2016. So all haters sorry.

‘My food is cooked with mortuary water’

A ZAMBIA Army officer in Ndola has told the Chifubu Local Court that his health has deteriorated because his wife cooks food using water from the mortuary besides secretly administering love potions.
Derrick Ng’ombe of house No. 0080 Pamodzi Township told Local Court senior presiding magistrates Kaala Nyambe and Agnes Mulengahe that he has since been losing weight since 2006 and decided to seek spiritual intervention.
This is a matter in which Ng’ombe has sued Euphresia Mubiana of the same address for divorce, saying he cannot continue living with a wife who is heavily dependent on love potions to sustain a marriage.
Ng’ombe and Mubiana are soldiers of Ndola’s Kalewa Barracks.
Ng’ombe told the court that there was a time a pastor was praying for him and it was revealed that their house needed prayers to rid it of demons.
Ng’ombe said when the pastor went to their house, he asked Mubiana to bring the charms which were in the house, which she did.
“The pastor told me that Mubiana also had a cooking stick which she uses to prepare my food using water from the mortuary. I was told by the pastor that as the cooking stick gets thinner, I also get slimmer,” Ng’ombe said.
The charms, cooking stick as well as the mortuary water were brought before court as exhibits.
Ng’ombe also told the court that he could not concentrate at work as he loses his memory due to the charms that Mubiana has been using on him.
Mubiana did not deny having kept the charms in the couple’s bedroom but instead told the court that she got the charms from her mother and that the charms were meant for the good health of her and the children.
She told the court that she was surprised when Ng’ombe told her that she was using charms on him. He then sprinkled the house with anointing water and stopped eating food cooked by his wife.
Mubiana said it was wrong for Ng’ombe to blame her for his failing health.
The court granted the couple divorce with no compensation on either party as there was no room for reconciliation.
The court also noted that any man would be put off to learn his wife was using charms.
The court ordered that the couple shares any properties that they acquired equally.

A few months after the United Nations Framework Convention on Climate Change, Africa expects to experience better results as far as funding for development and access to finance is concerned.

The need to increase national resources across the spectrum of developmental needs to fight the effects of decades of ineffective waste management such as ill managed mining debris; resources to manage natural environmental issues involving conservation of both fauna and flora; and even resources to ensure the access to necessary developmental projects that seek to open up the continent to commercial and trade facilities will depend on the developed nations response to the UNFCC current mandate.

The developed nations of the West have pledged to assist poorer countries with both funding and expertise meant to build up resilience to the combined effects of climate change and immediate human induced pressures such as land degradation.

The African Union New Partnership for Africa’s Development (NEPAD) recently launched the African Resilient Landscapes Initiative (ARLI). This initiative will be implemented through forest and ecosystem restoration, biodiversity conservation, climate smart agriculture, and rangeland management.

As main partners, the World Bank and the World Resources Institute will support the mobilization of financial and technical resources from multiple sources to design and implement country-specific strategies.

“The ARLI will mobilize African countries and partners to leverage sectorial interventions and collectively ensure the integrity, resilience, restoration and sustainable management of landscapes across regions,” said Dr. Ibrahim Mayaki, Executive Secretary of the NEPAD Planning and Coordinating Agency.

It will work with the African Forest Landscape Restoration Initiative (AFR100) which aims to bring 100 million hectares of degraded and deforested land under restoration by 2030.

“Restoration is one pathway to help improve the resilience of landscapes. The AFR100 platform seeks to help bring together government leaders to impact investors, development banks, bilateral donors, technical support providers and others to restore degraded and deforested landscapes,” stated Sean DeWitt, Director of the Global Restoration Initiative of theWorld Resources Institute in a latest world bank report.

In a joint statement at the recent Convention, the world’s multilateral development banks (MDBs) pledged to “consider climate change across our strategies, programs, and operations to deliver more sustainable results, with a particular focus on the poor and most vulnerable”. The statement revealed that the six banking institutions had already delivered US$100 billion for climate action in developing and emerging countries in the four years since starting to track climate finance in 2011.

It followed on commitments in recent weeks by the MDBs to increased financing for climate change mitigation and adaptation over the next few years. They pledged to increase Africa’s climate financing initiatives and to support the outcomes of the Paris conference through 2020.

“Each of our organizations has set goals for increasing its climate finance and for leveraging finance from other sources. These pledges support the US$100 billion a year commitment by 2020 for climate action in developing countries.”

About 180 countries of the world have now submitted their national plans through the Intended Nationally Determined Contributions (INDCs) to the UNFCCC, laying out plans to tackle climate change and to reduce emissions.

“On climate change, the development banks are shifting into high gear,” said Jim Yong Kim, President of the World Bank Group. “We have the resources, we have the collective will, and we have a clear roadmap in the national plans that our clients have submitted ahead of Paris,” he said in the November 2015 statement.

This process led to a loss of revenue and a big section of our audience. We have however, noticed that lately people are now upgrading to new browsers and the numbers are getting back to the levels we had prior to August when we made the changes.

The new changes enabled us to push more content to your browser at a much faster speed and we are pleased with the results thus far and continue to push for the 3 seconds mark per request. We are currently sitting at 6 seconds to load a page.

BoZ removes withholding tax on government bonds

BANK of Zambia (BoZ) has removed withholding tax on the discount income for government securities to promote the development of secondary market in debt obligation.

Discount bond is a bond bought at a price lower than its face value, with the face value repaid at the time of maturity.

The central bank also says the public and all investors in government securities are further reminded that the withholding tax shall still be deducted from coupon interest earned.

“We wish to remind the public and all investors in government securities that with effect from January 1, 2016, the withholding tax on the discount income for government bonds will no longer be deducted on all existing and new issues.

“This measure is meant to stimulate the development of secondary market in government bonds,” BoZ says in the public notice availed to the Daily Mail recently.

The BoZ says individuals and corporate institutions are eligible to participate in the primary auctions of government bonds.

Currently, the central bank issues government bonds in six maturity categories namely; two, three years, five, seven, 10 and 15 years.

B FLOW, who recently announced that he was changing from dancehall to kalindula because he wanted to be original, has gone back on his decision saying his fans have been complaining.
This is a complete turn-around for the man who a fortnight ago said the decision to go the kalindula way was final.
In his own words: “I wish to announce to all my fans and followers that I have officially changed my music style from Dancehall to Kalindula because I want to be original. This decision is final. I urge you to carefully listen before you begin criticising. Without wasting your time, here are my two new Kalindula singles – Tekwesha Ft. Chef 187 and Veli Badi (produced by Henrik Berhane for Zedway movements).”
Now, he says fans have been complaining that they still want him to do dancehall, hence his quick turn-around.
“My fans have been complaining and lamenting that they don’t want me to do Kalindula because they want that dancehall fire in me to continue burning,” he says.
“Well, I’m sorry to abort Kalindula prematurely, so I’m officially back on the dancehall tip. Who am I to deny mi fan dem weh dem ask for? Meanwhile, look out for my new dancehall album produced by Magg 44 and Jerry Fingers”.
It was always going to be intriguing if not interesting to see how B’flow, who got recognition from President Obama for using music for social good, was going to make the transition from dancehall to kalindula.
The two genres are quite distinct, but a creative person can always play around with them.
While dancehall is some kind of digitalised version of raggamuffin reggae, influenced by hip-hop, which it combines with, kalindula has its roots in Luapula Province and has to be played with atleast two lead guitars, a bass guitar, percussion and drums.

Father Bwalya teases Nawakwi over claims of her possible arrest

The ruling PF has said that it looks forward to seeing FDD President Edith Nawakwi arrested as she recently claimed that the government is plotting to put her behind bars for helping farmers.

PF Central Committee chairperson for information Frank Bwalya said that if Ms. Nawakwi does not get arrested, she should also be honorable enough to apologize for her claims.

Father Bwalya said that the apology should be made to the Zambian people because her accusation, which has been widely publicized would have proved to be falsehood.

In an interview with Qfm News Father Bwalya said that his party does not think a citizen can be arrested for simply campaigning outside the campaign time in the disguise of helping farmers with farming inputs.

Father Bwalya stated that the ruling PF is thus suspicious that there could something that Ms. Nawakwi is doing illegally in her business of helping farmers which she fears the police might arrest her for.

Father Bwalya said that it was however up to the Police itself to ascertain whether she should arrested or not and not by the instigation of the PF government.

Meanwhile, Zambians have been called upon to pray for the success of President Edgar Lungu’s assenting to the Constitution Bills on Tuesday the 5th of January this week.

People in the Country are being urged to do so keeping in mind how big the event to assent to the Constitution Bills will be in the life of their Country’s multiparty Democracy.

The ruling PF is of the view that President Lungu assenting to the Bills at a ceremony to be held at Heroes Stadium in Lusaka is therefore an event that any Zambian should want to be part of.

PF Central Committee chairperson for Information Frank Bwalya says his party believes that once the amendments to the Constitution come to effect, many things will change in Zambia.

Father Bwalya has referred to governance, politics and the rate at which the country will be developing as some of the things that are expected to change.

He states that his party is thus looking forward to Tuesday this week when the wave change in the country will be initiated.

President Edgar Lungu has directed ZESCO and the Energy Regulation Board to adjust downwards its new electricity tariffs following numerous complaints from many domestic users.

The directive marks a complete u-turn on President Lungu who just last month called on Zambians and the business community to embrace the new electricity tariffs.

President Lungu said this when he commissioned the Pensulo-Kasama 330 kilovolts transmission project in Kasama district on December 16 2015 adding that the new tariffs will guarantee meaningful investment and improvements in service delivery in the energy sector.

But through his Spokesman Amos Chanda, President Lungu on Sunday directed ZESCO to cut the new tariffs.

Mr Chanda said President Lungu will examine other ways of encouraging investment in the sector that has suffered stagnated growth due to relatively low tariffs compared to other countries in the region.

“The President wants Zambians to know that he is here to make decisions that will unite Zambia and not breed discontent,” Mr. Chanda said

He said the electricity tariffs reduction is something President Lungu felt had to be done expeditiously until economic alternatives to generate power and encourage investment in the sector are found because Zambians come above economic gains.

IT is not true that I directed my subjects to support Rainbow Party leader Wynter Kabimba in the 2016 general elections as reported by some sections of the media, says Chief Mutondo of the Nkoya people.

Chief Mutondo cautioned politicians visiting his chiefdoms not to drag traditional leaders into politics because they (chiefs) welcomed everyone regardless of their political affiliation.

He said as much as his chiefdom supported the Government of the day, that did not give guarantee to all the politicians to take advantage of them.

“At no time did I tell my people here that they should support the Rainbow Party for me to be senior chief, it is sad that politicians want to politicise everything and propagate things that could not be achieved,” he said.

Chief Mutondo was speaking to the Sunday Nation in a telephone interview though his Ngambela Mwanashiheni, Derrick Moyo.

“Politicians visiting the palace should not expect us tell them whether they are supported by the chief, because we welcome everyone who pays a courtesy call, and to say that we are supporting Mr Kabimba is not true and this should be avoided at any cost,” he said.

Chief Mutondo said his establishment was peaceful and preached unity, and that there was no way they could side with any political party when they were obliged to support the Government of the day.

He called for peace and unity, adding trying to drag traditional leaders into active politics was retrogressive to development.
The traditional leader said the policy of the royal establishment was to support the Government of the day in a bid to foster national development.

Chief Mwene Mutondo is alleged to have directed his subjects to support Mr Kabimba in 2016 general elections so that if the party won he could be crowned senior chief. The chief said such a statement should be retracted because it did not represent the Nkoyas but sabotaged the chiefdoms because of political propaganda.
