DEC investigators on secret South trip to probe Shoprite Checkers dividend saga

Three investigators from the Drug Enforcement Commission (DEC) are this week expected to fly to South Africa to probe why Shoprite Holdings is refusing to pay dividends to Zambian minority shareholders.

This is at the expense of Shoprite checkers and it is not known why the DEC has asked Shoprite Checkers to fund the trip.

This is a case in which Shoprite Holdings Zambia and its South Africa subsidiary have been refusing to release over K5.2 billion as dividends to Zambia minority shareholders.

But the chain store has paid off its South African shareholders, while holding on to the money for Zambians.

On Monday this week, the Lusaka Stock Exchange general Manager Beatrice Nkanza directed Shoprite Holding to pay Zambia minority shareholders their dues within two weeks or face reprimands.

The dividends have accrued from September 2011 to April this year.

The Lusaka High Court has refused to grant the Drug Enforcement Commission (DEC) stay of execution following a May 18 judgment against the DEC continued seizure of bank accounts for a Lusaka law firm Lewis Nathan Advocates.

The DEC had seized bank accounts for Lusaka law firm Lewis and Nathan for alleged money laundering the Lusaka High Court asked DEC to unfreeze the accounts because the law firm, which was representing Zambian minority shares was not involved in any fraud.

The Court which has however allowed the DEC leave to appeal against the judgment could not grant the stay as the appeal might not succeed.

In the judgment, Justice Christine Phiri has observed that the DEC seizure came at the time when the Shoprite Group freezing order granted by the Kitwe High Court but later thrown out, was still subsisting.

Sources at the DEC have said the commissions has authorized three officers including one from the Zambia Police to travel to South Africa to probe why the Shoprite Group is refusing to pay Zambian shareholders.

The named Drug Enforcement Commission (DEC) officers led by Mathias Kamanga are set to travel to South Africa this week on a trip that Shoprite Holdings has financed.

The trio’s trip is highly disguised in a DEC request for funding through normal channels ostensibly to undertake investigations in South Africa.

The three DEC officers leave for Johannesburg in a quest led by Deputy Commissioner Lottie Mpundu seeking to save the DEC’s face in the eyes of appointing authorities as well as prevent the law firm Lewis Nathan Advocates from pursuing damages against Shoprite in the Kitwe High
Court.

“It was today (May 28) when Elizabeth Kanjela discussed the list of officers to travel to South Africa together with Mr. Mpundu.” We thought this matter is over; It is far from being over because there is an invisible hand that is controlling the whole matter, the source said, adding “I personally told Mr. Mpundu to be careful but he seems to have a vested interest in the matter.”

The Lusaka High Court reprimanded the DEC over the move by Shoprite Checkers Zambia not to release dividends for local minority shares.

The Lusaka High Court also asked Shoprite Checkers to show cause for their continued seizure of the now unblocked accounts belonging to former Shoprite Checkers transfer secretary, Lewis Nathan Advocates.

The High Court also ruled that all sales that occur on the Lusaka stock Exchange are published on a daily basis to the knowledge of all market players including Shoprite Checkers which had however told a shareholders’ that the shares were lost in Lusaka.

The High Court also ruled that the DEC investigators overstepped the realm of the relevant confines and scope of the investigations relevant and logical to the fact in issue.

On December 5, 2011 and January 30, 2012, the DEC had seized bank accounts for Lewis and Nathan Advocates.

But the Court ordered and observed the opening of the account whose closure was effected while a Shoprite action in the Kitwe High Court to freeze the account through an injunction was still subsisting.

The Kitwe Court also disagreed with Shoprite claim that the seized accounts contained their money, before throwing the injunction and freezing order earlier granted.

The judgment came three days after the DEC had issued another seizure notice on Lewis and Nathan at Barclays and Stanbic banks.

Government to prove Zambia is yellow fever free

Government says it will ensure that laboratory tests are done to prove that Zambia is not a risk area for yellow fever in the region.

Minister of health Joseph Kasonde says government does not want to push the reclassification of Zambia as a low risk area for yellow fever without scientific evidence.

Dr.Kasonde has told journalists at a media briefing that he also held meetings with South Africa’s minister of health and World Health Organization regional director on how best to handle Zambia’s Yellow fever ranking.

And Dr. Kasonde has also told journalists that government plans to establish six hospitals in Lusaka to cater for the growing population.

The district hospitals would be in Chilenje, Chawama, Kanyama, Chelstone, Chipata and Matero.

The minister has noted that the Chawama and Chilenje clinics that were classified as first level hospitals by the previous government do not meet standards of a hospital but has added that the current government will work towards upgrading such facilities.

Dr. Kasonde has also told journalists that the ministry of health is in the process of engaging a consultant to do feasibility studies on the modernisation of the University Teaching Hospital (UTH).

The minister has also indicated that plans are underway to expand the cancer hospital so that it can begin to offer in-patient and training services.

He adds that OPEC Fund for International Development (OFID) has agreed to give a grant for the Phase two of the cancer hospital construction works.

Dr. Kasonde notes that the PF government will continue to upgrade health facilities in the country for improved health services.

Ronald Mukosha Quits As Kalulushi Modern Stars Coach

Ronald Mukosha has quit as coach of Faz Division One North side Kalulushi Modern Stars citing interference from some members of the club executive.

Mukosha confirmed his resignation in an interview on Friday evening.

“I have quit Kalulushi Modern Stars,” he said.

Mukosha said he wants to avoid being controlled by members of the executive.

“I have stopped because some one in the executive wanted me to be following his unfootballing instructions,” the ex-international, Power Dynamos and Lusaka Dynamos defender added.

Meanwhile sources at Independence Stadium in Kalulushi have suggested that Mukosha was this week suspended indefinitely by the club for alleged disobedience .

” He (Mukosha) was suspended earlier this week after he refused to follow some instructions,” the source said.

Mukosha who joined the Kalulushi side last season has left the team laying sixth on 17 points after last weekend’s week 12 games.

Ex-Power and Kitwe United coach Lawrence “Big Jim” Mweemba who was attached to the club this season is tipped to take over from Mukosha.

 

Ghana Take Storming Lead of Group D

Ghana have taken early but commanding lead of Group D in the 2014 World Cup qualifiers.

The Black Stars beat Lesotho 7-0 in Kumasi ton Friday evening to take a 24 hour lead of Group D ahead of Zambia and Sudans game in Khartoum on Saturday.

However, the game was suspended after 52 minutes of play as Ghana were leading 4-0 due to a power outage at the stadium.

It took engineers over 40 minutes to restore power at the venue before Ghana added three more goals to their tally on the day.

AC Milan midfielder Sulley Munthari put Ghana ahead in the 15th minute, striker Dominic Adiyah of Arsenal Kyiv in Ukraine scored a brace in the 24th and 50th minutes.

Marseille striker Jordan Ayew scored his first of two on the day in-between Adiyahs brace in the 45th minute.

Portugese-based midfielder Christain Atsu of Rio Ave made it 5-0 on 85 minutes while Ayew completed his brace three minutes later.

Defender Jeremaih Akaminko of Manisaspor in Turkey sealed the win for Ghana in the 90th minute.

Meanwhile Zambia, who will host Ghana on June 9 in Ndola, face Sudan on Saturday in
Khartoum hoing to keep pace of the Black Stars ahead if next Saturdays clash at Levy Mwanawasa Stadium.

Zambia landed in Khartoum under the cover of darkness on Thursday ahead of Saturday’s battle against Sudan.

The African champions landed in Sudan at 20:30 hours after a 30 minute delay on a Kenya airways flight from Nairobi.

Zambia are lodged at Hotel Corinthians just 20 minutes walk from Al Hilal hotel where Saturdays 2014 world Cup Group D match will be played.

Meanwhile, midfielder Joseph Sitali says he will not despair in his bid to earn a place in the national team after being dropped from the Chipolopolo Squad that is in Sudan for Saturday’s 2014 World Cup qualifier.

Sitali said he will continue working hard to secure a place in the in the national team.

The Power Dynamos skipper said he respects coach Herve Renard’s decision to drop him.

“As a player I think I did my best and I will continue working hard,” he said.

” The coach talked to me about his decision and encouraged me to work hard,” Sitali added

Sitali was one of two players Renard dropped for the Sudan clash together with defender Aaron Katebe of Zimbabwean club Hwange.

Nevers Mumba sworn in as MMD President, apologises to Zambians for MMD’s past mistakes

Zambia’s former ruling party, the Movement for Multi-party Democracy(MMD) today swore in their newly elected party president Dr. Nevers Mumba. Dr. Mumba was elected MMD president with a landslide victory over his closest rival Felix Mutati during the party’s 3rd extra ordinary convention held in all the country’s ten provinces.

Speaking during the inauguration ceremony, Dr. Mumba apologized to the people of Zambia for the mistakes the MMD made during its time in power.

He said that as the new party president, he takes full responsibility for the wrongs that the MMD made during its tenure. He has further stated that he is committed to ensure that the corruption tag that hangs on the party is removed.

Dr Mumba disclosed that he has set up an anti-corruption sub-committee to sniff and stop any acts of corruption in the party. He has further proposed to the national executive committee that any member who aspires for national leadership declares his assets prior to being considered for any office.

And Former Republican President Rupiah Banda is confident that newly elected MMD president Nevers Mumba will steer the party back to power. Mr. Banda has since urged Dr. Mumba to stand firm and not be intimidated.

Speaking this morning during the inauguration ceremony of Dr. Mumba at Mulungushi International Conference Centre, Mr. Banda said that the MMD will remain a strong party.

He said that he was confident that the party will rise again and retain the people’s confidence in the 2016 elections. Mr Banda expressed confidence that Zambia shall be saved under the excellent leadership of Dr Mumba.

The former president has called on the MMD members not to be cowards but ensure that unity prevails in the party and beyond. He further called on Dr. Mumba to preach peace in the party and ensure that democracy is upheld for the benefit of the party.

United Party for National Development (UPND) leader Hakainde Hichilema has said that the country could have realized about K4 trillion if the government had reintroduced the windfall tax for mining companies.

Mr. Hichilema said that the money collected from the mines in form of tax could have been channeled into infrastructure development in the country.

The opposition leader observes that investing in infrastructure would have helped in reducing the cost of doing business in the country.

Mr. Hichilema adds that this would have further encouraged the private sector to participate in the economic activities that would among other things contribute to job creation.

He has told QFM news that the PF government does not seem to have a clear policy on investment citing the take over of Zamtel as one example that makes the government’s position on foreign investment questionable.

Mr. Hichilema notes that government should be mindful in the way it handles cases involving companies suspected to have been corruptly sold to ensure that investor confidence is not eroded.

Govt is not negotiating with Gunvor & Trafigura till they hand over oaths of their proceedings-Yaluma

Government has said that it should be given an opportunity to conclude talks with the two foreign firms Gunvor and Trafigura regarding a two-year contract for the supply of oil and refined fuel.

Energy minister Christopher Yaluma has said that government is not negotiating with the two companies on anything, not until they hand over oaths of their proceedings.

Mr. Yaluma said that once they are done, the matter will be presented to his office and a comment will be made.

On Monday, energy permanent secretary George Zulu disclosed that government was talking to Geneva-based Gunvor over the supply of 1.4 million tones of oil and Trafigura on the supply of diesel and petrol.

It is however alleged that the two oil companies government is planning to engage to supply of oil have been involved in corruption and unsound environmental practices, a matter that has made stakeholders to caution government against engaging the two companies.

Speaking to QFM News, Mr. Yaluma said that what is being done should not be pre-empted because government has not given a final report.

Former Republican President, Rupiah Banda has come to the defence of the heavily criticized country’s judiciary.
Mr. Banda, whose close associates have been a target of the enhanced fight against corruption by the new regime, feels the attacks on the judiciary are uncalled-for and unnecessary.

With particular reference to President, Michael Sata, Mr. Banda contends the country’s judiciary remains one of the most viable organs of governance currently.

He adds it is the same judiciary that the incumbent President Sata sought intervention from when aggrieved on matters of national interest.

Mr. Banda has since asked politicians to respect other organs of governance and stop being double standards in fulfilling their personal egos.

The Former Head of State said this at Kenneth Kaunda International Airport on arrival from Lesotho, where he led an election observation mission team under the Electoral Institute for Sustainable Democracy in Africa (EISA).

Meanwhile, Police have warned the United Party for National Development -UPND- not to go ahead with their planned demonstrations over the suspended judges.

Lusaka Province Police Commissioner, Charity Katanga said that  if the UPND decide to continue with the demonstration, it will be at their own peril.

Mrs Katanga said that Police will not issue the UPND with a permit because the case is before the courts of law.

Mrs Katanga was speaking in an interview with ZNBC.

The UPND has threatened to hold demonstration on June 6 over the suspension of the three judges that were suspended by President Michael Sata.

President Sata suspended three High Court judges Nigel Mutuna, Charles Kajimanga , and Supreme court judge Philip Musonda and consequently appointed a tribunal to probe them against misconduct.

Chungu maintains probe call, Bank of Zambia has not disputed any misconduct facts

Former Access Financial Services Director Aaron Chungu has maintained that government needs to probe the financial dealings at the company which is now in liquidation.

Mr Chungu says none of the facts about the misconduct and potential criminality that he earlier stated have been disputed by the Bank of Zambia .

He told a media briefing on Thursday that some of the irregularities include huge and unjustified salary and administrative payments in excess of 12.7 billion kwacha paid from Access to the liquidator among others.

But the bank of Zambia yesterday urged Mr Chungu and his colleagues to go and inspect the liquidation schedule the central bank lodged at the High court.

The Bank of Zambia also advised Mr Chungu to report any matter he considers criminal to law enforcement agencies for action.

DHL employees in Kitwe have down tools

DHL employees in Kitwe have downed tools, demanding a pay increase and improved conditions of service.The DHL employees are demanding for 100 per cent salary increment. Their salaries range from K2 million to K2.5 million but their counterparts in Lusaka earn K3 million and above.

The workers have paralysed company operations and have voewed never to return to work because of slave wages.

The Kitwe workers said DHL workers received lower wages compared to their counterparts in Lusaka and other regions who do the same work.

Some employees interviewed said the strike was started after their DHL failed to implement a new pay structure two weeks ago.

The workers said they had not received a pay raise in the last four years although the courrier firm had been recording huge profits.

DHL has refused to issues a response because it is carrying out investigations into the workers’ strike.

The Union of European Football Associations (UEFA) has suspended Turkey Super Lig side Bursaspor from European competitions for one year for failing to pay the fee for Chipolopolo striker Collins Mbesuma when he moved from England side Portsmouth in 2007.

UEFA banned Bursaspor on Wednesday alongside two other Turkey Super Lig sides, Besiktas and Gaziantepspor who were also slapped with one-year bans for other financial misdemeanours.

According to Anatolia news agency of Turkey, Bursaspor chairman Ibrahim Yazici reacted harshly to the ban.

“We were not supposed to face a ban. This is a murder of law,” Yazici said.

Yazici said 2010 Turkey Super Lig champions Bursaspor would, like Besiktas, appeal to the Court of Arbitration for Sport (CAS).

“I cannot understand how a club without debt like Bursaspor can be hit with a ban. We believe that UEFA will return from its mistake,” Yazici said.

Bursaspor where scheduled to play in the upcoming Europa Cup League qualifiers after finishing fifth in the Turkey Super Lig.

Mbesuma joined Portsmouth from Kaizer Chiefs in 2005 after scoring a South Africa record of 27 goals in 33 matches then moved to Bursaspor in 2007 after a one season loan at Portugal side CS Maritimo where he scored seven goals in 23 matches.

The former Roan United prolific striker, who currently plays for Durban-based Lamontville Golden Arrows, left Bursaspor in 2007 on mutual consent to return to South Africa after playing only six matches for the Bursa-based outfit.

Turkey glamour side Besiktas, which was also scheduled to play Europa League qualifiers after finishing fourth in the league, was punished for failing to pay its players regularly according to the team’s lawyer.

Gaziantepspor on the other hand did not win UEFA qualification this year meaning their ban would be imposed in the first season when the team qualifies for a European cup competition.

Eskisehirspor would replace Besiktas in the Europa Cup qualifiers, but UEFA was yet to announce whether another Turkish team would replace Bursaspor in the same competition.
