Zambians made a clear choice, give PF a chance to exercise their mandate-Nawakwi

FDD president Edith Nawakwi says Zambians made a clear choice in the last election and there is need for the PF to be given a chance to exercise their authority.

And Nawakwi says she took a break from politics in order to reflect on the divisions which the party was facing.

Meanwhile, Nawakwi has reconciled with her vice-president Chifumu Banda and others who were calling from her removal from the helm of the party.

At a media briefing at the FDD secretariat today, Nawakwi said Zambians made a clear choice in the 2016 elections.

“When you say the nation has missed me, I have also missed the nation and I thought when we went to the polls in 2016, the nation actually put out a clear choice and we need to allow our friends to exercise their authority and see where they are taking us,” Nawakwi said.

And Nawakwi said she took time off politics to reflect on the wrangles which her party was facing.

“Even in the Bible it is clear that there must be a time for reconciliation and time for meditation. I have been on the political scene since 1990. Every year, 360 days commenting on issues, I thought while the party was more or less trying to find it’s balance, I should not be the face of the party and cement the idea that the party was just about one individual. I think where we are now, it is a very clear indication that intra party democracy in FDD is what propels the party.

“Yes, there are national issues but parliament is there, they have been commenting, you have been writing. If you talk about fire tenders, I will remind you that all that needed to be said was said two years ago. The only challenge is what I said in 2001 that us Zambians have a very short attention span, you leave one person to pursue an idea and that person becomes a bad person,” she said.

“I think it is a very healthy arrangement that I withdrew, it is not because I couldn’t say anything but I wanted the party to have other faces.”

“To date, an impression was created that I want to amend the constitution, but I want to tell you that to amend the party constitution you need two thirds majority…it is unfortunate that the world feels that they have lost my voice but you my comrade, when I was being told that I want to change the constitution, you didn’t stand up for me and say ‘we need her voice in this scenario’, I thought the press also agreed with that position that maybe it was time for my reflection to happen but there are many issues which we need to get together and it is this getting together that is very important because when we issue statements, you will know that these are FDD statements, not Mr [Antonio] Mwanza’s statements, not the chairman’s statements, not Edith Nawakwi’s statements. We want to have a spirit of togetherness so that when statements are coming, they are interrogated, they are well researched.”

Meanwhile, Nawkawi reunited with Banda whom she sidelined in the 2016 elections, opting for a political novice, Reverend Clement Mwanza from the Reformed Church of Zambia, as her running mate.

On March 22, Banda launched a ‘Save FDD’ campaign; demanding for a party convention to elect a new leader saying it was unconstitutional for Nawakwi to cling to the party presidency.

“The FDD party last held a convention in 2005. According to its Constitution, FDD is supposed to hold a convention every five years. As such the next convention could have taken place in 2010, but this did not happen.”

“The explanation which was furnished to the general membership for the failure was the National Policy Committee had failed to raise funds for the event. Later on 2015 presented another lawful occasion for holding a convention.”

“Again, the convention was not held and the opportunity was equally missed. The party secretariat explained off this failure by arguing that since the nation was going to the general elections the following year, change of leadership could have disadvantaged the party in the polls. For this same reason, it was accordingly announced that the convention would instead be held in February 2017 after the said general elections,” said Banda despite being expelled from the party a month earlier.

But Nawakwi announced that they had reconciled and she had welcomed him back to the FDD as her vice-president,

“We believe that genuine dialogue is a path to unity of purpose. It is for this reason that after serious reflection through an open and honest process of dialogue, we have today decided to offer a general amnesty to all those party officials whom we had expelled. Together, we are strong, divided, we diminish…at this point in time, allow me to welcome back honorable Chifumu Banda as the vice-president for the Forum for Democracy and Development,” said Nawakwi.

And Banda said the leadership had risen above their differences for the love of the party.

“In every family, there will be feuds. There is bound to be conflict and sometimes injury caused to one another. What is important in the life of every political party and in our lives as human beings is the ability to rise above these problems.”

“Today the FDD is demonstrating how good the leadership of FDD is because this is the first in the country where a political party that was besieged with misunderstandings for one reason or another, the leadership has risen above those. I wish to tell you madam president that the discussions we had were candid, we were open to one another, all because all of us have love for this party called FDD,” said Banda

Today’s Message:Call Out Seeds of Greatness

4

Today’s Scripture

“…God…calls those things which do not exist as though they did.”
(Romans 4:17, NKJV)

Call Out Seeds of Greatness

Very often, we see potential in other people that they can’t see in themselves. When you speak vision into them, when you tell them what they can become, you can help set the direction for their life. Your words have the power to push people into their divine destiny. I believe that the reason some people are not living at their full potential is because no one has ever spoken faith into them. No one has taken the time to say, “Hey, you’re great at this. You’ve got a gift here. You’re going to do something amazing.”

I believe that one of our assignments in life is to call out the seeds of greatness in other people. Look around at who God has placed in your life. They’re not there by accident. Take time to study them. See what they’re good at. What are their gifts? What do they excel at? Don’t just think about it, speak vision into them. Tell them what they can become. Let your encouragement ignite greatness on the inside. Help them rise up in confidence so they can be all God has called them to be!

A Prayer for Today

“Father, thank You for the people You’ve placed in my life. I choose to be faithful, to speak life and call forth greatness in them. Thank You for bringing me to new levels as I help others rise higher in Jesus’ name. Amen.”

Zanaco on Saturday rallied to beat Napsa Stars 2-1 to end their Barclays Cup jinx in a dramatic final that went to extra –time at National Heroes Stadium in Lusaka.

Perennial Barclays Cup campaigners Zanaco came into the game having never failed to qualify for the competition but had never won it prior to this year.

But Zanaco earned it the hard way against 2012 winners Napsa Stars who had held them twice to 0-0 and 1-1 draws earlier in league meetings this season.

Both sides had opportunities in the first half that finished scoreless to take a stranglehold on the match.

Defender George Chilufya and striker Felix Nyaende came close for Zanaco in the 12th and 22nd minutes respectively but their efforts went wide.

But it was Napsa who fired the first real warning shot in the 25th minute when Youremember Banda saw his effort from a tight angle parried on the near post by Zanaco goalkeeper Toaster Nsabata.

And it was again Banda who broke the deadlock in the 46th minute when he nodded-in Chitoshi Mukuma’s cross.

Napsa then went on to dominate proceedings as Zanaco’s memories of final failures rushed back to haunt them.

However, Napsa defender Derrick Mwnasa handed Zanaco a lifeline when he brought down Charles Zulu in the area in the 84th minute and referee Jan Sikazwe pointed to the spot.

Nyaende took the brave step up and sent Napsa goalkeeper Bola Masosa the wrong way and pushed the match into extra- time.

Extra-time then fuelled Zanaco’s belief and they were all over Napsa.

Zanaco got the magic goal in the 108th minute through veteran midfielder Isaac Chansa who headed –in Zulu’s cross to see the Bankers breathe a massive sigh of relief after breaking their Barclays Cup drought.

Mumamba Numba’s side now turns its focus back on defending the league title with an eye on a 2017 double.

Zanaco currently lead the table on 60 points, four points ahead of 2ndplaced Green Buffaloes with six matches left to play.

London Court orders Zambia to pay LapGreen of Libya $380Million compensation for repossessing ZAMTEL

The London High Court has ordered that Zambia compensates Libya $380million for nationalizing Zamtel.

This is a matter in which the Libyan Investment Authority (LIA), the investment arm of the Libyan government dragged the Zambian government to court for abruptly reversing the sale of Zamtel without compensation.

The Libyan company owned a 75 percent share of Zamtel while the Zambian government owned 25 percent.
According to the Financial Times of London, the Libyan Investment Authority reportedly pursued similar action against Chad, Rwanda and Niger.

In the report, the LIA claims that the four countries took advantage of “Libya’s political turmoil to nationalise assets belonging to the country’s $66 billion sovereign funds” following the eight-month long conflict that brought a brutal end to Muammar Gaddafi’s 40-year rule.
At the beginning of 2011, LAP Green Networks, a subsidiary of LIA, held stakes in nine telecoms operators across sub-Saharan Africa, including Chad’s Sotel Tchad, Oricel in Côte d’Ivoire and Gemtel Telecom in South Sudan.

On 2 May, Niger’s parliament voted to nationalise telecoms asset Sonitel, pulling back from a privatisation agreement to sell a 51% stake to LAP Green for $62.16m.

In January, then President Michael Sata seized a 75% stake in telecoms company Zamtel that LAP Green had purchased for $257m during a privatisation exercise in 2010.

LAP Green challenged the government’s actions in court and was asking for $480m in compensation.

The Financial Times quoted Hassan Bouhadi, chairman of the LIA as saying the legal action related to technology assets in the four countries named.

“The LIA is determined to regain what was squandered from the Libyan people,” Bouhadi Mr. said recently.

On Friday, Finance Minister Felix Mutati told Parliament in a ministerial statement that the court had ruled that Zambia should compensate LAP Green for seizing Zamtel from the Libyan sovereign fund in 2012.

Mr. Mutati did not give details over which court made the order nor payment timeline.

The company was sold in 2010 by the Rupiah Banda administration for US$394 million on grounds that it had failed to recapitalise the business.

In 2012, the PF administration under President Michael Sata forcefully took over Zamtel’s operation from LapGreen Network claiming that the 75% shares the company owned were corruptly sold by the previous administration.

Lap Green Networks denied any wrongdoing in the manner it acquired the company and said it would challenge the country’s authorities in the courts of law.

LapGreen Network then took the matter to the Lusaka High Court, where the government failed to defend its decision to repossess the company.

Instead, officials decided to enter a consent judgement to compensate LapGreen Network its initial investment in Zamtel amounting to US$252 million plus interest, calculated at 8%, and other charges.

The total amount payable to LapGreen Network came to US$382 million.

According to the settlement agreement, the government was supposed to make an initial payment of US$114 million in November 2016, followed by biannual payments of US$35 million in February 2017 and August 2017 respectively.

The opposition, the Forum for Democracy and Development (FDD) issued a statement through its spokesperson Antonio Mwanza demanding the government inform Zambians why it has failed to pay LapGreen Network and how it plans to settle the issue.

Almost three years ago, a Zambian High Court allowed Lap Green Networks to take the matter to the London Court as it was considered neutral ground after the Libyan company expressed concern that it would not be given a fair hearing in Zambia.

The court’s decision came after all foreigner directors of Zamtel were deported from Zambia.

In 2012, President Sata constituted a commission of inquiry to investigate how Zamtel was sold to the Libyans.

The Zambian government has failed to make public a report by the Commission of inquiry into the sale of Zamtel.

However, a leaked copy of the Commission Report however shows irregularities in the manner in which Zamtel was sold, alleging that Lap Green and RP Capitals, which was appointed as financial advisor, bribed senior Zambian government officials.

The Zambian government has repeatedly said it can only compensate Lap Green Networks for its investment in Zamtel, but that it will never surrender back the company to the Libyans.

In 2014, the Zambian government agreed to repay the US$103 million loan that Lap Green Networks obtained from China’s ZTE in 2011 for the expansion of Zamtel network.

The loan was obtained by Lap Green Networks in 2011 from ZTE in order to implement Zambia’s Global System for Mobile Communication (GSM) phase IV and Universal Mobile Telecommunication System (UMTS) projects.

The repayment of the $103 million loan was considered to be the first step in compensating Lap Green over its investment in Zamtel.

Secretary to the Cabinet Rowland Msiska instructed the Secretary to the Treasury to secure a loan from China’s Import and Export Bank (EXIM) to pay back the loan to ZTE on behalf of Lap Green.

Dr. Msiska however, refused to discuss why the Zambian government decided to pay back the loan, and why it has decided to do so while the case was still in court.

“Government does not discuss its plans and programs in the media,” Msiska had said.

HH condemns police raid at UPND Secretariat

Hakainde Hichilema

UPND leader Hakainde Hichilema has condemned police raid at the party’s office late Friday afternoon.

Mr Hichilema who is away in South Africa to attend the award presentation ceremony where he was being conferred with the African Freedom Award said he is deeply shocked by the raid.

Heavily armed police on Friday raided the UPND offices and conducted a search that yielded nothing.

Mr Hichilema has since described the raid as an example of needless intimidation.

“We have learnt with a deep shock and regret that heavily armed police searched our Secretariat while we were being conferred with an African Freedom Award in South Africa. They had a search warrant signed by a magistrate to look for weapons. Their search was futile. It was another example of needless intimidation and a complete waste of public resources,” Mr Hichilema said.

He added, “This was nothing but another perfect example of the abuse of public institutions by our colleagues in the PF. We do not need any guns to fight injustices because our weapon is God who gives us life, our guns and weapons lie in the strength to be honest, do just to others and stand up for our freedoms and democracy.”

“Ours is to work round the clock and ensure our country has good education system, a quality healthcare delivery system, good governance and rule of law, and basically if you like, our minds are preoccupied with working for our country’s good.

And heavily armed police who raided the UPND secretariat on Friday searching for concealed weapons and stolen goods found nothing after many hours of searching.

UPND spokesperson Charles Kakoma confirmed that police did not find anything after conducting their search in the presence of party lawyers.

The operation began around 16:30 and went on for about three hours.

According to a search warrant signed by a Lusaka Magistrate, police had information that offensive weapons have been concealed in the UPND secretariat.

Mr Kakoma said police did not find anything after conducting their search in the presence of party lawyers.

“The raid is over, they have gone back to their base. When they came they didn’t say what they were looking for, they only found our guards who refused them entry to search until our lawyers were informed and two of them came to witness the search. They searched in all the rooms and all over the premises looking for offensive weapons but they drew a blank,” Mr Kakoma said.

“After that they left but we hear that apart from raiding our offices, they also intend to raid houses of some senior members of the party and they will do that up to Tuesday we understand,” he said.

The case was now pushed to November 7, 2017 for possible plea while there bond has been extended.

Ms Miti posted on her Facebook page, “Went to court to find our file has not arrived from wherever. So our bond has been extended to 7 November.”

Mr Tembo said, “Earlier this morning, we went to appear before the Lusaka Magistrates Court to answer to charges that emanated from our protest at Parliament on 29th September 2017 against the $42 million fire tender scandal. Unfortunately the case could not proceed as the docket has not yet been taken to court by the prosecution. We shall next appear in court on Tuesday, 7th November 2017. Evidently, we were all in good spirits because we know that we are on the right side of history.”

Ms. Miti and others were arrested on September 29 after they allegedly defied police directives not to go ahead with the protests over the purchase of the fire trucks during the presentation of the national budget.

Henry Kapoko appeals to the High Court against his conviction and the jail sentence

FORMER Ministry of Health acting chief human resource development officer Henry Kapoko has appealed to the High Court against his conviction and the jail sentence slapped on him by the Lusaka Magistrate’s Court after it found him guilty of corruption.

Lusaka High Court deputy registrar Aridah Chulu, sitting as magistrate, found Kapoko guilty in all the six charges he was facing.

She sentenced Kapoko to two-year jail terms in each of the six counts which will run concurrently, meaning that he will be in incarceration for two years.

Meanwhile, Transparency International Zambia (TIZ) has welcomed the conviction of former Ministry of Health chief human resources development officer Henry Kapoko.

In a statement today, TIZ Executive Director Wesley Chibamba is however not amused with the sentence of two years that has been slapped on Mr. Kapoko.

Mr. Chibamba said for public servant theft of that magnitude (about K 20 million), 2 years is a slap on the wrist.

Mr. Chibamba said when public servants pilfer public resources, they are supposed to be punished in a manner that serves as a warning and a deterrent to other would be offenders.

“TIZ has always lamented on the way the justice system treats the corrupt and thieving public servants with kid’s gloves. When it comes to sentencing, they are given small jail terms and they walk out to continue living like kings on stolen public resources. Mr. Kapoko’s sentence was supposed to be so stiff as to send a warning to other civil servants who might be tempted to dip their fingers in public coffers”

“The public resources he stole were meant for the Ministry of Health, the institution directly in charge of saving human lives. Transparency International Zambia would like to see that this case doesn’t just end in a conviction and the accompanying cheap sentence, we would like to see the stolen public resources recovered and given back to government” Chibamba said

Mr. Chibamba has urged the Anticorruption Commission (ACC) to move in and apply for seizure of all of Mr. Kapoko’s assets pending forfeiture to the state.

He said TIZ has always emphasized on recovery of stolen resources so they can be rechanneled towards the intended purposes and so that criminals do not continue enjoying stolen wealth.

“Some of these criminals are becoming wrong role models in society since they are idolized and revered in their communities. Society should be abhorrent of stealing public resources and all those that do so should be demonized to the letter. Asset recovery should be a priority for the government. Transparency International Zambia is also very concerned at the longevity this case has taken”

“The case has dragged on for 9 years when it should have been disposed of in a shorter period. The evidence with which the conviction has been arrived at is the same evidence that has always been there. During the 9 year period, the culprits could have taken care to hide their stolen assets in offshore accounts or change ownership and basically put this stolen wealth where it is out arms reach for government. TIZ has always advocated for quick disposal of corruption related cases because dragging them has got a bearing on the case itself and on asset recovery if the culprit is convicted” Chibamba said

And the TIZ Executive Director has also urged Government through the judiciary and law enforcement agencies to punish corrupt people appropriately such that they can no longer enjoy stolen wealth.

“This calls for stiffer sentences and seizure of assets. We believe this can go a long way to deter others from committing the same crimes to the Zambian people” Mr. Chibamba said

Green Party President Peter Sinkamba says his party has taken a different approach to deal with the controversial acquisition of the 42 Fire Engine Trucks by the Zambian Government at an amount of 42 million US Dollars by engaging the European Partners against Corruption and the European Contact-Point Network against Corruption (EPAC/EACN).

In an interview today, Sinkamba said stakeholder organizations condemning the Green Party’s step of seeking assistance from EPAC/EACN to establish whether or not active or passive corruption took place in the transaction involving an EU domiciled supplier in Spain and a third party Lusaka based procurement firm Grand View International Limited are not at the same level with the Greens.

In a related development, the Green Party is investigating the issue of the Guptas family’s presence in Zambia who are an international cartel of corruption.

Green Party President Peter Sinkamba told Pan African Radio News today that the Guptas should not be entertained in Zambia because they are involved in State Capture Corruption.

“We are investigating the issue of the Guptas family’s presence in Zambia who are an international cartel of corruption” Sinkamba said

It has been reported in some section of the media that the Gupta family which has robbed South Africa of its resources has relocated to Zambia and is grabbing all government contracts under the rebranded name of ‘Yousufs’.
