Speculations on presidential power hand over vindicates stakeholders calling for the new constitution-Chipenzi

The Foundation for Democratic Process FODEP says speculations on whether president Michael Sata properly hand over power before living for Israel vindicates stakeholders calling for the new constitution as such speculations will never arise with a running mate clause included in the new draft constitution.

Speaking in an interview FODEP Executive Director McDonald Chipenzi said the drama that has engulfed the appointment of acting president should compel Justice Minister Wynter Kabimba to quickly release the draft constitution and curtail such unnecessary speculations in the near feature.

Mr. Chipenzi said the new constitution is a clear cut answer to these confusion and legal speculations taking center stage in the country’s political arena.

“This is why we always say that a new constitution could be the answer to these legal jargon, legal confusion or legal speculations on how things should run in the country and we hope that honorable Kabimba who is holding on to the document should see the agency of releasing the draft constitution to the zambian people and push for its enactment,” said Mr. Chipenzi.

He noted that Mr. Kabimba has been caught up in a situation that he should have prevented by way of pushing for the enactment of the new constitution which would spell out ones functions without any one having to explain it to the public.

Mr. Chipenzi also said the country should move from having such debates to discussing developmental issues something he says will only happen once the country has a new constitution in place.

“He thought he was being clever by playing politics with the document like that but now he is caught up with legal jargon by the end of day. So had we done a good job with the document we wouldn’t be talking about this; tomorrow he might be the president of this country does he want us to be solving confusions everyday? The answer should be no! He should be concentrating on developmental issues rather than debating on how did you get the power because the law should be very clear that when the president is incapacitated this is what happens,” Mr. Chipenzi said.

He noted that the new constitution should address these loopholes in the law hence the need for Mr. Kabimba to release the draft document so that the country can no longer be subjected to speculations on important issues such as the recent debate on whether the president properly handed over the instruments of power before leaving for Israel.

The Itezhi tezhi magistrates court yesterday discharged United Party for National Development (UPND) cadre Jacob Mubambo in a case in which he was charged with conduct likely to breach peace.

Mr. Jacob Mubambo, who is aspiring UPND candidate for Itezhi Tezhi constituency seat in 2016 elections was alleged to have conducted himself in a manner that was likely to breach peace during the agricultural Block show in Mbila area in Itezhi tezhi.

The prosecution applied for the substitution of the indictment in line with section 213 of Criminal laws of Zambia.
The court admitted the prosecution’s application arguing that the prosecution had a right to substitute an indictment at any stage of the case before judgment was delivered.

However, the lawyer representing Mubambo from K.A.S Chunga argued that the substituted charge was defective and that his client was not obliged to make a plea to a defective charge.

At this stage Magistrates Munalula Mubita considered and compared the old and new charges and later ruled that the new indictment had no particulars of the offence, therefore it was defective in nature.

“When a charge is prepared the particulars of the offence should be clearly written so that the charge was not defective but in this case the Lawyer is right that the charge is defective in nature and therefore the accused cannot take plea on such a charge” Magistrates Mubita said.

Magistrates Munalula Mubita then discharged Jacob Mubambo and ordered him to stand down from accused box.

Meanwhile, prior to the commencement of the court, UPND cadres clashed with some Patriotic Front cadres who were found at the court premises.

Some cadres came all the way from Lusaka and Choma and almost exchanged punches at court premises but quick action by Police saved the situation from deteriorating.

Government worried on low percentage of HIV/AIDS status’ awareness in Zambia

Government says it is saddened that only about 15 ;percent of people in the country know their HIV status.

Choma District Commissioner Bernadette Hamweemba says it shocking to note that most citizens in the country do not know their HIV/AIDS status.

Ms. Hamweemba says citizens should voluntarily go for free counselling and testing (VCT) at counselling centres to know their status’.

She said it is important that VCT also is integrated into existing maternal and child health services saying this is critical in the reduction of mother to child transmission of HIV or indeed the virtual elimination of mother to child transmission.

The District Commissioner said this during the commemoration of National VCT day which was held at Mbabala School yesterday.

The event was running under the theme: “reaching everyone everywhere with annual HIV counselling testing services”.

She said AIDS is one of leading causes of death in the region and that every effort should be made to reduce the spread of HIV.

“We also need to acknowledge that this will not be possible unless we step up very significantly our prevention efforts and also sustain, and in line with our commitment to universal access, expand our treatment programmes, we will not be able to do this unless people know their HIV Status, “she said.

Ms. Hamweemba noted that going for VCT has many benefits of which one is knowing one’s status allows the individual to take action to protect themselves against infection if negative or take action to access services if found positive.

She said that indicators have shown that HIV couples counselling and testing decreases the transmission of HIV by more than 60 percent within discordant couples and reduces sexually transmitted infections and unplanned pregnancies in all couples.

She further explained that mother to child transmission can be reduced or eliminated if people know their status so that they can access
services not just for a healthy HIV negative baby not for women themselves.

Several programmes have been embarked on in the HIV prevention, treatment, support and care in the country which has since
a drop in the prevalence rate of HIV from 16% in 2001 to the current 14.3 percent.

ZAMBIAN YOUTHS MUST REJECT OLD POLITICIANS IN 2016

As MMD Die Hard Youths, we wish to make a clarion call for young people to distant themselves from old and greedy politicians ahead of 2016 general elections.

We are aware that some old politicians from the days of our independence struggle want to regroup with the viewing to challenging for the presidency in 2016.

We wish to warn these old politicians to stay away from politics as today’s modern day politics are dynamic and scientific and not for the aged.

The old cannot simply compete in the political space. They are devoid of fresh ideas and cannot effectively engage in today’s highly challenging global environment.

We appeal to youths of Zambia to make it a point that His Excellency Michael Sata should be the last Head of State with ties to Zambia’s independence in 1964 to ever rule this country.

As the 2016 general elections approaches, Zambian must prepare to retire all those old politicians from the colonial era.

By clearing the political stage, the much needed space for young politicians will be created and Zambia will be on the road to recovery.

Zambia cannot simply continue being led by people from the Independence era politics. Majority of countries that have made social and economic progress have embraced youthful leadership and Zambia should follow suit.

In the MMD, we have able and proven leadership in Dr Nevers Sekwila Mumba. Dr Mumba has abundant energy and wisdom to transform Zambia into a nation that God destined it to be. It will take young Zambians to marshal adequate support across party lines to get Dr Mumba to State House in 2016 and begin the process of changing Zambia.

We are therefore appealing to all young Zambians not to look back to the old and retired politicians to take Zambia forward. Let us begin to focus on eyes on youthful leadership to take Zambia to its promised land. Let’s focus our eyes on Dr Nevers Sekwila Mumba.

Guy Scott not aware of demands for an apology from the Technical Committee

VICE-PRESIDENT Guy Scott says he has not yet received a letter from former members of the Technical Committee on Drafting the Constitution demanding an apology from him and the Minister of Justice Wynter Kabimba for allegedly saying they attempted to transfer government vehicles into their names.

In a telephone interview with the Daily Mail on Monday, Dr Scott said he would thus not comment on the matter.

“I cannot comment on that issue. I will have to consult my lawyer when I receive the letter. I have only seen a copy in the Daily Nation,” Dr Scott said

Mr Kabimba was not immediately available to comment on the issue.

It was reported that in a letter dated June 18, 2014, Mwansa, Phiri and Partners acting on behalf of Ernest Mwansa, Patrick Mvunga, Rodger Chongwe, Mwangala Zaloumis,
Reuben Lifuka, Chief Luchembe, Father Bantungwa and Suzanne Matale demanded an immediate apology from Dr Scott and Mr Kabimba.

“The retraction and apology must be prominently placed in the same newspaper that printed the libellous articles.

His honour the Vice-President and the honourable minister are given 14 working days in which to make the retraction and public apology of their statements,” the letter signed by an A.M Shilimi reads in part.

The former technical committee members stated that the words attributed to them are untrue, malicious and very misleading.

It is alleged that Dr Scott and Mr Kabimba accused the former members of the technical committee of trying to transfer government motor vehicles assigned to the technical committee to their personal names.

THE Archbishop of Canterbury Justin Welby says homosexuals need Jesus Christ and that the church should pray for them.

He told journalists in Kitwe yesterday that ‘gay people need the Gospel of the Lord Jesus Christ just like anyone else. The Church should therefore pray for them’.

Bishop Welby, who is head of the Anglican church, did not give his church’s specific position on homosexuals but said the church is still consulting on the matter.
The Anglican Church has been split on the issue of ordaining gay priests.

He said the church has an obligation to pray for homosexuals and that prayer is important to a Christian.

“We are trying to listen to what God is telling us on this matter as a church,” Bishop Welby said.

He, however, said there is need to treat everyone with respect and dignity.

“Homosexuality is a global issue, we need to treat others with respect and dignity. It is a human rights issue,” the bishop said.

Bishop Welby also said it is sad that evil-minded people use poverty, unemployment and religion to cause conflict in Africa.

And speaking at a church service at Cathedral of St Michael and All Angels Church in Kitwe, Bishop Welby called on the Church to pray hard so that it can have a positive impact on society.

He said reconciliation is a gift from God for Christians to live in harmony.

“Prayer is what renews our hope as Christians. Reconciliation is important; we need to learn how to love one another.

“We must be a church that loves one another, a church that reconciles with one another, we must be peacemakers. The church should be the unifying factor in communities,” he said.

Bishop Welby urged members of the Anglican Church in Zambia to be faithful witnesses of the Gospel of Jesus Christ and to lead by example in their daily lives.

“Going to church does not make you a Christian. Being in church does not make you a Christian, otherwise even benches were going to be Christian. It is knowing and loving Jesus Christ that makes us Christians,” he said.

Bruce Mwape-Mine Police will survive

Head coach Bruce Mwape believes his bottom placed FAZ Super League side Konkola Mine Police will survive relegation.

Mine Police have made a poor start to the 2014 season, collecting just 11 points from 14 matches and have one unplayed match against Nkana.

Mwape said the Chililabombwe outfit would bounce back from their low start during the second half of the campaign.

“We will pick up, it is not too late,” he said.

Mine Police have so far recorded two wins, five draws and seven defeats.

“We need to improve on scoring. We need to start scoring,” Mwape said.

He appealed to club supporters to rally behind Mine Police.

Meanwhile, Mine Police will move out of the bottom three if they beat Nkana in the two teams rescheduled Week 9 match to be played in Kitwe this month.

Dates for Presidential Powers hand over raises more questions -Msoni

All People’s Congress (APC) president Nason Msoni has said that he still doubts Justice Minister Wynter Kabimba was delegated with Presidential powers to act as Republican President.

This is despite Secretary to the Cabinet Roland Msiska confirming that President Michael Sata delegated Presidential power to Mr Kabimba by signing the instrument of delegation of the functions of President on Friday, 20th June, 2014 and Gazette Notice No. 385 of 2014 dated 27th June, 2014.

Mr. Msoni said that confirmation by Dr. Msiska has raised more questions than answers.

Mr. Msoni said this is because dates for the signed instrument of delegation functions of President and the publication of Gazette Notice No.385 of 2014 do not reflect the chronological order.

He questioned who was acting republican president between 20th June, 2014 when the instrument of delegation functions of President was signed and June 27th 2014 the date for the issuance of Gazette Notice No.385 of 2014.

Mr Msoni alleges that the two dates that the Secretary to Cabinet has indicated could have been backdated as cover up.

Guy Scott declines to comment on Israeli media reports about President Sata

Republican Vice President Guy Scott has declined to comment on Israeli media reports that President Michael Sata was admitted to Sheba Medical Center in Israel until Thursday last week when he left hospital.

In an article posted on its website on 30th June headlined: ‘Zambian president had been at Sheba: Is not in critical condition,’ Haaretz quoting Israeli officials also indicated that President Sata may even meet with outgoing Israeli president Shimon Peres later this week.

But when contacted for comment on the Israeli online publication’s claims, Dr. Scott told Qfm News in a telephone interview that the Patriotic Front government does not clarify information published on online media unless such information has been published in the name of the editor and companies.

And asked whether there are any further updates with regards President Sata’s visit to Israel, Dr. Scott said that government will give updates if there any and as things happens.

Dr Scott last week told Parliament that President Sata is in Israel on a private working holiday and it is not known when he will return home.

There has been growing public speculation on the President’s visit to the Jewish State.

Zambia Railways goods train derails in Mazabuka

A Zambia Railways Livingstone bound goods train carrying an undisclosed quantity of copper concentrates derailed on Friday night at Magoye lay-by 30 km south of Mazabuka District.

The Goods train was transporting copper concentrates for a company called Bridge Shipping Zambia destined for export to South Africa.

Zambia Railways Central Region General Manager Mubanga Jawala confirmed the accident but declined to give further details.

A check by a ZANIS crew that rushed to the scene found that five wagons laden with 33 metric tonnes of copper concentrates but slipped off the rail and overturned in Magoye.
A salvage operation was however tasked to remove the copper concentrates from the wagons onto waiting trucks.

Workers were found busy reinforcing the rail line that got damaged in order to normalise train operations and passage.

A technical team dispatched to the scene to ascertain the cause of the derailment is yet to conclude investigations.

However, workers at the scene attributed the derailment to alleged over loading on the five wagons.

In December 2010, a Zambia Railways train derailed in Kapiri Mposhi disrupting the travelling public and goods transportation while another derailed in Ndola after slipping off the rail line when transporting lime.

The Zambia Railways obtained a US$120 million loan two years ago from the Euro bond to upgrade rail infrastructure in the country and improve operations.

A DIPLOMAT from Turkish Embassy in Lusaka died on spot at the weekend after being involved in road traffic accident along the Zimba-Livingstone road in Southern Province.

Three other passengers sustained multiple injuries and are admitted at Zimba Mission Hospital where they are receiving treatment.

Provincial Police Commissioner Mary Chikwanda, who confirmed the incident yesterday, identified the deceased as Masuk Bektas, 53 who was driving from Lusaka to Livingstone.

Ms Chikwanda named the three passengers as Huseyin Erben, 28, Aykut Kaesa, 16, and Nathal Zorlu, 46 who are believed to be also officials from the embassy.

She said Mr Bektas, who was driving a Toyota Altezza registration number ALP 574, careered off the road and overturned due to alleged excessive speeding.

Ms Chikwanda said in an interview that the accident happened on Sunday around 07:20 hours about 15 kilometers from Zimba Township.

“Mr Bektas, a diplomat from Turkish Embassy died on spot due to excessive speeding, the car overturned to the right side of the road and he (Mr Bektas) sustained head injuries,” she said.

Ms Chikwanda said the three passengers who sustained multiple injuries, were immediately rushed to Zimba District Hospital for treatment.

She said that Mr Erben sustained bruises on his right hand while Mr Kaesa, a juvenile, sustained a swollen leg.

Ms Chikwanda said Ms Zorlu suffered a backache and was also admitted to Zimba mission hospital while the body of Mr Bektas was lying at Zimba Mission hospital mortuary.

Corruption in the Zambian judiciary is real- Acting Chief Justice

Acting Chief Justice Lombe Chibesakunda has bemoaned the high levels of corruption obtaining in Zambia’s Judicial system.

Speaking in Lusaka today during the launch of the Judiciary Service Charter Justice Chibesakunda noted that the perception of corruption in the country’s judiciary is real as there are some individuals whom she termed as bad eggs within the judiciary and urged the public to be on lookout such people.

“Distinguished invited guests, ladies and gentlemen, corruption affects everyone and every institution, and therefore the need to rid our society of corruption or indeed any perception of it, cannot be over emphasized.

“In the case of the judiciary, public perception is that there is corruption in our judicial system. Sadly, this is not just a perception, it is reality. There are a few bad eggs within the judiciary,” said the Acting Chief Justice.

She said the local court has been a source of concern as due to litigants appear in person hence making them more prone to abuse.

“The local court has been a source of concern. The local courts are to most litigants the face of judiciary. Litigants in the local courts appear in person so they are more prone to abuse. They are more likely to fall prey to unscrupulous court officials and unfortunately, but true, even to adjudicators seeking bribes to secure a more favorable outcome or judgment,” she explained.

She added that scourge was so rampant such that some Judiciary officials have been impersonating her on the Copperbelt and in the process obtaining free things such as beer.

“Some people in the copperbelt do not know who the acting chief justice is; they don’t know whether I’m a man or woman and some officials are taking advantage of that. They go to bars and get beer in my name saying Iam the acting chief justice can I have a beer.”

The Acting head of the country’s judiciary said it is not a perception that corruption exists in the Judiciary but a reality which all should know.

She further said such acts are not only morally wrong but also undermines the public confidence in the outcome of judicial matters.

Justice Chibesakunda however said there is need to rid of the cancer from the system if Justice is to be offered to Zambians.

And Transparency International Zambia Acting President Kalungu Sampa said the Service Charter which was initiated by his organisation will help reduce the possibility of corruption in the Judiciary.

He said the Judiciary deserves credit on the launch and that TIZ together with the Judiciary will now embark on sensitisation in all provinces.

Government fails to kick start Maize purchases

Government through the Food Reserve Agency will not start buying Maize from small scale farmers today, July 01 2014 as scheduled.

Agriculture Deputy Minister Greyford Monde confirmed in an interview that the Ministry will not commence Maize purchases due the high moisture content in the grain.Mr Monde said most areas still have grain containing moisture higher than the recommended 12.5 percent.

He said Government is however ready to launch Maize purchases as soon as the moisture content subsides adding that all the logistics are in place for the exercise.

But industry sources have revealed that the failure to launch Maize purchases is due to lack of funds.

“As we speak, Government has not released any funds to the FRA to start buying Maize. We are likely to see a repeat of the same shambolic Maize purchases even this year. This Government does not have money and it is coming up with several excuses,” the source said.

The source added, “When they were announcing that they will start July 01, they knew that all the harvested grain in all the areas would have dried. Tell me which areas in Zambia still had rains post May? This is another of their failures.”

But FRA Spokesman Daniel Msoka confirmed that the agency will not commence Maize purchases in areas where the moisture content is high.

Mr Msoka said the agency will however start buying in some areas where the grain had dried up.
He however did not state areas where the agency will start buying the crop together.
The FRA is targeting to purchase 1 million metric tons of Maize in the 2014/2015 crop marketing season.

Secretary to the Cabinet Rollard Msiska has confirmed that President Sata did appointment Justice Minister Wynter Kabimba to act as President before his departure for Israel.

Dr Msiska said President Sata signed the Instrument of Delegation of the Functions of President on Friday, 20 June 2014 and complied with the Law in all respects.

He said the appointment was published through the Gazette Notice No. 385 of 2014 dated 27th June 2014.

In a statement issued Tuesday morning, Dr Msiska hoped that the speculations over this matter will now be allayed.

Meanwhile Chief Government Spokesperson Joseph Katema has challenged people questioning the legitimacy of acting President Wynter Kabimba to read the constitution and see whether there is any illegality in his appointment.

Dr Katema told QFM News in an interview in response to growing speculation that power might not have been handed over properly, that the constitution is clear on the transfer of power for someone to act as President.

Dr Katema said only the republican President can appoint someone qualified to act as President from among members of the Cabinet while he is away.
