Allow Constitutional Court to independently determine President Lungu’s eligibility

ZAMBIA’S Constitutional Court will this Friday determine the eligibility of President Lungu contesting the 2021 elections. This has seen some media houses using every available means and persons to coward the Court into determine this matter based on the biased political views some analyst may hold.

Without adding more to this debate, the Constitutional Court should be left to independently determine this matter the same way the Court did with the eligibility of serving councillors who had wished to contest mayoral elections. In fact, anyone who has carefully read that judgment on councillors will understand the opportune time for making a determination of questions of such a nature the Court is confronted with. No one who has been before this Court like me would doubt the thoroughness with which the Court determines these questions.

The simple fact and truth is that the Constitutional Court will not determine the eligibility case based on whether President Lungu held office of the President once, twice, three times, etc. The question before the Court is, whether the first time President Lungu held office should be counted as President Lungu’s term of office or not, in view of provisions of Article 106.

In short, the parties to this case do not contest the fact that President Lungu was first elected in 2015 and later in 2016. However, the contention is whether the first term that lasted less than 3 years should be counted or not counted as a term for the President.

To me, the question at this point is whether the Court will allow a situation where the Constitution must be read as a whole or it must be read selectively – picking one part to apply to the question of President Lungu and leaving another part as not applying to him. This is wher the meat is. If the Constitution is read as a whole and not selectively, we may see President Lungu being declared eligible but if the Constitution is read selectively to only pick one portion and leaving another, the President may not be eligible.

Fortunately, the only Court with competent capacity to make this determination is the Constitutional Court and not analysts who may be hired or politically biased. There is one team that feels the Court only acquires legitimacy if it rules against Edgar Lungu – that is a wrong approach to matters of law.

In view of the above, Zambians must respect the decision of the Court – whichever way the Judgment must go on December 7, 2018. I say this because, having been a petitioner before this Constitutional Court and arguing the case of councillors effectively, one must always expect the case to go either way.

It is thus unfortunate that preceding the December 7 judgment, a lot of money has gone into some media houses with a view of discrediting the Court ahead of the Judgment. They have questioned the integrity and the experience and capacity of judges – the very judges they went before so they can make a determination. We all have a duty to contribute towards protection of judicial independence and integrity of the Court by doing what we can to avoid bringing the Court into public disrepute and odium.

The Judges of the ConCourt know that they are permitted to make independent decisions. In any adversarial legal system, you don’t expect everyone to agree with the Court judgment but the Court must be brave enough to deliver its ruling without paying so much attention to sponsored persons that have been hired to discredit the Court and cast doubts on it.

Zesco hoping to finish job on Tuesday

Zesco United captain Jacob Banda has warned that the have to work very hard in Tuesday’s date against AS Sonidep at Levy Mwanawasa Stadium in Ndola despite last weeks away win in Niger.

Zesco head into the 2018/2019 CAF Champions League first round, final leg date against Sonidep leading 2-1 from the first leg in Niamey on November 27.

A draw will be enough for Zesco to advance to the pre-group stage on December 15 where five-time champions TP Mazembe awaits.

“It was a sweet victory away from home. Playing in West Africa is not easy but we just have to stay focused and work extra hard at home,” Banda said.

“We are almost getting there now. We had just regrouped for pre-season for two weeks for the first leg and this is the third week and the fitness is still not there but we will catch up.

“They (Sonidep) are a good side and we just shouldn’t underrate them.”

Zesco are hoping to maintain the momentum of their good continental run to qualify to the league phase for a fourth successive season since reaching the 2016 CAF Champions League semifinals.

President Edgar Lungu has returned from Luangwa where he had gone on a working vacation.

The President was welcomed by Presidential Affairs Minister Freedom Sikazwe at State House upon arrival from Luangwa Valley National Park.

Presidential spokesperson Amos Chanda on Friday last week clarified that President Lungu had not secretly flown out to South Africa as alleged by National Democratic Congress Consultant Chishimba Kambwili.

Mr. Chanda explained that the President had gone on a short vacation because he needs to rest.

Minister of Gender Elizabeth Phiri says she advocates that Gender-Based Violence (GBV) in Zambia be non-bailable.

The Minister notes that punishment metered out on perpetrators of GBV is not enough because GBV victims suffers psychological harm for a long period.

Ms. Phiri said once cases of GBV are non-bailable, it will serve as a deterrent to would be offenders.

The Gender Minister said this last evening on “Sunday Interview on ZNBC programme monitored by ZANIS in Lusaka.

“No bail for perpetrators of GBV until the courts utilizes their full course,” Ms. Phiri said.

She said as the country observes the 16 Days of gender activism which started on November 25 and ends on December 10th, her ministry is harmonizing stiffer laws on GBV.

She said women in Zambia experience different forms of violence including spouse battering, sexual abuse, exploitation, rape, defilement and incest.

During the programme, the Minister condemned defilers, rapists and social media abusers stating that they lack respect for women and girls.

“Regrettably, it’s becoming a common occurrence an everyday basis. Barely a day passes in Zambia without the report of a case of violence against women, whether in a rural or an urban setting,” the Minister said.

She also condemned GBV victims especially women who are in habit of withdrawing cases at the police as well as courts.

The Minister further said her ministry is working closely with civil society organisations, Victim Support Unit of the Zambia Police Service, Men’s Networks, and cooperating partners in an effort to end GBV in Zambia.

She however, called on girls, women and men not shun away but report perpetrators of the vice to police and other law enforcement agencies in the country.

On gender equality, Ms. Phiri disclosed that she will soon table a bill to Cabinet to compel political parties to adopt more women in their structures.

She commended President Edgar Lungu for showing political will by appointing women to be at the helm of cardinal public institutions such as the Republican Vice President Mrs Inonge Wina, the Judiciary led by Ireen Mambilima among others who are in positions of governance.

Ms. Phiri, who is PF Kanyama lawmaker said, she will lobby President Lungu to use his creed to consider appointing women in Parliament.

Football Association of Zambia (FAZ) President Andrew Kamanga says rumors circulating on social media alleging that FIFA has cut funding to the country’s football governing body are misleading and false.

Speaking last evening when he featured on ZNBC’s Sunday Interview programme last evening, Kamanga stated that at no time has FIFA cut funding to FAZ adding that the association has been receiving its allocation just like any other football federation on a yearly basis to the tune of One point Two fifty million United States dollars.

Kamanga explained that recently the World football governing body gave out One point Two fifty million dollars, out of which 750 thousand dollars is meant for projects while the 500 hundred thousand dollars balance is for operations.

He disclosed during the live broadcast that in the last three years the football association has not drawn the 750 thousand dollars meant for projects as it was completing the construction of the school of excellence in Luanshya which he said has since been completed.

The FAZ president stated that the three year cycle allocation of two point two million dollars is readily available at FIFA.

In breaking down how the funds are disbursed so far, Kamanga disclosed that in 2016 and 2017 the association received from FIFA the full amount of Five hundred thousand dollars.

“ This year the association received 250 thousand in January and another 250 thousand dollars in July this year translating to Five hundred thousand dollars, “ said Kamanga.

He clarified the false reports by revealing that the football association has continued to receive thousand dollars on a monthly bases from FIFA and that the association is just for the November and December allocation 2018.

Meanwhile in the same light heated interview, Kamanga disclosed that FIFA will next year increase the yearly allocations to football federations from One point Two to One point Five million dollars.

Commenting on the poor performance by the senior national team, Kamanga said his Executive is disappointed with the performance of the national team.

“We disappointed with the senior national team as FAZ, twice in a role they have failed to qualify for the the Africa Cup of nations” he said.

He said the performance of the senior national team so far was not what the association was expecting.

The FAZ president has therefore apologized to government, soccer fans and the national at large for the national team’s failure to book a place at the Africa Cup of nation.

“On behalf of FAZ I wish to take this advantage and apologies to the government soccer fans and nations at large, the performance is not what we expected.

“ Especially that we put in everything we thought was adequate to make the team to qualify.” He said.

Mumbi Phiri sues Kambwili for defamation of character and demands K100 million

PF Deputy Secretary General Mumbi Phiri has sued Roan Member of Parliament Chishimba Kambwili for defamation of character and has demanded K100 million for special damages.

Mrs. Phiri has since asked the Lusaka High Court to order Mr. Kambwili to also offer her general and aggravated damages.

She has further asked the court to grant her an injunction restraining Mr. Kambwili from issuing defamatory statements against her.

In this matter, it is alleged that Mr. Kambwili who is also National Democratic Congress Consultant uttered defamatory words, which have injured her political and professional standing in society.

She says the defamatory statement implied that she is corrupt and that she built her house using bribes from the Chinese and Lebanese companies that get contracts from government.

Mrs. Phiri alleged that in doing so Mr. Kambwili did not bother to find out the truth before issuing the alleged statements.

This is contained in the statement of claim filed in the High Court.

Zambia and DRC agree to resolve the Kasumbalesa Border congestion

The Congolese Government has welcomed the call by Copperbelt Province Minister Japhen Mwakalombe to engage its authorities on the congestion of trucks at Kasumbalesa Border.

DRC Deputy Consulate General, Nkulu Ghyslain admitted that the prevailing situation at Kasumbalesa Border is not conducive and the matter has to be resolved immediately.

He said the situation cannot be allowed to continue considering that the country will be going to the polls this month.

Mr. Ghyslain said he will inform higher authorities in Katanga Province about a meeting further stating that, another meeting will be arranged on both sides of Kasumbalesa to ensure that the issue is resolved amicably.

He added that, with the onset of the rains the situation may result in an outbreak of disease noting that Zambia and the DRC enjoy cordial relations which should not be compromised.

And Copperbelt Province Minister, Japhen Mwakalombe has described the situation as a danger to the people citing the lack of sanitary facilities and proper food storage facilities.

Mr. Mwakalombe stated that it is gratifying that the two governments have agreed that the matter has to be resolved adding that, a long term solution has to be found to avoid the re-occurrence of the situation.

And ZRA Assistant Commissioner-North, Wagner Chilembo said over a thousand trucks were as of yesterday pulled off the road into the parking yard at Kasumbalesa on the Zambian side and in DRC.

He said with the provisional extension in the number of working hours from 18 to 22, the authority will ensure that the situation is normalized soon.

EU to create over 10 million jobs in Africa

The European Commission has proposed a new Africa – Europe Alliance to enhance sustainable investment and jobs between Europe and Africa.

European Union (EU) Ambassador to Zambia, Alessandro Mariani said the Africa – Europe Alliance will deepen economic relations and boost investment and jobs.

Ambassador Mariani said the alliance will create up to 10 million jobs in Africa in the next 5 years alone thereby, boosting investment in Africa and strengthening trade.

Speaking at the media breakfast in Lusaka today, Mr. Mariani echoed European Commission President Jean-Claude Juncker’s sentiments that Africa does not need charity but true and fair partnership with Europe.

In his presentation, Ambassador Mariani said in the partnership, the European Union has funds amounting to 44 billion Euros for loans and grants to be accessed by African countries.

He said for Zambia alone, the EU has been implementing projects in the area of energy, transport, education and agriculture in a bid to help the country and the COMESA region fulfill its role in regional integration.

He cited the construction of 250 stretch of the Great East Road to Mwami border as one of the projects that have been implemented adding that, in 2019, the EU plans to undertake another road project, Mpika to Chinsali road which will cost in access of 170 billion Euros.

The commission’s proposal for an Africa – Europe alliance for sustainable investment and jobs is part of a package which also include a proposal for a more efficient financial architecture outside the European Union which will also support further investment in Africa.

The EU is Africa’s closest neighbour and biggest investor currently providing 31 billion Euros in Official Development Assistance to Africa between 2014 and 2020 in order to boost Africa’s economy.

Ministry of Water Development, Sanitation and Environmental Protection has banned the use of packaging materials such as plastic bags and their resultant waste.

Making the announcement in Lusaka today, Ministry’s Permanent Secretary Ed Chomba said this is in accordance with section 58 of the Environmental Management Act No 12 of 2011.

Dr. Chomba said this is the Extended Producer Regulations which extends the responsibility of the producer of a product or class of products to the post-consumer stage of the product or class of products.

He said the extended Producer Regulations is one of the tools that government will rely on to manage, in an environmentally sound manner, packaging materials such as plastics and their resultant waste.

Dr. Chomba said the extended Producer Regulations will also regulate non-returnable glass and plastic bottle, cartons, beverage cans, waste oils, pesticides or chemical containers, used tyres, electrical and electronic equipment.

He said the regulations require a person or persons whose activities generate waste with potential to pollute the environment to employ measures essential to minimize waste through treatment, reclamation, re-use, recovery or recycling.

Dr. Chomba said the Ministry has since informed stakeholders and the general public that the Zambia Environmental Management Agency (ZEMA) has been engaging stakeholders from all sectors of the economy on the content, framework and the way regulations will operate.

He said among the key stakeholders that have so far been consulted include the Zambia Association of Manufacturers, Zambia Association of Chambers of Commerce and Industry, Oil Marketing Companies, Chain Stores and Shopping Centre Managers.

Dr. Chomba however, said the process of engagement is ongoing and will cover other sectors such as the electrical and electronic equipment merchants and chemical industry.

The Zambia Revenue Authority elite anti-smuggling squads working together with customs officers from Chirundu boarder have intercepted 3 trucks in different locations with alcohol believed to be meant for Christmas celebrations worth about K700, 000 in taxes.

ZRA Corporate Communications Manager Topsy Sikalinda says one of the trucks was intercepted in the southern province on the new bottom road off Siavonga in the bush where it was found offloading into two canter trucks and two small buses.

Mr. Sikalinda said the other two trucks were intercepted in Chirundu district after the border town with forged documents purporting to be carrying various furniture fittings.

He said these are pure cases of forgery, false representation and attempted smuggling contrary to the customs and excise act Chapter 322 of the laws of Zambia.

“We want to make it very clear to the owners of these consignments that this is a straight seizure, and we shall recommend for forfeiture of both the goods & trucks to the state”, He said.

Mr. Sikalinda said the Authority has since decentralized all the elite anti-smuggling teams in all major routes country as a permanent feature going forward. The officers are already on the ground in their permanent operational areas and we hope smuggling will now be brought to the lowest possible levels.

In another development, Mr. Sikalinda said the authority has also intercepted 568 cases of smuggled Kiwi shoe polish worth about K342, 160 in value on the Nakonde route.

He said these were concealed under floor tiles and they are believed to be counterfeit products.

“We have always said smuggling does no pay, these are the results. This year, going forward, the authority has resolved to ensure smugglers are prosecuted instead of being charged penalties”, Mr. Sikalinda added.

He has since appealed to Zambians to report anyone to the nearest ZRA office that is suspected to be smuggling goods into the country.

Close to 1,000 miners to lose jobs at Mopani

About 1, 000 miners at Mopani Copper Mines (MCM) are likely to lose their jobs after the mining giant starter its voluntary retrenchment exercise.

According to latest correspondence from MCM Chief Services Manager KV Chitoshi and to the people close to the Development , the company is asking employees to go on voluntary separation or opt for early retirement.

The mining company says it wants to reduce labour due to high operation costs.

All Mopani Schools are not affected by the job cut exercise.

But National Democratic Congress (NDC) acting Spokesperson Misheck Moyo has condemned Mopani’s plans to downsize its workforce through the voluntary separation scheme.

Mr Moyo said job reduction is an old habit adopted by most business entities at this time of the year when unions are on their way to negotiate new packages for the workers.

“This is just a form of blackmail aimed at hoodwinking Unions who are being duped into agreeing to smaller packages for the workers. We want to implore unions in the extractive industries not to depart from their core business of speaking out for workers.

“I hope Mopani will not fall into such a trap of blackmailing stakeholders. Metal prices on the international market are relatively high. Therefore the reasons advanced by MCM to streamline its labour force are basic and not really convincing,” he said.

Mr Moyo said that there is no need for MCM to reduce its labour force at this critical period when jobs are hard to come by.

“We are disturbed with revelations that Mopani Copper Mines MCM on the Copper belt plans to downsize its labor force. According to correspondence, MCM intends to retrench at least One Thousand miners,” he said.

“This will be undertaken through the voluntary separation scheme at both the MCM Mufulira and Kitwe divisions. The reasons advanced by MCM to streamline its labor force are basic and not really convincing. The metal prices on the international market are relatively stable.”

He said there is no need therefore for MCM to reduce its labor force at this critical period when jobs are hard to come by.

“MCM has been a good investor throughout the years. This is a company that has remained stable even at the height when metal prices had plummeted. We are wondering why Mopani now wants to cut jobs at such a time.”

Mr Moyo said the NDC is urging all the unions in the extractive sector not to entertain calls for such job cuts.

“However, threats by mining conglomerates to reduce labor at this time of the year are not strange. We are fully aware that unions in the mining sector will soon be meeting respective mining houses to negotiate for improved salaries and other working conditions for its members. In such situations, it is common for most business entities to resort to blackmail so as to hoodwink stakeholders.”

He added, We urge Mopani Mines not to fall into such a trap. Mopani Mines is a good corporate citizen.As a party, we urge them to reflect on their plans which will certainly have far reaching consequences if left unchecked. We understand, that most mines have operational challenges. However, these challenges can be resolved ably through consultations with relevant stakeholders.”

“We further urge unions in the mining sector should speak out with one voice and ensure that no jobs are lost. It is rather strange that only one particular union is speaking out against the pending job cuts. We want to implore unions in the extractive industries not to depart from their core business of speaking out for workers.Workers should be effectively be represented by their elected representatives.”

Politics does not have to be a matter of life and death, and neither should it be about spewing hatred and creating enemies at every turn.

To Game Store Mukuba Mall,

We deeply regret to inform you of the situation that took place last week Friday at Game Store, Mukuba Mall, Kitwe, Zambia. With all the hype around the amazing Black Friday sales at game, we were extremely excited and saw a chance to purchase items that at their usual price would not have ever been an option.

With this said, we managed to get additional leave from work in order to be at the front of the queue, as we also live a number of kilometers out of Kitwe. We reached Game at around 19:53hrs (Thursday, 22nd November), ready for the opening at 00:00 hours on Friday 23rd of November.

With our patience and persistence, we managed to be and remained right in the front of the queue when they opened the doors at 00:25 hours. As the doors opened, we all rushed to the fridge section, as we were going for the fridges that were K1 999 and the Game black Friday magazines showed that were only going to be 40 available. Being the first through the doors we thought we would definitely be getting our fridges, but to our surprise, there were people already in the store leaning against the fridges … with only two available.

We asked ourselves, how are there only two left when we were the first here, and how did these two other people manage to get here before us unless they were let through the back of the stores. Feeling heart broken, we continued to search for the rest of the items on our wish list, only to find that they had also been sold out.

When asking around we found that they had been sold prior to the day of the event and mostly to the game employees, who when the store opened at 00:25hrs were already at the check-out counters.

We write this on behalf of everyone who was patiently waiting outside the doors of Game, only to find heart break and disappointment. For the people from Kitwe, the Copperbelt and people who drove from Kalumbila and beyond for these great specials … all to find the same as us. We as Zambian Citizens were disappointed in our people, the corruption and the fact that such a well-known and what we thought as reliable brand would allow such things to happen in its stores and amongst its employees and management staff.

We do hope that you can provide us with an explanation of what happened in your stores on Black Friday.

Optimism expressed for Zambia’s efforts to combat the effects of climate change

Africa GreenCo, an energy solutions company, has expressed optimism at Zambia’s efforts to combat the effects of climate change.

Speaking when she paid a courtesy call on Zambia’s Ambassador to Germany Anthony Mukwita, company co-founder Ana Hadjuka says the efforts by government to diversify the country’s energy sector will reduce Zambia’s vulnerability to the effects of climate change.

She was speaking against the backdrop of the United Nations-organized climate change conference, otherwise known as COP24, taking place in the Polish city of Katowice.

“We have noted President Lungu’s decision to scrap energy subsidies thereby paving the way for private sector investment”, Ms. Hadjuka said.

She said the practical measures taken by the Zambian government motivated her company to seek opportunities to work in the country’s energy sector as the latter undergoes changes in line with the dictates of climate change.

And Ambassador Mukwita said the government of President Lungu took climate change seriously having experienced one of the most devastating power shortages that threated the whole economy between 2015 and 2016.

This was owing to low water levels in the Zambezi River on which the Kariba Dam, the source of hydro power in Zambia is located, a phenomenon expert attributed to climate change.

“This is why Zambia is represented at this conference by the Minister of Lands and Natural Resources Jean Kapata for purposes of adding our voice to the global narrative on climate change”, said ambassador Mukwita.

Africa GreenCo has been in discussions with the Zambian government regarding the possibility of setting up a jointly-owned but independently managed creditworthy intermediary offtaker that should attract private investment in renewable energies in the country.

Since Zambia’s independence 54 years ago, government has borne the financial burdens of shoring up the operations of the electricity supply company, ZESCO. However, the model proposed by Africa GreenCo shifts the burden to the markets.

For its operational capital, Africa GreenCo has applied for funding from sources that include Green Climate Fund, GCF, while a full funding proposal of $100 million dollars was submitted earlier this year by the African Development Bank and the Development Bank of Southern Africa with a letter of support from the ministry of National Planning in its role as Zambia’s National Designated Authority for GCF.

The Africa GreenCo proposal for Zambia was also approved by the European Commission under the External Investment Plan in July this year under the leadership of AFD (the French Development Bank). Other funding is expected from Partnerships for Green Growth and the Global Goals, P4G.

This is according to a statement issued to the Media by First Secretary for Press and Public Relations at the Zambian Embassy in Berlin Kellys Kaunda.
