Central African Cement Company and Sinoma CBMI have signed an agreement to set up a cement factory in Ndola at the total cost of 480 Million United States Dollars.
Central African Cement Company Chairperson, Willie Sweta said the singing of the agreement is a great milestone in fostering the country’s economic agenda.
Mr. Sweta explained that the cement producing plant will be set up in Ndola and will be one of the largest factories in Zambia.
He said once the activities commence 2 million tons of cement will be produced per year.
Mr. Sweta said this after the signing ceremony between his firm and Sinoma CBMI in Lusaka today.
He further disclosed that 1000 jobs will be created during the construction phase.
Meanwhile, ZCCM-IH Chief Executive Officer, Pias Kasolo said construction of the cement plant will commence in April 2019.
Dr. Kasolo explained that his firm will own 35% shares while, Sinoma CBMI will own 65% shares.
He pointed out that the project will see reduction in the price of cement thereby, providing an opportunity for people to build decent houses.
And Sinoma CBMI Company Limited Tang Laigou said the investment is key to the development of the Country.
Mr. Laigou hailed the Zambian government through the Ministry of Finance for the relentless support to his firm.
Sinoma CBMI Company Limited has done successful projects in Spain where the firm Constructed Spain Malaga FyM Cement Plant, Morocco Settat Cement Company in Morocco and CNBM Zambia Industrial Plant among others.
National Democratic Congress Secretary General Mwenya Musenge
National Democratic Congress (NDC) Secretary General Mwenya Musenge has lost his Electoral Petition Appeal in the Constitutional Court. Mr. Musenge had contested the Kitwe High Court’s judgement of November 23, 2016 that upheld the election of Mwila Mutale as Chimwemwe Constituency Independent member of parliament.
He consequently appealed to the Constitutional Court.
Mr. Musenge who had contested the Chimwemwe Parliamentary elections in the 2016 General polls on the Patriotic Front (PF) ticket filed four grounds of appeal.
Among the grounds of appeal were that the court below erred in law by holding that he had failed to prove allegations against the respondent to the high degree of clarity.
He had alleged that Mr. Mutale and his campaign team were masquerading as PF members and violence characterised his campaign exercise.
But the constitutional Court has upheld the Kitwe High Court’s Judgement and dismissed Mr. Musenge’s appeal saying it lacks merit.
Four Constitutional Court Judges presided over the matter.
These are Constitutional Court President Hilda Chibomba and Judges Annie Sitali, Mungeni Mulenga, Enoch Mulembe and Palan Mulonda.
Mopani Mines Plc says only 46 miners who opted for who applied for Voluntarily Separation of Service and met the criteria were released in November 2018.
And the mining giant has refuted reports of large numbers of retrenchments at the Mine.
The mining firm has however failed to provide an exact number of miners who are to lose jobs due to the ongoing exercise.
The opposition NDC yesterday revealed in a statement that over 1,000 miners at Mopani mines are to lose their jobs after the company cited high operational costs.
In a statement, Mopani confirmed that it has continued reviewing the costs throughout the life cycle of its operation to ensure the company can continue to operate efficiently, safely and sustainably in the face of the current high operational costs.
“In October 2018, Mopani launched a Voluntary Separation of Service exercise for employees who wished to take a voluntary separation package or go on early retirement. We have been open about this process, which has been communicated to employees and the Unions “ It said.
“46 of the employees who applied and met the criteria for voluntary separation of service were released in November 2018. Our priority for now remains to optimise operations and ensure we have a mine that provides a return on investment and long-term benefits for all stakeholders.”
“The stories currently circulating, reporting large numbers of retrenchments are inaccurate. We are looking forward to the fruition of our investments in three new shafts (Synclinorium, Mindola Deeps and Henderson Shaft in Mufulira) and a new concentrator.”
It added, “Once all projects are fully commissioned we will improve our production levels, efficiencies and safety, in addition to extending the life of the mines.”
The Constitutional Court cannot be trusted with protecting democracy in the country. Since its establishment, the ConCourt has unashamedly been on the side of the PF government rather than the neutral arbiter courts are meant to be. We all know the debacle the Court provoked when by a majority of three it illegally denounced its own unanimous decision taken a few hours prior declaring its decision to hear the 2016 presidential election petitioners Hakainde Hichilema and Godfrey Bwalya.
The cases of Lusaka Central and Munali constituency election petitions both which it dismissed are just latest examples of jungle justice this Court has become associated with. But here, I do not blame the Court. Rather, I lay the blame squarely on the door steps of Zambian people who tend to be too trusting even of the jungle as source of justice for them. When I saw Ms. Scott’s message on whatsup the week her Lusaka Central petition was up on appeal I realized immediately that like most Zambians, she was trusting that there could be justice at last from the jungle in her petition. In the message, Ms. Scott yearned for justice complaining that it had taken her over two years for the appeal to be processed. On my side, I knew there would be nothing of the kind from that Court.
Not only because it took too long before the appeal but everything else on the ground pointed to a dismissal of the appeal. Lusaka Central member of Parliament Ms. Mwanakatwe who was the appellant at the ConCourt was elevated to Minister of Finance by Edgar Lungu despite that her purported election as member of Parliament was quashed and declared illegal by the High Court. Experience around the world shows quite clearly that ministry of finance is by definition a very important ministry which cannot be entrusted to a person who is subject of proceedings that may result in her losing the parliamentary seat for which she holds the ministerial position. The two PF MPs both for Lusaka Central and Munali constituencies were allowed not only to hold onto their parliamentary seats after the High Court nullified them but also remained part of cabinet as if nothing had happened. All this shows that Edgar Lungu’s PF government either does not care about courts or that it has judges in Edgar Lungu’s pockets. Just like in the 2016 presidential election petition,, Edgar knew what judges would decide in the two cases hence the confidence he exhibited to not only leave them in cabinet but to elevate one of them to the hot portfolio of Finance Minister.
John Sangwa has previously laid bare the inexperience and dismal lack of qualification of ConCourt judges. According to Sangwa virtually none of the judges then qualified to sit on that important court and I agree. If anyone doubted Sangwa at the time of his article or perhaps thought that it was vitiated by jealousy, court’s decisions since have more than vindicated him. Unless you have ill-motives you can’t give ill-qualified inexperienced bunch of individuals responsibilities beyond their capacity. This is precisely what Edgar wanted, to appoint individuals that are incapable of interpreting the law hence who can be abused by him to do his bidding. In other words, he wanted both to e president and simultaneously to be head of the judiciary, the case now. Besides the façade of courts and the principle of separation of powers in the constitution, he in fact calls the shots.
Munyonzwe Himalengwa has bemoaned the fact that the ConCourt could not use the two election petitions in Lusaka Central and Munali to redeem itself. He too is right. However they are in fact redeeming themselves but not by showing fidelity to the law but to the PF, their paymaster. If you see the composition of the ConCourt in recent sittings, it includes those individuals that were considered ‘independent’ or those that had not been part of the dreaded Court during its earlier sittings. Judges Munalula, Mulembe, Ann Sitali and president Chibomba had either not been part of earlier courts or were seen to be relatively independent but certainly not anymore. If you read the letter of the law they announce or are part of including in these two cases, they appear to have shifted positions and too willing to play to the PF gallery rather that to the law.
Ideally, the ConCourt in terms of its hierarchical structure in the judiciary is not supposed to play the role of court of first instance such as the High Court. It is at the Court of first instance where the Court has the opportunity to listen to witnesses in relation to a matter hence the court with the jurisdiction to rule on issues of fact. Issues, for instance, of racial discrimination that were perpetrated against the petitioner in the Lusaka Central petition are prerogative of court of first instance which listened to witnesses to determine. There is a clear distinction between the mandate of a court of first instance and a hierarchically higher court with the latter only vested with issues of law and not of fact. To the extent the ConCourt also apparently reviews findings of fact and given the structure between the High Court and the ConCourt does not provide for the appeal court, the ConCourt is operating illegally.
More importantly, the preset structure of the ConCourt as enshrined in the 2016 constitution is illegal. When the constitution says decisions of the ConCourt on matters which come to it in its capacity as court of first instance are final, it seriously overlooks the right to appeal enshrined in the bill of rights as a universal human right attached to every human being. A basic right guaranteed in the bill of rights cannot be taken away or wantonly denied by a power in a chapter outside the fundamental human rights chapter. Therefore, it is illegal for the constitution to tell petitioners like HH and GBM that they cannot be heard by the ConCourt and that they have no right of appeal to anyone against this decision yet the bill of rights guarantees them this right.
During his confirmation hearing, current Chief Justice of Nigeria (Walter Samuel Nkanu Onnoghen) was asked by Senators whether Nigeria should establish a permanent and separate federal constitutional court? In his response, the CJ discouraged the idea arguing that a separate constitutional court was not Anglo-American tradition. The CJ drew parallels with the experience in the United Kingdom and other common law jurisdictions which did not have separate constitutional courts. He argued that idea of a constitutional court is part of civil law tradition like in French and like jurisdictions. In this sense, South Africa is an exception. Partly because South Africa is Roman-Dutch law but also common law and given the apartheid past, it was necessary for South Africa to break with tradition and enact the Constitutional Court in Section 166 of the post-apartheid constitution and prescribe its jurisdiction in Section 177. Just like the Zimbabwe constitution, the Chief Justice of South Africa heads the ConCourt which unlike Zimbabwe is a full time court. Unlike Zimbabwe, the South African CJ is not member of the Supreme Court of Appeal which is ranked one step lower than the ConCurt.
Finally, the way our constitution was ‘adopted’ prior to enactment by Parliament explains its current woes. Instead of seeking broader consensus from the population given the importance of the constitution, PF took it to State House where it was bastadadized into what it is today. In PF they think that the president is above the constitution hence they asked him or rather he demanded to have sight of it so that he could have a final say and this is why it is such a useless document full of contradictions. If you compare the Zambian constitution with the Zimbabwe 2013 constitution on the constitutional court, the latter has no contradictions characteristic of the former. Section 166 of the Zimbabwe constitution provides that the constitutional court shall consist of the Chief Justice, deputy Chief Justice and five other judges. Just think of this in relation to the Zambian constitution which leaves out the Chief Justice but instead brings people from nowhere and promotes them to this very high court? This is what the CJ of Nigeria was referring to, namely, that the constitutional court in common law jurisdictions is usually ad hoc only convened when there is a case requiring interpretation of the constitution. Even in South Africa which has this court separately from the regular courts it began it with separate jurisdiction specifically to interpret and apply the constitution but has since then expanded it to all other matters for which leave has been granted.
So, from various levels, the ConCourt should be abolished as permanent self-standing court. First, as explained above, its jurisdiction is illegal. Second, its hierarchical structure in the justice institutions is vague and uncertain. Third, it is composed of unqualified and inexperienced bunch of people. Decisions since the operationalisation of this court inevitably demonstrate this conclusion. Because of the illegality of this court, it follows that the occupants of the position of judge cannot plead security of tenure as in ordinary circumstances. Consequently, they can be removed without regard to the law governing security of tenure of judges.

Malawi has become one of the few countries in Africa to pass the Political Parties Act. The law, which came into effect on December 1, 2018, among other crimes bans politicians from using cash payments and other incentives to get support.
However, the ban does not affect campaign materials such as posters, leaflets and clothing, according to AP.
It has been enacted ahead of elections the country will hold in 2019. Malawi is set to hold presidential, parliamentary and council elections on May 21, and it is hoped that the law will level the playing field for politicians.
Anyone found in contravention of the law will be required to pay up to 10m Kwacha ($835,980.60) or spend five years in jail.
The law has been in discussion since 2017. Lawmakers have been debating on whether to enforce a partial or full ban. One faction had proposed banning political handouts during the election period but others wanted a complete ban, whether there are elections or not.
With the exclusion of clothing and non-election period, will this law really level the playing field considering the high level of poverty in the country?
Will it really achieve the intended objectives? Will it really level the playing field for politicians participating in an election?
And what lessons do we draw from this law as Zambia?
As the Green Party, we think that this law will not achieve intended objectives because of high levels of the poverty in the country. Chitenge materials, shirts, and all other various other types of clothing make a huge difference on voters who lack such needs. A party in government will for sure marshal resources from prospective government contractors to ‘dress’ the nation before and during election period and consequently win elections.
As Zambia, when time comes to enact the Political Parties Bill, we need to totally ban clothing before and during elections because of high level of poverty in the nation. Our view is that campaign materials should only be restricted to distribution of posters, leaflets and bill boards.

Movement for Multiparty Democracy MMD National Secretary Raphael Nakacinda on Tuesday made a resounding call to the Members of Parliament to rise above petty partisan politics and unity for a common good of delivering development to the citizens.
Nakacinda who delivered his maiden speech on Tuesday morning, after his nomination as MP by Republican President Edgar Lungu said there are some ugly heads with the potential to divide the country which were emerging that needed to be nipped in the bud and that the onus was on the MPs to redefine the conversations the house was having.
He explained that the conversation the house was having should be void of temporal,narrow partisan interests,ethnicity or patronage but the one which has the interests of the Zambian people in focus.
Nakacinda said the lack of patriotism was hurting the nation economically and that there is a deliberate attempt to demonize the country’s relationships with cooperating partners such as the relationship with China.
He said instead of demonizing the relationship with China the country’s conversation about China should be how to maximize the benefits from that country as the history between the two countries can neither be denied nor erased.
He said China offers a ready market for the country’s raw materials as well as products hence the need to ensure that the country utilises the gifts, talents and skills that it has to go on the negotiating table with and come out with a win win situation.
Nakacinda further expressed gratitude that the UPND has made strides in addressing the alleged tribal weaknesses by appointing former Finance Minister Situmbeko Musokotwane as their Whip but could not help but aim a jab by advising the opposition party not to wait for people to protest for them to do what is right.
‘Mr. Speaker, without hesitation I am very impressed, extremely impressed that a learned Senior Counsel, Hon. Jack Mwiimbu is seated shoulder to shoulder with my former Finance Minister, Honourable Situmbeko Musokotwane; one as leader of opposition in the house, another as Whip.
Mr. Speaker the only wish I had is that this should have been a natural phenomenon, not one that is induced because people have cried foul. It should have been a natural phenomenon because of, ‘One Zambia One Nation.’”
Nakacinda concluded his speech by saying that the sanctity of the people’s assembly should be safeguarded as it is an establishment for their own good.
“Mr. speaker, all I am saying is that I have come to participate in reintroducing the kind of discourse, of frank talk, the discourse of forthrightness, a discourse of mature debate, robust engagement, honestly challenging one another to make sure that at the end of the day, all of us serve with a live conscience that what really matters is Zambia and nothing else.
“Mr. Speaker, the sanctity of the people’s assembly must be safeguarded. It is an establishment of the people for their common good. It should not be a platform for narrow, sectional and partisan interests, as doing so would be an embezzlement, misappropriation, misapplication, abuse and a grand betrayal of the people’s aspirations.”
A 33-year-old man of Kambolozo Compound in Luangwa district has been killed by an elephant.
The man identified as Richard Kapufi was killed last Sunday around 20 hours along the Luangwa D145 road near Chendeyende Village.
Luangwa District Commissioner (DC), Ngoni Moyo who confirmed the death of Richard to ZANIS described the incident as sad.
And four officers from the department of National Parks and Wildlife shot dead an elephant which was trying to attack and kill them.
The officers were on a search for the elephant which killed Richard Kapufi when the slain elephant became angry and started running towards them.
Meanwhile, the department has issued a directive to have the elephant which has killed Richard shot dead to prevent it from killing more people.
According to scientists who have studied the behavior of animals, an elephant that kills a human being becomes more violent and attacks any person it comes across.
Ministry of Local Government Director of Finance, Margret Chanda says government hopes to roll out the Output Based Budgeting (OBB) system to all ministries, provinces and spending agencies by 2020.
Ms. Chanda said the system is aimed at improving the performance orientation of the budget with a focus on outputs and results.
She explained that the OBB system provides a more explicit and clear link between the mandate of an institution, its functions and its budgetary resource allocation.
Ms. Chanda said the introduction OBB is timely as there is a shift of expenditure responsibilities from central government to local authorities.
Ms Chanda said this when she paid a courtesy on North-Western Province Assistant Secretary Beatrice Muyambango in Solwezi today.
Meanwhile, Ms. Muyambango said the sensitization of the new budgeting system to the local authorities in the province is a welcome move.
She said the incentive will help in the decentralization of the system which encourages community participation in decision making.

Zesco in partnership with the World Bank has embarked on a subsidy programme called Electricity Supply Access Point – ESAP.
Spokesperson Henry Kapata says this is the fourth subsidy programme that the two institutions have partnered on to enhance access to electricity to low income groups.
He said the Electricity Supply Access Point is a countrywide programme that targets to connect twenty-two thousand residential and one thousand commercial premises respectively.
Mr. Kapata said the subsidy programme is only applicable to low income residential and commercial premises on standard rate.
He said under the programme, residential applicants in identified low income groups will only be required to pay 250 Kwacha to be connected, instead of the normal 769 Kwacha.
Mr. Kapata said ZESCO is determined to increase electricity connectivity in the country as it moves towards it vision of being the electricity hub in the region by 2025.
Milenge District AIDS Coordination Advisor (DACA) Fanny Gondwe has called for increased funding for youth and women empowerment programs in rural areas.
Ms. Gondwe has observed that this is because some women engage in risky behaviour such as prostitution as they are not self-sufficient.
Ms. Gondwe said in an interview that records indicate that as of May, 2018, 411 females in the district were on ART compared to 228 males.
She disclosed that 516 people in an age group of 25-49 are also on Anti Retroviral Treatment ( ART) in the area.
Ms. Gondwe said most of those affected by the pandemic in the district are women and people in their productive age.
“ If an HIV free generation is to be achieved, government and other stake holders should eliminate causes such as poverty, “ she said.
The DACA said she has since engaged traditional, church and civic leaders in her sensitisation programs so that community members know how to protect themselves.
Ms. Gondwe said if the country is to meet the 90/90/90 target , every citizen should have information on HIV/AIDS in order to prevent new infections.

Speaking during the handover of the truck at provincial administration in Mongu today, Acting Western Province Permanent Secretary Bernard Chomba urged the local authority to fully utilize the truck to ensure high levels of cleanliness in the district.
Mr. Chomba stated that it is important to ensure that all the public places and homes are kept clean to avoid outbreak of diseases such as cholera.
And Mongu Mayor Kusiyo Akayombokwa thanked government for supporting the local authority to improve its service delivery systems.
Mr. Akayombokwa said the truck will go a long way in helping the Council maintain roads and cleanliness in the townships.
He implored residents to work with the local authority and ensure high levels of cleanliness in the district.
The vehicle is meant to enforce the Make Zambia, Clean, Green and Health campaign in Mongu district which was re-launched by President Edgar Lungu in April this year.

Over 100 senior citizens from seven wards in Petauke Central Constituency have received free farming inputs.
Petauke Central Member of Parliament Dora Siliya says the senior citizens have been identified by the Ministry of Community Development in the district.
Ms. Siliya says the programme is ongoing and aimed at helping the vulnerable every festive season.
Ms. Siliya told ZNBC News in Petauke District that her constituency office has given out Urea, Seeds and D-Compound fertilizer to help the aged this farming season.
Ms. Siliya who is also Information and Broadcasting Services Minister said it is important for Members of Parliament to help the needy in society.
Meanwhile, Government has distributed over 17,000 metric tonnes of Compound D’ and Urea fertilizer for over 12,000 farmers in Rufunsa district under the Direct Farmer Input Support Programme.
And Rufunsa District Agriculture Coordinator Stanley Njovu, has praised Nyimba Investments Limited for distributing the inputs on time.
Mr. Njovu has since appealed to farmers to contribute 400 Kwacha each to their Cooperatives as the inputs are within their reach.
Speaking in an interview with NAIS after touring Rufunsa district to check on the availability of inputs for farmers, Mr. Njovu said most farmers are a bit skeptical about contributing the 4-hundred kwacha because of past experiences associated with the E-voucher system.
He however assured farmers that government has rectified the problems that were associated with the system.
And a farmer Manners Bwalya has commended the government and Nyimba Investments Limited for distributing the farming inputs on time and has encouraged government to roll out the programme to other areas where the E-Voucher is.

United Nations Office for Disaster Risk Reduction Representative for the Regional Office for Africa Katarina Soltesova says there is need for the Zambian Government to implement a holistic and inclusive approach to achieve disaster risk Reduction.
Ms. Soltesova says about 11 percent of the country’s population is potentially affected while the potential losses to crops is estimated at 16 million United States Dollars.
She further says the country’s hydro power production will be highly affected by climate change and in the future potentially lose about 2-hundred and 10 million United States dollars per year.
Ms. Soltesova said this at a workshop held in Lusaka under the theme “Building disaster resilience to natural Hazard’s in sub – Sahara Africa Regions, countries and communities”.
And officially opening the Zambia Disaster Risk Reduction Country level workshop, Minister in the Office of the Vice President Sylvia Chalikosa said there is need to bridge the integration gap between action on disaster risk and climate risk.
Ms. Chalikosa said government is committed to maximize the use of resources to reduce effects of disasters in the country.

Copperbelt province Minister Japhen Mwakambe has officially re-opened part of the road on Dag Hammersjoid commonly known as the under bridge which was partially closed to pave way for rehabilitation works.
Mr. Mwakalombe said infrastructure development remains part of government’s top agenda as it is key to economic development.
Mr. Mwakalombe who is also Chongwe Member of Parliament expressed delight that the road which was once a nuisance to motorists and other road users has now been permamently worked on, and has since saluted the business community in Ndola for having come to the fore.
He said infrastructure development also remains one of the major pillars in the Seventh National Development Plan(7NDP).
And speaking earlier, Ndola Mayor Amon Chisenga thanked the Copperbelt provincial Administration for helping the local authority to engage the business community where an amount in excess of 10 Million Kwacha was raised to rehabilitate the portion Of the road.
Mr. Chisenga said the under bridge road was for a long time been in a bad state, a situation that gave room to people to abandon the road which leads to the industrial area.
Present at the ceremony was Ndola Central Member of Parliament Emmanuel Mulenga who called on companies in the district and the province as a whole to emulate what their counterparts had done.
Mr. Mulenga commended the contractor China Jiangxi for putting up quality works which he expressed no doubt will stand a taste of time.
Meanwhile, Zambezi Portland Cement which is one of the business houses that have helped to rehabilitate the road through their representative, Mwangala Situmbeko pledged his companies continued Social Responsibility Programes.
