Lubinda claims govt has not taken stance on ICC

Minister of Justice Given Lubinda says Government has NOT taken a position on whether Zambia should leave or stay in the International Criminal Court -ICC.

 

Mr. Lubinda says government has decided to consult citizens on whether to leave the ICC because it wants to uphold the tenets of democracy.

 

He says the cost associated with the ongoing consultation process should not be debatable because it is negligible.

 

Mr. Lubinda says the consultation process on leaving or staying in the ICC which is taking place in 30 districts in the country will cost Government 2-Million Kwacha.

 

Speaking on ZNBC’s Sunday interview last night, Mr Lubinda said, it is not automatic that upon hearing citizens views the country will leave the ICC but like other African countries Zambia is required to submit the report to the African union.

 

The Minister explained that President Edgar Lungu is expected to present a report to the AU in June on what Zambians think about the ICC.

 

And the minister has advised citizens to take interest and submit their views and not to take the matter as political.

 

Mr. Lubinda said the consultation process is expected to end on Friday this week and a National Symposium is scheduled for April11th and 12.

Last week PF Deputy Secretary General said Mumbi Phiri President Edgar Lungu told  the party that he does not want Zambia to pull away from the ICC.

Government has ruled out discontinuing the ongoing consultations on whether Zambia should leave or maintain its membership to the International Criminal Court (ICC).

Justice Minister Given Lubinda says the consultations will go on despite advice from the Civil Society Constitution Agenda to discontinue the process in view of President Edgar Lungu’s position on the matter, and the general view of the people of Zambia that Zambia maintains its ICC membership.

Mr. Lubinda is shocked and saddened that some civil society organizations want to curtail the process of citizens being involved in the governance process of their Country.

He has wondered how the civil society organizations could have known that people want Zambia to remain a member of the ICC without consulting them first.

In an interview, Mr. Lubinda told QTV News that government does not in fact think it would make sense to discontinue the consultations when it’s half way in the process of getting people’s views.

He said he is personally happy that the majority of Zambians want to take part in the governance process and have since seized the opportunity to be heard by making submissions.
Mr Lubinda stated that government has in this case also been vindicated that it has no pre-determined position on whether Zambia should leave or maintain its membership to the ICC.

Meanwhile Mr.Lubinda has said there was no active case involving Zambia at the International Criminal Court(ICC).He said that the ICC confirmed this when his office inquired, just before the commencement of consultations on whether Zambia should remain a member of the court.

Mr Lubinda said unlike in other countries whether presidents and government made the decision on their own, President Edgar Lungu has chosen to give Zambians the chance to make the decision.
He explained that this was because the ICC matter borders of security and can help keep politicians in check.Mr.Lubinda emphasized that it would not have been prudent for President Lungu to make a decision on his own on matter that concerns all Zambians, as the ICC mainly deals with serious cases against humanity.

Chipata Central Correctional Centre Officer In-Charge Singendaba Mumbuwa has revealed that overcrowding remains a serious problem at correctional facilities in Eastern province.

He told High Court Judge Mwiinde Siavwapa during the official opening of Chipata High Court that most of the facilities were faced with overcrowding.

Mr Mumbuwa said as at 06:00 hours, Chipata Correctional Centre housed 1,030 inmates followed by Lundazi Correctional Centre which had 380 inmates.
He said Petauke had 276 inmates with Katete 258 and Nyimba 227 inmates bringing the total to 2, 171 inmates. The correctional facilities were built for a small population, for instance Chipata was built for 400 inmates.

In February, during the official opening of the Criminal and civil sessions of the High Court in Chipata , High Court Judge Mwila Chitabo said frequent high court sessions had helped to reduce congestion.He had however appealed to parliament to kindly review the sentencing powers of magistrates as most of the cases were referred to the high court for sentencing.

He said the magistrates continue to have limited powers to sentence perpetrators of the cases.The judge said a check on the criminal cause list of the cases before his court shows that Gender Based Violence has continued to increase.
“As they wait for sessions like this one, convicts are detained in our already overcrowded prisons without certainty of their fate which they only get after the High Court sentencing sessions,”Mr Justice Chitabo said.

Lusaka Dynamos to use Heroes Stadium

Lusaka Dynamos will play their 2017 season home games at National Heroes Stadium.

Dynamos CEO Simataa Simataa said the club is delighted to have secured Heroes as their home ground.

The club has played its home games either Sunset Stadium on Edwin Emboela Stadium over the last two seasons.

“Heroes Stadium is a venue of international standards and has very good facilities in terms of dressing rooms and the pitch which both add up to the quality football we want to see,” Simataa said.

Dynamos will be home in their first 2017 FAZ Super Division fixture of the season on April 8 when they host Power Dynamos.

They are now the first club to play all their scheduled league games at the two-year old venue.

Zanaco have played two league matches including one CAF Champions League game there last month against Young Africans.

Meanwhile, Napsa Stars too have announced a venue change for the 2017 campaign.

Napsa will now play their home games at Emboela after using Sunset in the second half of the 2016 season.

“The clubs contract at sunset ended in December and was not renewed,” Napsa media officer Gwen Chipasula said.

Zambia is facing a debt crisis-Fundanga

Former Bank of Zambia Governor Dr Caleb Fundanga has stated that the country’s public debt has now reached crisis levels.

And respected Economist Mr Muna Hantuba has predicted that Zambia may not be in a position to pay back the first Eurobond of US$750 million when it falls due in 2022.

Dr Fundanga noted that Zambia will face significant fiscal pressure between 2022 and 2027 as the Eurobonds matures.

He also noted that the ratio of external debt service to revenue is projected to increase and breach the sustainable threshold of 20 percent between 2022-2027 from 9 percent on average from 2015-2021.

Dr Fundanga was speaking at a public discussion organised by the Economics Association of Zambia under theme, ‘Zambia Debt Situation: Back to HIPC?’

“Based on the debt sustainability analysis conducted jointly by the World Bank and IMF in May 2015, Zambia’s risk of external debt distress was considered to be moderate. However, recent debt sustainability analysis conducted by the IMF and the World Bank indicate that Zambia has a high risk of external debt distress, emanating from the Eurobonds maturing between 2022 and 2027,” Dr Fundanga stated.

He said Zambia is currently a medium performer on the Country Policy and Institutional Assessment Score (CPIA) of 3.3 but warned that further slippages in policies will result in the country being classified as a weak performer under the debt sustainability framework.

Dr Fundanga advised that Zambia should continue implementing growth oriented policies which includes support to the export sector beyond copper.

He also suggested that Zambia should explore cheaper sources of finance and maximising borrowing from concessional and semi-concessional sources while moderating commercial borrowing.

Dr Fundanga said the Zambian government must undertake fiscal consolidation to avoid rapid accumulation of debt as current debt levels are unsustainable.

Meanwhile, Economist Mr Muna Hantuba has predicted that Zambia may not be in a position to pay back the first Eurobond of US$750 million when it falls due in 2022.

Mr Hantuba said Zambia may fall to redeem the debt because the country has not yet gathered sufficient prowess to deal with debt the way debt must be dealt with.

“If you borrow to build a road, to build a bridge or a school and the bill of quantity is a million dollars, there are two ways to do that. Borrow that 1 million dollars and deploy it, conclude it within time, let it become active and let the private sector get engaged, at the end of the day, there is social economic development that goes but if out of the targeted 1 million dollars, you add in 500,000 because there some guys who are queening up for rent seeking, it means that the cost of the project has gone up by 50 percent. In private sector, the moment you move on those parameters, you will fail to pay back the debt,” he said.

He added, “Or you can do the easier one which is receive the million dollars but you digress the project by sending inky 500,000 dollars, the other 500, 000 dollars has to go to these rent seekers because they have got the right access to the bids and tenders. Then you have got a project that is 50 percent done, if it’s a road, it’s the sort you drive, it’s a 1,000 KMs by the time you come back, it would have developed potholes but unfortunately, irrespective of how much of that money was correctly deployed, it must be paid back when it is time to pay back and then you will have to go back to the private sector and tax them.”

Mr Hantuba observed that domestic borrowing has been abused to collect money and enable a certain system.

“I wish I could ask someone how the current system is working. I wish I could ask how government is financing its activities, let alone paying debts. At this moment in time, I know there is a large deficit, I hope someone can tell me how it is being financed,” Mr Hantuba said.

“When I was doing Economics many years ago, we used to call it printing money, I thought there was actually a printing machine at the Central Bank where they were churning out it out but subsequently I learnt that it is just a mechanism of using some idle cash, pump it in and lend it to Government and hope Government will pay one day at its own terms. Is the Central Bank independent? Maybe it is, my suspicion is that if it were, it would not allow a scenario where government borrows as it requires with its own terms and then come again and say we need more and you do the same.

Mr Hantuba suggested that government considers longer dated treasury bills and longer term government bonds of around 20-25 years.

“Don’t be corrupt because corruption is expensive. Don’t misapply resources, stick to the budget. If your 2017 budget says you are not going about constitution, don’t do it. If your 2017 budget does not say about appointing of extra cabinet, don’t do it. That’s what private sector hopes government won’t do. Private sector does not expect Ministry of Justice to announce expenditure of 2 million (whatever the figure is) to ask people where we should be in court or not.

Zambia’s debt that was standing at US$ 9.44 billion as at September 2016, representing US$ 46.9 percent of GDP was made up of US$ 6.7 billion of external debt and US$ 2.74 billion in domestic debt.

The country’s external debt has escalated by 240 percent in the five-year period between 2011 and 2016 from US$ 1.97 billion in 2011 to the current US$ 6.7 billion in 2016.

Patriotic Front (PF) Deputy Spokesperson Father Frank Bwalya has charged that the Zambia Police is unprofessional for bowing down to political orders to deny the United Party for National Development (UPND) a permit to hold a rally in Kanyama.

Father Bwalya said it is unprofessional for Police to make a stance based on a political statement from a cadre.

“As a party we do not control the police, we do not give them instructions. There is no piece of legislation in this country that gives power to PF to instruct Police on what to do. If some one must have said something to that effect and the police follow it, it’s because themselves are being unprofessional,” Father Bwalya said.

Father Bwalya pointed out that police know that they are not supposed to dance to the tune of any cadre or any politician.

He noted that the police should not do anything to please the republican President who is the commander in chief but they have to do the right thing.

He said PF is not involved as they want every citizen to enjoy their right to assembly and freedom of expression.

Father Bwalya said it is unfortunate to try to stop the UPND from having a rally in Kanyama thinking they will say something which can make PF unpopular when they can do the same on a live radio programme which can cater for a wider audience than a localized rally.

He said Police must make their own statements without being influenced by any one.

The UPND leader Hakainde Hichilema planned to hold the rally in Lusaka’s Kanyama area to address the people on national issues and thank their supporters during the last general elections.

But Lusaka Police Commissioner Nelson Phiri claimed they could not allow the rally to go ahead because the situation in Lusaka is not safe for UPND.

The Commissioner sent riot police officers to surround the Lusaka’s Twashuka ground on Sunday before UPND could convene for a rally.

Armed Police in riot gear made the grounds look like a war zone as early as 06:00 hours.
On Saturday March 25, 2017 Patriotic Front-PF Lusaka Province Youth Chairperson Kennedy Kamba instructed the Zambia Police Service not to issue UPND with a permit for the rally.
In heeding to Kaamba’s directives,  Commissioner Phiri denied the opposition a permit citing security reasons.
And UPND Youths have accused the police of being a -PF branch.
National Youth Spokesperson Gilbert Liswaniso said the reasons police gave to deny his party to hold a rally failed to represent reality.
Meanwhile, Eastern Province UPND Chairperson Paul Tholes says the action by police is undemocratic and unfair.

Home Affairs Minister Stephen Kampyongo also yesterday warned the UPND leader Hichilema to conduct himself in  a lawful manner and stop masquerading as President of Zambia or face arrest for treason.

Mr Kampyongo who featured on the Patriotic Front Interactive Forum at Chrisma Hotel on Sunday observed that the actions of Mr Hichilema to continuously refute and recognise the democratic election of President Edgar Lungu and forcing people to share this view is treasonable and the law will soon visit him.

One person is reported to have been murdered yesterday after an attempt by opposition UPND cadres to hold a rally in Lusaka’s Kanyama township was stopped by the Police.

The deceased, Stephen Kalipa, aged 20 years, is believed to have been stabbed with a knife by an unknown person suspected to have been among UPND cadres.

Police Spokesperson Esther Mwaata Katongo who has confirmed the death of Kalipa says the murder happened about 12: 00 hours at Market called Mbasela.

Ms. Katongo has told QTV News in a statement the victim who was rushed to UTH was pronounced dead upon arrival and that the Police has since instituted investigations into the matter.

He says the police has also received another report in which Bertha Zuze aged 21 also of Kanyama compound was assaulted today by suspected UPND cadres using a plank.

And Ms. Katongo has dispelled reports circulating on social media that the Police today brutalized Kanyama residents and arrested 300 people over a UPND rally.

Ms. Katongo says contrary to these reports only two unruly cadres have been apprehended for taking part in an unlawful procession.

Ms. Katongo police officers were deployed in the township and that the situation is now calm.

She notes that this is with the exception of a group of about 100 suspected UPND cadres who wanted to dare the deployed police officers by conducting an unlawful procession in Kanyama.

Ms. Katongo narrates that when the group was approached, the cadres scampered about but that police officers managed to apprehend two who are yet to be charged.

She says one of the arrested has been identified as Innocent Kalimashi.

Ms. Katongo has warned all unruly cadres that police will not watch them harming innocent citizens but see to it that all those behind these crimes are brought to book.

She has since urged Kanyama resident to remain calm as police officers will continue patrolling the area to ensure that their security is provided.

The governing PF has been cautioned that it will turn Zambia into a banana republic if causes the repealing the current Law Association of Zambia (LAZ) Act.

MMD president Nevers Mumba is advising the governing PF to be wary that the only government that will turn against LAZ in Zambia’s history will be the one that chooses to be illegal.

Dr. Mumba states that this means that if the governing party wants to understand each other with LAZ it must stop being what he has termed as illegal and vindictive.

In an interview with QTV News Dr. Mumba notes that as things stand the PF government under the current leadership has allegedly manifested itself as a brutal regime.

Dr. Mumba says this is evidenced by how it seemingly has been fighting anyone that challenges it besides allegedly shutting down any media institution that is critical of it.

He states that as far as he has followed Zambia’s history the PF government is only proving to be the waste regime the Country has ever had.

Dr. Mumba believes that this is partly because it has not been accepted by other opposition political parties as being legitimate after the August 2016 general elections.

He however thinks that once this happens that other political parties accept it as being legitimate, the alleged brutality that is being observed in the Country may decrease.

THE Basic Education Teachers of Zambia (BETUZ) and some concerned parents have roundly condemned the planned distribution of condoms in secondary schools.

BETUZ spokesperson Kakunta Kabika said the planned distribution of condoms in schools by a named civil society had the potential to erode the morals of pupils and was a direct contradiction of the Christian and moral values on abstinence.

Mr Kabika said distribution of condoms in schools amounted to indirectly inciting sexual indulgence among pupils.

He said it was disheartening that Zambia’s cultural values were being diluted by so-called modern trends which were being championed by civil societies.

He said distribution of contraceptives in schools would only arouse indecent curiosity among pupils and lead them into practising sex.

He said instead of distributing condoms and contraceptives to pupils, civil societies should come up with more decent ways of teaching teenagers about sexuality and the dangers of sexually transmitted infections.

He said pupils should be taught that abstinence is the only way to avoid unwanted pregnancies and sexually transmitted infections like HIV-AIDS and others.

Esther Mwangala, a representative of the Parents Committee of Kamwala Secondary School in Lusaka said the distribution of contraceptives in schools served only to encourage immorality among the pupils who were not ready for the psychological and physical consequences of a sexually active life.

Ms Mwangala feels that the exercise will only encourage pupils to indulge in sexual activities which can lead to unplanned pregnancies.

“If condoms are distributed to them, some pupils will feel encouraged to start engaging in sexual activity…and that will distract them from studies and expose them to other unnecessary risks,” she said.

She rejected claims by those arguing for the distribution of condoms and contraceptives in schools that it would curb teenage pregnancies and the spread of sexually transmitted infections.

“Our morals have been shut down by such trends… there is no way distribution of condoms can stop teenage pregnancies. It will just add up to moral decay in secondary schools,” she said.

Minister of National Guidance and Religious Affairs Godfridah Sumaili said she strongly opposed the idea.

She said in repeated recent pronouncements, President Edgar Lungu had been very clear about the importance of the nation upholding its moral values, especially among the youth.

‘If there are any civil society groups trying to advocate for that, they have no blessing from both government and the country as a whole, because distributing condoms in schools is encouraging children to engage in sex before marriage, she said.

THE NDOLA Teaching Hospital management has restricted the use of mobile phones by staff in the wards.

The ban comes into effect immediately follows growing complaints from members of public over staff being distracted by mobile devices while on duty.

Senior medical superintendent Alex Mukupe said the ban was aimed at improving healthcare service delivery.

“We have banned the use of cellphones and those things they put in the ears so that the delivery of services improves,” Dr Mukupe said.

He said this during a cleaning exercise headed by Ndola Central Member of Parliament (MP) Emmanuel Mulenga who led women from different Christian denominations in a cleaning exercise of the institution.

Mr Mulenga said he would assist the institution to acquire name tags for all hospital staff for ease of identification.

“I will assist the hospital get name tags for everyone so that they can be easily identified by patients. I also propose to management to put up a suggestion box that will help review any complaints,” Mr Mulenga said.

The parliamentarian and his wife led about 100 women from different Christian denominations to clean wards at the hospital.

Mr Mulenga said he was humbled that women extended their motherly care to clean the health institution.

Dr Mukupe expressed his gratitude to Mr Mulenga’s gesture.

Mr Mulenga later handed over a youth-friendly centre at Mapalo Clinic, built using money from the Constituency Development Fund. He said the centre would assist the young people develop their careers.

Ndola mayor Amon Chisenga said it was important for the youth have a place of transit in their respective careers.

Zesco down 10-man Nkana to win Charity Shield

Zesco United thumped Nkana 2-0 in the Charity Shield final at Levy Mwanawasa Stadium on Sunday to grab the first silverware of the season.

A second half brace by forward John Ching’andu sent Zesco to the winners podium to lift the shield renamed after Zambia and Mufulira Wanderers great Samuel “Zoom” Ndhlovu.

Ching’andu was on the score-sheet with two speculative but spectacular long range goals in the 46th and 69th minute respectively after a goalless first half.

Nkana were forced to play the last 32 minutes of the match with ten men after captain Donashano Malama saw red from referee Wellington Kaoma for allegedly stamping on Zesco defender Ben Bahn.

The first half was tightly contested with both teams missing nice opportunities.

Jesse Were forced a save from Kelvin Malunga after six minutes before Ronald Kampamba saw his close range header fly over the bar a minute later.

Malunga who had a memorable first further stopped Idriss Mbombo and Davy Daka from scoring.

Walter Bwalya almost grabbed a consolation goal for Nkana but his effort hit the upright with Zesco keeper Jacob Banda completely beaten.

The investor conference on development of the Batoka Gorge Hydro Electric Project recently co-hosted by Zambia and Zimbabwe was over-subscribed in terms of attendance and interest, Finance Minister Felix Mutati has said.

“The conference was organized to market the project to potential financiers and investors following the preliminary feasibility study by Ernst and Young,” he said and added that, “through the event, the two Governments managed to stimulate initial indications of interest from financiers and investors who would like to finance the estimated US$4 billion project.”

During the conference, the Governments of Zambia and Zimbabwe, through the Zambia River Authority Council of Ministers, undertook to facilitate partnerships for the 2400 MW Batoka Hydro Electric Power Project; given the elevated power demand in the two countries and the whole SADC region. Zambia’s power demand is forecast to grow from the assessed 1,911MW in 2015 to a projected 5,508MW by 2035. Over the same period, demand in Zimbabwe may increase from 2,116MW to 5,301MW, respectively.

“The project will not only address the energy needs in the two countries but also contribute to addressing the regional power demand and actualization of the two countries industrialization and regional integration agenda,” stated Mr. Mutati and he also said, “it is in this regard that the urgency and need to timely execute the project were stressed by the two Governments.”

The Batoka Investor Conference generated significant interest from both financiers and investors who expressed strong commitment to participate once the project procurement documents were finalized. The two Governments committed to a transparent bidding process which would ensure a competitive process and value for money. With regard to the environmental impact assessment for the project, an assurance was made to investors and local delegates that the project is designed in a manner that minimizes environmental impact and degradation.

“Due to sparse human habitation around the gorge area, the project will not have any adverse impact on the social and economic welfare of the people on either side of the Zambezi River,” assured Mr. Mutati when asked about the plight of the current inhabitants in the precinct of the gorge.

The Minister also said “as a way forward, a roadmap of various activities related to development and construction of the Batoka dam wall and the power stations on both sides will be developed in consultation with stakeholders on both sides of the river.”

The conference, which was recently held in Livingstone Zambia, was graced by the Zambian Vice President Mrs. Inonge Wina. Over 300 participants from key multilateral development banks; development finance institutions; commercial banks; investors and contractors from across Africa, the Americas, Asia, and Europe attended.

The conference was hosted by the Zambezi River Authority Council of Ministers comprising Ministers responsible for Finance, Energy, and Water in both Zambia and Zimbabwe. The aim of the conference was to market the potential for the Batoka Dam Wall and for the combined output of 2,400 Megawatts from Hydro Power Stations on both sides of the boarder, located 54 Kilometers downstream from the Victoria Falls. The conference also accorded Zambia an opportunity to reassure the international community that the country remains a welcoming and one of the best destinations for investment in Africa.

“The Batoka Hydro Electric Power Project is a flagship undertaking for job creation and infrastructure development which is why, our part as Zambians, there is need for concerted collaboration among all responsible Ministries to ensure success of resource mobilization and timely construction of the dam and the Hydro Power Station,” concluded Mr. Mutati when asked to give an overview of the conference.

Fears of a genocide in Zambia are unrealistic- PF

The ruling PF has dismissed as unrealistic suggestions that Zambia is at the verge of having a genocide.

PF Deputy Spokesperson Frank Bwalya says it is not possible for a Christian nation like Zambia to have genocide as the opposition UPND wants people to fear.

Mr. Bwalya has wondered how possibly a genocide can occur when it has never been a Zambian spirit for people to kill each other based on ethnicity.

In an interview with QTV News Mr. Bwalya notes that history confirms it that even at a time when there was a one party state in Zambia none of the over 70 tribes turned against each other.

Mr. Bwalya says the ruling PF does not therefore think that six years of its being in power Zambians can turn against each other in a mass killing because they do not like President Edgar Lungu.

He says this is particularly that what has been achieved in the last six years the PF has been in power is already being compared to what has been achieved by all previous governments.

Mr. Bwalya says as far as he believes a genocide can never therefore occur even if another political party came to power after the ruling PF.

Meanwhile, the opposition UPND has challenged government to tell the nation whether Zambia is still a democratic and safe Country or not.

UPND presidential special advisor Douglas Siakalima has argued that if the Country is not safe for the opposition to hold public rallies it cannot also be safe for foreign visitors.

Mr. Siakalima says he is thus left to wonder whether government has also told the international community that Zambia is not a safe place to come in.

DOUGLAS SIAKALIMAHe wants to know whether government has made this communication to the international community especially with respect the Country’s capitol city Lusaka.

In an interview with QTV News Mr. Siakalima says his concern is that most tourists use Lusaka as their point of entering when they come to Zambia.

Mr. Siakalima thinks it will be fair for government to warn tourists before hand that Lusaka is not safe and therefore they should not come to Zambia through this entry point.

He believes that the concerns that have been raised by the Police that it is currently not safe for political parties to hold rallies in Lusaka should not be taken lightly.
