Muvi TV offices left vacant after Police forced staff out last night
Uncompromising police officers in riot gear last evening stormed privately run Muvi TV and Komboni Radio and forced the broadcasting stations to switch off their transmitters.
Around 19 Hours, police officers descended on the Muvi TV offices and asked all workers to vacate the premises and ensured that the station was switched off.
Another group of police officers in the group of officials from the Zambia Information and Communications Technology Authority (ZCTA) moved to Kamwala South where Komboni Radio is located and switched off the transmitters and went away with the equipment.
The police officers were ordered by the Independent Broadcasting Authority to go and enforce the suspension of broadcasting licences for Muvi TV, Komboni Radio and Itezhi Tezhi Radio.
Itezhi Tezhi Radio located in the Central Province has also gone off air.
And Muvi TV legal Counsel Milner Kakubo of Milner Katolo and Associates has revealed that the IBA has set September 14th 2016 as the date for a hearing over the matter.
Mr Kakubo told Journalists that Muvi TV will take advantage of the hearing as it explores other avenues in addressing the issue.
He also revealed that ZICTA officers switched off power at Muvi TV and got company files.

You’ve probably noticed by now that I have been going on about chillies for the last few weeks – well it’s not going to stop anytime soon. My chilli obsession has been growing, and it’s not because I have always been an avid fan of chillies, but my interest in them has started to increase; and as I get braver I try more daring spicy dishes. Chillies certainly add a kick to food; they add flavour and texture and are quite tasty; but it’s not just chillies that make this dish so delicious and exciting. Here’s your dish for the week – Baked piri-piri Tilapia.
Preparation time 10 mins | Cooking time 25 mins
Serves: 4
Ingredients
2 red peppers, cut into chunky pieces
1 green pepper, cut into chunky pieces
2 red onions, sliced
2 handfuls of Mushrooms (optional)
Drizzle of extra virgin olive oil
4 large pieces tilapia or cod ( or 1 or 2 whole fishes)
Coriander
green salad, to serve
For the piri-piri sauce
6 red chillies (for milder flavour, use less chillies)
1 tsp chilli flakes
2 garlic cloves
juice and zest of 1 lemon
2 tbsp extra virgin olive oil
1 tbsp smoked paprika
Salt to taste
Method
Heat the oven to 220 ? C/200 ? C fan/gas 7. Add the red & green peppers, mushrooms and onions to an oven tray, drizzle with oil, season well, with salt and roast for 15 mins.
Put the piri-piri ingredients in a food processor or blender with some salt – Purée until fine, and then pour into a bowl.
Add the fish on top of the veggies, and spoon over some of the piri-piri sauce. Spread some coriander leaves around the fish. Add some extra salt if needed, and then bake for a further 10-15 mins.
You can also grill the fish or cook it on the barbecue.
Serving
Serve everything with the left over piri-piri sauce, potatoes and a green salad on the side. You can also serve with fluffy rice. Enjoy!

UPND President Hakainde Hichilema has called for peace, unity and development following the August 2016 elections.
Stressing the importance of remaining peaceful at this sensitive time, Mr. Hichilema has condemned all forms of violence regardless of provocation.
“If you support UPND, please stop the violence. If you support PF, FDD, UNIP, Rainbow or any other party, please stop the violence. As UPND we encourage all victims to report criminal behaviour to the police, and at the same time we call on all members of Zambia Police force to protect each and every citizens, regardless of political affiliation.”
On unity, President Mr Hichilema asked whom Zambians will unite with, if they do not unite among themselves.
“Through the love of God, through intermarriage of our people and through the sacrifice of our founding fathers we are one Zambia, one nation.”
He called on UPND supporters to take centre stage in fostering unity in this country.
“Call your enemy, talk to them and let them know that it is unity we want in Zambia; shake hands, eat with them, laugh with them and above all pray with them. I refuse to be used as a scapegoat in bringing divisions in the country. That is why today I am calling upon all the men, women and youth to stand up and unite in support of our once democratic and peaceful nation”, said Hichilema.
President Mr Hichilema further stressed that peace and unity remain essential for development that will see children in school, food on the table and jobs for youths. He called for hard work and a focus on reducing poverty, saying “Rome was not built in a day, but with determination and focus our economy will flourish again and we must share the rewards among our people as the surest way of securing unity.”
Zambia has lost its appeal against Guinea Bissau over the latter’s alleged use of an ineligible player in the two sides 2017 Africa Cup Group E qualifier three months ago.
FAZ filed a complaint that the player goalkeeper Papa Massa Mbaye is alleged to be of Senegalese extract and has been capped by the nation of his birth.
CAF however, states that the Senegal-born Mbaye qualifies to play for Guinea Bissau because one of grandmothers’ hails from the ex-Portuguese colony and he has been a resident of that country from the age of 18 since 2009 despite a career that took him to Germany and Spain.
CAF added that Mbaye’s passport issued on June 1, just three days before Guinea Bissau beat Zambia 3-2 to seal their debut Africa Cup qualification, is legally binding.
Below is the CAF’s organizing committee of the Africa Cup of Nations full decision:
“1. In relation to the passport copies, ID cards, and other official documentation received for the player, the relevant authorities of the Republic of Guinea Bissau issued those documents. Hence CAF cannot dispute their authenticity.
2. The fact that the passport was issued on 1 June 2016, few days prior to the match played on 4 June 2016 against Zambia, does not change its validity.
3. In relation to the articles of the Regulations Governing the Application of the Statutes, article 6 does not apply in this case, since the player was never registered with the Senegal FA, hence this case is not about a change of association.
4. In relation to article 7 of the application of the Regulations Governing the Application of the Statutes which is about Acquisition of a new nationality and states: “Any player who refers to art. 5 par.1 to assume a new nationality and who has not played international football in accordance with art. 5 par.2 shall be eligible to play for the new representative team only if he fulfils one of the following conditions:
a) He was born on the territory of the relevant association;
b) His biological mother or biological father was born on the territory of the relevant association;
c) His grandmother or grandfather was born on the territory of the relevant association;
d) He has lived continuously for at least five years after reaching the age of 18 on the territory of the relevant association”.
The Committee established that the player does not fulfil criteria 7.a), and 7.b) above, since Guinea Bissau FA itself recognized that the player was born in Dakar, and that his parents were not born in Guinea Bissau.
“In terms of the clause 7.d), it requires that the player must have lived continuously for at least five years after reaching the age of 18 on the territory of the relevant association. The player has been resident in Guinea Bissau since April 2009, but he did play football abroad in Spain and Germany since then.
“In terms of clause 7.c), the Committee believes that Guinea Bissau FA fulfils this requirement since they have established that one of the grandmothers of the player,
Ngone Kane Diouf is from Guinea Bissau.
“Based on the above elements, the Organizing Committee considers that the player has fulfilled the obligation of article 7.c) of the Regulations Governing the Application of the Statutes, and that the player is deemed eligible. Consequently, the result of the match played versus Zambia on 4 June 2016 stands”.
Chikwato Village
Five political parties in Namwala district have met under the auspices of the district political parties’ liaison committee and resolved that they will work with traditional leadership to promote peace and unity in the area.
The parties include the Patriotic Front (PF), the United Party for National Development (UPND), the Rainbow, the Movement for Multiparty Democracy (MMD) and Forum for Democracy and Development (FDD).
The meeting was addressed by the District Electoral Officer Henry Chawah, who is also Namwala district council secretary.
The political parties have also resolved to have radio programmes that promote unity among members of the communities in their respective political parties.
Namwala district has experienced some post-election political violence following the announcement of the presidential election results last week.
In another development, chief Mungaila of the Ila people in Namwala district has distanced himself from the people who have been causing violence in some parts of his chiefdom.
Chief Mungaila’s representative Mbeza Shingwele told ZANIS that the traditional leader was in fact appealing for peace in the district.
Mr. Shingwele said the situation has now normalised and hoped that the state of affairs will remain as it is now.
And Government has intensified humanitarian efforts in Namwala district, Southern Province, where the number of people displaced by post-election political violence has now reached 143.
This follows the repatriation of 86 more people on Sunday by the Disaster Management and Mitigation Unit (DMMU) under the Vice-president’s office to Namwala Secondary School, which is being used as a safe zone.
Meanwhile, ZAMBIA Police in Southern Province says the situation was still unpredictable in different parts of the province.
Last week some suspected United Party for National Development (UPND) cadres rioted in different districts in the province after the announcement of the final Presidential elections results.
Southern Province Police commissioner Godwin Phiri said the police was alert and monitoring some stubborn prone areas.
“Despite the unpredictability of the state of affairs Zambia Police remain alert monitoring stubborn areas where there was intimidation,” Mr Phiri said.
He said the Police however, recorded one case of arson in Namwala where unknown persons set ablaze a house destroying property worth K15, 000 in an inferno.
Meanwhile a Ndola business executive Humphrey Katapa 31, has committed suicide in Kalomo after he threw himself onto the moving truck on the Livingstone Lusaka road on Sunday.
The matter was reported to Kalomo Police Station by Mr Kabaso Mpangi of Ndola that his business partner Mr Katapa committed suicide after throwing himself onto a moving truck which was heading to Livingstone from Lusaka.
“This occurred on Sunday around 16:00 hours near Kalomo River and was pronounced dead upon arrival at Kalomo hospital. The reason was not known and the body was deposited in Kalomo hospital mortuary,” he said.
The police in Choma recorded an assault of occasioning actual bodily harm on Brenda Hamweene caused by her son Shabiya Kasamu while Maamba police station recorded an assault case where Oscar Siachisumo 30, was assaulted by a person only identified as Lawrence, as the other name was not known.

Charles KakomaThe UPND has accused the PF of paddling lies through a statement on social media in which their Vice President is said to be inciting violence in the aftermath of elections.
Party Spokesperson Charles Kakoma said the statement circulating on social media is a propaganda by some disgruntled PF members who are depressed due to the cancelation of their President’s inauguration.
Mr Kakoma said only people without regard for the law think of bloodshed and that the constitution will ensure that the will of the people prevails.
“The statement circulating on social media accusing UPND Vice President Geoffrey Bwalya Mwamba is false, alarming and merely cheap propaganda by the depressed Patriotic Front who are nursing shock wounds from the cancelled inauguration they dreamt would be held tomorrow.
“Surely only lawless people think of bloodshed because the Constitution is there to guide and ensure that the will of the people prevail. “Balesabayila” because their sins and insincerity are getting back to their lawlessness which has been exposed in the manner they want to cause confusion in a country which has enjoyed peace since independence,” he said.
He also said his party believes in the unitary Zambia.
“We believe Zambia is a unitary state and its people have lived in harmony with each other until now when the PF has set an agenda of tribalism which has failed to work and now creating a situation as if they are ethnic divisions in a country known of peace.
“The said statement is merely to get at our Vice President who did not hold a meeting or address any meeting today. We are fully aware of all attempts to assume that peace is at stake, that will not work,” he said.
He further advised the Patriotic Front to stop using tricks in a bid to falsely warrant an arrest or questioning by the police on their leaders on issues that are non existence.
He also called on the police to remain professional and ensure that law prevail adding that his party’s members are being victimized without anyone being arrested.
” It is a well known fact that UPND members have been attacked, homes destroyed including its offices in Kitwe and Lusaka , members including women chased from their business premises and police have not made any arrests.
“UPND victims have instead been arrested and detained while Known PF cadres like Max and his team were released even after committing a serious offence in Petauke. We advise the PF to come to terms with reality that Zambia is a country and not an animal farm.”
Small Scale Farmers Development Agency Director, Boyd Moombwe, has expressed concern about the amount at which the Food Reserve Agency offers to buy maize from farmers.
Mr Moombwe said he is not surprised that small scale farmers as well as commercial ones are selling their harvest to private business partners because private buyers offer a price higher than that of FRA.
He said small scale farmers look at a better price because maize production is expensive and that farming is a business which should be treated like any other business where both parties need to benefit.
Mr Moombwe said the private sector gives cash-on-delivery while the FRA takes long to pay the farmers even when they fully depend on agency although the FRA buys maize on a regular basis.
The SAFADA Director also said the agency is looking to support 15,000 small scale farmers in Central, Eastern, Southern and Luapula provinces of Zambia by providing them with farming inputs for this 2016/2017 farming season and that farming should be considered as a business.
He urged government to put up policies that will protect the small scale farmers and encourage them to participate in the farming business in order to contribute to the country’s economic growth.
Mr Moombwe has appealed to Provincial Agricultural Committees and District Agricultural Committee to educate and train farmers in agriculture and building trust between the farmer and stakeholder.
He has also applauded the Ministry of Agriculture for supporting SAFADA in shielding small scale farmers.
The Young African Leaders Initiative (YALI) says it is utterly disappointed on the decision by the Independent Broadcasting Authority (IBA) to suspend the broadcasting licenses for Muvi Television and Komboni Radio among others and called on the IBA to provide detailed information to the nation on the so-called unprofessional conduct by the affected stations.
YALI Governance Advisor Isaac Mwanza said his organization believes that there is need for media houses, both public and private, to be as professional as possible especially at this time when there is tension in the country but that revoking licences without any warning was to extreme.
“We call for restraint and ensuring that the media double-checks information before it is given to the public. Media should guard against being engrossed in partisan politics.
“However YALI feels that revoking licences by the IBA is too harsh. IBA should have given stern warnings. They should use revocation of licences as a means of last resort after repeated warnings!” He explained.
He said his organization considers the suspension of MUVI TV and Komboni Radio as an infringement on the media adding that private broadcasters have done nothing but give the public information which the public media houses have continued to black of out.
“The IBA must be more aware that the government controlled-media have even more unbalanced and unprofessional in the manner they have continued to cover views from different political players even after elections and the private media have been offering the other side of news stories which have been blacked out on the public media.
“We consider the suspension of MUVI TV and Komboni Radio an infringement on the media freedoms and the thriving of an independent and free media in Zambia. We therefore urge IBA to rescind it’s decision in public interest and allow these media stations to freely operate.
“It is sad that IBA has suspended these licenses at a time when they know very well that affected media houses cannot appeal to the Minister as all ministerial offices are vacant and may remain vacant for weeks or months to come,” he said.
He also reminded the IBA that it’s actions are an affront to the growth of democracy in the country.
“YALI wishes to remind the IBA that it’s actions are affront to the growth of our democratic practices which allows the media to provide information from diverse sides.
“We therefore call on the IBA to engage the said media media houses with a view of correcting the situation so that as a country we are not seen to be sliding towards intolerance and dictatorial tendencies,” he said.
The IBA on Monday suspended the broadcasting licences of the biggest privately owned TV station in the country and its sister station Komboni radio after accusing the stations of unprofessional conduct.
SACCORD executive director Boniface CheembeSACCORD has appealed to political party leaders in the country to calm their supporters in the wake of electoral violence that has rocked some parts of the country.
SACCORD Executive Director Boniface Cheembe said it is regrettable and unfortunate that the country has continued to see distraction of both private and public property and the injuring of innocent people.
Mr Cheembe said political parties should allow relevant institutions to address grievances peacefully.
“The start of the end is with addressing any matters that various stakeholders may have had during the course of an electoral process. It is therefore important that we continue to maintain our calm and patience as a country as we allow our institutions to address peacefully the grievances that stakeholders may have in an electoral process.
“It is regrettable and unfortunate that we continue to see damage to private and public property and human beings being injured in continued post-election violence. It is true that anxieties are still high, but it is paramount that our political leaders continue to appeal for peace to all their supporters across the country,” he said.
He explained that the country belongs to all citizen regardless of the tribe they belong to and that no one should victimize anyone on account of their political affiliation.
“Zambia is for all tribes and citizens and no one person must take it upon themselves to victimize anyone on account of their political affiliation or on how they voted. It is important that anyone who is found chasing others from markets, bus stations, compounds or villages must be stopped as such individuals are miserably dividing our nation.
“Violence must stop and all our political leaders must continue to appeal to their supporters to stop the victimization of others. The new week deserves peace and tranquility as we allow the nation’s institutions to peacefully guide on the grievances,” he said.
The misleading and dangerous statement by Mr Tutwa Ngulube, the PF Legal Advisor that “the inauguration of President-Elect Lungu should go on, with or without the petition” (Lusaka Times date 19th August 2016) must be challenged and corrected. Mr Ngulube is a lawyer and an officer of the Court who must be careful not take advantage of ignorant citizens by deliberately inciting them. At a time such as this wisdom is expected and is a better quality to pray for.
MISLEADING DECLARATION
The statement is misleading because it is not the law; it is dangerous because it has sown a rebellious seed among the public, especially PF cadres, to get them to be ready to rise up in the event of an adverse decision by the Court. The argument that there is no provision in the amended Constitution under which the swearing in of a President may be stopped is patently flawed. There are other provisions and precedents which militate against his generalised conclusions. In addition to the provisions under the Amended Constitution there are also Court Rules that may be used to augment an argument. For instance the English Rules of the Supreme Court (White Book 1999), which are still applicable in Zambia, guide first that petitions are not pleadings (as opposed to, say, a Statement of Claim) and secondly that they are to be dealt with according to the specific subject matter brought before the Court and the applicable Rules of Court. For instance the handling of a petition under liquidation and remedies thereof is different from that for dissolution of a marriage. I thus challenge Mr Ngulube to indicate which law petitioners of elections in Zambia should follow other than the Electoral Law and its Rules and Regulations. I contend that the holding of the presidential election on 11th August 2016 triggered the petition, which stands in the way of the swearing in until it is resolved. While the Constitutional provisions are the anchor of the case, it is the electoral law that must be applied to resolve any electoral disputes. What has happened is to remove the jurisdiction of the Supreme Court as the court of first instance for presidential elections and transfer the jurisdiction to the Constitutional Court; everything else remains the same: the law, the procedures, the Rules and the reliefs and/or remedies. Mr Ngulube has not only misled himself, but has misled his cadres and the general public. His dangerous statement is another Armageddon for it has sown a rebellious seed among the public, especially PF cadres to get them to be ready to rise up in the event of a decision by the Court that does not agree with Mr Ngulube’s campaign message!
There are several reasons why an election petition results in nullification. The Learned author Lord Halsbury, in his Halsbury’s Laws, has explained this issue very well in his treatise on elections. He has listed and explained the grounds for petitioning, which are many and varied. They include bribery, treating, corrupt acts, illegal practices, publishing false statements in respect of other candidates, undue influence on voters by poorly timed but numerous charitable or philanthropic acts, interference with public meetings and, more importantly, breach of the electoral law as to elections. All these are on our statute books today, and are reinforced by the Amended Constitution assented to on 5th January 2016. Of course evidence is always demanded by the Courts!
DANGER IN THE AIR
Halsbury’s conclusions are different from lawyer Ngulube’s, because he says that if one provided credible evidence then such an election should be avoided (another term for nullification, which term is also found in our Electoral Act); to avoid connotes that the candidate cannot be sworn in. If our Electoral Act is put side by side with Halsbury’s we shall find that it is a carbon copy. I call upon Mr Ngulube to observe his own advice that “let us all wait for and respect the Constitutional Court to determine the matter…”. I agree, but that is Doublespeak for he should have not made his flawed statement in the first place. In our polarised atmosphere it is dangerous to mislead the public. I am sure that, as a lawyer, Mr Ngulube remembers the case of a former Chief Justice of Zambia, the Learned Mr Justice James Skinner, who was hounded out of office by party cadres and run away to Malawi. Mr Ngulube’s flawed arguments may tend to incite naïve members of the public. He has just been elected to Parliament; the Kabwe voters respect him and will likely believe whatever he says, even flawed legal arguments.
I advise Mr Ngulube to discard his blind loyalty but behave as a new broom, providing good leadership. The best and urgent advice he should have given was to his Party President, the President-Elect, to assist him to respect the constitutional transition in the Amended Constitution that he voluntarily assented to. Clearly Mr Ngulube has not carried out a proper job of advising his Party President. Even if his President was likely to ignore his advice as he has been doing with the Attorney General’s, Mr Ngulube should have tendered his advice and be vindicated later. It is dangerous to seek public support in order to become popular.
Although the Secretary to the Cabinet has belatedly called off the swearing in ceremony, much harm has been done, whose final chapter we may not predict. Let us pray that our citizens will not take the law in their hands, when the decision of the Constitutional Court does not go their way as happened in the James Skinner incident. Mr Ngulube, the ball is in your court to pre-empt the undesirable reactions.

Nkana are bracing themselves for the draws of the 2016 Barclays Cup to be conducted on Tuesday in Lusaka.
Coach Aggrey Chiyangi’s Nkana have bounced back to the Barclays Cup after missing last year’s edition.
Other teams in Tuesday’s draws are defending champions Green Buffaloes, Zesco United, Zanaco, Power Dynamos,Kabwe Warriors.
The rest are Konkola Blades, Zesco Victoria Falls, Nampundwe and Kabwe Academy.
“What is important for us is to look at the first game we will play in the Barclays Cup because we don’t know what the draws are going to bring out,” Chiyangi.

Roan sits on 38 points, three behind Konkola.

Police officers in riot gear this evening stormed the privately run Muvi TV and forced the station to switch off its transmission 15 minutes into the evening news bulletin.
The News Caster Mutolo Mwamba calmly made a farewell message to the viewers that the station is going off air without going into details.
Earlier today, the Independent Broadcasting Authority (IBA) suspended broadcast licenses for Muvi TV, Komboni and Itezhi Tezhi Radio for what it said was unprofessional conduct before, during and after elections.
And IBA Director General Josephine Mapoma has refuted reports that the suspension of licences is politically motivated.
“The suspension of Muvi TV, Komboni Radio and Itezhi Tezhi is not politically motivated, we don’t know whether these media houses are against PF or not but the decision has been made by board of directors at IBA,” says Mrs Mapoma.
The Independent Broadcasting Authority has with immediate effect suspended broadcasting licences for Muvi TV, Komboni Radio and Itezhi Tezhi Radio.
According to a statement from IBA Chairman Brigadier Justin Mutale, the IBA board met this morning and resolved to withdraw licences for the three independent media houses.
Brigadier General Justin Mutale said the decision follows the unprofessional conduct in which the three stations have conducted themselves in the recent past, which has posed a risk to national peace and security.
He said the suspension has been under Section 29 (1) (ii) of the IBA Amendment Act of 2010 which prescribes that the Board may cancel broadcasting licence if the cancelation is necessary in the interest of peace and security, welfare or good order.
Brigadier General Justin Mutale said the Authority has observed that before, during and after the August 11 2016 elections, Muvi TV, Komboni Radio and Itezhi Tezhi Radio have been conducting themselves in an unprofessional manner contrary to the provisions of the IBA Act.
“It has therefore become necessary to suspend the licences of the three stations in public interest,” Brigadier General Mutale said.
He said the stations have 30 days in which to appeal the decision of the Board as provided for in the IBA Amendment Act of 2010.
Brigadier General Mutale warned that the Authority will not hesitate to take decisive action against any broadcaster found to be unprofessional in their broadcast.
