Prisoners in Zambia will only enjoy their right to vote in the next general election-State

THE State has submitted to the Constitutional Court that prisoners in Zambia will only enjoy their right to vote in the next general election and not the one set for August 11.

Meanwhile, the Electoral Commission of Zambia (ECZ) has told the court that it cannot establish new polling centres in Zambian correctional facilities as the exercise has already closed.

This was in a petition where Prisons Care and Counseling Association (PRISCCA) executive director Geoffrey Malembeka petitioned the Attorney General and the ECZ to allow eligible inmates to vote in this year’s elections.

Dr Malembeka wanted the court to instruct the Ministry of Home Affairs which is in charge of issuing of National Registration Cards (NRCs) to immediately go into the Zambian correctional facilities and issue NRCs to those eligible to vote.

“ECZ should go into prisons through mobile voter registration and register as voters all prisoners eligible so that they too can vote on August 11,” he stated.

Dr Malembeka argued that all pre-trial remandees in prisons throughout the country were innocent until proven guilty, therefore they should enjoy their constitutional right to vote.

However, Attorney General’s chambers assistant senior State advocate, Murah Kapamba, said the prisoners’ right to vote and register could only be enjoyed in the next general election, as the voter registration, closed on February 29, 2016.

Mr Kapamba, however, submitted that the State did not oppose Dr Malembeka’s petition, because Article 46 of the Constitution permitted every eligible citizen to vote.

ECZ director of elections Chomba Chella said during preparations for this year’s elections, the elections body did not establish polling centres at any prison or detention centre.

Mr Chela said the voter registration was conducted from September 13, last year, to February 29, this year, after which, the exercise closed in readiness for the certification of the voter register.

He said that voters’ cards had already been issued to those eligible to vote and the ECZ could not register new voters as the exercise had already ended.

PF cadres arrested for attacking their MMD counterparts

katangaFIVE suspected Patriotic Front (PF) cadres in Kalulushi have been apprehended by police for allegedly attacking their MMD counterparts.

The PF cadres ambushed their counterparts as they were returning from a campaign rally in Lufwanyama.

Copperbelt Police chief, Charity Katanga and MMD aspiring parliamentarian Annie Munshya confirmed the development in separate interviews on Thursday.

It is alleged that seven MMD members were injured during the attack, but were treated and discharged from the hospital.

Ms Munshya condemned the attack on her members because the MMD and the PF were working as partners with the former also campaigning for President Edgar Lungu for the August 11, general elections.

She alleged that the unruly cadres confiscated her public address system as well as other campaign material and that her campaign vehicle was damaged during the confusion.

The matter was reported to police in Kalulushi.

Ms Katanga said the suspects were currently in police custody, but could not divulge more information.

Former Movement for Multi-party and Democracy President Nevers Mumba’s application to challenge the newly elected party President Felix Mutati in the Lusaka High Court has been thrown out by Lusaka High Court Judge Shapi Phiri.

Dr Mumba has continued to hold on to hope that the courts would hand him back the party even after he deliberately chose to abstain from a constitutional requirement of party general convention every 5 years. The former party leader refused to accept the out come of the convention which elected Mr Mutati as the leader of the party.

The Registrar of Societies has since recognized Mr Mutati and the newly elected NEC members as the legitimate office bearers of the MMD something that enraged the embattled former President of the party leading to his faction sueing the Registrar of Societies through his appointed National Secretary Rev Ruben Sambo.

Judge Shapi Phiri has since ruled that Mr Mutati and the new NEC were the legitimate leaders of the MMD as they had furnished the Registrar of Societies with the relevant requirements in the aftermath of the Party convention.

The judge also noted that Dr Mumba had deliberately decided not to provide evidence that the Registrar of Societies had recognized the Mutati led dully elected National Executive Committee as the legitimate office bearers of the party.

Meanwhile MMD National National Youth Chairperson Dauzen Tembo, has said this ruling has now finally put to rest the unwarranted debate on who the legitimate President for MMD is.

Mr Tembo also warned the media to desist from referring to “any one on the streets as MMD President” saying “We believe the media have now been given guidance by the courts on who the legitimate leader of the party is.”

“There is no faction in the MMD, so let Dr. Mumba now join the UPND as an individual, as the MMD we are resolved to rebuild our party from the poor leadership we had in the former leader, Mr Tembo further said the Daily Nation News paper committed no offence in calling Dr. Mumba as a former MMD president.”

Zesco United shift camp to Lusaka

Zesco United have packed up their bags in Ndola and heading to Lusaka on Friday for a three-day camp before flying out to Cote d’Ivoire on Sunday.

George Lwandamina’s side will be in Lusaka for the final phase of their preparations for their July 27 date against ASEC Mimosa in the 2016 CAF Champions League Group A fixture.

Zesco will exclusively train on the artificial pitches at Olympic Youth Development Centre and Independence Stadium.

This is in order for the team to adopt to the playing surface of next Wednesdays match venue at Stade Robert Champroux in Abidjan.

Zesco will fly out to Cote d’Ivoire on Sunday morning to Abidjan via Johannesburg.

Zesco are second in Group A on six points, one behind leaders Wydad and three ahead of ASEC who are third heading into the fourth round of matches next week.

Lwandamina’s side beat ASEC 3-1 in the first leg match played on July 16 in Ndola to see them bounce back from their 2-0 away loss to Wydad on June 29 in Rabat.

Vice President, Inonge Wina has warned of severe disciplinary action against any PF member found engaging in political violence.

Ms. Wina says the party wants the August 11 general election to be free and fair.

The Vice President, who is President Lungu’s running mate in next month’s election, sounded the warning when she met PF Kafulafuta District officials.

And Ms. Wina said President Lungu is eager to win the elections without a re-run.

She urged PF members in Kafulafuta to continue working hard to ensure that the seat is grabbed from the opposition.

Ms. Wina said the party is depending on the grassroots to produce positive results on the poll day.

And Copperbelt Province Minister, Mwenya Musenge assured the Vice President that the region is geared to give President Lungu and the PF victory in the election

Zambia, South Africa commit to improve worker interests

Zambia and South Africa have signed a memorandum of understanding (MoU) which seeks to protect the interests of their nationals working in the two countries.

The MoU which was signed in Cape Town, South Africa on Tuesday this week aims to define the basis for institutional relations under which cooperation would be developed between the two parties in the fields of employment, labour and social security.

Areas of cooperation will include collective bargaining, dispute resolution systems, and labour inspections.

Press Secretary at the Zambian High Commission in South Africa Nicky Shabolyo told ZANIS in a statement that the MoU will also cover social dialogue, labour market information, occupational health and safety, HIV and AIDS, and Wellness in the workplace.

Mr. Shabolyo disclosed that the MoU will include other areas such as international labour cooperation issues, social security issues relating to unemployment insurance and compensation, and productivity issues.

Minister of Labour and Social Security Mr. Fackson Shamenda signed on behalf of the Zambian Government while his counterpart, Ms. Mildred Oliphant, Minister for the Department of Labour signed on behalf of the South African Government.

Zambia’s Acting High Commissioner to South Africa, Ms. Philomena Kachesa, South Africa’s Labour Deputy Minister Mr. Sango Patekile Holomisa, representatives from Zambia’s National Pension Scheme Authority (NAPSA) and South African Government agencies witnessed the signing ceremony held at Parliament Buildings in Cape Town.

Mr. Shamenda said the signing of the MoU enhanced the strategic co-operation and partnership on employment, labour and social security between the two countries to which Zambia was fully committed.

He said there are many South Africans working in Zambia adding that South Africa also hosts a lot of Zambian migrant workers which he said demonstrates the two nations’ mutual interests.
And Ms. Oliphant referred to South African President, Mr. Jacob Zuma, whom she said had emphasised before that such warm historical ties between the two countries should translate into stronger economic, social and developmental relations between the two countries.

Ms. Oliphant said the signing of the MoU seeks at the very least, to ensure that the relations between the two countries remain stronger as the two countries continue with the quest for social justice and the betterment of the people.

She said that South Africa will always remain indebted to Zambia for the selfless support in the struggle against apartheid and that the role the country played would always be remembered as the two countries forge ahead to ensure that the fruits of the liberation of South Africa are experienced by the citizens and, most importantly, workers of the two countries.

Tanzania Zambia Railway Authority (TAZARA) Managing Director, Bruno Ching’andu, has dismissed media reports that the Chinese government is planning to take over the operations of the railway company.

Addressing over 200 workers at TAZARA New Kapiri Mposhi yesterday, Engineer Ching’andu said many workers have been asking about the taking over of operations of TAZARA by the Chinese government.

He said China is not taking over TAZARA and that such rumours should be dismissed forthwith.

Engineer Ching’andu said what is true is that the Chinese government is so passionate about TAZARA and wants to see it running smoothly.

He said at no time has China indicated that it was taking over the operations of TAZARA, adding that China wants to keep the China –Africa spirit live by seeing to it that the railway company operates the way it was designed.

“The Chinese Government is so passionate about TAZARA and wants to see to it that the company continues to operate the way it was designed. They lost about 62 people from their country during the construction of TAZARA and this is what makes them to continue having interests in the manner the company is running,” he said.
Engineer Chinga’andu, however, said what is true is that discussions have been held to see how best the company can revamp its operations and what has been discussed among others, is a possibility of a partnership that will be beneficial to the two parties.

He said discussions on the same will be held by the end of the year on the operations of TAZARA with the Chinese Government.

He also dismissed reports that China has released K3.2 million to boost the operations of TAZARA.

And Engineer Ching’andu has disclosed that K100 million has been released to Mununga Quarry in Mpika district to boost the operations.

Engineer Ching’andu said that the K100 million will go towards the rehabilitation of equipment at Mununga Quarry so as boost operations.

The plant, which has capacity to produce more than 2,000mt of quarry products per hour when operating at full capacity, has of late been facing challenges due to broken down equipment.

“The quarry is very viable and can make a lot of money for the company if it operates normally. This company has capacity to make up to K150 million a month and so we need to support them,” he said.

The TAZARA Managing Director is making his debut visit of all the 94 railway stations on the 1,860 km stretch of the railway line following his appointment on April 25 this year.

The line inspection tour has coincided with the 40th Anniversary of commercial operations in the two sister countries since the Chinese government handed over the operations on July 14, 1976 to the authority.

Engineer Ching’andu is taking time to talk to the workers encouraging them on the need to work as a team and regain the lost glory.

Engineer Ching’andu says his vision is to regain the lost glory of the railway company that has over the years performed badly, losing a lot of customers in the process.

He told the workers at New Kapiri Mposhi that there is no way 3,000 workers could manage to move only 90,000 tonnes of cargo in 2015.

He said the company has started making a turn round and in the 2015-2016 financial year, it has managed to move 130 tonnes of cargo which ended last month in June and has projected to move at least 380,000 tonnes of cargo for the coming financial year.

Engineer Ching’andu said it is possible to revamp the operations of TAZARA if all the workers worked together.

THE 2016 MEMORIAL OF DR FREDERICK JACOB TITUS CHILUBA

Some pressing family issues, including a bereavement, made it inopportune for me to promptly correct the misrepresentation by the Daily Nation (carried by the online Lusaka Times – LT news outlet) of my statement during the memorial of the late former President Dr Frederick Jacob Titus Chiluba. A different message was conveyed, which exposed me to unwarranted online hate messages, insults and offside innuendo. I do not blame LT for publishing the story which they lifted verbatim from the Daily Nation; but that article manipulated my message by withholding the heart of my message, namely that for Christians who are celebrating the Declaration of Zambia as a Christian nation to continue to consciously and deliberately avoid mentioning the name of Dr Chiluba regarding that Declaration is not only hypocrisy but is peddling a false history. I publish this article to reiterate my side of the story but not to quarrel with anybody.

As a family we are not ashamed to have attended the Memorial, which event had no political motives. We joined Mrs Regina Chiluba and her family to commemorate the 5th anniversary of the passing of the former President. My brief statement was primarily intended to console and encourage Mrs Chiluba and her immediate family present at the small but warm gathering of sympathisers, who included Dr Kangwa, Mr Ndove and brother Fortune, a gospel evangelist, who lit up the occasion. The message was also directed at Christians who seem to be ashamed to be associated with or to mention the name of the person who officially and publicly declared Zambia a Christian Nation. Although Mr Richard Sakala and Mr Faustin Kabwe were not present I discovered that they had earlier on in the day laid the two flowers that we found laid on the tomb.

I was called upon to say a prayer before the formalities of the event, which I gladly did. After the laying of flowers I made a few remarks. I was NOT aware then that there was a news reporter until after the ceremony. As we were departing a man thrust a recording device in my face and asked me to repeat what I had said as he had not taken down anything. Initially I declined but he explained that he wanted to quote me correctly so I acceded.

First let me state what I did NOT discuss. I did not discuss the late Mr Arthur Wina; I did not discuss the MMD neither did I claim that Dr Chiluba founded the MMD; and I did not discuss Dr Akashambatwa Mbikusita-Lewanika or Dr Chitala (even though I have previously publicly acknowledged the two via a USA Blog Radio live interview as the architects and vision carriers of the MMD). Thus the hate messages were uncalled for and not justified.

What I criticised was the false history being ferociously peddled by those who are using the Declaration as a campaign slogan in their political messages; false because they have so far deliberately and consciously avoided mentioning the name of Dr Chiluba as the person who declared Zambia as a Christian Nation. I wondered why those Christians who gathered at the Lusaka Show Grounds last year, including the President, DID NOT mention or acknowledge Dr Chiluba, though after the article Dr Chiluba has been “honoured” by President Lungu! But no matter how many times the name Chiluba is ignored regarding that Declaration this will not change that historical fact! It is hypocritical for any Christian, particularly those who were witnesses, to pretend that someone else did so. Why be ashamed of the messenger but be proud of and use the Declaration to get votes? Ever heard of Eve or King David with his scandals? Remember King Nebuchadnezzar who put God’s people in the lion’s den? What of St Paul who has on occasions been described as an assassin of the followers of Christ? These names are permanently etched in the Bible and may be used for rebuking, teaching and even as examples of how to and how not to!

The world has the film of the Celebration of the Declaration on the steps of State House, where President Lungu now resides. From those steps Dr Chiluba made a solemn promise on our behalf emphasising, inter alia, that from that moment corruption would be a thing of the past. What a wonderful and appropriate message, even today; what a lasting memorable legacy of Dr Chiluba’s tour of duty, though not yet realised. That pronouncement was a declaration of a standard, a high standard that we must all strive for. Upon that declaration we can today confidently point a finger at anyone, including President Lungu and his ministers, to live up to that standard. Using the Declaration, even after the passing on of Dr Chiluba, we must continue to challenge and demand and ask those in high offices, “how did you suddenly get those billions, those properties and too much loose change to spare?”

Fellow Christians, you may kill the messenger, but please take care NOT to kill the Message instead preserve it, protect it and above all practice what it declares! But for some prominent Christians to consciously ignore Dr Chiluba and/or manipulate the Declaration date from 29th December to another date is simply to lie and to continue peddling that false history. This was my memorial message on that special day, not a ‘treatise’ on the MMD!

Although I did not discuss the MMD I hold the view that Dr Chiluba may have not been the founder of the MMD but he played a strategic role in the emancipation of Zambians and helped to move forward the MMD dream. Those who went to look for him and other eminent citizens did so to strengthen the MMD leadership and to attract more numbers to their project which had become a national project.

No single person can claim the historic triumph of the MMD, which literary “killed the One Party Scheme”, and which Zambians must NOT allow to rear its ugly head ever, not even by using the Referendum ruse as a device once again to take us back on that perilous route. GM///

MMD President Dr. Nevers Mumba has warned President Edgar Lungu to stop abusing and mocking the name of God by hoodwinking Zambians to fast and pray against political violence when he is the chief culprit in fueling the vice and had recently publicly announced that he had summoned senior police officers to State House and to ordered them to ‘sort out’ the opposition. A few days after that a UPND rally in Chawama was cancelled at short notice and the crowd dispersed using live bullets resulting in the death of a female UPND cadre.

“He is instigating and fanning violence at night by using the police to harrass the opposition and in the morning wears a desceptive humble face to ask the country to fast and pray. God cannot be mocked and does not initiate violence but President Lungu does. It is not for God to stop violence, but Lungu,” warned Dr. Mumba.

He said as Commander in Chief with all security wings under his jurisdiction, President Lungu was abusing this authority with impunity to frustrate opposition campaign programmes including abrupt cancellation of opposition party rallies, provocative and senseless police and ZAF actions deliberately aimed at disadvantaging the opposition while giving unfair political advantage and free course to the PF to freely conduct their campaigns.

He was speaking at a huge mammoth rally in Luangwa township in Kitwe, part of the ‘whirlwind’ Copperbelt campaign tour being undertaken with alliance partner UPND Vice-President Geoffrey Bwalya Mwamba in which they addressed several huge rallies in Twapia in Ndola, Mpongwe, Kasumbalesa, Kantanshi, Chingola, Kafulafuta, all in just two days focused on comprehensively ‘combing’ the entire Copperbelt in preparation for the August election.

Dr. Mumba said wherever the team went in Northern and Luapula provinces during the previous week, they met heavy police resistance and harrassment exemplified by the surrounding of Mano Radio station by armed police, threats of grounding their chopper, cancelling of landing and flying permits and short-notice expulsion orders to leave the provinces by the Police command and Zambia Air Force Commander all under the guise of President Lungu’s anticipated visits to the areas.

This harrassment included the latest attack on UPND Vice-President’s private residence and harrassment of his wife and family in Kasama where the police raided and ransacked the place resulting in the disappearance of K345,000. 00 cash which had been in the house.

These incidents resulted in delays in their Luapula and Northern province campaign programmes which in most cases had to be cancelled or drastically shortened before the final leg of the tour to the Copperbelt.

The key message to the Copperbelt electorate was that in 2011, the PF came to ‘steal, kill and destroy’ their jobs and dreams as they had failed to bring new mining investors to the sector all due to President Lungu’s self-confessed lack of vision in managing the affairs of the country and caused the collapse of the economy due to the unstable, unpredictable and confused economic policy regime of the Patriotic Front which led to loss of investor confidence and the resultant job losses and escalation of the cost of living.

They urged them to join the rest of the country in removing the PF Government and rally behind the candidature of Hakainde Hichilema’s premium and focused leadership to save the country from total collapse.

ZUFIAW calls for ceasefire to political violence

Zambia Union of Financial and Allied Workers (ZUFIAW) President, Alick Mweemba, says ending political violence should not be left to the ruling party alone but should be condemned by all well-meaning Zambians.

Mr Mweemba told ZANIS in an interview in Ndola today that the violence that has rocked some parts of the country is detrimental to the economic growth of the nation.

He noted that with less than two months to the election day on August 11, 2016, political leaders should ensure that their cadres desist from all acts of violence as it will have a negative impact on investor confidence that Zambia commands.

He noted that the unprecedented political violence that is taking part in some parts of the country is being driven by the high unemployment levels among the youths and poverty which many people are faced with in the nation.

He urged the government to prioritise youth empowerment programs in order for the unemployed youths to be engaged in productive issues and not violence, adding that youths engage in violent activities because they do not have anything productive to do.

Mr Mweemba observed that for Zambia to get where it should be in terms of development there is need for all stakeholders to condemn violence as it retards development because investors with intentions to invest in the country cannot do so.

LAZ concerned with application of Public Order Act

The Law Association of Zambia (LAZ) says it is concerned with the manner in which the Public Order Act is being applied by the police.

LAZ Council Member, Chishimba Kaela, says the Public Order Act is been applied unfairly by the police infringing upon those in opposition.

ZANIS reports that Mr Kaela said LAZ is, however, happy with the high court’s verdict on the Public Order Act, adding that the police have now been mandated to give proper reasons before denying anyone permission to hold public meetings.

Mr Kaela said this during a public discussion held in Ndola yesterday to sensitise people on the implementation of the Public Order Act.

He also urged all those who are 18 and holders of National Registration Cards to vote ‘yes’ in the referendum.

Mr Kaela said Zambians have been given a chance to enhance the Bill of Rights by voting ‘yes’ in the referendum.

And speaking at the same function, Human Rights Commission (HRC) Chief Officer – Information Education and Training – Mweelwa Muleya, revealed that his organisation organised the public forum calling all stakeholders in the electoral process following complaints by the stakeholders over the unfair application of the Public Order Act by the police.

Mr Muleya said HRC is also concerned with the manner in which stakeholders have been failing to abide by the Public Order Act.

He said there is need to strike a balance between maintaining law and order and the protection of human rights.

The Southern African Center for the Constructive Resolution of Disputes (SACCORD) has observed that it is possible for Zambia to hold peaceful elections, but all stakeholders have to play their role fairly and objectively.

SACCORD Executive Director Boniface Cheembe said it is encouraging to note the appeal made by the Electoral Commission of Zambia (ECZ) Chairperson, Justice Esau Chulu, on the need for all political players to be allowed to campaign freely without intimidation.

Mr. Cheembe however noted that some political stakeholders have complained over intimidation and lack of a free space to conduct their campaigns and called political players to be more tolerant to one another.

He said it is of paramount importance that the people of Zambia, who during this campaign season are masters, are given an opportunity to listen to messages, ideas and manifestos that their various political leaders are putting forward.

He said that the Public Order Act (POA) must allow for peace and facilitate for the enjoyment of basic freedoms of assembly, association and expression.

He also said ECZ Chairperson must be commended for calling on the Police to apply the Public Order Act fairly and ensure that all perpetrators of political violence irrespective of political affiliation are prevented from disturbing the peace.

Suspected Zambia Army Chaplain caught pants down by wife

A video of a suspected Zambia Army Chaplain caught cheating on his wife with her young sister has gone viral on social media.

The Chaplain only named as Mwape was found ready handed in bed by his wife and some soldiers at what is believed to be the lovers house.

In the video the wife laments that she defended her sister whenever people told her that she was fooling around with her husband.

UPND U-Turns on Prayer Meeting, Canisius Banda to lead the party’s prayer delegation

The United Party for National Development (UPND) has U-turned on it’s earlier decision to not to attend the Prayer Meeting slated for July 24th.

In a statement released to the media, the party said that the’s Vice-President for Politics Dr. Canisius Banda will lead the UPND delegation in joining the National House of Prayers in Lusaka for a service to pray for peaceful elections.

Early this week, UPND Deputy Director for Policy and Research Joseph Lungu, who is also in charge of the party’s fasting and prayer organizing committee, said that the party would shun July 24th national prayers bacause the party did not not see the need to take part in the national day of prayer to be held on 24th July to pray for peaceful elections.

Speaking to QTV, Mr Lungu who said that his party had issues with the national day of prayer because the people who are spearheading them seemed to have some biasness towards the ruling PF and that UPND found it difficult to be part of such prayers.

Canisius Banda To Attend National House of Prayers in Lusaka This Sunday

Earlier this week we were honoured to attend prayers for peace hosted by the Church and the Law Association of Zambia. UPND President Hakainde Hichilema who attended and led the UPND delegation once again called for peace and unity, condemning all acts of violence regardless of the provocation.

This Sunday 24th July UPND Vice-President for Politics Dr. Canisius Banda will lead the UPND delegation in joining the National House of Prayers in Lusaka for a service to pray for peaceful elections.

UPND leader Hakainde Hichilema will be touring in Southern Province on the 24th, while Vice-President for Administration who is also the UPND running mate Geoffrey Bwalya Mwamba is scheduled to be in Northern Province.

But regardless of their location they will be joining us in prayers on this matter of national importance, as they have done in the past. We will be praying also for justice for those who have been victim of acts of electoral violence and their families.
