Kapoko found with a case to answer

Former Chief Human Resources and Development Officer at the Ministry of Health Henry Kapoko and his co-accused Nobert Peleti who was the Acting Director of Human Resources and Administration have been found with a case to answer.

This is in a matter where they are facing six counts of Abuse of Authority of Office, Theft by Public Servant and money laundering involving K1,290,402, development of Best Home Lodges, Purchase of House in Olympia.

The case came before Magistrate Hon. Alfrida Chulu. The Court held that the prosecution has proved its case in all the counts.

The matter is coming up for defence from 16th to 27th January, 2017.

Kapoko was arrested by the Anti-Corruption Commission in 2009 following the unearthing of a scam involving corruption, theft, and money laundering at the Ministry of Health.

Meanwhile, the Anti-Corruption Commission (ACC) in Mongu has arrested the Mongu Subordinate Court Magistrate Webster Milumbe for conspiracy to commit a felony.

Webster Milumbe aged 42 of House No. 6 Kambule Street in Mongu has been charged with one (1) count of conspiracy to commit a felony contrary to Section 394 of the Penal Code CAP 87 of the Laws of Zambia.

Particulars of the offence are that Webster Milumbe on dates unknown but between 1st May 2014 and 31st December 2014 in Mongu District did conspire with Brian Mutoiwa, a Court Interpreter at Mongu Subordinate Court to commit a felony namely forgery by acknowledging that he had signed the Warrant of Commitment to Undergo Imprisonment for a named convict thereby misleading the Prison Officers to release the said convict prematurely.

Magistrate Milumbe has since been released on bond and will appear in Court soon.

This comes barely a week after Brian Mutoiwa a Court Interpreter at Mongu Subordinate Court was arrested on two (2) counts being forgery of judicial document contrary to Section 349 of the Penal Code CAP 87 of the Laws of Zambia and uttering of false documents contrary to Section 352 of the Penal Code CAP 87 of the Laws of Zambia.

In this matter, it is alleged that Brian Mutoiwa aged 38 of North Park area in Mongu on dates unknown but between 1st May 2014 and 31st May 2014 in Mongu District did forge a document namely Warrant of Commitment to Undergo Imprisonment for a named convict by purporting that the said document had been signed by Honourable Milumbe when in fact not.

In the second count, Brian Mutoiwa on dates unknown but between 1st May 2014 and 31st December 2014 in Mongu District did knowingly and fraudulently utter a false document namely Warrant of Commitment to Undergo Imprisonment of a named convict to Nawa Nalumango a Prison Officer at Mongu Central Prison.

Mr. Mutoiwa has since appeared in Court.

Just Slim is set to release his new single “Stay positive” on 1st December . He had this to say about the song ;

“It encourages one to believe in them-self, stay positive through the ups and downs of life and to keep the faith until something materializes. It was inspired by my recent trip to Durban South Africa for the Keep the Promise concert and march where I got to meet Queen Latifah and Common, something I had never imagined would ever happen.”

Paul Banda (born June 17, 1989), aka Just Slim is a Zambian Singer, Songwriter, Music producer and disc jockey. Paul is an activist of positive living with HIV/AIDS and Ambassador to the Brothers for Life Campaign in Zambia.

In 2003, he was diagnosed with tuberculosis and recovered after undergoing treatment. Barely a year later, he had a relapse, a development which prompted doctors to recommend that Paul, who was then in secondary school, take an HIV test. Having in mind that he never had any sexual relationship, he found the physician’s recommendation very puzzling. This gave his mother the opportunity to disclose her HIV-positive status to him. After receiving some motherly counsel, Paul agreed to go for the HIV test which turned out positive but with a very low immune system whose CD4 count was four.

He decided to come out in the open about his HIV-positive status because he believed that if he talked about it with someone that person might use it against him and also knowing the type of discrimination surrounding people living with HIV/AIDS that also compelled him to reveal his HIV status.

Just Slim’s music career started in 2008 as a producer and song writer under the music label XYZ entertainment. In 2008 he co-produced a chart topping hit single by Zambia’s ‘Slapdee’ featuring JK titled ‘Gold digger’.

He decided to go solo and released 2 singles ‘Me’ and ‘Wachelwa’ which featured on an MTV documentary entitled Me, Myself and HIV in 2010.

In 2012, he released a mix-tape titled ‘Proof’ which enjoyed a considerable amount of airplay across the capital city – Lusaka.

To his achievement, he played the role of music supervisor on Zambia’s Award Winning TV Drama Series: Love Games produced by Media 365.

2013 – In recognition to his openness, and works he had done in reducing stigma related to HIV; and being a role model for other young people living with HIV in Zambia, he was awarded the first ever Bravery Courage & Commitment award  by the Ministry of Education.

In June, 2015 he released another single titled ‘Pon Replay’.

He went on to collaborate with fellow AIDS Health Care Foundation Ambassador Brian “B Flow” Bwembya on a song titled ‘Know Your Status’ in support of the 2020 campaign whose music video was shot in Durban, South Africa.

Just Slim was part of the “Keep the Promise” March and Concert at Kingsmead Stadium in Durban, rubbing shoulders with Common, Queen Latifah, B-Flow, Big Nuz, Mi Casa and other celebrities.

Some Munali Constituency PF Officials have said they will rally behind the right candidate in the constituency irrespective of who will be chosen by the party if there is a by-election in the area.

This revelation comes in the wake of the nullified Munali Constituency seat held by Prof. Nkandu Luo who until her nullification also served as Cabinet Minister in charge Higher Education.

The officials said they will support the candidature of the losing MMD candidate in the general elections Mike Mposha regardless of where he will stand whether on PF or MMD tickets.

The constituency officials who have declined to be named, said they have been vindicated by the nullification of Nkandu Luo because she didn’t deserve the party’s adoption certificate which she got dubiously saying it was the beginning of problems in Munali.

“We have said it before that we have been adopting wrong people, we as a constituency chose Mike Mposha as our candidate even through the interviews, but Luo bulldozed her way through the central committee.We said let’s wait and see where these problems will take them.You see, katwishi why we are running the party like a chipante pante as though we are amateurs who don’t know anything.No one should even blame the President on this one or the courts.It’s just clear that our Lady was not rightly chosen, she didn’t deserve it in the first place.

Mr Mposha won adoption elections in the PF adoption process before Nkandu Luo was given the adoption certificate to the disappointment of the constituency officials.

Mr Mposha was the MMD candidate in Munali constituency.

Meanwhile people within the PF have already started showing interest in contesting the Munali seat as a Hash tag has already been created by a Mubanga Mundashi.

Mr Mundashi who is the brain behind the PF National Youth league has openly declared that he will go for the seat.
In a post on his Facebook page Mr Mundashi said youths should not be made cadres but allowed to aspire for higher positions and that the chance had presented itself for a youth to take up from Prof Nkandu Luo.

The #MubangaMundashi4Munali2017PFTicket is latest indicator of the cracks in the ruling Party as reports in the media reveal growing discontent among party members especially the youths.

“Surely I feel extremely encouraged by all these gestures. I want to be a shining example for many youths who think their time has not yet come and their place in politics is to be mere cadres. I will not listen to anyone discouraging me because the negative voice is weak. I will however take advise where necessary.

“Let me state that I respect the rule of law and the party organs: Hon Professor Nkandu Luo has appealed against the nullification. We don’t want to seen to be going against the Party. When everything is settled we will surely start doing our homework so as to ensure PF Zambia wins the seat back.

“Surely Munali needs fresh minds that understand its problems and resonates with the people continuously.The time has come to rekindle the energy of 2011 and put back the hope and life into the community of Munali.”

Dr Charlotte Scott says the decision by the Lusaka High Court to nullify the election of Margaret Mwanakatwe as Member of Parliament for Lusaka Central seat proves that the August elections were not free and fair.

In an interview, Dr Scott said the overturning of Mrs Mwanakatwe’s victory means that justice has been served.
She however stated that the plea of the UPND is to have the presidential petition heard.

Dr Scott said the evidence coming out of the nullified seats goes to confirm that the UPND was robbed of victory.

Mrs Mwanakatwe’s election victory has been nullified on grounds including corrupt acts, use of discriminatory language, misuse of Government resources and that Dr Scott was prevented from campaigning freely by the Police.

“I am delighted with the judgement, and very grateful to the brilliant legal team, the whole Lusaka Central team, the people of Lusaka Central, and to the party leadership,” she said.

King Mohammed VI of Morocco will continue his African tour by paying a visit to Nigeria and Zambia in early December after his official visits to Ethiopia and Madagascar this month.

Zambia’s handling of the Sahrawi Arab Democratic Republic and its relationship with Morocco is likely to become a huge diplomatic embarrassment after a series of U-turns by senior PF government officials over the matter.

Historically, Zambia has always recognised Sahrawi Arab Democratic Republic independence efforts with First Republican President Dr Kenneth Kaunda being the first African leader to visit Sahrawi.

In February 2016, President Edgar Lungu accepted letters of credence from Mr Brahim Salam El Mami, Ambassador of the Sahrawi Arab Democratic Republic and assured Ambassador El-Mami that Zambia has always supported the Sahrawi people’s indisputable right to self-determination and independence.

Sahrawi Arab Democratic Republic or Western Sahara is the remaining country under colonisation under a fellow African country, Morocco and is a desert country lying between Algeria, Morocco and Mauritania.

But on July 10, 2016, a month before the August 2016, Foreign Affairs Minister Harry Kalaba announced that Zambia has cut ties with Sahrawi Arab Democratic Republic.

During a joint press conference with the Moroccan Minister Delegate to the Minister of Foreign Affairs and Cooperation Nasser Bourita in Rabbat, Mr Kalaba said Zambia will withdraw recognition of Sahrawi and severe all diplomatic ties with the Algeria-backed separatist group.

But on October 7th 2016, President Lungu assured Sahrawi Arab Democratic Republic Foreign Affairs Minister Salem Ould Salek when he paid a courtesy call on him at State House that Zambia remained committed to strengthening relations with Sahrawi for the mutual benefit of the two countries.

Morocco’s King Mohammed VI used the country’s hosting of UN meeting of states parties on climate change (COP 22) in Marrakesh recently to lobby African leaders at the Africa Action summit on the margins of the UN meeting to readmit Morocco into the AU.

Neither Mohammed VI nor his father Hassan II have attended an AU summit since Morocco walked out of the Organisation of African Unity (OAU) in 1984 in protest at the recognition of the Sahrawi Arab Democratic Republic (RASD) by the continental organisation.

Mohammed VI, however, is making every effort to ensure that this changes and he has been busy courting African leaders in the past six months having six African countries since asking to be re-admitted to the AU in September.

The surprise decision by Mohamed VI for the return of Morocco was announced at the AU summit in Kigali in July where 28 African countries signed a petition for the Sahrawi Arab Democratic Republic to be expelled from the AU, to pave the way for Morocco to join.

For the past few decades, Morocco has refused to sit in any international meetings alongside the Sahrawi Arab Democratic Republic.

For the Sahrawi Arab Democratic Republic to be expelled, however, Morocco and its supporters, mostly in Francophone West and Central Africa, would need a two-thirds majority.

It won’t be straightforward, however. Heavyweight countries like South Africa and Algeria, backed by countries like Zimbabwe and Equatorial Guinea, are determined that the issue of Morocco’s continued claim over the Western Sahara be resolved before letting the kingdom into the AU.

Lifting the occupation of Western Sahara is seen as “the last anti-colonial struggle” to be fought by the AU.
Pro-Moroccan media have accused AU Commission Chairwoman Nkosazana Dlamini-Zuma of wanting to “sabotage” Morocco’s plans.

According to AU rules, if an African country asks to join the organisation, the commission’s chair should send a letter to all member states and if a majority agrees, the issue will be tabled at the AU Assembly.

The request for adhesion was officially received by the AU Commission on September 22, but the letter was only sent out on November 3, a delay some believe was intentional.

The pro-Morocco camp is banking on Dlamini Zuma’s successor being more favourable to Morocco.

One of the frontrunners, Abdoulaye Bathily, the former UN special representative for Central Africa, is from Senegal, one of the strongest advocates for Morocco’s membership and for expelling the Sahrawi Arab Democratic Republic.

Kenyan Foreign Minister, Amina Mohamed, another strong contender, is also seen to be in favour of Morocco’s adhesion.

Stanbic Bank expects Inflation to pick up again in December

Standard Bank which trades in Zambia as Stanbic Bank says it expects the country’s annual inflation rate to pick up again in December 2016 after it dropped to single digit in November.

In a note to investors, Samantha Singh, an analyst at Standard Bank Group Ltd said the November headline inflation fell to 8.8% year on year was marginally higher than the bank’s expectation of 8.7% year on year, from 12.5% year on year in October.

Ms. Singh said the decline in inflation was largely owing to favorable base effects and lower food inflation.
“Food inflation fell to 9.8% year on year from 15.6% year on year in October while non-food inflation fell to 8.3% year on year in November from 9.0% year on year in October. We expect inflation to pick up again slightly in December, and thereafter remain in high single digits ” she said.

“However, higher fuel prices and transport fares pushed the headline CPI by 1.5% on a month to month basis from 0.5% month to month in Oct. The retail price of petrol was increased by nearly 39% to 13.7/litre, while the price of diesel was raised by 33% 11.4/litre) on 14 Oct as part of subsidy reform.”

She said despite an increase in fuel tariffs and likely increases in electricity tariffs, the bank expects headline inflation to be anchored by a steady decline in food inflation.

“Subsidy reform will initially be felt in the non-food components of the CPI basket, namely housing, water, electricity, gas and other fuels (which make up 11.4% of CPI) and transport (5.8% of the basket). On a month to month basis the transport sub-index surged to 10.7% month to month in Nov from 0.6% month to month in Oct while housing, water, electricity, gas and other fuels sub-index increased by 1.9% month to month from a 0.1% month to month decline in Oct,” she said.

On the currency market, Ms Singh said since the highs close to 11.50 in the first few months of the year, upside pressure on USD/Kwacha has been relatively muted.

She said the bank however expects that a slow grind higher is on the cards on a multi-month basis as corporate activity picks up after the election period.

“We expect that USD/Kwacha will trade in a range of 9.8 – 10.3 over the short term. The government has indicated its intention to negotiate a funded program with the IMF. Given our views about there being scope for further fiscal consolidation in the 2017 budget, it is highly probable that such negotiations would lead to more substantive fiscal consolidation that would support the BOP and the Kwacha.”

She added, “In such a scenario, it is highly probable that with inflation declining further, yields would decline meaningfully. The BOZ, which has borne the brunt of tightening macroeconomic policy, would ease the policy stance. We maintain that an easing cycle will most likely begin late in Q1:17 once the BOZ ascertains the impact of further subsidy reform on inflation.”

UPND loses Itezhi -tezhi seat

The Lusaka High Court has nullified the parliamentary election of United Party for National Development (UPND) winner Herbert Shabula as Member of Parliament for Itezhi-Tezhi Constituency in Central Province.

This is in a matter in which losing Patriotic Front (PF) candidate in the Itezhi-Tezhi parliamentary elections Greyford Monde had petitioned his seat in the Lusaka High Court on grounds that the opposition Mr. Herbert Shabula employed rigging schemes in the just ended elections.

Lusaka High Court Judge Pixie Kasonde Yangailo declared the parliamentary election of Itezhi-Tezhi Constituency, null and void.

Justice Yangailo cited extensive acts of violence perpetrated by Shabula and his supporters against the supporters of Monde.

Meanwhile the Lusaka High Court has upheld the election of PF’s Kelvin Sampa as duly elected Kasama Central Member of Parliament.

This is in a matter in which UPND Kasama constituency losing candidate Sibongile Mwamba had petitioned the election of Mr Sampa and the Electoral Commission of Zambia.

Ms Mwamba had asked the Lusaka High Court to nullify the election of Sampa alleging malpractices and widespread violence.

But when the matter came up for Judgment today, Justice Susan Wenjelani stated that the petitioner failed to prove the allegations to warrant the nullification of the seat.

Former ZANASU Vice President Prince Ndoyi has called on citizens in the country to block the increment of toll gates fees by 100% effective January 2017.

Mr Ndoyi said as opposed to hiking the prices government should instead reduce the prices because as it is they are making colossal sums of money from the current toll gates.He said government should not make National Road Fund a cash cow for politicians in power.

Below is the full statement

As young people we want to add our voice on the immoral toll gate fee hikes. We want to register our protest against the proposed 100% fee hikes at toll gates effective next year. We are surprised that the PF government seems to be in a quagmire of disarray and lacks consistency on a number of issues, owing to the contradiction between the aspirations espoused in the budget and the policy being pursued by the ministry in charge of toll gates.

We are aware that the hikes will result in transport fares going up, and so every other service and product has to go up EXCEPT THE SALARIES.People are being skinned to the bone. Transport operators will be forced to increase inter-city route fares due to this shock increase in toll gate fees.

We demand a downward adjustment instead because the roads are making colossal sums of money with just the three toll gates along the Lusaka-Kitwe route. Just at Chisamba check point were we conducted a research and discovered that at least 9000 vehicles pass through that check point everyday.Now for argument purposes do your maths of how much these guys collect in a day.It’s too much therefore why the increase and how did they arrive at the current figures and why 100% hike?

These monies the PF government wants to be in a hurry to collect from poor Zambians will soon start landing them in problems.Where will they take all those monies.In just a day they make millions.We do not want the hard working Zambians to be used to contribute to by-elections like they did through ZESCO which has been a cash cow for politicians in government. It’s immoral to hurt the Zambians further even when they are tightening their belts.

We say so owing to a Budget Speech that seeks to build and advance people’s power and respond to the people’s aspirations, reaffirm government’s commitment to place the people first, advancing people’s power. To this end, we appeal to government to remain committed to developing an inclusive economy that works for all.

The strong initiatives outlined in the budget seemed to increase efficiencies and decrease the cost of doing business, and increasing toll gate fees is one particular example of policy inconsistency. How then does increasing the costs of doing business by 100% become the creation of a conducive environment for more jobs, decent work and sustainable livelihoods, education and health, service delivery and rural development, in any pragmatic sense.

We therefore call upon government to reverse the hikes, to avoid unnecessary opposition from the general citizenry. We urge all Zambians to refuse these 100% hikes. We implore workers to be organized as we strongly block this unfair hike. Our roads are a public asset already paid for through taxation and the fuel levy, and motorists should not therefore have to pay again extortionate prices to drive on these public highways. We call upon Human Rights NGOs and LAZ to mount a legal challenge on the validity of the government’s decision to arbitrarily hike road toll fees by filing an application in the High Court seeking to interdict the NFRA from administering the new toll gate charges, they must be declared null and void.

We strongly feel, this proposed 100% hike is untimely and being presented in the midst of a sluggish economic climate and pressing fiscal challenges. It is clearly not aimed at rebuilding and re-igniting dynamic, responsive and inclusive economic growth, while enhancing spending.

The proposed road-use toll fee hikes, will place an unquestionable hardship on the already suffering masses, already struggling to recover from over 50% hike in petrol prices since January 2016, to which there is a current question on how the accrued moneys are being used or rather misused.We warn that this is may result in strong public rejection and protests as it directly affects everyone. We condemn the proposed toll gates fees hike. There is absolutely no justification for such a hike at a time poor Zambians are struggling to make ends meet.

Instead of increasing toll fees by 100 percent for the ordinary Zambian, the PF government should first deal with corruption which has destroyed the economy. The lack of development of our roads and over pricing on road contracts has been caused by corruption.

We strongly condemn such a move and we stand with the people and demand consultation, transparency and accountability on how public affairs are run and roads are a public affair. Government must not punish the poor by over burdening them with over priced goods and services.

We appeal to government to desist from the temptation to engage in such excessive risky behaviour because of moral hazards. This is a classical example of a dialogue of the deaf. Many sectors of the business community have warned against such hikes because they injure economic growth and activity if implemented through out the country and mainly at the border posts.It has a negative impact on the cost of doing business in Zambia as we all know Zambia has the most monotonous business registration system which favour foreign business houses as compared to local ones. Our protest will continue as we want the government to do justice regarding the fee hike.

In conclusion, we have protested strongly against the toll hikes, because we think they are immoral judging by a lack of justification. It is no news that our country’s government is rapaciously transferring the wealth, assets and livelihood of the entire nation over to a few government conspirators.

These seem to be happening so quick in recent days, it’s literally pouring down like a tropical rain storm as evidenced by the statement by the President over corruption. All essentials have become targets for exploitation – cars, road use, power, cement, even water. Dr Kenneth Kaunda once put it, “One of the reasons why peaceful protesting arguments are a valuable way of fighting unjust systems is because they make a direct appeal to the human instincts of those in power and it is their conscience, which is the real weapon against injustice. In the name of common decency, humanity and common sense, surely the poor families should be shown some compassion for morality and decency sake.

We dread to think how much all this will cost the poor families. Government must not be so blatantly uncaring, stubborn and unbending . We call upon the government to make the right decisions, because we see these harsh road tolls fee hikes as a “modernized privatization” of the nation’s road network.

Mwambashi bridge along the Kitwe-Chingola road has developed cracks calling for urgent attention.The Road Development Agency (RDA) awarded a K562 million contract to Sino Hydro Zambia Limited for the construction of more than 45 kilometres of the dual carriageway between Kitwe and Chingola on the Copperbelt province in March 2013.

The contract was to be undertaken within 24 months from the date of execution.The scope of work was to include the construction of a new bridge at Mwambashi River and reinforcement of the existing bridge at the same location. The project was to be implemented over a period of 2 years and was expected to generate over 500 jobs during the construction period.However, running into it’s 3rd year the project remains incomplete.

Government has,released K25 Million to the two contractors to finish the constructions works of the Kitwe-Chingola dual carriage way.

Zambia halt poor run on FIFA rankings

Zambia have made a modest improvement on the latest FIFA Rankings released on Thursday, November 24.

Chipolopolo move three places up the rankings from 94 to 91 to end a two-month fall.

Zambia’s 1-1 away draw with Cameroon, who are at number 65, in a 2018 World Cup Group B qualifier on November 12 and their 1-0 away friendly win on November 8 over Uganda, who are number 73 in the World, helped halt their poor rankings.

Algeria are the highest ranked side in the 2018 Group A qualifiers at number 38 and are 5th in Africa.

Nigeria are 50th in the World and 8th in Africa, Cameroon are 13th on the continent while Zambia are 22nd on the CAF rankings.

Senegal is the highest ranked CAF member on the FIFA rankings at number 33 while Côte d’Ivoire (34), Tunisia (34) and Egypt (36) make part of the top five.

Argentina lead the overall rankings, Brazil, Germany, Chile and Belgium complete the top five in that order.

Annual inflation rate reverses to single digit

The annual inflation rate for November 2016 has reversed to a single digit standing at 8.8% compared to 19.5% in November 2015.

Director of Census and Statistics John Kalumbi says this means that on average prices increased by 8.8% between November 2015 and November 2016.

Mr. Kalumbi clarified that the decrease in the annual inflation rate does not mean a fall in the prices of goods and services.

He said this during the release of the November 2016 statistics monthly bulletin.

The year on year inflation rate as measured by the ‘all items consumer price index’ in November has shed 3.7% on the October 2016 rate of 12.5 percent.

The monthly rate of inflation has however increased to 1.5% in November 2016 from 0.5% in October 2016.

Nchanga Rangers survive after winning demotion appeal

The FAZ Appeals Committee has reversed the demotion of Super Division side Nchanga Rangers to Division One on allegations of attempting to bribe a referee.

FAZ General Secretary Ponga Liwewe confirmed on Thursday that Nchanga have won their appeal against the Disciplinary Committee decision to demote the club.

The Disciplinary Committee ruled on 5 November that Nchanga be relegated from the top flight after four club officials were found guilty of attempting to corrupt a match official before a match against Nkwazi played on 29th October, 2016 in Chingola.

“The Appeals Committee, having examined the referee’s report of that match, found that the referee did not include the alleged bribery incidences,” Liwewe stated.

“The Committee, therefore, quashed all sanctions and fines imposed on Nchanga Rangers FC and its officials,” he said.

The Appeals Committee further reversed the slapping of life bans on Nchanga officials – Elijah Mugala, Matyola Haanyama, Patrick Nkhata and Shadrick Chalenga.

Nchanga must now fight relegation on the pitch.

The Chingola Club is placed 11th on the table with 39 points from 33 matches played.

Coach Bruce Mwape’s side must now win their last match to be sure of surviving relegation.

THE Lusaka High Court has nullified the parliamentary election of Minister of Commerce, Trade and Industry, Margaret Mwanakatwe as PF’s Member of Parliament for Lusaka Central Constituency in Lusaka Province.

This is in a matter in which losing UPND Lusaka Central Parliamentary Candidate Charlotte Scott had petitioned the election of Mrs Mwanakatwe and the Electoral Commission of Zambia.

Lusaka High Court Judge Mwiinde Siavwapa ruled this morning that Margaret Mwanakatwe was not validly elected as Member of Parliament for the Lusaka Central Constituency on PF ticket.

The Lusaka High Court nullified the election victory of PF’s Margaret Mwanakatwe due to widespread violence and racist remarks.

Judge Mwiinde Siavwapa said the racial remarks against UPND candidate Charlotte Scott were used for political reasons.

“In no way does it mean first respondent is a racist but I believe remarks were used for political reasons. On racial remarks it is clear that the target of remarks was the petitioner and has been proved,” Judge Siavwapa said in his judgement.

He said on allegations that Zambia Police breached the Electoral Process Act, Judge Siavwapa said allegation stands proved even though no evidence of reports made to police but that he will accept the Petitioner’s credibility on actions of police.

He however dismissed allegation of campaigning on polling day at Lusaka City Council Library as the culprits were not identified and has not been proved.

“There is no way those supporters could have been UPND and must have been PF which the first respondent admitted to when she said they must have been PF but not directed by me in her cross examination,” the judgement read.

Justice Siavwapa said the allegation of violence by Mrs Mwanakatwe’s supporters in town center.

“On boreholes, given the facts that the dates boreholes were sunk was within the campaign period and she took advantage of this to endear herself to voters. Even if the letter requesting for boreholes was done two months before campaign period, it did not change the fact that she had them sunk during campaign period. Allegation proved.”

“On cash donation to church. There is no dispute on this. And the video evidence shows she gave money. The only issues is when it was done. Donation was made as a way of inducing voters as was made two days before campaign period.”

Judge Siavwapa said on use of government resources, Mrs Mwanakatwe admitted that she used the government pool vehicle with a flag and she introduced herself as Minister on Race to Manda Hill Program which was a campaign activity meaning she had greater leverage and thus allegation proved.

“On buying of Chitenges the fact that she bought Chitenges in full view of the congregants it was meant to induce and not for purposes of philanthropy. The allegation was proved.

“In conclusion the 1st respondent was not validly elected. I declare election void,” the judgement read.

Government says ZESCO is hoping to end its five-day power blackout which has hit five provinces today, Thursday, November 24th 2016.

Five provinces namely, Northern, Muchinga, Eastern, Luapula and parts of central provinces have had no power since Saturday after a fault on the Kabwe-Pensulo 330KV transmission line.

The line was extensively damaged by suspected lightning which occurred around 13:00 Hours on Saturday.

ZESCO engineers have been working on repairing the damaged lines and Energy Minister David Mabumba who toured the site with Presidential Affairs Minister Freedom Sikazwe is hopeful that repair works could be finished today.

Mr Mabumba said there has been extensive damage to the Zesco Tower structures, including the earth wire and optic fibre conductors.

He estimated that the repair works will cost ZESCO around USD $1.5million.

Meanwhile, the blackout has led to undisclosed waste of perishable items such as food in the affected provinces.

A check in Kasama revealed that most butcheries in the Central Business District and some homes have had to discard huge amounts of food after it went to waste.

A butcher at Evonny Butchery in Kasama’s Location Market said in an interview that meat worth over K4, 000 has gone to waste.

Other businesses such as salons, barbershop and tailoring shops have also recorded huge losses.
