By-elections date announcement null and void – Sinkamba

Opposition Green Party President Peter Sinkamba says until the court gives its judgement on the pending cases pertaining to the for the Kwacha and Kabushi parliamentary by-elections, the election date set by the Electoral Commission of
Zambia is null and void.

Mr. Sinkamba says although the decision will enable the electorate in the two constituencies to have representation in Parliament, it would have been better for the commission to set the polling date after the court judgement on Thursday.

The opposition leader in an interview felt that the Commission’s decision to announce the election date was illegal as it seems not to have adhered to the court judgment that stayed the election in the first place.

“We are in total disregard of what ECZ has announced, this matter is in court for guidance on how it should proceed so unless we get
guidance from the court whatever ECZ is talking about is in vain, proper directives on how to proceed will be made by the court
tomorrow,” he said.

The opposition leader and others decided to take the matter to court in order to help the electorate in the said two constituencies not to lose
representation in parliament for the next four years.

That is if elections are not held within 90 days from the time the two seats were nullified as well as to have the two disqualified candidates heard by the court.

And United Party for National Development (UPND) Kitwe District Chairman Shadreck Chataba said the ruling party was ready for the
polls.

He expressed confidence that the party will carry the day because it has done its homework in terms of campaigning.

“We are ready for the elections and we are very confident of winning come rain, come sunshine because we have engaged all the electorates
in all the Kwacha constituency wards, so we are ready for the election on any date to face any candidate,” He said.

Yesterday the Electoral Commission of Zambia announced that the Kwacha and Kabushi parliamentary by-elections will be held on the 21st
October, 2022.

The Election was earlier stayed by the High Court to allow the court decide in a matter that Mr. Malanji and Mr. Lusambo sought
clarification on their eligibility to recontest their seats after their nomination papers were rejected by the Electoral Commission of
Zambia.

According to the announcement by ECZ, the Kwacha and Kabushi parliamentary by-elections will go ahead without fresh nominations.

Angola Face Zambia in 2022 COSAFA U20 Semifinals

Zambia will face Angola in Friday’s 2022 COSAFA U20 Cup semifinals at the ongoing tournament Eswatini is hosting from October 7-16.

Angola beat Seychelles a whopping 8-1 to seal their place as the best group stage runners-up.

They join Zambia, South Africa and defending champions Mozambique who are through to the semifinals after winning Group A, B and C respectively.

Angola emphatic win also denied hosts Eswatini hopes of that lone second best semifinal spot thanks to their superior goal difference.

Friday’s meeting will be a repeat of the 2020 third place playoff that saw Angola beat Zambia 2-1.

South Africa and Mozambique are also in action this Friday.

The Eswatini tournament is the first COSAFA U20 Cup since 2020 that took a break due to the COVID-19 pandemic.

Meanwhile, the two teams that will advance to the 2022 COSAFA Cup final will represent the Southern African zone at the 2023 U20 AFCON in Egypt.

ACC Clarifies that It Has Not Shut Down nor Taken Over SAVENDA Group of Companies

THE Anti-Corruption Commission (ACC) has clarified that it only put a restriction on one bank account belonging to Savenda Group of Companies following investigation on Corrupt practices.

The Commission has also clarified that it has not shut down the Company nor taken over.

ACC Chief Corporate Affairs Officer Timothy Moono said the Directors of Savenda have since been informed that they are at liberty to withdraw money from their other accounts, but that it should be backed with supporting documentation.

“The Commission wishes to inform the public that it has only restricted one of the many accounts that are held by the Savenda Group of Companies. The directors of Savenda Systems Limited have been informed that they are at liberty to withdraw any amount of money in the account as long as the request is backed up by verifiable invoices and supporting documents. At no time has the said company indicated that it had 800 employees whom it needed to pay. Further, the Commission has neither shut down the company nor taken it over,” he said.

This follows the commission conducting investigations against Savenda Group of Companies Director and Chief Executive Officer Clever Mpoha.

“Mpoha was in August this year subsequently arrested by the Commission and charged with the offence of Corrupt Practices by Private Persons in connection with a contract for the supply and delivery of military uniforms for the Zambia National Service. Before this, the Commission seized Simoonga Farms in Chikankata District which was purchased by Sturdy Mwale, Former Permanent Secretary at the Ministry of Defence using money paid on his behalf by the said Clever Mpoha,” Mr Moono said.

He further said that among the Savenda Group of Companies that the Commission has been investigating for some time is Savenda Systems Limited for multiple corruption offences.

“In the course of investigations, the Commission issued a Restriction Notice on one of the accounts for Savenda Systems Limited after an attempt was made by Mpoha to withdraw the entire sum of US$3,474,150.00 which was sitting in its account,” he said.

Mr Moono said the restriction was done pursuant to the Anti-Corruption Act. No. 3 of 2012, Section 61 (1) which gives the Director General powers to restrict a property or money in a bank for a person who is under investigation.

HH and First lady in Namibia for a 4 days State Visit

President HAKAINDE HICHILEMA has arrived in Namibia for a four day state visit at the invitation of that country’s President HAGE GEINGOB. President HICHILEMA’s plane landed around 10:45 hours and was received by Dr. GEINGOB.

The President also inspected a guard of honour mounted for him before joining Dr. GEINGOB on the Presidential dais. During his visit, President HICHILEMA is expected to grace the Swakopmund International Trade Expo -SWAiTEX.

President HICHILEMA is later today expected to deliver a keynote address at the Expo which is being hosted by Dr. GEINGOB. The President will also on the sidelines of the expo, attend the Zambia-Namibia Business Seminar where he is also expected to deliver a keynote statement.

During his visit, the President is expected to engage with both potential investors and partners to advance efforts to re-establish Zambia as an investment destination of choice.

The Swakopmund International Trade Expo is an annual international event organized under the auspices of the Namibia Chamber of Commerce and Industry and attracts several investors.

This year’s Expo is being held under the theme: “Towards a Shared Economic Vision – Our Shared Destiny.”

Manwhile, the Rhoma Foreign Relations Institute says President HAKAINDE HICHILEMA’S four-day visit to Namibia is crucial for Zambia’s Economic Diplomacy crusade to secure trade and Investment opportunities.

Rhoma Foreign Relations Institute Executive Director LENGWE BWALYA says the visit will also cement Zambia’s long standing cordial and friendly relations with Namibia.
Mr. BWALYA says the institute hopes that the trip will consolidate the Balance of Trade in ZAMBIA’s favour.

He says the trip will also add political will to the development of the Walvis Bay Ndola Lubumbashi Development Corridor under whose auspices the private sector development and implementation of an oil products and natural gas pipeline project is being facilitated.

Church calls for reconciliation among politicians

The Clergy in Nakonde District in Muchinga Province have called for reconciliation and unity among political leaders.

Holy Ghost Embassy Nakonde Regional Pastor, Sydney Isaac stated that the country can only develop if its leaders are living in harmony.

Mr Isaac, who was speaking in an interview with the Zambia News and Information Services (ZANIS) in Nakonde today, said political stability plays an important role in enhancing good governance.

“For many years we have been talking about promoting national unity but we cannot promote national unity if there is nothing about dialogue and forgetting the past just like the Bible says two cannot walk together until they agree,” he said.

He implored authorities to shun away from using hate speech against their opponents stating that it hinders the effort to promote peace.

“How are we going to gather and seek the face of God whilst among us there are leaders, men and women that God has chosen to represent us, if we are not one,” he said.

Mr Isaac appealed to the general public to practice forgiveness if the development is to prosper in the country.

He added that leaders who fought the country need to be celebrated in order to honour the sacrifices they made to enable the growth of the country.

Mr Isaac pointed out that leaders should not dwell on the past but should instead focus on developmental projects.

“Each and every day we are hearing on radio and on Facebook that this political leader was talking about this political leader but by this time we need to understand that the most important thing is unity,” he said.

Meanwhile, Luangwa District Commissioner, Luke Chikani says government recognises the role played by the church in national development .

Mr Chikani said the church and government are partners in development as they both govern the same people.

The District Commissioner said this when Bishop Diamantino Guapo Antunes of Tete Diocese of the Catholic Church in Mozambique paid a courtesy call on him at his office in Luangwa district.

Mr Chikani further applauded the Catholic church for supplementing government efforts in providing services to the communities in the district.

He listed the health and education sectors as some of sectors the church that is contributing to the uplifting of the livelihood of the people in the district.

“The church and Government are partners in development and as Government we are happy with the contribution coming from the church which is contributing greatly to the uplifting the livelihoods of our people in various communities,” said Mr Chikani.

Mr Chikani also affirmed the good relations between the church and government.

And speaking through an interpreter , Bishop Diamantino Guapo Antunes has thanked the Zambian government for the unity existing between the catholic believers in the nearby Zumbo town in Mozambique and the parishes in Luangwa district.

Bishop Diamantino said Zumbo Catholic Church branch was manned by priests in Luangwa district since inception and will be declared a parish on Sunday, 16th October 2022, weaning it from Lusaka diocese .

“Zumbo Catholic Church has been upgraded to a full fledged church and we are going to have it weaned from Lusaka on Sunday October 16,2022,” said Bishop Diamantino.

The catholic Bishop was accompanied by Katondwe parish priest father, Mathews Tembo, and two other priests from Mozambique.

Mongu Council Signs MoU with ZNBS to construct housing units

The Mongu Municipal Council in partnership with the Zambia National Building Society (ZNBS) will embark on a developmental project to construct housing units in Kasima area in the district.

And to ensure this development comes into effect, the Mongu Municipal Council and the Zambia National Building Society have signed a Memorandum of Understanding (MoU).

Speaking during the signing ceremony held at his office yesterday, Mongu Town Clerk Mr Oliver Muuka was delighted that the project would bring about development and reduce the deficit of housing units in the district.

Mr Muuka stated that the approach and model by the Zambia National Building Society was ideal in that it would allow for planning in terms of construction of roads, power connection and water reticulation.

“From a developmental point of view, this approach where the Council is starting from of building housing units on a bare piece of land give the Council an opportunity to plan the land with proper provisions of service such as water ratification and all other things unlike what we are struggling with in the sense that some of the areas we are trying to develop them, thus approach is ideal,” he explained

The Town Clerk explained that the agreement would give a perfect chance for the district to grow and attain a city status, and the Local Authority is therefore encouraged to engage other institutions as this will help the Council as a planning Authority to have decent structures and townships.

“This will give a perfect chance to grow the town, as the town is expanding in the direction where the Council has identified the land where the housing units will be built, which means that the township will grow and be able to attain the status of a city, as growth is one of the requirements needed in order to attain the city status,” he said

“For the Council, these housing units apart from providing a service to the occupants, it is an addition to the assets of the Council, the housing units will also add to our revenue base, and it is also an opportunity for both local contractors and the local people to gain employment,” Mr Muuka added

Mr Muuka mentioned that from a housing deficit point of view, the Municipal Council has a serious deficit of houses, this will have a serious impact on the people that are supposed to work and deliver services to the district.

“Some of the people that work from here have left families elsewhere, because of the serious lack of accommodation, so this will give us an opportunity to have an increased slot of housing,” he disclosed

Meanwhile, Zambia National Building Society Board Chairperson, Mr David Nama noted that the Bank was excited to be part of the solution for infrastructure development in Western Province adding that shelter was a critical ingredient to sustainability in any individual.

“Because we know we have had these teachers and medical personnel that were recently employed, hence, I believe that this is the right time for us to begin to work as we have capable management that will carry on this fundamental and important act,” Mr Nama said

Mr Nama disclosed that Zambia National Building Society had requested for land in order to embark on a housing project in Mongu district, and the Council availed approximately 400m by 250m land in Kasima area.

“The land was availed at no cost because the Bank would meet all costs for servicing including construction of all-weather access roads to the development site,” Mr Nama said

And Zambia National Building Society Managing Director, Mildred Mutesa signed the MoU on behalf of the Bank and the Town Clerk signed on behalf of the Local Authority.

Later after signing, the team proceeded to site in Kasima area where the Council officially handed over the piece of land to the Zambia National Building Society.

PF to Commence Legal action against Electoral Commission of Zambia

The opposition Patriotic Front (PF) has said it is commencing appropriate legal action against Electoral Commission of Zambia (ECZ) for deciding to proceed with the by-elections in Kabushi and Kwacha constituencies on the Copperbelt Province without awaiting the outcome of the court processes.

PF acting Secretary General Nickson Chilangwa said the decision of the Electoral Commission of Zambia (ECZ) to proceed with the by-elections in Kabushi and Kwacha constituencies without awaiting the outcome of the court processes is an abrogation of the Constitution and contempt of court.

The Electoral of Zambia on Tuesday announced that the delayed controversial Kabushi and Kwacha parliamentary by-elections will take place on Friday, 21st October 2022.

This is despite the ongoing court case in which former Kabushi Member of Parliament Bowman Lusambo and former Kwacha Member of Parliament Joseph Malanji are seeking to re-contest their old parliamentary seats.

The ECZ stopped Mr. Lusambo and Mr. Malanji from re-contesting in the by-elections by refusing to get their nominations saying they caused the two by elections.

In a statement, Mr Chilangwa said in the legal action ECZ and its commissioners will be cited for contempt of court in their individual capacities.

He warned that the behaviour of ECZ is not only illegal but extremely reckless, irresponsible and is a recipe for serious public discordant.

“On 24th August, 2022 the Electoral Commission of Zambia (ECZ) issued a circular to the effect that those whose elections in Kabushi and Kwacha constituencies were nullified would not be allowed to contest the elections.Our candidates went and filed their nominations which were rejected by the returning officer and we proceeded to court. The elections were stayed by the High Court and the stay is still in force. Today ECZ has issued a statement that they will proceed with the elections in the two constituencies.We find the decision of the Electoral Commission of Zambia (ECZ) to proceed with the by-elections in Kabushi and Kwacha constituencies without first awaiting the outcome of the court processes, an abrogation of the Constitution and gross contempt of court.
This is the very behaviour by the ECZ that caused the current legal impasse that the country is experiencing over the Kabushi and Kwacha by-elections,” Mr. Chilangwa said.

“The behaviour of ECZ is not only illegal but extremely reckless and irresponsible and is a recipe for serious public discordant.It is now clear to the Zambian people that the ECZ has no desire whatsoever to allow the people of Kwacha and Kabushi to have a free and fair election and vote for candidates of their choice.ECZ and the public are fully aware that the issues of the by-elections in Kabushi and Kwacha are subject of active court processes to which the ECZ itself is part to. There are currently three court processes concerning the Kwacha and Kabushi by-elections;The High Court gave a specific order, ordering ECZ to stay the elections in Kwacha and Kabushi. The Court of Appeal ordered a stay of the delivery of the judgment of the High Court pending determination of the appeal filed by the Attorney General and the ECZ itself and there are proceedings in the Constitution Court on the interpretation of the 90 day period set by the Constitution concerning the period of holding of by-elections,” he said.

Mr. Chilangwa added:”ECZ and the public may wish to be reminded that the Court of Appeal has ruled, suspending the running of the days until it makes its ruling on the matter.Clearly ECZ is working on the instructions of the UPND to disenfranchise Hon Bowman Lusambo, Hon Joseph Malanji and the Patriotic Front from participating in the Kabushi and Kwacha by-elections. Zambians must brace themselves for a complete degeneration of Constitutionalislim and the total breakdown of the rule of law as the UPND gets more and more desperate to resuscitate its fading popularity.
We wish to inform our members and the nation at large, that the Patriotic Front has instructed its lawyers to commence appropriate legal action against ECZ including citing the ECZ commissioners for contempt of court in their individual capacities.”

Meanwhile, Zambia Must Prosper Party (ZMP) is shocked by the Electoral Commission of Zambia’s (ECZ) decision to set Friday 21st October, 2022 as the day of voting in the Kwacha and Kabushi constituencies by-election when there is an active high court order for stay and other legal challenges awaiting final determination.

ZMP Party Spokesperson Trymore Mwenda said the decision by the commission is disregard for the courts of law by the ECZ under the UPND government.

“Zambia Must Prosper Party (ZMP) is shocked by the Electoral Commission of Zambia’s (ECZ) decision to set Friday 21st October, 2022 as the day of voting in the Kwacha and Kabushi constituencies by-election when there is an active high court order for stay and other legal challenges awaiting final determination.This total disregard for the courts of law by the ECZ under the UPND government is worrying and a matter which should be stopped or the country’s hard fought democracy is headed for doom.The UPND government seems determined to turn this country into a banana republic as the latest breach by the ECZ is not the first but a series of systematic events clearly engineered at disadvantaging opponents,” Mr. Mwenda said.

He charged that the New Dawn government has captured ECZ.

“We have stated in the past and what ECZ is doing confirms the shrinking political freedoms of opposition political parties in this country since UPND assumed office.The UPND government and ECZ must know that this country belongs to all of us and that such arrogance can only be tolerated up to a certain point thus we urge them to do things for the greater good of the country.Zambians have not forgotten of an audio recording which went viral of two top UPND officials plotting to disadvantage a named opposition political party during the Kabwata parliamentary by-election.It is clear ECZ is captured and working under difficult circumstances so much so that it is literally fighting the judiciary a situation which is a threat to the country’s constitutional democracy.We urge the ECZ officials to free themselves from the hands of the UPND manipulators because posterity will judge them harshly as UPND will one day be out of government,” Mr. Mwenda said.

The two by-elections were initially scheduled to be held on 15th September 2022 but could not proceed due to a court ruling.

The Lusaka High Court on 13th September 2022 granted Mr. Lusambo and Mr. Malanji a stay for the by elections in Kabushi and Kwacha constituency not to proceed as planned on 15th September, 2022.

Four candidates filed their nomination in the Kabushi election while five candidates managed to file their nomination in Kwacha Constituency in August, 2022.

Meanwhile, the High Court had last month granted the prayer by former Kwacha PF Member of Parliament Joseph Malanji and his Kabushi counterpart Bowman Lusambo to suspend the by-elections in the two constituencies pending determination of the matter in which they have contested the Electoral Commission of Zambia’s decision to declare their nomination invalid.

Judges Mwape Bowa, Sharon Newa and Catherine Phiri ruled that though the High Court does not have the authority to make a determination on constitutional matters, Article 52(4) of the constitution gives it the power to handle challenges relating to nominations in an election.

The trio said proceeding with the by-elections would be of grave injustice to Mr. Malanji and Mr. Lusambo as there was a likelihood of disenfranchising the duo by the time their petition would be determined.

Earlier in September, the Constitution Court declared Bowman Lusambo and Joseph Malanji eligible to re-contest the Kabushi and Kwacha parliamentary by elections respectively.

Mr. Lusambo and Mr. Malanji had challenged in court the Electoral Commission of Zambia’s decision to reject their nomination to re-contest the Kabushi and Kwacha seat respectively.

Chambeshi Gutted by Mwepu Retirement

Zambia captain Enoch Mwepu’s former coach at senior and junior national teams – Beston Chambeshi is gutted to see the midfielder forced to end his football career by a hereditary heart condition.

Mwepu’s Premier League club Brighton on Monday announced the heart condition, which can worsen over time, would put the player at an extremely high risk of suffering a potentially fatal cardiac event, if he were to continue playing competitive football.

In an interview in Kitwe, Chambeshi said talented Mwepu will be missed.

The Nkana coach branded Mwepu as an asset to the nation.

Chambeshi has since asked Mwepu to accept his current health status.

“I received the message with sadness. When you look at the young man, he was one of the most talented players and for sure we needed him as a nation. I even failed to express myself when I heard about the news,” Chambeshi said.

Chambeshi named Mwepu as Chipolopolo’s captain for the first time in their 2-1 win over Mauritania in a FIFA World Cup qualifier in September, 2021.

“If you look at Mwepu, he was an asset to the nation. The boy is disciplined and had a bright future in football but this has come sudden which everyone cannot accept but there is nothing we can do. All I can say is to pray to God that the young man can accept the situation he is in,” he said.

“He was exceptional. He is a chap who can lead the team. When appointment him National Team captain I saw something in him. We will miss the young man,” Chambeshi said.

Chambeshi coached Mwepu when Zambia won the Under-20 Africa Cup on home soil in 2017.

Lt. Gen Sitali commends the existing military ties between the United States Army and the Zambia Army

The Zambia Army Commander Sitali Alibuzwi has commended the existing military ties between the United States Army and the Zambia Army.

Lieutenant General Sitali said the Zambia Army enjoys close cooperation and Partnership with the United States Army in various areas.

Lt. Gen Sitali was speaking in Washington DC where his attended the Association of the United States Army (AUSA) conference.

He explained that the Zambia Army stands ready to benefit best practices from the conference which is being held under the theme, “Building the Army of 2030”.

The Army Commander said the conference theme resonates well with the Zambia Army’s vision of having a professional, modern and versatile Army that meets the aspiration of the people of Zambia by the year 2025.

Earlier, Lt Gen. Alibuzwi was part of the delegates that attended the official opening of the AUSA conference with keynote address by the Secretary of Army Christine Wormuth.

Equally, President of the Association of American Army General Robert Brown addressed the conference which attracted 30,000 delegates and over 650 exhibitors.

The Zambia Army Commander is also expected to hold high level engagements with several key military leaders on the sidelines of the conference.

This is according to a statement on Tuesday Zambia Army Spokesperson Martin Liyungu.

Chieftainess Threatens to Sentence Subjects to Hard Labour for not sending Children to School

Chieftainess Chungu of yaba people in Lupososhi Town has urged parents and guardians in his chiefdom to ultilise government’s free education policy by taking their children to school.

Chieftainess Chungu observes that with the free education policy in place, no child should fail to go to school.

The traditional ruler in an interview on Tuesday observed that previously some parents and guardians gave an excuse of lacking funds as reasons for not taking their children to school but later married them off, a situation she said should be a thing of the past.

” lack of money will now not be a reason why a parent cannot send their child to school because education is free from grade one to 12,” Chieftainess Chungu said.

She has since encouraged parents to find other means of finding school requirements such as uniforms and books, saying what government has done means a lot.

” Here in rural areas people can still engage in farming activities so that they raise some money to buy some of the school requirements because school fee is what was the challenge for them,” she said.

Chieftainess Chungu has disclosed that she has come up with by laws in her chiefdom to prevent parents from marrying off their children at an early age and that the coming of the free education policy will strengthen her fight against child marriages.

According to the by-laws anyone found wanting is subjected to hard labour, locally called ‘Milima Chipuba’, the move she said has helped to fight child marriages in the chiefdom.

Meanwhile Rotina Mulenga a member of the community volunteers under the Non-governmental Gender Organization Coordinating Council ( NGOCC) revealed that her organisation has managed to retrieve 49 girls from early marriages, to date.

Mrs. Mulenga said out of those retrieved 20 have since managed to complete their grade 12 education.

” We are working closely with our Chieftainess in bringing back girls who have entered marriages and we are taking them back to school, already some of them that were retrieve have even completed their grade 12, “she said.

Mrs. Mulenga has since called for stakeholders to come on board and help to put up a dormitory at Chungu secondary school saying the move will help to keep girls from engaging in bad vices.

20 male Ethiopians apprehended in Choma for illegal entry

A joint team of Immigration and Police officers in Choma district have apprehended 20 male Ethiopian for illegal entry.

Department of Immigration Public Relations Officer Namati Nshinka says the illegal immigrants aged between 15 and 35 were apprehended around Monze-Chisekesi area on Saturday 8th October 2022 between 07:30 and 13:30 hours.

ZANIS reports that Mr. Nshinka explained in a statement on Tuesday that this was after they ( the P.Is ) failed to produce documentation legalizing their entry into the country.

“The Monze Immigration Office has apprehended Twenty (20) male Ethiopians aged between 15 and 35 for illegal entry.

“ They were apprehended by a Joint Team of Immigration and Police Officers around the Monze-Chisekesi Area on Saturday 8th October 2022 between 07:00 and 13:30 hours after they failed to produce documentation legalizing their entry into Zambia,” said the Department spokesperson.

The apprehended Ethiopians were nabbed after a tip off from members of the community.

Prior to being apprehended the named nationals were wondering about possibly waiting for transport for their onward journey.

Meanwhile, the department has also taken a 34-year-old Zambian Taxi Driver of Choma into custody to assist with investigations after it was established that he had connived with the illegal immigrants.

In a related development, the Department of Immigration on 9th October, 2022 removed 43 Ethiopians via Kenneth Kaunda International Airport after paying Court fines for illegal entry and unlawful stay.

The latest removals brings the total number of Ethiopians removed from various Correctional Facilities since 8th September, 2022 to 344.

So far the number of persons of different nationalities removed by the Department of Immigration between 7th and 10th October, 2022 stands at 117.

“During this period, the Department apprehended Sixty-Eight (68) persons for various immigration offences, secured Twenty-Four (24) convictions and refused Eighteen (18) Foreign Nationals entry into Zambia.”

Government reiterates its commitment towards children’s rights

The government has reiterated its commitment towards upholding the rights of children across the country.

Lusaka Province minister Sheal Mulyata says government will continue strengthening existing measures to address the challenges faced by children especially the girl child.

Ms. Mulyata states that government has made strides to address challenges faced by children such as the enactment of the child code bill into law.

Ms. Mulyata was speaking in a speech read on her behalf by Chongwe district commissioner Dr. Evans Lupiya during the international day of the of the girl child commemorations at Margaret Mwachiyeya Secondary school in Chongwe.

She said the enactment of the Child code bill demonstrates the importance government attaches to improve the welfare of children in the country.

Government acknowledges the challenges facing girls in the country such as lack of access to education and participation in decision making processes among others.

“The scourge of early marriages is another problem which had continued to negatively affect the lives of girls which in turn affects their future.

“ Government is working with traditional leaders in the fight against early marriages, ” said Ms. Mulyata.

She thanked all stakeholders that have been supplementing government’s efforts to curb early marriages among girls and improve their lives.

Meanwhile, World vision National Director John Hasse states that World Vision will continue supporting children in its areas of operation.

Mr. Hasse said the organisation is working with children in a number of schools under young journalist clubs to enable them to voice out their views on issues affecting them in society.

He urged all stakeholders in the country to make efforts to protect and promote the rights of children.

“Protecting and promoting children’s rights is everyone’s responsibility. Let’s all work together and improve the welfare of children in the country,” Mr Hasse said.

Speaking during the same event, Luyando Himwinga a Grade 11 pupil at Margaret Mwachiyeya Secondary School called on government and other stakeholders to create more platforms to enable them to participate in decision making processes affecting the girl child.

Himwinga commended government for enacting the Child Code Bill but however, called for the Act to be published in a simplified format and made available to school going children.

“We are grateful to the Government for enacting the Child Code Bill and we want this Bill to be distributed across the country, ” said Himwinga.

She further called for policies which will abolish cultural norms which prevent girls from voicing out their concerns and participating in decision making processes.

The International Day of a girl child commemoration punctuated by poems, dances , traditional music from pupils and live performance by Brian Bwembya aka B – flow was also attended by children from Muchinga, Central, North wetstern,Northern and Southern Province.

The renowned musician also took time to counsel the young people to make decisions that will impact on them positively when they grow up.

He said he is what he is today because of the positive decision he made when he was young.

“I want to urge you to make positive decisions about what you want to be in life when you grow up. Make decisions now on what you want to be in future,” said Bwembya..

HH hosts 13 GBV survivours at State House

President Hakainde Hichilema and first lady Mutinta Hichilema yesterday afternoon hosted a private luncheon for the thirteen gender-based violence ( GBV ) survivors who were accompanied to state house.

Others that accompanied the young women include immediate family members and members of a multi – sectoral team led by Minister of Heal Sylvia Masebo.

The President empathized with the survivours and has since tasked the Cabinet Office to constitute a high level, cross sectional committee on GBV as provided for in the Anti- gender based Act No.1 of 2011.

President Hichilema has also instructed the Cabinet Office to provide enhanced support to the Gender Division, in the development of a new 5 year national action plan on the prevention and response to Gender Based Violence.

Mr. Hichilema has further encouraged additional investment in mental health services to provide survivors with access to long term psychological care.

“Resources will be dedicated towards scaling up support services for survivors, particularly for those who are unable to return home” he said.

President Hichilema used the occasion to also thank all government and community members who played a role in securing the safety of the 13 women.

Why Destroy the Electoral Commission of Zambia Just to Fix Lusambo and Malanji?

The Electoral Commission of Zambia (ECZ) has announced that the Kabushi and Kwacha parliamentary by-elections will be held on 21 October 2022. The Commission has further stated that the campaign period in both constituencies will run from 11 to October. We find this move by the ECZ problematic for a number of reasons. And we ask the Commission to reconsider their decision.

First, following the earlier resignations of the two candidates in both Kabushi and Kwacha constituencies, which decisions were formally communicated to and acknowledged by the ECZ, it would be unconstitutional for the Commission to conduct elections in both constituencies without calling for fresh nominations. Article 52 (6) of the Constitution of Zambia provides that “Where a candidate dies, resigns or becomes disqualified in accordance with Article 70, 100 or 153 or a court disqualifies a candidate for corruption or malpractice, after the close of nominations and before the election date, the Electoral Commission shall cancel the election and require the filing of fresh nominations by eligible candidates and elections shall be held within thirty days of the filing of the fresh nominations”.
This is the only provision that deals with the resignations of successfully nominated candidates. In both Kabushi and Kwacha, we had a candidate who resigned and the ECZ acknowledged receipt of their resignations. Once a candidate has resigned, the law requires the Commission to cancel the existing nominations, call for fresh nominations by eligible candidates and hold a new election within 30 days of the date of the new nominations. Indeed, this is what the ECZ has previously done. When a candidate belonging to the opposition UPP who had successfully filed nomination papers for the Kabwata by-election resigned, ECZ immediately cancelled the election and called for fresh nominations. When Ms Charity Lumpa who had successfully filed nomination papers for Lusaka Central resigned as an independent candidate prior to the 12 August 2021 election, the ECZ cancelled the earlier nominations and called for fresh ones.

Why is the ECZ abrogating the law and changing the precedent it has set when it comes to Mr Bowman Lusambo and Mr Joseph Malanji? And can the ECZ cite any law that empowers the Commission to proceed to conduct elections if a candidate who had resigned changes their mind after the Commission has even acknowledged receipt of their resignation? What the ECZ has done this time is lawless. The law requires the Commission to cancel the nominations and call for fresh ones only. There is no law that provides for a nominated candidate who has resigned to rescind their decision after resigning. After receiving the resignations of the two candidates, what the ECZ should have done is to call for fresh nominations from all eligible candidates. Anyone interested, including those who had resigned, would be free to file their nominations, if they are eligible to stand for the election.

What those who had resigned cannot do is to pull back their resignations and crawl back into the race. Nix! It does not work that way. This is not a game. It is not chidunyu where one can do whatever they like without any regard to the laws of the land. The decisions of the ECZ should always be based on the or backed by law. The ECZ should stop this lawlessness and do the correct, legal thing. We know they are under extreme pressure from the UPND, but if the three commissioners who made the decision – Mr Ali Simwiinga, Ms Ndiyoyi Mutiti and Maj Gen Vincent Mukanda Rtd – cannot follow what the law provides for, let them resign before they set the country ablaze.

Second, it is blatant lawlessness and contempt of court for the ECZ to proceed to conduct elections in both Kabushi and Kwacha when there are active processes relating to the same issue that remain before our courts of law. When a matter is in court, parties to the case cannot do some self-help measures outside the court process to correct the premise of the original dispute. That is lawless. As things stand, the ECZ’s hands are tied. Proceeding to hold elections in Kabushi and Kwacha before the matters that are in court are disposed of would amount to interfering in the court processes or in the matters that are before court. It actually amounts to contempt of court.

In the High Court, there is a case between Mr Lusambo and Mr Malanji and the ECZ that is yet to be determined. The judgment for this case was ready but moments before it could be delivered, the UPND rushed to the Court of Appeal to stop the Lusaka High Court from delivering the judgement. Why? It is possibly because the UPND may have learnt that the verdict was likely going to be in the favour of Mr Lusambo and Mr Malanji. Rather than facing the humiliation of losing to PF lawyers including Tutwa Ngulube, the Attorney General and his team appear to have decided that they would rather have no elections in both Kabushi and kwacha and deprive the people in these constituencies of representation in Parliament than allow the courts to pass any verdict that would clear Mr Lusambo and Mr Malanji to stand in the by- elections. But should the institutional credibility of both ECZ and the Judiciary be destroyed this way just to punish two individuals?

There is also an active case involving Mr Peter Sinkamba and Mr Isaac Mwanza versus the ECZ in the Constitutional Court. In the wake of the resignations of those two candidates from Kabushi and Kwacha, Mr Sinkamba and Mr Mwanza asked the Constitutional Court to order the ECZ to cancel the earlier nominations for both constituencies, call for fresh ones and organise a fresh election within the stipulated timeframe, as per the earlier cited provision of the Constitution. The matter was heard and the Concourt was supposed to deliver judgement on Monday this week, 10 October. But when the matter came up for judgement, the Attorney General applied to be joined to the case on the ground that it borders on public interest. Again, here, like was the case in the matter before the High Court, the UPND may have learnt that the verdict was likely going to be in favour of the petitioners and consequently moved swiftly to file an application that prevented the ConCourt from delivering judgement. Again, we ask: why this desperation?

The reason why the UPND is running from one court to another seeking to delay the delivery of any judgment that may go against them is that any cancellation of the earlier nominations in Kabushi and Kwacha would provide the opportunity for Mr Lusambo and Mr Malanji to file their nominations, since, in the wake of the earlier ConCourt judgment on their matter, nothing now stops them from doing so if fresh nominations are called. What we see here is the abuse of the court process by those in power today, one that the judiciary itself is perpetuating. The matter between Mr Sinkamba and Mr Mwanza versus the ECZ was already argued. Why did the Concourt allow the State to join the matter at the 11th hour when the court was set to deliver judgement? Where was the State all along or when the matter was filed and argued?

We urge our judges to refuse to be abused in this way. Let all the judges in the judiciary know that the best way of securing their credibility and the credibility of the judiciary itself is by dispensing justice in a timely manner and in accordance with the law. It is not by taking sides that appease one political group or another, be it those in government or those in opposition. The UPND and their supporters are quick to condemn the ConCourt when it suits them and similarly are quick to abuse the same judges again when it suits them.

It is also becoming clear that the Attorney General is not defending public interest in the matter of Mr Lusambo and Mr Malanji. He and his team appear to be defending the interests of the UPND. They seem to have decided that they would rather have no elections in both Kabushi and kwacha than allow the courts to pass any verdict that would pave the way for Mr Lusambo and Mr Malanji to stand in the by-elections. The UPND knows that they do not stand a chance of winning Kwacha and Kabushi if Mr Lusambo and Mr Malanji are on the ballot, hence this desperation to exclude the two from the ballot. But should we destroy the institutional credibility of both ECZ and the Judiciary just to punish two individuals? Why not defeat them through the ballot if the UPND is as popular, as they claim in these two constituencies? Not even Mr Edgar Lungu and the PF were so afraid of defeat that they excluded their political opponents from the ballot. Let Mr Lusambo and Mr Malanji stand. Defeat them fairly and through the ballot.

We ask the ECZ to reverse the decision they have made and wait for the active court processes to be completed. Destroying the credibility of this important institution just to disqualify Mr Lusambo and Mr Malanji is akin to shooting down an Airbus A380 plane carrying 853 passengers just to kill 2 people! We repeat: if Mr Ali Simwiinga, Madam Ndiyoyi Mutiti and Maj Gen Vincent Mukanda Rtd cannot comply with the provisions of our Constitution, we demand that they resign from their posts instead of setting the country on fire. No elections should be held in Kabushi and Kwacha without fresh nominations.

We also ask the UPND to stop abusing the ECZ and the justice system all in an attempt to block Mr Lusambo and Mr Malanji from standing. Yes, there are loopholes in our electoral laws but until the relevant law is changed, Mr Lusambo and Mr Malanji have the right to benefit from those loopholes. It is not the job of the UPND to determine who should lead our people. The job of the party in power is to deliver what they promised people when they were in opposition and hope that voters will reward them at the ballot. Mr Hakainde Hichilema and your UPND, muletutwala kwisa? Please stop destroying the credibility of our institutions. You were elected to rebuild, not worsen, the standing of ECZ and the judiciary in the eyes of the public.

Finally, we ask Mr Hichilema to appoint the substantiative leadership at ECZ so that they can in turn appoint the new CEO, as per the law. It is not healthy to our democracy and the strength of our formal institutions to leave such vital institution like ECZ being run by people on an acting basis. This leaves room for the manipulation of the ECZ that we continue to witness.

ECZ to go ahead with Kabushi and Kwacha parliamentary By Elections despite ongoing Court Cases

The Electoral of Zambia has announced that the delayed controversial Kabushi and Kwacha parliamentary by-elections on the Copperbelt Province will take place on Friday, 21st October 2022.

This is despite the ongoing court case in which former Kabushi Member of Parliament Bowman Lusambo and former Kwacha Member of Parliament Joseph Malanji are seeking to re-contest their old parliamentary seats.

The ECZ stopped Mr. Lusambo and Mr. Malanji from re-contesting the by-elections by refusing to get their nominations.

The two by-elections were initially scheduled to be held on 15th September 2022 but could not proceed due to a court ruling.

The Lusaka High Court on 13th September 2022 granted Mr. Lusambo and Mr. Malanji a stay for the by elections in Kabushi and Kwacha constituency not to proceed as planned on 15th September, 2022.

In a statement issued late on Tuesday afternoon, ECZ commissioners stated that the campaign period commences today and will go on until 21st October, 2022.

The ECZ statement did not touch on the pending court case regarding the disqualification of Mr. Lusambo and Mr. Malanji from the two by-elections.

ECZ commissioners, Ambassador Ali Simwinga, retired Major General Vincent Mukanda and Ambassador Ndiyoi Mutiti in a joint statement said the decision follows a meeting held to decide the Commission’s position on the two parliamentary by-elections.

“As the public may be aware, the by-elections for Kabushi and Kwacha Constituencies were scheduled to take place on 15th September 2022.However, the Commission could not proceed to conduct the by-elections following the High Court ruling delivered on 13th September 2022,staying/suspending the election for the two constituencies. Members of the public may also recall that two independent candidates had resigned from their candidature and that the said candidates have since rescinded their resignations,” the joint statement said.

The Commissioners said they were aware that the Constitution gives 90 days in which to conduct a by-election.

“In view of that, the Commission at a Commission meeting resolved that the poll date for the by-elections for Kabushi and Kwacha Constituencies shall be on Friday 21st October 2022. The polls will take place from 06:00 hours to 18:00 hours,” the statements said.

Four candidates filed their nomination in the Kabushi election while five candidates managed to file their nomination in Kwacha Constituency in August, 2022.

Meanwhile, the High Court had last month granted the prayer by former Kwacha PF Member of Parliament Joseph Malanji and his Kabushi counterpart Bowman Lusambo to suspend the by-elections in the two constituencies pending determination of the matter in which they have contested the Electoral Commission of Zambia’s decision to declare their nomination invalid.

Judges Mwape Bowa, Sharon Newa and Catherine Phiri ruled that though the High Court does not have the authority to make a determination on constitutional matters, Article 52(4) of the constitution gives it the power to handle challenges relating to nominations in an election.

The trio said proceeding with the by-elections would be of grave injustice to Mr. Malanji and Mr. Lusambo as there was a likelihood of disenfranchising the duo by the time their petition would be determined.

Earlier in September, the Constitution Court declared Bowman Lusambo and Joseph Malanji eligible to re-contest the Kabushi and Kwacha parliamentary by elections respectively.

Mr. Lusambo and Mr. Malanji had challenged in court the Electoral Commission of Zambia’s decision to reject their nomination to re-contest the Kabushi and Kwacha seat respectively.
