Holstar surprises fans with the release of his latest Rock inspired EP ‘Nkani Za Mutima’

Duncan Sodala professionally known as Holstar surprises fans with the release of his latest Rock inspired EP ‘Nkani Za Mutima’ which means ‘Affairs of the heart” in Vernacular. It is slated for release on all streaming platforms on 26 August 2022.

His EP is short and leaves you with a yearning for more, it has a poetic vibe and makes one remember the first time they fell in love, that all satisfying feeling. It features only three tracks – Number 1, Sunga Mutima featuring Rosah and Whole Time.

Nkani Za Mutima is Entirely produced by Copperbelt based producer John J-hun Zgambo and is Engineered by Church Ulukuta, Uncle Ticky and Paul Makes Magic.

When asked about the EP and what inspired it, Holstar said “Nkani Za Mutima” was inspired by my love for Zamrock and wanting to express myself in a different way than people are used to.”

Over time Holstar has won numerous accolades including the Best East African Rapper award nominated by Creative-Hiphop.com in 2021.

Children living with Autism, have unlimited potential – Mutinta

First Lady Mutinta Hichilema says children living with Autism, just like any other child, have unlimited potential that must be fully developed and allowed to blossom.

Mrs. Hichilema noted that children living with autism need specialized developmental healing and nurturing techniques, specifically structures designed to lessen their physical limitations in order to make it easier for them to perform regular daily functions as well as fully utilize their abilities.

Mrs. Hichilema was speaking in Kabwe district during the ground breaking ceremony for the Caleb Centre for children living with autism.

The First Lady arrived in Kabwe to officiate at the ground breaking ceremony for the construction of a centre in Luasanse ward for children living with Autism.

 Provincial Permanent Secretary, Milner Mwanakampwe led other government and UPND officials to welcome  Mrs  Hichilema  ahead of her official engagements.

Autism spectrum disorder (ASD) is a developmental disability caused by differences in the brain. Some people with ASD have a known difference, such as a genetic condition.

Other causes are not yet known. Scientists believe there are multiple causes of ASD that act together to change the most common ways people develop.

People still have much to learn about these causes and how they impact people with ASD.

People with ASD may behave, communicate, interact, and learn in ways that are different from most other people.

There is often nothing about how they look that sets them apart from other people.

The abilities of people with ASD can vary significantly. For example, some people with ASD may have advanced conversation skills whereas others may be nonverbal.

Some people with ASD need a lot of help in their daily lives; others can work and live with little to no support.

 

Three Children die after unknown gadget they were playing with exploded

Three children of Kasasa village in Mpulungu district have died in unclear circumstances while two adults are nursing serious injuries in hospital.

The three children aged nine, five and two years old met their fate while playing with an unknown gadget which exploded killing them instantly and injuring the other two persons.

Northern Province Minister Leonard Mbao, who rushed to the scene and later visited the victims at the hospital, confirmed the incident to ZANIS which happened yesterday.

Mr. Mbao, who is also Mpulungu area Member of Parliament, described the incident as regrettable.

He said investigations to establish the cause of the explosion have been instituted.

And Mpulungu District Commissioner, Geard Sikazwe, who accompanied the minister, identified the deceased as Promise Simusokwe aged two, Philip Simbeye aged nine and five year old Richard Sinkala.

Mr. Sikazwe also named the casualties as Everlyn Nachilima aged 44 and Ronald Simutowe aged 24 years, a census enumerator who was on duty.

Meanwhile, Laban Musonda, a nurse who was found attending to the victims, informed the minister that the two sustained multiple fractures but are in a stable condition.

Government has put in place fundamentals to revive the Zambia’s economy-Matambo

Copperbelt Province Minister, Elisha Matambo has said that the government has put in place several macroeconomic fundamentals to revive the country’s economy.

Mr Matambo said the new administration has put in place a tax administration system that has given a positive investment signal that Zambia is ready for business in the mining sector.

Mr Matambo said this when Bank of Zambia Governor, Denny Kalyalya called on him at his office in Ndola yesterday.

He stated that strides have also been made to revive the economy of the Copperbelt stating that government is working with various stakeholders to revamp the industrial area in Ndola to create more jobs for the local people.

Mr Matambo said despite some industries not being operational, Copperbelt remains the engine of the country’s economy.

He commended Dr. Kalyalya and his team for ensuring that government’s agenda to revive the economy is attained.

Mr. Matambo cited the single digit inflation rate attainment, stability of the Kwacha and the friendly business environment as key macro-economic indicators currently prevailing.

And Dr. Kalyalya said he is pleased to note that a lot of economic activities are happening on the Copperbelt.

Dr. Kalyalya said an increase in economic activities is an indication of economic growth.

He is accompanied to the Copperbelt by his deputy operations, Francis Chipimo.

Zambia expects to raise US$92 million from tobacco sales

Zambia expects to increase its tobacco harvest by a quarter and generate $92 million from leaf sales at the close of the marketing season in September.

By August 12 2022, the country’s tobacco growers had sold 35 million kg of leaf through the approval sales floors against projected sales of 33 million kg.

Flue-cured Virginia accounted for 27 million kg and burley represented 6 million kg of the leaf sales.

Agriculture Minister Reuben Mtolo Phiri told the International Tobacco Growers Association’s Africa Congress in Lusaka that the sector had performed well during the season despite various headwinds coupled with low investment.

He said the government is committed to creating an investment-friendly environment.

“The government is now in the process of enacting a new legal framework for the industry that will bring about effective regulation and foresee improved private stakeholder participation across the tobacco value chain,” said Mr Phiri.

Zambia’s eighth national development plan emphasizes crop diversification and increasing profitability among all actors within the value chain.

Constitutional Court sets September 9 as day for hearing Bowman Lusambo and Joseph Malanji case

The Constitutional Court has dismissed the urgent application by former Patriotic Front(PF) Kabushi Member of Parliament Bowman Lusambo and his former Kwacha counterpart Joseph Malanji to stay the nominations ahead of the by-elections in the two constituencies.

Judge Palan Mulonda has anchored his ruling on the premise that there is no prejudice that Mr. Lusambo and Mr. Malanji would suffer if the nominations are not stopped.

Judge Mulonda has set September 09, 2022, for hearing the substantive matter where Mr. Lusambo and Mr. Malanji have contested the decision of the Electoral Commission of Zambia (ECZ) to bar them from filing their nominations.

The two are being represented by Lusaka Lawyer Tutwa Ngulube Of Tutwa Ngulube and Company.

Solicitor General Marshall Muchende and other lawyers from the Attorney General’s Chamber are representing the state while the ECZ is being represented by its in-house lawyers.

The ECZ has cited article 72 sub-article four of Zambia’s Constitution as the ground for its decision not to accept Mr. Lusambo And Mr. Malanji’s nomination papers.

The provision states that a candidate who causes a by-election is not eligible to re-contest.

Meanwhile, Four candidates have successfully filled in their nominations as the UNIP candidate fell off for late arrival ahead of the Kabushi Parliamentary by-election in Ndola on the Copperbelt scheduled for 15th September 2022.

The Kabushi Seat fell vacant after the Constitutional Court upheld the High Court’s decision to nullify the election of Patriotic Front (PF”s) Bowman Lusambo over violence and bribery.

The successful candidates who presented their credentials before Kabushi Constituency returning officer Elias Mwalaba were Osius Telela of the Leadership Movement, UPND’s Bernard Kanengo, Richard Kalasa an independent candidate and Alfred Yombwe another independent candidate.

Mr. Lusambo saw his nomination rejected after it was declared invalid by Returning Officer Elias Mwalaba around 12:00 hours.

Mr. Mwalaba declared the nomination centre located at Lubuto Secondary School closed at 15:00 hours.

Earlier, the returning officer advised the successful candidates to adhere to the electoral code of conduct as they campaign in Kabushi.

Mr. Mwalaba cautioned candidates and their political parties to stick to the ECZ campaign time table ahead of the Kabushi Parliamentary by election.

He warned candidates against violence, intimidation and other electoral maul practices.

Meanwhile, UNIP candidate Kebby Kaseba failed to file his nomination in Kabushi Constituency after arriving late at the nomination centre.

Mr. Kaseba arrived at the nomination 40 minutes after it was officially closed.

He tried to plead with the returning officer saying he went to the bank to withdraw nomination fees after the party failed to adequately financially support him.

“Unfortunately, we had a lapse on finances. I was at the bank trying to draw some money so that I can balance hence my coming here late. I am sorry that I have delayed in coming. Under your jurisdiction if you can kindly consider my humble request that I file in my nomination,” Mr. Kaseba told the Returning Officer.

But Mr. Mwalaba vowed not to bend saying it was illegal to accept Mr. Kaseba nominations when he was late.

“Really, you have apologized and we have sympathized with you but the law cannot be one sided. We had a candidate here and we quoted the law, we invalidated the nomination. We are not going to be fair if we are going to go against the law and allow you inside because the law says if we close, we close. I think we ask you to bear with us in all fairness. Thank you so much,’ Mr. Mwalaba said.

Mr. Kaseba was seen leaving Lubuto Secondary School as one police officer escorted him out.The Kabushi nominations were peaceful as scores of police officers were deployed to preserve peace, law and order.

Over 30 uniformed police officers were deployed inside and outside the nomination center.

One year of United Party for National Development government: Is Bally fixing it?

After Zambia held tripartite polls in August 2021, the country ushered in a new government led by President Hakainde Hichilema dubbed the new dawn administration .ending ten years of inept Patriotic Front rule that had left the country debt ridden, bankrupt, lawless and polarized.

As a result, the United Party for National Development inherited a country gripped by serious economic challenges which had led to our people going through severe hardships. The economic problems have been excecated by the effects of Corona Virus induced shut downs which limited economic activity. The war in Ukraine has further caused economic upheaval as pries of fuel and food have soared owing to supply chain constraints resulting from the conflict.

Against this back drop, the new administration has managed to control inflation, reduce and stabilize the Kwacha exchange rate against major convertible currencies, decentralized resource allocation through enhanced CDF, created employment in education and heath, among others. Additionally, increased Foreign Direct Investment due to restored investor confidence has seen FQM investing over US$1.2 billion in existing mining projects as well as a US$250 million investment in setting up the biggest Nickel mine in Africa.

Other notable succusses of the past one year include, but are not limited to, making the Zambian kwacha the world’s second-best performing currency and Africa’s 6th most powerful currency

The country has also led the way in restructuring the developing world’s humongous indebtedness to China. Over the last few months China has co-chaired Zambia’s debt committee with France, bringing the Asian giant to the common debt management framework for the first time. .

On August 22, China announced debt forgiveness for 16 African countries without giving details. Zambia having been the restructuring trail blazer is no doubt a major beneficiary.

However, the cost of living crisis is overshadowing most of these advances, the major reason being there has been little, if any, tickle down effect felt by the populace . Prices of basic commodities among them mealie meal, sugar, transport, shelter remain high and mostly unaffordable as poverty levels show no significant signs of abetting. Social protection, though, has, to some extent, been streamlined to benefit the most vulnerable.

The scarcity of money, though an essential quality of any serious currency, has hit hard. Government in it’s quest to pay only genuine suppliers of goods and services through a prolonged audit and verification process has, in effect, bankrupted many businesses, particularly small and medium sized suppliers ones. . While the problem of ‘air suppliers’ was real and pandemic level rampant under the PF, after a year the chaff should have been judiciously separated from the wheat. This is a major system failure as it has negatively effected the health sector, for instance, where supplier mistrust is causing erratic availability of drugs in health institutions.

Macro economic stability has been further enhanced by the enacting of the Bank of Zambia Amendment Act no 15 of 2022, that, among other things, secures the tenue of the Governor and the two deputies, positions prone to political manipulation as evidenced in the recent past.

In the area of law reform, strides have been made to repeal and amend the archaic Public Order Act though citizens continue to be held in remand without sight of trial as laws, mostly unfairly and maliciously enacted, continue to be used punitively against suspects who may or may not be guilty. Generally, though, accused persons are not being detained unnecessarily and trek to court from the comfort of their homes. This is a great improvement though more can be done to in terms of wide accessibility across suspects’ social economic status.

Many beneficiaries of these normalized bail and bond conditions are suspects of economic crimes known in common parlance as plunderers of national resources, who are as varied as they are numerous. The corruption fight which has suffered significant set backs in the past seems to have picked up momentum after the appointment and ratification of new board and Director General, though we are yet to see successful prosecutions subsequent to the much heralded arrests.

On the political front, alliance partner Kelvin Bwalya Fube (KBF) has formed his own party. Its impact, if any, is yet to be seen, suffice to say KBF campaigned extensively and quite effectively for HH, featuring on radio stations countrywide with very compelling pro Bally arguments. Should this ‘defection’ be a cause for concern? The jury is still out.

In mining, the impasse at Konkola Copper Mines continues raising doubts of the veracity of achieving the lofty 3 million tons of annual copper production target Revelations of the callous extravagance of the former provisional liquidator have not helped matters. Additionally, it is yet to be seen if tax breaks gifted to mining companies in the current budget have yielded the desired investment levels leading to higher production and resultant future taxes.

On a more positive note, planned value addition of Congolese and Zambian minerals through robust manufacturing before export has been roundly welcome as long overdue.

The notoriously volatile fuel prices have made the transport sector unpredictable, the multiplier effect being that prices of goods continue to fluctuate against the flow of reduced inflation.

Even though major policy pronouncements meant to increase efficiency such as giving inputs directly to farmers rather than cooperatives have been made, the agriculture input supply chain appears to have been severely disrupted to an extent that as August comes to an end there is no clear indication as to when inputs will be in the country or where they are coming from. This is, surely, a cause for serious concern for future national food security.

All in all, the administration has fared well under difficult circumstances. The upcoming by elections in Kabushi and Kwacha , nonetheless, will be important litmus tests as to whether urban domiciled Zambians are willing to give more opportunity to the UPND and Bally to fix what was almost irreparably broken or vote in protest against the high cost of living, equally astronomical unemployment and stratospheric poverty..

One year into transition, it would be unfortunate if what was being commemorated was the departure of the Patriotic Front rather than a celebration of the arrival of the United Party for National Development.

Hichilema is Following the Corrupt Path of Rhodes, Oppenheimer

We have consistently and repeatedly talked about President Hakainde Hichilema as a continuation of the businessmen and politicians who colonised, exploited, brutalised and dehumanised us for decades. His admiration for Cecil Rhodes and the Oppenheimers has inspired him to follow their corrupt path of combining business with political leadership at the highest possible levels. Cecil John Rhodes was a British mining magnate and politician in southern Africa who served as Prime Minister of the Cape Colony from 1890 to 1896.

Like Mr Hichilema, who is the 7th President of the Republic of Zambia, Rhodes was the 7th Prime Minister of the Cape Colony, and was in office from July 17, 1890, until January 12, 1896. An ardent believer in British imperialism, Rhodes and his British South Africa Company colonised the southern African territory of Rhodesia (now Zimbabwe and Zambia), which the company named after him in 1895. The son of a vicar, Rhodes was born at Netteswell House, Bishop’s Stortford, Hertfordshire. As a sickly child, he was sent to South Africa by his family when he was 17 years old in the hope that the climate might improve his health. He entered the diamond trade at Kimberley in 1871 when he was 18, and, thanks to funding from Rothschild & Co, began to systematically buy out and consolidate diamond mines. Over the next two decades, he gained near-complete domination of the world diamond market, forming a massive monopoly. His diamond company, De Beers, formed in 1888, still retains its prominence into the 21st century under Anglo and the Oppenheimers.

Rhodes entered the Cape Parliament at the age of 27 in 1881, and in 1890, he became Prime Minister. During his time as Prime Minister, Rhodes used his political power to expropriate land from black Africans through the Glen Grey Act, while also tripling the wealth requirement for voting under the Franchise and Ballot Act, effectively barring black people from taking part in elections. After overseeing the formation of Rhodesia during the early 1890s, he was forced to resign in 1896 after the disastrous Jameson Raid, an unauthorised attack on Paul Kruger’s South African Republic (or Transvaal). Kruger was Rhodes’s main business competitor.

Rhodes’s career never recovered; his heart was weak, and after years of poor health he died in 1902. He was buried in what is now Zimbabwe – his grave has been a controversial site.

Rhodes’s racial views are a subject of scrutiny and debate. He believed the natives of the Cape to have existed in a state of barbarism.

Sir Ernest Oppenheimer, (born May 22, 1880, Friedberg, Hesse-Nassau, Germany – died November 25, 1957, Johannesburg, South Africa) was an industrialist, financier, and one of the most successful leaders in the mining industry in South Africa and Rhodesia.

Oppenheimer became a junior clerk at the age of 16 with Dunkelsbuhler & Company, London diamond brokers. In 1902 he moved to Kimberley, South Africa, where he served as a Dunkelsbuhler’s representative. In 1917, with considerable backing from the financier J.P. Morgan, he formed the Anglo American Corporation of South Africa Ltd, to exploit the east Witwatersrand goldfield. Two years later he formed Consolidated Diamond Mines of South West Africa Ltd (reformed as the Namdeb Diamond Corporation in 1994). This diamond-prospecting corporation was so successful that he gained control of De Beers Consolidated Mines, which once dominated the world diamond market, and in 1930 he established The Diamond Corporation Ltd.

In 1929, Oppenheimer formed the Rhodesian Anglo American Corporation to exploit the rich copper deposits in Northern Rhodesia. His last project was the pioneering of new goldfields in the Orange Free State, South Africa. Oppenheimer served as mayor of Kimberley from 1912 to 1915 and was a member of the Union of South Africa Parliament from 1924 to 1938. Oppenheimer used his positions as mayor and member of parliament to expand and consolidate his business empire. He was involved in a number of controversies; including price fixing, antitrust behaviour, and an allegation of failing to release industrial diamonds for the United States war effort during World War II.

Mr Hichilema, in a new time and new way, is following in the footsteps of Rhodes and Oppenheimer by using his political position of President of the Republic of Zambia to expand and consolidate his business empire. But we all know that using political office to advance personal or associates’ business interests amounts to grand corruption.

Following this path of businessman/politician, Mr Hichilema may turn out to be the most corrupt President of our country. It is not a secret that Mr Hichilema’s businesses, like those of Rhodes and Oppenheimer, are doing business with the government he controls and directs. This is a very primitive, crude form of insider dealings. Mr Hichilema is without shame or restraint directing government business to businesses he is associated with or is in one way or another gaining a benefit from.

Today, civil servants are in a very serious and painful debt trap that is benefiting their political leaders, who are connected to Bayport and other companies that are mercilessly exploiting them. And because of this, attempts at debt swaps to bail out civil servants have been frustrated or reversed. Today, civil servants are forced into medical insurance schemes with Madison, whose books they are acquiring. There is no doubt that the key leadership of this government is also associated with companies getting government tenders to supply fertilisers.

They are really following in the footsteps of Rhodes and Oppenheimer, who ruled and did business with the governments they controlled and directed. But whereas Rhodes and Oppenheimer got away with it, Mr Hichilema and his league will find it very difficult to do so, no matter what schemes of concealment of business interests they deploy. Times have changed. The Zambian people will certainly demand the highest levels of transparency and accountability of Mr Hichilema’s business dealings.

Councils embarks on projects in Lusaka and Chisamba

The Councils in Lusaka and Chisamba have embarked on different ventures that will bring about sanity and development in the two districts.

The Lusaka City Council has embarked on a plan to remove unauthorized food and alcohol stands mounted in the Central Business District (CBD) in a quest to improve food hygiene and sanity, while the Chisamba Town Council (CTC) has successfully surveyed points in which it will set up drainages and create roads and install culverts throughout Chisamba District Wards in an effort to link the district to other areas and open up opportunities for the local people.

Lusaka City Council Public Relations Manager Chola Mwamba cited in a statement issued that the action to remove food and alcohol vendors from the CBD is aimed at maintaining sanitation in the city.

Ms Mwamba stated that the Local Authority will not entertain vendors that have mounted cooking and alcohol stands on the island of Cairo Road and Filter Lanes of Lumumba Road because the practice is not only unhygienic but also a nuisance.

“This means that any act, omission, or thing which is, or may be offensive, dangerous to life, or injurious to health is contrary to The Public Health Act Cap 295 Section 67, the Food safety Act No. 7 of 2019, The Liquor Licensing Act No. 20 of 2011 and the Statutory Instrument No. 12 of 2018 (The Local Government (Street Vending and Nuisances) (Amendment) (No. 2) Regulations, 2018),” she explained

She added that other than the pollution that cooking stands come with, they can also cause fire accidents to the nearby infrastructures and can cause injuries to pedestrians.

Ms Mwamba said that in line with this, the Council has since heightened its inspections of food outlets in the CBD and will extend the exercise to other areas in the city where illegal catering services are being offered.

“The Local Authority had already warned the people engaging in illegal cooking and illicit sale of alcohol on the streets,” she said

Ms Mwamba said that those operating such businesses have since been guided that the operation shall lead to seizure of articles, removal of all stands and makeshift structures that have been built within the CBD as they are considered to be a Public Health Hazard.

Meanwhile, Chisamba Town Council Public Relations Officer Nakubiana Shabongo cited in a statement issued that the Council is eager to develop a good road network for the people of Chisamba District as it will have many positive effects such as stimulating development and commercial activities as the roads will link farmers to buyers and reduce both the cost of doing business and time of travel.

“The survey was conducted in line with the feedback from the Civic Leaders who gave guidance on the priority areas to be tackled,” Ms Shabongo said

Ms Shabongo added that the Chisamba Council recently procured a Tractor Backhoe Loader (TLB) amounting to an estimated K1.2 million to facilitate a good road network in the district and it will also be used for farming purposes by the Local Authority.

“We are likely to start works by next week, this is because the supplier of the TLB is currently training our staff that will be handling the machine and once this is done, we will finalise all the logistics,” she said

She noted that the grading and graveling of roads across the district will be conducted by the works department of the Chisamba Town Council, therefore a good road network remains vital in linking businesses thus alleviating poverty.

Ms Shabongo cited that connectivity remains important and will ease access to so many opportunities for the people of Chisamba District and as the Local Authority, priority has been given to having a good road network and water supply which has been a challenge to the people within this locality.

Ms Shabongo has appealed to the public to desist from the habit of dumping rubbish in the drainage systems as this brings about drainages being clogged which causes areas and roads to be waterlogged.

“Drainages collect, transport and dispose off water through an outlet, which might get blocked because of littering in drainages,” she said

Ms Shabongo cited that the project is very significant as it will change the face of the district as it is aimed at opening up and linking the district to many opportunities.

ECZ Rejects nomination of PF candidate Bowman Lusambo

The Electoral Commission of Zambia (ECZ) has rejected the nomination papers for former Kabushi Member of Parliament Bowman Lusambo on the basis that he does not qualify to recontest the Kabushi seat that was nullified by the Constitutional Court citing to Article 72 (4) of the Constitution of Zambia Amendment Act No. 2 of 2016.

The ECZ Officials at the nomination center for Kabushi Constituency informed Mr Lusambo that his nomination is invalid and any questions henceforth should be addressed to the Courts of Law.

The officials further urged Mr Lusambo to desist from causing any form of violence outside the nomination center premises.

Speaking after his rejected nomination, Mr Lusambo who’s commonly known as the Bulldozer stated that the game is till on until his face is found on the ballot paper, because the ECZ is not the final institution to make a final decision as there are institutions in the country such as the Courts of Law.

“There will be no election in Kabushi Constituency without his face “Bowman the Bulldozer” appearing on the ballot paper and God is his witness,” he mentioned

“We have just come from the Courts and the Court did not disqualify anyone,” Mr Lusambo stated

Mr Lusambo added that despite today being the last day to file nominations, he is confident that everything will be fine as the anointing of God is upon him.

“I will come back, we are ready for them, and am inviting that person whose fearing me so much, he knows himself let him come and stand in Kabushi,” he said

Yesterday the Electoral Commission of Zambia Corporate Affairs Manager Patricia Luhanga issued a statement stating the Commission’s position on the eligibility of candidates whose elections were nullified by the Constitutional Court and thereby causing vacancies in the National Assembly.

Ms Luhanga noted that the Commission’s stance was in accordance with the nominations currently taking place today Thursday the 25th of August, 2022.

Ms Luhanga cited that the Commission in line with Article 72 (4) of the Constitution of Zambia Amendment Act No. 2 of 2016 will therefore, not accept nominations from any candidates who caused a vacancy in the National Assembly.

“Article 72 (4) of the Constitution of Zambia Amendment Act No. 2 of 2016 states that (2) The office of a Member of Parliament becomes vacant if member; (h) is disqualified as a result of a decision of the Constitutional Court; (4) A person who causes a vacancy in the National Assembly due to the reasons specified under clause (a), (b), c, d, g, and h shall not, during the term of that Parliament (a) be eligible to contest an election,” she cited

She added that Electoral stakeholders should take note that the above position relates to the National Assembly elections and not the Local Government elections.

Ms Luhanga said that the Commission is urging stakeholders to acquaint themselves with the two recent judgments and the Constitutional Provisions on eligibility of candidates who caused a nullification or a vacancy in the National Assembly.

Meanwhile, the Law Association of Zambia President Lungisani Zulu said that the with the ongoing debate surrounding the eligibility of former Kabushi Member of Parliament Mr Lusambo and the former Kwacha Member of Parliament Mr Malanji to re-contest their seats that were nullified by the Constitutional Court last month, the Association has felt statutorily bound to offer its understanding of the law.

Mr Zulu stated that eligibility to stand as a Member of Parliament is provided for under the Constitution of Zambia and adherence to the provisions of the Constitution affects the rule of law and it is for this reason and in light of the extended public interest that the Association has felt compelled to explain the law.

Mr Zulu explained that regarding eligibility following nullification of election as determined by the Constitutional court in the matter of Lusambo vs Kanengo and Anor (CCZ/A 19 of 2021) [20221 ZMCC 13 (28 July 2022), the question of whether a person can re-contest is dependent on whether the courts not only nullify the seat but also disqualify a person in such a petition.

Furthermore, according to the Constitutional Court decision in The Law Association of Zambia vs The Attorney General 2021/CCZ/0051, where this issue was addressed, the Court stated that a nullification of a seat by the court is distinct and not the same thing as disqualification of a person.

“Our perusal of the decision in the Lusambo vs Kanengo case reveals that the court merely nullified the seat without disqualifying Mr Lusambo in the election petition,” he said

He added that LAZ has also noted the observations of the Constitutional Court in the Lusambo vs Kanengo case on the gaps or lacunae in the Constitutional provisions relating to Members of Parliament and re-echoes the call for Constitutional reforms to urgently address these to enhance their clarity.

Mr Zulu mentioned that as far as eligibility following nullification on the basis that one does not possess a grade 12 certificate as determined by the Constitutional Court in the matter of Joseph Malanji vs Charles Abel Mulenga and Electoral Commission of Zambia 2021/CCZ/A0021, the question of whether Mr Malanji can recontest is dependent on whether he possesses the minimum qualifications set in the Constitution at the time of nominations.

“Mr Malanji’s eligibility will therefore depend on whether he will adduce evidence that he possesses a Grade 12 certificate at the time of filing in of nominations,” he mentioned

Public Protector embarks on decentralization process

The Office of the Public Protector in Zambia has embarked on decentralizing the services of the institution, in all the ten provinces in Zambia.

Public Protector Zambia Chief Investigations Officer, Bwalya Siulanda says the institution saw it prudent to establish their presence in all provincial centres, in a bid to create awareness of all their services.

Speaking when she paid a courtesy call on Muchinga Province Permanent Secretary Henry Mukungule, Ms. Siulanda charged that the decentralisation of the institution’s services to the districts, will guarantee effective service deliverywhich is responsive to the needs of the people.

She stated that the institution is working with the government in ensuring that there is fairness in how public officials deliver their services, adding that the presence of the Public Protectorwill create a better platform for public officials to air their grievances with a high possibility of effective redress.

“We are going to have an engagement with public officials to sensitize them on the core functions of the Public Protector in Zambia”, she said.

Muchinga Province Permanent Secretary Henry Mukungule, has welcomed the move by the institution to decentralize their services to the districts and that  the step is in line with the government’s devolution agenda.

Mr. Mukungule noted that the institution’s plans will allow more public workers to have an understanding of the institution’s services, especially when it comes to resolving public matters.

The Permanent Secretary stressed that the mandate of the institution is very noble, as it supplements the governments efforts in ensuring that there is transparency and order in the civil service.

“A lot of our employees may not know where to run to when they have problems, so you having your officers present here will help a lot,” he added.

Mr. Mukungule further assured the Investigations Officer for the Public Protector in Zambia of the availability of office space in the 4-Storey provincial administration building which is nearing completion.

The Public Protector Zambia is in Muchinga Province for a sensitization and awareness campaign with the general public and government officials.

President Hichilema lauds bilateral relationship

President Hakainde Hichilema says Zambia values bilateral relations with other countries as they play an important role in the development of the country.

ZANIS reports that President Hichilema was speaking when outgoing Georgian Ambassador to South Africa who is also accredited to Zambia, Beka Dvali and Italian Ambassador to Zambia Antonino Maggiore bid farewell to President Hichilema at state house in Lusaka today.
President Hichilema said Zambia wants to take lessons from the developmental journeys of Georgia and Italy.

The Head of State  said that Zambia would also love to enhance its relations with Georgia and Italy in the areas of trade and investment.

President Hichilema noted that apart from Italy’s infrastructure development contribution to Zambia, the Italian President’s visit to the country this year was historical and the birth of many more bilateral relations.

The President appreciated Italy’s contribution before, during and after Zambia’s electoral process last year.

He wished both Ambassadors well as they take up their new roles.

And Both Ambassadors reiterated the developmental relations with Zambia.

UPND business executive accepts Party’s decision to re-adopt candidates who lost elections

United Party for National Development (UPND) member and Copperbelt-based business executive Mellbin Muyoba Simangolwa has accepted the ruling party’s decision to re-adopt Bernard Kanengo for next month’s Kabushi Parliamentary by-election.

Mr. Simangolwa applied to the UPND for adoption ahead of the Kabushi Parliamentary by-election.

The UPND on Wednesday announced the re-adoption of Mr. Kanengo as the party’s candidate in next month’s Kabushi Parliamentary by-election ahead of Thursday’s nomination day.

After attending the briefing at which UPND Chairman for Elections Garry Nkombo announced the re-adoption of Mr. Kanengo, Mr. Simangolwa pledged to campaign for the UPND candidate and ensure that the party scoops the Kabushi Parliamentary Seat.

Mr Simangolwa said he was pleased with the intra party democracy in UPND and will continue to respect the decisions of the party.

He told his supporters to respect the party’s decision and support Mr. Kanengo.

“We are united, we are UPND. We never divide. I want to congratulate my brother Bernard Kanengo and pledge my full support during the campaigns. We shall win Kabushi as UPND by landslide. I have already communicated to my team to respect the Party decision and support the adopted candidate,” Mr. Simangolwa said.

“You really have to understand that there is always one chance at a time and we truly appreciate that my colleague Bernard Kanengo has been considered this time. We wish him well and we will definitely rally behind him and support him and make sure we can secure that seat for UPND. I think what is more critical is that the ground needs to be made fertile obviously because of previous activities that have happened in the past but we pray that those things will be ironed out and we will be able to forge forward. We wish him well and wish the party all the best,” Mr. Simangolwa said.

“We will be able to support the party. What we are more focused on is to secure the seat for UPND and we are providing that alternative leadership. This process has gone on smoothly and no hard feelings at all. I still have other things that I can do to serve the party and I am committed to serve the party,” he said.

Meanwhile, the UPND National Youth Executive has hailed Mr. Simangolwa for accepting the ruling party’s decision to re-adopt Mr. Kanengo in the Kabushi Parliamentary by-election.

UPND deputy national youth information and publicity secretary David Chikwanda said Mr. Simangolwa has shown maturity that is needed in politics.

Mr. Chikwanda said democracy favours one person at a time and emphasised that Mr. Simangolwa will have his chance in future.

He also expressed confidence that Mr. Kanengo will this time around win the Kabushi Seat.

“As youths we are very confident that the adopted candidates will carry the day because they have full support from those they were competing with. We are one family and intra Party democracy is healthy. We want to commend Mr Mellbin Muyoba Simangolwa for his maturity and we look forward to working with him on different assignment as a party,” Mr. Chikwanda said.

The UPND has also re-adopted Charles Mulenga for the Kwacha Constituency Parliamentary by Elections.

The Kabushi and Kwacha Seats fell vacant after the High Court nullified the election of Bowman Lusambo and Joseph Malanji in the 2021 General Elections.

PF lost the seats after the Constitutional Court upheld the High Court’s decision to nullify the election of Mr. Lusambo and Mr. Malanji last year.

Napsa Stars Move To Heroes Stadium

Napsa Stars have moved house across Lusaka to National Heroes Stadium for the 2022/2023 season.

The promoted Lusaka club has traditionally play its home games at the iconic Woodlands Stadium since 2012.

Napsa will get a feel of their new home as early as this Saturday when they host Nkwazi there in a Lusaka derby.

“We had a chat with the team and everyone is excited about this development. Now we just call on our current and potential supporters to rally behind us even at this new home stadium,” Napsa Stars CEO Ponga Liwewe said in a statement.

“We want to wean ourselves off the mother company and generate our own revenue.

“But we are also looking at the huge population in that sector and we know a lot of people in that area need a team like NAPSA Stars to keep them entertained.”

Napsa fill the void at Heroes left by demoted Lusaka Dynamos who occasionally played their home matches there.

Green Buffaloes left Heroes next door neighbours Independence Stadium a couple years ago and now play their home games at a more central location in the Capital at Edwin Emboela Stadium.

Chulu Excited After Nkana Debut

Nkana defender Amon Chulu has expressed his joy after making his Kalampa debut this week.

Chulu joined Nkana from Lusaka Youth Academy this month.

The young left back was voted man of the match in his maiden game for Nkana as they drew goalless with Kabwe Warriors on Wusakile last Sunday.

Chulu described his debut at Nkana Stadium as interesting and tough.

“It was quiet interesting and a bit tough but it is good for me I jumped in very first and related to what was going on very first,” Chulu said.

He said coach Beston Chambeshi prepared him well for the debut

“Coach Chambeshi did well to get me ready for the first game of the season,” Chulu said.
