Punishment for City Market fire perpetrators be exercised within law- LAZ

The Law Association of Zambia (LAZ) has cautioned that any powers exercised by the government in pursuing anyone allegedly involved in the fire that gutted part of city market in Lusaka must be used within the limits provided by the Zambian constitution.

In a statement, LAZ President Linda Kasonde says the association has noted statements in the media attributed to President Edgar Lungu and Vice President Inonge Wina calling for the punishment of the people that caused the fire.

Ms Kasonde states that while LAZ appreciates that this is an emotive issue, government should exercise restrain until the matter is fully and thoroughly investigated so that the cause of the fire can properly be determined.

She says LAZ further cautions the public against speculating as to who caused the fire and what their motives were at this early stage.

Ms Kasonde adds that all citizens are guaranteed the protection of the Bill of Rights as provided by the Republican Constitution and such rights should never be abrogated as to do so would defeat the ends of democracy, constitutionalism and the rule of law in Zambia.

She says LAZ further urges government to look into the plight of the victims of the fire and hopes that efforts to reconstruct the market will be undertaken in the shortest possible time.

The LAZ president says the fire that consumed property of defenceless, ordinary Zambian citizens is deeply regretted, especially in light of the fact that the destroyed property was the only source of livelihood for many of the victims of the fire.

Ms Kasonde states that LAZ calls upon law enforcement agencies to thoroughly investigate the matter, and if the fire was an act of arson, bring perpetrators to book in the shortest possible time.

THE Civil Society Constitutional Agenda (CiSCA) contends that President Edgar Lungu’s intention to invoke Articles 30 and 31 of our Constitution to declare a state of emergency is totally misplaced and a knee jerk reaction to an incident that has not even been investigated.

CiSCA profoundly regrets the fire that gutted the city market during the long weekend and deeply sympathises with the affected traders. We do not, however, accept that that the incident of the fire at city market is enough justification for the declaration of a public emergency or declaration relating to threatened emergency. We therefore strongly urge the President not to use his constitutional powers under article 30, declaration of public emergency and 31, declaration relating to threatened emergency loosely.

CiSCA would like to remind President Lungu that the crime of arson is adequately covered by the Penal Code and is far from the realm of reasons for declaration of a State of emergency real or threatened.

We would like to further remind the President that suspending any of our fundamental freedoms is essentially suspending our dignity and humanity. Further, we want to categorically remind him that his executive powers are derived from us the citizens of this country under Article 90, and not the other way around.

Furthermore, we want to state that a declaration of public emergency is enforced by the police whom we have already seen disregarding with impunity some aspects of Article 15 which protects all of us, including suspected criminals, from inhuman, degrading treatment or punishment or other like treatment which is a non-derogable human right and cannot be suspended even in a state of public emergency. We do not believe that the police is adequately prepared to manage such an emergency considering that the previous state of emergency was 26 years ago and at a time when trust and confidence in our police service is at an all-time low.

CiSCA would like to inform fellow citizens that if and when the emergency is declared, there are rights that cannot be suspended even in an emergency. The full protection of these rights that cannot be suspended is impossible to implement in a state of emergency without infringing on them because human rights are inter-related, interdependent and indivisible. The rights to life, Article 12, to be protected from slavery and forced labour, Article 14 and to be protected from inhuman or degrading punishment or other treatment, Article 15 cannot be suspended. We urge citizens not to be afraid because human rights are not a sovereignty issue and have not been since 10th December 1948.

CiSCA hopes and prays that the affected traders will be adequately supported to rebuild their businesses again. A clear and transparent mechanism should be put in place to ensure that whatever support is provided goes only to those who are affected. CiSCA prays that measures will be put in place to prevent occurrences of fires in public places and bylaws that guarantee the security and safety of people and property will be enforced.

President Edgar Lungu will tonight at 20:00hrs address the nation on both Radio and ZNBC Television.

Today, the President held a Special cabinet Meeting at State house in Lusaka that called to order following an inferno that gutted City Market to discuss the stringent measures Government will take to bring the culprits to book.

Yesterday, the head of State rushed to city market on his return from Ethiopia, where he had gone to attend the African Union summit.

He assured the traders he addressed at the market that Government would not sit idly by and watch criminals destroy their livelihoods.

“In light of this calamity, we will come up with serious and draconian measures and based on the report I will receive, some people might have to lose their rights,” he said on arrival at Kenneth Kaunda International Airport.

On his departure from Addis Ababa, the President directed investigative wings to conduct thorough investigations into the matter to establish the cause of the fire and ensure that the culprits face the law.
Mr Lungu called for calm in the country as investigations are being carried out.

“I hope whatever is happening back home regarding the gutting of city market is not one of their prophecies.

“Let us be calm and allow those who are charged with the responsibility to investigate to find out what is causing this upsurge of activities which are bordering on economic sabotage,” he said.

President Lungu said the country is busy putting up infrastructure and unknown people are burning it with the hope of being put in office or that probably Zambians will be sympathetic towards their cause.

Incarcerated UPND President Hakainde Hichilema has called on the Zambia Police Service to thoroughly, professionally and speedily investigate what he has described as the regrettable fire that gutted part of Lusaka City Market yesterday.

In a statement issued to QFM News, Mr. Hichilema is also urging Lusaka residents and other people who may have information that led to the fire to assist the police as they investigate.

Mr. Hichilema says a professional, unbiased and conclusive investigation is essential in order to determine the true cause of the fire.

He says this will assist the country in deciding and acting on proactive measures to minimize similar tragedies going forward.

The UPND Leader says this will also help the community to avoid un-researched conclusions as to the cause of the fire given the already negative political situation in the country.

Mr. Hichilema has since offered his sympathy to those who have lost merchandise, property and other valuables in the inferno given the current economic and social difficulties that people are going through.

Dialogue, NOT State of Emergency will Heal the Nation- Green Party

The news that President Edgar Lungu is once again contemplating invoking emergency powers to declare a State of Emergency is extremely worrying to us as the Green Party.

Invoking a State of Emergency is a violent response to violence.

As we have always stated, violence, whether by the State, bandits, vandals or terrorist, and in whatever form, and for whatever reasons, is almost always self-defeating because it breeds more and more violence. The ultimate victims are innocent souls who many a time have nothing to do with the scores the perpetrators intend to settle with their perceived enemies.

Invoking the State of Emergency is State-sponsored terror in that the police, army, and other security agencies are given unlimited power to reign terror on innocent citizens through dusk-to-dawn curfews where citizens will be unwarrantedly arrested and detained; citizens will be deprived of their rights to privacy and subjected to humiliating house and body searches; right to freedom of movement will be curtained, including right to ownership of private property and other rights. Such measures will only exacerbate tension and divisions in the nation.

As the Green Party, we believe the declaration of the State of Emergency is extremely uncalled for at this point in time, not only because the emergency measures will deprive citizens of their constitutional rights, but is likely also adversely hurt the economy. The emergency measures will surely scare away the donors, investors and tourists. Our economy is too fragile to endure such economic fallout.

In this regard, we implore the President to exercise maximum restraint on invocation of emergency powers. The negative consequences of such measures by far out-weigh the positive outcomes. If anything, invoking emergency powers is like playing in the hands of perpetrators of acts of sabotage. The primary objective sabotage acts is to aggravate ill-feelings and more violence so as to plunge the nation into terror, humiliation and anarchy. If State response is by way of more terror, through the State of Emergency, then the saboteurs will achieve their objective.

Our view as the Green Party is that instead of invoking emergency powers, the President, as the Commander-in-Chief, should better still order for a mobilization and deployment of all Army, Police, National Service and other defence and security, who were trained by the United Nations and African Union in peace keeping and observer missions tactics to guard strategic public and private installations countrywide, with unequivocal instructions to abide by constitutional imperatives.

Our defence and security agency have excelled across the world in terms of peace-keeping and observer duties. They need to replicate their achievements abroad here at home. Meantime, whilst the troops restore order, most importantly, we the politicians should immediately go into a dialogue mode to resolve our differences and chart a peaceful way forward. There is need to urgently reform institutions that have gotten the nation into this ill-fated situation of terror, tension, disunity, and deep hatred, especially the Constitutional Court and the Electoral Commission of Zambia. We should not continue burying our heads in the sand pretending there is no problem when our nation is slowly and surely getting into political and security decay.

Representatives of Zambia’s Public-Private Partnership Unit (PPP) returned at the weekend from a visit to the United Kingdom where they presented project opportunities valued at more than USD 22 billion to prospective investors. Among the opportunities they presented was the Batoka hydro power project, the Jubilee City concept, of a state-of-the-art and iconic business and commercial metropolis in the heart of Lusaka, and the 202km Livingstone-Kazungula-Sesheke railway line linking Zambia to the Namibian Port of Walvis Bay.

Addressing the Financing African Infrastructure conference last week in London, Ms. Christah Kalulu, Permanent Secretary at State House responsible for oversight of the PPP Unit, told delegates that infrastructure development is a key pillar of Zambia’s 7th National Development Plan.

“Our motives are clear. More and better roads, railways, energy, water, sanitation and housing will improve productivity in our economy, create jobs and lift Zambians out of poverty.’’

 She went on to say, ‘’the priority that President Lungu attaches to working with the private sector to improve Zambia’s infrastructure and grow Zambia’s economy is evidenced by his decision to locate our national PPP Unit in State House.’’ 

Ms Kalulu told delegates that ‘’structuring PPPs can be complex, but I am encouraged by the interest you have shown in investing in Zambia and the portfolio of projects that we are bringing to the market. We stand ready to work with you to make these projects bankable, so that you can derive sustainable returns and Zambian citizens can benefit from your investments.”

While in London Ms. Kalulu and Mr. Keeta Shisholeka, Acting Director of the national PPP Unit, participated in a series of roundtable meetings at which they presented projects to pre-qualified financiers and project developers, and outlined the nation’s legal and regulatory framework and procurement practices.

 Ms. Kalulu and Mr. Shisholeka also held bilateral meetings with officials from the UK’s Department for International Development and International Trade, as well the UK’s Infrastructure and Projects Authority, the agency responsible for designing and delivering PPP projects in the UK.

They also participated in a dialogue hosted by the British Foreign and Commonwealth Office (FCO) on the theme ‘’Boosting Trade and Investment in sub-Saharan Africa,’’ which was held at the FCO’s rural retreat at Wilton Park in Sussex, England. Representatives from the governments of Ghana, Ethiopia, South Africa and Uganda were also present.

Commenting on the visit, Keeta Shisholeka added, “Our national PPP Unit is constantly seeking to drive innovation, create scale and maximise the development benefit of projects for Zambians. Our exchanges in London have opened new avenues and new opportunities for us to deliver on our mandate to improve Zambia’s infrastructure. I am enthused by the degree of interest we have witnessed in our nation and our economy.”

Zambia is rated the fifth most attractive African nation for investors in the 2017 Quantum Africa Investment Index.

MMD Die Hard Youths Coordinator Gerald Chiluba says the declaration by African Union that the country’s elections were free and fair should put to rest talks of legitimacy by the UPND.

The opposition UPND have refused to acknowledge the outcome of August 11th election in which the PF were declared winners but Mr Chiluba says the AU’s declaration should halt the retrogressive talks of legitimacy which is dividing the nation.

The former COBUSU President said not acknowledging the authority is what has led to high levels of intolerance and the divisions which are being seen in the country today.

“As MMD Die Hard Youth Wing it is our expectation that after the declaration by the African Union that “Zambia’s August 11 2016 elections were free and fair and were further coupled with transparency”, political leaders need to halt talks of legitimacy and finally accept the authority in government.

“Lack of acknowledging the authority in power is what has led the country to these levels of sabotage we are expriencing today and that is why we need to immediately take a leave from talks that cannot be substantiated.

“The AU has given its position with regard to the August elections after thorough investigations and observations that surrounded the voting, that is why Zambians should, starting from today and going forward be comforted that there was no victory which was stolen from them as the African Union which is a respected organ in Africa and speaks without fear or favour has made a declaration that as usual the elections were free and fair,” he said.

Mr Chiluba further urged government to quickly put an end to what he termed politically motivated acts of arson.

“We are therefore, calling upon the government of the Republic of Zambia to quickly end this politically motivated arson by puting in place serious security interventions so as not to drawback our efforts in developing of our respective communities. Because this loss of assets will force many into deprivation and economic distress, which will eventually lead the country into further abject poverty.

“We are further calling for the involvement of all stake holders which includes; the Church, traditional leaders, political players, Civil society organisations, the Youth and all men and women of Zambia regardless of their previous standing with the government to rise above politics and begin to build and walk in a positive and committed path of reconciliation,” he said.

The Director of Public Prosecutions Lillian Shawa Siyunyi has entered a nolle prosequi in the case where President Edgar Lungu’s spokesperson Amos Chanda and Daily Nation Newspaper owner Richard Sakala were facing contempt of court charges.

Mr. Chanda, Mr. Sakala are scheduled to appear before Magistrate Felix Kaoma at 12:00 hours today in a matter where UPND leader Hakainde Hichilema applied to cite them for contempt.

Mr. Chanda is accused of making prejudicial remarks on Aljazeera TV regarding a matter which was actively before court published in the Daily Nation Newspaper.

But the DPP has this morning signed a nolle prosequi, discontinuing the case.

My life is in danger because of careless outbursts by Mumbi Phiri and Stephen Kampyongo

Dear Brothers and sisters,

Pray for me, immediately after Kampyongo and Mumbi Phiri issued statements that associated my name to yesterday’s city market inferno. Just yesterday alone I received over seven death threats. As I speak now my life is in danger and I have moved from my original home for fear of being killed by PF members. It is so disappointing that senior members of the patriotic Front can make such careless statements seconds after the fire gutted the market. In a normal functioning state, Police would have been allowed to carry out thorough investigations before any statement is issued. Iam so disappointed by the inspector general of Police Mr.Kanganja, instead of caution Kampyongo and Mumbi Phiri for threatening the life of an innocent citizens like me, he was there clapping and nodding his head.

I have suffered a lot because of their carelessness and as I speak I was offered a position of dean at one of the Universities and now my offer has been put on hold.

Here are facts people need to know, City market is owned by the Lusaka city council, it was constructed in 1997 by the then MMD government along Lumumba road as a modern market.

It has hundreds of stores / stands, it’s properly metal fenced and has about 12 entry/exit points that includes for passenger transport and small points for pedestrians, these points are always under lock during nights by the management.
In proximity of less than 100 meters in the southern part of the market is a Paramilitary camp popularly known as muzaleka” mounted for the sole purpose of patrolling the market at night by the paramilitary police.

The market itself is also very secure and concrete made and locked by 18 hours and activities only remain outside the actual market (within the metal fence).

For one to have entry into the market, the gates must be opened by the management.

The Market was opened by PF Management at 05:00hrs to allow sweepers and cleaners, 30 minutes later the market got burnt. Judge for yourselves who is behind all this.

There is power in our tongues and I earnestly appeal to all political players not to rush in issuing unsubstantiated statements that may take away the peace that we have enjoyed since independence.

According to our little understanding, the president can declare the state of emergency when there is political tension in a country.

Edgar Lungu is on record of saying there is no tension in Zambia, its only exist in those Catholic bishops and some journalists.

His vice President Inonge Mutukwa Wina also echoed on Friday in parliament when she was asked by one of the UPND MP about the state of the nation.

The political tension is nor here nor there, it’s just an imagination and visualization from others’ heads said Inonge Wina.

If what the president (?) said yesterday was true that he should be allowed to be a dictator for a short period is true, then this country is headed for disaster, bbola nga na ikosa being rough will not help you score goals, what he needs is to sober up and find lasting solutions to challenges going on in the country.

One of the reason why we have insisted that the gutting down of the City Market should be investigated independently is because from the look of things PF is playing double standard game and they seem to know exactly what happened.

There is no way they can hint on the state emergency unless if they are telling Zambians that it was a planned move in order to paralyze the judiciary system so that President Hakainde Hichilema and other political prisoners remains in prison for a longer time.

The economy is already crippled and the state of emergency will worsen the situation.

Before you start pointing fingers, think about what you have done? State of emergency over your own orchestrated/stage managed crimes, will not offer any solutions to the many challenges facing this country.

For months now we have been warning Zambians over your evil plans that began a year ago. You thought the incarceration of HH will see UPND members take to the street, thereafter seize the moment to declare one. Alas you did not get what you hoped for and the only option/last resort is move onto stage managed satanic arsons in order to get public sympathy.

We are so grateful for the able Leadership of our beloved mother Hon.Mutale Nalumango and GBM for restraining our members not to take to the streets, even under intense provocation, they read your evil intentions and as UPND we shall Continue being Law abiding citizens and not fall to your traps.

We ask government to urgently compensate Our people who lost Property in the inferno.

The questions that need answers are:

1.Where did the fire start from?
2.At what time did the fire start?
3.Was the market open by that time?
4.Where were our police who patrols the market?
5.Why did it take so long for fire brigade to respond to the inferno and why were fire engines from the airport not called to come and beef up other fire men prevent colossal damage?

I have instructed My Lawyers to commence litigation against Mumbi Phiri and Hon.Kampyongo, I will not rest until I see these two evil beings punished by the Law.

Lusaka residents prepare to experience the glamour of polo at annual event which marries the sport of polo with fashion

On Saturday, 8 July 2017, Lusaka’s socialites, celebrities and A-listers will meet at Lusaka Polo Club to indulge in a day of luxury and glamour. Six people have died while over 20 have been admitted to Ronald Ross Hospital in Mufulira and Mansa General Hospitals when a Kashikishi bound Likili Bus overturned 30 kilometers on the pedicle road in the Democratic Republic of Congo.

 

The bus which left Ndola in the morning is suspected to have been over speeding when it overturned killing five people including 2 teachers from Nchelenge.

Mufulira District Commissioner Hildah Kawesha who rushed to the scene says six people died on the spot while eight were rushed to Mansa for treatment.

Mrs. Kawesha says four of the dead are females while two are males.

And Ronald Ross Hospital acting head of clinical care Nathan Singogo has described the over 15 victims admitted as stable.

Dr. Singogo has told ZNBC news that only one person is in the intensive care unit and the rest are in the ward recovering.

President Edgar Lungu has told Zambians to bare with him if he becomes a dictator  as he intends take unprecedented measures to stop the acts of  hooliganism being perpetrated.
Speaking upon arrival from Addis Ababa the head of state who expressed displeasure at today’s acts of sabotage revealed that security offices would now up their game and take necessary measures to curb the acts of hooliganism because people’s livelihoods are being affected.
“I do not want to pre-empt the measures we have put in place to up the game and we have done that. But I will wait to be briefed…,” President Lungu said.
“If it means taking measures which are unprecedented we will do just that, some people will have to lose their rights. People who have lost their property have lost their livlihoods. So if I become a dictator for once bare with me.”
The head of state then proceeded to City Market to go and see the extent of damage as well as meet some affected traders.
The President who was in the company of security and defence officers, minister of home affairs Stephen Kampyongo, his presidential aides Amos Chanda, and Kaizer Zulu.
The head of state was greeted by hundreds of traders as they all cried out to him to bring the perpetrators to book.
More than one third of city market has been gutted after suspected arsonists torched the building.
The market went up in flames shortly after another market in Misisi also got torched.

About the challenges the company has faced thus far, Mr Jaber points to the high import duty on raw materials.

“The importation rates on raw materials are too high. We need better rates to be more competitive against imported finished products,” he states.
