African Rainbow Minerals founder, Mr. Patrice Motsepe speaking at the 2016 ARM Broad-based Economic Empowerment (BBEE) Trust and Motsepe Foundation meeting in Sandton, Johannesburg on 22nd November, 2016.
South Africa’s business magnet, Patrice Motsepe has paid glowing tribute to the people of Zambia and other countries in the Southern African region for contributing to building his business empire.
Mr. Motsepe, who is founder and Executive Chairman for South African based African Rainbow Minerals (ARM) which has a 50 : 50 per cent share in Konkola North copper mine with the world’s second largest miner, Vale, was speaking yesterday when he met over 80 kings and chiefs at the 2016 ARM Broad-based Economic Empowerment (BBEE) Trust and Motsepe Foundation meeting in Sandton, Johannesburg.
The traditional rulers were drawn from Zambia, South Africa, Lesotho, Swaziland, Zimbabwe, Namibia and Botswana, among others. The meeting also included representatives from religious organisations, churches and civil society organisations.
Zambia was represented by Paramount Chief Chitimukulu, Chief Mumena and Chief Madzimawe. Invited guests included Zambia’s High Commissioner to South Africa, His Excellency Mr. Emmanuel Mwamba and other diplomats accredited to South Africa; Dr. Tshepo Ramaphosa, wife of South Africa’s Deputy President, Mr. Cyril Ramaphosa, and King Goodwill Zwelithini of the Zulu in Kwa Zulu-Natal province.
“People of Zambia, Botswana, Lesotho, Swaziland, Zimbabwe, South Africa and other countries in the region are important to us because they are the ones who have made us who we are. This is why we realise that we need to give back to the community,” Mr. Motsepe said.
Mr. Motsepe and his wife Dr. Precious Motsepe, personally handed out cheque donations ranging from R325, 000 to R2 million, to various organisations and churches being supported under the BBEE Trust.
A number of ARM, community development efforts are delivered through the ARM BBEE Trust, which was established with the primary objective of contributing to the improvement of the living conditions of the poor and marginalised persons. The ARM BBEE Trust provides funding to various provincial rural trusts throughout South Africa. The provincial trusts were established by ARM to fund various education, health, welfare and enterprise development projects.
According to Forbes, the 54 year-old Mr. Motsepe is Africa’s first black billionaire after attaining the feat in 2009.
Speaking off the cuff and in an emotional speech, Mr. Motsepe noted that there were a lot of people who had “very little in this world. These are people who sacrifice even when knowing that they may not have a decent meal the next time. Yet they still give. These are the people who encourage us to do what we do.”
Mr. Motsepe has also condemned segregation of people, particularly by world leaders, based on religious faith and other beliefs. He called for deliberate action by individuals in positions of influence that will bring people together regardless of their beliefs or race.
He said his Foundation was honoured to have been graced by the presence of the kings and chiefs because “we want to respect the role of traditional leaders and we want our children to grow up respecting their culture.”
And South Africa’s Minister of Agriculture, Forestry and Fisheries, Mr Senzeni Zokwana, who was guest of honour, commended Mr. Motsepe and his Foundation for the initiative pointing out that there was need for the world to unite so that it could effectively tackle the challenges it was faced with.
Congress of Traditional Leaders of South Africa (CONTRALESA) president, Chief Setlamorago Thobejane urged other wealthy businesses and individuals to emulate Mr. Motsepe and give back to the community.
Chief Thobejane said CONTRALESA has been observing and believed that Mr. Motsepe’s generosity was nothing but something that came from his heart.
“If only all those who control the wealth of South Africa could be like you, we could have been a great nation. We call on others to emulate you as they cannot continue making profits out of the 50 million South Africans without giving back,” he said.

The use of popular campaign slogans “Boma ni Boma” and “Sonta Epowabomba” has come back to haunt the PF in the election petition which saw Professor Nkandu Luo’s lose her Munali parliamentary seat.
Justice Edward Musona in his judgement stated that the political battle in Munali Constituency Parliamentary elections was not fought on a level ground because Prof. Luo was a Cabinet Minister and abused government resources in her campaigns such as government motor vehicle, government driver, government fuel and other resources attaching to the office of Minister while the other candidates went into that war in their private capacities.
In a damning judgement on the conduct of the PF during the elections, Justice Musona stated that the PF slogan “Boma ni Boma” clearly proves that abuse of government resources and confirms that Professor Luo was in government, she was the Boma.
“F/Nkandu Luo was aware at the material time that she was in the campaigns as a Minister while other candidates did so as ordinary members of the public. There is no dispute that the slogan, “Boma ni Boma” was used in Munali Constituency Parliamentary elections. There is no dispute that the Respondents including the 1st Respondent were aware of this intimidating slogan. This slogan was not only intimidating but was also belittling the other competitors who then were not in government as F/Nkandu Luo was,” part of the judgement read.
Justice Musona said the Petitioner further told this court that the 1st Respondent who was a serving Minister continued to campaign as a Minister Inspecting Government on-going projects using Government transport, Government driver and other Government resources after Parliament was dissolved.
“Among the on-going Government projects which the 1st Respondent is alleged to have inspected during campaigns after Parliament was dissolved are water projects in Kaunda Square Ward, Mtendere Ward and Chainda Ward, and there were also slogans such as “sontapo epowabomba”, which literally means show us where you have worked. The 1st Respondent also held rallies without the police stopping her because she was a serving Minister, this the Petitioner alleges that it worked to the advantage of the 1st Respondent and unfortunately to the disadvantage of the Petitioner. The Petitioner alleged that she was not allowed to hold public meetings (rallies) as the 1st Respondent did. During fighting the 1st Respondent’s party would shout a slogan saying “Boma ni Boma.” What the Petitioner understood by this slogan, and going by what she experienced during those campaigns was to mean that the party for the 1st Respondent was above the law because it was the Political Party in government.”
The judgement reads, “It is not in dispute that Cabinet Ministers of which the 1st Respondent purportedly was are entitled to government motor vehicle, public fuel and public driver. The 1st Respondent herself admitted that she had two government motor vehicles of which one was an official motor vehicle and the other was a personal to holder motor vehicle. She also admitted that she had a government driver. The only dispute is that she used a government motor vehicle and a government driver or other government resources during her campaigns. According to her, she told this court that when going on her campaigns she would park the government motor vehicle at her house and leave the government driver then she would go on her campaigns using her personal motor vehicles namely, a Toyota Noah and a Toyota Regius driven by a non-government driver.”
“The lacuna in her evidence is that I have not seen any government guideline to preclude a Minister from using government resources such as a government motor vehicle during campaigns. Ministers had government resources at their disposal. It was left solely to the Ministers themselves whether or not to avail themselves of those government resources, of which the 1st Respondent denies having used government resources.”
“Truly, the 1st Respondent had her personal motor vehicles, namely, a Toyota Noah and a Toyota Regius which she used during her campaigns but I have seen no evidence to show that she truly did not use a government motor vehicle as well. In the contrast, there is evidence from the Petitioner that the 1st Respondent was seen driven in a government motor vehicle with a Zambian flag flying during campaigns.”
Justice Musonsa said, “The Petitioner testified how she saw the 1st Respondent driven in a government motor vehicle with a Zambian flag on it. Wendy Lwendo Michelo was PW5 who also testified that she once saw the 1st Respondent being driven in a government motor vehicle with a Zambian flag on it, and that there was a Toyota Noah branded in PF colours with a portrait for the 1st Respondent accompanying that government motor vehicle. PW5 described the scene where she saw this as Kaunda Square Stage 2 off Tomstone J38 Road, first turn to your left then the first house on your right. The 1st Respondent was seen distributing PF ‘T’ shirts and PF chitenge materials at that house. I am, therefore, satisfied that these pleadings in the first paragraph of this election petition have been fully proved.”
“The 1st Respondent argued vehemently that she did not use government funds during her campaigns, but admitted that she used her salary which she was paid as a Minister. She called her salary as meagre and that she raised other funds from other sources to supplement her salary and what was paid to her as gratuity. Indeed, that was admission that the salary which she was paid was spent on her campaigns. She was paid that salary as a Minister the office which she held illegally.”
To the extent that she held the office of Minister illegally it follows that even the salaries which accrued to her were paid to her illegally, she was not entitled to that money. Those salaries were government money which she used to fund her campaigns. The only question is to what extent did that salary advantaged the 1st Respondent against the Petitioner?”
“The evidence shows that whereas the 1st Respondent used that salary and supplemented it with other resources from other sources, the Petitioner did not have such a salary. It is therefore true that she used government funds and this affected the Petitioner who had no access to government funds and had to depend solely on her private sources. This ground has been proved.”
Justice Musona also stated that there is evidence that the campaigns in Munali Constituency Parliamentary elections were marred with violence adding that the violence reached a crescendo when on 8th August, 2016 the UPND campaign bus was attacked by PF cadres.
“Apart from saying that she was not at the scene of the attack and that she did not know of that attack, F/Nkandu Luo has not sufficiently shown to court what measures she took in order to cage her supporters and/or agents whose violent conduct had then become a notorious fact even to the 1st Respondent. The brutal attack by PF cadres on UPND supporters which occurred in Mtendere on 8th August, 2016 was capable of influencing the voting pattern in Munali Constituency, this is so because news of that attack was reported in the media thereby spreading throughout Munali Constituency,” the judgement read.
Justice Musona said it then became risky to be associated with UPND especially when it became apparent that the state police officers were not capable of protecting the UPND supporters.
He charged that this was proved when the UPND supporters were attacked on their campaign bus and that the matter was reported to police and one suspect was identified but no action or arrest was taken by state police officers.
On the issue of the Form Gen. 12, Justice Musona ruled that Form Gen. 12 is a legal document and the failure by the Electoral Commission of Zambia to avail and provide this Form Gen. 12 shows not only the unfairness and lack of transparency but also the illegalities surrounding the Munali Constituency Parliamentary Elections.
“Some unfairness, procedural lapses and illegalities which characterized the Munali Constituency Parliamentary Elections could easily have been curtailed by the Electoral Commission of Zambia but did not sufficiently do so. I have found that the Electoral Commission of Zambia failed to conduct transparent, free and fair Parliamentary Elections in Munali Constituency in accordance with their mandate,” the judgement reads.
“The evidence by the Petitioner was that in Munali Constituency the Electoral Commission of Zambia did not provide adequate election material such as Form Gen. 12 and ink. In particular, the Petitioner had to make several photo copies of Form Gen. 12 and distributed them to Chainda Ward, Chakunkula Ward, Mtendere Ward and Kalingalinga Ward including University of Zambia (UNZA)which is in Kalingalinga Ward. By 14.00 hrs on 12th August, 2016 counting of votes had ended yet there was only one (1) Form Gen. 12 there which was with the Presiding Officer. A dispute arose as to which figures should be indicated on that Form Gen. 12. A PF member had different figures and insisted that his figurers should be recorded on Form Gen. 12.”
“This impasse was resolved after a recount of the votes was done. F/Wendi Lwendo Michelo who was PW5 in this case testified that at Kaunda Square Community Hall which is in Munali Ward, PF cadres caused confusion when UPND cadres demanded to have Form Gen. 12. According to PW5, the situation was calmed when state police officers who were present requested the PF cadres to leave the polling station. The allegation concerning lack of or the inadequacy of Form Gen. 12 did not affect the Petitioner alone. Suffice to state that it affected all the participants in that Parliamentary race.”
“This issue, however, is an important matter in the conduct of elections and in the spirit of promoting transparency and building confidence in the electoral system. It is important because Form Gen. 12 is a document for the Electoral Commission of Zambia which is used in an election at polling stations to record election results both in figures and in words. The design of Form Gen 12 shows that polling agents should append their names in full and signature at the back of that Form Gen. 12. Even if the use of Form Gen 12 is not couched in mandatory terms, when a dispute of this magnitude arises, compliance as to the way it is supposed to be filled in becomes a necessity. I have seen Form Gen. 12 for each polling station in Munali Constituency. Some of those Form Gen. 12 are not signed at the back. I have seen no reason why Form Gen. 12 for all the 14 polling stations were not signed by polling agents. This was despite the fact that the Petitioner wanted Form Gen 12 to be availed by the Electoral Commission of Zambia in order to record the election results thereon and also counter sign the same.”
The ruling PF says its members should brace themselves for more nullifications judgements of its parliamentary seats following the High Court’s decision to nullify Professor Nkandu Luo’s election victory in Munali.
PF Lawyer Kelvin Bwalya Fube is commonly known as KBF said the party is likely to see more judgements of its seats nullified over the next ten days.
Mr Fube who is also Chairman for Elections said what is at play now is a struggle for parliamentary seats. He said all is not lost and that the party just needs to focus and strategize and execute its plans to perfection.
Mr Fube also stated that Professor Luo is still eligible to recontest the Munali.
“Under the new Constitution by elections will be held pursuant to Article 57 within 90 days of the Vacancy. In the case of Munali which we have lost or in the case of Nalolo (which we had nullified). ECZ is mandated to set the place, time and date of the by Election. Our Hon. Minister Nkandu Luo is eligible to stand and re contest. The court did not disqualify her from standing,” Mr Fube said.
“We are expecting more judgments in the next 10 days.As a legal team we did our best. We now have brace for by elections and/or Appeals. As Party we need to start preparing for these results with these factors in mind,” he said.Mr Fube said Lusaka and the Copperbelt seats must not be lost at all costs.
UPND Officials at the scene of the impounded trucks
Opposition UPND Copperbelt Chairman Elisha Matambo and three others have walked to freedom after the State entered a nolle prosequi after three months in detention at Kamfinsa State Prison.
They were arrested on August 14 2016 for and charged with aggravated robbery after they intercepted a motor vehicle that was allegedly carrying pre-marked ballot boxes heading to Kitwe along the Ndola-Kitwe dual carriage way.
They wondered why the materials were heading to totaling centres in Kitwe when voting had closed and results were being awaited.
The officials suspected that the votes in some polling stations in Kitwe were going to be manipulated as they would favour the Patriotic Front.
But when the matter came up in the Kitwe High Court, state prosecutors from the DPP’s Chambers announced that they were entering a nolle prosequi.
Zambia should consider reverting to the old system of sourcing petroleum products through the southern route so as to make use of the railway system which is cheaper and more reliable.
Former deputy minister of Energy Charles Zulu said oil marketing companies (OMCs) should consider using the railways to ferry fuel into the country because it is more cost-effective than road transport.
Zambia currently procures the bulk of her refined products by road via Dar es Salaam and this has been blamed, together with the use of middlemen, for the escalating costs of the pump price in the country. Before UDI in the then Rhodesia, when the country’s fuel stocks were delivered by rail through the southern route, Zambian motorists could buy petrol at K2 per litre.
Speaking to the Daily Nation yesterday, Mr. Zulu said rail transport was best as it would enable oil companies to transport fuel at a reduced cost compared to what they were currently incurring.
“While the OMCs ferrying fuel into the country have preferred to be using road, there is a much cheaper mode of transporting the commodity which is by railway and if they can utilise it, the costs they are incurring will drastically reduce which will make them cost-effective,” Mr. Zulu said.
“However, the decision lies in their hands because Government is now not actively involved in the oil procurement process which has solely been left with the private sector while the State concentrates on formulating policies aimed at smoothening the operations of the sector through its regulatory role.”
Mr Zulu said Government’s policy direction in the oil procurement will help revamp the sub-sector and reduce the price of fuel in the long-run, adding that the decision by Government to allow private players in the sector was long overdue and will address some of the challenges that Government encountered form time to time.
“When you look at the 2017 Budget, you realise that the role of Government is just to regulate the sector as OMCs will take a leading role in the importation and supply of fuel in the country and this is a plus on the part of Government.”
The MMD has strongly re-affirmed that Dr.Nevers Mumba is the President of MMD. Dr.Mumba was elected in the MMD party convention in 2012 for a five year term.MMD spokesperson Ireen Musonda said when Mr Mutati was expelled from the party in 2015 for gross misconduct he challenged his expulsion in the high court, which then upheld his expulsion. Mr.Mutati challenged the ruling but later withdrew the matter quietly from court.Mrs Musonda said the fight against MMD by unknown youths and the PF minister of Home Affairs, Honourable Kampyongo, who is a stranger to the MMD,is misdirected.
Below is the full statement
We, the Movement for Multi-Party Democracy (MMD), wish to strongly re-affirm that Dr. Nevers Sekwila Mumba firmly remains President of the party and wish to dispel all the mischeveous misinformation that has consistently been circulated in the public domain by the enemies of the party challenging this fact.
Dr. Mumba was democratically and duly elected MMD President, by landslide victory, in the MMD Party Convention of May 2012 for a five-year term which expires in 2017. We therefore challenge the assertion that Mr. Felix Mutati is the President of the MMD by the fact that Mr. Mutati lost to Dr. Mumba in that election, a position which has never been challenged anywhere nor by anyone.
After that Election, Mr. Mutati remained party member and Chairman of the Commerce Sub-comittee of the MMD National Executive Committee. He was later expelled from the party for gross misconduct in March 2015. He appealed against this expulsion and he humbly submitted himself to the MMD Truth and Reconciliation Disciplinary committee and was forgiven and re-admitted to the party with a proviso that he desist from engaging in activities similar to those which led to his expulsion. But Mr. Mutati’s conduct was again found wanting and was subsequently summarily dismissed from the party in January, 2016.
Thereafter, Mr. Mutati challenged this expulsion in the Lusaka High Court and after studying the grounds of his expulsion by the MMD, the Lusaka High Court agreed with the MMD position and threw out the injunction which he was seeking and the court upheld his expulsion from the party. Mr. Mutati tried to challenge this ruling again but later quietly withdrew the matter from Court. By this action alone, Mr. Mutati reverted to his expelled status.
We wish to state that this relentless fight for the MMD Presidency by some unknown youths, Honourable Kampyongo, who is a stranger to the MMD as he is a PF minister, and others, is misdirected against Dr. Nevers Mumba. We strongly advise that they channel their energies to the 2012 MMD leadership that presided over the 2012 Convention which declared Dr. Mumba duly elected MMD President. We further appeal to them to take this fight back to the Lusaka High Court and if they can, to let them reverse the ruling that upheld the expulsion of Mr. Mutati from the MMD and thereafter find an acceptable way of imposing him as MMD President.
Finally, we wish to advise these youths that the MMD, being the mother of multi-party democracy in Zambia and the party under which Zambia was declared a Christian nation, cannot and will not engage in thuggery to resolve party issues, as they are suggesting. As democrats, we are law-abiding and will continue to pursue the route of the Courts of Law to settle any disputes and to always seek progressive and meaningful dialogue. We therefore strongly appeal to the said youths and indeed Honourable Kampyongo, to avoid unncessary threats and insults against Dr. Mumba but instead, in a calm and reasonable manner, advance their strong reasons as we have done, as to why the MMD and indeed the nation, should regard Mr. Felix Mutati as MMD President.
The 2016 FAZ Super Division title could be decided as early as Wednesday.
Leaders Zanaco will be confirmed as champions if they beat tenants Napsa Stars away at Sunset Stadium in Lusaka on November 23.
Defending champions Zesco United on the other hand need to win at home on the same date against Kabwe Warriors at Levy Mwanawasa Stadium in Ndola to keep their 2017 continental dreams alive.
Zanaco, who have 69 points, can seal the title race with three games to spare if they can beat Napsa and attain unassailable 72 points.
Victory will see Zanaco go clear as Zambia’s third most successful club with seven crowns leaving Power Dynamos and Green Buffaloes on six.
Nkana and Mufulira Wanderers have 12 and 9 titles respectively.
Meanwhile, a Zanaco win will mean Zesco will now be left battle for second place whose prize is a 2017 CAF Confederation Cup slot.
However, a draw or defeat will potentially see Zesco miss continental football for the first time since 2013.
Zesco have 57 points with five games in hand and are ten points behind Nkana who have one match left to play.

Losing candidate for FDD in Munali Constituency in the 2016 August elections Antonio Mwanza says the move by former area Parliamentary NKandu Luo is unwise as she risks embarrassing herself in the Constitutional Court.
Mr Mwanza said the reasons for the nullifying are water tight as the evidence is solid and indisputable.
“Nkandu Luo has decided to appeal against the nullification of her election as Member of Parliament for Munali. That’s her constitutional right but should the Constitutional Court uphold the ruling of the High Court then she will be banned from re-contesting the seat in the by-election in accordance with Article 72 of the Republican Constitution.
“The grounds that the High Court has based its decision are solid and indisputable. And Nkandu Luo herself knows from her heart of hearts that she did not win those elections. Deep down in her heart she knows that she was the most unpopular candidate in Munali. She knows that.
“And to take the matter to the Constitutional Court and risk a disqualification all together is very unwise. The wise thing to do is to accept the ruling of the High Court and allow herself a second chance by taking part in the by election than risk a total disqualification, should the Constitutional Court uphold the High Court’s ruling. Madam Nkandu Luo, KAKO NI KALI MUMANJA,” he said.

Professor Luo who is also Higher Education Minister has directed her lawyers to immediately appeal the decision of the Lusaka High Court that nullified her seat.
The Lusaka High Court Judge Edward Musona this morning overturned the election victory of Munali PF Member of Parliament Nkandu Luo.
Professor Luo has also directed that lawyers obtain a stay of execution to stay the decision of the Court.
Judge Musona cited electoral irregularities and rampant acts of violence as reason for nullification of the Munali seat.
Judge Musona nullified the election on grounds that the ECZ failed officials to properly handle the electoral process and did not provide the Gen 12 forms to 14 polling stations in the constituency.
Judge Musona ruled that Prof Luo had an undue advantage in the election because she was a serving Minister at the time of election and used public resources especially that the Constitutional Court had ruled Ministers pay back to the treasury the monies they had accrued during that period.
Professor Luo retained the seat after polling 38, 356 votes while UPND’s Doreen Mwamba came second with 24, 207 votes.
Professor Luo was declared winner by Munali Constituency Returning Officer, Emmanuel Makulila.
