President Hichilema Challenged to Investigate the $50 millions Fertilizer Scandal

The Patriotic Front (PF) has challenged President Hakainde Hichilema to institute investigations into the $50 millions fertilizer scandal. Speaking at a media briefing in Lusaka today, PF Vice President Given Lubinda said that President Hichilema should also extend his corruption crusade to some of his people serving in his government as he follows up historic corruption.

Mr. Lubinda said that the PF supports the fight against corruption hence it’s call on the president to extend the corruption fight to cases being committed by people serving in his government.

He said that the PF will be forced to remind President Hichilema if they see no action being taken on historic cases affecting his colleagues.

“For now we appeal to him to investigate the scandal involving the $50M deal in which caked and underweight fertilizer has been procured for FISP at a collosal cost of $1,407 per tonne when the price obtaining in the country is below $1,000 per tonne,” Mr. Lubinda said.

Mr. Lubinda said the PF party is shocked that ministers in the new dawn government who were highly spoken about by President Hichilema when he was appointing them have now been reduced to common criminals who are being taught the art of stealing by a clique. Mr. Lubinda has since advised president Hichilema to watch over his ministers rather than warning the clique.

“Warning the clique not to tempt the UPND ministers because they are very weak souls will not help,” Mr. Lubinda said.

He said that the PF is disappointed that even after several leadership workshops where the President was sensitizing his Ministers and Permanent Secretaries, there are still weak angels in government. Mr. Lubinda has questioned what kind of lectures the President offered to his Ministers for them to later engage the clique for further studies.

Meanwhile, Mr. Lubinda has said that the PF party is reliably informed by PF members within the system that the new dawn government is now targeting lawyers and law firms that have been defending PF members on the list of targeted victims. He said that the UPND government is doing this to intimidate these law firms so that they stop providing legal services to the PF.

“We have indisputable evidence that Zambia Revenue Authority, National Pensions Authority, Workman’s Compensation Control Board, and other tax agents of the state have been triggered into action to investigate the compliance levels of the Law firms,” he said.

The PF Vice President has since questioned how there can be the Rule of Law which President Hichilema has been preaching when some citizens are denied legal representation. He said the former ruling party is aware that the new dawn government is doing all this to decimate the PF because they cannot stand the pressure of being reminded of their campaign promises.

Former Foreign Affairs Minister Hon Joseph Malanji Sues UPND Candidate for Defamation

Former Foreign Affairs Minister Hon Joseph Malanji has sued Kwacha Constituency United Party for National Development (UPND) losing candidate Charles Abel Mulenga demanding compensation for defamation of character.

According to a writ of summons dated 18 January, 2022, and filed in the High Court for Zambia, at the principal registry holden at Lusaka, the plaintiff Mr. Malanji is demanding exemplary damages and an order for an injunction restraining the defendant Mr. Mulenga or whosoever might be acting on his behalf from making statements that are defamatory about the plaintiff.

“On or about 2nd June, 2021, whilst addressing a rally at Chisokone Market in Kitwe district on the Copperbelt, the defendant falsely and maliciously issued the following defamatory statement in reference to the plaintiff…. ‘Mr. Joseph Malanji forged a grade 12 School Certificate and used the forged Certificate for the nomination exercise with the Electoral Commission of Zambia (ECZ)’, ” reads part of the statement of claim.

“The said statement was repeatedly made to people at different political gatherings, meetings and rallies where the defendant was always the host speaker. On 27th November, 2021, the defendant lodged a criminal complaint against the plaintiff at Kitwe Police Station wherein he alleged as follows: ‘…..Hon Joseph Malanji abused the electoral process by presenting a forged grade 12 Certificate and claimed that he very aware that he has no grade 12 Certificate’.”

Meanwhile, the Zambia Police Kitwe District Criminal Investigations Office in collaboration with the Examination Council of Zambia on 22nd December, 2021, cleared Hon Joseph Malanji on allegations of forgery and uttering of Grade 12 Certificate.

In his report, Zambia Police Kitwe District Criminal Investigations Officer Mr. Peter Bwalya disclosed that Hon Malanji voluntarily produced the grade 12 results to the Police who subjected the same for verification with Examination Council of Zambia.

“On 27th November, 2021, at 12:30hrs, Kitwe Central Police Station received a report from M/ Charles Abel Mulenga aged 57 of House Number 44kk3 Jambo Drive Kitwe. He reported that Hon Joseph Malanji abused the electoral process by presenting a forged grade 12 Certificate for adoption as he claimed that he was very aware that he has no grade 12 Certificate,” reads part of the Police report.

“Hon Joseph Malanji voluntarily produced the grade 12 results to the Police and the Police subjected the same for verification with Examination Council of Zambia. Examination Council of Zambia verified and confirmed that the examination results submitted were genuine and were duly issued by the Examination Council of Zambia. Hence, Hon Joseph Malanji has the genuine grade 12 Certificate based on the authentic of the Examination Council of Zambia.”

Lamba-Lima Royal Council of Zambia backs fight against corruption being spearheaded by the New Dawn Government

The Lamba-Lima Royal Council of Zambia (LLRCZ) has backed the fight against corruption being spearheaded by the New Dawn Government.

LLRCZ Executive Chairman Josphat Nsundwe said people that have stolen public resources must be made accountable for their actions without looking at tribe or political affiliation.

“The Lamba Lima Royal Council of Zambia (LLRCZ) is in total support of the New Dawn Government’s fight against corruption. The LLRCZ is of the view that all those who stole from the Zambian people should be made to account for their actions without looking at tribe pr political affiliation,” Mr. Nsundwe said.

“In other incidents, the Zambian people have heard of the alarming revelations of the previous leadership to strip the national assets, among them, Zambia Electricity Corporation (ZESCO) – Zambia Telecommunications (ZAMTEL), Zambia Railways Limited (ZRL). Zambia Airways, just but to mention a few. Let the New Dawn Administration look critically at the lifting of the immunity of the fallen Government leadership since 1991. This will make equal the stripping of the national assets by the corrupt leaders to lift the immunity of the corrupt leaders in order for them to face the law,” he said.

Mr. Nsundwe alleged that the Lamba-Lima Royal Council of Zambia is aware that some former and current officers in the civil service were corrupt.

He said the UPND Government should not hesitate to fire Government officials who have records of corruption in the past.

“The LLRCZ wishes to advise the New Dawn Government to get rid of all Council Secretaries who have records of corruption at the time they served in the previous administration. The District Council Secretaries, District Education Board Officers, Judicial officers who previously served in the previous regime and are known to be corrupt should not be spared if the New Dawn Government is to succeed in its developmental agenda,” he said.

Mr. Nsundwe said the UPND Government’s developmental agenda may not succeed when corrupt elements remain in the system.

“The above mentioned civil servants are key in any development agenda of the country. The LLRCZ further wish to advise the New Dawn Government through the Chief Justice, Inspector General of Police to re-organise the judiciary and the Police Service that corrupt judicial and Police Service and officers others are flashed out of the system if this fight is to succeed,” he said.

Meanwhile, Mr. Nsundwe said there is a need for the New Dawn Government to investigate the gassing incidents witnessed in the country around 2020 and the burning of markets.

He said people behind gassing incidences and burning of markets must face the law.

“In addition to the trust the Zambian people have given the New Dawn Government, the people expect to see to it that they are informed of the alleged perpetrators of gassing incidences and the burning of markets, the country experienced prior to the change of Patriotic Front (PF) Government,” Mr. Nsundwe said.

Man hands himself in to Zambia Police for shooting dead his 28 year old wife

Police in Lusaka have arrested Isaac Chulu aged 33 of Katete in Eastern Province after he handed himself to the Police for shooting dead his 28-year-old wife Modai Mwambazi of Katete.

According to the Police Spokesperson Rae Hamoonga, the incident occurred on Tuesday 18th January 2022 at around 18:00 hours in Kabanana Site and Service in Lusaka.

Mr. Hamoonga said on a fateful day around 07:00 hours, the deceased called her father Clement Mwambazi, and informed him that they were traveling to Lusaka from Katete to sort out their marital disputes which the couple was facing.

He said according to the father of the deceased, around 18:00 hours upon arrival in Kabanana Site and Service in Lusaka in the company of a marriage counselor and friend to the suspect, they sat to discuss the matter.

Mr. Hamoonga explained that while they were discussing, the suspect went outside the house and was followed by his wife and suddenly a gunshot was heard and the father went to see what was happening only to find his daughter lying on the ground and bleeding profusely from the head.

He said immediately after that, the suspect, marriage counselor and the friend to the suspect got into the vehicle which was parked outside and sped off.

Police rushed to the scene picked the victim and took her to Chipata level one Hospital where she was pronounced dead upon arrival.

The body of the deceased has been deposited in the Mortuary awaiting postmortem and burial.

The Summoning of KBN TV Journalists by Zambia Police gets condemnation

THE Zambia Institute of Independent Media Alliance (ZIIMA) has said that it is appalled by the police call-out issued to KBN TV, a private TV station in the Republic of Zambia, barely a day after exposing what is alleged to have been a conversation between a State House aide and a Permanent Secretary colluding to kill democracy.

In a statement released to the media by Wilson Pondamali, the ZIIMA Consultant, ZIIMA said that the IBA Act is very clear on complaints handling procedure, and the police call-out is in this case, a clear abuse of state institutions by the government.

Mr Pondamali said that ZIIMA also viewed the police action as an attempt by police to excite their paymaster using wrong dance antics.

Riding on President Hakainde Hichilema’s media freedom pronouncements, ZIIMA called for Zambia police to search their souls and withdraw that form of harassment, adding that the Government must know that there cannot be democracy without a free media, democracy also directs us to uphold the rule of law, and the IBA Act is not an exception.

ZIIMA further shed some light on the IBA complaints handling procedure, in case police were ignorant:

“An aggrieved person shall write to the radio or TV station, highlighting the complaint, and time on which it was broadcast. Upon receipt, the radio or TV station shall respond to the complaint within 14 days. Where the station has not responded within 14 days, or the complainant is not content with the response, the complainant shall write to the IBA”.

“Clearly this has not been done, hence our resolve that this is an act to intimidate the Media, it must be stopped!

“We also call on journalists and media houses across the country to be balanced, objective, verify information that comes their way, and avoid serving interests of politicians as they gather and publish news,” concluded the statement.

Meanwhile, Amb. Emmanuel Mwamba, who was at Police Service Headquarters to offer solidarity to KBN TV, has condemned the remarks made by President Hakainde Hichilema for stating that the “Clique” and “Corrupt” had hijacked the media, adding that such remarks frighten the media who would be forced to choose who to cover.

Mr. Mwamba said that this was a flagrant violation of freedom of expression and freedom of the press and also condemned the summoning of KBN TV Editor. saying the role of the media was to apply news judgment to the material they gather and receive, and air such news after processing.

Mr Mwamba advised the Police to concentrate on the details exposed by the Audio that demonstrate that state institutions were being abused to fight political battles and urged the Police to instead summon State House Special Assistant for Politics, Mr. Levy Ngoma, and Home Affairs Permanent Secretary Josephs Akafumba to answer to those suspected criminal charges.

Zambians are pleased with the policies of the New Dawn Government of President Hichilema-Mike Mposha

Minister of Water Development and Sanitation Mike Mposha says the people of Zambia are pleased with the policies of the New Dawn Government of President Hakainde Hichilema.

Mr. Mposha, the Munali Member of Parliament, said the United Party for National Development (UPND) Government is already fulfilling its campaign promises.

He cited provision of free education, increased Constituency Development Fund allocation and release of Local Government Equalization Fund as some of the development the UPND Government has so far delivered.

Mr. Mposha was speaking to UPND supporters after escorting the party candidate in the Kabwata Parliamentary by-election Andrew Tayengwa to file his nomination on Wednesday.

He said the UPND National Management Committee made a wise decision to again field Mr. Tayengwa in Kabwata Constituency.

“The people of Munali banituma kuti ni kuuzeni kuno ku Kabwata that nchito yo chita replace the late Mkandawire yayamba. Mu August when we had general elections, here in Kabwata we re-soundly voted for Levy Mkandawire. Unfortunately, we didn’t plan for it death took our brother. The party has given us Tayengwa and we are happy that the National Management Committee made a very good decision and we need to go out in Kabwata in all the five wards to deliver victory,” Mr. Mposha said.

He said the UPND Government has silenced its critics by providing free education.

“Wherever we are going our people are very happy with the policies of UPND. They doubted us. Barry (President Hakainde Hichilema) told the people of Zambia that we shall provide free education and PF were arguing. But let me tell you that as we speak now almost all the schools have received money to facilitate free education as schools re-open next week. Like the candidate said we have increased Constituency Development Fund (CDF) from K1.6 Million per constituency per year to K25.7 Million. We want this money to go on the ground in the constituencies to facilitate development,” Mr. Mposha said.

“So there are so many things that your party is already fulfilling. The council workers are now being paid on time. All the councils have received money; the Minister of Local Government is here. The councils have already received the money we call equalization fund. The PF failed to release Constituency Development Fund for 2021; Chilombwana Garry Nkombo came in as we speak all the constituencies have received K1.6 Million for 2021 CDF,” he said.

Mr. Mposha called for conceited efforts in Kabwata Constituency for the ruling party to win.

“This is your working Government. This is your Government which is fulfilling the campaign promises. So we shall work with you as your leaders as your Ministers as Members of Parliament to ensure that we deliver Kabwata in all the five wards,” he said.

Garry Nkombo calls for a peaceful and issue based campaign in Kabwata

United Party for National Development (UPND) Chairman for Elections Garry Nkombo has called for a peaceful and issue based campaign in Kabwata Constituency ahead of the 3rd February rescheduled Parliamentary by-election.

Nine Parliamentary candidates on Wednesday successfully filed their nominations for the Kabwata parliamentary by-election slated for 3rd February 2022.

The UPND has maintained the same candidate Andrew Tayengwa, despite allegations that the party had engineered the cancellation of elections to enable them to field a different and stronger candidate in the Kabwata polls.

Speaking to UPND supporters after the nomination, Mr. Nkombo said the ruling party did not at any time think of changing its Kabwata candidate.

The Minister of Local Government and Rural Development also hailed the peaceful atmosphere noted during the nominations.

“Today we have very few words. The words are that of the doom-Sayers banyala. Bamene banali ku kamba kuti tizachinja candidate banali ku nama. Very short story, some political parties, some political parties, they came and said the UPND are the ones who have engineered this breakdown in the by elections. They are the ones who have caused the stoppage, the postponement of the by-election because they want to change the candidate. Have we changed the candidate? We want to confirm here that we never at any moment thought of changing our candidate because we resolved that ourselves as a party and Andrew Tayengwa as an individual are the winning formula for Kabwata,” Mr. Nkombo said.

“Today is actually a very good day, a defining day, a defining moment where for the very first time in the short history of Patriotic Front we have not seen blood on nomination day, please clap for yourselves. Clap for yourselves again.”

“I want to encourage us to conduct a peaceful, issue based, door to door campaign until the 3rd of February when we are going to escort Mr. Tayengwa to Parliament. I want to thank you through the people of Kabwata, that the marketeers in Kabwata, the bus drivers and conductors in Kabwata, the civil servants in Kabwata have not forgotten that the cadre is no longer in charge,” Mr. Nkombo said.

Mr. Tayengwa thanked the UPND for maintaining his candidature in the Kabwata Parliamentary by-election.

He pledged to deliver victory for the UPND in Kabwata Constituency.

“Nifuna kuonga zdikomo, you the people of Kabwata have spoken but nchito iyamba lelo. We have to go back now and do door to door campaigns. As you know that Tayengwa is a grassroots man so we need to go back mu community so that tichite nchito yatu yamene tiziba,” Mr. Tayengwa said in Nyanja mixed with English.

“This is a very great day for me nionga dzikomo ku chipani kunichita re-adopt again. I want to thank the election chairman (Garry Nkombo) and the Secretary General. I will not disappoint you; I will ensure that victory is delivered to Kabwata Constituency,” he said.

This is the second time nominations for the Kabwata by-election have been held after the Electoral Commission of Zambia canceled the earlier nominations following the withdrawal from the race by former UPP candidate Francis Libanda citing Article 52 of the constitution.

Other successful candidates are Patriotic Front (PF’s) Clement Tembo, Economic and Equity Party President Chilufya Tayali, Democratic Party’s Fred Mubanga and New Heritage Party’s Kennedy Muyoya.

The rest are PeP’s Henry Muleya, United National Independence Party’s (UNIP) Engiwe Mzyece, Socialist party’s Trevor Ng’andu and People’s Alliance for Change’s Sydney Zyambo.

The Kabwata by-election was necessitated by the death of UPND’s Levy Mkandawire in November last year in a road accident.

According to the latest voters register, Kabwata Constituency has 108,729 voters of which 52,401 are males and 56,328 are females.

Transparency International Zambia (TIZ) has urged President Hakainde Hichilema to take immediate, visible, and decisive action against his appointees whom he has discovered to be getting influenced into corruption.

TIZ Executive Director Maurice Nyambe said that action based on evidence and against his appointees found wanting, will consolidate the head of state’s position that he will not allow corruption under his watch.

Mr. Nyambe says it is worrying to hear revelations from the head of state that a clique of criminals who are currently pursued by law enforcement agencies have now started teaching his ministers and permanent secretaries how to siphon money meant for the poor.

He has reminded the government that Zambians elected them into office partly on the basis of their promise to be different from the patriotic front regime under whom corruption was allegedly allowed and at its highest.

Mr. Nyambe added that the President and his ministers must now begin to act towards eradicating corruption beyond just saying the right things without results.

Yesterday, Opposition Patriotic Front Member of the Central Committee in Charge of Information and Publicity Raphael Nakacinda has refuted allegations made by President Hakainde Hichilema suggesting that the PF was teaching UPND Government officials to steal.

President Hichilema on Monday said the clique of criminals whom law enforcement agencies are currently pursuing have now started teaching his ministers and permanent secretaries how to siphon money meant for the poor.

The Head of State said this when he swore in the Teaching Service Commission chairperson Daphne Chimuka and Drug Enforcement Commission (DEC) Director General Mary Chirwa.

But speaking after escorting PF’s Clement Tembo to file his nomination for the delayed Kabwata Parliamentary by-election, Mr. Nakacinda wondered how PF officials would teach corruption the UPND Ministers and Permanent Secretaries whom President Hichilema oriented when coming into Government.

Mr. Nakacinda further commented on the audio circulating on social media purporting that President Hichilema was destabilizing opposition political parties.

“Before I call the acting Secretary-General (Nixon Chilangwa) to invite the Vice President (Given Lubinda) allow me to speak to you about what happened, let me tell you what happened before they cancelled these elections,” he told PF supporters who came to witness the filing in of nominations.

“Yesterday a video came out in which Levy Ngoma implicated the President in something suggesting that it is him who has embarked on a crusade to destabilize opposition political parties.”

“The other day the President was alleging that PF is corrupt but it is his Ministers who are corrupt. He was alleging that some people are teaching his Ministers to be corrupt but is it not Mr. Hakainde who had an orientation workshop with his Ministers? Is it not Hakainde who taught his Ministers? The S.G here is the microphone, I am a trouble maker. Speaking in Bemba can land me in problems,” Mr. Nakacinda said using Bemba and English.

Chishala Kateka weighs in on the Appointment of Ministers’ Wives to Top Corporate Positions

New Heritage party President Chishala Kateka has weighed in on the debate raging on regarding Ministers’ wife being appointed to top corporate positions in Government entities.

In a post on her Facebook page, Ms. Kateka said that even if their wives of relatives of these Ministers are qualified, Ministers need to think about Zambians first.

This week the appointment of Minister of Green economy and Environment Collins Nzovu’s wife, Shezzipe Banda Nzovu as Head of Procurement at ZESCO has attracted criticism from some sections of the society, with some people calling on President Hakainde Hichilema, who is serious about fighting corruption, tribalism, nepotism, cronyism and favouritism, he should revoke the appointments of his ministers’ wives and relatives.

Ms Kateka wondered why should leaders only leave a trail of looting, which only comes to the attention of the public after they leaders leave office, rather than leaving a trail of achievements.

When will our Ministers be in the news for the right reasons?
In our nation, when a Minister is in the news, it is usually for the wrong reasons.
Just when will our Ministers, current and former, be in the news because they have done what they are supposed to do? Why must our Ministers nearly always be associated with corruption, nepotism or some other (social) scandal?
We are tired. Could our leaders please bear in mind the fact that they have a duty to the Zambian people to serve them to the best of their ability!
A Minister’s role includes but is not limited to the following:

    • directing government policy and making decisions about national issues
    • spending a lot of time discussing current national problems and how these can be solved
    • presenting proposed laws—from their government departments.

The above should leave very little time for what our leaders are now becoming well known for. Why should leaders only leave a trail of looting…which only comes to the attention of the public after these leaders leave office – rather than leaving a trail of achievements?

In addition to the above Why on earth would the appointing authorities appoint members of the same family to top positions in a country where there are so many people that need jobs?

Even if those family members are qualified, wisdom dictates that you think about perception. What will the man on the street think about such appointments? And what is this appointing of your relatives to Procurement Departments?

All this is very upsetting. When given an opportunity to lead this nation, please think about the Zambian people first!!!

Privatisation – Deconstructing the myth, lies and truth

The new year is still in infancy yet the disinformation mill across Zambia’s political divide is already in overdrive showing no signs of abating.

Despite the copious amounts of information dominating our discourse, truth is in short supply. As the adage goes, lies have short legs and often carry punitive consequences once uncovered. This old-age aphorism provides the biggest incentive for truth yet politicians serving in both government and the opposition and who supposedly carry a weightier responsibility to truth still feel no compunction for lying.

This reminds of Amilcar Cabral – that doyen of sound leadership whose caution to his peers still finds resonance in contemporary politics. ‘Tell no lies and claim no easy victories,’ was his refrain. Straight to the point, why is Information Minister Chushi Kasanda trying to hoodwink the public to believing that the so-called unbundling or rationalisation of state-owned entities is nothing but an exercise in futility? Far from it, this process has an endgame.

Call it by any other name, privatisation is back. If the state has its way, Zesco and Indeni will soon be on the chopping block in readiness for sale to interested equity partners. Konkola Copper Mines (KCM) will follow suit and so too will Mopani Copper Mines (MCM) among a raft of other ailing parastatals. It’s troubling then that government is failing and lamentably so to articulate a concise position ceding the high moral ground to scaremongers. Is there reason then for government’s spirited attempt to spin the obvious?

Why is the government obfuscating facts?

It’s true that Zambia’s electorate abhors privatisation cited for eroding the country’s industrial base which in turn resulted in extensive job losses in the early 90’s. Today, odors of unemployment, and poverty characterise most towns on the Copperbelt – once the country’s manufacturing hub. Against the temptation to pronounce on his complicit or innocence there-off, it’s indisputable that the ghost of privatisation and alleged profiteering from sale of state entities still haunt the incumbent President.

This may well explain the state’s lackadaisical approach to facts on the fate of these firms. To what extent then is buttressing the truth helping government? You wonder. The steady erosion in public trust on this issue is largely the result of a yawning gap for truth. This has also created a window for perceptions to fester. Don’t forget. In politics, perceptions equate to reality. It shouldn’t, therefore, surprise if speculations of possible ill-motive or corruption begin to circle this process.

The painful reality though is that these moribund parastatals require fixing. And Finance Minister, Situmbeko Musokotwane ought to be forthright; perhaps he should assume a lead role in communicating the rationale behind the imminent sale of these firms. There is no need to defend the indefensible. A spade is a spade and can’t be called a big spoon by any stretch of imagination.

Some questions. Other than rubbishing a process that could potentially save these companies, have critics thoroughly interrogated the rationale for privatisation or are they merely opposed to the process because a much-maligned global financial lender has asked the state to reign in on these companies’ financial drain to the fiscus?

And so what if the sale of these entities is being instigated by the International Monetary Fund (IMF) as a conformity to the recently signed staff level agreement (SLA). Is it not fact that Zesco, Indeni, KCM and MCM can’t function without cash injections from the state? How sustainable is it for the state to keep pumping money into bottomless pits? Isn’t this hostility a classic example of shooting the messenger and not the message.

The case for privatising Zesco

Paradoxically, critics of the sale of these firms served in previous governments yet failed to provide tangible solutions to save these companies. Truth is that fundamentals on the demand and supply side have changed. As such, Zesco’s nearly 40-year-old business model in which the power utility owns the entire value chain from generation, transmission and distribution is obsolete.

Forget load-shedding, the generation side of its business is battling to meet demand and even when it has excess capacity from independent producers such as Maamba Collieries, its grid suffering from years of neglect is incapable of carrying excess load. For long, Zesco’s inefficiency has impeded economic development. Is there value in sustaining a monopoly that can barely keep the lights on?

Splitting this company into three independent firms which would be generation, transmission and distribution with the state maintaining a majority stake in each of the new entities is worthy a consideration. Laden with massive debt, this firm is in desperate need of recapitalisation which can only be offered by new investors. Unbundling Zesco will also create competition and allow for new players including those in the renewable energy space to enter the market. Need we explain more?

Hand back KCM to Vedanta

What purpose has the liquidation of this company served except to decimate more jobs in a town battling severe unemployment? Government should simply hand back the company to its rightful owners and negotiate a new service level agreement (SLA). Vedanta may have breached contractual obligations but the state has no right to appropriate an asset that was rightly paid for by an investor. There is no better opportunity than now for government to re-engage Vedanta on fresh terms. Aside from a few controversies that have dogged the company over the years, Vedanta has some of the best run mining entities spread across the globe – all the state requires is to enforce a win-win SLA.

Sell Mopani

The prognosis for MCM looks dire which perhaps explains why its majority shareholder Glencore opted to flee this investment after depleting much of the company’s ore body at the Nkana and Mufulira mines. The remnant ores at the two mines, occur at great depth and is too costly to extract. At Mufulira mine alone an unavoidable investment of US$300 million is required to continue with operations.

Against competing needs of the public, does the state have the luxury of spending such money on a single mine? Even a zero-tax rate demanded by mining houses won’t wash away MCM’s liquidity crisis. A similar situation pertains at KCM’s Konkola mine (ore at Nchanga is virtually exhausted). The less written about Indeni the better.

So why should the government keep such cash guzzlers in its fold instead of selling them to investors that are willing to sweat and turn these assets to profitability?

CEC Says it Strongly Refutes Claims made by Dr Mbita Chitala About ZESCO Capture

Copperbelt Energy Corporation Plc (CEC) has said that allegations and claims made against the company by Dr. Mbita Chitala, the immediate past Board Chairman of ZESCO Limited in his book, ‘Corporate Capture: The Political Economy of Electricity Management in Zambia (How Not to Manage a State Enterprise)’, do not have merit.

In a statement made available to the media by Chama Nsabika, Senior Manager Corporate Communication, CEC said that the integrity of the book, which is purported to contain information suggestive of a CEC scheme in the alleged corporate capture of ZESCO, is questionable and that it is extremely disappointing that Dr. Chitala chose to make such serious and unsubstantiated claims against a company bound by strict disclosure obligations as a listed entity, whose information can easily be verified.

CEC STRONGLY REFUTES CLAIMS MADE BY DR. MBITA CHITALA

CEC is deeply concerned by the claims made by Dr. Mbita Chitala, the immediate past Board Chairman of ZESCO Limited (ZESCO), in his recently released book; ‘Corporate Capture: The Political Economy of Electricity Management in Zambia (How Not to Manage a State Enterprise)’.

The integrity of the book, which is purported to contain information inter alia suggestive of a CEC scheme in the alleged corporate capture of ZESCO, is
questionable and the claims made against CEC are meritless. It is extremely disappointing that Dr. Chitala chose to make such serious and unsubstantiated claims against a company bound by strict disclosure obligations as a listed entity, whose information can easily be verified.

As one of the leading listed companies on the Lusaka Securities Exchange (LuSE), CEC adheres to strong corporate governance principles and conduct and has clear, transparent and honest communication and disclosures.

Whatever Dr. Chitala’s motives, it is clear that he makes several contradictions, misstatements, omissions of fact, and repositioning of narratives to lead the reader to a particular conclusion.

Dr. Chitala openly acknowledges various schemes, including the establishment of a new Special Purpose Vehicle, which was considered to take over CEC while he was Chairman of ZESCO.

He provides two detailed options which he sketches out in the book. This could explain his motivation to undermine CEC so as to bring its value down
and possibly take over the Company on the cheap. We are continuing to study the book systematically and are still seeking legal guidance on some of the allegations and inaccurate statements.

However, in the interest of transparency, we would like to highlight a few of the allegations and inaccurate statements:

• Throughout the book, Dr. Chitala tries to build the narrative that CEC’s shareholding is dominated by foreign interests.

In Table 60, he presents a “CEC shareholding at becoming public” which is completely fabricated.

Two shareholder groups in the table which he credits with a combined 45.1% shareholding in the Company were not even shareholders of the Company at the time.

ZCCM-IH and ZECI, two entities representing Zambians, held over 72% of the shares which is not captured therein.

In Table 61, he again continues with the misrepresentation showing shareholding in 2018 with ZCCM-IH at 13.25% instead of 20%.

CEC is a listed company on the LuSE and, therefore, its shareholding is a matter of public record and easily verifiable by anyone.

It is surprising that Dr. Chitala, whose biography at the beginning of the book refers to him as, “a registered Finance and Investment Adviser with the Zambian Securities and Exchange Commission” couldn’t verify this basic information which he relies on to make a key argument in his book.

• An allegation he makes consistently is that CEC disadvantages ZESCO by paying a suboptimal tariff. Dr. Chitala contradicts himself with regard to what the actual tariff CEC pays ZESCO.

On page xvii, he states, “[ZESCO sold] to the mines through CEC at an average tariff of US$c 6.33/kWh. This was simply poor business.” Yet on page 114, he states, “Under the BSA, CEC obtained power from ZESCO at an average tariff of US$c 8.11/kWh.” If the Chairman of ZESCO for 5 years is not clear what their largest customer buys power at, why should we expect any different from those he reported to? No wonder Mr. Ronald Chitotela recently argued in Parliament that under the BSA, ZESCO sold power to CEC at US$c 3/kWh.

• CEC – Mopani Tariff Negotiations of 2017. Dr. Chitala on page 148 writes: “Until I left ZESCO, CEC had not concluded its tariff discussions with Mopani and failed to provide any progress to ZESCO or government.”

This is, again, another blatant lie by Dr. Chitala. The truth is that CEC and Mopani completed these negotiations within 2017 and signed an addendum to their Power Supply Agreement (PSA) reflecting the agreed changes in tariff.

It is again difficult to understand the motive behind blatant lies as presented on this subject by Dr. Chitala.

Following the signing of the addendum between CEC and Mopani, CEC proceeded to inform both ZESCO and the Government and proposed a draft addendum to the BSA
to ZESCO.

However, under the leadership of Dr. Chitala, ZESCO was unwilling to review the addendum from CEC nor to sign it.

• Dr. Chitala makes a claim that the BSA through Clause (b) (i) and (ii) gave exclusivity of supply to CEC on the Copperbelt to the detriment of ZESCO and its business.

In similar fashion as all the other points that Dr. Chitala raises as issues that ZESCO had with the BSA, what has been presented in the book is, unfortunately, nothing but misrepresentations and half-truths.

However, for brevity, we will only cover the issue dealing with exclusivity of supply because of its alleged business implications on ZESCO.

On page 97, he writes: “Clauses 10 (b) (i) and (ii) gave Exclusivity of Supply by CEC to the Copperbelt and was bad as it was discriminatory and violated all laws of commence.

By this clause CEC was granted an ‘exclusive franchise’ for the supply of power on the Copperbelt.

This entailed that only CEC could supply all mining and mining related activities. This exclusively was very restrictive and provided a monopoly to CEC with regard to supply of power to the mining customers on the Copperbelt, a position not commercially viable.

Further, the said clause prohibited ZESCO from constructing, owning or operating transmission and distribution lines in these MineCo sites.

The net effect of the foregoing was that ZESCO became restricted in owning or expanding its network on the Copperbelt.

Section 8 of the Competition and Consumer Protection (CPC) Act, prohibited Parties from entering into Agreements that restrict competition.”

However, Dr. Chitala completely omits an important aspect of the BSA contained in Clause 1 (a) (iii) which prohibited CEC from purchasing the power it supplied to its mining customers from any other source but ZESCO, unless in situations where ZESCO had no capacity to supply CEC’s power requirements.

The BSA, therefore, exclusively reserved the Copperbelt mining market for ZESCO’s power and, thus, solidly protected ZESCO’s business interest in this respect. It was always clear that under the BSA, CEC could not and did not buy power from any other company but ZESCO.

• Dr. Chitala makes various claims of CEC owing ZESCO an amount ranging from US$225 – 325 million.

On page xxix, he pegs CEC’s alleged owing to ZESCO at US$325 million and on page
120, when discussing his proposal for ZESCO to acquire CEC, he states, “ZESCO would have to pay a cash price of US$288 million.

However, ZESCO also noted that CEC owed ZESCO about US$257.1 million and that this amount would be used to offset the price for the purchase of any ordinary shares from CEC.”

However, Dr. Chitala goes on to contradict himself on page 124 by stating that the purported money that CEC owes ZESCO is the subject of Judicial Review proceedings in a case brought by the Chamber of Mines
against the Energy Regulation Board (ERB) in 2014.

Dr. Chitala states, “If the ERB decision is determined to be lawful by the Zambian High Court, ZESCO would be entitled to claim US$ 225 million from CEC.” Worth noting is that CEC would also be entitled to claim a similar amount from the mines in such a case.

Further, Dr. Chitala omits to state that the decision of the ERB, while being the subject of the ongoing judicial review, has also been stayed by the High Court.

• Dr. Chitala misrepresents a number of the court cases involving the companies.

1. Common Carrier Proceedings (Statutory Instrument 57 of 2020) – this is a matter in which CEC commenced judicial review proceedings against the then Minister of Energy’s decision to declare CEC’s transmission and distribution lines as common carrier on 29 May 2020.

Dr. Chitala selectively does not take the reader through to the final outcome but rather chooses to end with the following; “The court of appeal refused to grant CEC an order of stay of execution of the Minister’s statutory directive. This meant that ZESCO would be enabled to use CEC’s assets to supply KCM and other mining companies on the Copperbelt who so wished at a tariff set by the ERB and the CEC action appeared to be
academic actions with no legal import.”

The real final outcome is that High Court Judge Elita Phiri Mwikisa found that the applicant (CEC) succeeded on all grounds and accordingly quashed the decision of the Minister of Energy to declare its transmission and distribution lines as common carrier (SI 57).

In a 71 page judgement, Judge Mwikisa stated, “whereas the Applicants concede that the minister does have power under section 15 (1) to declare a transmission line as a common carrier, they argue that he does not have power to declare the entire interconnected
power system as common carrier and that he acted in excess of his powers.

The Applicants contend that this action by the minister amounts to expropriation. I tend to agree with the submissions of the Applicants to the extent that the Minister’s decision was ultra vires as he acted in excess of his powers,”

2. ZESCO and KCM Injunction – this is a matter in which ZESCO and KCM were granted an ex-parte injunction against CEC which stopped CEC from interfering with the supply of power by ZESCO to KCM following the expiry of the PSA between CEC and KCM. CEC counterclaimed, accusing ZESCO and KCM of colluding, which led to CEC not being paid US$144 million relating to unpaid invoices for power CEC had supplied to KCM under their PSA.

Again, Dr. Chitala selectively does not take the reader through to the final outcome but rather chooses to end with the following, “ZESCO considered the CEC action as groundless, not least since ZESCO had not been privy to that PSA and was itself free as the Electricity Act 2019 provided to compete for business.”

The final outcome is that the matter came up for a status conference in August 2021 at which both ZESCO and KCM informed the court that they were discontinuing their actions following the quashing of SI 57 of 2020 by the High Court upon which they had grounded their respective claims.

ZESCO finally filed its notice discontinuing the action.

We are deeply concerned with the way Dr. Chitala’s book is positioned and with its depiction of CEC. Our Board is discussing any additional action the Company could take, about which our stakeholders will be
informed accordingly.

CEC remains committed to transparency and full disclosure.

The Company reassures all its stakeholders that it is engaging constructively with the new Board and Management team at ZESCO, the Ministry of Energy and the ERB with the key objective of advancing the interest of the sector in a fair and equitable manner.

9 Candidates successfully filed in their nominations as UPND maintain the same candidate

Nine Parliamentary candidates have successfully filed in their nominations for the Kabwata parliamentary by-election slated for 3rd February 2022.

This is the second time nominations for the Kabwata by-election have been held after the Electoral Commission of Zambia canceled the earlier nominations following the withdrawal from the race by former UPP candidate Francis Libanda citing Article 52 of the constitution.

The ruling United Party for National Development (UPND) has maintained the same candidate, despite allegations that the party had engineered the cancelation of elections to enable them to field a different and stronger candidate in the Kabwata polls.

The successful candidates are PF’s Clement Tembo, EEP’s Chilufya Tayali, Democratic Party’s Fred Mubanga, New Heritage Party’s Kennedy Muyoya. Others are PeP’s Henry Muleya, UNIP’S Engiwe Mzyece, Socialist party’s Trevor Ngandu and People’s Alliance for Change’s Sydney Zyambo.

Speaking to journalists, UPND candidate Andrew Tayengwa says people will vote for him due to the number of achievements the UPND has scored thus far.

Meanwhile, Opposition Patriotic Front Member of the Central Committee in Charge of Information and Publicity Raphael Nakacinda has refuted allegations made by President Hakainde Hichilema suggesting that the PF was teaching UPND Government officials to steal.

President Hichilema on Monday said the clique of criminals whom law enforcement agencies are currently pursuing have now started teaching his ministers and permanent secretaries how to siphon money meant for the poor.

The Head of State said this when he swore in the Teaching Service Commission chairperson Daphne Chimuka and Drug Enforcement Commission (DEC) Director General Mary Chirwa.

But speaking after escorting PF’s Clement Tembo to file his nomination for the delayed Kabwata Parliamentary by election, Mr. Nakacinda wondered how PF officials would teach corruption the UPND Ministers and Permanent Secretaries whom President Hichilema oriented when coming into Government.

Mr. Nakacinda further commented on the audio circulating on social media purporting that President Hichilema was destabilizing opposition political parties.

“Before I call the acting Secretary General (Nixon Chilangwa) to invite the Vice President (Given Lubinda) allow me to speak to you about what happened, let me tell you what happened before they cancelled these elections,” he told PF supporters who came to witness the filing in of nominations.

“Yesterday a video came out in which Levy Ngoma implicated the President in something suggesting that it is him who has embarked on a crusade to destabilize opposition political parties.”

“The other day the President was alleging that PF is corrupt but it is his Ministers who are corrupt. He was alleging that some people are teaching his Ministers to be corrupt but is it not Mr. Hakainde who had an orientation workshop with his Ministers? Is it not Hakainde who taught his Ministers? The S.G here is the microphone, I am a trouble maker. Speaking in Bemba can land me in problems,” Mr. Nakacinda said using Bemba and English.

Meanwhile, Mr. Nakacinda said the crowd that flanked Mr. Tembo during nominations shows unity in PF.

“Ba Honourable Chishimba Kambwili has come all the way from Luanshya to come and support escort Clement Tembo during the nominations. This unity is what we need in the party and we will demonstrate in Kabwata what unity is able to produce by making sure that Clement Tembo goes to Parliament,” he said.

In his brief remarks, Mr. Tembo reminded PF members that campaigns have again started in Kabwata Constituency following the filing of nominations.

“Let us all be peaceful and go back home safely. Do not forget the campaigns have started today. We are going to give you all the campaign materials in your respective wards. God bless you. Thank you,” Mr. Tembo said.

PF vice President Given Lubinda said:”Ladies and gentlemen, campaigns have started today. I am not going to say a lot because this is a nomination centre. I just want to raise the man the party has chosen to succeed me in Kabwata.”

PF acting Secretary General Nixon Chilangwa urged PF members to respect leaders.

“We have begun the journey to ensure that Clement Tembo wins the elections in Kabwata. Let us all support Clement Tembo. Respect all leaders in the party. Respect Given Lubinda, respect Chishimba Kambwili, and respect Nkandu Luo,” Mr. Chilangwa said

ACC and DEC should exercise professionalism in the execution of their mandates to inspire public confidence-APNAC

The African Parliamentarians Network Against Corruption (APNAC) has noted with serious concern the approach taken by the Anti-Corruption Commission (ACC) and the Drug Enforcement Commission (DEC) in the fight against corruption to continue summoning and arresting suspects, properties ceased while depriving the owners before investigations are concluded.

APNAC Zambia Spokesperson Miles Sampa has said that despite the new dawn government and the President in particular, highly demonstrating goodwill towards the fight against corruption with a resounding call to zero tolerance on corruption, which APNAC fully supports.

Mr. Sampa said that some searches carried out on suspect’s properties though having the blessing of the law, have been more of an ambush with a lot of illegalities such as denying suspects access to follow the proceedings of search as well as denied the right to engage legal representation during the search.

He said that APNAC, therefore, calls on the ACC and DEC to exercise professionalism in the execution of their mandates so as to inspire public confidence which is already eroded or the whole process may be rendered to be an academic exercise and a battle for politics.

Mr. Sampa said that APNAC further requests the ACC and DEC to take interest in the reinstatements of public officers taking place to ensure that the officers being reinstated were not genuinely under some disciplinary action but now conveniently claiming to have been political victims.

APNAC ZAMBIA CHAPTER PRESS STATEMENT ON THE ANTI CORRUPTION COMMISSION (ACC) AND THE DRUG ENFORCEMENT COMMISSION (DEC) 19/01/22

The African Parliamentarians Network Against Corruption (APNAC) Zambia Chapter is a non partisan voluntary body of Parliamentarians established in May 2005.

The main impetus of APNAC is to be a vehicle for coordinating and strengthening Parliamentarians in the fight against corruption and promotion of good governance.

We wish to start by categorically stating that ACC and DEC, both established by Acts of Parliament, stand us our valuable partners in the fight against corruption and therefore we fully support their mandates.

However, we wish to state that we have observed with serious concern the approach taken by ACC and DEC towards the anti corruption fight. The New Dawn government and the President in particular, has highly demonstrated goodwill towards the fight against corruption with a resounding call to ZERO tolerance on corruption and this we fully support as APNAC. He has also been very categorical that while we pursue the perceived corrupt, be it in the past , the present and the future, there is need to uphold the rule of law. Emphatically, no arrests should be entertained before investigations are concluded.

In view of the foregoing, we find it very unfortunate that suspects continue to be summoned and arrested, properties ceased while depriving the owners even before any investigations are concluded. Some searches carried out on suspects properties though having the blessing of the law, have been more of an ambush with a lot of illegalities. Suspects have been denied access to follow the proceedings of search as well as denied the right to engage legal representation during the search. Undoubtedly, this falls below any good practice.

We therefore, want to call upon ACC and DEC to exercise professionalism in the execution of their mandates so as to inspire public confidence which is already eroded otherwise the whole process may be rendered to be an academic exercise and a battle for politics.

We further wish to request ACC and DEC to take interest in the reinstatements of public officers taking place to ensure that the officers being reinstated were not genuinely under some disciplinary action but now conveniently claiming to have been political victims. We also wish to call for investigations into some seemingly improper appointments of public officers especially those alligned to top Government officers such as Minister or MPs.
We undertake to ensure no one is above the law in our quest to advocate against all forms of Corruption be it petty, institutional or grande.

Going forward, We demand that DEC should change its name to one that does not restrict them to only drugs related issues but to the fight against all white collar crimes. We are further of the strong view that the new DEC should be of equal institutional standing as ACC as opposed to being a parallel crime unit but with junior or lower powers. With this approach, there will be accountability and transparency between ACC and DEC and able to investigate each other if and when need arise as happens with CIA and FBI in the USA.

We finally wish to reiterate our position of continuously working and partnering with ACC and DEC as we carry out this noble cause for our Country and Continent.

Liswaniso warns UPND youths against inciting fellow youths to rise against the party and its leadership

UPND National Youth Chairperson, Gilbert Liswaniso has called on youths in the party to desist from inciting fellow youths to rise against the party and its leadership.

And Liswaniso has warned that the youths would not sit back with hands folded and watch members of the opposition wage unjustifiable attacks on President Hichilema.

Addressing the Press at the UPND National Youth Command Center in Lusaka on Tuesday, Mr Liswaniso stressed that he has noted with regret how named opposition political parties have taken to unfairly and unjustifiably defaming the name of the President for political expediency.

Mr Liswaniso, who emphasized that President Hichilema was aware of the numerous economic challenges that the youths in the party and the country were facing, stressed that the there was no need for Zambians to stress as the Head of State had only done about a quarter of available appointments in the civil service.

He also called on the youths to abide by the party guidelines on forming co-operatives, stating that those who wanted quick benefits would only jeopardize the operations of Government and its endeavours to deliver development for all Zambians.

“As much as we want quick benefits, we should be aware that this will in the long run affect our well being. We have the pressure from our youths and this calmness that we see from the youths is because we engage each other,” he said.

He also warned members of the party to desist from attacking the party and Government in public.

“As party members, we should guard against attacking the party in any way. If you’re a genuine member of the party, you should guard against attacking the party and its leadership. If you attack your own political party, tell us…we will give it to you. It is our responsibility to rectify things when they go wrong. We are aware of the high expectations from the youths who turned out in large numbers to vote for change. From the time we formed Government, as the National Youth Chairperson, we have been going round the country to assure the youths that the promises that President Hichilema made would come to pass,” he said.

Liswaniso has since warned of stern action against those who were in the habit of issuing unwarranted attacks against the party, Government and civil servants.

He says those who will be attacking President Hichilema as an individual would be dealt with in their individual capacity.
He also warned members of opposition political parties to desist from fanning confusion and violence in the 3rd February Kabwata Parliamentary by-elections to stay away.
