Chongwe UPND cadres defect to PF

Over 100 United Party For National Development (UPND) members in Kanakantapa ward of Chongwe constituency have defected to the ruling Patriotic front (PF).

Chongwe Member of Parliament Japhen Mwakalombe who received the defectors after watching a soccer tournament for youths in the area commended them for joining PF adding that the party is ready to work with everyone who is willing to foster development in the country.

Mr. Mwakalombe stated that he is pleased to note that a lot of people in Chongwe are joining PF as they appreciate the development which is taking place in the area.

He cited the construction of 55 kilometres of roads and a Police station in Kanakantapa as one of the milestones undertaken by the government to uplift the lives of people in the farming area.

The lawmaker also urged old PF members to embrace new members and work with them at all levels of the party.

He further called on young people in the ward to use their skills in sport as a means of earning a living.

Meanwhile, one of the defectors Joyce Machona disclosed that she has decided to join PF because she is impressed with the development that has been delivered to the area by government.

President Lungu urges church to counsel politicians over rule of law

President Edgar Lungu has challenged the church to counsel politicians to observe the rule of law before, during and after elections.

President Lungu stated that the church has a cardinal role to play in promoting peace and unity in the country.

He said all political players are expected to be patriotic and upon the one Zambia one nation motto.

“And please give all political players counsel to ensure respect for the rule of law during and after the elections.

“We are expected to be patriotic and uphold the one Zambia one nation motto as this will enable us to coexist during this period,” he said

The President urged the church to pray for a peaceful elections as the country gears up for campaigns next week ahead of the August 12 polls.

President Lungu stated that the church has a significant role to play in fostering peace and harmony in the country.

He said as a country, Zambia is known for its record of peace in the region and at global level.

President Lungu has since urged Zambians to strive to uphold the record and to coexist regardless of political divergent views.

“Let’s us respect other and associate with each other even when we differ in affliction of political parties,” said the President.

The Head of State said this when he graced the construction of the BIGOCA multipurpose facility in Lusaka’s Barlastone area.

And President Lungu has implored political parties to observe COVID-19 guidelines ahead of campaigns next week.

He reminded the gathering that COVID-19 has claimed a lot of lives and continues enhance the need to observe the guidelines.

President Lungu hoped that political plays will adhere to the guidelines to be provide by the Electoral Commission of Zambia and the Ministry of Health.

President Lungu said there is need to observe COVID-19 guidelines by all political players so as to avoid flaring of COVID cases in the country.

And speaking at the same event Minister of National Guidance and Religious Affairs Godfridah Sumaili encouraged churches to seize the opportunity by building beautiful church buildings.

Rev Sumaili also informed the gathering that the construction of the house of national prayers has progressed.

Meanwhile BIGOCA General Overseer Archbishop Peter Royd Ndhlovu disclosed that 300 direct and indirect jobs are going to be created within the surrounding community.

Dr Ndhlovu expressed optimism that livelihoods of the local will be improved as a result of the construction project.

He cited the construction of a community school and a clinic as some of the immediate benefits that will be passed to the community of Barlastone.

Acquaint yourselves with electoral rules, stakeholders prodded

Kabwe District Electoral Officer (DEO), Joel Shawa, says it is imperative that stakeholders acquaint themselves to the electoral rules.

Officially opening an Electoral Commission of Zambia (ECZ) nomination briefing at the Civic Centre this morning, Mr Shawa said it is imperative that stakeholders especially candidates must be taken through the steps of filing in their nominations to avoid hiccups.

He urged the stakeholders to be very attentive during the proceedings and ask questions in order to be armed with the right electoral information.

“It will be sad and unfair for an aspiring candidate to fail to file nominations even after being briefed,” Mr Shawa said.

He said aspiring candidates should pay particular attention to the opening and close time on the nomination day to void being disadvantaged.

“Once the returning officer has announced that the nomination centre has closed, there are no negotiations. If you show up out of the stipulated time, do not bother the officer because we are guided by rules,” he said.

Aspiring candidates from the ruling Patriotic Front (PF), Socialist Party, the Movement for Multiparty Democracy (MMD), the United Party for National Development (UPND), National Democratic Congress (NDC) and the National Party for Progress attended the briefing meeting.

Meanwhile, Kabwe Municipal Council (KMC) Senior Health Inspector, Humphrey Munsanje, has advised political players not to drop the guard against the COVID 19 pandemic.

Mr Munsanje said all stakeholders especially political parties should encourage their members to continue abiding by the COVID 19 golden rules.

He also reminded aspiring candidates from various political parties and other stakeholders that the COVID 19 vaccines are now available and those willing can access them at various health facilities.

Government to consider Chinese Covid-19 vaccine

Government will consider adding Chine’s Sinopharm COVID-19 vaccine to its basket of vaccines to ensure adequate doses for the eligible population in Zambia.

This follows World Health Organisation (WHO) approval of the Sinopharm COVID-19 vaccine and added it to the list of vaccines, which is a prerequisite for a potential COVAX roll-out.

Minister of Health Jonas Chanda says Sinopharm is in use in over 100 countries with millions of people vaccinated and it is a safe and efficacious vaccine.

Dr Chanda expressed delight to note that great improvement in the flight concerning the COVID-19 vaccination uptake by Zambians especially the frontline workers.

‘’We are elated to see many ordinary people including our service providers in our markets and bus stations follow their leaders in accessing the COVID-19 vaccine, ’’ he said.

Dr Chanda indicated that in the last 24 hours 5,787 persons have been vaccinated with the AstraZeneca-vaccine bringing the total of all vaccinated so far against COVID-19 to 77,348.

He further urged all the political parties to be a part of the positive response in tandem with the COVID-19 prevention guidelines to ensure safety from COVID-19 before, during and after elections and indeed any other incidences as the country goes into the campaigns and elections processes.

“We are elated to report the positive receipt of COVID-19 guidelines by the different parties after a team of technical experts from the Ministry of Health Headquarters and Zambia National Public Health Institute participated in the Electoral Commission of Zambia led engagement with the political party leaders and other related stakeholders,” Dr Chanda said.

He further disclosed that in the last 24hours Zambia reported 53 new confirmed COVID-19 cases out of 4,325 tests conducted bring the cumulative number of confirmed cases recorded to date to 92,057.

“Currently there are 33 patients admitted to our isolation facilities in the country. Among these 30 are on Oxygen therapy of whom 3 are in critical condition and the country has recorded one COVID-19 related death bringing the cumulative of death recorded to 1,257 to date,” Dr Chanda said.

Ministry of Health commissions two health facilities in Ndola

Minister of Health, Jonas Chanda has officially opened Kantolomba Health center in Kantolomba ward and Mwenye health center in Chichele ward of Bwanamkubwa constituency in Ndola district.

Speaking when he commissioned the two health centers, Dr.Chanda said government aims at bringing quality health services closer to the people that is why with the help of the Ndola City Council and the citizens in the area have managed to construct the two health centres.

Dr. Chanda who is also Bwanamkubwa Member of Parliament said in 2016 he promised to construct health centers in Chichele and Kantolomba, and has now fulfilled it.

“The two health posts have been constructed with the constituency development funds,” he said.

Dr.Chanda said the two health centres have all the equipment and health personnel will be running 24/7.

He further added that a total of K586, 962, 28 was spent on the Mwenye Health center while K568, 975,000 was spent on the construction of Kantolomba health center.

And Acting Provincial Health Director Charles Sakulanda thanked the ministry of health for making it possible for the people to have health services within their locality.

Dr. Sakulanda further encouraged the people to take the COVID 19 vaccine to avoid the contraction and spreading of the coronavirus.

He said health practitioners will now be in public places such as markets bus stations to allow more people get vaccinated.

Meanwhile Mary Bwalya a resident of Kantolomba Township has thanked government for opening up a health center which has a maternity wing in the area.

Ms Bwalya said people used to go as far as Lubuto and Twapia which are over 6 kilometers away from the township.

“We are grateful that we will not have to move as far as twapia health clinic to acquire health services”, she said

Media urged to demystify Covid-19 vaccine

The Ministry of Health in the Northern Province has challenged the media to help sensitize the public on the Covid 19 vaccine in order to generate demand from the people.

Provincial Health Director, Lawrence Phiri said the media as agents of change should help to create awareness to the public so that people can start accessing the vaccine.

He indicated that the media is a critical stakeholder and a valuable source of information for the masses as it cuts across boundaries.

Dr. Phiri explained that it is therefore important for the media to develop clear, accurate, and consistent communication which is responsive to people’s needs and influences positive behavior towards the vaccine.

“There are a number of myths and misconceptions about the safety and efficiency of the vaccine but it’s your role as the media to ensure that you help in addressing any misconceptions, disinformation and rumors concerning the vaccine,” he said.

Dr. Phiri said this during a media engagement meeting on COVID-19 vaccination held at Ludo Lodge in Kasama district.

Meanwhile, the Provincial Health Director has expressed happiness with the response of people in Nsama and Mporokoso districts towards the vaccination exercise.

He said the two districts have seen a positive attitude by people in accessing the vaccine adding that this is a tremendous effort in ensuring a smooth delivery of Covid-19 vaccine to priority groups.

Dr. Phiri said this is an indication that people in the two districts understand the importance of the vaccine in mitigating the negative effects of the pandemic on the economy.

“ The introduction of Covid-19 vaccine alongside consistently advocating for COVID appropriate behavior of wearing masks, washing hands, maintaining physical distance, prompt testing and isolation is a major step towards reducing the spread of the pandemic and further reducing the associated disease and deaths.” He said

And speaking at the same meeting Emmanuel Banda who represented media personnel said such engagements are helpful to journalists in the province as they are an important stakeholders in the fight against the Covid 19 pandemic.

He said the engagement meeting has empowered the media with skills and information that will enable them to educate the public on the vaccine and create confidence in the exercise.

Mr. Banda noted that the myths, rumours and misconceptions have taken center stage in the uptake of the Covid-19 vaccine hence the need for media personnel who are experts in communication to disseminate correct information to the grassroots.

Elections briefing important – ECZ

Mwinilunga District Electoral Officer Kennedy Kazanda says nomination briefings are an important exercise during any election period as they help in contributing to smooth running of an election and enhance democratic practices.

Mr Kazanda said this during the August 12th, 2021 general elections stakeholders’ nominations briefing meeting held in the district today.

He said the exercise is tailored to equip electoral stake holders with information that will help aspiring candidates especially to lodge in their nominations without any challenges.

He said Electoral commission of Zambia (ECZ) does not want confusion during nomination hence wants to ensure everyone knows what to do when filing in so that they are not disqualified.

“We do not want confusion during nomination, that is why this meeting has been called for you to know in advance what you are required to present,” he said.

Mr Kazanda said nomination briefings is one of the series of important activities culminating into Election Day.

He reminded aspiring candidates and political parties to know all the wards and polling stations in the district including newly delimitated ones as it will help them manage their campaigns and election activities in general.

Mr Kazanda urged stakeholders to take note of changes which have taken place pertaining filing in nomination in this year’s elections such as the Grade12 certificate or its equivalent requirements.

“Ask all questions here, this is where you will get the correct information not elsewhere,” Mr Kazanda said.

He requested stakeholders present in the meeting to get all necessary clarifications as it is the only official platform where they can be given accurate and correct information pertaining election nominations as opposed to getting information from outside sources.

The nomination briefings are being held country wide in preparation for filing in nominations for the August, 12, 2021 general elections scheduled to start on May 17th, 2021.

Tourism key in socio-economic development – President Lungu

President Edgar Lungu says tourism plays a key role in the social and economic development of the country through wealth and employment creation.

President Lungu said the country is moving on a positive trajectory towards attainment of the tourism master plan.

The Head of State explained that Chitambo district like many other sites in the country has to be fully harnessed in order to propel both local and international tourism.

President Lungu made the remarks in Chitambo district Friday afternoon when he opened the Visitors information center in honor of late Christian missionary David Livingstone.

“Let us all be champions of promoting domestic tourism as it will help the country in job and employment creation. We should also hail the role that local people played in the preservation of this heritage,” President Lungu emphasized.

The President pointed out that tourism industry needs to continue diversifying in order to create visibility.

And Tourism and Arts Minister Ronald Chitotela hailed the British government for the support to the Sector.

Mr Chitotela was quick to mention that President Lungu is the champion of tourism as he is the second head of state to have visited Chitambo village.

He pointed out that all roads leading to sites will be rehabilitated.

And British High commissioner to Zambia Nicholas Woolley and Senior Chief Chitambo hailed government for the memorial centre.

The duo noted that the center will enhance the flow of people visiting the Chitambo village.

President Lungu has since returned to Lusaka.

Government to enforce laws on garbage collection

Vice President Inonge Wina has implored the Local Authorities to ensure that environmental laws are observed when business houses are engaged in the collection of garbage.

She was responding to a question by Nakonde Member of Parliament Yizukanji Siwanzi, who wanted to find out if government has plans of regulating garbage collection following the bad practices among garbage collectors.

Agreeing to the status, Mrs. Wina said government will look into the issue to ensure that there is environmental protection wherever there are mounts of garbage.

The Vice President explained that the Ministry of Local Government has by-laws pertaining to the collection and disposing of waste.

She noted that the bad practices in garbage collection could be as a result of low compliance among garbage collectors because the Local Authorities are not enforcing the law.

“We are urging the ministry concerned to ensure that they observe the enforcement of these by-laws among garbage collectors,” Mrs. Wina directed.

Mr. Siwanzi commended some men and women who have ventured into the business of garbage collection but that the manner in which the service is being carried out was worrisome.

He noted that garbage collectors are not using the right vehicles among other equipment to collect and dispose of the garbage.

He cited some cases where garbage collectors carry waste unsecured and passing through food markets and eating places thereby causing a health hazard in terms of infection and pollution to the community.

He wondered if government had any plans of instituting any laws to regulate the sector

“Does government have any plans to regulate this particular sector as I have seen that even their workers are working without protective gear,” Mr. Siwanzi submitted.

In 2018, Parliament enacted the Solid Waste Regulation and Management Act, 2018, Act Number 20 of 2018. An Act to provide for the sustainable regulation and management of solid waste; general and self-service solid waste services; the incorporation of solid waste management companies and define their statutory functions; the licensing and functions of solid waste service providers, operators and self-service solid waste providers and provide for their functions; the regulation, operation, maintenance and construction of landfills and other disposal facilities; the setting and approval of tariffs for management of solid waste and provision of solid waste services; and matters connected with, or incidental to, the foregoing.

ERB urges motorists to ignore fuel shortage rumours

The Energy Regulation Board (ERB) has urged motorists to ignore false fuel shortage rumours circulating on some social media platforms.

ERB Public Relations Manager Kwali Mfuni says motorists should ignore unofficial statements regarding the fuel supply situation and avoid panic buying as that would create an artificial shortage of fuel in the country.

This is after rumours of a purported looming fuel shortage circulating some social media platforms, which have potential to create panic and exert pressure on the country’s fuel supply chain.

‘’Such rumours are of great concern, particularly because the measures being put in place to address challenges affecting the steady supply of fuel, particularly diesel in some parts of the country in the recent past, are beginning to bear fruits, ’’Ms Kwali noted.

She indicated that recent official communication from ERB regarding the fuel supply situation in some parts of the country, has not only acknowledged some challenges but also highlighted engagements with concerned parties such as the Oil Marketing Companies (OMCs), transporters and Government agencies to resolve the fuel supply challenges in the affected areas.

Ms Kwali further stated that in order to avert an artificial strain on filling stations motorists are encouraged to desist from panic buying, as that has potential to disrupt normal supply of fuel.

‘’It should be emphasized that the co-operation of motorists is key to the restoration of normal fuel supply, in particular diesel, especially in those areas where challenges have been reported recently, ’’she said.

Ms Kwali added that ERB has temporarily waived the restriction on filing stations offloading petroleum products at night to avert any disruption in fuel supply.

‘’This is in addition to the waiver for petroleum tankers to move at night, which was effected on 29th April 2021 till further notice, ’’she said.

Ms Kwali also encouraged members of the general public to contact ERB on the Toll free number 8484 and inquire on any matters relating to the supply of fuel, or contact any ERB offices in Lusaka, Kitwe, Livingstone and Chinsali.

A Brief History of the Affidavit form for Presidential Candidates

In view of the substantial amendments to the Zambian Constitution in 2016, it followed logically that the prescribed affidavit for a presidential candidate would itself be altered in order to take into account the latest amendments to the Constitution.

The 1996 Amendment had for example, a parentage clause which required a presidential candidate’s parents to have been Zambian by birth or descent. The 1996 affidavit for a presidential candidate had paragraphs reflecting the same. This affidavit was in use from 1996-2015.

The 2016 Affidavit form which came into being through Electoral Process General Regulations, Statutory instrument No. 63 of 2016 dropped some paragraphs which were in the 1996 a Affidavit but were no longer in the Constitution as amended in 2016.

The 2016 affidavit for a presidential candidate also added some new paragraphs which were not part of the 1996 affidavit and were not required by the Constitution as amended in 1996. An example is the declaration of assets and liabilities.

However, the only difference between the 1996 and 2016 affidavits that has even resulted into a Constitutional Court petition is the dropping in the latter of a paragraph which provided that:

“That I have not twice been elected as President.”

This has led some people to wrongly assume that the dropping of the above paragraph was aimed at preventing a challenge of President Lungu’s nomination to recontest the forthcoming General Election this August for his second and last term. Such an assumption only demonstrates a lack of understanding of the effect of the 2016 Amendment on the issue of twice having been elected as President.

Under the 1996 Amendment, there was no express qualification (proviso or rider) for a presidential candidate to run for a third election without violating the two-term limit clause.

Under the 2016 Amendment, it is now possible for a presidential candidate to be elected more than twice without violating the provision on twice having been elected.

It follows that the paragraph which appears in the 1996 affidavit cannot exist in that exact form in the 2016 affidavit.

It’s little wonder Mr John Sangwa SC himself alternatively prayed in his petition that the 2016 affidavit be amended in such manner as would in the judgment of the Court satisfy Article 106(3) of the Constitution.

Article 106(3) has already been held by the Constitutional Court not to be a standalone provision. It must be read together with Article 106(6). This is unlike the 1996 Amendment which had a standalone provision on twice having been elected without any express qualification as is the case under the current Zambian Constitutional order.

At this point it is important to also understand that under Article 7 of the Constitution of Zambia, Statutory Instruments, such as the one containing the Affidavit form under dispute, are part of the Laws of Zambia and can be challenged in Court. The challenge to Statutory Instrument is provided under Article 67 of the Constitution which states:

“67. (3) A person may challenge a statutory instrument, for its constitutionality, within fourteen days of the publication of the statutory instrument in the Gazette.”

The question which the Constitutional Court may be faced with is whether the petition to challenge the form, in effect the Statutory Instrument, is constitutionally time barred or not.

For avoidance of doubt, many media houses and political commentators seem to be misleading the public that the Affidavit form was secretly amended by ECZ. This is untrue and patently false. The Affidavit was used in the 2016 elections by all Presidential candidates, without any problems at all. Lelo chaipa bwanji that you are accusing the Commission of manipulating the Affidavit?

No the Electoral Commission has done no wrong or manipulation at all. The Commission has always been doing what it does since time immemorial when the law changes on elections.

HH and 5 others sue the Attorney General for damages over 2017 treason arrest

UPND leader Hakainde Hichilema and five others have sued the Attorney General for Malicious Prosecution, unlawful detention, false imprisonment, torture and other claims arising for their arrest for treason and other trumped up charges in April 2017.

In a detailed writ of summons and statement of claim filed into the High Court Principle Registry in Lusaka on 7th May 2021, the opposition leader and his colleagues seek compensation for pain, suffering and other harm suffered by them at the hands of the State during their ordeal.

They further alleged that their arrest, detention and subsequent prosecution was without justifiable cause and that it was Malicious.

The Attorney General has 14 days in which to respond to the claim.

During the 2017 Kuomboka ceremony, Mr Hichilema and others were arrested for treason for apparently failing to give way to a presidential convoy and were detailed for 127 days.

They later walked to freedom later the state discharged them.

Nkana Queens FC Receive Donation From Wusakile MP

FAZ National Women’s League side Nkana Queens have received a donation of jerseys, football nets, boots and balls from Wusakile Member of Parliament Pavyuma Kalobo.

Kalobo handed over the donation to Nkana Queens during a ceremony held at Nkana Stadium in Kitwe.

“I want you girls to take football seriously. Be disciplined if you are to go far in your career, without discipline you won’t go anywhere,” Kalobo told the players.

Team Manager Christopher Mwewa thanked Kalobo for the gesture.

“We are grateful to Honourable Pavyuma Kalobo for the donation. The MP has contributed a lot in the running of women’s football,” Mwewa said.

“We want more people and companies to come and support us. It is not easy to run a football team,” he said.

Nkana Queens is one of the 14 teams that have this year constituted the first ever National Women’s Football League in Zambia.

Konkola Blades Eye Glory in Copperbelt Cup Final

Konkola Blades have another opportunity to win a trophy in several years when they face Ndola United in the 2021 FAZ Provincial Cup final at Nkana Stadium on Saturday.

The Chililabombwe side recently missed a chance to win the ABSA Cup after being eliminated at the semifinal stage by Zesco United.

Konkola are competing in the National Division One League while Ndola are in the Copperbelt Division 1 League.

Copperbelt Division 1 sides Jumulo and Mufulira Blackpool will face-off in the third and fourth match earlier at 13h00 as a curtain raiser to the cup final.

The cup final will be followed by an award ceremony in which champions across all FAZ organised leagues will be honoured.

“We want all the teams and individuals involved to follow the Covid-19 measures. It is unfortunate that fans won’t be allowed,” said FAZ Copperbelt Chairman Patrick Ndhlovu.

Nawakwi sued by African Life over Anglo American claims

FDD president Edith Nawakwi has been sued in the High Court of Zambia for contempt of Court by African Life Financial Services following remarks made during a press conference on 6th February 2021 while a case between the latter and its former employees was pending before Court.

The applicants are seeking leave to cite Ms Nawakwi for contempt of Court so that she may show cause why she should not be sent to prison for her utterances.

The matter has been taken to court by Mr Muna Hantuba in his capacity as Executive Director of African Life Financial Services who contends that Mrs Nawakwi’s comments over the transfer of retirement benefits for workers employed by Anglo American to African Life were contemptuous.

Return dates for the application are yet to be set.
