Lusaka Dynamos’ 2019 Title Challenge Ends at a Price

Lusaka Dynamos’ title challenge in Pool A of the 2019 FAZ Super Division season is over after losing another player contractual dispute case filed with FIFA and have been docked league points in the process.

FAZ have confirmed that Dynamos have been docked three points after failing to comply with a FIFA directive to settle all dues owed to Ghanaian Sheriff Deen.

The Deen verdict came barely two months after his compatriot, Abdul Latif Mohammed, also won a similar case filed with FIFA against Dynamos and the club was subsequently docked three points in March.

“FAZ General Secretary Adrian Kashala has advised Lusaka Dynamos FC that the deduction of points is as directed by the FIFA Disciplinary Committee correspondence of 15 May, 2019 in relation to the case between the Ghanaian player Sheriff Deen and Lusaka Dynamos FC in an employment-related dispute in connection with overdue payables,” FAZ said in a statement.

“FIFA passed a ruling on 22 February 2019 and consequent correspondence has shown that no payment has been made to Sheriff Deen, despite the request to Lusaka Dynamos FC to initiate the process of clearing the debt owed to Sheriff Deen or face sanctions.”

Dynamos now have 27 points from 30 points, and consequently out of the top two race in Pool A that is now a four-horse race heading into the final round of games on May 26.

Kabwe Warriors lead Pool A on 31 points, Zesco United are second on 30 points, tied with Zanaco and Red Arrows.

KCM pollution of the Kafue river

Pollution of the Kafue river by the giant mining firm KCM goes on unabated. In recent weeks, there has been an upsurge of toxic wastes spilling into the waterways.

Fish and marine animals are dying and can be seen floating on water. Some euphoric scores of villagers can be seen scooping dead fish for consumption and selling to unsuspecting buyers. The water appear brownish, has a pungent smell and is irritating to the skin.

KCM has a smelter at the Nchanga mine and uses acid to purify the copper ore. The poisonous by-products of this complex process are regularly discarded into the Mushishima river which is a tributary of the Kafue river. Villagers and farmers dotted along these two rivers are wholly dependent on these water bodies for their livelihood. All these people together with the domestic and wild animals are frequently exposed to the harmful wastes which obviously have adverse effects on health both in the short and long term.

I strongly urge the Zambia Environmental Management Agency (ZEMA), the Department of Safety in the Ministry of Mines, the Chingola Municipal Council and other relevant authorities to effectively enforce applicable laws that govern appropriate mining procedures and tame KCM to fully comply with stipulated regulations.

The banks of the river Kafue is now clogged with silt from the smelter and this has transformed the flora and negatively impacted on the fauna of this environment. It is worrisome that if the current trend continues, a repeat of the infamous 2006 catastrophic poisoning of the Kafue is imminent.

It is morally evil and very disturbing for KCM to uphold this destructive tendency of the environment with impunity and disdain. The mining firm has no regard or remorse for the lives of the poor indigenous inhabitants that are perpetually poisoned leaving them weak and distraught. Its main focus is to simply extract copper and boost profits whilst leaving a trail of colossal environmental destruction. By any measure, KCM is surely abrogating some laws of Zambia and deserves retribution.

The Zambian High Commission in South Africa says Paramount Chief Mpezeni IV and Paramount Chief Mwata Kazembe are expected to visit Prince Mangosuthu Buthelezi of the Zulu Kingdom of KwaZulu-Natal (KZN), in South Africa, following the death and burial of his wife.

Paramount chief Mpezeni IV of the Ngoni people of Eastern Province will together with Paramount Chief Mwata Kazembe of the Lunda people of Luapula Province visit the bereaved Prince, in South Africa.

Princess Irene Buthelezi, 89, who passed on recently, was married to Prince Buthelezi for 69 years, before she met her demise, following an illness.

This is contained in a press statement released by First Secretary Press and Public Relations at the Zambian High Commission in South Africa, Naomi Nyawali.

Ms Nyawali said the traditional leaders will lead a Zambian delegation that will include Deputy Secretary to Cabinet, Christopher Mvunga and His Royal Highness Chief Maguya.

She further stated that the delegation will visit Prince Buthelezi at his Ulundi palace in KwaZulu-Natal to deliver message of condolence and offer moral support

She also stressed that Zambia and South Africa have over the years enjoyed close cultural ties which saw Prince Buthelezi grace this year’s Ncwala ceremony of the Ngoni people.

KCM take over, ZCCM-IH now applies to Lusaka High Court to liquidate the Mine

ZCCM Investment Holdings Plc has asked the Lusaka High Court to grant them an order to appoint Milingo Lungu of Messrs Lungu Simwanza and Company as provisional liquidator of Konkola Copper Mines Plc.

This is according to an application for ex parte order appointing provisional liquidator filed in the High Court on Tuesday, May 21st 2019.

According to the order, the Liquidator will have powers to carry on the business of KCM so far as is necessary for the beneficial winding up.

The Liquidator also wants powers to make any compromises or arrangements with creditors and make any agreement on all questions in any way relating to or affecting the company or its assets.

The liquidator father wants powers to take possession, custody and control all the assets of KCM.

The Liquidator will also have powers to bring or defend any action or other legal proceedings in the name and or on behalf of KCM, dispose assets by public tender or the most transparent manner under the circumstances and sell the real and personal property and things in action of KCM by public tender or private contract.

Zambia’s government filed notification of plans to take over Vedanta Resources Ltd.’s domestic copper assets, President Edgar Lungu said.

The southern African nation’s Eurobond yields surged to a record high and the currency hit a 3 1/2-year low.

The move marks an escalation in tension between the government and mine owners, after Lungu last week threatened to “divorce” Vedanta and Glencore Plc, two of the biggest employers in Africa’s second-largest copper producer.

Relations have been simmering after the state earlier this year increased royalties and unveiled a plan to overhaul the value-added tax system.

Lungu mainly targeted Konkola Copper Mines, Vedanta’s local unit, in a weekend visit to Zambia’s Copperbelt province, where some companies are cutting production and firing workers.

“There should be no question about our resolve to divorce, starting with KCM,” Lungu said in comments broadcast on state TV on Sunday. “We have filed that notification.”

The kwacha fell as much as 1.7% on Monday to 14.3152 against the dollar, the weakest level since November 2015, while yields on Zambia’s $1 billion of Eurobonds due 2024 rose by 19 basis points to 18.4%, the highest on record.

Konkola is yet to receive formal notification on the future of its assets in the country, it said in an emailed statement Monday.

The company said it plans to meet the government “as a matter of urgency to discuss the future of KCM and the impact that the current onerous situation is having on the company, the people of the Copperbelt and the Zambian people as a whole.”

Zambia has for years accused mining companies of not paying enough tax and has made 10 changes in the past 16 years as it struggles to settle on a comprehensive system for the industry.

This year’s royalty increases have come as Lungu’s government seeks cash to settle a surging foreign-debt bill. Servicing external loans has already caused foreign reserves to drop to a decade low, while the currency has fallen by more than 14% against the dollar this year, making it the worst performer globally after Argentina’s peso.

The state has had run-ins with Konkola Copper Mines for years and revoked its CEO’s work permit in 2013 over planned job cuts. Still, the latest turmoil could be symptomatic of a populist shift amid what could be a looming economic crisis, according to Neville Mandimika, an economist at FirstRand Bank Ltd. in Johannesburg.

“Whenever a government comes under stress you see more populism,” he said by phone Monday. “It’s almost a self-fulfilling prophesy in that the worse it gets, the worse it will get.”

Zambia’s Copperbelt province has often been a political bellwether for the country, and the ruling Patriotic Front has historically enjoyed strong support there. In April, a new party led by Lungu’s former information minister Chishimba Kambwili won a by-election in the province’s Roan constituency.

In the 2016 elections, the PF had won the same constituency with more than twice as many votes as the opposition.

Lungu said the government would comply with the law in taking over Vedanta’s assets, and that other investors were keen to operate them. His spokesman, Amos Chanda, declined to identify the companies.

Glencore must hand over to local contractors two copper shafts it plans to close, Mines Minister Richard Musukwa said in comments broadcast over the internet at the weekend.

Mine Unions yesterday staged a solidarity demonstration in support of government’s move to take over Konkola Copper Mines in Chingola and Chililabombwe.

The unions were later joined by different stakeholders, miners, ex-miners and residents of Chingola and Chililabombwe to petition government to quickly find other investors to take over operations at Konkola Copper Mines.

Joseph Chewe, the Mineworkers Union of Zambia president, charged that Vedanta Resources had failed the people of Chingola, Chililabombwe and Kitwe.

Mr Chewe led a group of youths and other three union leaders in a solidarity walk to deliver a petition later to Copperbelt minister Japhen Mwakalombe at the District Commissioner’s office in Chingola.

Mr Chewe said the unions have suffered at the hands of Konkola Copper Mines investors and it was now time for them to leave the Country.

He also advised government not to bring in Chinese to run the mines but look at other serious investors.

“We have come to deliver this petition, we heard what the President said and we are in support of what he mentioned. It is for this reason that we want Vedanta to go; time for them to pack is now, we are tired. Enough is enough, we can’t continue like this,” Chewe said.

Mr Chewe said that there was need to consider fencing off Konkola Copper Mines until another investor is identified.

And Mwakalombe said government had already made a decision and will follow the necessary steps in taking over KCM.

Mwakalombe said the petition would be delivered to President Edgar Lungu.

Vedanta Resources have, however, sought an urgent meeting with the government to discuss President Lungu’s position that they leave the mine.

And Presidential spokesman Amos Chanda yesterday told Reuters a notice had been issued to KCM in April last year over a number of breaches of the terms of its licence and it had not convinced the government it should keep the licence.

He also said “about three investors” whom he declined to identify were interested in the asset, but no formal negotiations had begun.

Meanwhile, ZCID spokesperson Jackson Silavwe has said that the recent pronouncement by President Edgar Lungu to take over Konkola Copper Mines (KCM) is well timed and deserves the full support from patriotic citizens and called on President Edgar Lungu to appoint a high-level task team with extensive expertise in mining, management and economics to come up with best modalities to run Konkola Copper Mine profitably and re-examine all the existing mining agreements.

Silavwe said Zambians have been for far too long tolerated the “rants of the profit crazed mining companies”.

He said a report of a technical audit committee chaired by Dr. Sixtus Mulenga showed that KCM was heavily in debt and faced threats of insolvency as at September 30, 2013, and had maintained the same status for six years.

“Zambians are yearning for real economic development powered by their own abundant natural resources. The now Zambian is not afraid to run his own economic affairs. All the minerals belong to Zambians, the foreign investors must share the wealth or leave,” Silavwe. who is also ZCID spokesperson, said.

He further called on government to conduct forensic investigations and prosecute Vedanta Resources Limited for abrogating the agreement.

Silavwe has also urged government to run KCM professionally and avoid political patronage.

ECZ ready to conduct the Katuba Parliamentary by-election

The Electoral Commission of Zambia has said that the Speaker of the National Assembly Patrick Matibini has notified Commission on the vacancy in Katuba Constituency and that the Commission is now awaiting guidance from the Attorney General’s office on the date for the by-election.

Speaking in an interview with ZNBC News in Lusaka yesterday, ECZ Public Relations Manager Margaret Chimanse said that the preparations for the Katuba by election have started and the ECZ is ready to conduct a by-election.

The Katuba seat fell vacant after the death of UPND area Member of Parliament Patricia Mwashingwele.

TWO (2) LOCAL GOVERNMENT WARD BY-ELECTIONS FOR MAAMBO AND LUPUI WARDS IN PEMBA AND MITETE DISTRICTS RESPECTIVELY

Notice is hereby given to the general public that the Electoral Commission of Zambia has prescribed Tuesday, 6th June, 2019 as the date on which to conduct Two (2) Local Government by-elections in Maambo Ward of Pemba District and Lupui Ward in Mitete District. The vacancies in Maambo and Lupui wards are as a result of resignations of councillors on 18th and 11th March 2019 respectively.

The polls will take place from 06:00 hours to 18:00 hours.

Aspiring candidates in the by-elections should lodge completed and attested statutory declaration and nomination papers subscribed before a Magistrate, Local Court Magistrate, Head of a Government Primary or Secondary School, Principal of a College, Commissioner of Oaths, Election Officer or Returning Officer on Thursday 23rd May.

Aspiring candidates in the Local Government by-elections should take along with them nine (9) supporters who must be registered voters in the affected wards. Aspiring candidates will be required to pay Four Hundred Kwacha (K400.00) non-refundable nomination fee.

Candidates for the ward by-elections must also present certified copies of their grade 12 certificates or equivalent or higher qualification.

In view of this, the Commission wishes to advise aspiring candidates who may wish to contest in these elections and by-elections that failure to comply with these requirements shall render the nomination papers null and void.

Media personnel and Registered Non-Governmental Organisations wishing to monitor/observe the elections are advised to apply for accreditation in the respective districts which will take place from 22nd May to 5th June, 2019.

Accreditation for political party officials wishing to monitor elections in the wards shall only be up to a maximum of 10 members per political party.

Please note that only a maximum of 5 accredited members per political party and two accredited representatives of NGOs shall be authorised to represent their respective political parties or NGOs at the Collation Centre (Totalling Centre).

Only three (3) senior officials of any participating political party with Electoral Commission of Zambia accreditation will be allowed to accompany aspiring candidates into the Nomination Centre during the filing of nominations. The rest of the supporters should remain outside the 400 metre parameter from the Nomination Centre in accordance with the law.

Number of Cholera cases in Mpulungu district significantly reduced-Chilufya

The number of Cholera cases in Mpulungu district, Northern Province have reduced significantly with only 13 new cases being reported yesterday.

Health Minister of the Republic of Zambia, Hon. Dr. Chitalu Chilufya reveled that ever since the disease broke out on the 3rd of April this year, close to 30 cases had been recorded on a daily basis.

“Today, we recorded 13 new cases and even discharged 11 so leaving under treatment, 20. This is a good sign and the epicave is clearly showing that there is a slump in the number of new cases recorded on a daily basis,”he said.

He announced that the multi sectoral response would be escalated and that with the vaccines and improved access to clean and safe drinking water and the other high impact public health interventions put in place such as the temporal fish ban and the extention of the holiday period for the school going children, the outbreak would be brought under control not too long from now.

He also said the Multi Sectoral team was already on the ground working hand in hand with local teams in the area to quickly arrest the disease.

The Minister gave the update in Geneva, Switzerland today.

He is in that country to attend the World Health Assembly which is taking place from the 20th through to the 24th of May 2019.

Zambia is set to launch the Multisectoral cholera elimination plan 2019-2025 at a side event to be Co hosted with the WHO Director General Dr. Tedros Adhanom and the global task force against Cholera.

Government has said that it has received reports that some unscrupulous persons are taking advantage of recent challenges in the local foreign exchange market to spread false information implying that exchange controls are about to be re-introduced in Zambia and that foreign currency accounts held in our banking system will be converted into Kwacha.

In a statement released to the media, the Minister of Finance Mrs Margaret D. Mwanakatwe said that these insinuations don not represent the longstanding policy of the Government of the Republic of Zambia and she assured local and foreign investors, businesses, and the general public that not introduce foreign exchange controls

WE WILL NOT RE-INTRODUCE EXCHANGE CONTROLS

LUSAKA, 20th MAY, 2019

The Government has received reports that some unscrupulous persons are taking advantage of recent challenges in the local foreign exchange market to spread false information implying that exchange controls are about to be re-introduced in Zambia and that foreign currency accounts held in our banking system will be converted into Kwacha.

I want to state that these insinuations DO NOT REPRESENT the longstanding policy of the Government of the Republic of Zambia. In addition, I wish to assure both local and foreign investors, businesses, and the general public and categorically state that *THE GOVERNMENT IS NOT ABOUT TO AND WILL NOT RE-INTRODUCE EXCHANGE CONTROLS.* To the contrary, the Government remains committed to maintaining the current flexible exchange rate regime.

Looking back to the 1980s and 1990s, the nation will recall the painful experience that Zambia endured due to exchange controls after which we resolved as a country to do away with exchange controls as they did not resolve the underlying challenges faced by the economy then, but made things worse.

Diversification of the economy, particularly the export sector, is one way of strengthening our domestic and external sector performance, sustainably. In this regard, the Government, through the revised 7thNational Development Plan and the Economic Stabilisation and Growth Programme, has developed a robust framework aimed at addressing the challenges faced by the economy and meeting the aspirations of our people. As Government, we are committed to implementing these programmes and the current challenges the economy faces make this task even more compelling.

Further, it is also important to note that the Bank of Zambia manages the Government’s exchange rate policy in the context of its overall objective of maintaining price and financial system stability. The Bank of Zambia will hold its quarterly monetary policy meeting this week and will be having a media briefing on Wednesday May 22, 2019. A detailed assessment of recent developments in the foreign exchange market as well as monetary policy developments will then be provided to members of the public at that time.

I take this opportunity to appeal to my fellow citizens and friends of Zambia to be on high alert and help curb mis-information. The practice harms the less privileged due to the propensity of falsehoods to impair the social-economic progress of the country.

Zesco United refuse to let Dynamos defeat get under their skin

Zesco United have told contenders to their FAZ Super Division crown that Sunday’s away loss at Lusaka Dynamos was not a sign they were cracking to final round pressures.

Dynamos stunned Zesco with a stoppage time goal from Dennis Dauda at the end of the match at Nkoloma Stadium in Lusaka to deny them an opportunity to reclaim first place in Pool A on the penultimate day of the 2019 season.

Zesco stay second despite the defeat, one point behind Kabwe Warriors on 30 points but tied on points with Zanaco, Red Arrows and Dynamos in a dead-heat race in Pool A.

“We shall fight until the last game and we have to win it. I am saying anything can happen in football, we won’t give up,” Zesco assistant coach Alfred Lupiya said.

“The boys just lost concentration at the back and we conceded that goal. Mistakes are part of football and we can’t grill the players over spilt milk.”

Zesco must now beat relegation threatened Kitwe United this Saturday in their final game in Ndola and hope they would have done enough to cross the finish line.

WEEKEND SCORECARD: Chambeshi challenges 2019/2020 continental envoys

Nkana coach Beston Chambeshi has challenged Zambia’s 2019/2020 continental envoys to excel and not just to make the numbers.

Sixth placed Nkana will not return to Africa next season after falling short of a top two finish in Pool B following Sunday’s 0-0 away draw at second placed Buildcon at Levy Mwanawasa Stadium in Ndola.

Nkana cannot touch the 30 point threshold in their last two games and now miss out on continental action just two months after making their quarterfinal debut in the 2018/2019 CAF Confederation Cup.

“Nkana is a brand and everyone knows that when they fight in continental competition, they fight for honours,” Chambeshi said.

“I just wish the best to all the team’s that will participate in the CAF Champions League and CAF Confederation Cup.

“I hope they will maintain the same form that we have left.”

Meanwhile, Green Eagles are so far the first Zambian rep to confirm their continental ticket in the CAF Champions League after winning Pool B.

Second placed Buildcon and third placed Nkwazi head into the final round of Pool B games this Sunday chasing CAF Confederation Cup qualification.

Pool A is going tothe wire with the top five sides in a dead heat for the two continental slots.

Kabwe Warriors lead Pool A on 31 points ,one more than defending champions and second placed Zesco United who are tied on 30 points with Zanaco, Red Arrows and Lusaka Dynamos.

President Lungu Displeased with the Failure to Adhere to the 20% Local Contract Allocation

President Edgar Lungu has directed his Special Assistant for Project Monitoring and Implementation Andrew Chellah to quickly convene a meeting with all Copperbelt based Contractors and foreign firms.

President Lungu says the meeting is aimed at finding a solution to the non adherence to the law on 20% local contract allocation.

And the Head of State, Sunday, took to task the AVIC International Senior Consultant Lei Ying Qi who was at pains in explaining why no local firms have been engaged at the construction site for the Copperbelt International Airport.

The Local Contractors Consortium representative said the local contractors were being sidelined by the Foreign Firms.

Meanwhile, Special Assistant to the President for Press and Public Relations Amos Chanda said the Head of State wants all contractors, foreign firms and line ministries to urgently meet.

Mr Chanda reiterated that President Lungu wants the local contractors to benefit from all the Projects being implemented by foreign firms on the Copperbelt.

“President Lungu has therefore directed as follows; that the main contractors meet with the representative of the local contractors…Mr Andrew Chellah, Special Assistant to the President for Projects in State House, Engineer Ngulube from NCC, RDA – all the contracting parties in government to meet with the major contractors and come up with an amicable, not just administrative procedure but a mechanism to strictly adhere to that law,” said the Presidential Spokesperson.

Car inspections increase prior to importation into Zambia

The Zambia Compulsory Standards Agency has recorded a 12 percent increase in vehicle inspections in the month of April from the countries of import to ensure road worthiness prior to imports to Zambia.

The Agency conducted a total of 645 vehicle inspections in April 2019 compared to 568 conducted in March.

Used motor vehicles are inspected at source prior to shipment to ensure roadworthiness and the Agency has contracted three companies namely Auto Terminal Japan Limited, EAA Limited and JEVIC Limited to conduct the inspections.

Caroline Kalombe, the Agency Communications Officer said these companies provide roadworthiness inspections in Japan, Singapore, South Africa, United Arab Emirates and the United Kingdom, the regions which account for more than 90 percent of total imports of used motor vehicles into Zambia.

She said the Agency conducts inspections on products falling under compulsory standards to ensure that they comply with the prescribed standards and to prevent the importation of substandard and unsafe goods onto the Zambian market.

Mr. Kalombe said the administration of compulsory standards ensures that products manufactured in Zambia and those imported into the country are designed, produced and supplied in accordance with the requirements of the compulsory standards and meet consumer needs, demands and expectations.

She said compliance to compulsory standards also ensures that these products are not only safe but can also compete favorably in local, regional and international markets.

Ms. Kalombe said in this regard, the Agency not only promotes the growth of industry but also protects it against unfair technical barriers to trade in both the local and export markets.

She said administration and enforcement of compulsory standards further promotes a culture of quality and safety among manufacturers, consumers and the general public as the Agency continues to execute its mandate.

Ms. Kalombe has reminded importers of used vehicles that the roadworthiness inspection of used motor vehicles at source is a mandatory requirement aimed at ensuring public safety, and environmental protection.

4 Men sentenced to 5 years imprisonment for possessing game meat

Four men have been handed five-year jail sentences in Mpika and Chinsali after being convicted of illegal possession of up to 51 kilograms of illegal bush meat of various wildlife species.

Allan Chanda was convicted and sentenced to five years imprisonment with hard labour by the Mpika Subordinate Court for Unlawful Possession of Protected Trophy namely, Hippo meat weighing 12 kilogrammes, contrary to section 130 (1) of the Zambia Wildlife Act number 14 of 2015.

The Court also convicted and sentenced Sten Kabengele and Mupanga Lwanga to five years imprisonment with hard labour for Unlawful Possession of Protected Trophy, namely Black Lechwe meat weighing 24 kilogrammes, contrary to section 130 (1) of the Zambia Wildlife Act number 14 of 2015.

In Chinsali, the Subordinate Court sentenced Shadrick Katongo to five years imprisonment with hard labour for Unlawful Possession of 15kg of Sable Antelope meat, and another six months’ imprisonment for unlawful possession of five shotgun Shells.

Illegal bush meat trade is considered to be the biggest threat to wildlife populations in Zambia and the region, even over and above the ivory and rhino horn trade, according to a statement issued by Ministry of Tourism and Arts spokesperson Sakabilo Kalembwe.

Konkola Copper Mines Plc (KCM) has said that is has not yet received any information formal communication from the Government of Zambia, in particular, the Head of State President Edgar Lungu or the Minister of Mines Mr Richard Musukwa on the decision regarding the future of KCM.

In a statement released to the media , the company said that it has made urgent effort to to seek a meeting with the President and the Minister of Mines, but have not been successful.

Over the weekend, President Edgar Lungu announced that Government will disengage with KCM saying he would not allow Zambia to be blackmailed or arm twisted by mining investors as the country was still ripe for investment.

He said Government had resolved to part with KCM and would invoke the legal process to that effect.

The President assured that Government would follow the due process of the law in disengaging with the KCM investor, Vedanta Resources.

“We have been taken for a ride by some of these investors. So I am here to announce that Government is divorcing KCM,” President Lungu said.

And Mines Minister called on KCM Workers and all Zambians to be Vigilant, to Protect the company Assets. Mr Musukwa told the media on the need for Konkola Copper Mines employees and all Zambians, considering “the current situation”, to be vigilant and protect the Assets at the mining Firm.

“For a long time now, as a survival plan, the mining house has been involved in the process of selling some scrap and equipment. We got a report from our people on the grou. And to that effect, arising from this situation, we are calling on the workers and our people to remain vigilant and ensure that such activities with this situation, must NOT be entertained,” said Mr Musukwa.

Chingola, 20 May 2019: Konkola Copper Mines Plc (KCM) is aware of media reports, quoting the President of Zambia, Mr. Edgar Chagwa Lungu, in respect of a decision regarding the future of KCM.

KCM is yet to receive formal communication from the Government of Zambia on this, although it has sought an urgent meeting with the President and/or the Minister of Mines.

The intention of KCM and its primary shareholder, Vedanta, is to continue to engage with the Government in a constructive and transparent manner. The Government, through ZCCM-IH, is a direct and critical shareholder of KCM and its representatives who are on the KCM Board are fully apprised of and are party to the circumstances of the company and major decisions that have been taken.

Vedanta is a long-standing investor in KCM and in Zambia, having invested over US$3 billion since the acquisition of this asset. The company employs nearly 13,000 people at its sites and operates clinics, hospitals and schools through its corporate social responsibility programme that amounts to over $210 million since 2004. The company is yet to receive a positive return on this investment while, on the other hand, taxes, duties, fuel and power costs have risen exponentially among other issues, thereby placing an enormous and unaffordable burden on the company. The most recent restrictions and duty on concentrates has negatively impacted the running of the smelter and the much needed acid to run its operations. KCM has contributed over $1.4 billion to the Zambian Exchequer since acquisition and continues to be the leading Pay as You Earn contributor in the country.

KCM is seeking to meet with the Government as a matter of urgency to discuss the future of KCM and the impact that the current onerous situation is having on the company, the people of the Copperbelt and the Zambian people as a whole.
