Landmark Jurisdiction case won by Zambian farmers at Supreme court

Historic victory for opens the door for global claimants to seek justice against British multinationals in the UK.

The Supreme Court today announced its verdict in the landmark case of the Zambian communities consistently polluted by Konkola Copper Mines (KCM), a subsidiary of British miner Vedanta Resources Plc, allowing them to have their case against the parent company and its subsidiary tried in the UK. The ruling sets a strong legal precedent which will allow people with claims against subsidiaries of British multinationals to sue the parent company in the UK.

The judgment by Chief Justice Lady Hale, and four further judges, re-affirms the rulings of the Court of Technology and Construction in 2016 and the Court of Appeal in 2017. Lady Hale refused Vedanta’s pleas in appealing the former judgments stating that, contrary to the claims of Vedanta’s lawyers:

  • the claimants do have a bona fide claim against Vedanta
  • the company does owe a duty of care to the claimants, especially in view of the existence of company wide policies on environment and health and safety.
  • that the size and complexity of the case, and the lack of funding for claimants at ‘at the poorer end of the poverty scale in one of the poorest countries of the world’ means that do not have substantive access to justice in Zambia.

The 1,826 claimants, represented by UK law firm Leigh Day, are from farming and fishing communities downstream of KCM’s mines and plants. They claim to have suffered continual pollution since UK firm Vedanta Resources bought KCM in 2004, including a major incident in 2006 which turned the River Kafue bright blue with copper sulphate and acid, and poisoned water sources for 40,000 people(2). 2,001 claimants took KCM to court in Zambia in 2007. The courts found KCM guilty but denied the communities compensation after a nine year legal battle. As a result the victims took their case to UK lawyers.

James Nyasulu from Chingola, a long term campaigner in the case, and lead claimant in the Zambian cases, issued this statement:

“The Supreme Court judgment will finally enable justice for the thousands of victims of pollution by KCM’s mining activities, who have suffered immensely since 2006 to date, in the Chingola district of Zambia. Their livelihoods, land and health have been irreparably damaged by pollution which has rendered the River Kafue completely polluted and unable to support aquatic life. Some have already died as a result.

We are very grateful to the British Supreme Court for allowing the case to be tried in the UK where we trust that justice will finally be done. As our thirteen years of legal battles have shown, we have been unable to get justice in Zambia.”

Now that the Supreme Court has confirmed their permission to have the case tried in the UK the case itself can begin.

Samarendra Das from Foil Vedanta said:

“As the UN’s Sustainable Development Goals recognise, sustainable development and access to justice go hand in hand. The judges ruling today recognises and enforces that principle.

Criminal companies like Vedanta can no longer so easily whitewash their reputation and assume a ‘cloak of respectability’ by virtue of a London listing. This is an historic day for victims of British multinational’s abuses worldwide.”

In a further development Vedanta Resources de-listed from the London Stock Exchange on 1st October 2018, amid global protests following the killing of 13 people, shot by police during protests against the company’s copper smelter in Tuticorin, Tamil Nadu, India. Commentators (including Foil Vedanta in their comprehensive report on the company’s global operations entitled ‘Vedanta’s Billions: Regulatory failure, environment and human rights’)1 claimed the company were fleeing regulation in the UK. However, Vedanta remains liable in the UK for damages arising from the Zambian case.

It is now possible that claimants from some of the many of the Indian communities affected by pollution and human rights abuses by Vedanta may also seek to get justice in the UK.

In April 2016 a High Court ruling granted the claimants jurisdiction to have their case against KCM and Vedanta heard in the UK, citing KCM’s uncertain and opaque finances as one reason they may not be able to get justice in Zambia. The Court of Appeal upheld this verdict in July 2017.2 (3)

ZDA implores Zambians to access the Chinese Market

The Zambia Development Agency has implored Zambian exporters to access the Chinese market through the China Desk set at the Zambia Development Agency.

The China Desk offers strategic and technical guidance to Chines investors and prospective investors on the investment opportunities available and possible joint ventures between Zambian and Chinese investors and entrepreneurs.

ZDA in partnership with the International Trade Centre through the Partnership for Investment and Growth in Africa (PIGA) project created a China Desk at the Agency to facilitate for Zambian and Chinese business corporations.

The creation of the Chinese Desk was as a realization of the growing importance of China as a business partner both in trade and investment.

In partnership with the Agency, PIGA offers strategic and technical guidance to Chines investors and prospective investors on the investment opportunities available, facilitating trade and possible joint ventures between Zambian and Chinese investors and entrepreneurs.

“The China desk further facilitates for Zambian enterprises to export their products to the Chinese market through helping them to participate in various trade fairs and exhibitions including the China International Import Expo among others,” elaborated ZDA Director General Perry Mapani.

Mr. Mapani adds that PIGA has been working on a web portal that will be linked to the ZDA website in both Chinese and English to further make it easier for both parties to have relevant information on investment climate opportunities, rules and regulations.

Working with the Agency, the project also offers tailor made trainings to enterprises on various aspects of business and how to approach the Chinese market in particular.

“China is one of the major economic players in Zambia and across the continent hence the importance of coming up with strategies to deal with market and Chinese investors,” said Mr. Mapani.

In the year 2018, projected Chinese investments that came through the Agency was an excess of USD2 billion representing about 49 percent of the total projected investments.

The projected investment figures for 2018 shows how important a business partner China is and it cannot go unnoticed.

The goal of PIGA and the China Desk is to increase exports, jobs and local development through foreign investments and business partnerships in the agro processing and light manufacturing sectors in Zambia.

PIGA is a partnership of the Government of the United Kingdom (UK) of Great Britain and Northern Ireland’s Department for International Development (DFID), the China Council for the Promotion of International Trade (CCPIT), the China Africa Development Fund (CAD Fund) and the International Trade Centre (ITC).

Under this partnership, DFID, CCPIT, CAD Fund and ITC jointly aim to increase investment-led exports and local development in two productive sectors, agro processing and light manufacturing, in Zambia, Ethiopia, Kenya and Mozambique.

PIGA is a component of Invest Africa, a large DFID programme linking private sector investors, buyers, financiers and governments in several African countries, to boost manufacturing and create jobs by increasing foreign direct investment.

This is according to a statement issued to the Media by ZDA Manager Communications and Public Relations Faith Musonda.

Zambian music fans and pundits have often remarked that English Hip-Hop struggles as a sub-genre in the country and Chanda Mbao seems to be proving them wrong.

On Monday, ‘Money Gang’ shot to number 1 on Hot FM’s Top 10 at 10 after amazing fan love the song received. This was after peaking at number 1 on Power FM’s Hip-Hop Top 5 and climbing Radio Phoenix’s Local Rhythm’s Countdown to number 4.

The List, released by Leading reputation management consultancy firm, Reputation Poll International recognises and honours individuals, organisations and brands who consistently impact lives positively around the world.

The 2019 List features renowned individuals from across the globe involved in diverse sectors such as entertainment, politics, religion, education, philanthropy, and business among others.

The event had a plethora of talented musicians on hand such as DJ Nano , DJ Ms Selfie  , Kaladoshas , Macky 2 , Dope G , DJ V Jeezy and a surprise performance by Slap D. The headline acts were South African artists Sho Madjozi and DJ Heavy K.

The excited crowd went wild when Sho Madjozi got on stage. She had great energy as she performed her hit singles such as Huku , Wakanda forever , among others.

Heavy K was the last performance of the night , many had been eagerly anticipating his set and he did not disappoint. The audience was in raptures when he played crowd favorites such as ‘Celebration‘ , ‘Inde‘ , ‘Sweetie‘ ,and many many more of his hits.

Jameson connects event was definitely a night to remember.

IMF sharply cuts Zambia’s GDP growth target for next year, sees higher inflation above 10%

The International Monetary Fund has projected that Zambia’s economic growth will fall to 2.9 percent next year from the 3.1 targeted for this year.

In its annual World Economic Report released on Tuesday at the ongoing Springs Meeting in Washington D.C, the Fund also see higher inflation above 10 percent by end of 2019.

It projects that inflation will jump to 12.0 percent in 2020 after closing at 10.7 this year.

And the IMF says the global economy is slowing more than expected and a sharp downturn could require world leaders to coordinate stimulus measures.

The Report pointed to the U.S.-China trade war and a potentially disorderly British exit from the European Union as key risks and warned that chances of further cuts to the outlook were high.

Some major economies, including China and Germany, might need to take short-term actions, the IMF said.

“This is a delicate moment for the global economy,” IMF chief economist Gita Gopinath said in a news conference to discuss the report.

Governments may need to open their pocketbooks at the same time “across economies” if the slowdown becomes more serious, Gopinath said, adding that loose monetary policy might also be needed.

The comments provided an eerie warning to the global officials gathering in Washington this week for the spring meetings of the IMF and World Bank. The world engaged in coordinated fiscal stimulus to counter the 2008 financial crisis.

The Zambian delegation is led by Finance Minister Margaret Mwanakatwe who started off her busy schedule on Tuesday in Washington D.C with a meeting with the World Bank Country Team for Zambia.

“Just finished a great meeting with the World Bank Country Director for Zambia, Paul Noumba Um, and his team. We were looking at various issues related to cooperation between the two development partners. Away from the meeting, I found it extremely interesting that the World Bank in Washington has moved from serving water in plastic bottles in its meetings to serving it in bio-degradable packages. Zambian manufacturers, what are you waiting for?”

“The initiative by the authorities here in DC reminds me of home in Zambia where plastic carrier bags are no longer given freely in supermarkets or elsewhere. For my friends the youth and women, the measure serves as a business opportunity to begin selling reed baskets and the like. Go for it my people!”

Mrs Mwanakatwe said that she will also take the opportunity of being in Washington to honour invitations by the international community to address elite investors’ and business forums separately organized by Standard Chartered Bank, Barclays Bank, and Bank of America Merrill Lynch for investors from the Asia, Canada, Europe, Middle-East, and the United States of America.

“I am also scheduled to attend the launch of the IMF Regional Economic Outlook for Sub-Saharan Africa, and will be joined at the event by my counterpart Minister of National Development Planning, Alexander Chiteme, who is expected to arrive in Washington later today,” she wrote.

“I addressed my delegation this morning and urged the team to be at their best and to represent the country well. I requested all of them to endeavor to send messages that are consistent with the country’s positive ambitions and aspirations aimed at making Zambia a prosperous middle income nation where no one will be left behind.

The members of my high-level delegation include the Secretary to the Treasury Fredson Yamba, Deputy Secretary to the Cabinet [Finance and Economic Development] Christopher Mvunga, and Bank of Zambia Governor Dr. Denny Kalyalya.

The others are Ministry of Development Planning Permanent Secretary Chola Chabala, Ministry of Finance Permanent Secretary for Economic Management and Finance Mukuli Chikuba, Zambia Revenue Authority Commissioner General Kingsley Chanda, and Zambia Integrated Forestry Landscape Project Coordinator, Dr. Tasila Banda.

“While in Washington, DC, my delegation will attend and participate in events, meetings, seminars and sessions of both the International Monetary Fund [IMF] and the World Bank Group (International Bank for Reconstruction and Development – IBRD, International Development Association – IDA, International Finance Corporation – IFC, and the Multilateral Investment Guarantee Agency – MIGA.”

“We will also attend the International Monetary and Financial Committee [IMFC]; the highest ranking organ of the IMF, which comprises the IMF Board of Governors [Ministers of Finance and Governors of the Central Bank from 189 member states] and the Executive Board of the Fund. My team will also attend the IMF Africa Group 1 Constituency Meeting and the African Consultative Group (ACG) Meeting with the IMF Managing Director Christine Lagarde. Meetings with the Director of the IMF Africa Department, Abebe Selassie, and the IMF Executive Director for Zambia Dumisani Mahlinza are also planned, at which discussions are expected to focus on developments in the economy and the upcoming Article IV Consultation Mission to Zambia,” Mrs Mwanakatwe wrote.

The delegation’s engagements will extend to dialogues with Fitch, Standard and Poor’s, and Moody’s Rating Agencies. At these meetings, the parties will be looking at Zambia’s macroeconomic situation, fiscal affairs, debt matters, and foreign reserves, among other issues.

Zesco aim for top spot at Arrows

Zesco United visit Red Arrows on Wednesday afternoon at Nkoloma Stadium in Lusaka seeking a win to catapult them to top spot of the FAZ Super Division Pool A for the first time this season.

The defending league champions currently sit at number four on 18 points, three behind leaders Kabwe Warriors who have a lesser goal difference after nine and eleven games played respectively.

Wednesday’s match is also the second of Zesco’s three-match backlog in the league they accrued prior to their just-ended CAF Confederation Cup Group C campaign.

Zesco won the first game 5-2 at home against bottom placed Prison Leopards in a delayed Week Six fixture on April 3 in Ndola.

George Lwandamina’s side also heads into the game unbeaten in their last five competitive games in that notably includes a draw and two straight league wins heading into the match against Arrows.

He will be banking on the form of strikers Jesse Were and Lazarus Kambole who have four league goals each this season on top of their impressive haul of five and seven continental goals respectively.

Meanwhile, Arrows come into the match on a five-game unbeaten run since third placed Lusaka Dynamos beat them 1-0 at Nkoloma on February 23.

Since then, the 2004 champions have won three and drawn two league games and sit just two points behind Zesco on 16 and 18 points from eleven and ten games played respectively.

Lawyers should be watchdogs for rule of Law-President Lungu

President Edgar Lungu has urged lawyers to be the watch dogs that ensures that the rule of law thrives.

President Lungu said lawyers must keep in check the executive, judicial and legislative arms of governance in an effort to ensure all are alert and adhere to the tenets of the law.

President Lungu was speaking on Tuesday when he officially opened this year’s Commonwealth Law Conference in Livingstone.

He said Zambia is indeed honoured to have won the bid to host the prestigious conference.

Let us work together as we continue reforming our laws for the better. It’s a promise my Government is committed to keep.

“Our legal fraternity has indeed placed Zambia where it must be in the Commonwealth community of nations and beyond. We shall always endeavor to be a Country of laws,” President Lungu wrote on Facebook.

“As I officiated at the 21st Commonwealth Law Conference in our beautiful tourist capital, Livingstone under the theme “The rule of law in retreat? Challenges for the modern Commonwealth”, I did so with a lot of pride that our visitors will help tell a story of the Zambia they experienced,” he wrote.

“As a Latin maxim goes: “Fiat justitia ruat caelum” which means, “Let justice be done though the heavens fall”, I urge practitioners to take up the mantle, to be the watch dog that ensures that the rule of law thrives. They must keep in check the executive, judicial and legislative arms of governance in an effort to ensure all are alert and adhere to the tenets of the law,” he prodded.

Mopani Copper Mines Plc has with immediate effect resumed operations at its Nkana and Mufulira mine sites following an intensive safety audit of underground operations.

Mopani Copper Mines Plc public relations manager Nebert Mulenga has confirmed the resumption of operations at the two sites.

Mr. Mulenga said in a statement that the mining company which declared a safety work stoppage last ensured that during the suspension, all employees underwent supervisory and safety training sessions.

He added that the employees also signed commitment letters to undertake safe work.

“It is our hope that employees have benefitted from the supervisory and training sessions, which reinforced among other things, the duty and right of each and every employee to report unsafe practices and refuse to undertake any assignment deemed unsafe,” Mr. Mulenga has said.

Women organizations and some opposition political parties have taken to social media to congratulate Lusaka Lawyer Linda Kasonde on her election as Vice President of the Commonwealth Lawyers Association.

During the ongoing Commonwealth Law Conference in Livingstone, Ms. Kasonde who is also Former LAZ President was elected as Vice President for Africa of the Commonwealth Lawyers Association

Women for Change said Ms. Kasonde’s election is a milestone.

“Hearty congratulates Ms. Linda Kasonde, former Law Association of Zambia President on her election as Vice President of the Commonwealth Lawyers Association for Africa. This indeed is a milestone for the women’s movement not only in Zambia but Africa as whole.

And the Zambia National Women’s League has also congratulated Ms. Kasonde on her election.

Opposition leader Hakainde Hichilema also took to Twitter to pass his congratulated message to Ms. Kasonde.

YALI says imposters sponsored by known Zambia politician to create parallel organisation

The Young African Leaders Initiative (YALI) has notified the Registrar of Companies that imposters have been sponsored by a known Zambia politician working and civil society activists to generate confusion in an attempt to legitimise a body that is not legally recognised by Zambian laws.

In a letter dated Monday, 08 April 2019, YALI President Andrew Ntewewe stated that some imposters whose intention is to conduct anti-government operations in Zambia while running unregistered entity not recognised by the law have been sponsored to destabilise the operations of the Young African Leaders Initiative which was duly registered on 6th January, 2011 under the laws of Zambia.

YALI was formed in Zambia in November, 2010 following attendance of the President’s Forum for Young African Leaders (PFYAL) held in the US and officially registered in 2011. For any organisation to operate in Zambia, it must be legally registered by either the Registrar of societies, companies or NGOs. YALI has received funding from the US Government and other foreign Governments from 2011. In 2017 YALI received funding in excess of K1 million to conduct the TechCamp in 2017 in Lusaka involving youth leaders from Namibia, Zambia, Malawi, Zimbabwe and other countries outside the region.

Mr. Ntewewe has stated that the directors of Young African Leaders Initiative have no desire whatsoever to effect any change of name to allow an illegal entity not recognised by law to champion an anti-governmental agenda. Mr. Ntewewe said these plans to destabilise YALI by placing various imposters have existed for a while

YALI has since instructed its lawyers to prosecute any individual found breaching Zambia’s corporate laws in its name. A Mr. Wilfred Chilufya has purported to have been elected as Young African Leaders Initiative Regional Leadership Centre South Africa (YALI RLCSA) Zambian Chapter, an organisation that is not recognised by law in Zambia and is operating illegally.

Over 73 % of Grade 1 entrants not enrolled in pre-school in 2017

UNICEF says 377,482 children in Zambia, around 73.9 per cent of Grade 1 entrants-started school without any pre-school experience in 2017.

This has coincided with a new report released on Tuesday in which UNICEF warns that 175 million children of pre-primary age are not enrolled globally. 
 
The report notes that countries with high numbers of children not in pre-primary education are missing a critical investment opportunity and are at risk of suffering deep inequalities from the start.

In low-income countries, only 1 in 5 young children are enrolled in pre-primary education.
 
“Pre-primary schooling is our children’s educational foundation – every stage of education that follows relies on its success,” said UNICEF Zambia Country Representative, Noala Skinner.

“Yet, too many children around the world are denied this opportunity. This increases their risk of repeating grades or dropping out of school altogether and relegates them to the shadows of their more fortunate peers.”
 
A World Ready to Learn: Prioritizing quality early childhood education – UNICEF’s first ever global report on pre-primary education – reveals that children enrolled in at least one year of pre-primary education are more likely to develop the critical skills they need to succeed in school, less likely to repeat grades or drop out of school, and therefore more able to contribute to peaceful and prosperous societies and economies when they reach adulthood.
 
Children in pre-primary education are more than twice as likely to be on track in early literacy and numeracy skills than children missing out on early learning. In countries where more children attend pre-primary programmes, significantly more children complete primary school and attain minimum competencies in both reading and math by the time they finish primary school.
 
Globally, the report notes that household wealth, mothers’ education level and geographical location are among the key determinants for pre-primary attendance.

However, poverty is the single largest determining factor.

Some key findings are that across 64 countries, the poorest children are seven times less likely than children from the wealthiest families to attend early childhood education programmes. For some countries, the rich-poor divide is even more apparent.
Other factors include the Impact of conflicts as more than two thirds of pre-primary-age children living in 33 countries affected by conflict or disaster are not enrolled in early childhood education programmes.

Yet, these are the children for whom pre-primary education has some of the greatest benefits. Pre-primary education helps young children affected by crises overcome the traumas they have experienced by giving them a structure, a safe place to learn and play, and an outlet to express their emotions.

Cycle of educational achievement is another key factors and across countries with available data, children born to mothers who have completed secondary education and above are nearly five times more likely to attend an early childhood education programme than children whose mothers have completed only primary education or have no formal education.

In 2017 an average of 6.6 per cent of domestic education budgets globally are dedicated to pre-primary education, with nearly 40 per cent of countries with data allocating less than 2 per cent of their education budgets to this sub-sector. Across the Eastern and Southern Africa region (ESAR), governments on average dedicate 1.8 per cent of their education budgets to pre-primary education.
 
“If today’s governments want their workforce to be competitive in tomorrow’s economy, they need to start with early education,” said UNICEF Zambia Representative, Noala Skinner.

“If we are to give our children the best shot in life to succeed in a globalized economy, leaders must prioritize, and properly resource, pre-primary education.”
 
UNICEF is urging governments to make at least one year of quality pre-primary education universal and a routine part of every child’s education, especially the most vulnerable and excluded children.

To make this a reality, UNICEF urges governments to commit at least 10 per cent of their national education budgets to scale up early childhood education and invest in teachers, quality standards, and equitable expansion.

No hope for March salaries this week, UNZA management tells Lecturers

Management at the University of Zambia has told Lecturers and other workers that there is no hope that they will receive their delayed March salaries this week.

According to a staff memo issued by UNZALARU General Secretary Kelvin Mambwe, management held a meeting with the three University of Zambia unions over the delayed payment of March salaries.

Mr Mambwe said the meeting started around 16 Hours and lasted for about two hours.

“In explaining the reasons for the delayed salaries, Management informed the unions that it has no capacity to pay workers because the Government has for the past two months failed to remit to the University the monthly grants as well as the tuition fees for those students sponsored by the Government,” Mr Mambwe wrote.

He said this position has consequently affected Management’s ability to pay salaries, as the internally generated resources are insufficient to address the problem.

“Unfortunately, there is no hope that the Government will honour its obligations this week,” Mr Mambwe added.

He said in the same meeting, Management requested the unions to give it up to Monday next week to lobby the Government to release the much-delayed grants and outstanding tuition fees.

“We will issue another update on this matter early next week or earlier,” he said.

President Lungu commends PF on the Copperbelt Province for conducting peaceful campaigns

President Edgar Lungu has commended the Patriotic Front (PF) on the Copperbelt Province for conducting peaceful campaigns, ahead of the Roan parliamentary by-elections.

ZANIS reports that the President said this upon arrival at Simon Mwansa Kapwepwe International Airport, ahead of his scheduled campaigns in Luanshya district.

The President called on the PF members to continue holding peaceful deliberations until the close of campaigns on Wednesday, April 10th, at 18:00 hours.

President Lungu said the PF is aware of the strategy by opposition political parties, adding that the PF will however stick to their mandate and distance themselves from any form of violence.

And speaking earlier, PF Copperbelt Province Chairperson Nathan Chanda assured the Head of State that the party was strictly adhering to his instruction of conducting peaceful campaigns.

Mr Chanda explained that the party has decided not to concentrate on the opposition, but rather confine themselves to issue based campaigns.

The Provincial Chairperson also revealed that the party on the Copperbelt has resolved to ensure that they vote for President Lungu back to state house come 2021.

Meanwhile, Copperbelt Minister Japhen Mwakalombe who led hundreds of Ndola residents to Simon Mwansa Kapwepwe International Airport to receive the President, said people in the province are elated with the transformation that is taking place.

Mr Mwakalombe SAID Copperbelt residents have witnessed numerous developmental progress which include works on the Ndola/Chingola dual carriageway.

He added that people in the province were happy with the water reticulation that is taking place and has since created jobs for the locals.

President Lungu is in the province to drum up support for the PF candidate in the Roan Parliamentary by-election, Joel Chibuye, slated for Thursday April 11, 2019.
