UPND lawyer Martha Mushipe loses practicing licence, her law firm shut

The Law Association of Zambia has withdrawn the practicing licence for UPND lawyer Martha Mushipe with immediate effect.

The Association has also closed down Mrs Mushipe’s law firm, Mushipe & Company Limited.

Mrs Mushipe is accused of running a one man show.

LAZ says Mrs Mushipe cannot appear before any Court of Law or Tribunal and should not file any court process of whatever nature until further notice from the association.

In 2016 LAZ summoned Ms. Mushipe who was a senior counsel for the UPND to appear before its legal practitioners’ committee for alleged misconduct during the Constitutional Court’s hearing of the presidential election petition.

Police at the time charged and arrested Lusaka lawyer Martha Mushipe for being in possession of seditious materials.

The charge related to a confidential document entitled “Strategy of domination PF against UPND 2015-2016 and beyond-UPND at crossroads-transition or conflict/Patriotic Front’s use of ethnic divide and rule as a means of maintaining political control in Zambia 2015-2016 and beyond”.

The Chinese Contraceptive pill is not a herbal drug and is illegal-ZAMRA

The Zambia Medicine Regulatory Authority (ZAMRA) has disclosed that the initial test results for the Chinese Contraceptive pill have indicated that it is not a herbal drug and has long lasting side effects.Speaking at a Press briefing in Lusaka today, ZAMRA Director Medicine Control, Zuma Munkombwe noted that the Chinese Contraceptives is not a registered drug.

Dr. Munkombwe said the pills quality and safety is not yet certified in the country and has since called on all Chinese health facilities to stop dispensing it.

He said what is sad is that on the packaging the instructions and the ingredients are in Chinese which does not conform to the standards of the country.

Dr. Munkombwe said ZAMRA made investigations on the alleged pill, inspected premises and tested the efficacy.

He said as things stand, ZAMRA has certified the Chinese contraceptive pill not fit for the Zambian market.

Dr. Munkombwe said it was discovered that the Chinese pill has two active hormes with very high content and long lasting side effect because of its high dosage.

He said the Chinese that own the facilities that dispense the pill have been warned to desist from stocking the pill.

Dr. Munkombwe said it is sad that the same pills are brought into the country in briefcases and are not declared at the point of entry.

He said like any other drug, there is need to follow the right procedure and if a drug is illegal it must attract a fine.

Kamanga wishes Chipolopolo good luck

FAZ president Andrew Kamanga is wishing Chipolopolo all the best in Saturdays 2019 AFCON Group K qualifier against Namibia.

Namibia and Zambia clash on match-day-two of the 2019 AFCON qualifiers without a win or point in Group K following similar 1-0 away and home defeats to Guinea Bissau and Mozambique respectively in June 2017.

Saturdays match will also mark Sven Vandenbroek’s first days on the job as Chipolopolo coach since he replaced Nyirenda Wedson Nyirenda in July.

And one of the Belgians first acts was to recall some high profile veterans like the DR Cong- based midfield duo of Nathan Sinkala and Rainford Kalaba of TP Mazembe who were banished from the team by Nyirenda over the last 20 months.

ZESCO staff report early for work after Lusambo visit

Majority of workers at ZESCO Head Office in Lusaka this morning arrived early for work a day after Lusaka Province Minister Bowman Lusambo visited the institution.

On Thursday, Mr Lusambo stormed ZESCO HQ before 08 Hours and cautioned the workers against reporting late for work.

And a check on Friday morning at ZESCO HQ revealed that a large number of workers had arrived way before 07:30 Hours.

Records from the Human Resources Department confirmed the impressive early turn out of staff.

It is believed that some workers feared being locked out of the gate if they arrived after 08 Hours.

This was after word went round that management had resolved to start turning away late comers.

During his impromptu tour of ZESCO, Mr Lusambo who was stationed at the main gate demanded that the workers change their attitude towards work if the institution is to provide quality service to the people.

He said ZESCO is an important national installation and it is critical that workers put in more than 100 percent in their work.

Mr Lusambo said the culture of poor time keeping is one that has contributed to the under development in Zambia.

“It’s unacceptable that you have to report for work after 08 Hours. We pay you a salary and you stealing from us by coming late. This should not be allowed to continue,” Mr Lusambo told an identified man from the IT Department at the gate who reported late for work.

Mr Lusambo who was later briefed by the ZESCO management said his office had been receiving numerous complaints from members of the public on the poor attitude of ZESCO workers.

He also told ZESCO management to start limiting the amount of staff loans that workers are acquiring.

Mr Lusambo said the issue of over borrowing is causing a lot of financial stress among ZESCO workers further urging the Finance and HR Departments to intervene by setting a reasonable threshold staff loans.

He observed that financial stress is causing low morale among workers and creating a breeding ground for corruption.

Sven: Chipolopolo ready for Namibia

Chipolopolo Sven Vandenbroek has declared that they are determined leave Windhoek this weekend with the three points.

Chipolopolo and Namibia clash in Windhoek on September 8 on match day two of the 2019 AFCON Group K qualifiers.

Both Zambia and Namibia have zero points following similar 1-0 home and away defeats in June , 2017 to Mozambique and Guinea Bissau respectively.

The match will also mark Vandenbroek’s debut game following his appointment in July.

“I don’t think there is anyone in this room who likes to lose, so everyone likes to win,” Vandenbroek said when the team paid a courtesy call on the Zambia High Commissioner to Namibia Stella Libongani on Friday.

“We are all in a good mood and so you can erase your worries.

“The second thing is even when we have to win, we also have to be reflective, in that we have to organize everything in the best way. It is a two way thing.

“But tomorrow we will play for a win and will do our best to come back with the three points.”

Saturday’s game will be the third meeting in 2018 between the sides after initially drawing 1-1 in January at 2018 CHAN in Morocco in a final Group B match.

Zambia later beat Namibia 4-3 on post-match penalties in the 2018 COSAFA Cup quarterfinals s on June 2 in Polokwane, South Africa.

Meanwhile, the match will also mark the return of midfielder and ex-Chipolopolo captain Rainford Kalaba after a 15 month exile after former coach Wedson Nyirenda banished him from the team.

Also back is Kalaba’s TP Mazembe club mate and midfielder Nathan Sinkala who returns for the first time since the 1-1 away draw against Cameroon in a 2018 FIFA World Cup Group B qualifier in Limbe in November,2016.

The Zambia Police Service has urged calls boys in the Central Business Districts (CBDs) around the country against stripping innocent ladies and women for what has been termed as ‘indecent dressing’

Ms. Katongo noted that the vice of call boys undressing girls and women in public places is not only harassment but also inhuman.

Speaking in a telephone interview with ZANIS in Lusaka today, the Police Spokeswoman said there is no dress code in Zambia.

“No-person is allowed to treat another person inhumane manner by undressing a girl or woman. That’s harassment! Therefore, call boys immediately must stop this nonsense,” Ms. Katongo vividly said.

She wondered why no-one undresses boys or men who opt to wear trousers below their thighs.

Ms. Katongo has further appealed to the victims to report the perpetrators usually call boys to the police.

She further appealed to members of the public to assist by arresting the culprits and surrender them to the police or other law enforcement agencies.

The Police public relation officer said call boys should be counseled on their ‘bad behavior’ as opposed to taking the law into their own hands.

Sadly and in most instances in the country, a number of girls and women have been stripped naked by a horde of youths who accuse them of impolite dressing.

Chienge Council Chairperson expresses worry at stalled road works

Chienge Council Chairperson Mpundu Mwape has expressed worry at the stalling of works on Kaputa-Lunchinda road in Luapula Province.

Mr. Mwape said the stalling of the road construction has greatly affected businesses for the local people as the road has now become impassable for almost a year now.

The Council Chairperson said this in an interview with ZANIS in Lusaka today.

He explained that the road is under the 8000 link Zambia road project and connects Chienge district to the Democratic Republic of Congo through Mpweto district in Katanga Province.

Mr. Mwape revealed that China Henan was awarded the contract to construct the road of which mobilization was conducted but no progress has been recorded.

He said the contractor has been on site for about three years but has not commenced works.

Mr. Mpundu has since appealed to the Road Development Agency (RDA), to ensure that the contractor commences work on the construction of the road in order for the road to be completed in good time.

He explained that the road is of great importance to the area as it services a huge number of people.

Police on the Copperbelt have summoned Bahati Patriotic Front (PF) member of parliament Harry Kalaba to appear before the division headquarters on September 11 at 10:00 hours.

According to a call out issued by the Copperbelt Division Criminal Investigations officer and delivered to Kalaba today, the former Foreign Affairs Minister is expected to appear before them without fail.

And The Democratic Party has won the court case in which it had sought for judicial review in a matter where the party had been deregistered by the Chief Registrar of Societies Madam Mhende.

High Court Judge Sharon Newa has since directed the Registrar of Societies to issue the party with a duplicate certificate of registration.

In this case, the Democratic Party, through its national secretary Precious Ntambu, commenced judicial review proceedings challenging the registrar’s decision to cancel registration of the party, arguing that it was illegal.

The Registrar deregistered DP on June 6, this year, on grounds that it had not addressed the issue of why it should not be cancelled.

But delivering judgement on Thursday, Justice Sharon Newa said the decision to cancel the registration of the party was illegal, irrational and procedurally improper.

“In this case, not only was the Registrar of Societies decision to cancel the registration of the applicant as a political party illegal, it was also irrational, unreasonable and procedurally improper and I declare so, and the applicant succeeds. I accordingly quash the registrar’s decision and direct the registrar of societies to issue the Democratic Party with a duplicate certificate of registration. The applicant is also awarded costs to be taxed in default of agreement, leave to apply is granted,” said judge Newa.

And DP Spokesperson Judith Kabemba says “the party wishes to thank its members across the country, our sympathizers and the nation at large for your resilience, endurance and determination that you have demonstrated through out the struggle.”

“Your ability to stand firm and not grow weary has again demonstrated that Zambia needs and is ready for change and that change is the Democratic Party,” Mrs Kabemba said.

“Further , we wish to advice our leaders in the structures all across the country and members to go flat out and begin the national wide mobilization which the party had earlier embarked on before being unceremoniously and unfairly disturbed.”

She said the party believes that the time that the party has lost in this process will surely be recovered soon because Zambia needs change and that change is what is going to give the party a platform.

“Let me state that the nation will be availed with the full judgment of the court. The party will further advice it’s members soonest on other activities that will be lined up,” she said.

CSOs granted K48.9 million for the promotion of good governance

The Swedish Government says it has aligned itself to Zambia’s Seventh National Development Plan (7NDP) in achieving broader development objectives.

Swedish Embassy Head of Development Co-operation, Karin Sverkin notes that the plan is effective, inclusive participatory, accountable, transparent and leads to good governance.

Ms. Sverkin said this in Lusaka today during the signing ceremony of K48.9 million grant to support the civil society organizations (CSOs) in Zambia through the Swedish International Development Agency (SIDA) and Action Aid Zambia.

The grant is meant to strengthen the effectiveness of the civil society in promoting good governance and increase citizens awareness and human rights in the country.

The Envoy challenged the beneficiaries of the grant to use the funds prudently by being transparent and accountable.

And Action Aid Zambia Board Chairperson, Aretha Mwale paid tribute to the Swedish Government for aiding CSOs in areas of civic participation, youths and women rights, humanitarian and emergencies.

Ms. Mwale disclosed that the grant has renewed CSOs’ commitment towards social justice, gender equity and poverty eradication in Zambia.

Meanwhile, Action Aid Country Manager, Nalucha Ziba disclosed that the organisation has expanded its services in selected districts of Muchinga, Northern and Western Provinces respectively.

Ms. Ziba said this is in line with the four-year strategic plan (2018-2022) which prioritizes empowering women, girls and the youths, civic participation, accountability and gender equality.

Importation of cheap oil will not affect fuel pump price

Government says the US$20 million worth of fuel consignment from Saudi Arabia is now being transported from Tanzania to Zambia .

Minister of Energy, Mathews Nkhuwa told ZANIS in an interview today that the bathing (off-loading) of fuel which docked on the 10th of August was concluded.

Mr. Nkhuwa explained that the fuel consists of diesel and petrol, noting that the transportation of diesel is underway.

He disclosed that the exercise of transporting fuel from Tanzania into Zambia will be done within 2 to 3 weeks and another consignment will be ordered from Saud Arabia.

“The Fuel is rolling into the country starting with diesel and later on petrol which will be transported into the country. But let me emphasize that this consignment will not see a reduction in the pump price of fuel because the fuel the country uses is more than this consignment,” he said.

The Minister explained that the country has enough fuel reserves and the fuel being imported from Saudi Arabia will be an addition to the existing stocks.

He further disclosed that the country uses US$1 billion worth of fuel per annum adding that, US$ 500 million is imported and US$ 500 million worth of fuel is produced by Indeni oil refinery.

He said Zambia Oil and Gas exploration resumed with enthusiasm in 2000 following the discovery of oil and gas in Uganda and Kenya in the great East African Rift Valley.

He noted that Zambia and other African Countries should learn from Nigeria and Equatorial Guinea on the exploration of oil and gas.

Acting President Inonge Wina has appealed to the Zambia Revenue Authority(ZRA) to proactively engage all stakeholders to help the country cultivate and sustain a positive culture of paying taxes among the citizens.

Mrs. Wina said ZRA should forge effective partnerships with other enforcement agencies to undertake joint enforcement in order to reduce enforcement costs and make tax administration more cost-effective, efficient, equitable, simple and responsive to economic growth.

Mrs. Wina said this during the official opening of the ZRA Service Centre at the Cosmopolitan mall in Lusaka yesterday.

She said there is need to ensure that there are no sacred cows in the tax system hence, the need to make the taxes fair for every tax payer as there is one sure way of reducing the poverty levels for people than them having more disposable income.

Mrs. Wina commended the ZRA for reforming and modernizing its operations to suit the needs and expectations of its stakeholders.

She stated that it is only through such initiatives of taking services closer to the people that voluntary tax compliance will increase in the country.

Mrs. Wina noted that it is important to reduce the cost of compliance for the people if the country is to widen the tax base.

She said government will like to see that while Zambians pay taxes, the tax burden should not stifle their livelihoods.

Mrs. Wina is hopeful that the minister of finance will consider the plea of not burdening ordinary Zambians with taxes as she presents the 2019 National Budget.

She said the Patriotic Front has not deviated from the desire to put more money in the people’s pocket as it has been the founding principal of the party manifesto and remains committed to it.

Mrs. Wina added that, the desire of government is that tax administration should be more consultative and responsive to the peculiar needs of all taxpayers.

She said government will continue to support initiatives aimed at strengthening stakeholder engagement and enhancing the public confidence in the country’s revenue mobilization systems.

Mrs. Wina explained that at the same time, it is important to ensure that the tax burden is fairly distributed according to the principal of ability to pay and if taxpayers in reciprocation voluntarily recognize their moral and civic duty to pay taxes.

And ZRA Commissioner General Kingsley Chanda revealed that the institution’s intention is to increase its presence throughout the country in order to make it easier for people to pay taxes.

Mr. Chanda explained that that is the reason for continuously taking services closer to the people.

Meanwhile, Acting Minister of Finance, Emerine Kabanshi said the ZRA Service Centre will not only increase revenue collection for the provision of public goods and services but will also reduce the cost of compliance for the taxpaying public.

She assured ZRA of continued support to achieve sustained modernization and automation of revenue collection processes coupled with an upscale in taxpayer education and advisory services.

Nevers Mumba: The Real Ghost Haunting the MMD

Growing opposition to UNIP’s monopoly on power, due in part to economic problems and corruption, led to the formation of the MMD in July 1990, led by Dr Akashambatwa Lewanika, Arthur Wina, Sikota Wina and Frederick Chiluba the head of the country’s trade unions.

The First ever multi-party general elections since the introduction of a one party state in the early 70s were held on 31 October 1991, and saw the MMD sweep to power in a massive landslide win. Chiluba was elected President of Zambia becoming the 2nd Republican President with 76% win of the vote to Kaunda’s 24%, whilst in Parliament the MMD won 125 of the 150 elected seats.

Before his party’s convention in 1990, Mwanawasa was widely tipped to become the President of the MMD, but he declined the overture, citing his young age and inexperience. After Frederick Chiluba was elected as President, he appointed Mwanawasa as Vice-President in December 1991.

Mwanawasa served as Vice-President until he resigned in 1994. In 1996 he unsuccessfully contested against Chiluba for the presidency but lost. After the loss, Mwanawasa retired from politics until the 2001 election.

In August 2001, the National Executive Committee of MMD elected Mwanawasa as its presidential candidate for the 2001 election. He won the election, held on 27 December 2001.

Mwanawasa ran for a second term in the presidential election held on 28 September 2006. Michael Sata of the Patriotic Front was considered his main challenger.

His re-election was confirmed on 2 October; according to official results, he received 42.98% of the vote. He was sworn in for another term on 3 October. A few days later, he named a new cabinet and appointed Rupiah Banda as Vice-President.

Mwanawasa did not complete his second term in office due to poor health leading to his demise on 19 August, 2008.

Presidential elections were held in Zambia on 30 October 2008 following the death of Mr. Mwanawasa as the elections had to be called within 90 days of his death.

It was expected that there would be internal problems within the ruling MMD as Mwanawasa had not declared a successor prior to his death, but Acting President Rupiah Banda was selected as the MMD’s candidate without apparent problems after beating the likes of Ng’andu Magande who was among the contestants.

In 2011 as per tradition and Party constitutional demand the MMD went on to hold its general convention in kabwe that saw Republican President Rupiah Banda elected for a 5 year term as president of the party and MMD presidential candidate for the 2011 general elections, unfortunately MMD Presidential candidate Rupiah Banda lost that election to PF Presidential candidate Michael Sata, After the MMD lost the 2011 elections to the PF, Rupiah Banda relinquished his position as MMD President and went into retirement leading to the party holding an extraordinary convention to elect “a leader” that will complete the 5 year mandate started in 2011 by RB, this extraordinary convention saw the likes of former finance minister in the MMD government Hon Situmbeko Musokotwane, Hon Felix Mutati and Nevers Mumba go head to head for the position of party President, Nevers Mumba emerged victorious against his closest rival Felix Mutati, a defeat Mutati graciously accepted but this was the beginning of what is referred to in the MMD circles as the death of democracy and the birth of tyranny as those that did not support Nevers Mumba or had views that where different to his were either suspended or expelled and those seen to be loyal to the new party President rewarded with positions.

Those senior party members opposed to his way of presiding over party matters such as his two vice presidents, Hon Micheal Kaingu and Hon Brig Gen. Dr Brian Chituwo, Hon. Dr Musokotwane, Hon. Michael Mabenga, Hon. Shikapwasha, his closest ally during his presidential bid, Hon Dorah Siliya, Hon. Prof. Lungwangwa, Hon Catherine Namugala, Hon Anne Chungu, Hon Mutolo Phiri, Hon. Muchima, Hon Felix Mutati, Hon George Mpombo, Amb. Muhabi Lungu, MMD legal affairs chairperson Bradford Machila, Hon. Maj Richard Kachingwe who was unceremoniously, ridiculed, embarrassed, beaten and dragged out of the party secretariat by Nevers Mumba through Bowman Lusambo and his thugs, among others were either suspended or expelled.

Dr. Mumba continued going against the party constitution by appointing members who were loyal to him in order to consolidate his grip on power but it was just before the 2016 elections that the situation changed as even those he appointed to positions of power saw the need to save the party from tyranny and unconstitutional leadership, Hon Mwansa Mbulakulima who was appointed by Nevers Mumba as Party National Secretary, Mr Raphael Nakachinda who was appointed as Party Spokesperson braved the possibility of expulsion and physical attacks from Nevers Mumba’s minions and stood on the side of the truth together with those who were slapped with what they termed as illegal suspensions and expulsions then demanded that a convention be held as the five-year mandate given to Dr. Mumba was nearing its expiry.

This was followed by tedious court processes characterized by injunctions and counter injunctions and at one point Nevers waving Plain papers to the media lying that he had obtained an injunction against Mutati and those calling for a convention, a stunt that later came back to bite Nevers as the media now knew what type of clothe he was made from but after all the infighting and court documents, a convention was successfully held which ushered in Hon. Mutati as Party President but this did not end the legal battles which have continued to-date now over the legality of the convention as well as legitimacy of those elected.

However, from a moral aspect, one only needs to wind back on Dr. Mumba’s past to understand why this confusion in the MMD has continued.

Dr. Mumba did not start his public life as a politician, He started out as an evangelist who took the religious platform in Zambia by storm becoming the first tele-evangelist in the country and for close to two decades pulled huge crowds, preaching with eloquence, a message of hope and dignity through Christ under a theme message of “Zambia shall be Saved”.

However, because of his fame a growing desire for power grew in him, Dr. Mumba, in 1997 while away in Windhoek Namibia, announced that he had formed an organization called The National Christian Coalition (NCC) to push for political reforms in Zambia and that the NCC was going to take on President Chiluba’s government head on.

Realising that Mumba’s society was a political front and not a church organization, Chiluba’s government was unleashed on the NCC’s status as a society forcing its leader to quickly transform it into a political party and renamed it the National Citizens Coalition (NCC).

His abandonment of the pulpit in preference to politics dwindled his fortunes as many of his followers felt betrayed as they remembered a time he assured them that he would not join politics as joining politics would be a demotion to his purpose and call from God, this drastically marked the downfall of the good name he had built for himself. His followers started doubting him and soon, even his financial status suffered.

Two years after Mwanawasa came into power in 2003, he gave Dr. Mumba a man that challenged his election a second chance to reorganize himself by appointing him as Republican vice President. As a matter of fact, Dr. Mumba dissolved his NCC 24 hours before to facilitate for that appointment, again betraying people that believed in him, this time his political followers and other NCC party leaders.

However, he hardly lasted a year as vice president as he was fired in 2004 due to his unbridled abuse of power resulting from his visible pride and arrogance.

When RB came into power, he, just like his predecessor Mwanawasa had done, extended an olive branch to Dr. Mumba by appointing him as ambassador to Canada but was recalled during Michael Sata’s regime following the Barrick Gold Co-operation scandal in which he was accused of pocketing huge sums of money meant for the Canada-Zambia exchange show a case that is stil in court to now.

With this history, the MMD has demonstrated all through the ages that it was founded on strong democratic principles which are not only enshrined in its constitution but evident in its intra-party democracy in which the party has had a peaceful transfer of leadership every after five years.

It is true to say Dr. Mumba today is the ghost that is haunting the MMD because of his puffed up ego of national leadership while playing dictatorial tendencies to shut up dissenting voices and paralyze his perceived competitors within the rank and file of the party.

No wonder he found solace in going to bed with another dictatorship, the UPND, in the previous election because birds of the same feather truly flock together! Had it not been for Dr. Mumba, the MMD would not have been as divided as it is today and would probably have been the second largest opposition political party because it is the only party with a true national character with representation in all corners of the country from section to provincial level.

From 1990 to-date, it is only during the reign of Dr. Mumba that the party failed to observe intra-party democracy. Two years in office as Party President Hon Felix Mutati has already started holding Provincial Conferences to have the members of he party elect their leaders as per MMD tradition and constitutional demand, something that was last seen before Nevers Mumba became President.

We challenge Nevers Mumba to tell us who in his National Executive Committee was elected by Party Members, when and where was the said convention held to elect them and when does their mandate end.

To the MMD faithful, the elephant is already in the house and it will take decisive and drastic measures to remove it without breaking your property.

President Lungu arrives back from China

President Lungu has arrived back home after concluding his working visit to China where he attended the China Africa forum and visited a number of Chinese firms.

President was met on arrival by the Vice President Ms Inonge Wina and other Government officials.

On His last day the president toured China’s largest integrated copper producer, Jiangxi Copper Corporation Limited (JCC), based in the Chinese province of Jiangxi.

Established in 1976, JCC is a state owned enterprise and the only Fortune Global 500 companies in Jiangxi province. And in 2017, JCC produced 1.3749 million tons of copper cathode, achieved a turnover of 225.2 billion Yuan with EBIT at 7.734 billion Yuan.

Its principal activities include copper mining, milling, smelting and refining to produce copper cathode and other related products, including sulphuric acid.

Jiangxi Copper Corporation Limited like other Chinese enterprises and companies have expressed interest in investing in Zambia following the historical twinning of Jiangxi and Muchinga provinces.
