Constitutional Court Hears Challenge on Former President Lungu’s Eligibility

38

Lusaka businessman Michelo Chizombe has presented arguments before the Constitutional Court, alleging that the Electoral Commission of Zambia (ECZ) violated Article 52 of the Constitution by accepting former President Edgar Lungu’s nomination papers in the 2021 Presidential Election. Mr. Chizombe contends that Mr. Lungu was ineligible to contest the 2021 General Election.

Mr. Chizombe reiterated his stance during yesterday’s submissions, following the petition he filed in October. In his petition, he sought a declaration that former President Lungu was not eligible for a presidential bid in 2021 and should be disqualified from any future elections. Additionally, he sought a declaration that Mr. Lungu’s participation in the 2021 General Election was unconstitutional.

The basis of Mr. Chizombe’s argument lies in Article 106, Sub-Article 3 of the 2016 Amended Constitution, which, according to him, renders Mr. Lungu ineligible for contesting the 2016 General Election due to having been sworn in twice as the Republican President in 2015 and 2016. Mr. Chizombe also referenced the repealed Article 35 of the 1996 Amended Constitution, which, he argued, excluded individuals elected twice from contesting Presidential Elections.

The Constitutional Court is tasked with considering the merits of Mr. Chizombe’s petition and determining whether the ECZ acted in breach of the constitution by accepting Mr. Lungu’s nomination papers in the 2021 election. The court proceedings will play a pivotal role in shaping the interpretation of constitutional provisions related to presidential eligibility.

The case raises crucial questions about the interpretation of constitutional provisions and their implications for political figures seeking reelection. The court’s decision will have significant consequences for the country’s political landscape and may set precedents for future electoral challenges. The hearings continue as stakeholders closely watch the developments in this landmark case.

8

President Hakainde Hichilema, in a message to the UPND party leadership in the Northern Province, emphasized the need for unity, organization, and a relentless focus on development to fulfill the promises made during the election campaign. The President, reflecting on the party’s history and the challenges faced, urged members to prioritize delivering progress for all Zambians during the New Dawn government’s five-year mandate.

Acknowledging the historic journey of the UPND, often marred by name-calling and challenges, President Hichilema expressed gratitude for the overwhelming support from Zambians in the 2021 elections. He noted the party’s past struggles, highlighting the merger of Muchinga and Northern Provinces and the continuous efforts to convey the UPND’s message even in challenging times.

“We recall vividly how we used to get 1, 000 votes from both Muchinga and Northern Provinces before they were merged and this was back then but we didn’t stop pushing our message in this part of the country,”he said

President Hichilema urged party functionaries to move beyond past grievances and focus on delivering the change that Zambians voted for. He stressed the importance of development over lawlessness, underscoring the responsibility of party members to work in an organized manner for the benefit of the country.

“Our message to our UPND Northern Province party leadership this evening was clear. There is no President Hakainde Hichilema without UPND, and therefore, anyone given an opportunity to serve the public must always have this at the back of their mind,” President Hichilema stated.

He further emphasized the necessity of unity within the party, urging the recruitment of new members, active mobilization, and consistent communication with voters regarding achievements, current progress, and future plans. President Hichilema reminded party members that their roles in public service were a direct result of UPND’s existence and the trust bestowed upon the party by Zambian citizens.

The President concluded his message by expressing optimism that, working in an organized manner, the UPND would deliver progress for all Zambians during its five-year mandate. He extended gratitude to the Northern Province party leadership for their commitment to the UPND cause, noting tangible rewards such as free education and job opportunities already materializing under the New Dawn government.

The Fistula Foundation has officially handed over a state-of-the-art Fistula Ward with a 40-bed capacity to St. Francis Mission Hospital in Katete District. The newly constructed ward, valued at over K2 million, aims to provide dedicated space for treating a substantial number of fistula patients concurrently, ultimately contributing to the decongestion of the hospital.

The event, attended by Eastern Province Minister Peter Phiri, marked a significant step forward in addressing maternal and neonatal health concerns in the region. Minister Phiri emphasized that maternal and neonatal services remain a top priority for the government, expressing the administration’s commitment to eradicating obstetric fistula—a condition that adversely affects the fundamental human rights of women.

“The government is committed to achieving universal health coverage for sexual and reproductive health services. The government’s vision is to prevent fistula and institutionalize treatment at all provincial hospitals,” Minister Phiri stated.

Bwalya Chomba, the Fistula Foundation Zambia Programmes Director, affirmed her organization’s dedication to supplementing government efforts in providing high-quality repair services for fistula cases. Ms. Chomba highlighted the pervasive impact of fistula in many communities, expressing the organization’s commitment to supporting the treatment of affected women in the Eastern Province.

“In the world that we envision, women will be able to flourish in their communities instead of languishing in the shadows. Today, we celebrate the three-year partnership, during which we have supported the treatment of almost 350 women for a free life-transforming surgery coming from across the entire Eastern Province,” she declared.

William Mchombo, the Chairperson of the St. Francis Hospital Board, conveyed gratitude to the Fistula Foundation for its commitment to improving the well-being of women in the area. He also acknowledged the government’s ongoing support for church health institutions, emphasizing the positive impact of various health initiatives.

Chief Mbang’ombe of the Chewa people in Katete and Sinda Districts pledged to ensure that women suffering from fistula in the communities receive the necessary repair surgeries. Obstetric fistula, resulting from prolonged obstructed labor during childbirth, remains a significant health concern, and the new Fistula Ward at St. Francis Mission Hospital is poised to make a considerable impact in addressing this challenge in the Eastern Province.

President Hichilema Advocates for Increased Zambian Representation in International Organizations

19

Cornelius Mweetwa, Chief Government Spokesperson and Information and Media Minister, has conveyed President Hakainde Hichilema’s commitment to fostering greater representation of Zambians in international organizations, particularly highlighting the African Union (AU).

During a courtesy call on the African Union Commissioner for Trade, Minerals, and Industry, Albert Muchanga, Mr. Mweetwa emphasized President Hichilema’s desire to see more Zambians assume roles in international bodies. Acknowledging the critical role of Zambian professionals in international organizations, Mr. Mweetwa highlighted their capacity to advocate for the country’s positions on key global matters.

Speaking about the President’s vision, Mr. Mweetwa stressed that Zambians serving in international roles should project a positive image of the country on the global stage.

Additionally, Mr. Mweetwa touched upon a recent Presidential directive concerning government workers’ travel expenses. He stated that any government official traveling at government expense is required to produce a detailed report justifying their travel. This directive, particularly targeted at ministers, is intended to ensure transparency and accountability. Ministers are expected to present reports during Cabinet meetings, outlining the specifics of their travel, matters discussed in meetings, and the tangible benefits for Zambia.

Commenting on the directive, Mr. Muchanga echoed its importance, affirming the need for accountability in government-related travel. He emphasized that ministers’ reports are essential for informed decision-making and contribute to Zambia’s active participation and benefit in international forums.

The statement on this matter was provided by Inutu Mwanza, First Secretary-Press and Tourism at the Zambian mission in Ethiopia.

Thanking Mothers and Christmas Celebration

1

By Mwizenge S. Tembo, Ph. D.

Emeritus Professor of Sociology

When my 88-year-old mother passed away in 2018, I was grieving for weeks and months. The woman who had given birth to, cuddled, nurtured, and fed my 8 siblings and I was gone from this earth. I had known her in my life for 58 years. Her sweet soulful voice was going to be with me for the rest of my life even though she was physically gone. She had done so much in nurturing and guiding me that it was priceless. How could I ever thank her?

Grief and deep pain are at their worst the first minute, hours, days, and perhaps even weeks after a beloved one is gone. But then miraculously the deep festering wound in your heart that grief inflicts begins to congeal and heal along the edges. I badly wanted to thank my dear departed mother. I gradually realized that 8 years earlier in 2010, I had thought of writing all my mother’s sayings when I was growing up with my 9 siblings. This is how I came to write the book: “Sayings of my Mother”. https://www.amazon.com/dp/B0CNRBR8VY/ref=sr_1_1?crid=3G4T2R71JLX7R&keywords=mwizenge+tembo&qid=1700602394&sprefix=mwizenge+tembo+%2Caps%2C60&sr=8-1

Pensulo Publishers in Lusaka in Zambia have published the book.

The book has 24 selected sayings. Two Examples of some of the sayings are: “Saying 1. Mwana wolela nge nibotolo yayi(You do not raise a child like they are a delicate glass bottle)” “Saying 3. Kurya nge unamino pasingo (Don’t eat as though you have teeth in your throat)”. Writing the book was a labor of love. I had zero expectations that anyone else beyond my immediate family of siblings, young nephews and nieces would find the lofty sayings interesting. What stunned me was the raving reviews of the book and the sayings from more than half a dozen top and respected academics, cultural activists, men and women, renowned, and young budding writers. The book and the sayings seem to have hit a chord. I suspect that it is because we all have or have had mothers. Some of you are mothers right now. The sayings might echo some of the common sayings from mothers both in Zambia and all over the world.

It just occurred to me that readers may be interested in the Sayings of my Mother. As a matter of fact, the book is not only a thank you to my mother during this Thanksgiving holiday, but you can use some of the sayings to celebrate your mother who is living and those mothers that have passed. My thinking from earlier in the year was to publish the book and let it be a special celebration for both my mother, motherhood, and all mothers. I cannot understand why and how the “Sayings of my Mother” has suddenly transformed to an appropriate Thanksgiving and Christmas or holiday celebration of all mothers and motherhood.

Brief discourses following each of the 24 sayings include allusions to and brief applications of the sayings to life, sprinklings of cultural sociology, evolutionary anthropological concepts, motherhood, and kulanga Tumbuka Zambian/African language term or what is called counselling in Western epistemology. Nothing is heavy in the book because I deliberately wrote the book so that it is light and meaningful reading that appeals to the soul of motherhood and what it means to be a mother. The book is readable for everyone.

Out of the blue, Mr. Merle Wenger of the Harrisonburg Unitarian Universalist Church invited me to give a Sunday sermon to the congregation. You are welcome to attend the sermon on Sunday November 26 at 11:00am at 4101 Rawley Pike, Harrisonburg, VA 22801. If you cannot attend physically you can attend via Zoom. I regarded the unexpected request as an invitation from God and a blessing as that will be an opportunity for me to thank my mother during this Thanksgiving and celebrate her life and the lives of all mothers. I will share the intimate story of this ordinary woman who performed extraordinary things in my life and the lives of others. My mother was born in 1930. Never went to school because girls were not allowed to go to school during that time. This may be true for many or most mothers of her generation in Zambia in the then British Colonial Northern Rhodesia in Eastern Zambia in Southern Africa.

The book has been published and is available on Amazon: https://www.amazon.com/dp/B0CNRBR8VY/ref=sr_1_1?crid=3G4T2R71JLX7R&keywords=mwizenge+tembo&qid=1700602394&sprefix=mwizenge+tembo+%2Caps%2C60&sr=8-1

Stop playing Victim Tayali urges PF , as Bowman Lusambo is arrested

40

Police formally arrested and charged five individuals, including Bowman Lusambo, a prominent figure associated with the Patriotic Front (PF), for the offense of Unlawful Assembly. The charges are in contravention of Section 74 and 75 of the Penal Code Act Chapter 87 of the Laws of Zambia.

The individuals arrested are Bowman Lusambo, 47, of Chamba Valley in Lusaka; Saidi Chibwana, 52, of Industrial Area in Kabwe; Matthews Changwe, 39, of Kasanda Mine Area in Kabwe; Martin Simfukwe, 44, of Makululu Compound in Kabwe; and Billy Sichamba, 52, of Bwacha in Kabwe. The alleged offense occurred on November 2, 2023, at Kabwe town center along the Great North Road in Kabwe District.

Police Public Relations Officer, Rae Hamoonga, confirmed the joint arrest and charges, emphasizing the alleged violation of laws pertaining to assembly. All suspects have been released on police bond and are expected to appear in court in the near future.

However, the arrests have triggered a wave of controversy, with political commentator Chilufya Tayali, self-proclaimed “Public Lawyer of the Public Court of Opinions,” expressing skepticism about the Patriotic Fronts reaction to the situation. Tayali questioned whether the previous administration, the PF, would have tolerated a similar scenario during their tenure.

Tayali further urged those in opposition to exercise restraint, emphasizing the importance of maintaining peace in the country. He cautioned against playing the victim and highlighted the need for responsible political behavior.

“Police Public relations officer have told you, you are not in power, behave yourselves,we need order.” he said.

“Let’s be honest, would PF, when they were in power, allow UPND cadres to just spring up anywhere in support of any of their leaders like what happened to Bowman Lusambo in Kabwe where he had been summoned by police.
Why do you want to play victim when you know better about such politics. Just behave yourselves, you are not in power. We want peace in our Country. What do you expect the police to do when you have outnumbered them as cadres,” Tayli reiterated

Rural Electrification Authority Initiates Bio-Digester Project in Boarding Schools Nationwide

4

The Rural Electrification Authority (REA) has embarked on a groundbreaking initiative by commencing the construction of bio-digesters in 20 boarding schools across Zambia, allocating K5 million from its K197 million budget for renewable energy projects.

Senior Engineer Civil Planning at REA, John Mwale, announced that two boarding schools in each province will benefit from this renewable energy project. The bio-digesters, designed to promote eco-friendly and cost-effective energy sources in learning institutions, mark a significant step towards sustainable energy practices.

Speaking during a site handover ceremony at Kasisi Girls Secondary School in Lusaka, Mr. Mwale highlighted the positive impact of bio-digesters in schools, emphasizing their role in fostering environmental conservation and providing affordable energy solutions.

Lusaka Province Education Officer, Felix Ngoma, seized the opportunity to encourage the contractor to initiate training sessions for teachers and pupils on the proper operation of the bio-digesters. Mr. Ngoma expressed optimism that this initiative would contribute to cost savings on energy expenses, particularly in meal preparation for the students.

“The implementation of bio-digesters in schools aligns with our commitment to providing sustainable and affordable energy solutions, reducing the reliance on traditional energy sources,” stated Mr. Mwale. The project aims to address both environmental concerns and financial constraints faced by educational institutions.

In response to the news, Kafumbe Mambwe, the Head Teacher of Kasisi Girls Secondary School, expressed gratitude to REA for selecting their institution for this transformative project. Ms. Mambwe emphasized that once the bio-digester is completed, the school will no longer depend on firewood for meal preparation, contributing to a cleaner and more sustainable environment.

The REA’s investment in renewable energy projects for educational institutions reflects a broader commitment to fostering sustainable development, reducing carbon footprints, and creating a more energy-efficient future for Zambia. As construction progresses, the initiative is expected to set a precedent for similar environmentally conscious projects in the country.
