LAZ PRESS STATEMENT ON MISLEADING MEDIA REPORTS AGAINST THE ASSOCIATION

The Law Association of Zambia has noted misleading reports circulating in the press that LAZ has been ordered to pay K5, 000, 000.00 in costs for an interlocutory application before the Constitutional Court. LAZ would like to state the correct position on the matter.

On 1st March 2017, LAZ was successfully joined to the case of Dr Daniel Pule and others V the Attorney General in which the applicants are seeking a declaration that President Edgar Lungu is eligible to stand for election in 2021 on the basis that LAZ is an interested party by virtue of its statutory mandate to promote and protect Constitutionalism and the rule of law in Zambia as provided by section 4 of the Law Associatrion of Zambia Act Cap 31 of the Laws of Zambia.

LAZ made an application to a single judge of the Constitutional Court requesting permission to appeal the decision by the judge denying LAZ the opportunity to extend the time to file certain documents to the full court of the Constitutional Court.

The application was successful. However, in view of the delay occasioned by LAZ, the single judge awarded costs against LAZ which were not quantified as the parties have been ordered to agree on how much is payable in costs, failure to which, the amount of costs payable will be taxed (assessed) by the court.

LAZ has received a demand for costs in the sum of K5,000,000.00 from Dr Pule’s lawyers which LAZ has rejected in view of the excessiveness of the amount and has communicated the same to Dr Pule’s lawyers. Should the parties fail to agree on an appropriate amount for the costs, the matter will be referred to the court for taxation (assessment) of costs.

LAZ urges parties to this case to refrain from attempting to argue legal issues through the media as the case is still on-going. LAZ will further engage with the editors of the media houses that carried the misleading story to see how best the correct position can be reflected by them. LAZ has every confidence that due process will be followed by the Constitutional Court and that, whatever the outcome of the case, justice will prevail.

Zambia to launch 100MW solar tender

Zambian government says it will launch a tender for photovoltaic (PV) projects up to 20 MW in early 2018, which will be developed under the incentive scheme for solar energy.
The 100 MW tender will be the first round of the program GET FIT Zambia, which was launched on December 7.

It is now the official implementation program for the Zambian REFiT Strategy, an initiative developed with the support of German development bank KFW, aimed at accelerating private investments in small and medium sized renewable energy projects in the country.

Through the REFiT Strategy, the Zambian government hopes to allocate around 200 of PV and renewable energy capacity to small- and medium-scale projects with a maximum size of 20 MW, to be procured over a period of three years. Eligible technologies include hydro, solar PV, geothermal, biomass, waste energy and wind power.

Under the 100 MW solar tender, the government said that selected projects will have to sell power to state-owned power company, Zesco under a long-term PPA, and will have to be located close to substations, whose reliability has already been tested by Zesco in partnership with the KFW.

The government said all substations used for round one and two of the Scaling Solar program however, will be ineligible.

Prior to the launch of the request for qualification phase of the tender, GET FiT Zambia and partners in the Ministry of Energy will host a private sector workshop in Lusaka.

The REFiT Strategy was formally launched by the Ministry of Energy in October, after being approved by Zambia’s cabinet in July.

Ndola City Council has launched the ‘Know Your Leader’ program on radio Chimwemwe in Ndola.

The program is designed to get up close information about the leaders presiding over the affairs of the wards, cities, provinces, the nation and other institutions of governance.

The Mayor Amon Chisenga who was the first to feature, got interactive with the listeners and highlighted developmental projects so far scored under his tenure as mayor.

Amongst the highlighted projects by Mr Chisenga were the Copperbelt International Airport, overhaul of the water reticulation system for the city of Ndola, road construction projects under the C400 and Pave Zambia 2000.

The Mayor also highlighted the intensified garbage collection systems to avoid water borne diseases especially cholera and prudent land management systems by way of introduction of a GIS system by the department of planning.

When asked where he would want to see Ndola City by the year 2020, Mr. Chisenga was quick to share the vision of Ndola City Council which is to be a prosperous City by the year 2030, and a leading economic hub.

The Mayor further implored residents of Ndola to be vigilant and help curb issues of underage drinking and patronage of bars as the Council remains vigil to arrest the situation.

Mayor Chisenga also appealed to all well-meaning residents to love were they live and dispose of their waste in designated places for them to receive a proper waste management service from the Local Authority.

He urged everyone to subscribe for garbage collection service with the Council or franchise contractors within their residential areas.

Incest earns Kasama father 20 year jail sentence

The Kasama High Court has sentenced a 52 year old man to 20 years imprisonment for incest.

Appearing before High court Judge Davis Mumba, last Friday was Ignatius Mwila of Chief Munkonge’ s area in Kasama district.

Mwila, who is a peasant farmer, is said to have had carnal knowledge of his biological daughter on different occasions contrary to the laws of Zambia.

Passing sentence, Judge Mumba expressed dismay at the behavior of Mwila.

Judge Mumba said Mwila’s conduct to have sex with his biological daughter was an abomination only fit for animals that have no reasoning.

He said such characters needed a harsh sentence to deter would be offenders.

And in the same court, a man of Mpika district in Muchinga province was sentenced to 15 years imprisonment with hard labour for defilement.

Judge Mumba stated that such cases were on the increase in the country hence the need to punish offenders.

Two other people were also sent to prison for 10 years with hard labour for various offences.

Earlier, Judge Mumba condemned Jericho Chifunda and Lewis Muma to jail for arson and trafficking in psychotropic substances respectively.

The accused persons were represented by acting senior Legal Aid Counsel Keith Katazo and prosecuted by state advocate Mukuma Chipawain the matters before the court.

Passing sentence, Judge Mumba noted that the offences committed by the accused persons were grave.

Father arrested for killing his son

Police in Chipata district have picked up a 44 year old man for allegedly murdering his biological son.

Speaking in an interview with ZANIS yesterday, Eastern Province Division Criminal Investigations Officer Patson Mukomongo said police have arrested Samson Mkandawire of Chipata West for the alleged murder of his 26 year old son by the name of Agrippa Mkandawire.

Mr. Mukomongo said the duo picked up a fight on Wednesday last week around 01:00 hrs. after a misunderstanding.

He said the deceased who sustained a swollen stomach was rushed to Chipata Central Hospital where he was given medication and discharged later.

Mr. Mukomongo said the condition of the deceased worsened on Friday and was taken back to the hospital before being pronounced dead on Saturday morning.

He said a hoe handle is suspected to have been used by the suspect to beat the deceased.

Mr. Mukomongo said the investigations are ongoing and that the body of the deceased is in Chipata Central Hospital Mortuary awaiting post-mortem while, the suspect is in police custody.

Lusambo says CBU situation is unfortunate

Copperbelt Minister Bowman Lusambo says the student unrest at the Copperbelt University is unfortunate. Mr Lusambo said the situation could have been avoided through dialogue and round table engagement.

He said it is imperative for all the parties involved especially the students to adopt a less provocative and confrontational manner when airing out their concerns.

“I find the behavior of the students very disturbing especially that as intellectuals, society expects them to apply themselves in a more acceptable fashion than resorting to street demonstrations. Over the last one year as Minister in charge of the Province, I have openly engaged the student leadership on a number of issues and such engagements have always produced healthy results,” Mr Lusambo said in a statement.

He added, “The student leadership know my house, they have my phone number and they have been to my office several times and we have used effective methods of engagement to resolve issues affecting the student populace. Not too long ago, my office effectively intervened when majority of students faced the prospect of missing out on end of term exams due to failure to settle tuition fees.”

Mr Lusambo said it is baffling that students this time around opted to run into the streets in the thick of the night and in the process threatened public peace, order and property.

“I wish to strongly place it on record that Government shall not tolerate irresponsible and riotous behavior by students. The method of stone throwing by students may have worked effectively in the 70s but it has no place in our modern day society. As a former University student myself, I believe that the best approach is a roundtable discussion with all the parties involved,” the Copperbelt Minister said.

“As much as the strong handedness by some officers from our law enforcement agencies may not be appropriate, it is always important to remind the students not to provoke the situation. Our law enforcement officers are professionally trained to handle various situations in order to protect public order and peace and will always apply maximum restraint when dealing with defenseless individuals but I know that they will not watch a volatile security situation to degenerate.”

He said, “It is important that all stakeholders including parents and guardians provide effectively counselling to the students and make them understand that they are expected to be in campus at all times and not rush to the road side for whatever reasons.”

Mr Lusambo said the students should also be reminded that the majority are at campus at the expense of the tax payer and it is disingenuous to expect public sympathy from the same people that are paying for their stay at campus whose property and peace they are threatening wantonly.

“I wish to reiterate that Government through the Minister of Higher Education is fully committed to finding a lasting solution to the situation at CBU just like at many other institutions of higher learning. It is therefore imperative that students cooperate with the University management and remain calm as Government is working round the clock to resolve the matter.”

Mr Lusambo has since rubbished some online media reports attributed to him that he denied that there was any student unrest at CBU.

“I have just returned from Samfya, Luapula Province on official government business and there was never a time over the past weekend that I spoke to any Journalist over the situation at CBU. The nation would do well to dismiss such reports with the contempt it deserves,” he said.

Mr Lusambo has also warned some political players who may want to take advantage of the situation at CBU that as Provincial Minister, he is always on guard on all activities in the Province.

“Any machinations that may point towards fanning further disturbances in academic affairs at CBU or any other higher learning institutions in the Province will not be tolerated. Let us all work towards promoting dialogue as we develop all spheres of our beautiful nation,” he said.

Marketeers’ body welcomes banning of Street vendors in Mufulira

The National Traders and Marketeers Association of Zambia (NATMAZ) in Mufulira has praised government for banning street vending in the district.

Association District Chairperson Elvin Sakala praised government for the move saying this will create fair competition for marketeers doing their businesses in markets.

Mr. Sakala said the presence of street vendors was disadvantaging traders stationed at markets as people were opting to buy things from the streets rather than going to the markets.

He urged the Mufulira Municipal Council to uphold the decision and ensure that vendors do not return to the streets of Mufulira.

Last week, Mufulira Municipal Council cleared street vendors from the Central Business District in a move aimed at improving the cleanliness of the town and ensuring that trade was conducted at designated places.

The National Road Fund Agency (NRFA) says it is overwhelmed with the increased levels of compliance among motorists passing through the two newly opened Toll Gates in Kasama in Northern Province.

NRFA Public Relations Manager Alphonsius Hamachila said that so far, the number of vehicles passing through Kalense and Kateshi toll plazas in Kasama district has increased from the targeted 500 to over 600 per day.
ZANIS reports that Mr. Hamachila said he is optimistic that the development will translate into increased revenue collection for government from the road sector.

He has since encouraged motorists to continue supporting government policy on improving roads, stating that the proceeds from the toll gates will go towards the maintenance of roads across the country.

Mr. Hamachila has also called on stakeholders in the area to continue rendering the necessary support to officers manning the two road facilities in the district.

Meanwhile, some Kasama residents constructing houses in the area have complained of the increased transportation costs of building sand by K100 because of the toll-gate charges.

They have since appealed to the Police, Road Safety and Transport Agency (RTSA) and other stakeholders to intervene stating that the move by transporters is day-light robbery.

Don’t rush for those products on promotion cautions CCPC

The Competition and Consumer Protection Commission (CCPC) in Western Province has cautioned consumers against buying substandard and defective products during this festive season.

In an interview with ZANIS on Friday, CCPC Provincial Economist Bravo Muchuu said consumers should not get too excited with most price discounts but cross-check products to avoid buying any expired food stuffs and products.

“This is the period (festive season) that most of the prices are on discount, there are a lot of promotional offers such that consumers don’t even mind about the expiry dates of some products, or cosmetics or some drinks or whatever, food stuffs and end up buying food that is expired, especially those in rural areas,” he explained.

Mr Muchuu said it was imperative for consumers to question traders over attractive promotional offers which are rife this time of the year.

He observed that some traders intend to make clearance sales thus capitalizing on bulk buying from customers.

Mr Muchuu urged traders to be honest with the state of some products which have defects and are put up on promotion.

The CPCC Provincial Economist advised buyers to conduct window shopping of several stores before purchasing goods to avoid buying substandard products and not to incur financial losses.

Women, youths urged to take advantage of CEEC industrial clusters

Kitwe District Commissioner Binwell Mpundu has urged women and youths to take advantage of the industrial clusters that government will establish through the citizens economic empowerment commission (CEEC) funded at a cost of US$30 million by the African Development Bank.

ZANIS reports that the district commissioner said this when he officiated at a stakeholder’s workshop for the skills development and entrepreneurship project that support women and youth held at Malik barrack.

Mr Mpundu said the project’s goal was to contribute to job creation, promotion of gender equality and poverty reduction in the county while supporting women and the youth through skills development and entrepreneurship.

Mr Mpundu said his office will support the project and ensure its successful implementation because once completed it will open doors to businesses that will require financial backing.

Mr Mpundu said the US$30 million project will facilitate the construction of 10 industrial clusters and provide support to cassava value chain development in target districts of Mansa, Kasama, Northwestern provinces with market development intentions to Lusaka and the Copperbelt.

And CEEC Gender specialist Charlotte Sampa said Zambia is in a hurry to be transformed and it can only do that if all stakeholders are involved.

Ms Sampa emphasized that they will work closely with cooperatives once the project takes off to empower them with skills development and entrepreneurship.

Zambia’s Kenani transit centre now hosts more than 10, 000 refugees

The number of refugees fleeing violence in the Democratic Republic of the Congo (DRC) and being hosted at the Kenani transit centre in the north of Zambia has now passed the 10, 000 mark since August this year.

Kenani is the Zambia’s largest refugee transit facility with some 10,065 people in it.

“We passed the 10, 000 mark on Saturday, and more Congolese refugees are coming in from Chiengi. The overall number of new arrivals from the DRC to Zambia so far in 2017 through Chiengi and other entry points is now nearing 14, 000,” confirmed UNHCR Representative to Zambia, Ms Pierrine Aylara.

The Nchelenge District Administration has agreed to expand the Kenani transit center, by providing more space. The newly allocated space can now accommodate an additional 1,000 refugee families/5,000 individuals as efforts are continued to open a new permanent refugee settlement within the coming weeks.

Meanwhile, the Government, UNHCR and partners, are working to have Congolese refugees at Kenani transit centre as well as new arrivals relocated within weeks to a new permanent refugee settlement – called Mantapala – within Nchelenge District, with more space for improved facilities.

However, limited funding might hamper the timely relocation of refugees. Additional funds are required by humanitarian and development partners to repair the main access road and to open inner roads within the new refugee settlement. The funds are further required to set up basic infrastructures such as health, water and sanitation and primary education facilities as well as other basic amenities.

While the majority of Congolese arrive through the Chiengi border area, then relocated to Kenani, some are crossing into Zambia through other entry points, such as Nsumbu, Kaputa, Nakonde and Mpulungu in Northern, Kapushi and Kakoma, in North Western and Kasumbalesa and Sakania, on the Copperbelt province. These are relocated to Meheba and Mayukwayukwa Refugee Settlements.

Some 13, 924 Congolese have fled to Zambia since the beginning of 2017 through various entry points other (Chiengi and other entry points).

Zambia make dignified COSAFA U20 exit

Hosts Zambia on Monday made a dignified exit from the 2017 COSAFA U20 Cup after beating Swaziland to bow out of the tournament.

Zambia beat Swaziland 2-0 at Nkana Stadium in Kitwe in their final Group A match.

A brace by Francisco Mwepu saw Zambia collect their first and only win including the only goals they have scored at the tournament.

Both goals came in the second half after an opening period that saw Ngosa Sunzu denied twice by Swaziland goalkeeper Mlamuli Lukhele.

Mwepu ensured Zambia bowed out with honour with two headers in the 49th minute and stoppage time.

In-between the impressive midfielder Godfrey Chanda, who played his first match at the tournament, saw his 59th minute long-range drive parried and the second in the 70th minute.

Zambia finish 3rd on 4 points, one behind Malawi in 2nd place, who are tied on points with Uganda but who beat them to the semi-final spot on goal difference.

Swaziland exit bottom of the table on 1 point.

Meanwhile, the final of the COSAFA U20 Cup has been shifted from Levy Mwanawasa Stadium in Ndola to Nkana Stadium on the same date.

President Edgar Lungu has directed the Ministry of Health to start the KNOW YOUR STATUS programme for children and young people.

This is so because Zambia’s population is still young, and President Lungu says HIV-AIDS presents a threat to Zambia’s future development.

He has said young people therefore should be involved in the fight against HIV-AIDS, saying effective interventions are needed, adding that his government remains steadfast in efforts in the crusade.

This is through various interventions, such as reducing infections, increasing the number of those on Anti-Retro Viral -ARV- drugs, as well as enhancing testing and treatment.

President Lungu was speaking in Lusaka, during Zambia’s commemorations of the World AIDS Day, which falls every December 1.

The commemorations were pushed to today, December 11, and the theme is ELIMINATING HIV BY 2030 STARTS WITH ME.

And in a quest not to leave anyone behind, just as it is in the 7th National Development Plan, government has constituted a multi-diverse HIV-AIDS Coalition, which will oversee the national agenda on HIV-AIDS.

President Lungu says the coalition will comprise traditional leaders, government departments and other interest groups, without leaving anyone behind.

Meanwhile, President Lungu has also launched the 2018 Lusaka Province Anti-Retro Viral Therapy -ART- Campaign, which is sponsored by the US government-supported PEPFAR.

And speaking at the same event, Minister of Health, Chitalu Chilufya said President LUNGU has shown political will in the fight against HIV-AIDS.

During the same event, President LUNGU honoured former President, Kenneth Kaunda, with a life-time achievement award for his work in the crusade against HIV-AIDS.

In honouring Dr Kaunda, President Lungu said the former President’s work begins with his announcement in 1986 that his son had died of AIDS.

Two men rescue 14 year old girl from crocodile

A 14 year old girl of Mulumbo Village in Senior Chief Kambombo chiefdom in Chama District of Muchinga Province has survived a crocodile attack.

Judith Lungu told the Zambia News and Information Services in an interview in Chama at the weekend that she was caught by a crocodile Friday around 17:00 hours when she went to fetch water.

Judith said she was in a group of four other girls when the crocodile pounced on her just as they were leaving the waters of Lubumbu River after drawing water.

She said the crocodile caught her by the leg and started dragging her into the deep waters and was quickly rescued by two men, Jackson Ngulube and Julius Ng’uni of the same Village who were watering their gardens at the time of the attack.

Judith explained that the two men jumped into the River pursued the crocodile with spears until it abandoned her.

Judith was immediately rushed to Katangalika rural health centre before being referred to Chama District Hospital where she is currently admitted and her condition has been described as stable.

The girl sustained deep wounds on her thigh and on her back.

The ruling PF has embraced the use of social media in its mobilization activities and over the weekend organized a workshop for all administrators of all PF What’s App blogs on the Copperbelt.

This is the second workshop that the ruling party is holding for PF What’s App group administrators.

The workshop was held at the Sherbourne Gust House on Sunday in Kitwe under the theme ‘using What’s App and Electronic Media as a tool for Mobilization.”

The workshop attracted several admins of PF What’s App groups on the Copperbelt drawn from all districts.

It was opened by Kitwe Mayor Christopher Kangombe and with remarks from PF Media Director Sunday Chanda and State House Press Aide Amos Chanda.

One of the participants who asked to remain anonymous said the workshop was an eye opener.

“As a responsible party is holding a second workshop for the administrators on all PF blogs on the Copperbelt to promote the responsible use of social media and electronic media as the tools for mobilization,” he said.
