Former President Rupiah Banda
Former Republican President Rupiah Banda has been nominated to lead an elections observer mission to the 2019 Presidential and National Assembly Elections in the Federal Republic of Nigeria.
The Electoral Institute for Sustainable Democracy in Africa (EISA) nominated Mr. Banda to be its lead observer for the forth coming general elections.
Mr. Banda will lead a team of 24 observers drawn from civil society organizations and election management bodies from across africa.
EISA Executive Director Denis Kadima says his organization is honored to invite the former president to be its lead observer to the elections, which he has described as critical.
EISA is a Pan-African Non-Governmental Organization (NGO) specialized in democracy, elections and governance and promotion of credible elections on the African continent and it’s observation mission in Nigeria will be a short term mission which is expected to last for nine days starting on 12th to 20th February.
This is contained in a statement to media by First Secretary for Press and Public relations at the Zambian High Commission in South Africa Naomi Nyawali.
Deserted Street in Sesheke after the political Violence
The Electoral Commission of Zambia has said it is monitoring the developments on the ground in Sesheke District, following the reported incidents of electoral violence.
In a statement released to the media by Ms. Margaret Chimanse, Public Relations Manager, the commission urged all political parties to comply with campaign timetables to avoid possible clashes.
The Commission further urged Zambia Police to remain professional and ensure that agreed campaign schedules are adhered to, and are conducted in a peaceful atmosphere.
The Commission further reminded political parties and their candidates that it will not hesitate to disqualify any offenders who may contravene the Electoral Process Act No. 35 of 2016, if the situation degenerates any further.
The Commission also appealed to the media, particularly social media, on the need to report accurately in order to avoid alarming the general public.
Meanwhile, Zambia Police Service has said that it will institute an inquiry into the perpetuated violence in Sesheke district.
Inspector General of Police Kakoma Kanganja also said that no live ammunition was fired by the officers to disperse the unruly crowd in Sesheke.
Mr. Kanganja has since warned that the police will not tolerate people perpetrating violence and that they will be sternly dealt with.
And Mr. Kanganja has disclosed that the Police has since reinforced officers on the ground to deal with any further disturbances in the area.
He has also called on all officers to ensure they use proportionate force to bring violence to a stop.
Mr. Kanganja has further appealed to the electorate of Sesheke and all political parties participating in the parliamentary by-election to exercise restraint and tolerance as required in a civilized democratic society during and after the elections.
Yesterday, President Edgar Lungu urged political cadres in Sesheke to desist from engaging in acts of violence.
President Lungu said that there was no need for political cadres to engage in acts of violence when their leaders were not fighting, adding that it was high time cadres took stock of their actions and realized that violence does not yield anything.
The President said this in Sesheke district at a political rally where he was drumming support for the PF parliamentary candidate Dean Masule.
And four houses belonging to PF supporters are said to have been burnt in Maondo area in Sesheke district.
PF Sesheke Campaign Manager, Kebby Mbewe and PF Southern Province Chairperson, Lawrence Evans, called on the Police to bring the culprits to book.
The duo said the party is tired of seeing its members beaten without any serious action being taken by the Police.
President Edgar Lungu has said that his desire to develop all parts of the country is being hampered by some Members of Parliament that choose not to work with his government for fear of being reprimanded by their political party leadership.
Speaking when he paid a courtesy call on Senior Chief Inyambo Yeta in Mwandi yesterday, President Lungu said it is Government’s desire to develop and improve the lives of Zambians across the country.
He said the government is ready to continue partnering with the Mwandi Chiefdom to foster development in the area.
The Head of State said this is because traditional leadership like the Royal Establishment in Mwandi is pivotal in fostering development.
And Senior Chief Inyambo Yeta has thanked the government for several developmental projects being undertaken in his chiefdom, which include Mwandi, Mulobezi and Sesheke districts.
The Senior Chief cited the opening of a district hospital in Mulobezi and the setting up of a nursing school in Sesheke as some the projects that will greatly benefit his subjects.
Senior Chief Inyambo Yeta has however appealed to President Lungu to intervene and ensure the Sesheke – Livingstone road is worked on.
He said the road, which links Zambia to Namibia and the rest of the Southern region, has been in a deplorable state for a long time.
President Lungu, who was accompanied to Mwandi Palace by some cabinet ministers, PF Secretary General Davies Mwila and senior government officials, is expected to open the newly built district hospital in Mulobezi before addressing a public rally in Sesheke district.
For justice to prevail, any case must be viewed through the pure unadulterated eyes of justice, rather than through the clouded lenses of any kind of prejudice.
The recent arrest of Honourable Ronald Kaoma Chitotela and his being charged with two counts of concealing properties believed to be proceeds of crime has understandably generated varied opinions and sentiments ranging from the studiously rational; to the emotionally charged and even the uttermost (and gutter most) outrageous.
At the end of the day, justice must prevail without fear or favour. By the same token, justice must prevail without prejudice or emotional manipulation.
Justice is not based on emotions or preconceived sentiment; it is based on facts presented before a court of law.
One of the most sacred principles in the Zambian criminal justice system is holding that a defendant is innocent until proven guilty. In other words, the prosecution must prove, beyond a reasonable doubt, each essential element of the crime(s) charged.
Our justice system also ensures that, a person is considered innocent until proven guilty. The Zambian Constitution guarantees to every person “equal protection under the law.”
Consequently, under “the presumption of innocence”, an accused person is considered innocent unless proven guilty and this is expressed by the Latin maxim: _“ei incumbit probatio qui dicit, non qui negat”_ (The burden of proof is on the one who declares, not on one who denies). It is a legal principle. Justice cannot be for one side alone, but must be for both.
However, people that have myopic minds and tunnel vision and who have vested interests and anti-government agendas like United Party for National Development (UPND) leader Mr Hakainde Hichilema will not see beyond their interests.
There is a lot to be taken into account in the administration of justice. Tragically, Mr Hichilema knows very little about governance, let alone the administration of justice as his chequered intra-party record shows.
It is outrageous though not surprising that people like Mr Hakainde who are prejudiced and carry predetermined positions on anyone linked to the ruling party have it all conveniently twisted. On one hand they want President Edgar Chagwa Lungu to follow the Anti-Corruption Act; yet on the on the other hand they are asking for the law to be applied only in one direction.
How can they be prodding the President of the Republic of Zambia to ignore what the constitution says about an accused being innocent until proven guilty? How bizarre!
They want the Head of State to use the law for Honourable Chitotela to be arrested yet they do not want the President to follow the same law under Part 3 under the Constitution, Article 18 which talks about an accused being innocent until proven guilty!
They should not conveniently forget the practical and live example President Lungu gave of one of his former ministers Hon Chishimba Kambwili whom he fired based on charges and how to date, the said former minister has not been convicted!
President Edgar Chagwa Lungu has demonstrated that he is magnanimous enough to allow his ministers to be arrested and charged, and he has remained true to his public undertaking of not interfering in the due process of the law.
We ask Mr Hichilema and his ilk: what’s wrong with allowing justice to prevail?
We believe in the rules of natural justice. If Honourable Ronald Chitotela’s continued occupation of office was to jeopardise investigations, certainly he would have been asked to go home. The same would apply in the event that his continued occupation of the office of Minister would have any bearing on a fair trial.
Why should Mr Hichilema want the Head of State to go against the Zambian constitution as well as the United Nation’s Universal Declaration of Human Rights, Article 11 which provides presumption of innocence and provides that the legal burden of proof is thus on the prosecution?
The fight against corruption is real, but Mr. Hichilema would like to trivialise it; Fighting corruption does not entail playing to the gallery nor does it entail abandoning the rule of law; Justice cannot be for one side alone, but it must be for both.
After all is said and done: the picture is infinitely bigger than Mr Hichilema’s remarkably finite understanding of justice.

A swarm of bees has attacked a PF camp gathering in Sesheke and several people have been admitted to hospital.
This comes barely a few days after lightning struck a PF camp killing one person and leaving several with severe burns.
And PF Campaign Manager for the Sesheke Parliamentary by Election Kebby Mbewe says what is happening in the district should save as a wakeup call to the church to pray for the country.
Mr. Mbewe says the death of a PF cadre as a result of Lightening is beyond political rivalry.
He says it is surprising that another camp for the PF was attacked by bees.
Mr. Mbewe says political campaigns should not degenerate to a point where suspicious activities become central to a by election.
He says several PF members are currently admitted in hospital after being attacked by the bees and lightning.
Mr. Mbewe says it is for this reason that the PF is calling on the Church to Pray for Sesheke and the country because the forces of darkness seem to be attacking innocent people.

Opposition leader Hakainde Hichilema says police fired live ammunition at him and his supporters in Sesheke today.
The incident happened during a political rally in the southwest of the country.
Mr Hichilema’s Spokesman Brian Mwiinga also confirmed the incident in an interview.
“Our lives are in danger as Police and PF cadres are discharging live ammunition at us and our people. We appeal to the Nation to remain calm but steadfast for any eventualities to come,” Mr Hichilema posted on his Facebook page.
And Mr Mwiinga said Mr Hichilema wasn’t hurt in the incident.
“It was shocking, the police just came from nowhere and began discharging live ammunition,” Mr. Mwiinga said.
“Hichilema’s life is in danger,” he said.
Western Province Police Commissioner Charles Lungu was unaware of the incident.
Meanwhile, UPND National Chairperson Mutale Nalumango has complained that the ugly PF violence under President Edgar Lungu’s leadership has once again been experienced in the usually peaceful Sesheke Constituency, in Western Province.
Commenting on the teargasing which happened today in Sesheke, Mrs. Nalumango says from the happenings on the ground, there is no doubt this was yet another assassination attempt at the UPND President Hakainde Hichilema who the PF have been hunting for sometime now.
Mrs. Nalumango says reports so far indicate that the PF thugs, some wearing police uniforms are still hunting for the UPND President, whose whereabouts and safety are unknown.
She said even more importantly, UPND is receiving disturbing news of several of its people being seriously injured after being brutalised and shot by hired PF thugs from various parts of the country.
She has since urged UPND members to remain calm as as the party leadership establish the exact situation regarding Mr. Hichilema, party officials and several other people who are still being hunted by heavily armed hired PF thugs in Sesheke District.

UPND Leader Hakainde Hichilema says President Edgar Lungu’s arguments that Infrastructure Development Minister Ronald Chitotela cannot be fired on grounds that he is innocent until proven guilty has set a very bad precedent for the country.
Mr. Hichilema says the offences slapped on Mr. Chitotela so far are a mere joke as they do not match what we believe is a grand corruption matrix which implicates a number of very high level PF politicians and government officials.
He said going by President Lungu’s arguments, it is now highly irregular for any organization in the country to dismiss or indeed put on suspension or on forced leave any of their erring employees who are facing disciplinary action until their matter has been determined.
“This means all the more than 80 officers, including the Permanent Secretary, who are currently on suspension from the Ministry of Education on mere suspicion of financial embezzlement must immediately go back to work until their matter has been concluded”, he said.
Mr. Hichilema said former Minister of Community Development Emerine Kabanshi and her officers plus the Post Master General McPherson Chanda and his officers who were dismissed on mere allegations of misusing the Social Cash Transfer Funds must immediately resume work until their matter has been determined.
He said the UPND is also aware that there are a number of account stuff and officials at the same Ministry of Infrastructure who are currently on suspension on mere suspicion of financial embezzlement, and these must equally be allowed to go back for work.
Mr. Hichilema said there are several other public service and private sector employees that are on suspension or on forced leave facing disciplinary hearings or are in court facing various charges, who must equally go back to work until their matters have been determined.
“In fact, some of the affected officers in both government and private sector are on suspension, forced leave, facing disciplinary hearings when they have not even been arrested by law enforcement agencies. Bank tellers, teal operators in shops and other companies on suspension or on forced leave on suspicion of financial embezzlement must equally go back to work”, he added.
Mr. Hichilema said as a suspect going through court hearings, Mr. Chitotela will still be flying the pride of the Zambian flag, representing the country at both local and international stage, proudly meeting various dignitaries, and later drive the ministerial vehicles to court.
“In fact, going by President Lungu’s arguments, had Mr. Chitotela been charged with a none boilable offence, he would have been coming from Chimbokaila prison on daily basis going for work. And yet, in normal circumstances, the mere act of being arrested by law enforcement agencies should have triggered a resignation voluntarily by Chitotela on moral grounds, Mr. Hichilema said.
He said going by the media reports on the alleged plunder and corruption going on at Mr. Chitotela’s Ministry, it fully confirms that he is indeed a special Minister who is blackmailing the top core of the entire PF leadership.
He said like the UPND has repeatedly said, when these people are plundering, they are equally hell bent in trying to divide as a country so that we don’t unite together to liberate ourselves, yet they are not sharing their loot with anyone.
Mr. Hichilema said it is time we united together as citizens as we are all suffering at the hands of these economic saboteurs.
Former Anti-Corruption Commission Director Agness Kayobo Ngandu has been unanimously elected to sit on the African Union Advisory Board on Corruption.
Mrs. Ngandu has been voted by the African Union Executive Council with the highest of votes; 46 member states out of 53
The African Union Advisory Board on Corruption (AUABC) promotes and encourages adoption and application of anti-corruption measures on the continent.
It also collects and documents information on the nature and scope of corruption and related offenses in Africa.
The AUABC develops methodologies for analyzing the nature and extent of corruption in Africa, and disseminates information and sensitizes the public on the negative effects of corruption and related offenses;
It also advises governments on how to deal with the scourge of corruption and related offenses in their domestic jurisdictions.
This is according to a statement issued to the media by First Secretary for Press and Tourism at the Zambian Embassy in Ethiopia Inutu Mwanza.
President Edgar Lungu has arrived in Western Province to drum up support for the Patriotic Front Sesheke Parliamentary candidate Dean Masule in the forthcoming by-elections.
The Head of State arrived at around 9:00 hrs in Mwandi District, Western Province and proceeded to pay courtesy to Senior Chief Inyambo Yeta of the Lozi speaking people of Sesheke in Western province.
President Lungu will after meeting the Senior Chief proceed to Mulobezi District were he is expected to commission the Mulobezi District Hospital.
The Head of State will then fly to Sesheke were He will hold public rallies.

The cost of living for a family of five in Lusaka has declined by K29, from K5, 424 in December 2018 to K5, 395 in January 2019, the Jesuit Centre for Theological Reflection (JCTR) has revealed.
According to the JCTR latest Basic Needs Basket, the K29 decline will have little impact on the lives of people because the cost of Basic Needs Basket for January remained high.
The JCTR disclosed in their report that the country has continued to experience high unemployment and poverty levels of 41.2 percent and 54 percent respectively, coupled with inequality, corruption and other socio-economic challenges.
According to the report, Basic Needs Basket also shows that the most significant changes were noted in the sale of tea bags which decreased by K12, from K85 to K73 while charcoal reduced by K5 from K138 to K133 per K50 kg bag.
The report indicates that the prices for commodities such as vegetables dropped due to seasonal factors, adding that the price for fish and Kapenta increased by K28 from K103 to K131 per kilogram and Kapenta increased by K14 from K198 to K202.
The basic needs baskets also shows that housing in Lusaka’s high density areas remained high at K3,000 per month for a 3 bedroomed house, ZESCO bills amounted to K292 for 402 kilowatts per hour, and water bills were calculated at K192 per month.
The BNBV illustrates that living in Lusaka remains expensive and challenging for average Zambians noting that living in Lusaka limits opportunities for development and slows the growth of human dignity.
The report observes that if the status quo is maintained, the country will continue to languish in high poverty levels which might be difficult to recover from adding that the impact would be felt by Zambians surviving on the social and economic margins.
The JCTR has urged that job creation should be initiated by both the public and private sectors to address the high unemployment and promote wage for people to help meet the high cost of living across the country.
This is in recognition that government must act on the common good and demonstrate a preferential option of the poor.
The JCTR has further urged government to fully embrace and expand the e-voucher programme in order to promote agriculture diversification from maize growing to livestock and fish farming.
The JCTR has also stressed that urban farming should also be encourage so that households are able to exercise increased self-sufficiency and supplement some basic needs.

Transparency international Zambia is disappointed with President Edgar Lungu’s inability to act decisively against corrupt elements in his government.
The organization is particularly disappointed that he has refuse to relieve Housing and Infrastructure Development Minister Ronald Chitotela of his duties even after the Anti-Corruption Commission found enough evidence after their investigations for them to effect an arrest on the sitting cabinet minister.
Transparency International Zambia President Reuben Lifuka recently requested President Lungu to relieve Mr. Chitotela of his duties so that the due process of the law can take its course without any interference from his office.
TIZ Executive Director Wesley Chibamba says his Organisation now wonders how this is going to appear when Mr. Chitotela is going to answer corruption charges driving a government ministerial vehicle flying a Zambian flag.
“We think our Ministers and leaders in general need to have a moral cautious. The allegations against Mr. Chitotela are quiet humongous and some of them are pointing to the fact that there could be state house involvement and President Lungu’s refusal to fire him really fires up that kind of speculation because unless he is hiding something, we would have expected him to demonstrate his resolve to fight corruption by beginning to let go of those elements in his rank and file that are deemed to be corrupt”, he said.
Mr. Chibamba said the ACC does not just effect an arrest, they go through a thorough investigative process and when they find evidence to the effect that this person is corrupt and they can produce this evidence in court, that is when they effect an arrest.
He said ACC does not just arrest people from without but with evidence on hand.
“What President Lungu has demonstrated today is that he does not mind having corrupt elements in his government, he does not abhor corruption which we think is a direct contradiction to his pronouncement on the 9th of December 2018 when he came to officiate at the International Day Against Corruption”, Mr. Chibamba added.
Mr. Chibamba has since requested President Lungu to do the honourable thing and relieve Mr. Chitotela of his duties, unless there is something that they are hiding that they do not want the Zambia people to know.
Foreign Affairs Minister Joseph Malanji says Zambia has maintained an open door asylum policy that allows refuges to live among citizens.
Mr. Malanji said in 2017 more than twenty thousand refugees entered the country from countries in the region, followed by more than ten thousand others in 2018.
He said this when he made an intervention on the theme ” Refugees, Returnees and Internally Displaced Persons: Towards Durable Solutions to forced Displacement in Africa”, during a closed door session of the 34th Extraordinary Executive Council.
Mr. Malanji said Zambia’s commitment and policy to sheltering refugees and internally-displaced-persons has remained intact for over 50 years.
He said the country has continued to receive asylum seekers from neighbouring countries and from far beyond.
According to a statement issued by First Secretary for Press and Tourism at the Zambian Embassy in Ethiopia, Zambia currently hosts over 76,000 refugees.

VICE President Inonge Wina has outlined President Edgar Lungu’s vision of empowering rural communities with a view of reducing poverty and hunger.
“The President’s vision is to further improve nutritional levels which is in conformity with India’s Prime Minister Narendra Modi’s vision of ending poverty by empowering rural communities,” Mrs. Wina said.
The Vice President said Zambia recognised agriculture as the main stay of the economy.
“I wish to emphasise that agriculture productivity is largely dependant on the various components of modern technology such as irrigation, modern multiplication of improved seed varieties that are drought resistant and can withstand harsh weather conditionalities,” she said.
Mrs. Wina added that Zambia stood ready to benchmark from India in the area of technology especially solar water pumping solutions.
The Vice President said this in Mumbai, India, when she held talks with India’s leading solar powered water pump manufacturer, Shakti, which manufactured digitalized water pumps in the outskirts of Indore, a City in the Indian State of Madhya Pradesh.
“There is need for solar pumping technology in Zambia to increase dry season irrigation to achieve food sufficiency,” she said.
Mrs. Wina had since invited the company to travel to Zambia to explore investment opportunities.
And Shakti Pumps Vice President for International Business Lakhpatsingh Dabi said the solar powered water pumps which could be switched on and off from any part of the world on phone also made it impossible to use once stolen.

And Zambia’s High Commissioner to India Judith Kapijimpanga said the company could work with water utilities in Zambia in providing solar water pumping solutions in view of the energy deficit that equally affected water supply.
