Court clears William Banda, state fails prove the allegations against him

FORMER MMD Lusaka Province Chairman William Banda yesterday walked to freedom after the Lusaka Magistrate’s Court acquitted him of two counts of being in possession of property suspected to be proceeds of crime, contrary to section 71 (1) of the Forfeiture of Proceeds of Crime Act.

Mr Banda, who is now a Special Advisor to UPND Leader Hakainde Hichilema, was arrested in connection with the possession of five (5) vehicles, a Toyota Prado registration number ABZ 1661, Toyota Prado registration number ABR 9874, Toyota Harrier registration number ALB 3619, Toyota Surf registration number ABG 9009 and Toyota Cresta registration ABX 1408 “reasonably suspected to be proceeds of crime.”

He has been set free after the court found that the prosecution failed to prove its case beyond all reasonable doubt.

In acquitting him, Magistrate Lameck Mwale, stated that it was difficult to prove that the vehicles and the money were “reasonably suspected to be proceeds of crime because the State failed in their investigations to prove the allegations.

Mr Mwale said it was not in dispute that four of the five vehicles were registered in Mr Banda’s name except for one which was registered in his wife’s name.

He said he was also alive to the fact that Mr Banda was found in possession of the vehicles and money amounting to K 1.8 million which were acquired through a number of property and business he had in Lusaka, Chongwe and Chipata which was in accordance to Mr Banda’s evidence.

In his evidence, Mr Banda told the court that he used his money to acquire the said property because he was running some businesses.

It was also his evidence that he had sold a property which was situated along Manchinchi Road which was sold at K 1 million.

In another count, Mr Banda was accused of being in possession of cash amounting to K1.8 million “reasonably suspected to be proceeds of crime.”

The prosecution called eight witnesses.

THE Government has described 2016 as a successful year in its quest to take development to the citizenry, and is optimistic that the country’s economy will continue flourishing next year.

Chief Government spokesperson Kampamba Mulenga said despite global economic challenges that had not spared Zambia, the Government had performed fairly well in its quest to improve the livelihood of all citizens.

Ms Mulenga, who is Information and Broadcasting Services Minister, said in an interview yesterday that in view of many economic gains that the country had recorded, the Government was confident of doubling its success next year.

“I am happy to state that the Government has this year performed fairly well in its implementation of various programmes of development and we are very confident that more economic gains will be achieved in the coming New Year,” she said.

The minister said the massive infrastructure development the country had so far achieved was remarkable and had assured of remaining committed in uplifting the welfare of all citizens.

The Government’s continued investment in infrastructure projects such as health and education, she said, had been key in helping to uplift the living standards of all Zambians.

She said her ministry would remain committed to ensuring that the implementation of phases two and three of the digital migration project became a success.

The digital migration project is being implemented as part of the global decision to execute the International Telecommunication Union (ITU) resolution which was passed in 2006.

This involves change of television broadcasting system, from analogue to digital terrestrial broadcasting, and the Government has decided to implement the project in three phases.

Ms Mulenga assured of the Government’s commitment in improving the welfare of the public media institutions, namely, the Times of Zambia, Zambia Daily Mail and the Zambia National Broadcasting Corporation.

The minister called for peace and unity, citing the need for all citizens to remain committed in helping realise the Government’s national development agenda.

Constitutional Court dismisses Mwanakatwe’s stay of execution on her election nullification

THE Constitutional Court has dismissed the application for stay of execution of judgment pending an appeal hearing in a petition filed by Lusaka Central Member of Parliament (MP) Margaret Mwanakatwe.

The application was lodged following the High Court’s decision to nullify her seat due to electoral malpractices.

Constitutional Court Judge Enock Mulembe in his ruling said he did not see any need to entertain the application for a stay because a seat was not vacant until the court made a final determination.

He said he found the application for a stay irrelevant since the law, as per constitutional provisions, had stated that the seat only becomes vacant after the final determination of the Constitutional Court.

“My considered view is that I see no need to entertain this application for stay any further when, by operation of law and in terms of the Constitution, it is clear when the seat becomes vacant,” Justice Mulembe said.

Mr Justice Mulembe further urged the parties to focus on preparing for the hearing of the appeal so that the court could have the opportunity to bring the matter to a final determination.

“Considering this application has raised important constitutional issues of a public interest nature, I order that each party bears their own cost.
“For the foregoing reasons, the application for stay of execution of judgment pending appeal is accordingly dismissed,” he said.

Justice Mulembe noted that Article 72(2) of the Constitution addressed instances when the office of an MP became vacant or ceased to be one, hence his decision to dismiss Ms Mwanakatwe’s application as her appeal was not yet determined.

Government still owes K2.4 billion in unpaid VAT refunds to mining firm

Zambia Revenue Authority has disclosed that it is still withholding K2.4 billion of the K5 billion owed to mining companies in Value Added Tax refunds because the correct documentation has not been provided.

ZRA Commissioner General Kingsley Chanda said Government began paying up to K800 million a month in VAT refunds to mining companies in June.
He said this during a news conference held in Lusaka.

Mr Chanda said Government is aiming to put an end to a long running dispute in which firms were owed about $700 million.

He however said that some funds are being withheld because companies have not provided documents showing the export destination.

The ZRA Commissioner General also disclosed that the tax authority lost K1 billion in expected tax collection because of low copper prices and the depreciation of the kwacha this year which hit mining companies.

He said ZRA has made progress in collecting revenue despite not receiving 1-billion Kwacha in income tax from the mines owing to economic challenges following a slump in copper prices.

Mr. Chanda said he is optimistic that in 2017, ZRA will meet its tax obligations following some changes to the tax system in the national budget.
Meanwhile, ZRA says it is pursuing over 72,000 vehicles that do not appear in its asycuda system.

ZRA Commissioner General Kingsley Chanda said preliminary database reconciliation and identification of wanted vehicles by the authority and Road Transport and Safety Agency as at 9th December 2016 indicate that 72- thousand 8-hundred and 42 vehicles have no matching records.

He said the over 72,000 vehicles, which is 19.1 percent of the registered vehicles include high value automobiles which have not taken advantage of the amnesty to normalise the situation.

Mr. Chanda adds that the motor vehicle amnesty to normalise the situation is still underway and will end on December 31st.

He has appealed to motorists with vehicles that were not cleared with ZRA to do so as they will not be fined or pay interest but just normal tax.

Mr. Chanda also revealed that the Commission has received only 146 applications from 8 stations for the amnesty from which it has collected K1.4 million.

He has however stated that ZRA is expected to collect K3.6 million from the exercise as pending assessments are in excess of K2.2 million.

The ZRA Commissioner General has since warned those who will not adhere to the amnesty that their vehicles will be impounded and forfeited to the state.

Mr. Chanda said ZRA will come up with the final “most wanted list” after December 31st 2016.

Horse Shoe Restaurant Drama continues, now workers defend the Minister of Labour

The drama at the now infamous Horse Shoe Restaurant has continued to unfold as the saga has taken a new twist as some workers from the restaurant have told MUVI TV that there are no human rights violations at the restaurant.

MUVI TV reports that the workers who stormed the station came to the defence of the embattled Minister of Labour Joyce Nonde Simukoko who has been at a receiving end of criticism and condemnation from members of the public, including members of the her Party PF, for instructing the police to arrest the whistle blower who brought the violations to the attention of the public.

Last week the HRC publicised a report carried at the restaurant where it indicated that there was wide spread human rights violations by the owners of the restaurant which the workers seem to be refuting in the video footage.

This surely a slap in the face for those that have come to the defence of the workers especially the Human Rights Commission(HRC).

Accordingly, the affected workers stormed MUVI TV studios in Lusaka to speak out on the matter.

The workers have termed the Human Rights Commission findings of abuse of their rights by the Restaurant management as untrue.

Vice President Inonge Wina says government has completed the construction of 60 out of 64 health posts allocated to Western Province.

Mrs. Wina says the expansion of health infrastructure across the country is testimony that government wants to build the economy with a healthy citizenry.

The Vice President says President Edgar Lungu wants Zambians to access quality and affordable health services.

Mrs. Wina says the recruitment of over 7 thousand health personnel will help in delivery of quality health services especially in rural areas.

Ten inmates escape from Sinazongwe police cell

ABOUT ten inmates have escaped from Sinazongwe police station cell after breaking
the wall.

The Police have since launched a man hunt to arrest the inmates and
called on members of the public to report if they see any of the
prisoners to the nearest Police Station.

Southern Province Police Commissioner Bonnie Kapeso said the inmates
broke the wall in the cells at the Sinazongwe Police station and thereafter
removed the bugler bars.

He said the incident happened during the Christmas holiday.
“Yes I can confirm about 10 inmates have escaped from Sinazongwe and
my appeal is to the members of the public if they notice any of them
they should report to the nearest police station,” he said.

Minister of Commerce Margaret Mwanakatwe has commissioned works for the construction of a motor vehicle Assembly plant at the Lusaka South Multi-Facility Economic Zone – MFEZ.

Mrs Mwanakatwe says the state-of-the-art plant by GO NOW Zambia is a milestone in Government’s efforts to industrialise the Country.

She says it is gratifying that GO NOW Zambia has partnered with China’s third biggest motor vehicle Assembling company in setting up the plant which will gobble 1-hundred and 75 million US Dollars.

Mrs Mwanakatwe says the plant is milestone in technology and skills transfer to Zambians.

The Minister says Government is working hard to diversify the economy and reduce the cost of doing business.

She says 1-hundred and 44 companies are willing to invest in the MFEZ as Zambia remains a conducive environment for investment.

The Minister of Commerce has urged other companies to emulate Go Now Zambia by investing in the country’s sectors such as water Development and Energy.

And GO NOW Zambia Chief Executive Officer Siisii Mukelebai says the company has so far acquired 4 million US Dollars for equipment for the the plant.

The GO NOW Zambia Chief Executive Officer says ZEMA has already approved the project after acquiring land on lease.

Mr. Mukelebai says the project is important as it will afford citizens an opportunity to own economically priced vehicles.

President Lungu acts to curb army worms

President Edgar Lungu has directed the Disaster Management and Mitigation Unit (DMMU)under the Office of the Vice-President to join the Ministry of Agriculture in an emergency operation to curb the spread of army worms that have invaded some districts on the Copperbelt, Luapula and Central Provinces.

The operation involves among other Government agencies, the Ministry of Agriculture, DMMU and the Zambia Air force (ZAF).

The Zambia Air Force has since began to airlift chemicals to Ndola on the Copperbelt, Chinsali in Muchinga Province, Kasama in Northern Province and Chipata in Eastern Province.

The District Agriculture Coordinators (DACOs) for Lusaka, Luapula and North Western Provinces have already collected the chemicals.

President Lungu has directed that the chemicals that were purchased under emergency operations should be distributed to all parts of the country although the outbreak of army worms has been reported on the Copperbelt, Luapula and Central Provinces.

The DMMU and Ministry of Agriculture will be doing random checks across the country tomorrow (Thursday) to ensure that the emergency operation of spraying was going on as directed.

President Lungu is concerned that if the outbreak of the worms is not controlled speedily, the crop yield for 2016/2017 may negatively be affected.

He has assured farmers that all provinces will receive the chemicals by tomorrow morning.

“All DACOs are expected to closely monitor the operations against army worms and provide regular reports on the situation,” State House Spokesman Amos Chanda said in a statement.

Nkana extend Walter Bwalya’s deal

Nkana have revealed that striker Walter Bwalya has signed a two year contract extension that will keep him at the Wusakile club until July 2019.

Bwalya was the 2016 FAZ Super League top scorer with 24 goals.

Nkana president Everistol Kabila confirmed in statement that Bwalya penned a two year contract extension on Tuesday.

“Walter signed his contract extension today Tuesday, December 27, 2016 and this new contract will see him stay with club till July 2019,” Kabila said.

“I am very happy for the boy and the Zambian football because this is going to make the league competitive and more exciting as Zambian clubs are now able to return quality players amid lots of interests from foreign clubs,” he stated.

Bwalya has scored 35 goals since he joined Nkana from Forest Rangers in July 2015.

“Nkana Football Club is a big cub and for it to achieve its objectives, it needs to attract quality players of Walter Bwalya’s calibre.”

The player is reported to have received offers from some local and foreign clubs.

Kabila further stated that the squad will be reinforced in some areas such as goal-keeping, defence and midfield before the 2017 season commences.

THE decision by member of the central Committee (MCC) chairperson for elections Jean Kapata to fire her deputy election Kelvin Fube Bwalya (KBF) is justified and there is no need for her to apologise for branding him a rebel, secretary general Davis Mwila has guided.

On Monday, KBF dismissed assertions and remarks attributed to Ms Kapata calling him rebel and demanded for an apology.

But in an interview with the Daily Nation, Mr Mwila said it depended on how KBF understood the word ‘rebel’, adding that for him (Mwila), a rebel was someone who was not following the rules and working against the party.

Mr Mwila said Ms Kapata who is a member of the central committee had the power and authority to appoint any member from the subcommittee.

“In this case, KBF (Mr Fube) was in the subcommittee so the same chairperson has the powers to remove anyone from the committee even to disband it. So, in terms of removing KBF, it was within the powers of the chairperson. She was within her powers,” Mr Mwila said.

And Mr Mwila said Ms Kapata does not owe KBF any apology for removing him from the commission.

The PF chief executive has warned party officials fighting for positions and causing confusion on the Copperbelt to immediately stopped and let those elected to work.

He said at party structure level the term of office was still running as all party officials were elected in June 2015, adding that their term of office was three years.

Meanwhile, the Mandevu Constituency executive has charged that Ms Kapata did not owe Mr Fube any apology and KBF’s demands that she should show remorse for branding him a rebel are nothing but wishful thinking.

Mandevu Constituency secretary Lemmy Bwalya has charged that the party structures were intact under the leadership of President Edgar Lungu and that all other party leaders still had the mandate and enjoyed their immunity in line with the party constitution.

The Political Environment in Zambia is still hostile for women-Mumbi Phiri

THE political environment in Zambia is still hostile for women but we are comforted by the fact that there are exemplary women like Vice-President Inonge Wina who have opened the way for other women to come on board, Mumbi Phiri has said.

Reflecting on her political life since coming onto the political scene in 2006 when she won the Munali parliamentary seat, Ms. Phiri said her political journey has not been rosy but said resilience, determination and the courage to rub shoulders with men had made her who she was today.

She advised women interested in taking up political careers to believe in themselves and realise that there was still some degree of stigma as politics in Zambia was still regarded as a game for men and women were just supposed to be spectators.

She, however, said women had the political acumen to change the political landscape in the country only if they could prove their worth just like men who had made the grade in Zambian politics.

She challenged women in politics to be more versatile in what they were doing without necessarily abandoning their duties as mothers or wives in their families because they still had a role to play in their homes.

“My only advice to women who want to take the a political path is to be focussed on what they want to achieve and not to be distracted by people because the political environment in Zambia is a little bit hostile towards women.

“A few year ago women were regarded as housekeepers and this is why whoever joined politics was attacked and accused of a lot of things just like they have done to me.

“If I were not determined, I would have abandoned politics because a lot has been said about me. The only good part for which I praise God is that my husband is a very understanding man who has not only disregarded the mudslinging against me but was the one who single-handedly sponsored my campaign for Munali in 2006 because he believed in me,” Ms. Phiri said.

She challenged women to hold themselves in high esteem if they wanted to make an impact in their political lives.

She said people like Ms. Wina were worth emulating because she had practiced her politics with dignity.

“There is this notion among people that for a female politician to get to the top in life, they have to use their bodies but that should not be the case. People will respect us based on what we portray when we join politics. We are in the limelight and whatever behaviour we portray is under scrutiny.

“We need to be mindful of what we do, wear or what we say in publics and I am glad that we have people like Ms. Wina who have conducted themselves as politicians in a dignified manner.

‘‘What she puts on or says portrays a picture worth emulating because if you are a woman in politics and every day you put on mini-skirts, for example, people will judge you based on your dress code because there is a lot of stereotyping out there,” Ms. Phiri said.

Kalumbila husband kills wife after a domestic dispute.

A 29-YEAR-OLD woman of Kisasa compound in Kalumbila district has been killed by her husband after a domestic dispute.

North Western Province police chief Auxensio Daka said the incident occurred on Monday around 21 hours and identified the deceased as Karen Makechi while the suspect is John Palata of the same compound.

Mr Daka explained that the deceased suffered a twisted neck and swollen private parts as an unknown object was inserted in them.

He said the matter was reported to police by the deceased’s younger sister Tina Bajibanga.

“We recorded a murder case in Kisasa where a man beat his wife to death following a domestic dispute,” said Mr Daka.

He said the suspect has been detained and charged with murder while the body of the deceased has been deposited in Solwezi General Hospital mortuary awaiting post-mortem.

Meanwhile, 29-yea-old Pearson Bisanka of Mambwe village in Kakombe area in Kasempa district has committed suicide by hanging himself to a tree with a chitenge material.

Mr Daka said police visited the scene and found the deceased’s body still hanging to the tree about 200 meters from the village. “The incident was reported by the father of the deceased. However, when police officers visited the scene they found that there was no foul play suspected so the family was advised to bury the body,” he said.

Over 230 flee DRC for Zambia

A total of 233 refugees from the neighbouring Democratic Republic of ZambiaCongo (DRC) have so far entered Zambia following the political instability that has characterised that country.

However, the Zambia Red Cross Society says about 400 asylum seekers from the Democratic Republic of the Congo (DRC) have so far received humanitarian assistance in the last few days.

ZANIS reports that Ministry of Home Affairs Permanent Secretary Chileshe Mulenga said the country has continued to record an influx of refugees from the DRC into Zambia through various border posts.

Dr Mulenga said the highest number of 151 refugees entered Zambia on December 21, 2016 through Sumbu, Mpulungu and Kaputa border posts of Northern and Luapula provinces respectively.

He said the Office of the Commission for Refugees is working closely with all the law enforcement agencies to screen the refugees from the DRC before placing them in the designated refugee centres.

And Dr Mulenga expressed hope that the political instability in the DRC will be resolved peacefully and timely for the benefit of the people.

Dr Mulenga said Zambia and DRC have for a long time continued to enjoy cordial relations and therefore the current political instability in the DRC is of great concern.

He said this is not the first time that Zambia is hosting the refugees from the DRC and other neighbouring countries and called on Zambians to respect and honour human rights of refugees.

Dr Mulenga has also called on the international community, especially the United Nations High Commission for Refugees (UNHCR) and the Zambia Red Cross Society to help the refugees from the DRC to settle peacefully in the country.

However, the Zambia Red Cross Society says about 400 asylum seekers from the Democratic Republic of the Congo (DRC) have so far received humanitarian assistance in the last few days.

Zambia Red Cross Society Communications and Public Relations Manager Bruce Mulenga confirmed to ZANIS in Lusaka today that the Society has established transitory camps with Emergency Response Materials in Kipushi, Kakoma, Chiengi, Kaputa, Nsumbu, Mpulungu and Nchelenge districts.

Mr. Mulenga explained that the humanitarian assistance includes food aid and non-food aid such as blankets, mosquito nets and immediate medical support.

And from Kaputa district in Northern Province, ZANIS reports that over thirty-five Congolese nationals mainly from Moba in Katanga region of Eastern Congo have entered Zambia to seek asylum.

Kaputa District Commissioner, Mulenga Fube said the district is conducting both security and health screening on the asylum seekers before they are accepted in the country.

Mr Fube said that the district which borders Congo DR has been receiving asylum seekers almost on a daily basis adding that the number is likely to increase.

The District Commissioner further revealed that Chief Kaputa has since provided the Congolese nationals with temporal shelter during their stay in Zambia.

And in Mpulungu , district authorities have disclosed that 47 asylum seekers from Congo and Burundi have been received and are in transit to Maheba refugee camp.

Mpulungu District Commissioner Dennis Sikazwe said that all the asylum seekers will be taken to Maheba refugee camp because the district does not have capacity to accommodate them.

Leadership Wrangles in PF indicative of Governance Failure by President Edgar Lungu-Kakoma

The opposition UPND says the on-going leadership wrangles in the PF are indicative of governance failure by Republican President Edgar Lungu.

In a statement UPND Spokesperson Charles Kakoma said the wrangles in the ruling party has a trickle down effect on the governance system of the country.

Mr Kakoma also accused President of extending the dictatorial tendencies he uses against the opposition to his own party.

The on-going leadership wrangles in the Patriotic Front (PF)gives us the reason why Edgar Lungu has failed to govern the country.

It is interesting to note that PF members now believe what UPND has been saying about Lungu’s dictatorial tendencies.

It is also sad that Jean Kapata does not realize that she is being used to whip her own brothers .

The earlier Jean Kapata realizes the better.

The on-going intra-party wrangles in PF should quickly be resolved by party leader Edgar Lungu as they have a trickle down effect on the governance system of the nation.

It also seems Edgar Lungu is so insecure even with those that helped him in the disputed elections.

For us , this is not a strange thing we are seeing under Edgar Lungu’s leadership.

The same dictatorial tendencies he uses to oppress the opposition members are now being applied within the PF .

He is now using certain PF members like Jean Kapata to whip others members with dissenting views. It seems Edgar Lungu enjoys fighting .

Am sure Michael Sata would be very angry with Edgar Lungu if he came back to life today.

Now, all those Christians for Lungu should see why UPND has never trusted Lungu’s prayer days.

The PF wrangles have vindicated us .Edgar Lungu is a brutal dictator who cerebrates the sufferings of others.

Edgar Lungu does not appreciate.

UPND will take Kelvin Bwalya Fube’s revelations seriously. We also commend him for exercising his freedom of expression correctly.

UPND is open to all those being chased by PF self proclaimed leaders.

As UPND,We believe in national integration.

We also believe that our common enemy is poverty not fellow citizens.

Let Edgar Lungu fight poverty not fellow citizens.
