Vodafone Zambia hosts minister of justice

Hon. Given Lubinda and CEO Lars Stork pose with Vodafone Zambia Brand Ambassadors

Justice Minister Hon. Given Lubinda toured the Vodafone Zambia head office and operational hub in Lusaka on Thursday (December 22) to familiarise himself with the state-of-the-art telecommunications centre.

The use of information and communication technology (ICT) is considered one of the key elements to significantly improve the administration of justice. The rapid development of technology has opened up new opportunities that were unthinkable years ago. Around the world, several statutory reforms have been introduced to allow the use and the exchange of electronic data and documents within national judicial systems.

Speaking during the Minister’s visit, Vodafone Zambia CEO, Lars Stork said: “We launched in the Zambian market in June 2016 with 4G data services aimed at transforming the communication sector with an initial investment of US$ 40 million. We are confident that the developments currently taking place in Zambia’s ICT sector, with regards to innovation and regulation, will further transform and streamline the way people communicate and manage their affairs.”

Hon. Lubinda expressed his happiness and positive impressions by the ICT infrastructure and architecture Vodafone has put in place, which is supported by a youthful workforce accounting for 50 per cent of the company’s staff compliment.

“I am thoroughly impressed with the investment, the level of innovation, the technology and the pledge to drive change in the communication space. The confidence and the passion of the workers at Vodafone Zambia have, equally, amazed me. If others can emulate what is happening here, Zambia will move many steps ahead,” said the Justice Minister.

The honourable Minister visited Vodafone following an invitation from the next generation operator. In today’s increasingly digital world, ICT cuts across many spheres, from commerce to finance, governance, health, and the administration of justice.

“At Vodafone, we understand that ICTs are cross-cutting and impact on all segments of the society. Therefore, we are building relationships with stakeholders in the public and private sectors. The Ministry of Justice is among our key stakeholders. As such, we are pleased and humbled that the Honorable Minister took the time to visit us,” concluded Mr. Stork.

Apologise or things will get personal, KBF warns Jean Kapata

PF deputy elections chairperson Kelvin Bwalya Fube
PF deputy elections chairperson Kelvin Bwalya Fube

Dismissed PF Vice Chairman of Elections Kelvin Bwalya Fube has demanded that her former boss Jean Kapata apologises for branding him a rebel.

Mr Fube who is commonly known as KBF reacted angrily and dismissed assertions that he was part of a rebellion in the PF.

He said history would show that he has worked selflessly for the party without seeking a position in return.

“I have done nothing wrong, I am not a rebel, if there’s a fight in PF, I am not part of it”.

He added, “Hon. Kapata can fire me as her Deputy Chair for Elections, that’s within her powers but she cannot call me a rebel and for that I am demanding an apology.”

“I didn’t need a position to work for late Michael Sata, I didn’t need a position from Ba Micheal Chilufya Sata to work for him”.

” I signed a pact with late Michael Sata that I would run the 2011 General Election campaigns and I took the risk because I believed in the man”.

Mr Fube said he has worked selflessly and tirelessly for the PF.

“Not one Ngwe did I get from the President. I know of colleagues who can’t do anything without being paid or be given money “.

“I am not one who works for positions”.” I have never applied for any job, if the President finds it fit to give me a position, so be it”.

He was speaking on a live news conference on Monday broadcast on Radio Christian Voice and syndicated country-wide on other community radio stations.

Mr Fube said was deeply offended by Hon. Jean Kapata’s remarks who he claimed has helped immensely including offering personal help.

He disclosed that he has helped and sacrificed his personal life but a mere thank you is enough and that Kapata recently asked him to help her as she had a niece who was going to ZIALE though he would not expect anything in return.

“Hon Kapata called me to help her niece who’s preparing to go to ZIALE because Jean Kapata asked me to help her. I will not fire her, that’s not how I work”.

And Mr Fube has maintained that the mandate of the current PF Central Committee has expired.

He said he knew that President Lungu will follow the law regarding the expired mandates of members of the Central Committee and other party structures.

Mr Fube reiterated his calls for elections for all the positions in the PF excluding that of Presidency because President Edgar Lungu was just recently elected at a convention in 2014 following the death of President Michael Sata.

” The President is a lawyer just like me, in fact far much more senior to me. He is a lawyer, he won’t abrogate the party constitution, or the nation’s constitution “.

He said his call for elections was founded on provisions of the Constitution and his remarks acted as a mere reminder.

” The call for elections has not been my call, I was merely reminding them. The call has been dictated by the party constitution “.

He also condemned remarks attributed to the Secretary General, Davies Mwila who is allegedly to have said those calling for elections wanted to go into party leadership using the back-door.

” My SG Davies Mwila is on record saying those people calling for elections want to get into office using the back door method. If calling for elections is a back door method, what is the legitimate way?”

“When something is wrong, it’s wrong, be courageous to correct it. Maybe am not the only one who holds this view”.

He also called for the careful manner in which independent members of Parliament are treated as they were mostly members of the PF.

” We have 14 Independent MPs in Parliament and we are being told we can’t work with these people. It is this position I object “.

He further dismissed allegations that he has been speaking or meeting Former Information Minister Dr Chishimba Kambwili.

“When I speak, I speak for myself. Those of you who know me know that I am a very independent minded person.”

He also denied having meetings with former information minister Chishimba Kambwili with a view to destabilise the PF as alleged by Kapata.

Mr Fube said that unlike some members who asked for payments in return when they work he was not that kind of a person.

Dropping centres for abused children must conform with the needed standards-Chishanga

3

COPPERBELT Young Women Christian Association Coordinator Sharon Chisanga has implored all organizations in the region that are opening dropping centres for abused children to conform with the needed standards and guidelines of such facilities.

She observed that some dropping centres were working like orphanage homes, hence to implored those establishing them to follow the needed standards.

Ms Chisanga explained in an interview in Kalulushi yesterday that dropping centres for abused children had special standards, very different from orphanage homes.

“The first two main objectives of a dropping centre of the abused child is to counsel the victim to remove trauma from her and also to help her be opened up start talking as some they do not want to talk about what would have happened to them.

“But it has come to our attention that some dropping centres that are being established in some parts of our province are not doing that so we are saying they are lacking such merits,”she said.

She pointed out that orphanage homes were mainly only for caring for the under privileged through providing them with food, shelter and clothing among others. She said the idea of having more dropping centres in the region was welcomed, but standards were needed to be followed.

Ms Chisanga urged those who would wish to know more on guidelines and standards of a dropping centre should get in touch with her office in Kitwe so that they could be helped in one way or another.

Meanwhile Ms Chisanga has said that the cases of child abused and defilements have slowly started reducing in the region.

She attributed the move to much sensitizions by organizations like hers and stiffer sentences that courts were slapping on the convicted offenders.

“At least we have started seeing some reduction in cases of child abuse and defilements and this can attributed to the much sensitive that various organizations are conducting in their respective communities,”Ms Chisanga.

The Lisimba Commission of Inquiry is a Chinese Egg that will NOT Hatch!

Bregedier General Godfrey Miyanda
Brigadier General Godfrey Miyanda

By Brig Gen Godfrey Miyanda

INTRODUCTION: My purpose in discussing the Commission of Inquiry led by the Honourable Mr Justice Munalula Lisimba is to express my personal views on what I have perceived as frequent populist pronouncements by the Executive that may prove costly and unproductive and may even contribute to further alienation of many Zambians from their own country.

THE MIND OF THE PRESIDENT: it is important to understand the mind of the President who conjured up the idea of resolving election disputes through a Commission of Inquiry. The timing of the initial announcement is significant as it points to what motivated the President to establish the Commission.

On 15th August 2016, barely five days after the end of the 2016 elections, a horde of PF cadres descended on State House to give solidarity to and/or petition their President. President Edgar Lungu received them and, as part of his statement, criticised the “voting pattern of three provinces”.

He was to probe the “post-election violence” but made no reference to previous elections. He promised to say more the next day (16th August 2016) at a scheduled PF rally at Woodlands Stadium. That promise from the Steps of State House alarmed me as it carried what I thought was an unintended tribal innuendo. I therefore urgently wrote a statement to dissuade the President from repeating the statement which was likely to be beamed live to a wider audience.

Whether by coincidence or divine intervention, the President toned down at the Stadium and instead birthed the “Dundumwezi thank you” message! Still the “voting pattern” mantra was echoed and later he formally established the Commission. This is the mind of the President who established the Commission, himself a participant in the disputed election and the President of the PF, one of the main suspects in the violence and other electoral violations.

THE MIND OF THE CHAIRMAN: It is important to understand the mind of the Chairman of the Commission as he is the one to oversee the whole process and actualise the President’s Grand Scheme. It is easy to read the mind of the Hon Judge Munalula Lisimba because he appeared on Muvi TV’s Assignment programme live on Sunday 18th December 2016. The interview was titled “Investigating Electoral Violence – Is it Necessary?” I have summarised some pertinent snippets of the Judge’s interview, not exactly verbatim, but close to it:

‘He explained that the Terms of Reference are in two segments: the first segment is historical to establish the general outline of voting patterns prior to 2016, and find out who influenced the voting pattern. The second segment will identify specific incidents of violence before, during and after the 2016. The mandate of the Commission is to promote reconciliation in the nation but witnesses will not be summoned. We want to get the truth; we know there was violence but who caused it? Were there elements in the pattern of voting that influenced the voting? Did any group or organisation influence the people to vote in a certain way? For example some chiefs were openly involved. Why were these chiefs partisan? We shall find the reason for the voting pattern, what happened, who participated, who motivated the voters, who caused this negative trend. We are inviting all the 40 political parties to come forward to tell us why their members were involved, why their members were beaten’. Chairman Lisimba even gave an example of what they expected to hear from prospective witnesses, e.g. they should say “I was present when Mr B attacked Mr A”. The Judge then assured the public that the Police would be there in full force to protect witnesses!

This is the Mind of the Chairman, laid bare by himself. But without summoning witnesses how will the Commission get at the truth they require to cross-check evidence implicating those not attending the hearings? The leaders of some panga-wielding cadres will not come voluntarily. In fact the Leader of the PF, the one who established the Commission, is not a compellable witness so he cannot be compelled to give evidence even if the Chairman wanted to hear his side. How then will Judge Lisimba obtain his empirical evidence?

PUBLIC POLICY: I contend that the establishment of the Commission of Inquiry contradicts current public policy regarding electoral administration and resolution of electoral questions and/or disputes. President Lungu announced his Commission while petitions were in progress. To date some of these petitions are still undetermined, awaiting verdicts by the appropriate organs of state with requisite mandates. The grounds for petitioning the Courts are many and varied with remedies or sanctions provided therein. They include bribery, treating, corrupt acts, illegal practices, publishing false statements in respect of other candidates, undue influence on voters (which includes violence and intimidation), interference with public meetings and, more broadly, breach of the Electoral Process Act.

All these are on our statute books today, and are reinforced by the Amended Constitution that President Lungu assented to on 5th January 2016. Public Policy is always to be found in the Constitution and other published laws of the land.

One cannot be wrong if one observes the law and avoids manipulating it to suit one’s secret agenda. It is important to understand what our system of government provides for resolving electoral disputes, which ordinarily come once in five years. There is no vacuum.

The Electoral Process Act addresses the issue of electoral dispute better than the Lisimba Commission. This system covers, inter alia, campaigning, establishing of Conflict Resolution Committees in all Constituencies, even before arriving at the point of litigating.

No one is allowed to find out how people voted; it is unconstitutional and illegal.

In this regard the Electoral Process Act Number 35 of 2016 was promulgated and assented to by President Lungu on 6th June 2016. Under the Franchise Article 45 provides that “citizens are free to exercise their political rights and that elections shall be free from violence, intimidation and corruption”. Article 46 provides that “a citizen who has attained the age of eighteen years is free to register as a voter, and vote in an election BY SECRET BALLOT”. The Electoral Commission of Zambia is designated as the organ of State that conducts and administers elections throughout Zambia, subject to the law relating to Petitions.

The Lisimba Commission thus runs counter to Public Policy and was established prematurely and in bad faith. No one is allowed to find out how people voted; it is unconstitutional and illegal.

Further since the Commission will NOT summon anybody, what will happen if the key suspects do not volunteer to give evidence? How will the Commission obtain its empirical evidence through this Commission? And how will Judge Lisimba and his team ensure there is reconciliation by usurping the judicial functions of our courts that have continued to receive direct evidence of the various disputed elections?

CONCLUSION: I submit that the correct forum for electoral disputes or questions is already provided for in our laws (Constitution, Electoral Process Act and subsidiary regulations).

Commissions of Inquiry must be the exception rather than the rule in resolving electoral disputes. Let all outstanding petitions be concluded without let or hindrance. Imagine if the presidential ballot boxes for 2016 were opened and recounted live in full public view what truth would be found in Pandora’s Box! We may even find therein thousands of missing votes for President Edith Nawakwi, President Saviour Chishimba or even President Andiford Banda! It is a known fact that the votes of so-called small parties are fraudulently allocated to the so-called big parties in places where the small parties have no agents to challenge the poll (like the days when a frog used to stand but was unable to petition)!

The Lisimba Commission is a sheer waste of public funds and an abuse of the President’s discretionary power for establishing inquiries. He himself is conflicted but is NOT a compellable witness so he cannot be subpoenaed even if the Commission attempted to do so. He ought not to superintend over any inquiry into the disputed election in which he participated. Further he is the leader of the PF, a political party whose record of violence is in the public domain.

I say that the Lisimba Commission is a sham, an ill-advised wild goose chase that is but a conduit for further abuse of public funds. This Commission is a giant Chinese egg; it will not hatch. It must be disbanded!

Ex-APR striker Bwalya warns Zanaco about opponents

1

Former Rwanda based Zambian striker Joseph Bwalya has tipped Zanaco ahead of their CAF Champions League preliminary round clash against APR in February.

Zanaco welcomes Rwandese giants APR in the first leg tie on 11th February in Lusaka before the return leg set for Kigali seven days later.

Bwalya, who played for APR from 2006 to 2007, said the Zambian champions should not underrate his old club.

The ex-Power Dynamos and Kabwe Warriors forward described APR as a well organised and professional club.

“APR is not a team to underrate. They play good football and have foreign players from DR Congo, Uganda and Kenya,” Bwalya said.

“People should know that coming from Rwanda does not make APR a weak team,” he noted.

Bwalya believes winning the first leg with a comfortable margin would be vital as Zanaco aspire to advance in the Champions League.

“They need to score more goals in the first leg. They must aim to score at least three goals here,” he noted.

“Zanaco must work hard in order to go far in the competition. I am confident they will perform well. They have a good side,” Bwalya said.

Winners of the Zanaco versus APR tie will face either Tanzania’s Young Africans coached by George Lwandamina or Ngaya de Mbe of the Comoros.

Copperbelt Minister Bowman Lusambo has sounded a stern warning to all those undermining President Edgar Chagwa Lungu’s vision.

Mr Lusambo said he is fully aware that some people in the province are determined to frustrate the implementation of President Lungu’s vision to develop the province.

He said he will not sit idle and watch some people frustrate President Lungu’s vision in the province.

Mr Lusambo said President Lungu has a clear vision of taking development to all parts of the country hence the need to give him full backing.

He was speaking Saturday afternoon when he flagged off the street cleaning exercise in the Ndola Central Business District as part of the Keep Zambia Clean programme.

Mr Lusambo, accompanied by Provincial Permanent Secretary Reverand Howard Sikwela, Ndola Mayor Amon Chisenga and Ndola District Commissioner Cannon George Chisulo and other officials cleaned Chisokone avenue, one of the busiest streets in the city centre.

The exercise is an initiative of the Ndola Street Vendors and Marketeers Association who have now started cleaning the streets where they trade from.

The Provincial Minister also took part in a tree planting exercise in the city centre.

Mr Lusambo commended the Ndola Street Vendors and Marketeers Association for the initiative saying Government is also eager to work with people with progressive ideas.

“We are happy when we see people taking it upon themselves to work with Government. My office, the office of the P.S and the DC’s office are always open for people with developmental ideas, please come forward and together, let us build this great province,” Mr Lusambo said.

He added, “Cleanliness is next to Godliness. The rainy season is here so we have to keep our surroundings clean, including our trading areas if we are to avoid Cholera and other waterborne diseases.”

Government will not ration ARV drugs-Health Minister

3

The Ministry of Health says it will not ration Anti Retro-viral drugs -ARV- because the country has enough stocks.

Minister of Health Dr. Chitalu Chilufya disclosed this in an interview with ZNBC News in Lusaka.

Dr. Chilufya has since called on organizations dealing with HIV issues to openly dialogue with the ministry on their concerns instead of rushing to the media.

And Dr. Chilufya says the ministry has a strict policy of not procuring drugs with a short shelf life.

He says all drugs that are being bought for hospitals have a long shelf life with clear expiry dates.

Kambwili says President Lungu’s emphasis on diversifying the economy must be taken seriously

Chief Government Spokesman Chishimba Kambwili

Roan Member of Parliament Chishimba Kambwili says President Edgar Lungu’s emphasis of diversifying the economy must be taken seriously .

Speaking when he donated over 150 bags of fertilizer to his constituency in Luanshya, Dr. Kambwili urged Zambians to embrace the President’s call and begin to take agriculture as a business rather than a past time.

He said the donation of fertiliser is meant to enhace the agriculture sector in his constituency.

Dr. Kambwili said the distribution of seeds and fertilizer is one way of encouraging the community in his constituency to start practicing farming.

Dr. Kambwili who is also PF chairperson for sports is happy with efforts being made by small scale farmers in 14 cooperatives created since 2007 who have ventured in pig , chicken rearing and farming to continue .

And Dr. Kambwili has called for serious and dedicated investors in the mining sector.

He said mines must be handed over to proper investors who have the interests of Zambians at heart and the desire to help boost the economy.

And President Edgar Lungu has donated 250 thousand Kwacha towards the construction of the shelter at Chisokone market in Kitwe.

Presidential Affairs Minister Freedom Sikazwe, who handed over the money to Nkana Member of Parliament Alexander Chiteme in Kitwe, said the head of state wanted to see the shelter complete in two weeks.

Mr Sikazwe said President Lungu has further directed the Kitwe City Council to contribute the remaining 157 thousand Kwacha needed to finish the shelter.

He said the head of state has instructed the local authority to utilise the money it collects from marketeers at Chisokone market for the works.

Meanwhile, Kitwe Mayor Christopher Kangombe says council engineers will be on-site tomorrow to commence the works.

Mr Kangombe added that the structure is expected to be completed on schedule as directed by President Lungu.

And National Traders and Marketeers Association of Zambia President Goodson Mofya said the donation by the head of state will go a long way in alleviating the suffering of marketeers at the market.

Meanwhile, Association of Vendors and Marketeers in Zambia President Able Chikwa said the donation by President Lungu had proved his critics wrong.

Mr Chikwa said since the shelter collapsed two weeks ago, people were laughing at the marketeers and telling them that government had abandoned them.

Bank of Zambia should be commended for stabilising Inflation and Kwacha Exchange Rates

GOVERNMENT and the Bank of Zambia (BoZ) should be commended for fiscal and monetary policies that have stabilised inflation and exchange rates this year, says economist Lubinda Habazoka.

Dr Habazoka said in an interview that much as 2016 had been a tough year, with inflation and interest rates increasing, Government should be commended for its efforts to reduce the two variables.

He however said tight monetary policies should form part of austerity measures in 2017.

“Government and the Central Bank should be commended for fiscal and monetary policies that have stabilised inflation and exchange rates.

“But what we should not forget is that tight monetary policies are austerity measures in a way. When citizens are unable to access funds, it becomes difficult for businesses and households to get resources cheaply for their use,” he said.

Dr Habazoka explained that Government should not proceed with its planned “debt refinancing programme” in 2017 to avoid tougher measures in the future because bonds were better refinanced when they were about to fall due.

“More debt accumulation will cripple our economy. Another US$3 billion debt will see the Kwacha trade above K18 per dollar as we might struggle to find forex to service capital market debt.

“Government should also be very careful with the toll gates currently under construction,” he said.

He said the best austerity measure was to cut Government spending and not increasing tax.

Dr Habazoka said increased taxes mostly affected potential for small business owners.

He explained that households should have been given a relief on taxes to increase consumption of goods and services in Zambia because increased demand will lead to economic growth.

“As we enter 2017, there is hope that the Kwacha will stabilise as mining activities increase amid bullish metal prices spearheaded by Trump’s promise to increase infrastructure development in the USA,” he said.

GBV is the cause of broken families say Chipata Catholic Father

3

CHIPATA Catholic Pastoral Centre Director Fr Archangel Nkhata has said Gender Based Violence(GBV) was the major reasons for broken families.

Fr Nkhata said during Christmas mass at Saint Gabriel Mpezeni Parish in Chipata on sunday that marriages were breaking owing to GBV which was as the result of misunderstandings by the couples.

He said couples must dialogue whenever there was misunderstandings inline with the teachings of the Bible.

“When you differ in life sit down as a husband and wife to discuss in the sober way because most of the marriages are breaking as the result of gender based violence,”Fr Nkhata said.

CHIEF Nsamba of Lunga District in Luapula Province has appealed to the
Government through the Disaster Management and Mitigation Unit (DMMU)
to quickly consider replacing a new roof at Mandwe Primary School in
his chiefdom,as the old one was completely blown by heavy down pour
that was experienced in the area a few weeks ago.

The chief said if the situatation is not addressed it would affect
the learning process of great number of pupils at that school.

In a telephone interview from his palace over the weekend, the
traditional leader explained that the heavy rain which was
experienced in his chiefdom about a week ago had left a trail of
destructions to both trees and buildings.

But he said he was extremely concerned with Mandwe Primary School
whose the entire roof was blown off leaving all learning materials
completely soaked and damaged.

“A few weeks ago we had a very bad hailstorms, which left a lot of
destructions to crops and many houses of our people. But our major
concern and cry is the school, because this is rain season and if it
can remain without a roof, pupils will have no where to learn once
schools opened in January,”he said.

He said Mandwe Primary school which is a two by one Classroom block
was catering for a good number of pupils, saying that unless something
was done soon the School it would not be opened  and it will affect pupils.

“I visited the school and I can safely confirm that at the moment the
school has many problems. It needs new books and repair of a
roof, probably new iron sheets are needed there.

“The old roof was completely removed by the hailstorm and all iron
sheets were extensively damaged, this led to all learning materials
being soaked and damaged by the rains,”he said.

The chief stressed that Mandwe Primary School was a cardinal learning
institution in his chiefdom because even children from distant
villages were  being catered for.

MISA Dissociates itself from ‘Zambia Radio Awards’

The Media Institute of Southern Africa (MISA) distances itself from the recently held ‘Zambia Radio Awards’ at a shopping mall in Lusaka on Friday, 16th December, 2016.

It has come to our attention that award recipients were given an impression of the awards being organised in partnership with MISA, with some award recipients still awaiting certificates to be purportedly issued by MISA Zambia.

We are also in receipt of complaint letters from some of the award recipients regarding the award ceremony and adjudication process, with some of the recipients returning the awards presented to them.

At no point was MISA involved in the organisation or adjudication of the said awards as the only awards the institution runs are the annual MISA Zambia Media Awards, which are a flagship of the organisation held every year in April since 2002 at a national event which is widely publicised with transparent adjudication and partnerships with major stakeholders.

The institution therefore indemnifies itself from any alleged obligations as intimated by some award recipients given the false impression created at the Zambia Radio Awards.

We wish to call on all organisations looking to hold media awards to undertake serious consultations and partnerships to avoid sowing division and embarrassing the entire media fraternity in the country. In future, it will be important for the media fraternity to consider a comprehensive awards ceremony that encompasses all media awards ceremony as opposed to the current situation where some organisations still hold their own awards for a single category.

Our interest is the promotion of high standards in the media as a safeguard of the media’s public responsibility in the quest to promote and protect media freedom and the freedom of expression.

MISA remains open to collaborations for the 2017 Annual National Media Awards which cover over 20 award categories across print, radio and television. We therefore wish to call upon corporate, civil society and other organisations working in specific sectors to come on board and ensure their sectors are represented in the awards which aim to promote professionalism and excellence in the media industry.

Chairperson,

President Edgar Lungu has said that the Patriotic Front (PF) will go for the general conference when time comes and all leaders will re-contest their positions.

In an interview with ZNBC, the President said that PF is not like some parties that are insisting that they already have credible and reliable leaders and hence no need for elections.

President Lungu said that the general conference will give the party a new lease of life because democracy demands that elections are held after a specific period even at party level.

The President further said that the PF remains united and will not be distracted from its focus on development by people venting their anger and ambitions of taking over from him in 2021.

President Lungu said that he has heard sentiments from the media on the perceived friction in the PF which he says is a small element but insists that the party is united.

The President also told ZNBC news in an interview that Zambia was on course and has good leadership in place focusing on economic development and uniting the country.
