Civil Society alarmed at Inspector General of Police’s threats to arrest Doctors for attending a Zoom meeting

JOINT CSO PRESS RELEASE ON THREATS TO PROSECUTE ATTENDEES OF RESIDENT DOCTORS’ ASSOCIATION ZOOM MEETINGS

We, the undersigned civil society organisations (CSOs), note with great alarm a statement allegedly made by the Inspector-General of Police on 30th May 2021 threatening to prosecute attendees of Zoom meetings hosted by the President of the Resident Doctors’ Association of Zambia, Dr. Brian Sampa, on the basis that such meetings are illegal on account of Dr. Sampa allegedly having been suspended by the Health Professional Council of Zambia and are contrary to the Cyber Security and Cyber Crimes Act.

It is the position of the undersigned that neither the Health Professional Council Act nor the Cyber Security and Cyber Crimes Act criminalise attendance of online meetings addressed by an official who might or might not have been suspended. We therefore view the threat issued by the Inspector-General of Police as the continued attempt to curtail the constitutional freedom of association that citizens enjoy.

It is an abrogation of the citizen rights of expression and association that has been carried out for years in the in the physical space through the abuse of the Public Order Act. This suppression of both rights is now being transferred to the cyber space on vague and undefined grounds, as the undersigned CSOs warned would happen when the Cyber Security and Cyber Crimes Bill was being debated. We wish to remind the Inspector-General of Police that the constitutional right to freedom of assembly is guaranteed regardless of the platform. The powers of the police should not be used to intimidate citizens, especially ahead of the 2021 general elections.

We urge the members of the Resident Doctors’ Association to demand that the Police Service provide a specified legal basis within the Cyber Security and Cyber Crimes Act on which their right to assemble online is being threatened. The blanket claim of illegality and general threats of prosecution under the Act have no place in a democratic dispensation. We urge all members of the public to educate themselves on the Cyber Security and Cyber Crimes Act to avoid being taken advantage of by any person or authority. Finally, we urge the police to also educate themselves of this new law to avoid illegally enforcing it.

Again, we jointly remind the police that the constitutional rights of citizens be respected even when the exercise of those rights is inconvenient for government.

Resolve Doctors crisis-HH

12

UPND leader Hakainde Hichilema has called on the PF government to quickly resolve the doctors crisis.

Mr. Hichilema said Government must quickly address the concerns of Resident Doctors in order to avert a crisis in the delivery of health services in the country.

“We are concerned by reports that resident doctors are being threatened with arrests and intimidation, a situation which appears to be fueling the crisis instead of resolving it,” Mr Hichilema said.

“We are not being insensitive to the matter at hand, but we fear that if Government continues with its heavy handedness, the situation might get out of hand.”

He added, “We are aware that doctors fall under essential workers and are not unionized but this should not disadvantage them when they complain of unresolved issues. We expect authorities to give them a hearing so that industrial harmony is maintained.”

Doctors are demanding, among many other matters, the payment of salary arrears for 309 of their members, creation of positions for senior resident medical officers, registrars and consultants and recruitment of 500 graduate doctors who are currently roaming the streets without jobs.

Mr Hichilema has since called upon Labour Unions, the Civil Society and indeed ordinary citizens to speak out against such injustices saying doctors are workers, like any other worker and their plight should attract the interest of the Labour Movement and all stakeholders.

“The nation cannot expect the best from our doctors if they are subjected to frustrating conditions and such humiliation,” he said.

The UPND leader said the country is facing a serious health crisis through the ravages of Covid 19 and Government cannot afford to compromise the situation by fueling a go-slow among resident doctors when their plight can easily be addressed.

“It is saddening that with the high unemployment rate, political instability and the Covid-19 pandemic the country is facing, there is a looming go slow by doctors in our health system, and this is due to insincerity among those in positions of authority,” Mr Hichilema said.

“We implore Government to release funding in order to resolving the doctors’ plight and honour its obligations. Let us not set a precedent for other workers facing similar circumstances,” he said.

“I want to remind those in authority that if a Doctor is not in a proper disposition and is pleased with the conditions of service, that doctor cannot be expected to discharge his or her duties with utmost dedication.”

“Our fear is that thousands of innocent Zambians will be negatively impacted by the effects of this go-slow if the situation remains unresolved,” he said.

Mr Hichilema added, “I also urge the Labour Movement to help resolve this matter by applying their negotiation skills and ensure productivity levels in the health sector are maintained.”

Small scale farmers happy with 2021 maize price of K150 per 50Kg bag

The Small Scale Farmers Association has welcomed the floor price of maize which the government has announced for 2021 crop marketing season.

Government has pegged the cost of a 50 kilogramme (kg) bag of maize at K150.

Small Scale Farmers Association Director Noel Simukonda told ZANIS today that the price is good for the farmers who got subsidised farming inputs from the Farmer Input Support Programme (FISP).

Mr. Simukonda said the 2021 floor price will improve the income levels of about one million small scale farmers who accessed fertilizers and inputs through FISP

‘‘K150 is quite a good price and they will get some kind of profit,” he said.

He however observed that small scale farmers who bought unsubsidized inputs might not get the best profit out of the K150 floor price.

He has since urged farmers who benefitted from FISP to be patriotic enough and sell their farm produce such as maize, soya beans and rice to the Food Reserve Agency (FRA) since they got the inputs at a relatively lower price.

The FRA has announced that it will purchase a 50 kg bag of white maize at K150 in the 2021/2022 crop marketing season.

FRA Board Chairperson Kelvin Hambwezya said in Lusaka that the agency will also purchase a 50 kg bag of soya beans at K500 and 40kg of paddy rice at K200.

Mr. Hambwezya disclosed that the purchasing price of white maize has increased by 40 per cent from the previous crop marketing season and farmers will be paid as soon as they deliver the commodity to FRA.

He noted that that the agency’s prices will not disadvantage the private sector who are expected to purchase the larger share of the 3.6 million metric tonnes of maize.

During the 2019/2020 marketing season, the price of maize was at K110 per 50 kg bag.

PF Media Director calls for the dismissal of the protesting Resident Doctors

The Patriotic Front (PF) has called for the dismissal of the protesting Resident Doctors.

Party Media Director Antonio Mwanza has charged that the doctors have no justification to down tools as government has already paid what is due to them.

He says the PF government has continued to prioritize the health sector and will therefore not entertain the illegal strike from residents doctors.

And Mr. Mwanza has also disclosed that the PF has impeccable information that some Doctors are working with known opposition political parties to sabotage the government.

“We are extremely dismayed by the unprofessional and unethical conduct by the resident Doctors who have decided to go on strike even when government has met their demands,” he said.

The PF Media Director further added that it is shocking and unethical that the doctors have decided to go on a go slow and allow patients to die at their watch even when government has already cleared their arrears.

“When government paid them all the money they have now changed the narrative and now talking that government must pay other doctors and that government must
Change the condition of service for doctors,” Mr. Mwanza added.

Mr. Mwanza explained that the Resident Doctor’s Association of Zambia is not registered as a union to bargain for worker’s condition of service.

He charged that the PF will not allow unappreciative doctors who after being trained by tax payers money can down tools and allow patients to die on their watch.

Mr. Mwanza said it is the duty of doctors to protect lives and must not for any reason run away from their oath.

He has since appealed to government to take disciplinary action and dismiss all the Resident doctors who have gone on strike.

The PF Media Director charged that the country has a lot of doctors who not yet employed and are willing and ready to work for the people of Zambia.

Kanganja’s contract is about to expire without convincing proof of improvement

Zambia Inspector General of Police contract about to expire without convincing proof of improvement

On Wednesday, December 23, 2020, two civilians were killed in Lusaka as the United Party for National Development (UPND) leader Hakainde Hichilema appeared before the police to face police interrogation.

The incident forced Zambian president Edgar Lungu to make some changes to the Zambia Police Service command. The president sounded not not happy with then eroding peoples’ confidence in the Zambia police.

The Deputy Inspector General of Police Bonnie Kapeso was dropped. The Inspector-General of Police Kakoma Kanganja was given a six months contract to prove his competence.

According to president Lungu, Kanganja’s six months contract was to allow enough time for IG to transform the police and regain peoples’ confidence.

It was not an easy contract as the Inspector General would have to serve without fear or favor. Something that could not happen without offending the Patriotic Front (PF) cadres or even the president.

It could be a reason why the contract has entered its sixth month and IG Kanganja seem stack on the same spot. No change to show. If any, not enough to regain peoples’ confidence.

The just ended nonviolence nomination filing process for the upcoming August 12 election has earned the police a thank you from the opposition leader Hakainde Hichilema.

“Zambia Police, thank you for maintaining law and order during our nominations filing. Nkani Izibika. We shall not forget you Ku Canaan,” Hakainde posted on Facebook on May 20.

Again, the United Party for National Development leader Hichilema has just thanked police on his Facebook post:

“Special thanks to the police officers who were assigned to police our visit in Kanyama for the professional conduct they exhibited,” posts Hakainde to thank police for peaceful visit to Kanyama in Lusaka where he went to check on victims of PF cruelty.

It is a positive thing but not strong enough to overshadow the favor that PF cadres continue to enjoy from Kanganja and the police. Even when they act above the law in day light, Kanganja seem to ignore.

The ambiguity in the Zambian law has led to questioning of president Lungu eligibility to contest the upcoming August 12th elections.

The Legal Resource Foundation has taken the matter to court and is being represented by State Counsel John Sangwa.

Lusaka Province PF chairman Kennedy Kamba is not happy with Sangwa’s decision to represent the Legal Resource Foundation and has called for PF to treat him as a political opponent.

Sangwa takes it as a threat and many Zambians agree with him and are calling for police to act but in vain.

Threatening peoples’ lives is not free speech but a crime. Kanganja can’t be silence on Kamba’s behavior and expect to regain peoples’ confidence. His silence is proof of favoritism.

Zambian are very much aware that if Kamba was from the opposition, he would be in trouble with the police. Probably spend more than 48 hours in custody before appearing in court. Another area which Kanganja has completely failed to transform.

Covid-19 is another issue. The PF government is trying to use Covid-19 restrictions to stop the opposition from selling out their manifestos and Kanganja is openly trying to help actualize the plan.

The interesting part is that Kanganja wants to go the extra mile. PF is pushing to ban rallies and the Inspector General is pushing for Zambia to go into the August election without door-to-door campaigns!

Acting like he is not interested in winning public confidence.

Unfortunately, whether the Inspector General should go or stay after his contract expires is in the hands of president Edgar Lungu.

But still, it is possible to influence Lungu’s decision. Lusaka Times has a comment section. People should use it to help evaluate Inspector General Kanganja.

President Lungu expected in Luapula for a four days working visit

President Edgar Lungu is expected in Luapula province today for a four-day working visit.

Luapula Province Permanent Secretary Charles Mushota said during the visit, the Head of State is set to commission a fuel depot, two mini hospitals, inspect water projects and witness the official harvest of the Greenfield maize irrigation crop, among other developmental projects.

According to the programme, President Lungu is expected to visit Mansa, Kawambwa, Samfya, Lunga, Chembe, Milenge and Chifunabuli districts.

ICTs, a fulcrum of economic development-DC

3

Solwezi District Commissioner Rosemary Kamalonga has expressed confidence that the recent enactment of the three cyber related pieces of legislation will ensure that all citizens are protected online.

Ms. Kamalonga said the goal of government is to ensure that Information Communication Technologies (ICTs) become a fulcrum of economic development and a vehicle to drive Zambia towards attaining its developmental goals.

She said this is aimed at facilitating the country’s achievement of a knowledge based society as well as the vision 2030 which aims at transforming Zambia into a middle income country.

She said this in Solwezi yesterday in a speech read on her behalf by district administrative officer, Anthony Fulwe during a cyber awareness meeting organized by the Zambia Information Communication Technology Authority (ZICTA) for the members of the public.

“As government, we are positive that these laws will bring sanity in the way that internet is used in Zambia,” she said.

Ms. Kamalonga said the enactment of the three laws on cybercrime also shows how government is committed to promoting confidence, security and trust in consumers of goods and services in the cyber space.

She added that a clean cyber space is key to promoting e-commerce anchored on full citizen participation as espoused in the seventh National Development Plan.

She has since urged ZICTA to continue raising awareness regarding cyber laws because they are meant to benefit the Zambian citizenry.

She has meanwhile thanked ZICTA for the role it is playing in facilitating easy communication and making cyber space safe for members of the public.

And ZICTA Corporate Communications Manager Ngabo Nankonde said despite the much enjoyed benefits of information technology, there is need to enhance security in the platforms used when conducting transactions as well as build confidence and trust in the users.

Ms. Nankonde said this is why government enacted the electronic communication and transactions Act No. 21 of 2009 (the ECT Act), with a view of safe guarding citizens online and promote e-commerce.

“With time, technology advanced and more and more new cybercrime related issues started emerging and this piece of legislation became inadequate in addressing these challenges,” she explained.

Ms. Nankonde said it was against this background that the ECT Act No.21 of 2009 was repealed and replaced with recently enacted laws.

The recent laws are the electronic communication and transaction Act No. 4 of 2021, cyber security and cybercrimes Act No. 2 of 2021 and data protection Act No. 3 of 2021.

Law on inmates’ vacation not new-Commissioner General

Zambia Correctional Service Commissioner General Chisela Chileshe has clarified that the piece of legislature which allows inmates serving life sentences to go on a two-week vacation to visit their families has been in existence for over five decades.

Dr. Chileshe, who was the guest on Diamond TV programme dubbed ‘COSTA’ explained that the licensing of inmates is not a new law as it has been in existence since 1965.

He disclosed that no inmate has however been released under the licence since 1965.

“It is not a new law and nothing has changed, no inmate has been released under the license,” he said.

Dr. Chileshe revealed that the licensing of an inmate imprisoned for life has been enshrined for decades in the Prisons Act section 116.

He however clarified that not every prisoner qualifies for the 14 days vacation licence.

Dr. Chileshe has meanwhile refuted claims that the law of licensing is being amplified because of the forthcoming general elections.

The Commissioner General insisted that the piece of legislation has nothing to do with the election as it has been in existence since 1965.

“The licence for somebody imprisoned for life has been enshrined for five (5) decades in the Prisons Act section 116, it’s not just given to anyone but as prescribed by the statute. The license is not about elections it has been there since 1965,” he said.

He added that, “as far as we are concerned, the piece of legislature has never been used. The law has been in existence and it has just been carried over,” he said.

The news of releasing inmates on a two weeks vacation raised uproar among members of the public amidst concern of security.

China donates 100,000 doses of Covid-19 vaccine to Zambia

19

China has donated 100,000 doses of Sinopharm vaccine to Zambia that will benefit 50, 000 people. Ministry of Health Permanent Secretary for Technical Services Kennedy Malama disclosed the development when he gave an update on Zambia’s Covid-19 situation today.

Dr. Malama said the Chinese made Sinopharm vaccine has been approved for use on the Zambian population and is expected in the country soon.

He said the country has placed high priority on the vaccination agenda in light of the looming third wave of the Covid-19 pandemic.

“We are delighted that with the approval of the Sinopharm vaccine for use on the Zambian population, we anticipate to receive the 100,000 doses in due course pledged to Zambia by the People’s Republic of China and this will benefit 50,000 of our people being a two dose vaccine,” he said.

The Permanent Secretary assured Zambians that government is working hard to analyse the evolving epidemiological state of the pandemic and heighten the country’s response by making vaccines available and accessible to Zambians.

“Given the observed rise in our daily Covid-19 cases and our critical epidemiological analysis of the situation, it is clear that Zambia is entering the third wave and unless we ramp up our preventive interventions, the Covid-19 narration for our country may be so different in the coming weeks, a very undesirable situation indeed,” said Dr. Malama.

He stated that government will continue to cement its multisectoral approach in responding to Covid-19 by continually creating resilience in the health care systems in order to address other public health concerns in the country.

Dr. Malama further said government will continue to implement targeted testing as part of routine surveillance and case finding intervention, which in the last 24 hours has detected 213 new confirmed cases out of 3,642 tests conducted

He said the new cases have taken the cumulative number of confirmed cases recorded to date in the country to 95,263.

Dr. Malama said Lusaka, Eastern and Western provinces each recorded positivity rates of 11, 12, and seven, which are way above the World Health Organisation recommendation of five.

This indicates a higher transmission and likelihood of more people with Covid-19 in the community.

He said Lusaka recorded 130 new cases, followed by Eastern 21, Western 19, Southern 20, Central 13, North-western four, Northern three, Copperbelt two, and Luapula one while Muchinga recorded no new cases in the last 24 hours.

“The breakdown of the new cases and positivity (given in brackets) by province are as follows: Central 13 (3.4%), Copperbelt 2 (0.6%), Eastern 21 (12.3%), Luapula 1 (0.5%), Lusaka 130 (11%), Muchinga 0 (0%), Northern 3 (2.1%), North-western 4 (2.6%), Southern 20 (2.6%) and Western 19 (7.3%). With three of our ten provinces recording a positivity above 5%, this is indicative of higher transmission and that there are likely more people with COVID-19 in the community,” he said.

Dr. Malama also announced that three people, two from Levy Mwanawasa Hospital and one from Muchinga died in the last 24 hours from Covid-19 related deaths, taking the death toll to 1,281, with 721 classified as Covid deaths and 560 as Covid-19 associated deaths.

He said 204 discharges were recorded from both the Covid-19 isolation facilities and home management, bringing the cumulative number of recoveries to 91,956.

Dr. Malama said there are currently 2,026 active cases, of which 1,923 are under community management and 103 are admitted to Covid-19 isolation facilities.

He said in the last 24 hours, there were 17 new admissions and those presently in admission, 73 are on oxygen therapy and 13 in a critical condition.

The Permanent Secretary has therefore urged the general public to continue adhering to Covid-19 public health guidelines and measures of masking up, washing hands, maintaining physical distance, avoiding crowding and staying home and seeking medical attention early.

Voter education facilitators urged to up their game

Kalomo District Electoral 0fficer, Oswell Mpofu has advised voter education facilitators in the area to diligently apply themselves to ensure that eligible voters in this year’s general elections turn out in numbers to cast their vote.

Mr. Mpofu says this year’s election was crucial as many political players has come on board and urged stakeholders in the electoral process to carry out their duties diligently in order to gain public confidence.

“This year’s election is crucial, therefore some of you, as voter education facilitators must apply yourselves to the task on issues pertaining to elections in an effort to reduce voter apathy and the number of rejected ballot papers in the forthcoming elections,” Mpofu said.

The District Electoral 0fficer was speaking at the official opening of a five day voter education facilitators’ training workshop in Kalomo over the weekend.

Meanwhile, Kalomo district voter education committee chairperson, Elizabeth Kawaza has prodded voter education facilitators to abide by the electoral code of conduct.

Mrs. Kawaza says all facilitators should be non-partisan, objective and transparent in their conduct under their 60 days Electoral Commission of Zambia bondage when conducting voter education to the electorate in the 20 wards of Kalomo central and Dundumwezi constituencies in the district.

The Electoral Commission of Zambia ( ECZ ) has instructed to allocate two voter education facilitators in each ward country-wide to sensitize people on electoral issues.

Zambia has over Seven million eligible voters to participate in the August, 12, general elections.

For the first time, Zambia has more women positioned for the second highest position- VEEP.

Vice President Inonge Wina has commended political parties who have settled for female running mates ahead of this year’s August 12 elections saying it is a momentous step towards the attainment of gender equality in the country.

The Vice President noted that for the first time, Zambia has this year recorded the highest number of women positioned for the second highest position in the governance of the country.

“It is for the first time that we have had more positioned for the Vice Presidency, and this is commended,” she explained.

Mrs Wina was speaking during a meeting with traditional leaders in Chipata, where she also presented Professor Nkandu Luo as President Edgar Lungu’s running mate.

Mrs Wina said although the country still has a long way to go before it attains gender equality, the step taken by most political parties is a step in the right direction.

“We might still have a hundred more years to go before we are where we are supposed to be as a country, but we are headed there”, she noted.

Other than the PF fielding Professor Nkandu Luo as President Edgar Lungu as running mate, the United National Development Party is likewise fielding Mutale Nalumango as its running mate to its candidate Hakainde Hichilema, a fit that has elated a number of women movements and political players.

And Vice President Wina has expressed concern over the high numbers of candidates who have opted to contest as independent candidates after being ‘ ditched ‘ ahead of the August 12th elections.

She said is saddened with the development where Eastern province is leading with over 40 candidates deciding to go independent as a result.

“Eastern province is topping with about 43 candidates resigning from their respective parties to contest as independent members. This has been quite an issue and we are trying to ascertain why”, she questioned.

Meanwhile, the Ngoni Royal Establishment called on political players to avoid politics of insults, but to instead safeguard the peace of the country.

The Establishment’s representative Chief Madzimawe said peace is synonymous to development meaning there is no guaranteed of development in the absence of peace.

“You can only talk of development when there is peace because peace comes first. As such, we expect all political players to always be conscious of this fact and ensure they conduct themselves in a peaceful manner”, he said.

He further called on politicians to take heed of the covid-19 situation as they carry out campaigns ahead of the elections.

And Chief Mbangombe who represented the Chewa Royal Establishment commended government for embarking on various development projects.

Stating that people can attest to the development that has been recorded in the country, Chief Mangombe further commended President Edgar Lungu and the Patriotic Front (PF) party for the choice of a woman as the PF.

Zambia in Covid-19 third wave as new confirmed cases rise by 159% in one week

16

A Medical Expert in Zambia has warned that the Covid-19 third wave is now underway in Zambia.

Dr Francis Mupeta who is the Head of the Infectious Diseases Unit at UTH said the trend of new cases recorded in Zambia point to the start of a third wave.

Dr Mupeta said in the past 7 days, Zambia recorded an increase in the number of confirmed cases by 159% compared to the previous week.

He said deaths increased by 15% last week compared to previous week while the average number of hospitalization increased by 64% in the same period.

“If we look at Levy, the biggest treatment centre, the total number of hospitalised patients increased by 105% last week compared to the previous week while in the same period, patients on oxygen increased by 81% and the number of deaths by 50%,” Dr Mupeta said.

“If we compare the number of admissions at UTH and Levy in the same period, there was an increase of 57% in COVID-19 admission and a gigantic increase by 137.5% at Levy,” he said.

“Take together, we are not expecting resurgence, we have already reached resurgence thresholds in many parameters according to WHO guidelines.
In short, the third wave of COVID-19 has began.”
